A year ago, New York City Mayor Bill de Blasio came out in support of closing Rikers Island. Advocates had pushed to close the jail complex, with its well-documented history of violence. Then-New York City Council Speaker Melissa Mark-Viverito had made its closure a top priority, putting pressure on the mayor. In announcing his support, de Blasio said it would take a decade to close Rikers. The inmate population would have to be whittled down, with the help of reforms to keep people out of jail and others to move people through the system more quickly. Smaller jails would then have to be built in the boroughs. The mayor’s announcement was pivotal. What had seemed like a political and practical impossibility now had a path forward. Today, politicians are trying to outdo each other in suggesting shorter and shorter timelines to shutter Rikers. Yet obstacles remain. Will residents embrace new jails in their neighborhoods? Will lawmakers enact new reforms to reduce the inmate population? This week, we take a closer look at the current landscape, from the city’s proposed – and already existing – detention facilities to the circuitous pathways that lead people to end up at Rikers.

Latest MOLINARO MAKES IT OFFICIAL He originally declined to run. But a grass-roots campaign urged him to enter the race, and after racking up support from a number of GOP county leaders, Dutchess County Executive Marcus Molinaro launched his gubernatorial run last week. He has tentatively locked up the Republican nomination over state Senate Deputy Majority Leader John DeFrancisco. Molinaro started out in an assertive stance, calling Cuomo “corrupt,” “corrosive” and “argumentative.”

In a surprise announcement, Gov. Andrew Cuomo, state Senate Minority Leader Andrea Stewart-Cousins and Independent Democratic Conference leader Jeff Klein announced the state Senate Democrats would immediately reunify and the IDC would dissolve. According to the plan, Stewart-Cousins would lead the conference with Klein as her deputy. Originally, there had been talk of reunifying after the April 24 special elections. If Democrats win both seats up for grabs, they would technically hold a 32-seat majority. As it stands now, bringing the IDC back in the fold would leave Democrats in the minority with 29 seats, since Democratic state Sen. Simcha Felder separately caucuses with the Republicans.

The

UNARMED BLACK MAN KILLED BY NYPD New York City police officers shot and killed an unarmed, mentally ill black man in Brooklyn on Wednesday after mistaking a pipe he was holding for a gun. State Attorney General Eric Schneiderman’s office announced that it would investigate the shooting of 34-year-old Saheed Vassell. Officers were responding to a 911 call when they said Vassell took a “shooting stance” and pointed the object at them, but one witness said officers never told him to drop the item.

C&S: The WFP supports reunification, but you’re also continuing to support primary challengers to members of the IDC. Do you think there is a dissonance there? BL: No, I don’t. It was the pressure of these insurgent candidates whom we have been supporting that has produced this outcome. But there’s still tremendous frustration about how the Democratic Party in New York state, exemplified by these eight IDC incumbents, has put their donors and alliances with the Republicans ahead of standing up and fighting for working families. And there’s so many examples of that, from criminal justice reform, to protecting immigrants, to climate legislation, to strengthening our rent laws, to fair funding for education. Time and time again, the Republicans have blocked these bills from becoming law, and the IDC-Republican coalition has blocked these things from becoming law. And I was there in 2012

when we worked really hard to retake the Democratic majority, and we had 33 votes, and the IDC stepped in and took it away from us, and gave it to the IDC-GOP coalition. So after that move, there were six consecutive budgets – six years – where all these things were blocked. And of course these things were DOA because the people in charge who controlled the gavel were people who are currently supporting Donald Trump. C&S: Cynthia Nixon said, “If you’ve set your own house on fire and watched it burn for eight years, finally turning on a hose doesn’t make you a hero.” What’s your response to that? BL: No comment. Look, in terms of the governor’s race, the 232 grass-roots members of our state committee will be meeting and they have an important decision to make.

THE IDC DEAL Will Jeff Klein & Co. actually rejoin the Democrats? By GRACE SEGERS and FRANK G. RUNYEON

IT WAS DÉJÀ VU all over again: the Independent Democratic Conference and the mainline Democratic caucus in the state Senate appeared ready to reunite. Like President Jimmy Carter brokering peace in the Middle East, Gov. Andrew Cuomo shepherded a deal between state Senate Minority Leader Andrea Stewart-Cousins and IDC leader Jeff Klein. Under this arrangement, Stewart-Cousins would be the leader of the Democratic conference, and Klein her deputy. However, this isn’t the first time the schismatic Democrats have attempted to reunite – nor is it guaranteed to work.

Cuomo pressures the Democrats NY1’s Zack Fink reported on Tuesday that Cuomo was holding a “Democratic unity” meeting at The Capital Grille in Manhattan, with attendees including Stewart-Cousins, Klein and influential Rep. Joe Crowley. Cuomo asked Klein and Stewart-Cousins to reconcile immediately, instead of following the previous plan for reunification, which involved rejoining the two caucuses if the Democratic candidates won the April 24 special elections for two state Senate seats. The New York Times report-

ed that the two legislative leaders shook hands after the meeting, with attendees applauding the made-for-TV sight of New York politicians making an ad hoc deal in a steakhouse. The three officials – Cuomo, Klein and Stewart-Cousins – appeared at a Wednesday press conference in Manhattan to officially announce the news. The Cynthia factor The timing of the deal was a bit suspect. The state budget was finalized days earlier under the current arrangement, in which the eight IDC members have a

