In early 2011, shortly after I was hired at City & State, I visited a yoga center in the Berkshires with some friends. Shortly after arriving, we attended a “yoga dance” class. I noticed a man off to one side who was gamely following the instructor’s orders to dance like a monkey. He seemed oddly familiar. Then it dawned on me that he resembled a certain New York politician, although I wasn’t sure, since he was wearing glasses and was shorter than I expected. I saw him later that day in the dining area, alone with his meal. I couldn’t help but approach him. Are you in New York politics? “Yes.” Are you the New York attorney general? “Yes.” He seemed mildly annoyed with me, but explained that he occasionally dropped by the yoga center when he was in the area, where he had once served as a deputy sheriff. I kept the chat short – but I was thrilled to encounter a real political celebrity. Seven years later, the novelty of meeting big-name politicians like Eric Schneiderman has worn off. As we were all reminded last week, they’re not necessarily better than the rest of us – and sometimes, they’re much, much worse.

Latest The state Legislature will decide who to appoint as attorney general until the November election. Some want to simply keep Underwood in place, but lawmakers have given no indication, despite rumors, as to who they will choose. Many are saying the next attorney general must be a woman. A lot of Democrats have been floated as potential candidates, including Rep. Kathleen Rice, state Sen. Michael Gianaris, New York City Public Advocate Letitia James, former gubernatorial candidate Zephyr Teachout and former U.S. Attorney Preet Bharara – although Bharara’s candidacy may not go far since he made a name for himself targeting the state Legislature.
SCHNEIDERMAN SHOCKER On Monday night, The New Yorker published a bombshell story in which four women accused then-state Attorney General Eric Schneiderman of physical and psychological abuse while each was dating him. Publicly, Schneiderman had long been a crusader for women’s rights and against domestic abuse. The story led to immediate calls for his resignation, including from Gov. Andrew Cuomo and U.S. Sen. Kirsten Gillibrand. Within hours, Schneiderman had announced his resignation, though he continued to deny wrongdoing, saying the alleged abuse was simply “role-playing.” Solicitor General Barbara Underwood officially stepped in as acting attorney general on Tuesday.

VANCE DENIED Although Manhattan District Attorney Cyrus Vance Jr. had opened an investigation into Schneiderman, Cuomo had other ideas, instead appointing Nassau County District Attorney Madeline Singas as a special prosecutor. Schneiderman’s office had been looking into whether Vance mishandled an old criminal case against Harvey Weinstein, which Cuomo said would, at the very least, give the appearance of a conflict of interest. Vance disagreed, firing back that Cuomo’s decision was politically motivated. Cuomo stuck to his guns, saying giving the job to Vance would be “silly.”
Back & Forth C&S: What’s the biggest hole in New York City’s “sanctuary city” policy? CM: One of the biggest holes right now is confronting head-on the mayor’s decision to remove legal representation for all immigrants who need it. Our mayor has decided that there are some who deserve it and some who do not. And his line in the sand is based out of people who have been convicted of a certain amount of crimes. Due process is at stake here. In order for our judicial, criminal justice system to work, everyone must have representation. It’s not up to us as elected officials to decide who’s worthy of justice.

that have yet to make it into the governor’s office in a real way. Cynthia is for every New Yorker, not just a few. Cynthia is about putting action behind words that we have seen so empty from this governor. There is a real dangerous situation that we are putting all New Yorkers in across the state when we do not take that step to bring the DREAM Act, to bring the Liberty Act, to bring driver’s licenses for all. These are about public safety. This is about human dignity for every New Yorker and the economy. Cynthia not only has that vision; I believe in her, and I believe her when she says she’s going to fight for us. I believe her when she says education is about bringing resources to every school for every New York kid. But the state Senate isn’t the only legislative chamber that’s shedding members – several Assembly members are also declining to run for re-election this year.

Hikind, a powerful, often controversial, Brooklyn Democrat with some conservative social views, announced he would not seek re-election after 36 years in office. Hikind is endorsing Simcha Eichenstein, who works for the New York City mayor’s office, as his successor.

