EDITOR’S NOTE Last week, Democrat Jon Ossoff lost a closely watched special election to Republican Karen Handel in Georgia’s 6th Congressional District. The campaign for the vacant seat of Tom Price, who joined the Trump administration as health and human services secretary, was widely seen as a referendum on the president. Campaign contributions flowed in from across the country and a record $55 million was spent. Handel ultimately won by nearly 4 percentage points in the traditionally Republican district, an outcome that mirrored House special election results in Kansas, Montana and South Carolina. In each case, the Republicans lost ground but fended off defeat. What it all means for Democratic efforts to retake the House in 2018 is being vigorously debated. Here in New York, where Gov. Andrew Cuomo has pledged to help oust the state’s House Republicans, strategists on both sides are undoubtedly assessing what worked in Georgia and what didn’t. In this magazine’s cover story, we take a look at the re-election odds of Rep. Chris Collins, who has drawn more scrutiny than any other New York Republican in Congress.

C&S: Tell us a little bit about your blog Second Ave. Sagas. What motivated you to start it? BK: It’s a hobby that grew out of an interest in transit that sort of developed over the course of my life. I grew up in the city. When I got back after college the Democrats had just recaptured the Senate and Chuck Schumer promised to fund the rest of the Second Avenue subways, so it seemed like this thing would actually get built – and this was in 2006. So I started the blog thinking I’d follow the progress of the subway. Over time the site just grew to become a look at transit in New York City. It’s really a part of the city that touches everybody. I’ve tried to be a voice for the people so they can understand the news and the politics of it. C&S: What do you think of Gov. Andrew Cuomo’s recently announced plan to address the issue? BK: There are two points to make about his genius plan. One, it marginalizes the people who work at the MTA. There are a lot of smart people there who have a lot of good ideas. He’s essentially saying the people I’ve hired are not good at their jobs. And two, the biggest problem is the signal system. All of the delays on a daily basis stem from the signal system. C&S: So how do we fix the subways? BK: The first thing you have to do is go to the MTA and say what’s the fastest way to replace the signals. We can shut the subways down in segments while we repair them, and in a number of years the service will be a lot better. SCHOOL’S OUT – AND SO IS THE STATE LEGISLATURE It may be summertime, but the livin’ isn’t easy for New York City Mayor Bill de Blasio. The state legislative session concluded Wednesday without an agreement to extend mayoral control of city schools. State Senate Republicans tied the issue to raising the city’s charter school cap, a non-starter for Assembly Democrats. Unless a special session is convened to resolve the matter, the city will revert to the old board of education system when mayoral control expires on June 30. When the state Legislature failed to extend mayoral control in 2009, a special session over the summer quickly re-established it. But de Blasio doesn’t have a lot of leverage, and state lawmakers seem as unwilling to go back to work as kids are to go back to class. A NEW OLD CHAIR FOR THE MTA Like a Terminator with transit experience, Joe Lhota is back. In a surprise move Wednesday night, Gov. Andrew Cuomo named the former Metropolitan Transportation Authority chairman to the post he left nearly five years ago, although this time Lhota won’t serve as CEO. Lhota, who was quickly confirmed, will be charged with solving the subway crisis – and working with de Blasio, his former 2013 mayoral opponent. A FINE MAN FOR THE STATE’S HIGHEST COURT New Yorkers can take pride in the state’s newest judicial appointment. The state Senate voted Wednesday to confirm Paul Feinman to the New York State Court of Appeals, making him the first openly gay person to serve on the state’s highest court. Feinman is a respected jurist, and, according to friends, a “mensch,” both of which bode well for his time on the court.

GOVERNOR CUOMO ADVANCES LEGISLATION TO GIVE STATE CONTROL OF MTA BOARD AND ADDRESS CURRENT CRISIS Governor Andrew M. Cuomo today advanced legislation to give New York State majority control of the MTA and thus the responsibility and authority to address the current crisis. The legislation would add two additional state seats to the MTA Board appointed by the Governor and an additional vote for the Chairman. Of the new Board’s total voting members, it would now give the state eight appointees and nine votes. Currently, there is no voting majority on the MTA. New York State currently has six seats, New York City has four seats and Nassau, Suffolk, Westchester, Dutchess, Orange, Rockland, and Putnam have the balance of the Board’s seats for a total of 14 voting seats. The MTA’s organizational structure was originally created in 1965. While the Board included all governments in the MTA region it also divided responsibility among the Authority’s various political leaders. That created a Board without accountability, which requires constant coalition building on the board to effect action. Finger pointing has been standard operating procedure for decades.
“The MTA is run by the state of New York and the governor,” New York City Mayor Bill de Blasio said last month.
A day later, Cuomo appointed Joe Lhota, the former MTA head, as chairman. The search for an executive director, another gubernatorial appointee, continues.
While running against de Blasio in 2013, Lhota called for less state control over the MTA.
STATEMENT FROM GOVERNOR CUOMO:
Cuomo and de Blasio announced a deal in 2015 to fund the MTA’s five-year capital plan. But experts worry the state share will rely on increased borrowing.