power-sharing agreement with state Senate Republicans, who are just one seat shy of a 32-seat numerical majority in the 63-member body. Renegade Democratic state Sen. Simcha Felder also separately caucuses with the Republicans. Stewart-Cousins was not included in this year’s budget negotiations. Cuomo has also been just fine with the arrangement for years. Politico New York reported in 2014 that he had condoned the creation of the IDC in 2011, and even encouraged its formation. He reportedly privately advised leaders of the new coalition of the IDC and the GOP when the two joined forces in 2012, after Democrats had achieved a numerical majority in the state Senate. Publicly, the governor professed neutrality, saying “they’ll pick their leadership themselves” and “I have no intention of getting involved in either situation” when the coalition plan was discussed. In 2014, the Republicans gained an outright numerical majority, and Klein’s IDC continued as a separate conference that worked with the GOP. Whether or not Cuomo has been actively involved in maintaining the power-sharing agreement between the IDC and the GOP in the state Senate, he has allowed it to continue. One key difference this year is that Cuomo is facing a high-profile primary challenger who has criticized him for being insufficiently progressive – and he is widely seen as a potential presidential candidate in 2020 as well. This year, Cynthia Nixon, the actress and activist, is challenging Cuomo from his left flank. After primary challenger Zephyr Teachout received nearly a third of the primary votes in 2014, Cuomo may be wary of an opponent with higher name recognition and a credible argument that he has not done enough to support Democrats in the state Senate. Nixon has already needled Cuomo for condoning the IDC. She has also criticized the exclusion of Stewart-Cousins from budget talks as part of her strategy of persuading black women to vote for her instead of Cuomo. By rushing a plan for unification, Cuomo is displaying a commitment to Democratic ideals and key demographics. On Wednesday morning, Nixon’s campaign sent an email that said, “If you’ve set your own house on fire and watched it burn for eight years, finally turning on a hose doesn’t make you a hero.” The email continued by presenting several news articles describing Cuomo’s dealings with the GOP and the IDC as evidence of “Andrew Cuomo, the Republican.”

The Simcha factor Assuming that the IDC and the Democrats do actually unite, and assuming that the Democrats win the two seats in the upcoming special elections – two big assumptions – the Democrats may still face hurdles to obtaining a majority. First, there is the parliamentary issue of electing a majority leader. Under current Senate rules, chamber leadership can only be changed by a vote of 38 senators, meaning that even if the IDC and mainline Democrats joined forces, they would not have enough votes to unseat current Senate Majority Leader John Flanagan. This could mean that the minority party leads the chamber until at least 2019. (There is also the question of whether Klein would go gentle into that good night and allow Stewart-Cousins to be the sole leader, after so many years of holding power over his own conference.) More critical, however, is the one-man disrupter, Felder. The Brooklyn state senator most recently held up negotiations over the state budget while arguing for more relaxed state education requirements for yeshiva schools. If both Republicans and Democrats have 31 members in their caucuses, Felder – who had previously called for the IDC and the Democrats to reunify but has been noncommittal about his own allegiance – becomes even more influential. Both caucuses would be vying for his vote. Flanagan expressed confidence this week that Felder, and the IDC, would maintain their relationships with the Senate GOP. Felder told City & State that he would wait until after the April 24 special elections before he would make a decision. “I don’t feel compelled to stay and I don’t feel compelled to leave,” Felder said Wednesday afternoon as he searched a store for Kosher for Passover yogurt. “It’s best for my constituents not to do anything until the elections.” He added: “As someone with no allegiance to either party, I’d have to be an idiot to do anything now. How do my constituents gain? There’s an election coming up in a few weeks. So, either the Republicans win and I’m 33 – and it certainly doesn’t make sense for me to move at that time – or the Democrats win both seats and we’re back to the horse-trading that we talked about before.” Primary problems Cuomo isn’t the only one facing a potentially tricky primary this year. Seven of the eight IDC members are facing prima-

ry challenges, with each opponent contending that the IDC is not progressive enough for an overwhelmingly blue state. If reunification occurs immediately, it waters down the primary argument that IDC members need to be unseated in order to regain and retain a Democratic majority in the state Senate. However, the primary challengers aren’t going down without a fight. Like Nixon, their message seems to be “too little, too late.” The seven candidates wrote an open letter to their opponents on Wednesday morning, criticizing a string of “Republican budgets thanks to the IDC’s continued support for Republicans,” and blaming them for allowing budget negotiations to occur without Stewart-Cousins this year. The candidates outlined ways in which the budget was insufficiently progressive on issues such as criminal justice reform and gun control, and warned that “we will not allow you to mislead New Yorkers with claims of unity.” We’ve been here before As dramatic as the deal and its extenuating circumstances may seem, advocates of Democratic unity may want to wait before breaking out the champagne. In 2014, Klein and Cuomo released a statement saying that the IDC would rejoin the Democrats after that year’s elections. That deal failed to materialize after Republicans won an outright majority. Despite his refusal to rejoin the mainline caucus, in 2015 Klein was invited by Cuomo to the negotiating table for the state budget. Klein also seems to be pleased with the current arrangement. In previously unpublished quotes from an interview with City & State’s Frank G. Runyeon in October 2017, Klein said that he thought the arrangement between the Republicans and the IDC “just works well.” “If 32 of us all magically just came together tomorrow, we wouldn’t have enough votes to codify Roe v. Wade, we wouldn’t have enough votes as Democrats to do the contraceptive bill, we wouldn’t have enough for GENDA,” Klein said about the potential for Democrats to reunify. He continued that he didn’t “see us ending the IDC.” “I like bringing funding to my district,” Klein said. The power-sharing arrangement perhaps gives him more influence in the state Senate than he would have if he were a member of a unified caucus. This political calculation could be a reason for why a potential deal could fail.