Staten Island Democrat Titone announced in March that he would not be seeking re-election, in favor of running for the Staten Island Surrogate’s Court. In Titone’s 61st Assembly District, Democrats have an overwhelming voter enrollment advantage.
Republican Marchione’s decision to step down came as a bit of a surprise, as she was first elected in 2012 after a bruising primary. There is a relatively open field to replace Marchione in her Capital Region seat.
Staten Island’s Castorina announced he would seek a Surrogate’s Court judgeship instead of running for re‑election. He also stepped down as chairman of the Staten Island GOP. The race has attracted a candidate, Republican Michael Reilly.
The longtime Republican chairman of the Racing, Gaming and Wagering Committee is ready to move on and spend time with family. Bonacic’s Hudson Valley district is considered winnable by Democrats.
Butler, a Republican representing parts of the North Country, announced last summer he would not seek re-election. The open seat has attracted several candidates, including Republicans Robert Smullen, Philip Lloyd Paige and Patrick Vincent, and Democrat Keith Rubino.
The 90-year-old Larkin is ready to retire. Several candidates are interested in the Republican’s Hudson Valley district. Democratic Assemblyman James Skoufis is weighing a run, as are Republicans Tom Basile and Mike Anagnostakis.
Oaks, a Central New York Republican, announced that he would be retiring in part because he had lost some enthusiasm for working in Albany. He has been the ranking member of the Assembly Ways and Means Committee for six years.
The Long Island Republican will not seek re-election, and will be rejoining the Navy. Contenders include Democrats Darrin Green and Patchogue Mayor Paul Pontieri and Republican Assemblymen Andrew Garbarino and Dean Murray, as well as Neil Foley.

FREE STREET PARKING IN MANHATTAN IS A RIP-OFF Stopping suburbanites from parking in Upper Manhattan should only be the beginning of parking reform.

OR ONE OF THE world’s most densely populated islands at the heart of a transit-rich city, Manhattan has a lot of free parking. This public subsidy for car owners exists in even the most expensive parts of the borough, where private garages charge as much for a parking space as it costs to buy a house in many cities. Unsurprisingly, demand is high for free parking in Manhattan. Residents have long complained of visiting drivers using their neighborhood streets as a parking lot. Bridge-and-tunnel folks don’t only park near their destination; some will park as soon as they enter
Manhattan and then take the subway. New York is contemplating policies to address the problem of too many people driving on the crowded streets of Manhattan, including congestion fees. (A small first step was taken in the new state budget, which added surcharges to taxis and ride-hailing services like Uber and Lyft.) A pair of recently introduced bills in the New York City Council would reserve the majority of street parking in Upper Manhattan for residents, though state and city transportation officials said that it would require enabling legislation in Albany to be implemented.
But one of the simplest ways to stop people from driving into Manhattan would be for the city to stop using valuable real estate as free parking. In his seminal book, “The High Cost of Free Parking,” UCLA urban planning professor Donald Shoup cited 16 studies showing that, on average, 30 percent of cars in congested traffic on city streets were cruising for parking. One 1995 study found that in Manhattan, drivers averaged more than 10 minutes searching for parking between 11 p.m. and 2 a.m. Shoup advocates charging a price that will reduce demand just enough to ensure that spaces are fully used, but without a surplus of drivers searching for free parking. In the New York City context, however, this could result in wealthier suburbanites snatching all the available parking spaces and leaving residents in lower-income communities frozen out. Most American homeowners park in their own driveway, but some cities have neighborhoods, like those in Manhattan, where residents rely on street parking. Such cities – Washington, D.C., for example – mostly regulate street parking on residential streets with a residential parking permit program. Reserving parking for local residents would discourage others from driving into the most congested parts of the city and prevent city neighborhoods from being used as a parking lot for suburbanites. It would also ensure that the people living there have access to parking, rather than whoever can afford to pay.

