After Gov. Andrew Cuomo finalized his policy-laden state budget in April, he suggested there was little left to accomplish. “If we didn’t get it done in the budget, it means you don’t have the political will to get it done,” the governor said, adding, “Frankly, everything big we wanted to get done we got done in the budget.” Of course, Cuomo’s assessment reflects his own political will as much as anyone’s. As Albany observers know, the governor’s structural power and political skill usually are enough to persuade state lawmakers to pass what he wants. If ethics reforms and tuition assistance for undocumented immigrants were top priorities for him, he likely could get them done. Indeed, while tying policy legislation to the budget increases the odds of success, two of the governor’s landmark legislative victories – the legalization of same-sex marriage and passage of the SAFE Act gun control law – were passed on their own. In this edition, we highlight issues that are still being debated in Albany – even if they aren’t “big” enough for Cuomo.

C&S: The Puerto Rican Day Parade is June 11, and there’s controversy about honoring Oscar López Rivera. How do you feel about him be celebrated as a National Freedom Hero? NV: For many of us, Oscar López Rivera is our Nelson Mandela. We cannot overlook the abuse of power from the federal government, the FBI, and the (U.S. Department of Justice) by imposing such a severe sentence of 70 years for a seditious crime. Not even presenting evidence that Oscar López Rivera was even involved or a co-conspirator to (the Fraunces Tavern bombing) that was committed here in New York. So there was no evidence at all. He was in Puerto Rico. He wasn’t here at the time. So 70 years for a seditious crime is an abuse of power. No matter how you look at it. The only crime that he committed in my view was to love Puerto Rico and to pursue the freedom of Puerto Rico. C&S: Some accused the New York City mayor’s office of inappropriately stoking fears around federal immigration officials visiting a public school and asking for a student. Did you think that was the case? Are you concerned about unprecedented steps from immigration agents? NV: Whether or not the mayor’s reaction was without checking first or trying to get to the bottom of the facts, it shows how much fear exists in the immigrant community. And I think that the mayor did the right thing because people need to know. And especially our children and the parents of our children, that they have in the mayor someone who will be standing up to the ill, mean-spirited policies coming out of the White House. DE-KLEIN-ING FORTUNES Already dogged by a stipend scandal that has caught the attention of prosecutors, state Senate Independent Democratic Conference Leader Jeff Klein is facing calls to break off his relationship with state Senate Republicans. The push also comes as Democrats regained a numerical majority in the state Senate with Brian Benjamin winning an open Harlem seat. Smelling blood, the Working Families Party criticized Klein for empowering “Trump” Republicans. Minnesota U.S. Rep. Keith Ellison, a Democratic National Committee leader, said he would try to “bring together a Democratic majority in the New York state Senate.” Even state Sen. Simcha Felder, a Brooklyn Democrat who caucuses with the GOP, called on Klein to “unconditionally and publicly rejoin the Democrats.” TRUMP UP THE VOLUME Facing an onslaught of negative headlines about ties with Russia, President Donald Trump’s administration changed the subject by introducing a budget proposal that would reduce spending by a whopping $4.5 trillion. It was widely criticized in New York, where Gov. Andrew Cuomo said the social safety net cuts would be “devastating” and New York City Mayor Bill de Blasio said “children will die” if the plan goes through. DE BLASIO IN DA BRONX De Blasio held his latest City Hall in Your Borough, relocating to the Bronx for the week to take questions and roll out a few announcements. The diehard Red Sox fan displayed his aversion to the local New York Yankees, but perhaps the biggest development was an announcement that he now supports a long-delayed plan to convert the Kingsbridge Armory into an ice rink complex.