WHY IT COSTS SO MUCH TO BUILD ANYTHING IN NEW YORK CITY $70 an hour for a “coffee boy”? Construction unions aren’t corrupt – they’re broke

THIS WINTER, New York has had two major construction scandals. In March, a subsidiary of Related Cos., the giant real estate firm building out much of the Hudson Yards site on Manhattan’s West Side, sued construction unions, alleging that they inflated costs by more than $100 million, including fooling Related into paying up to $70 an hour for someone who fetches coffee. Weeks before that, state and local law enforcement officers raided the offices of Bloomberg LP, looking for evidence that construction firms defrauded the former mayor’s financial firm and other victims by another $100 million. Fraud, of course, is a deadly serious matter. But at least fraud is illegal, so it can be stopped once it is found. The bigger problem pushing up New York’s construction costs – not only at office buildings, but also

at government entities like the Metropolitan Transportation Authority – is what’s legal. It’s also part of the nation’s looming pension and health care retirement crisis, and it is much harder to fix. Few New Yorkers care if Bloomberg or Related have to pay more for prime office and residential buildings. But high construction costs affect public infrastructure too. MTA projects are vastly more expensive per mile of track than in comparable cities. The Second Avenue subway cost about eight times as much as recent subway extensions in Berlin and Paris. One reason for the high costs and extra time has become obvious in the past few years: inefficient work practices. As this author noted nearly three years ago, because of inefficient union work rules, New York transit projects often require 25 workers

on a tunnel boring machine, when as few as five are necessary in Western Europe. When a tunnel worker in New York makes $118.85 per hour in wages and benefits, as required by the state’s prevailing wage law, that’s a lot of wasted money. There’s nothing wrong, of course, with paying a highly skilled construction worker a wage that’s sufficient to live on in an expensive city. There are just often too many such workers for a particular job. So it would seem obvious that the answer is to eliminate overstaffing. The industry is already gingerly moving toward having robots take over some construction jobs, particularly the less skilled ones. A robot can already do some crude bricklaying work, and the MTA is experimenting with an automated mechanism to replace workers doing some of the simplest track work.

But construction unions resist any changes to work rules not because they are corrupt or irrational, but because they have a big problem. Their retirement funds, which they administer themselves, are in crisis. They need new, young workers to keep paying into these broke funds in order to support the benefits of older, retiring workers. The average tunnel worker’s hourly pay is $65 an hour in wages, while the remaining nearly $44 an hour is in pension and health benefits. As the Empire Center for Public Policy’s E.J. McMahon’s recent report noted, 25 of New York’s top construction union pension funds have racked up a $12 billion collective deficit, endangering the benefits of nearly 188,000 workers, retirees and their beneficiaries. Project developers, from the MTA to private high-rise builders, must also pay ever-higher health premiums on behalf of union workers to keep pace with the constantly escalating cost of health care. Speaking of the state’s prevailing wage law, McMahon’s report noted that the hourly benefits payments it requires, in particular, provide a bailout of underfunded union pension and retiree health care plans. Consider, for example, the Ironworkers Local 580 union, whose members do work on bridges and other major structures. It has a pension fund in “critical status,” which the fund had to certify to the U.S.

Treasury Department. In October 2016, the union’s pension fund was on track to be insolvent by 2025, putting the retirement of nearly 1,000 people at risk. “For each active participant in this plan, there are approximately 35 inactive participants receiving benefits or entitled to future benefits,” according to the union letter. As the number of current workers shrinks, the pension bill per current worker grows. Fiscal watchdogs have been warning for years that pension and health care funds in the public and private sectors would become unsustainable, causing upheaval and uncertainty for millions of retirees and older workers around the country. Both government and the private sector must crack down on overstaffing, perhaps devoting a portion of the money saved from more efficient work to making increased payments into broke pension funds. They can’t do much about pensions without causing pain: A dollar less in a pension is a dollar less in a pension. But they can tackle the rising cost of health care. Large and rising health care costs plague not just the private construction unions that the MTA and other government entities depend on to do much of their construction work; it’s a problem internally at the government authorities as well. The MTA’s health care costs will top $2 billion next year for the first time, nearly twice what they were in 2005 in inflation-adjusted dollars.

In January, Amazon, JPMorgan Chase & Co. and Berkshire Hathaway Inc. got together to use their “extraordinary resources” to try to tamp down health care costs for their own employees. But such costs are even worse in the public sector. Government and union construction workers routinely retire, while retaining their health benefits, before the age of 65 when Medicare kicks in. The New York state and city governments have the same “extraordinary” resources that these three companies have, in terms of the massive size of their workforces and the potential to experiment across a mass scale with better health care practices. New York City’s government alone has more workers than JPMorgan Chase. On the national level, some proponents of cutting costs advocate for a single-payer system, such as in the U.K. and most of Europe, which would give the government bargaining power with health care providers. New York state and city governments and the MTA are already single payers on behalf of their massive workforces. They’ve just failed to use that existing bargaining power to lead the way in cutting costs. As long as we continue to treat our infrastructure and other big construction projects, from subways to union-built office buildings, as a funnel for massive health care payments, we won’t get better, cheaper infrastructure.

ost people caught drinking a beer in Central Park aren’t sent to Rikers Island – but it’s possible. And most people accused of murder aren’t allowed to walk free – but that’s possible too.

