If Gov. Andrew Cuomo were to pick a symbol to sum up his tenure, it would likely be the new Tappan Zee Bridge. When he took office, the old Hudson River crossing had been studied for years, with plenty of evidence showing how decrepit it was but little action otherwise. The governor prioritized building a new bridge, passing legislation to streamline the project and pressing ahead in the face of political resistance. By 2013, construction was underway. In his State of the State address that year, Cuomo’s policy book and slideshow were dominated by an image of the new bridge design soaring over the state Capitol. By the end of this year, the project is expected to be finished. But it hasn’t always been a smooth ride. It won’t be done on time, it may run over budget and it’s unclear how high its tolls will rise. Naming it the Gov. Mario M. Cuomo Bridge has spurred opposition from locals who want it to remain the Tappan Zee. And while the governor got that job done, the public’s attention has shifted to another transportation infrastructure problem that may be even more intractable – New York City’s broken-down subways.

Latest New York City Mayor Bill de Blasio announced an $89.1 billion executive budget on Thursday, with record-high spending offset by the city’s humming economy – and a one-time, $1 billion windfall thanks to federal tax changes. The City Council’s desire to provide half-price MetroCards for low-income New Yorkers was left out again, but they have until June 30 to hash out the final budget.

SOME VERY SPECIAL ELECTIONS Democrats picked up both open state Senate seats in Tuesday’s special elections. Shelley Mayer won in the highly watched state Senate District 37 race in Westchester County and Luis Sepúlveda easily won in the Bronx. In the Assembly, each party largely retained control of their seats, with the exception being on Long Island where Steve Stern flipped Assembly District 10 blue for the first time in 40 years. With the two seats Democrats won in the state Senate, and the Independent Democratic Conference rejoining the mainline Democrats, the conference now has 31 members, giving the Republicans a precarious one-seat majority. And as usual, the deciding vote is state Sen. Simcha Felder.

THE KINGMAKER Despite the Democrats having a technical majority in the state Senate, Felder has decided to stay with Republicans until at least November, allowing the GOP to keep its majority. Gov. Andrew Cuomo tried to get the renegade Democrat in line by sending him a strongly worded letter, but to no avail. Cuomo insisted he’s “not a pressure kind of guy” when asked what more he would do to get Felder back in the fold.

Back & Forth C&S: You founded the New York State Mentoring Program in 1984, and still work with it today at age 86. How did it start? MRC: Because of the huge incarceration rate of the young people in prison. And the state police told my husband that there was no room for them anymore. They had to get another prison built. So my husband (Gov. Mario Cuomo) looked at me and he said, you know, Matilda, you’re a mother of five children, you’re a teacher and you know what danger this presents if we don’t do something right away to see how we can curb this.

Democrats should exile Simcha Felder

Failing to punish disloyalty encourages more of it. By BEN ADLER

EVERY NEW YORK political insider has been there: talking to a friend or relative about something happening in Albany and struggling to explain why the Democratic state Senate majority is actually the minority. And so the inevitable innocent question is asked: “Wait, they’re Democrats but they caucus with the Republicans?” And, usually thereafter, “Why do the Democrats keep nominating them?” Why indeed. Since the Independent Democratic Conference’s reunification with the rest of their party, state Sen. Simcha Felder is the sole Democrat still aligned with the state Senate GOP. Them has become him. Just before the Democrats won both state Senate races in last week’s special elections, Felder announced that he would stay with the Republicans at least through the end of the legislative session. That gives him plenty of time to hold an auction and sell his affiliation to the highest bidder. As Felder holds both parties, and by extension the state’s entire population, hostage to his whims, it’s worth asking why the actual majority party is so powerless to stop him. Partly this is attributable to the unusual politics of Felder’s district: Whereas IDC members often represented fairly typical Democratic districts, and they were therefore potentially vulnerable to a primary challenge, Felder hails from a heavily Orthodox Jewish Brooklyn district. Many of his constituents are registered Democrats but vote Republican for president and sometimes other offices. While Felder has fielded

a Democratic challenger this year, appeals to liberal ideology or party loyalty are unlikely to dislodge him. But that doesn’t mean the state Senate Democrats have to allow him in their caucus, much less offer anything to recruit him. Instead, the Democrats should warn Felder that if he does not rejoin before the November elections, he will be unwelcome afterward, or that he would be stripped of all seniority and relegated to the lowest rung on the totem pole. If the Democrats pick up just one state Senate seat in November, they will have the majority without Felder. And they could flip more than just one seat: Eight Republican state senators represent districts carried by Hillary Clinton in 2016. Inspired by opposition to President Donald Trump, Democratic fundraising, candidate recruitment, grass-roots activism and voter turnout are all on the upswing. Recent elections across the country show a “blue wave” building. Gov. Andrew Cuomo referred to that possibility last week when he sent an open letter to Felder pleading with him to rejoin his

nominal caucus. “The Democratic Conference will not need you in November the way they need you now,” Cuomo warned. “You have said that you act in the best interest of your constituents. For their benefit, now is the time that matters.” It’s curious that Cuomo – a legendarily shrewd and unforgiving political operator – has not dropped the hammer on Felder. Cuomo forced the IDC to rejoin the Democrats through nothing but sheer force of will. The deal he brokered contained only two major concessions to the IDC: allowing IDC leader Jeff Klein to serve as the Democratic caucus’s second in command, and, at least implicitly, Cuomo and his party agreed not to back the IDC’s primary challengers. So why can’t the same be done to Felder? Is Cuomo, so adept at punishing those who cross him, suddenly powerless? If so, revealing as much to a body that may remain closely divided next year is dangerous. Most state senators understand, and many relentlessly pursue, their self-interest. If both parties reward disloyalty and selfishness, Felder won’t be the only one who