SE JODIO THE PR PARADE IF THE “BLUE FLU” HITS TOWN There’s a buzz in municipal labor circles that as June 11 gets closer there’s going to be an outbreak of “blue flu” that will spread among the NYPD rank-and-file. The mass “sick day” among police officers would be a means of protesting the presence and designation of Oscar López Rivera as a National Freedom Hero by the National Puerto Rican Day Parade’s board of directors. Bochincheros tell us that New York City Patrolmen’s Benevolent Association President Patrick Lynch – who’s very creative in finding ways to deal with people that the PBA opposes (just ask Mayor Bill de Blasio) – already has this in mind. “If the blue flu hits the rank-and-file, it could put the parade at risk of taking place,” said a bochinchero who is familiar with the operations of these big events. “The permit to march on Fifth Avenue could be revoked if security can’t be guaranteed.” I bet the board didn’t see this one coming. SCHNEIDERMAN BEING SERVED AN ARROZ CON CU ... Fed up with the mess that the National Puerto Rican Day Parade board of directors has created, there’s bochinche among well-known puertorriqueños that they want a meeting with state Attorney General Eric Schneiderman. “He (Eric) handpicked the leadership and let Melissa (Mark-Viverito) politicize the process. It’s time for him to step in,” said one of the bochincheros who’s not happy with the attorney general. B&B was told that Schneiderman “won’t get involved unless there’s some misappropriation of funds or some other administrative matter that affects the organization.” We hear that’s not going to sit well with folks that have lost faith in the current board leadership. Stay tuned.

NICOLE GAINING TRACTION The late entrant into the 2017 New York City mayoral race, Assemblywoman Nicole Malliotakis, is being viewed favorably among Republicans. One bochinchero said, “She’s energetic and engaging.” There are others who feel that Malliotakis “beats Massey in the primary but loses in the November general.” There is consensus that the debates between Malliotakis and Massey will be fun to watch. What’s telling among Republicans that we’ve spoken to is that “Paul Massey is his own worst enemy.” Two bochincheros agreed, with one saying, “He’s a nice enough guy, probably makes a good neighbor, but he’s low energy. The 2017 version of Jeb Bush.” One knowledgeable GOP bochinchero emphasized that Massey is “probably a good neighbor, but would make a shitty mayor.” I’m sure some of you are thinking, “We already have that at City Hall.”

LIU VS. AVELLA REMATCH One Queens bochinchero – a lifelong Democrat and county insider – told B&B that there’s a groundswell of support among the regulars to convince former New York City Comptroller John Liu to primary state Sen. Tony Avella, a member of the Independent Democratic Conference. “He (Liu) was a little radioactive then (in 2014), but he’s going to have solid support now. Tony has very few friends in government.” That support from the county organization and “a good look at the numbers in their first race” should be enough to get Liu a victory in a primary, according to the bochinchero. Democrats in Queens are already buzzing about Assemblyman Francisco Moya taking on state Sen. José Peralta, another IDC member. However, if professor Liu decides that academia isn’t cutting it for him this could be a pelea to look forward to. Let us pray! JOHN LIU

Our Perspective NYC Sends a Message by Banning On-Call Scheduling By Stuart Appelbaum, President, Retail, Wholesale and Department Store Union, RWDSU, UFCW

W

orking in retail in New York City can be a tough way to make a living. Low wages and insufficient hours can make it a struggle just to get by. And, until now, retail workers have faced the brutal practice known as on-call scheduling. But finally, thanks to a new law passed by the New York City Council, with Mayor de Blasio set to sign it soon, on-call scheduling will be a thing of the past. The RWDSU is proud to have led the fight against on-call scheduling, which disrupts workers’ lives and their families’ lives by requiring them to keep themselves available when they are not scheduled to work with no guarantee of an actual work shift. We work with retail workers, both unionized and nonunionized, every day. And we know how on-call scheduling has made it impossible for workers to take a needed

second job or plan for the basic necessities of their lives, including child care, education, or medical care. That’s why the passage of Intro. 1387 is so important. The new law will restore control and balance to the lives of working people in New York City. The law bans New York City employers from scheduling workers to be on call. Employers will not be able to cancel a shift within 72 hours of the start of the shift except under extreme conditions like a natural disaster. Employers can only add shifts within 72 hours with workers’ consent. The new law takes away from employers a cruel, exploitative computer-driven system designed to optimize employer profits while sacrificing any considerations for working

men and women. It will restore control and balance to the lives of working people in New York City. Retail workers deserve to thrive, not just survive. We applaud the city council’s action, and look forward to the mayor signing this bill into law. The de Blasio Administration’s partnership with the RWDSU to support workers sets a national precedent that will be felt across the country. It’s important that more cities recognize the destructive effect of on-call scheduling and ban the practice. Retail workers deserve to thrive, not just survive. And banning on-call scheduling is an important part of setting an environment where retail workers can move forward and build better lives.