New York City’s criminal justice system is rigid and rule-based in many ways, but every player in the system makes some choices – for example, police officers can often choose whether your is infraction is worth a ticket, or if it’s best to let you off with a warning. New York City Mayor Bill de Blasio’s administration, like many other criminal justice stakeholders, is hoping to leverage these choices to reach a specific goal: lowering the number of inmates held in New York City jails in order to close the Rikers Island jail complex by 2027. In 2017, some 77 percent of the 9,100 average daily inmates in city jails were pretrial detainees. So if fewer people are arrested, or more people who are arrested could be diverted out of the system in other ways instead of awaiting trial in jail, fewer people would have to experience what an independent monitor of Rikers Island called a “culture of violence.” And de Blasio could achieve his goal of “smaller, safer, fairer” jails. New York’s already making progress. Manhattan District Attorney Cyrus Vance Jr. recently announced that his office would decline to prosecute most cases of turnstile jumping, leading to an immediate drop in arrests. Nonprofit bail funds will pay bail for certain defendants – like those accused of misdemeanors who have no other options for paying their bail. And after a delay of a year and a half, the de Blasio administration plans to allow defendants to pay bail online, saving their friends and family members the hassle of paying bail in person, and thus getting inmates out of jail faster. And fewer people are getting arrested to begin with. New York City police made 240,000 arrests last year. It’s an incredible number – an average of 657 a day. But it’s the fewest the city has seen in years. As recently as 2011, the city arrested 337,000 people – 40 percent higher than last year. But New York City still has a long way to go. We researched the process of getting arrested and charged in the five boroughs, with help from visits to Manhattan Criminal Court and interviews with a court clerk and attorneys from the Legal Aid Society. We then created a chart where you can follow what could happen when somebody is stopped by the police in New York. Like the “Choose Your Own Adventure” series of books, you’ll be able to see the options different players have throughout the process, and just how many steps it takes to get from the street to a jail cell on Rikers Island. Yes, most people caught drinking a beer aren’t sent to Rikers. In fact, the most common reason for arrest in New York is alleged misdemeanor larceny, such as shoplifting. But there are endless ways to end up in jail, and – once you’re in the system – many ways to avoid it, too. Follow along.

The New York City Council members who are letting the city build or expand new jails in their districts were showing New Yorkers “something very powerful,” Mayor Bill de Blasio said in a Feb. 14 press conference. “You’re showing them political bravery, and a devotion to something bigger.” That “something bigger” may as well have referred to the criminal justice system’s citywide footprint. There are at some 32 different facilities across the city where people are incarcerated in one form or another. These range from city jails on Rikers Island to halfway houses where federal inmates can ease back into society. While the discussion of new jails inevitably leads to cries of “not in my backyard,” jail facilities may already be in more “backyards” than you think – and that’s not even counting the 77 NYPD precincts where arrestees are taken and held for hours at a time. So as the de Blasio administration moves toward closing Rikers Island, we mapped all the locations in the five boroughs – city, state and federal; juvenile and adult – where people are getting locked up as well as the courts where arrestees are processed.

And of course, there’s the professorial figure played by J.K. Simmons who tells tales of unlikely disasters enshrined in a Hall of Claims – with Farmers Insurance Group inevitably coming to the rescue. Entertaining or not, insurance itself plays an essential role – and one that is increasingly important in today’s society. Innovative technologies are ushering in everything from smartphones to drones to ride-hailing services and self-driving cars – all of which bring both opportunity and risk. Our increasingly interconnected digital world also allows insurers to become more efficient. And the industry itself is constantly evolving, with new rules and regulations introduced all the time. Health insurance was a major target in the state budget negotiations this year, including a proposed windfall tax on health insurers and a tax on health insurance conversions. But as lawmakers debated those proposals in Albany, the state still faced a number of other insurance issues – some of which were addressed as part of the budget talks, and some that weren’t. Here are five key legislative and regulatory issues affecting the state’s insurance industry. By REBECCA C. LEWIS

MEDICAL MALPRACTICE

Doctors and hospitals in the state pay out more in medical malpractice suits than anywhere else in the country, including nearly $618 million last year, according to a report from Diederich Healthcare. And the costs may increase even more due to a bill signed into law in February, critics say.

Lavern’s Law, which was opposed by many doctors and hospitals, makes it easier to file medical malpractice lawsuits in cancer cases that had been initially misdiagnosed. It extends the statute of limitations and starts the clock at the time the misdiagnosis was identified, rather than when the

mistake was made. The bill that passed is a scaled-back version of the original. Since the governor signed the bill into law early this year, medical malpractice costs in the state are not attributable to it, and the longterm effects on payouts are unclear. “There is absolutely no evidence that medical malpractice recoveries are disproportionate to the injuries victims receive at the hands of a very few irresponsible medical professionals,” said Assemblyman Kevin Cahill, chairman of the Insurance Committee. “The real issue is how we and the medical profession can work together to make health care even safer.” But members of the business and medical community fear that in the coming years, Lavern’s Law will drive up costs and liability for doctors while also having a detrimental effect on access to care due to doctors’ fear of litigation.