defects, or threatens to, to gain personal or political advantage. Felder is, after all, not the first Democratic state senator to caucus with Republicans to aggrandize his own power. In that distinguished company he joins Hiram Monserrate and Pedro Espada Jr. who threw the state Senate into crisis in 2009 by switching teams mid-session. (Monserrate was later expelled from the Senate after being convicted of beating his girlfriend, and Espada was defeated in a primary and convicted of federal corruption charges.) Since Felder is keeping state Senate Republicans from falling into the abyss, it stands to reason that they grovel before him, most recently by agreeing to exempt yeshivas from the state educational quality regulations that apply to all other schools. If there were a way to defend Felder’s behavior, it would have to be that he is caucusing with the Republicans because he is relatively conservative and he is working for moderation and consensus. But there is nothing ideological or consensus-driven about Felder’s politics. His demands are re-

lentlessly parochial and frequently divisive. If it isn’t special treatment for yeshivas, then it’s overturning the will of the New York City Council to allow plastic bags to continue polluting our waterways, or it’s a dangerous and expensive campaign to place armed guards in public schools. In 2013, for example, Felder blocked the installation of speed cameras in New York City, although he offered to reverse his stance if the city picked up the tab for yeshiva school buses. Felder doesn’t build consensus between the parties, he simply shakes them down. Felder’s actions, like those of the IDC until the recent reunification, are especially ignoble when viewed through the lens of racial and gender equality. New York state legislative negotiations have long been dominated by “three men in a room.” They always have been men. During the IDC’s reign, Klein, who has been accused of nonconsensually kissing a then-staffer, was invited into the inner sanctum. So this year four men discussed revising the state government’s sexual harassment guidelines without any input from state Senate

Minority Leader Andrea Stewart-Cousins, or any other woman. Were Felder to caucus with the party that he supposedly belongs to, Stewart-Cousins would be the first woman in the room. Meanwhile, the power the GOP exercises over redistricting is one reason that Latinos and Asian-Americans are 19 percent and 8 percent of the state’s population, but they are only 8 percent and 1 percent, respectively, of its state legislators. If Felder caucused with party he belongs to, Democrats would have not only the power to pass liberal measures but to end the gerrymandered district lines that give Republicans any chance of winning the Senate at all. New York politicos may not realize it, but having petty, transactional legislators overturn election results by caucusing with a party they do not actually join because it would impede their re-election prospects is not normal. It isn’t done in other states. It is a product of the particular anti-democratic and dysfunctional nature of New York politics, and a party headed by a politician with Cuomo’s skills should be able to put an end to the debacle.

Randomly charging fees on certain vehicles won’t ease congestion. By ERIC GOLDWYN

WHILE NEW YORK did not pass congestion pricing in the recently adopted state budget, Gov. Andrew Cuomo touted the new surcharge in the core of Manhattan on ride-hailing services ($2.75), yellow taxis ($2.50) and car pool rides (75 cents) as a step toward improving gridlock and funding New York City’s deteriorating mass transit system. Adding fees to these types of trips isn’t inherently bad – especially since so many good transit options abound in Manhattan below 96th Street – but it’s neither an effective way to reduce congestion nor fund

transit. According to Charles Komanoff, the analyst behind the Move New York congestion pricing and toll reform plan, these new fees would improve travel speeds in the zone by 3 percent. Komanoff is too generous by reporting a percentage. A 3 percent increase in travel speed is actually a boost of less than a third of a mile per hour. The reason he anticipates such a minor increase is that while the fees will take taxis and ride-hailing vehicles off the road, that newly opened up road space will encourage more private car drivers, for whom there is no financial disincentive, onto the roads.

Cuomo predicted the new fees will create an ongoing revenue stream of more than $400 million per year to fund the Metropolitan Transportation Authority. On its face, that sounds promising, but the MTA has demonstrated such an ability to waste money that, absent reform, that sum might buy very little improvement. In light of the ongoing cost overruns and delays that hampered the first phase the Second Avenue subway or reports that East Side Access, a project to bring Long Island Rail Road trains to Grand Central Terminal, is over budget by nearly $1 billion are stark

reminders that the MTA’s spending is out of control. So, instead of inadequate piecemeal responses to transit infrastructure funding needs and streets clogged with traffic, New York City and New York state must set goals – all buses south of 96th Street in Manhattan should travel at least 10 miles per hour, say, or a pollution reduction target – before selecting a policy to accomplish it. We can play with the current composition of traffic and estimate how much each mode – taxi, private vehicle, truck, ride-hailing vehicle – contributes to traffic, greenhouse gas emissions or other social harms. (In fairness to the new surcharges, because they drive around all day, taxis and ride-hailing vehicles are worse offenders in terms of pollution and congestion than the average commuter driving to midtown Manhattan from Queens.) Then, with those goals in mind, we can tailor solutions by developing models that test different scenarios. That may include protected bus lanes, a fee to enter Manhattan’s central business district, eliminating parking placards or more drastic measures like banning specific types of vehicles during rush