MEN BLACK EVERYBODY IN ALBANY SHOULD BE WORRIED ABOUT THE FEDS’ LULU PROBE By EDDIE BORGES DEMOCRATS AND REPUBLICANS in both the state Senate and Assembly must be getting hot under the collar since learning that the acting U.S. Attorney for the Eastern District of New York is sending federal investigators to Albany to look into a legislative slush fund unknown to most voters. Of course, for this latest investigation of public corruption in the state Capitol, legislators can thank the cannibals among the state Senate Democrats who have been trying to make a meal of their colleagues who formed the Independent Democratic Conference. Once the feds arrive in Albany, they are unlikely to limit their investigation to the IDC members that the Democrats were targeting. Investigators will be legally obliged to follow any leads they find, in whatever direction that takes them.

But it’s not only state legislators who should be worried. The majority parties in county legislatures across the state also may get some unwanted attention as media outlets work to localize the story. The legislative stipends, or “lulus,” are payments to members of the state Legislature for chairing committees and task forces, or for holding leadership positions. Until this week, most New Yorkers had no idea that on top of the $79,500 annual salary legislators collect, almost all of them have been nickel-and-diming taxpayers with extra fees for work presumably covered under the job description for “state legislator.” The minority party conferences, the Democrats in the state Senate and the Republicans in the Assembly, get some leadership lulus, but are locked out of the more

lucrative lulus for committee chairs. This includes the legislator who is leading the charge for a criminal investigation. State Senate Minority Leader Andrea Stewart-Cousins gets the third-largest payment of any member of the state Senate from this legislative slush fund. Last week, Stewart-Cousins announced she was shocked – shocked! – that there was gambling in the casino and demanded a probe into the payments that some IDC members were getting even though they were not committee chairs. That’s pretty daring for several reasons: • Stewart-Cousins takes home an annual $34,500 lulu for serving as minority leader. • Democrats and Republicans, just two months ago, breathed a huge sigh of relief when President Donald Trump fired U.S. Attorney Preet Bharara. He was investigat-

ing leads developed by the Moreland Commission to Investigate Public Corruption, which state legislators had pressed Gov. Andrew Cuomo to shut down before it finished its work. • And, finally, there is the abuse of the system that the lulu represents, which editorial boards around the state have been writing about for decades. And now, reporters and editorial writers are back on the lulu beat. Lulu is short for “payment in lieu of expenses.” Yet, a review of the Legislature’s budget will show that legislators who collect lulus are also still putting in for expenses. In the state Legislature, they refer to their expenses as per diems. For each day spent in Albany, New York legislators each collect $172, even if they live within walking distance of the state Capitol. But even that is not enough for some legislators, and every couple of years some of them go to jail for falsifying expenses. Maybe instead of “per diem,” the more honest name would be the “double-dip.” Legislators have been whining for years that they are underpaid; yet they have not had the courage to vote for a raise for themselves, as the law allows. Instead, they’ve

been dipping into the state treasury for extra fees. And now the feds have accepted Stewart-Cousins’ invitation to swarm Albany and review legislators’ financial records – the ultimate nuclear option in the bloodletting between mainline Democrats and the Independent Democratic Conference.

of trying to harness voters’ discontent with the national election by reinvigorating the state party to elect more Democrats, the leader of the state Senate mainline Democrats is plotting to run candidates against fellow Democrats. And now she’s compounding her failures by encouraging the feds to sift through the muck.

MAYBE INSTEAD OF “PER DIEM,” THE MORE HONEST NAME WOULD BE THE “DOUBLE-DIP.” Now any chance of Stewart-Cousins ever reuniting Democrats in the state Senate is likely over. That’s probably why she’s exploring running for county executive in Westchester. Why endure another legislative session with the “three men in the room” hammering out important decisions while she peers through the keyhole? It didn’t have to be this way. Stewart-Cousins’ decision not to reach out to IDC Leader Jeffrey Klein following the 2016 election was a failure of leadership. Instead

New York Democrats want him gone. But their problem is with his style more than his substance. By ROSS BARKAN