HEALTH INSURANCE In his executive budget, Gov. Andrew Cuomo proposed a windfall tax on health insurers in the state who benefit from corporate tax cuts under the federal tax law, as one of his “revenue raisers” to close a $4.4 billion budget shortfall. The measure was opposed by politicians on both sides of the aisle as well as the health insurance community and budget experts. The proposal did not make it into the final budget deal, but another another one of his proposals did – the tax on the conversion of nonprofit health insurers to for-profit. The measure specifically targets the sale of Fidelis Care to Centene Corp., which was already in the works before Cuomo announced his initial proposal. The conversion is expected to generate a total of $2 billion in revenue over four years, including $1 billion in the first year.

PRINCIPLE-BASED RESERVING FOR LIFE INSURANCE

DISTRACTED DRIVING

In 2009, the National Association of Insurance Commissioners introduced a set of guidelines on how to calculate life insurance reserves, known as principle-based reserving. The NAIC officially adopted the method in 2017, giving states until 2020 to change their laws to allow principle-based reserving so those states can keep their accreditation. Mary Griffin, president and CEO of the Life Insurance Council of New York, said the method is a far more flexible and less formulaic way to calculate life insurance reserves than previous methods, which could cut costs for some consumers. She said that right now, New York is one of only two states that have not passed principle-based reserving laws. Griffin said enacting the change is not controversial, but it is complicated. She sees New York’s slow pace as lawmakers doing their due diligence to read through and understand the aspects of the method before passing any legislation. “New York tends to take a longer time (to) review anything that the NAIC comes out with, so I think it was just a question of taking a longer time to review it,” Griffin said. “The Department (of Financial Services) did have a bill that they introduced into the Legislature last year and it passed in the Senate, but in the Assembly, it was such a complicated issue, they wanted to have more time. So we’re hopeful that this year, the Assembly and the Senate will both take it up.”

Despite new safety features and technology in cars, traffic fatalities have risen in recent years – including in New York state, where traffic deaths rose sharply in 2015, by 7.7 percent. Nationwide, 3,450 deaths were attributable to distracted driving in 2016, or roughly 9 percent of all traffic fatalities. The New York Insurance Association is pushing for new legislation to decrease those numbers and make the roads safer. The bill, known as Evan’s Law, would equip police officers with “textalyzers” that tell the officers how recently a mobile device was used at the scene of an accident. Ellen Melchionni, president of the New York Insurance Association, said this legislation was a first step. She hoped that down the road, textalyzers would be used not just at the scenes of accidents, which Evan’s Law would restrict the device to, but also at traffic stops the way breathalyzers are. “I think society is slowly getting to the point where they don’t want to tolerate it anymore, just like with drinking and driving,” Melchionni said. “It took a while to change opinion about that until the numbers got to where they were and we made it very public about how many lives were lost and how dangerous it was with drinking and driving. This is very, very similar.”

TITLE INSURANCE New York state last year finalized new regulations on title insurance and the state Department of Financial Services implemented them in February. But those new regulations have been sharply criticized by the title insurance industry, which filed a lawsuit soon after the rules went into effect to reverse them, claiming they would “wreak havoc.” The state Senate included language in its one-house budget proposal that would have rolled back some of the new restrictions, but that did not make it into the final budget. State Sen. James Seward sponsored a bill, co-sponsored by Cahill in the Assembly, that he said would “clarify the law” and prevent “regulatory overreach” by DFS. He said the new regulations “prohibit a title agent from being able to buy a cup of coffee for a client, or host a lunch,” which he said are normal business practices. “As the sponsor of the original legislation which recognized title insurers as a regulated profession under the insurance law, I know the (state) Legislature did not intend for common marketing activities to be prohibited, and my bill will expressly clarify the legislative intent,” Seward said.

C&S: Bill S6704, regarding title insurance, has been criticized. Why do you think this bill is necessary? JS: Title insurance is an important industry employing thousands in New York state. I do not want to see punitive regulations employed simply because of a few bad actors or sensationalized cases. This legislation would clarify the law and stop the Department of Financial Services from what I view as regulatory overreach. Title insurance differs greatly from typical insurance products. Agents do not advertise directly to consumers, instead, they rely on inter-

personal relationships, common in the general business economy. The new DFS regulations would prohibit a title agent from being able to buy a cup of coffee for a client, or host a lunch – normal business practices. Regulation 208 could limit competition, and result in several insurers leaving the New York marketplace. C&S: What is being done in the state Legislature to address distracted driving? JS: One initiative being explored is the use of new technology to increase enforcement related to distracted driving. Last July, the governor directed the Traffic Safety Committee to study new “textalyzer” technology that is specifically designed to detect if a cellphone was used moments before an accident. I know there are questions regarding the constitutionality of the proposal, and I am interested in evaluating the committee’s findings.