hour or a rationing scheme similar to the one used in some European and Asian cities in which only even- or odd-numbered license plates can enter the city center on a given day. Of course, any policy that restricts or charges for driving may be unpopular and unable to pass in Albany. Technical debates cannot escape politics. But if we identify benchmarks and work through scenarios based on accurate data, we can at least attempt make rational policy rather than just pulling numbers out of thin air to decide what fees will be charged. Instead of fetishizing a magic dollar amount that needs to be raised and focusing on what needs to happen, New York can start to intelligently tackle congestion and transit infrastructure improvements. It’s also worth asking why we expect mass transit infrastructure to be paid for primarily through dedicated revenue streams. The city of New York will spend more than $14 billion repaving roads and maintaining bridges over the next 10 years, in large part through bonds. Why do roads and bridges get a blank check, paid from future taxes, while mass transit only gets $1 billion from bonds over 10 years and thus

requires an entirely new pot of money? Repaving roads will exacerbate rather than alleviate congestion, as drivers are induced to use smoother, faster roads, which in turn will undercut the small gains of a fee on taxis and ride-hailing vehicles. The rich transit options south of 96th Street make it hard to argue against the congestion fee. By that same logic, however, one could just as well apply it to all vehicles. If state legislators are concerned that residents in the far reaches of the outer boroughs need to drive to work in Manhattan, perhaps they can normalize fares across different MTA services. Neighborhoods in Queens or the Bronx often have Long Island Rail Road or Metro-North Railroad stations, respectively, but the cost can be much higher than a subway ride. Reducing those fares, and also those of express buses that serve much of Staten Island and subway deserts of southern and eastern Brooklyn and Queens, would give potential drivers an affordable transit option. (Like the Fair Fares proposal for discounted subway and bus rides, these discounts could be limited to those below a certain income threshold.) Redesigning bus service to be more frequent, reliable and fast would also make it a better option for commuters. We also need to give a long, hard look at how the MTA spends money. Recent investigations and headlines continue to show that we pay more for infrastructure than cities in Europe and Asia. Rather than just writing bigger checks, the governor needs to demand accountability from the MTA. The first phase of the Second Avenue subway cost about $2.5 billion per mile, which is nearly five times what Paris recently paid to construct Line 14 of its Metro, but it’s a bargain compared to the $4 billion per mile projections that have been announced for the Second Avenue’s phase two. This cost escalation jeopardizes service expansion elsewhere in the system and makes it hard to imagine that the full plan for the Second Avenue line will ever materialize. A surcharge on taxis and ride-hailing vehicles is meant to appease a bunch of interest groups who will all end up not much better off. The core problems – all of the vehicles that make New York’s congestion unbearable and the MTA’s out of control spending habits that make Imelda Marcos’ shoe collection look like a rounding error – remain unaddressed, and solutions that skirt those issues promise little in long-term relief.

NYC gave Cuomo the cash he wants for the MTA. Now he wants more – but his numbers don’t add up. By JEFF COLTIN

GOV. ANDREW CUOMO WALKED into the marbled halls of Cipriani Wall Street earlier this month and held out a metaphorical tin cup, crying poverty and asking New York City to contribute more money to the Metropolitan Transportation Authority. His speech before the Association for a Better New York confirmed that the fight over MTA funding between Cuomo and New York City Mayor Bill de Blasio will continue, even after the city agreed to pay $418 million for the Subway Action Plan after months of badgering by Cuomo. “I think New York City and the City Council and the state Legislature are being shortsighted if they don’t invest in the MTA’s future,” Cuomo said to applause. “It is the lifeblood of the city.” A slideshow behind him read “NYC must pay its legal obligation,” with graphics asserting that New York City has an $8 billion budget surplus while the state has a $4 billion budget deficit. The governor’s suggestion was that New York City has more money to give. De Blasio had resisted allotting the money for months, saying that city taxpayers already contribute enough and that the MTA wasn’t spending its money wisely. But there may be an issue with the governor’s calculations. The state was able to close its projected $4.4 billion defi-

cit in the final state budget agreement. What’s more, the de Blasio administration said there simply is not $8 billion lying around City Hall. “This is completely disingenuous,” said Freddi Goldstein, a deputy press secretary for de Blasio. Doug Turetsky, chief of staff and communications director for the New York City Independent Budget Office, called the governor’s figures a “misrepresentation.” “The city does not have an $8 billion surplus,” he said. Turetsky said there is a $2.6 billion surplus for the current fiscal year ending June 30. But the city is obligated to have a balanced budget at the beginning and the end of the year, so that money will be rolled over into the fiscal year 2019 budget to prepay expenditures like debt payments. “If you count that as surplus that (you) can use, you’ve blown a $2.6 billion hole in next year’s budget,” he said. Asked to clarify the governor’s $8 billion figure, state Budget Division spokesman Morris Peters said it includes the $2.6 billion surplus for fiscal year 2018, a $4.25 billion surplus in the Retiree Health Benefit Trust, $1 billion in general reserves in this year’s budget and $250 million in the Capital Stabilization Reserve. Peters pointed to a 2017 report from the New York City comptroller’s office that

adds these same sources together to describe the city’s “budget cushion.” “It doesn’t matter how many pockets they put it in, they’re still sitting on $8 billion,” Peters said. “We should all be so broke.” In separate interviews, Turetsky and Goldstein both disagreed that those numbers count toward the city’s supposed budget surplus. They both said the Retiree Health Benefit Trust can only be used for its nominal purpose – for retiree health care costs – and sits outside of the city budget. They both noted that the reserves also aren’t a surplus, since they’re baked into the budget. “The governor has been doing this for a while, saying, ‘Look at this money, they’re in great shape,’” Turetsky said. At the same time, New York City Comptroller Scott Stringer and the New York City Council are saying that de Blasio needs to divert more money to the city’s reserves. “The de Blasio administration is getting hit from both sides,” Turetsky said. In March, Stringer’s office predicted the city would have a $417 million budget surplus this fiscal year. But Cuomo and MTA Chairman Joe Lhota, a Cuomo appointee who also spoke at the ABNY event, blamed a lack of funding from New York City for delays in