So residential parking permits could have benefits but also unintended consequences. If the city simply converted on-street spaces to resident permit parking, it would be easier for residents to drive on a regular basis since it would no longer be so difficult to find a space. That means it would be much easier to own a car as a city resident. Make something easier and you likely will get more of it. But does the city want more Manhattanites to own cars and drive around the city? That would undermine the benefits of reducing congestion and pollution by discouraging suburbanites from driving into the city. At the very least, the city should charge for the resident parking permits, at a price commensurate with the value of the land in the neighborhood. Shoup has demonstrated the perverse incentives created when governments effectively subsidize parking, such as increased traffic. It hardly makes sense to charge residents a fare every time they use transit, while providing a large plot of public land for them to park their cars for free. With rates geared

Our Perspective Workers Can’t Live on Sub-Minimum Wages!

o worker should earn less than the minimum wage, ever. But in many lowwage industries, including car wash, where many workers are represented by the RWDSU, that’s what has been happening for years. Now, however, there’s hope that this will change, and that countless workers in New York state – including car wash, restaurant, nail salon workers, and parking attendants – will be guaranteed to take home at least the minimum wage for their hard work. The RWDSU and other unions and workeradvocates are leading the charge to get rid of the so-called “tip credit,” which has allowed operators to pay workers well below the minimum wage on the theory that tips will more than make up the difference. In reality, however, this system has created a confusing web of different minimum wages that often provides employers with an outrageous license to steal. In many cases, including car wash, a mind-

boggling morass of differing sub-minimum wages – which can change weekly – leaves workers scratching their head over what their actual minimum wage is supposed to be. Hearings, ordered by Governor Cuomo, are being held throughout this spring and summer in Buffalo, Syracuse, Long Island, New York City, and Albany. Department of Labor officials are hearing first-hand about the struggles workers affected by sub-minimum wages are experiencing. Workers have testified about the inability to live in dignity because they can’t afford decent housing for their families, and how they can’t look for other work because they cannot afford adequate transportation. Workers struggle with paying their bills and putting food on the table. For the car wash workers in New York City – especially those without union representation – sub-minimum wages are a vehicle for wage theft and systemic underpayment. Investigations have shown that employers don’t always make up the
extra pay for workers when tips are short, and car wash workers don’t always receive the tips customers presume are going into their pockets. We shouldn’t be giving unscrupulous employers additional opportunities to underpay their workers, and that’s exactly what tip credit does in the car wash industry and many others. Car wash operators have been fined and directed to make restitution for wage theft to the tune of millions of dollars. In many industries, immigrant workers are particularly susceptible to tip credit-aided wage theft. Nail salon workers, deliverymen, car wash workers, restaurant workers; all are affected by wage theft and the sub-minimum wage loophole that makes it easier for employers to underpay them and even steal from them. The ongoing hearings are an important next step in ensuring that 5,000 car wash workers in New York now have a chance to earn fair wages for their work, and that no worker in the Empire State is underpaid and impoverished. It’s time to get rid of the tip credit, eliminate legal sub-minimum wages, and raise wages to make sure that all workers have a chance to thrive in New York.

New York City voters don’t seem to mind what their elected officials believe in – they just can’t be atheists.
W
HEN IT COMES TO RELIGION, New York City residents generally abide by the credo of “live and let live.” Voters in eastern Queens, for example, once voted for a self-identified heathen to represent them in the New York City Council. Sure, Dan Halloran’s adherence to the neo-pagan religion of Theodism was “a point of contention” in the 2009 race, but he won and served for four years – until he was arrested and convicted for his part in a scheme to buy a spot on the ballot for a mayoral candidate. But even in New York City, there may be one religious line that politicians are not willing to cross: godlessness. Based on a dozen conversations with City Council members, staffers and others in the political world, there doesn’t seem to be any city politicians, whether on the 51-member council or in the three citywide positions, who are publicly declared atheists, who do not believe in God or any higher power. Some questioned whether an atheist could get elected – even in ultra-liberal New York City. “Nones,” or those who aren’t a member of any religion, are a rapidly growing segment of the U.S. population. Roughly a quarter of people – both nationwide and in New York City – identify as atheist, agnostic or “nothing in particular.” These “nones” are part of the spiritual fabric of the Empire State, the most religiously diverse state in the country. But atheists are more rare – just 4 percent of the city’s population, according to a 2014 Pew Research Center study. That number seems to be zero percent among the city’s politicians. After all, there doesn’t seem to be anything to gain.
“Even in a city as liberal as New York, it’s still seen as somewhat perilous to self-identify as an atheist in politics,” said City Councilman Mark Levine, who said he strongly identifies as Jewish. New York City Public Advocate Letitia James, a self-described “church girl,” agreed that atheism could pose a problem in an election. “I know in some constituencies, that would cause an issue,” she said. “That would be a major issue.” City Councilman Ritchie Torres said the same. “It would cost you more than it would benefit you,” he said. Torres said he was a cultural Catholic who now identifies as a deist, adopting a philosophy that God created the world but does not intervene in its functioning. Deism, once adhered to by Thomas Jefferson, has a long history in American politics,
but Torres doesn’t have much opportunity to talk about it with his colleagues at City Hall. “Philosophy of religion does not tend to be the subject of debate at the City Council,” he said. Yet religion plays an undeniable role. Bronx City Council members Fernando Cabrera and Rubén Díaz Sr. are both Christian pastors. Queens City Councilman Eric Ulrich was once on a path to become a Catholic priest. And every City Council meeting begins with an invocation, an often lengthy prayer from a religious leader invited by a member of the council. Such prayers have been challenged by secular groups, but the U.S. Supreme Court has ruled that they are allowed. And even though former City Councilman Simcha Felder reportedly once tried to halt it, don’t expect the practice to stop.