EMOCRATS EVERYWHERE ARE dreaming of President Donald Trump’s impeachment. It’s only a matter of time, they say, until the corruption catches up to him and the House and Senate stand together to terminate this national nightmare. For most of them, it’s merely a question of when, not if. A recent piece in The New Yorker, a publication as fervently anti-Trump as any mainstream news outlet, is dedicated to this possibility, exploring the myriad ways Trump’s first term could be cut short. “Trump’s critics are actively exploring the path to impeachment or the invocation of the 25th Amendment, which allows for the replacement of a president who is judged to be mentally unfit,” Evan Osnos writes. Undoubtedly, Trump’s failure to divest from his business ventures, his possible violation of the Constitution’s emoluments clause – a ban on presidents accepting gifts from foreign states – and his sudden firing of FBI Director James Comey all demonstrate he has a gross disregard for ethics. An independent investigation – whether helmed by newly named Justice Department special counsel Robert Mueller or an independent commission – must air all the facts about his contact with the Russian government. Whether Trump survives four years will ultimately come down to the composition of the House and Senate. If Democrats can defy long odds and retake the House in 2018, they can begin impeachment proceedings and, armed with subpoena power, can make Trump’s life very difficult. Republicans know next year’s midterm elections could be particularly disastrous. Yet the Democratic obsession with deposing Trump obscures several uncomfortable truths. For one, Trump’s vice president is Mike Pence, who, if Trump were successfully impeached and forced out of office, would be the most unabashedly right-wing president of the last half-century, if not longer. He’s a man far more committed to realizing the Koch brothers’ Hobbesian, ultra-capitalist dystopia than Trump, who is a leader without a fixed ideology beyond allegiance to his own ego. As much as the left decries Trump’s attempts to end democracy as we know it, a Pence presidency represents something far more dangerous. This isn’t immediately obvious because Trump is, for a large swath of America, a terrifying president and a mercurial bully with the Twitter feed fit for the WWE personality he once was. He is a rash and extremely erratic man now blessed with

vast and dizzying powers. He does not read; he does not learn. Other than shedding the veneer of liberalism he adopted for his days as a New York socialite, very little about his personality has changed in the past 40 years. Many media talking heads and Democrats, however, appear to be more concerned with Trump’s style than his substance. House Minority Leader Nancy Pelosi said last month that she “never thought (she’d) pray for the day” George W. Bush was president again. CBS News’ “Face the Nation” moderator John Dickerson recently lament-

ed the “coarseness” coming from the White House, and the ways Tom Perez, a Democratic National Committee chairman unafraid of foul language, is encouraging a race to the bottom. Bemoaning how Trump is not presidential has become something of a cottage industry. The subtext here is that the establishment left and mainstream media, each cloistered in their affluent urban enclaves, would tolerate Trump a lot more if he just started acting like the president from “The West Wing.” If only he had the sophistication of Barack

Obama, the grandfatherly mien of Ronald Reagan, or the down-home sunniness of Jimmy Carter. If only he showed up at the White House Correspondents’ dinner and stopped saying mean things about the media on Twitter. If only he was cool, calm and collected, projecting the image of a leader that an educated American, prancing through Europe on holiday, could be proud of. Pence, the potential 46th president, would punish progressives with more competence and gravitas. A former congressman and governor with a lifetime’s worth of rela-

tionships on Capitol Hill wouldn’t struggle so mightily to rewrite the tax code and eviscerate Obamacare. He wouldn’t let a budget go by without slashing and burning Planned Parenthood because he’s a man of God who knows how to work the levers of government to screw over women. He wouldn’t hesitate to launch a war in Syria because he’s not an isolationist paleocon – he’s the good Republican foot soldier who proudly cheered on Bush’s Iraq War. Speaking of Bush, it’s amusing that Pelosi is suddenly nostalgic for those eight years that inflicted far more damage on the country and world than Trump could hope to match, barring a nuclear showdown with North Korea. As of today, there is more blood on the hands of Bush and every politician who voted for the Iraq War than Trump’s – and that includes his vanquished opponent and hero of the so-called resistance, Hillary Clinton. The toll is still staggering to comprehend: hundreds of thousands of Iraqis and more than 4,000 U.S. troops dead, the entire Middle East in flames, with ISIS as Bush’s sinister parting gift to the world, and the ensuing global chaos that will likely characterize much of the 21st century. The fundamental weakness of the establishment left – the Democratic Party and its many pundits and operatives scattered across the media and in various consulting and lobbying shops – is laid bare with every lamentation of Trump’s uncouthness. Bush built a surveillance state and a military machine designed to ensure the U.S. remains permanently at war. Democrats enabled and encouraged this state of affairs under Obama because he was their executive. As long as he was launching drone strikes with a smile, all was good in Washington. Would it be better for Democrats if a seemingly sober, clean-cut Republican blocked Muslims from entering this country or did his best to destroy the U.S. Environmental Protection Agency? Would they sleep better at night if President Ted Cruz or President Marco Rubio fought hard to privatize Medicaid and Social Security, obliterating whatever is left of the New Deal consensus? Eventually, Trump will no longer be president and American democracy, despite all the wailing to the contrary, will have persisted. What form it takes under the next Democratic president will tell us whether the Trump years taught us anything.