The Mayor’s advocacy ensured that riders’ money couldn’t be diverted and would actually go toward a real plan for their subways rather than station facelifts and light shows,” de Blasio’s press secretary Eric Phillips said in a statement to City & State. “We wish the Governor were even half as obsessed with fixing his subways as he is with Mayor de Blasio.”

C&S: There’s a new transportation surcharge in Manhattan south of 96th Street on taxi rides and ride-hailing trips. Will this lessen congestion? Or is it just a way to fund the MTA? PT: We think this was a good first step by Albany. I think it is mainly a revenue raiser for the MTA and obviously one that is very urgently needed. I won’t say that there won’t be any congestion benefits to this charge, but I definitely think it will be modest. C&S: When is the last time you attended a meeting about the Brooklyn-Queens Connector?

PT: We are still having internal conversations, including with the mayor. I can’t remember exactly when the last one was, but it was fairly recently. Deputy Mayor (Alicia) Glen laid it out there pretty honestly, at the questions we’re grappling with. What are the economics of the project in the end? How much of it can pay for itself? To the extent that we need city or federal dollars, how much is going to be available in terms of federal dollars? You’ve really got to make sure, before you commit to a project like this, you have a good picture of what you’re going to do under the ground. Getting a handle on that for a project this big

has been something that’s taken a while to analyze. C&S: Why is there a new campaign about safe driving on warm days? PT: We’ve gone back and looked at the (traffic crash) data again. In the warmer months, on the weekends – not during the week – we see a big spike in crashes and injuries and fatalities, particularly for motorists and motorcycle riders. C&S: How are the airport construction projects going – will LaGuardia’s overhaul be completed on time? RC: It will be on time and on budget. It is an $8 billion construction project, which will produce an entirely new 21st century state-of-the-art airport. With the exception of Terminal A, every single airport building will be demolished. There will be new terminal buildings, new gates. There’s already a new garage, new roadways, new dining facilities. The gates will start opening by the end of this year and the construction of the new airport as a whole is moving forward at a very rapid clip.

C&S: What is next for the Port Authority with the Gateway rail tunnel project? RC: The Gateway project has to be built. Not to build it puts at risk the only passenger rail link that supports the Northeast Corridor and supports an enormous number of commuters whose livelihoods depend on it – 450 trains with 200,000 passenger trips a day. The region’s economy depends on it. The states of New York, New Jersey, with the Port Authority, have pledged $5.5 billion to the tunnel project and the region. The country needs Washington to step forward and that is where we stand.

C&S: How has security surrounding Port Authority Bus Terminal changed after the attempted terrorist attack in December? RC: The Port Authority has always put security and safety at the top of the priority list. When the new chair and I took office in the fall of last year, one of the first things we did was to bring in outside experts to review security at all of our facilities. What the incident at the Port Authority demonstrated was how strong our security currently is and how well-trained and focused the Port Authority Police Department and our security are. We remain enormously vigilant.

THE POTENTIAL DANGER OF SOCIAL ENGINEERING: By: Marc Herbst, Executive Director Long Island Contractors’ Association (LICA)

The recent horrific bus crash on the Southern State Parkway on Long Island is a grim reminder of what can occur when social engineering is implemented as part of construction design. It’s widely known that Master Builder Robert Moses intentionally built Long Island’s parkway bridges with underpass clearances to prohibit buses. His personal prejudices drove him to make sure less affluent (translation: poor minorities) could not visit his marquee playgrounds and parks which he was creating on Long Island during the 1930s. However, not all examples of social engineering are as dark as Moses’ bridge designs. Sometimes it can have positive effects, such as in the aftermath of the 9-11 terrorists attacks which forced greater attention on the need for infrastructure safety and protection. As a result, the new Mario Cuomo Bridge which replaced the Tappan Zee, was deliberately built with two spans to ensure the network could remain functional should an attack damage one of the spans. Redundancy of facilities is now commonplace in construction design. The impact of the collaboration between civil engineering and social engineering is not limited only to physical structures such as bridges. Its influence includes policies and regulations that are enacted to guide the design and construction of our state and national infrastructure. As part of the recent state budget deliberations, there was a strong advocacy effort to increase the current Minority and Women Business Enterprise (MWBE) percentage goal-requirements for hiring subcontractor firms for public construction jobs. A broad range of issues were debated and considered in the final hours of budget negotiations. However, the final agreement simply extended, but did not increase, the current program goals. Advocates were unhappy, but while an arbitrary increase in goal percentage may have been an expedient political success, in reality, it would not have achieved the program’s real intent: to provide more opportunities for minorityand women-owned businesses to work successfully on contracts that enable their firms to grow and graduate out of the program. To achieve its true mission, the program must be managed with meaningful state support to help MWBE firms acquire the necessary financial capacity for bonding, insurance and other requirements to compete in the construction business. Program administrators must also responsibly analyze the actual inventory of firms who are available and capable to perform the type of work required. Currently, only 20% of certified MWBE companies are in the construction industry and over half of the listed firms’ information contains errors. Moving forward, policymakers must base their decisions on accurate data and consider long-term effects before they enact social legislation in the construction industry. Otherwise, the results could be as glaringly ugly and obvious as today’s structurally obsolete bridges that were built with a terribly flawed and biased social engineering blueprint.