The invocations at the council’s stated meetings do make some members feel uncomfortable, Levine said, “but no one wants to be the one who publicly pushes against that tradition.” After all, religion plays a role in many campaigns for elected office. “Institutions of faith remain among the most frequent stops of any campaign in New York City,” Levine said. “And that’s probably as true today as it ever was.” It’s certainly true of New York City Mayor Bill de Blasio, who has regularly appeared at churches, synagogues and other places of worship both while campaigning and while governing – even though he identifies as spiritual, not religious, and does not belong to any church.
De Blasio’s press secretary Eric Phillips told City & State the mayor’s lack of a church has never been an issue with voters. Opposition messaging blaring from vans in the 2013 mayoral campaign deriding him as “anti-church” and atheistic didn’t seem to hinder his landslide win. Since a handful of articles following his 2014 inauguration discussed his (lack of) religious views, the mayor’s beliefs have been largely ignored in the media. Occasionally opposed in matters of the budget, de Blasio and City Council Speaker Corey Johnson are aligned on matters of faith. Raised Catholic, Johnson now just considers himself “spiritual.” “I believe in a higher power, which is a source of comfort for me and something I can and have leaned on in troubling times,” Johnson
said in a statement provided to City & State. Politics is a tough job, he said, “and I like to think the universe has a plan that involves all of us.” City Councilman Daniel Dromm, like Johnson and Torres, is openly gay, a fact that led him to leave the Catholic Church in the 1980s. “There is some type of a god, but I don’t necessarily believe in religion,” he said. City Councilman Justin Brannan said he has struggled with his faith, but wouldn’t call himself an atheist. “I’m a big believer in faith in action,” he said. “Just going to church on Sunday, but then being an asshole the other six days of your life – why bother going to church?” Last month, four members of the House of Representatives – although none from New York – established the Con-
gressional Freethought Caucus, devoted in part to defending atheists from discrimination. Is such fear keeping some New York City politicians from identifying as atheists? A number of council members who others suggested might be nonbelievers declined to comment for this story. But one member saw nothing to fear. Brooklyn City Councilman Brad Lander is both a “proud and active Jew” and somebody who “wrestles with the divine.” His Park Slope congregation, Kolot Chayeinu, proudly declares itself as a place “where doubt can be an act of faith,” and Lander said his colleagues wouldn’t be judgmental either. “If I had certainty in nonbelief,” he said, “I would feel comfortable expressing it as a member of this City Council.”

The woman knew what he did was wrong, but she told herself it was a one-time incident, and that he was “a good attorney general” who was “doing good things” and she “didn’t want to jeopardize that.” Schneiderman claimed his innocence, chalking up these and other alleged acts of physical and verbal abuse to “role-playing” and “consensual sexual activity.” But a few hours after the story was posted last Monday evening, with startlingly similar accounts from four women, he announced his resignation. Now that a host of politicians are scrambling for a chance to succeed him, the question remains: Does it make any difference that he’s gone? In many ways, it doesn’t.