HEN A BELATED STATE budget agreement was announced in April, officials gave themselves a pat on the back. Gov. Andrew Cuomo touted an increase in education aid, a free tuition program for some public university students and more than a dozen other measures – while keeping overall spending in check. Democrats joined the governor in applauding a law raising the age of criminal responsibility to 18. Republicans praised the new workers’ compensation reforms. And members of both parties welcomed the expansion of ride-hailing services in upstate New York and the allocation of $2.5 billion for clean water infrastructure. “With this budget, New York is once again leading the nation and showing what responsible government can achieve,” Cuomo boasted. But while the state budget was jampacked with new spending commitments and policy changes, there’s plenty that didn’t get done. To cite a few examples, lawmakers are challenging Cuomo’s oversight of state economic development programs, state Senate Republicans are holding up mayoral control of New York City schools and a battle over vacation rental websites like Airbnb has reignited. Tensions between Flanagan’s conference and New York City Mayor Bill de Blasio were heightened after a failed effort by the mayor to oust state Senate Republicans from power in 2014, and since then mayoral control has been extended only for one year at a time. Assembly Speaker Carl Heastie, a de Blasio ally, rejected the linking of charter schools and mayoral control, which expires in June.

NEW YORK CITY’S now-annual fight over who should control the nation’s largest school system is officially underway. On the same day the Assembly passed a two-year extension of mayoral control, the state Senate majority leader threw down the gauntlet. In a letter to Mayor Bill de Blasio last week, John Flanagan wrote that the way New York City released its school budget information “does not satisfy the law” and does not allow for a “meaningful analysis” of an extension of mayoral control. “A fundamental shortcoming of this administration has been a lack of transparency and response to requests for information,” the letter reads. “The lack of detail on how New York City spends the almost $9 billion provided to it by the state has been one of the key determining factors in a short-term extension of mayoral control.” City officials said the information Flanagan requested would be available online by the end of the week. Freddi Goldstein, a spokeswoman for the mayor’s office, addressed Flanagan’s letter directly. “Senator Flanagan received the information required by law and more,” she wrote in

a statement. “It’s time for the Senate Republicans to stop playing games and let the city get on with the work of educating our 1.1 million kids.” For the past two years, de Blasio has been granted only one-year extensions of mayoral control, even though he asked in 2015 for mayoral control to be made permanent, and in 2017 for a “multi-year” renewal. This year, it briefly appeared that a oneyear extension might be slipped quietly into the budget deal, but that did not come to pass. Now, the issue will likely be resolved this summer, leaving plenty of time for another back-and-forth between state Senate Republicans and de Blasio. State lawmakers have capitalized on that opportunity in the past. After de Blasio’s hearing last year, Flanagan said de Blasio displayed a “disturbing lack of personal knowledge about city schools.” De Blasio then skipped the next hearing, which allowed lawmakers to make another round of critiques.

This year’s state budget included Gov. Andrew Cuomo’s marquee free tuition program, although it is somewhat limited in that it only covers last-dollar costs for certain in-state residents at SUNY and CUNY schools. In a last-minute change, state Senate Republicans inserted a controversial mandate that scholarship recipients would have to work in-state for four years after graduation or have the funds converted to a loan. Some Assembly members have proposed to loosen the requirements, including on taking a full credit load or the fouryear graduation timeline, and the education committee chairs in both houses have raised issues about insufficient state funding.