HOW SKYSCRAPERS CAN FINANCE

A NEW PENN STATION Why lawmakers should embrace development around the overcrowded and outdated transit hub.

IN MOST CITIES, a politician fearing the transformation of a neighborhood into a forest of skyscrapers would describe it as being turned into Manhattan, or Manhattanized. That convenient metaphor was unavailable to state Sen. Liz Krueger, however, when she wanted to inveigh against a legislative proposal from Gov. Andrew Cuomo that, in an early version, would have enabled the state to take over planning the redevelopment of the area around New York Penn Station, bypassing municipal control entirely. So instead Krueger said,

rather confusingly, “I don’t want Singapore in the middle of Manhattan. And I certainly don’t want one person up here to be deciding whether or not we’re going to have Singapore in the middle of Manhattan with no community participation or process or local government role.” The final legislation passed as part of the state budget was far less ambitious, declaring every New Yorker’s least favorite train station “antiquated, substandard, and inadequate to meet current transportation and public safety needs and present(ing) an unreasonable safety

risk to the public.” It calls on the Metropolitan Transportation Authority and Empire State Development Corp. to “coordinate and consult with community leaders, business groups and federal and city government to design a solution.” The law could facilitate a potential eminent domain claim against Madison Square Garden Co., strengthening the state’s hand in negotiations over the acquisition of the 5,600-seat Hulu Theater beneath the main arena. Cuomo wants to use the theater area for a new grand entrance to the station on Eighth Avenue,

as part of a larger renovation. The Penn Station budget amendment also called for the allocation of unspecified funds to Empire State Development for redevelopment planning. Krueger and other critics of the legislation are right to suspect that Cuomo wants to build more skyscrapers around Penn Station, and their concerns about eliminating avenues for local input are well-grounded, but they are wrong to oppose significant new development. New York City needs more offices, hotels and housing; the city’s centrally located regional transit hub is exactly where they should go. The real risk is not that too many tall buildings will go up, but that Cuomo’s desire for a monument to his achievement will overshadow the more important work of making Penn Station function better for daily riders. The earlier draft legislation provided a clearer picture of Cuomo’s true ambitions for the area. The governor previously hinted at his preference for state government leadership in the redevelopment of the area around Penn Station. In his May 2017 presentation on renovating the station, he argued that the “real solution lays in entirely rebuilding Penn Station.” As a shortcut to bringing his ambitions about, the draft included a provision enabling ESD, the MTA or the city to bypass all municipal planning rules – including zoning laws and the Uniform Land Use Review Procedure – when undertaking the redevelopment of the station and its environs. Unsurprisingly, a blanket exemption met opposition from local elected officials like Krueger, who would largely be cut out of the planning process for an important part of midtown Manhattan. Cuomo’s abortive maneuver had its roots in the much more ambitious plans of a decade ago to rebuild the station and the surrounding neighborhood, which fell apart in the wake of thenGov. Eliot Spitzer’s political demise and the 2007‑2008 financial crisis. The above‑ground portions of Penn Station were demolished in 1963, which began the process of replacing the soaring spaces of Charles McKim’s grand old building with a warren of ugly hallways and low ceilings. The original 1910 layout remains intact, and it is woefully obsolete for a station that now mostly serves busy commuter routes rather than the long-distance trains of decades past. It is entirely incapable of handling the 600,000 people per day who pass

through the building and its adjacent subway stations. The loss of the old building mobilized the nascent preservationist movement in New York City, and by the 1990s U.S. Sen. Daniel Patrick Moynihan was spearheading efforts to rebuild an impressive new station building that would give the city a landmark to replace what was lost. In the mid-2000s, Spitzer, Vornado Realty Trust – the area’s principal private landowner – and Related Cos. were working on a plan to move Madison Square Garden to a new location west of the Farley Post Office across Eighth Avenue, which would in turn be transformed into a new great hall named for Moynihan. The arena would be replaced with a large new station and retail complex. As part of the deal for the developers to pay for rebuilding the station, they would receive air rights to build multiple new skyscrapers on their adjacent land – the “Singapore” that Krueger was concerned about. Cuomo’s attempt to pre-emptively disarm community groups and sideline urban planners points to the possible revival of such plans. A decade ago, many locals were wary of large-scale development in the area. Preservationists were concerned about the loss of the historic Hotel Pennsylvania for a new skyscraper. Others lamented the interference with the city’s existing skyline. The inclusion of Steven Roth, Vornado’s chairman, on Cuomo’s committee for planning the rebuilding of Penn Station is also a sign that a larger real estate development project may be in the works. While completely jettisoning the municipal planning process would be rash and unfair to the area’s residents, the Penn Station area is ripe for more density. The station itself is the city’s largest rail hub, and the area is only a few blocks from the largest subway station at Times Square. It is far better connected than the Hudson Yards development area, immediately to the west, which only has a single subway station. Its infrastructure is also not as overcrowded as the East Midtown area, which has also been the site of a recent rezoning to add density in exchange for improvements to Grand Central Terminal. The city and state are going to great lengths to incentivize office construction in the Hudson Yards and the World Trade Center areas, while developers seem eager to build in the better located Penn Station area. The need for addition-