C&S: Why do you think Bill A8467, on title insurance, is so highly criticized? KC: More than any other single insurance topic, Assembly members from across the state have brought the concerns of their constituents regarding title insurance regulation to my attention. While some would attribute the currency of the issue to heavy industry lobbying, it is clear, instead, that the disruption caused by regulatory overreach has impacted stakeholders in every phase of real estate transactions. C&S: In the state budget, Cuomo proposed a wind-

fall tax on health insurance providers. Is that still under discussion? KC: The health care windfall tax proposal was a misguided approach to what is a much more serious financial situation faced by the state due to changes in the federal tax code. My colleagues and I rejected the 14 percent tax on health insurers in our one-house budget. Ultimately, the proposal was not included in the final spending plan. C&S: What’s the latest on “principle-based reserving” for the life insurance industry?

KC: We are getting close to a solution that will provide the Department of Financial Services with the tools they need to implement principle-based reserving while having necessary legislative checks and consumer protections in place. Existing proposals by DFS would remove legislative guardrails from an essential part of solvency protection for the life insurance industry. We are in earnest negotiations to build a framework for a responsible realignment of asset consideration while providing the flexibility necessary to the industry and regulators in a global marketplace.

THE INSURANCE INDUSTRY doesn’t have a reputation for disruption and innovation, but that may be changing. Modernization and technology are already altering the way insurers provide their services. Not only do websites and apps allow consumers to compare services from different companies, which can increase competition, but the industry is also confronting the emergence of self-driving cars and the expansion of online services. As the pace of innovation quickens, insurers and legislators are trying to catch up to these changes in a moment that could define the future of the industry. The insurance industry is reacting to the introduction and expansion of ride-hailing services. The state passed a law last year that allowed companies like Uber and Lyft to operate statewide, excluding New York City which had already established regulations on ride-hailing services. State lawmakers required ride-hailing companies to provide $1.25 million in vehicle liability insurance whenever a customer takes a ride. Autonomous vehicles have also been in the public eye due to high-profile accidents, which has led drivers, companies and lawmakers to ask whether self-driving cars are safer than having humans behind the wheel. The state budget extended a testing period for self-driving cars until April 2019. To participate, companies need to meet state and federal requirements and have a $5 million insurance policy, which has also prompted companies to develop new types of insurance. Insurance companies also have increasing opportunities to adopt new technology to improve how they do business. Another key aspect of modernization is consumers’ increased access to information and the shift in demanding a greater level of responsiveness from their insurer. “A goal of the insurance industry is to increase financial literacy of our policyholders, and we believe one key component of enhanced education is providing the information in a form that is easily accessible on an individualized basis,” said Ellen Melchionni, president of the New York Insurance Association, a trade group. Allowing information about plans to be sent electronically, which is not allowed in the state, would reduce costs for insurance providers. Melchionni said the industry faces resistance from regulators. “Despite more and more customers wanting information available through the internet and apps, there is a hesitancy on the part of regula-

tors and legislators to allow companies to use modern means of communicating with customers,” she said. “The inclination by many public policymakers is to instead continue to use paper and mail as the primary forms of delivery.” The most recent bill that deals with the electronic delivery of insurance information is sponsored by state Sen. James Seward, the Insurance Committee chairman. It would allow insurers to electronically deliver insurance notices and post policies online with policyholders’ consent. A previous version of the bill was vetoed by the governor in 2016. Assemblyman Kevin Cahill, who chairs the Insurance Committee, said he too is focused on ways the industry can take advantage of new technology. “For example, we allowed for domestic mutual life insurance companies to offer their policyholders the option to vote during uncontested elections and to send board meeting notices electronically,” Cahill said. “This was a commonsense measure that up until recently was not allowed.” The health insurance industry has also seen the need to adapt. Leslie Moran, senior vice president of the New York Health Plan Association, said insurers have begun to invest in ways to improve communication and individualize services. This can be done through various methods: Insurers are investing in new apps to schedule appointments, online cost calculators and even holding medical appointments online or via smartphones, which may increase policyholders’ access to doctors and nurses and get patients more involved in their care. Moran also noted the importance of protecting customers’ information that is stored online. “Every time you expand your use of technology, you’re also increasing the potential risk of that data becoming compromised,” Moran said. As more and more services are provided online, there is a stronger need to secure information and avoid leaks and data breaches. In 2016, the Independent Insurance Agents and Brokers of New York, New York Insurance Association and the Professional Insurance Agents of New York created guidelines to combat security breaches. The state Department of Financial Services also updated its cybersecurity regulations for financial institutions to require the establishment of a cybersecurity officer, the use of multifactor authentication and the establishment of an incident response plan.

JS: The Senate Insurance Committee just recently passed my bill (S427) that would clear the way for peer-to-peer personal vehicle sharing. Car sharing, as it is known, would provide a number of economic, environmental and transportation benefits. I am also working on a bill (S2526) that would allow all insurance notices and documents to be delivered electronically with policyholder consent. You would think this would be common sense in today’s electronic world; however, current law requires documents or notices be “mailed.” Several consumer safeguards are built into the legislation, which mirrors similar laws already in place in at least 13 other states. Finally, I am awaiting a report concerning autonomous cars. Last year’s state budget authorized demonstrations and tests of the burgeoning technology with strict oversight by the DMV and the New York State Police. A report is due by June 1, and I look forward to evaluating the findings.