FEDERAL BUDGET CUTS

Last week, President Donald Trump’s administration rolled out its 2018 budget proposal, which the state Education Department said would reduce education aid to New York by $433.5 million. While many observers expect Congress to ultimately pass a budget with less draconian cuts, state Education Commissioner MaryEllen Elia and Board of Regents Chancellor Betty Rosa warned that the proposed cuts “will have far-reaching impacts across the nation, with life-shattering consequences for New York’s children.”

Following widespread outcry among teachers, parents and elected officials, the state Department of Education announced that it would revise and rebrand the controversial Common Core standards. This month, the new education standards – dubbed the Next Generation English Language Arts and Mathematics Learning Standards – were officially rolled out following an extensive review, and the Board of Regents are expected to vote on the changes in June. LAWMAKERS HOME IN ON AIRBNB AND PROPERTY TAXES By ASHLEY HUPFL

GOV. ANDREW CUOMO and New York City Mayor Bill de Blasio have tried to stem the rising tide of homelessness, but housing continues to be a major issue across the state. Here is a rundown of some of the measures on the table in the final weeks of the state legislative session. VACATION RENTAL WEBSITES Last October, Gov. Andrew Cuomo signed legislation that targeted websites like Airbnb by penalizing residents who rent out their apartments on a short-term basis. Airbnb challenged the law in court, and in Albany this session the company is pushing for legislation sponsored by Brooklyn Assemblyman Joseph Lentol that would create exceptions to allow for more vacation rentals. The Hotel and Motel Trades Council, a union opposed to Airbnb, and its allies launched a counteroffensive against the measure. PROPERTY TAX REFORM New York City’s property tax system has long been criticized as unfair, with lower rates in wealthier areas and higher rates in poorer areas. City officials have pledged

to address the matter, but due to the complexity of the tax code and the political risks of changing the status quo, not much has been done. State Sen. Betty Little, the Republican chairwoman of the state Senate housing committee, has called for a commission to review and recommend changes to the city’s property tax system. Separately, in response to concerns about high property taxes outside of New York City, state Senate Republicans passed legislation that would make the governor’s property tax cap permanent. FEDERAL BUDGET CUTS President Donald Trump’s proposed budget for 2018, which he rolled out last week, would slash funding for a number of programs, among them public housing. While Congress is expected to ultimately pass a budget with less drastic reductions, New York officials have assailed the cuts, including to the U.S. Department of Housing and Urban Development’s Community Development Block Grant program. “This plan would also hollow out the Community Development Block Grant initiative, which funds

Meals on Wheels and is critical to many of our communities,” warned U.S. Rep. Nydia Velázquez. If the cuts go through, city and state lawmakers will have to explore ways to cover the shortfall. WHAT GOT DONE The 421-a tax abatement program was renewed in the state budget as the Affordable New York housing program. Under it, developers of new residential projects with at least 300 units of affordable housing in certain areas of Manhattan, Brooklyn and Queens that meet construction wage requirements and maintain a set number of affordable rental units for 40 years will qualify for a full property tax abatement for 35 years. For all other affordable developments, eligibility will be tied to the number of affordable units. The Cuomo administration estimates this will create 2,500 affordable units each year. The state budget also allocated $2.5 billion for affordable housing projects, as part of a $20 billion five-year plan. The funding aims to create or preserve 100,000 affordable housing units and 6,000 supportive housing units.

AS TRAINS BREAK DOWN, LAWMAKERS HAVE YET TO ARRIVE AT FIXES By JON LENTZ NEW YORK CITY’S subways are bursting at the seams, with commuters cramming into increasingly overcrowded cars and signal malfunctions contributing to a steady uptick in delays. Derailments on the downstate commuter rail network have reverberated across the system. And while elected officials emphasize highprofile expansion projects, such as the Second Avenue Subway, maintenance and upgrades have languished. It’s hit a boiling point in recent days, with elected officials trying to deflect blame. New York City Mayor Bill de Blasio and Gov. Andrew Cuomo clashed over who controls the Metropolitan Transportation Authority, which manages much of the region’s mass transit system. The governor then shifted attention to the White House, calling on President Donald Trump to help deal with New York Penn Station’s