al hotel capacity in midtown Manhattan is evident, as New York also has among the highest hotel prices and occupancy rates in the country. The aging Madison Square Garden arena – the oldest in the NHL and second oldest in the NBA – will likely not last forever on the site, and Penn Station is in need of wholesale reconstruction. The opportunity to make better use of the surrounding blocks that will be presented by the inevitable MSG and Penn Station reconstruction should not be missed. Nevertheless, it is clearly a problem that discussions of Penn Station have too often focused on aesthetic improvements when the station has more fundamental problems that hinder its efficient operation. Some are based in jurisdictional squabbles, such as the need for Amtrak, Long Island Rail Road and New Jersey Transit to maintain entirely separate concourses with their own information displays and signage. Allowing riders on all lines to use all available access stairs to the platforms would go a long way to reducing congestion. Other options are more complex, and transit expert Alon Levy and the University of Pennsylvania’s School of Design have both discussed the possibility of significantly widening the platforms, so passengers can arrive and depart more easily than they do now on the narrow platforms. All of these changes have little to do with what’s above or around the station, and should be more of a focal point going forward. Cost overruns on pharaonic, aesthetically driven transit infrastructure projects, such as the World Trade Center transit hub, have also made New Yorkers wary of such massive and arguably wasteful undertakings in the future. A sharper focus on operational improvements would offer more benefits to transit riders. Cuomo’s legislative proposal may have tipped his hand, indicating that another large-scale redevelopment is in the works. If the state is able to develop a good plan for upgrading the station, including necessary operating improvements, selling air rights may be able to help pay for it. Transit riders can hope that this renewed planning will bring about the operational improvements that the station desperately requires – and they should not worry if the city gets a few new skyscrapers in the bargain.

C&S: In the state budget, was there anything left out for funding transportation infrastructure? JR: I think you have to say this: We have an aging infrastructure in New York just like the entire Northeast. Where I’m pleased is, after almost 10 years without a coordinated transportation capital program or any kind of parity between mass transit and roads and bridges, we now have that. An infrastructure framework and funding is in place. Now, the challenge becomes proper implementation. For too long we got caught up in whether we were going to be for roads and bridges or mass

transit. The reality is both are critically, critically needed. … So, the job really becomes making sure the funding is in place going out the door. C&S: Do you have any concerns with the MTA implementing these repairs on roads and bridges? JR: Certainly. All you have to do is pick up any publication and understand that the MTA has a lot of needs. There’s a lot of different opinions on how their money is used, should there be more capital, and is it operating to peak efficiency. I think those are going to go on to the end of time. What’s critical is that we try to meet that

need for commuting people in New York that rely on that transportation. What we try and do as we do the budget is put the money in place, coordinate that with New York City and the other entities that chip in, and try to make it work. Our goal, quite frankly, is to make sure that $27 billion stays on track too. To some degree, chairing this committee, it makes me and others who are interested in that parochially to be the watchdogs for getting money out the door. Because the need is so great, it’s hard to quantify what projects are the most important, but we try to make sure there’s activity.

I will always be open to any proposal that addresses the issue of transportation deserts in our city. It’s not only a new mode of transportation, with the BQX, but it’s also learning what can happen there, look‑ ing at light rail as a possible project, something that can be modeled in other places in the city. I hope that (the BQX) con‑ versation will continue. I would be open, but it would have to make sense financially, and also be efficient, if that’s the program that we get to fund.

C&S: There’s a new trans‑ portation surcharge in Manhattan south of 96th Street on taxi rides and ride-hailing services like Uber and Lyft. Are you worried about the effect of the surcharge on the yel‑ low cab industry? YR: I hope that this is only the beginning of many conversa‑ tions that we need to have, engaging all sectors to do their part to reduce the level of congestion in our city. It’s also raising revenue so that the MTA is able to have the resources that they need, with the understanding that they also have to control the costs.

THE GATEWAY PROGRAM is the Lucy’s football of regional politics – long‑promised and long-awaited, but always just out of reach. In 2010, thenNew Jersey Gov. Chris Christie scuttled a plan to build a new rail tunnel underneath the Hudson River. Nearly eight years later, progress continues to be agonizingly slow. In December, Gov. Andrew Cuomo and Christie reached a tentative funding deal for the project, but the Trump administration killed the agreement. Then the latest federal spending bill included some funding that could be used for the project. Here are the most important things to know about what the Gateway Program is, who’s involved and how easy it is for the football to be snatched away.

What is it?

The project includes building an additional rail tunnel underneath the Hudson River and repairing the existing tunnels. It also involves expanding New York Penn Station and replacing the Portal Bridge, which carries New Jersey Transit trains to and from New York. Early work on replacing the North Portal Bridge began in October, with state funding secured and federal funding pending. The Gateway Program, and specifically building and repairing tunnels beneath the Hudson, was a priority for the Obama administration. In 2015, the administration ranked it as the most important rail infrastructure project in the country and committed to paying up to half of the cost.

How much will it cost?

A report released in July by the Federal Railroad Administration and New Jersey Transit estimated that the entire Gateway Program could cost as much as $29.1 billion, while the tunnel project could cost nearly $13 billion.

Who are the key players?