C&S: What is your committee doing to keep up with the creation of new, modern ways of providing insurance services? KC: The intricacies of insurance administration, as a new technology, had our attention. For example, we allowed for domestic mutual life insurance companies to offer their policyholders the option to vote during uncontested elections and to send board meeting notices electronically. This was a common-sense measure that up until recently was not allowed. We also continue to work with stakeholders and our sister states to deal with an array of cybersecurity issues. While not a “new, modern way of providing services,” the reality of climate change presents new and modern challenges. The committee has been focused on assuring that companies provide fair, prompt payment that customers expect following natural disasters. With Superstorm Sandy and the recent surge of extreme weather, we are actively advancing legislation to clarify existing law and protect customers during times of crisis. One example is a bill I carry in the Assembly (A391) that creates standard definitions for commonly used terms and phrases found in homeowners’ and commercial line policies. Consistent definitions for terms such as “utility disruption” or “hurricane trigger” will give policyholders peace of mind, knowing that their policy should be interpreted the same way as their neighbor’s following a natural disaster.

C&S: DFS recently passed cybersecurity regulations. What are the next steps? MV: New York’s landmark cybersecurity regulation passed the one-year mark (on) March 1. Feb. 15 was the date for the first certificate of compliance deadline under our regulations. We believe our regulation has gone a long way to improve safeguards for New York’s financial services industry, and it has led to the NAIC adopting a model law that is based on the DFS regulation.

MV: DFS conducted an extensive investigation and discovered alarming industrywide practices that violated New York’s anti-inducement law. DFS issued two regulations following two extensive comment periods prior to the final title insurance regulation going into effect. These actions resulted in a regulation that addresses affiliate transactions and unlawful inducements. The regulations leveled the playing field to protect consumers and lower closing costs.

C&S: What are the department’s main concerns when it comes to title insurance?

C&S: Are there any particular challenges related to virtual currency?

MV: Once again, New York is the leader in a new, innovative market that also presents risks. After thorough review and a public hearing, New York finalized the virtual currency licensing regulation, which adds to existing licensing for trust and money transmitters. At the time DFS enacted this regulation, the industry was in its infancy. Other regulators are now following DFS’ lead. Virtual currency is an industry where regulation is necessary to protect markets and permit innovative businesses who engage in lawful business, while protecting markets and consumers.

COULD NEW YORK SURVIVE WITHOUT GATEWAY?

Washington made a down payment on the elusive rail tunnel. The entire Northeast By GRACE SEGERS depends on fully funding it. LAST MONTH, President Donald Trump signed an omnibus spending bill that included indirect funding for the Gateway Program, with $540 million allocated to Amtrak for capital projects. The additional money will likely be earmarked for the program as well as additional funding to New York and New Jersey that the states could use for Gateway. The project, which has repeatedly been threatened by Trump, would include a new rail tunnel underneath the Hudson River to complement the two aging tubes now in use and makes some additional infrastructure upgrades on both the New York and New Jersey sides. The U.S. Department of Transportation claimed victory because the bill “removes preferential treatment for the New York and New Jersey Gateway projects.” Garnering funding for the project beyond this federal infusion could be critical. Experts warn that failing to adequately fund it could cause cascading transportation and economic problems for the entire region, resulting in greater delays for Amtrak and New Jersey Transit, increased traffic congestion and lost productivity. Building the additional tunnel, however, would double current rail capacity under the Hudson, alleviating overcrowding. Trump had knocked down a proposal by Gov. Andrew Cuomo and then-New Jersey Gov. Chris Christie for the federal government to provide half the funding for the new tunnel, in keeping with an agreement by the Obama administration to pay for half of the project that Christie had previously abandoned. The Trump administration argued that the agreement was not formalized, and pushed for the two states to pitch in more.

Trump’s vendetta is perplexing on the merits: A real estate developer who made his name and fortune in Manhattan, Trump – and his close adviser and son-in-law Jared Kushner, the scion of a New Jersey real estate fortune – should understand the importance of reliable Hudson River crossings. Trump also campaigned on a promise to rebuild American infrastructure. Washington insiders speculate Trump’s Gateway opposition may stem from his animosity toward U.S. Senate Minority Leader Charles Schumer, a Democratic senator from New York who considers the project a priority. The tunnel was also supported by several Republican lawmakers, including House Appropriations Committee Chairman Rodney Frelinghuysen of New Jersey, who is retiring this year, and Long Island Rep. Pete King, a Trump supporter. The $540 million that could be applied to Gateway was half of the requested $900 million. If Gateway is not funded adequately, or in time to make significant changes, it would force commuters to rely on a crumbling transit system that is in constant need of repairs and vulnerable to losing three-quarters of its carrying capacity if one of the tubes fails – and with no backup if both tubes are out of commission. Here is a guide to exactly what losing Gateway would mean for New York and its neighbors, from delaying the transfer of goods to burdening already overcrowded airports. Why is Gateway so important? The Gateway Program would update a critical stretch of the Northeast Corridor, a rail line primarily owned by Amtrak, which