track closings this summer. Cuomo also appealed to the public for “groundbreaking and innovative solutions” to the problems. But lawmakers already have ideas about how to improve the system, starting with ensuring that the more than $30 billion in capital funding for the MTA is actually spent. “A few years ago, the five-year capital plan allocated an enormous amount of money, probably not enough, and that money needs to be spent appropriately and in a very timely fashion, and that doesn’t always happen,” said Assemblyman Jeffrey Dinowitz, who chairs the Committee on Corporations, Authorities and Commissions, which has some oversight over the MTA. The Bronx lawmaker said that securing more money is also part of the solution, and echoed a concern raised during this year’s

budget process: Cuomo cut the MTA’s funds by $65 million. The administration argued that the loss was more than made up elsewhere, but lawmakers and transit advocates have continued to hammer away at the issue. “We fought, and we ultimately were not successful, but he cut the MTA budget by $65 million,” Dinowitz said. “Now, they could say that’s not a lot of money compared to the overall budget, but $65 million is still $65 million. That money should not have been cut from the operating expenses at the MTA.” Dinowitz also joined dozens of city lawmakers who called on Cuomo to make changes to speed up bus service: allowing passengers to board through every door and allowing bus drivers to trigger a green light while approaching an intersection. “Those two relatively simple

Other lawmakers are championing legislation authorizing the MTA and the Long Island Rail Road to halt payments to Amtrak, which runs Penn Station, to compensate commuters for unscheduled delays. Amtrak has been under fire since a minor derailment set off cascading delays in early April, with the governor suggesting that operation should be transferred to a private entity. The MTA, LIRR and New Jersey Transit rent space in Penn Station. “What I believe here is that this gives the backing to the MTA and the Long Island Rail Road to stop payments, and as I’ve been reading in the news and hearing on the news is Amtrak, after the governor and our national representatives … have gotten together calling on Trump for federal funding, which I fully support, Amtrak came out and said that they have the money to do this fix,” said state Sen. Elaine Phillips, the bill’s sponsor who also chairs the Infrastructure and Capital Investment Committee. “So that’s even more reason why the MTA/Long Island Rail Road should be withholding our lease payments.”

Delays ahead WATER QUALITY

After facing sharp criticism over the state’s response to water contamination in the village of Hoosick Falls, Gov. Andrew Cuomo this year signed the $2.5 billion Clean Water Infrastructure Act, which is aimed at upgrading drinking and clean water infrastructure across the state and instituting new quality control measures. But despite the latest efforts, Hoosick Falls residents have continued to call on the state to provide an alternative water supply, while the state Senate recently advanced a measure that would let the village issue $1.5 million in bonds to help cover cleanup costs.

Around half a dozen state agencies and authorities currently can use the method, which combines the design and building phases into a single contract. The state Thruway Authority is using design-build on the bridge that will replace the Tappan Zee Bridge. Cuomo this year tried but failed to allow design-build at other state agencies.

AFTER PRESIDENT DONALD TRUMP fired U.S. Attorney Preet Bharara, who had developed a reputation as the “Sheriff of Albany,” state lawmakers must have breathed a sigh of relief – and seemingly stopped pretending to care about ethics reform. Discussions around reforms became more prominent after Bharara’s office arrested both legislative leaders – Assembly Speaker Sheldon Silver and state Senate Majority Leader Dean Skelos – within weeks of each other on corruption charges in 2015. Each year, Gov. Andrew Cuomo proposes ethics reforms as part of his agenda, with some success and failures. This year, the governor proposed the usual ethics reforms he has included for the past few years, but little was done to include them in the state budget. He has blamed the state Legislature for the lack

Recently, it was reported that stipends that are supposed to go to committee chairs in the state Senate went to several GOP and Independent Democratic Conference members who do not actually chair those committees. Krueger said she stands with her conference leader, state Senate Minority Leader Andrea Stewart-Cousins, who has demanded that the practice be

funds, there has also been heightened attention paid to the oversight of the programs in questions. This year, Cuomo proposed a rebranding of the controversial Start-Up New York program, which offers tax breaks for businesses that partner with a college or university. The program has been criticized for creating relatively few jobs, but little was done to provide more oversight. For a governor who repeatedly prides himself on being able to make deals and get things done, some lawmakers believe if Cuomo really wanted to pass ethics reforms, he would have already.