DARLING OF THE progressive movement, Schneiderman was supported in his first attorney general bid as a counterweight to the more centrist Andrew Cuomo, went on to build a national reputation by prodding the Obama administration to take a harder line against Wall Street after the financial crisis, and spearheaded a lawsuit against Trump University that set the stage for a legal onslaught against the White House once Donald Trump became president. And given the nature of the attorney general’s office, there’s little reason to think the man mattered more than the office. “With this particular New York resignation, it makes very little difference,” said James Tierney, a former Maine attorney general who led Columbia University Law School’s National State Attorneys General Program. “There’s a terrific staff that predates Schneiderman. They’ve been doing this a long time; there’s a lot of talent. I could not imagine that the Legislature would replace him, or the voters would replace him with someone who had a dramatically different view of politics or government. Specifically, I would think that Trump should not be breathing any easier today. I don’t think there will be any change – if anything, it will be more aggressive.” The office is being led for now by Barbara Underwood, who previously served as the state’s solicitor general and has a wealth of legal experience, including graduating first in her law school class at Georgetown University, clerking for U.S. Supreme Court Justice Thurgood Marshall and serving as the first female U.S. solicitor general. Cases filed by Schneiderman against Trump’s policies on immigration, the environment and health care are ongoing. While Schneiderman’s downfall is a blow to morale, more than 650 assistant attorneys general and over 1,700 employees will keep developing new cases to pursue, as they’ve always done. Schneiderman was also just one member of a sizeable coalition of Democratic attorneys general from states like California and Massachusetts who partnered on a slew of lawsuits, such as the 17-state effort to keep the Obama-era Clean Power Plan in place. Even if other attorneys general get less press than New York’s, they have taken the lead on other key cases, most notably the lawsuit against a ban on travel from several predominantly Muslim countries. “Sometimes New York is left out on purpose,” Tierney said. “A great example was the fight on the travel ban, which was led by Washington and Hawaii. I didn’t mean that the New York AG Schneiderman believed any less than the other AGs on that particular issue, but as a strategic decision they felt that it would be better to bring that case in 9th Circuit as opposed to the 2nd Circuit. These kinds of decisions are made all the time.” In the coming weeks, the state Legislature could name Schneiderman’s replacement, who would serve at least until voters make their own pick in the fall. Since the 150 members of the Assembly and the 63 members of the state Senate vote together, the Democrats – who hold 104 seats in the Assembly alone – can pick one of their own. The Assembly requested applications last week and will interview candidates this week, and will work with fellow Democrats in the state Senate and consider

Heastie said diversity is an important factor, and current and former officials in the office have said it’s equally important that a serious candidate with relevant experience and a strong legal mind fill the job to maintain the credibility of the office.

Apart from serving and protecting New Yorkers, that pathway is ample incentive for the officeholder to pursue high-profile cases that resonate with progressive primary voters – especially in a blue state like New York. Attorneys general do vary in how aggressive they pursue bad actors, though Schneiderman and his two immediate predecessors – both Democrats – have followed a pattern of running a proactive office. Robert Abrams, another Democrat who served as attorney general from 1979 to 1993, built the foundation of the office that exists today. Eliot Spitzer picked up where Abrams left off, wielding the state’s Martin Act to subpoena witnesses and seize documents while targeting financial firms and corporations. When Spitzer was elected governor, Cuomo picked up where he left off, investigating kickback schemes and unscrupulous student loan providers, although perhaps with less of Spitzer’s crusading zeal. When Cuomo was elected governor, Schneiderman took over and quickly made a name for himself by taking on Wall Street. But it wasn’t just that they were Democrats. Most of their tenures were also shaped by what was going on in Washington. Abrams filled a enforcement vacuum left under President Ronald Reagan. Spitzer took up consumer protection issues and battled financial companies that had more of a free rein under President George W. Bush. Trump’s presidency – and the myriad unpredictable moves that have come with it – began on Schneiderman’s watch.