Planning for the project is administered by the Gateway Program Development Corp., which was formed in 2016. Its stakeholders included Amtrak, the Port Authority of New York and New Jersey, New Jersey Transit and the U.S. Department of Transportation. The corporation originally had four trustees – one representative each from the states of New York and New Jersey, one from Amtrak and one from the transportation department. However, in keeping with President Donald Trump’s tradition of opposing most policies championed by his

predecessor, his administration backed away from the program. In July, the U.S. Department of Transportation pulled out of the board overseeing the corporation. The Trump administration also aims to phase out a grant program that would have provided funds for the project. In September, Trump met with Cuomo and Christie and a bipartisan congressional delegation from both states to discuss the issue, but no definitive deal was made. Members of New York and New Jersey’s congressional delegations, including Republicans like Rep. Rodney Frelinghuysen of New Jersey and Rep. Pete King, pushed for Gateway funding to be included in the omnibus government spending bill passed in March. Although Trump threatened to veto the bill if it included funding for Gateway, the ultimate bill signed by the president included $540 million for capital improvements that Amtrak could use for the program as well as grants to the U.S. Department of Transportation that New York and New Jersey could apply for.

What was Cuomo’s plan?

The agreement reached by Christie and Cuomo specifically addressed the Gateway tunnel project: building the new tunnel under the Hudson and repairing existing infrastructure. Cuomo proposed contributing $1.75 billion from New York using a loan from the federal Railroad Rehabilitation and Improvement Financing program, and designating a portion of the state budget to finance that loan each year for 35 years. New Jersey Transit would provide $1.9 billion, also financed through the federal railroad loan program. New Jersey Transit would pay back the loan by hiking train fares beginning in 2020. The Port Authority previously committed $1.9 billion to this project, bringing the total contributions to $5.55 billion. The federal government would have been expected to finance the other portion of the project, in addition to providing the loans. With New Jersey and New York splitting half of the local cost via loans, the federal half of funding for the Gateway project would have needed direct investment.

Why did the federal government reject this plan?

Apathy from the White House and animosity from some New Jersey officials dimmed this proposal’s chances

for success. According to reports, the Trump administration is unenthusiastic about Christie and Cuomo’s proposal, which focused on funding the new tunnel while sidestepping the issue of repairing the existing tunnels. The two states also had not yet applied for the railroad loans, which the whole plan relies on. Further, the Trump administration’s infrastructure plan attempted to shift more responsibility for infrastructure projects to the states. Trump officially scrapped the agreement between the federal government and the states laid out by the Obama administration at the end of December. “We consider it unhelpful to reference a nonexistent ‘agreement’ rather than directly address the responsibility for funding a local project where nine out of 10 passengers are local transit riders,” a top Federal Transit Administration official wrote. In February, the FTA downgraded Gateway’s importance in its ratings of grant proposals. The new plan was also hammered by New Jersey Gov. Phil Murphy and New Jersey Democratic leaders for adding a fee to New Jersey Transit tickets. However, Murphy has made obtaining funding for Gateway a priority since taking office in January.

What happens next?

Because the federal spending bill did not specifically allocate funding for the Gateway Program, the U.S. Department of Transportation said that it “removes preferential treatment for the New York and New Jersey Gateway projects.” The administration continues to believe that state officials should contribute more funding to the program. In an interview with City & State last month, Scott Rechler, a member of the MTA board and chairman of the Regional Plan Association, said state officials should try negotiating Gateway funding on Trump’s terms, as the president has “made it clear that he doesn’t want to fund a $30 billion project to the New York region.” “Let’s try to resize the Gateway project to a level that’s more of the $10 billion to $12 billion,” Rechler said, adding that the states would have to create user fees to help fund the project. “I would not debate whether or not we should be using Washington’s money, I’d go out to the private sector and use that incremental revenue stream to fund bonds on behalf of New Jersey and New York, to fund their half.”

GETTING FROM point A to point B should, theoretically, be a relatively simple task. But in order to travel, the transportation infrastructure needs to be in place and up to par. Across the state, major projects are underway to repair and update that infrastructure so New Yorkers can get where they need to go – whether that’s through the air, over land or over water. Though some may be on track to be completed while others wallow in planning, here are five major projects underway that should make it easier for New Yorkers to get around.

LAGUARDIA AIRPORT The renovation of LaGuardia Airport began in June 2016 with an expected completion date of 2021 and total cost of $8 billion. The construction will constitute a complete overhaul of the airport, which former Vice President Joe Biden famously described as like something out of a Third World country. The first portion involves completely replacing Terminal B with a new central terminal, an undertaking Gov. Andrew Cuomo has called the largest public-private partnership in the U.S. The second half will connect Terminals C and D with the newly constructed Terminal B. The project will also include an AirTrain line between LaGuardia and the Mets-Willets Point No. 7 subway station. Since the start of construction, the new Terminal B parking garage was completed. The project also hit a milestone on March 26 when the final piece of steel was installed at the new main terminal.

GOV. MARIO M. CUOMO BRIDGE Construction on a new Tappan Zee Bridge, since officially named the Gov. Mario M. Cuomo Bridge, began in 2013, and the first lane of traffic opened in August. The old Tappan Zee was closed to traffic on Oct. 6, although the original date had been set for Feb. 17, 2017. The entire project, both the new bridge construction and the old bridge demolition, was originally projected to be done by April 3. Needless to say, that deadline was not met. Matthew Driscoll, the state Thruway Authority’s acting executive director, told the Journal News in January that the completion date would likely be toward the end of this year. The project utilizes a process known as design-build, which bundles the planning and construction phases into one for a potentially speedier process. Gov. Andrew Cuomo recently announced that the debris from the old Tappan Zee will be put to good use in six artificial reefs around Long Island, which would also save money compared with sending the debris to a salvage yard.