connects Boston, New York City, Philadelphia, Baltimore and Washington, D.C. The rail line covers eight states and the district and accommodates 820,000 passengers per day on more than 2,000 trains. The 10-mile segment of the NEC between Newark Penn Station and New York Penn Station carries 200,000 Amtrak and New Jersey Transit passengers on 450 trains every day. The most significant phase of the Gateway Program entails building a new tunnel underneath the Hudson and repairing an existing one, which was opened in 1910 and is quickly deteriorating. This would also cost nearly $13 billion out of the total $30 billion price tag for the program. If the current tunnel fails – which Amtrak estimated in 2014 would happen within 20 years – nearly 1 in 4 NEC passengers would be affected, and so would the economy in the Northeast. In total, the NEC serves a region that is home to 17 percent of the country’s population and contributes 20 percent of its GDP. The local impacts would be huge, because, according to Bloomberg, almost 13 percent of Manhattan’s workforce resides in New Jersey. What happens if the tunnel fails? Dani Simons, a vice president at the Regional Plan Association, a research and advocacy organization that studies economic growth and sustainability in the tri-state area, estimates that emergency repairs to the tunnel could take more than a year. “This is really back-of-the-envelope calculations, but it would take somewhere between 14 to 18 months optimistically

to get it back up to a state that it could be reopened for service again,” Simons said, based on Amtrak’s forecasts. She added that this would not solve the problem, as the tunnel would just be back to its previous condition. The tunnel has two tubes, so even if only one tube was out of commission and needed emergency repairs, it would still significantly reduce capacity. In fact, train traffic would be cut by three-quarters instead of one-half because the tunnel currently allows for 24 trains to travel in each direction per hour. If only one tube were usable, trains would have to alternate directions and the capacity would be reduced to six trains per hour, according to a study by the RPA. Simons also said that New Yorkers should not take comfort in the fact that the tunnel may not fail for a decade or so, as it could take that long to build a new one. Simons said that commuters are already feeling the effects of the failing system, as recent electrical signal problems have caused delays that prevent people from getting to work on time, and businesses from functioning properly. “People are going to make different decisions about how to travel or even whether they want to work in New York City anymore,” Simons said. What would that mean for New York? In 2016, the Partnership for New York City, a coalition of the city’s largest business interests, estimated that the city’s employers would lose $5.9 million for every hour that New Jersey Transit is out of service. If the tunnel were out of service, or even if service was reduced to one tube, at least 100,000 people would be forced to shift their commuting habits. If people commuting from New Jersey opted to take private cars or buses, that would increase congestion on the region’s highways, bridges and car tunnels, which are already gridlocked at peak hours. The Partnership for New York City recently released a study that found traffic congestion already costs the metro area $20 billion per year. “Gateway is vital to the New York economy, to millions of New York workers, to jobs and wages for 50 million Americans throughout the Northeast Corridor,” Schumer said at a press conference in March. How about everywhere else? The tunnel closure would slow the movement of freight, as many goods in the region travel by truck.

“When you put more traffic congestion on the Northeast Corridor, you’re not just impacting people who are commuters and driving to work, you’re impacting people trying to deliver the goods up and down the East Coast that are critical to the functioning of our economy,” Simons said. For Amtrak customers traveling to various locations along the East Coast and passing through New York, the reduction in service may lead them to choose traveling by plane instead of train. Simons said that shifting a portion of Amtrak riders to air travel would overburden the region’s airports, which are already operating at peak capacity, leading to delays in air traffic. JFK Airport and LaGuardia Airport have among the worst

on-time arrival records in the country. JFK had the longest arrival delays last year, while LaGuardia had the second-longest arrival delays and the highest percentage of canceled flights. “The delays that are happening at JFK, LaGuardia and Newark are felt throughout the entire air travel network in our country,” Simons said. Although it may seem like bad tunnel service only affects Acela passengers jetting to Washington, D.C., or perennially disgruntled New Jersey Transit commuters, failure to build the Gateway project could have national repercussions, and lawmakers of both parties are urging the president who campaigned on infrastructure and fixing the economy to realize its importance.

LOSERS ANDREA STEWART-COUSINS After seven long years languishing in the minority, the senator, who was elected Senate Democratic leader in 2012, could become the state’s first female legislative majority leader. Stewart-Cousins and Jeff Klein shook hands at a closed-door meeting to reunite the mainline Democrats and the eight members of the Independent Democratic Conference. If everything goes according to plan, Stewart-Cousins would be the Senate majority leader, and Klein, the IDC leader, her deputy.

State Sens. Andrea Stewart-Cousins and Jeff Klein buried the hatchet last week, but will their Democratic unity deal stick? Either way, what will it mean for Gov. Andrew Cuomo, Senate Majority Leader John Flanagan, Deputy Senate Minority Leader Michael Gianaris and dozens of others? For now, here are the clearest Winners & Losers from that deal – and from the week’s other noteworthy developments.

JEFF KLEIN “I don’t see us ending the IDC,” he said. “I think it just works well,” he said. Well, Jeff Klein ain’t saying that anymore. Now, he’s taking credit for a deal announced Wednesday to immediately dissolve the IDC and reunite with the mainline Democrats in the state Senate. The deal doesn’t even give him co-leadership like he has now with the Republicans. Plus, two members of his conference just lost the shady lulus they were getting.

Note to NYC Department of Education: If you’re going to fire a teacher, follow the rules. The IDC “have until April to come back” to the fold, the congressman said in January. What deal? This state senator still decides the balance of power in the chamber. The Erie County clerk kept the Children’s Psychiatric Center in West Seneca.

She was fired after less than two months as head of investigation for NYC schools. Hope she didn’t spend all that money she’s accused of stealing, since she’s out of a job.