In 2013, Schneiderman sued Trump University in a lawsuit the president settled before taking office. Trump’s real estate and other business dealings are natural targets, as are his and his family’s foundations, which have been scrutinized by the office’s Charities Bureau. Additionally, the Trump administration has taken actions that have frustrated many New Yorkers: blocking immigrants and refugees from entering the country, rescinding DACA, scaling back transgender rights, withdrawing from the Paris climate agreement, opening up offshore drilling in the Atlantic. And in a solidly blue state with a diverse population and strong support for progressive policies, there’s plenty to be gained politically by bringing cases against the White House, especially when attorneys general in New York are always looking to raise their profile. “Let me speak for myself: I would intend to be very aggressive against the Trump policies coming out of Washington that I believe are hurting New Yorkers, and they are plentiful,” said state Sen. Michael Gianaris, a potential candidate, echoing the views of countless others angling for the post. “We’re talking about immigration or health care or any other ways that Washington is doing things harmful to New Yorkers. So I would intend to continue a very aggressive approach.”

ACEBOOK FOUNDER AND CEO Mark Zuckerberg, out of his customary hoodie and instead dressed in a suit, showed up to testify before Congress in April. In the wake of reports that the voter-profiling company Cambridge Analytica harvested personal data of Facebook users in an attempt to better target political ads, Zuckerberg was summoned to the Capitol for what one observer called the “Mayweather-McGregor fight” of the tech world. The fallout was swift, and in many ways is still being sorted out. Some blamed Facebook for not ensuring more privacy for the social network’s 2.2 billion active users. Many felt cheated, and answered calls to delete their Facebook accounts. The episode cast a spotlight on Facebook’s use in elections, and how political actors target voters. Though good government group Common Cause filed complaints alleging Cambridge Analytica broke U.S. election law, the company insisted it did nothing illegal, asserting that other firms use data in a similar fashion. For good or for ill, what’s clear is that political advertising on social media platforms like Facebook is on the rise. Digital advertising has grown from 1 percent of political ad spending in 2014 to an expected 22 percent in 2018, according to research from advertising consulting firm Borrell Associates. In New York, candidates and campaigns are capitalizing on the social media site’s native advertising platform to get their message out to voters. In conversations with City & State, professionals who have bought and created local New York political ads on Facebook described the advantages of social media ads in 2018: hypertargeting, grabbing attention and planning for the future. FINDING THE AUDIENCE Cambridge Analytica was criticized for harvesting some 50 million Facebook users’ data and shopping it around to companies and campaigns, including that of then-presidential candidate Donald Trump. Much of the Facebook users’ personal information, such as where they live and what pages they like, was used by the company to sell targeted ads. That’s what made finding pro-choice voters a lot easier for Heidi Sieck. A longtime Democratic political operative who has worked on six presidential campaigns, Sieck founded the #VOTEPROCHOICE campaign in 2016 to back candidates who supported access to abortion “in every election, everywhere, no matter where it

C&S: What do you think the biggest benefits are of bringing Amazon’s second headquarters to the state? RS: There are benefits and there are burdens, and a careful assessment will have to be made. The costs will involve the incentives, which are unknown at this time. The benefits will include increased employment and wealth. And there is also the aspect of added congestion and infrastructure demands. So it is a mixed bag. C&S: What are some of the more concrete tech employment initiatives happening in the state? RS: One is an initiative by
Assemblyman Clyde Vanel in expanding the availability of the Excelsior tax credit to include companies involved in the development of blockchain technology. He will be introducing legislation shortly, and I will co-sponsor it, to allow such companies to more readily access the Excelsior tax credit program. The legislation will, for the first time, define such activities in state law. C&S: Do you think there is enough understood about blockchain and bitcoin to be moving forward with these kinds of initiatives? RS: All we can do is set out definition in law for what will
qualify, and if the initiative fits that definition, then the state should be satisfied. If a company fits that criteria, then it will be eligible for the Excelsior tax credit benefit. C&S: What do you see as the benefit of utilizing blockchain technology? RS: Far be it from the state of New York to stand in the way of technological advances or evolving elements of the economy. I have supported the Ubers and the Lyfts and I’ve supported Airbnb and other disruptive technologies. This legislation will be an attempt to keep up with changes and technological advances.