BROOKLYN-QUEENS EXPRESSWAY

The idea for a connector between Long Island and either Westchester County or Connecticut over (or under) the Long Island Sound has been thrown around for decades, dating back to at least 1957, though every proposal has ultimately failed. The proposal was revisited in January when the Montreal consulting firm WSP released a study commissioned by the state that examined multiple possibilities for a bridge or tunnel across the Long Island Sound. It concluded the project could cost as much as $55.4 billion and could only originate from Oyster Bay or Kings Park on Long Island. The study looked at nine different proposals and decided that five were worth further examination, with some connecting to Connecticut and others connecting to Westchester. It also suggested that the state look into bridge/tunnel combinations, although Cuomo has only committed to the idea of a tunnel. Local officials strongly oppose the project, citing environmental concerns.

SYRACUSE’S I-81 The state Department of Transportation first started looking at the best way to repair or replace a 1.4-mile section of Interstate 81 in Syracuse in 2008, with the initial study ending in 2013. Cuomo has repeatedly looked at building a tunnel to replace the aging viaduct that currently exists, despite the transportation department rejecting the idea and opposition from community members and local leaders like then-Syracuse Mayor Stephanie Miner. Cuomo ordered a new study to examine the possibility of a tunnel, which concluded late last year, that said while a tunnel is technically feasible, it would cost up to $4.5 billion and take as long as 10 years to construct. Two other possibilities would be far cheaper, according to the study. Rebuilding the viaduct would cost $1.7 billion, while another option to reroute traffic onto the existing city street grid and use I-481 for through traffic would cost $1.3 billion. Still, Cuomo instructed the department earlier this year to include a tunnel option in the project’s environmental impact statement.

LONG ISLAND SOUND LINK

The $1.7 billion project to repair a 1 1/2-mile stretch of the Brooklyn-Queens Expressway was announced in 2016, but the repairs have not started. The expressway has long suffered from crumbling infrastructure that, without speedy repairs, transportation officials have said the road will become so unstable that they will need to ban trucks from using it. As part of the state budget, the state Legislature recently approved the project to use design‑build procurement, which will reduce the price tag by an estimated $100 million. BUSINESS TO GOVERNMENT DIRECTORY: ENGINEERING & ARCHITECTURE

The past few years have seen a building boom in New York, with the city on pace to reach $150 billion in construction spending by 2019, according to the New York Building Congress. While mega projects such as Hudson Yards and the redevelopment of the World Trade Center site account for a sizable portion of the demand for qualified architects and engineers, the overall strength of the corporate sector and construction of new residential units are also driving the market. The mayor’s affordable housing push, coupled with recent rezonings such as Midtown East, should pave the way for new mega vertical projects requiring architects as well as structural, mechanical and electrical engineers. Building opportunities could accelerate once developers find ways to take advantage of the 421-a tax abatement program, which was updated last year. New York City already has undertaken some large infrastructure projects in recent years, including construction on the Bayonne Bridge, East Side Access, the Second Avenue subway, the No. 7 line subway extension and LaGuardia Airport redevelopment. Gov. Andrew Cuomo, moreover, has pledged to overhaul Penn Station and local officials continue to lobby for federal funds for the Gateway rail tunnel project. Many in the engineering industry, however, have PUBLISHER’S SECTION

been frustrated by the inability of Congress to deliver a sustainable funding base for long-overdue investments in infrastructure. The federal government has not raised the gas tax – which underwrites investment in road construction and mass transportation – since 1993. The design-build delivery system, which bundles together the design and construction phases of a project, represents a streamlined approach to building infrastructure that can potentially save time and money. The method is being increasingly used on public works around the country, but its adoption has faced political hurdles in New York City. The 2019 state budget granted design-build authority to expedite the construction of new jail facilities to replace Rikers Island and the rehabilitation of the Brooklyn-Queens Expressway and NYCHA projects. The $1.5 billion expansion of the Jacob Javits Center, underway since last year, marked the first time the Empire State Development Corporation, the state’s development arm, was allowed to employ the method. While engineers and architects see advantages in design-build, they caution that certain safeguards should be in place, and standards upheld. Industry leaders are currently engaging with policymakers and other stakeholders to develop best practices.

NEW YORK’S BUILDING BOOM On the legislative front, the 2018 priorities of the American Council of Engineering Companies of New York includes bills to protect engineering firms from indemnification demands that fall outside the control of consultants, as well as protection against lawsuits that firms may face as a result of providing emergency response services. ACEC also advocates for the expansion of Qualifications-Based Selection to more public entities, the exemption of capital funding from the local property tax cap, provision of mandate relief for municipalities, as well as investment in capital projects and the maintenance of existing infrastructure. While the Trump administration withdrew from the Paris climate accord last year, New York City continued to push ahead on its own ambitious goal of reducing carbon emissions 80 percent by 2050. Last year, de Blasio announced mandates requiring building owners to make steep reductions in greenhouse gas emissions, with penalties for those who fail to comply. Buildings account for 70 percent of New York City’s greenhouse gas emissions, so whether retrofitting existing buildings, incorporating green technologies in new ones, or helping form public policy moving forward, architects and engineers will continue to play a pivotal role in creating a more sustainable built environment for generations to come.