Not surprisingly, the panelists expressed concerns about steps taken to repeal the Affordable Care Act, proposed budget cuts that could trim programs for the poor and efforts to stiffen sentencing guidelines for nonviolent drug offenders. Maya Wiley, who chairs the city’s Civilian Complaint Review Board and is senior vice president for social justice at The

New School, referred to the administration’s intentions as “intentional ignorance in service of the elite.” Other members of the panel – Zerlina Maxwell, the director of progressive programming for Sirius XM, and Shirley Leyro, a criminal justice professor at Borough of Manhattan Community College – were united in branding the administration as a danger to progressive goals. The discussion was also about the future

of the Democratic Party, the role citizens play holding government accountable and the targeting of immigrants. The conversation praised the work of activists who stood up to the administration. Here are three of the top takeaways: POLITICIANS AREN’T ROCK STARS L. Joy Williams, a national political strategist, said it was important to reverse the relationship between officials and engaged citizens, and said people must be proactive in holding legislators at all levels accountable for establishing better funding structures and policies. “The elected official doesn’t have to be the rock star,” she said. More specifically, she said, it isn’t just about exercising the right to vote, but how that right can affect people’s lives. For example, those who marched and died to agitate for the Voting Rights Act during the civil rights movement did so under threat from the Ku Klux Klan and often local law enforcement. “They had no elected power, they had no power to protect themselves, their property, their communities and their children,” Williams said. “What they saw in the right to vote was the ability to elect themselves and protect themselves and assert their citizenship in the country.” That connection between involvement and voting, Williams said, has a direct effect on the ability of people to succeed and leads to a more informed electorate. THE CENSUS COUNTS Wiley said one issue that hasn’t garnered as much attention as it should is ensuring an accurate census count. The U.S. Census Bureau is gearing up for its decennial count in 2020. LIKE MANY NEW YORKERS, Yomaira simply wants to provide for her family. She works as a home health aide, often seven days a week, to make ends meet and never takes a vacation. It’s a challenge for her to support her brilliant daughter, a student at Brown University on a full scholarship, while at the same time caring for her own mother. As rents rise uptown, the seemingly small cost of a MetroCard has become a huge burden for Yomaira. She would rather purchase the more cost-effective unlimited MetroCard, but she rarely has enough for the upfront costs. Yomaira must make tough choices to get her mother to frequent doctor appointments. She prides herself on being responsible, carefully setting aside money for different expenses. Yet far too often, she has to take money intended to pay rent in order to purchase a MetroCard. This means she pays her rent late, or worse, her mother misses appointments because they can’t afford to get to the doctor. Yomaira’s struggle is a common one; nearly 20 percent of all New Yorkers live in poverty. For those struggling financially, this phrase could not be truer: “It’s expensive to be poor.” By virtue of not having the money to purchase unlimited MetroCards, our most vulnerable neighbors actually end up paying more for their transportation. One in four lower-income New Yorkers – including many of our constituents – re-

ported that they were often unable to afford fares in the last year, according to the social services organization Community Service Society of New York. For them, a fare is a means to receive medical care, advance in their educational attainment and pursue employment opportunities. In response, the transit advocacy group Riders Alliance and Community Service Society of New York have pro-

posed implementing Fair Fares, a proposal to cut fares in half for people below the poverty line. This plan is modeled after similar programs other cities designed to help alleviate poverty. If eligibility for such a program were placed at the poverty line, as many as 800,000 New Yorkers would be eligible. To protect the vulnerable, we must reduce barriers to opportunity. Instead of being free to pursue educational and economic opportunities, many of our neighbors are forced to make do with less. As a result, the rationing of MetroCards is common. The simple act of moving around the city is weighted against the

Let us not look to Albany, but instead look into the eyes of our fellow needy New Yorkers. As we have done in the past, let us commit to upholding our ideals of fairness and opportunity for all. New York City currently helps subsidize fares for seniors, peo-

ple with disabilities and students. The city Human Resources Administration already spends tens of millions providing low-income residents with free MetroCards, but they are only available when recipients attend services and workshops, forcing many to hoard their MetroCards or haggle for more cards. We propose a formal, unified program so New Yorkers can get to work, college classes or take their kids to child care. Now is the time. We need our mayor to continue to deliver results to hard-working families. Like Yomaira, there are many more New Yorkers whose lives would be transformed with a lifeline to public transit. The mayor has called Fair Fares a “noble idea” that he is open to considering. We, and a majority of our colleagues in the City Council, stand ready to partner with him to make this noble idea into reality.