C&S: How are the efforts to expand broadband to underserved parts of the state going? JG: I would say it’s moving too slowly and not as smoothly as it could and should be. First and foremost, one of my concerns is, are we really getting into the unserved areas as quickly as we need to? And then shoring up the underserved areas before we continue to go into some of the more competitive markets. We also want to see competition in many of these communities across the state to ensure that people have a choice and they are being given the best opportunity from a broadband
perspective in making that choice. And in the end, I still think there are a lot of areas that are neglected, and obviously the objective here in contemporary society is that everyone should have this opportunity. This is no longer a luxury, but actually a part of being able to function in 21st century society, that these access opportunities need to exist. C&S: Does the state need to make deals with multiple companies to expand in the same area to bring competition? JG: Yeah, we’re a capitalistic society and I believe that competition and choice for
the consumer is beneficial. But we also have to look in areas that are unserved, and it may not be financially feasible for some of these companies to go in. So there’s got to be a myriad of an approach here in trying to ensure that we fulfill the mission, and the mission is to have access to broadband across the state. More opportunities for choice and competition could be beneficial to the consumer. But again, in some cases, you need to look at it a little differently because if you’re in an unserved rural area, you may have to work on some incentivizing in order to get somebody to do what needs to be done.

C&S: How is the OneNYC initiative to bring broadband to all New Yorkers going? SS: It’s going well. There are different parts to the pro‑ gram. The first part is the effort to bring broadband on our streets, which is the high‑speed public Wi-Fi strat‑ egy. And that is tied to the LinkNYC kiosks. So the Link deployments, things are going very well. We just briefed the City Council on this and we have another briefing as part of a budget hearing next week on it. So we have 1,500 Links deployed, scattered across the boroughs and that’s going quite well. I think it’s 3.5 mil‑ lion active subscribers using
free, high-speed public Wi-Fi from the Links. And I think the other metric I just saw is we’re seeing double-digit growth in the number of subscribers every year since we deployed the Links. C&S: You’re fairly new to the job. What do you consider to be your most important role? SS: I’m still two months in. But really, I’ve broken down our core objectives into three parts. The first is going all-in into achieving digital equity for all New Yorkers. Digital equity implying equitably distributed, affordable broad‑ band in every home, on ev‑ ery street, in every borough.
The second one is really a focus on DoITT as a shared services provider. DoITT pro‑ vides a set of IT services to serve our internal agencies. We have over 100 agencies that we support in different ways. So the first objective I’ll have for our agency is to really transform ourselves more ful‑ ly and entirely into operating like an external service com‑ pany. Less a call center, in‑ ternal service order taker. So it’s a big cultural shift for us, but the idea is to really start transforming how we interact with agencies: treat them like customers, have a menu of services that are really easily understood and explainable and measurable.

5 big technology issues New York is facing now By REBECCA C. LEWIS
At times, it can feel like technology is advancing faster than people are able to keep up with. It can also be hard to remember what it was like before things like smartphones became commonplace. But regardless of whether or not people are ready, technological advancements continue at full speed. The rules and regulations that need to be put in place to address those advancements tend to move at a slower pace. Here are five major tech‑related issues in New York as the state contends with a future full of change.
NET NEUTRALITY The Federal Communications Commission rule change ending net neutrality went into effect on April 23, but only partially. Net neutrality technically still exists, for now, since large portions of the plan still await approval from the Office of Management and Budget. Broadly, net neutrality is the principle that internet service providers should treat internet content equally, without favoring or hindering any particular site. Democrats have been rallying across the country to save net neutrality. Former state Attorney General Eric Schneiderman filed two lawsuits in an attempt to block the FCC from rolling back the regulations. Gov. Andrew Cuomo signed an executive order in January meant to protect net neutrality in the state, telling internet service providers that if they did not continue to observe the policy, they would lose their state contracts. More recently, state Sen. Brad Hoylman introduced legislation in collaboration with California state Sen. Scott Wiener that would write into state law the protections that net neutrality is meant to provide. Most notably, the legislation would make it illegal in New York for an internet service provider to slow down, or throttle, access based on content as well as charge customers fees for preferred service.

TELECOMMUNICATIONS CONSOLIDATION The state allowed Charter Communications to purchase Time Warner Cable last year. The deal was that Spectrum, Charter’s brand that provides internet and phone services, would expand its high-speed broadband access to parts of upstate New York and New York City that did not previously have access as part of Gov. Andrew Cuomo’s Broadband for All program. However, the process has not been going smoothly. In March, the state Public Service Commission, which initially approved the acquisition, issued two orders against Spectrum. One asserted the company was not living up to its promise to expand broadband. The other began an investigation into whether the company is complying with the franchise agreements it made with New York City. The PSC is also trying to get Spectrum to pay a $1 million fine for failing to live up to the broadband agreement, something the company said was not true.
ELECTION CYBERSECURITY In the wake of Russian meddling in the 2016 elections, Cuomo pledged to improve New York’s election security. It was a key point of his State of the State address, when he unveiled his democracy agenda to protect the state’s election integrity. The state invested $5 million as part of the budget passed in March to bolster the state’s defenses against cyberattacks. That money will be used on what Cuomo called “a four‑pronged strategy.” The first part sets up an election support center that will provide cybersecurity training to county elections officials. The next is to create a cybersecurity toolkit to ensure that both state and county election boards have access to the proper tools to address threats. The third prong provides boards with vulnerability assessments from the state Office of Information Technology Services. And lastly, county officials will be required to report any breaches to the state Board of Elections, which would then put out annual reports on the status of election and voter security. In April, Cuomo signed the Democracy Protection Act, which is meant to bring transparency to political advertising in order to minimize outside influence on elections.

DIGITAL CURRENCY REGULATION In 2015, the state Department of Financial Services issued new rules in order for digital currency companies to operate in the state. To do so, they needed to apply and receive a BitLicense. Many bitcoin companies did not take well to the new regulations, resulting in an exodus out of the state – at least a dozen companies decided to leave. To date, only four companies have received a BitLicense: Circle, Ripple, Coinbase and bitFlyer. A bitcoin entrepreneur sued DFS in 2015 over its regulations, saying the agency was overregulating the industry. The suit was eventually dismissed in January. However, dissatisfaction with the rules have not completely gone on deaf ears. In February, state lawmakers held a roundtable to hear the concerns of bitcoin businesses about BitLicense and indicated they may revisit the regulations. State Sen. David Carlucci told the news outlet CoinDesk that he would introduce legislation to reform BitLicense “very soon.” In the other chamber, Assemblyman Ron Kim introduced legislation in February to make it easier for bitcoin companies to operate in New York by eliminating both the license fee and the license itself. Assemblyman Clyde Vanel also proposed legislation in February to create a study to examine the possibility of a state-backed cryptocurrency.
STATE INTERNET SALES TAX An internet sales tax in New York, for the time being, appears to be dead. In his executive budget this year, Cuomo proposed what he called the Internet Fairness Conformity Tax, which would require large online retailers like Amazon and eBay to collect a sales tax when a third-party sells through them to a New York customer. According to Cuomo, the tax could generate $89 million. However, the proposal faced strong opposition from Republicans in the state Senate. Ultimately, the proposal did not make it into the final budget, but the internet sales tax may yet return. This was not the first time that Cuomo has proposed the tax, and though it has always been shot down by Republicans in the state Senate, the governor may finally be able to enact the tax if Democrats manage to reclaim the chamber in November.

I’d like to think that was my idea, but it wasn’t. Clearly it took them more than a couple weeks to write. It had been something that was in the hopper. When I started there (it seemed) that having a woman leader in that role provided people with an opportunity, an opening to push the envelope a little bit more. That was profoundly important to me. The ability to make sure that it’s the type of place that can attract and retain really talented women over the years will only serve that organization well.”

It could have been that in her entire life, and she was 6 at the time, she only would have known a black president and a woman president. And I had to tell her about a different reality. And it reminded me in that moment, and to this day, that this work is so important and it’s never linear.”