“The MTA is in a state of crisis. Historic underfunding leaves it with obsolete equipment going back to the 1940s. The bureaucracy is dysfunctional. The recent Penn emergency track closures on July 8 will be the proverbial straw that breaks the camel’s back. The July 8 LIRR and New Jersey Transit cancellations will drive more people into the subway system, in the middle of the summer. There is no quick or small fix for the MTA. We are advancing $32 billion for the MTA capital plan – an historic amount – but it must be implemented: new cars purchased, new signals installed, new equipment acquired and new personnel hired. We are conducting an international conference next week for the best vendors. “The MTA Board structure assumed regional participation in the metropolitan area’s transportation systems but left no one in charge. While New York State has six of the 14 voting seats – that is not control. There is no transformative plan that will require major change and possibly more investment that will be agreed upon by the various separate political bodies with competing needs. Complex projects don’t get effectively managed by unanimous agreement of large political bureaucracies. We don’t have 10 years to do this. The state will dedicate itself to the task and assume responsibility, but the state needs the authority. “The state has taken a similar approach at the Port Authority. New York State is responsible for LGA and JFK Airports’ reconstruction. The state is responsible for oversight of the Tappan Zee Bridge, the Kosciusko Bridge, and many more. The state does not shy away from challenges, but we need the ability and authority to perform. “On the Second Avenue Subway project, for example, the MTA was floundering. The state took control of the projects using state personnel. The other members of the MTA Board did not oppose the state’s role as it was either not in their region or because they had no desire to participate in what appeared to be a doomed project. The Second Avenue Subway had been delayed for years and was projected to miss the deadline again. With the state’s intervention, we completed the task on deadline. “Some people assume the state’s six voting seats are the majority and say the state

“The only crack in the support for Nancy is in her critics’ asses.” That was the response I got from a member of the New York congressional delegation when asked if House Minority Leader Nancy Pelosi was in peligro. “Nancy always warned us that this district is as red as they come,” referring to the June 20 special election for Georgia’s 6th Congressional District in which seasoned Republican Karen Handel defeated novice Democrat Jon Ossoff. Another New York Democratic bochinchero opined that Pelosi’s critics went overboard: “This has solidified support for Nancy.” While in Washington, D.C., on Thursday and Friday, I got the sense that the support for Pelosi from neoyorquino reps is solid. However, U.S. Rep. Kathleen Rice, who represents New York’s 4th District, is taking some hits for her criticism of Pelosi. Several congressional bochincheros told B&B, “(Rice) has not made a lot of friends here.” Another incensed member of the New York delegation told me, “Gerson, ask (Rice) how much money she’s raised to get Democrats elected.” Insider bochincheros in D.C. also tell us that U.S. Rep. Joe Crowley, the fourth-highest ranking member of the House minority, hasn’t been as vocal as he should be in defending Pelosi. I asked the interlocutor if Crowley is blatantly not supporting her: “No. It’s just that Crowley wants to be liked by all so he’s just nice to everyone.” Sounds to me like he’s hedging his bets. You know, keeping his options open, por si acaso Pelosi’s booted. The thinking in the swamp is that Pelosi’s last hurrah will be winning back the Democratic majority in the House, and she’ll retire after that. Yeah, sure …

MAYORAL CONTROL MESS ON CUOMO? Several Democratic Albany bochincheros who are not fans of New York City Mayor Bill de Blasio tell us that this unresolved mayoral control mess is because of Gov. Andrew Cuomo’s political games to get even with the mayor. OK. “The extender that expired this month should have just been made for five or seven years,” one bochinchero said. The políticos are buzzing and the consensus among most is that New York City’s never going to go back to a decentralized, school board system. OK, pero, what if that happens? Bochincheros point to analysis that shows it would be too expensive to dismantle the current system. One said, “That would cost tens of millions of dollars and come back to haunt Cuomo on the budget side.” One state senator told B&B that Republicans aren’t worried: “If the charter school number isn’t increased in New York City, this isn’t going to hurt the mayor in his re-election bid.” The reasoning here is that it’s Cuomo who will have a tougher re-election fight in 2018 than de Blasio will have this year. Which should be taken as, “It’s all going to be worked out,” said the optimistic bochinchero. ANDREW CUOMO
MORE PUERTO RICAN DAY PARADE BOCHINCHE Oscar López Rivera may have left Fifth Avenue, but the fallout over his designation as a “hero” at the National Puerto Rican Day Parade continues. Two well-informed bochincheros tell us separately that Goya Foods won’t even think of sponsoring the parade as long as the current leadership on the board of directors remains. I asked if that means they want the parade’s board chairwoman, Lorraine Cortés-Vázquez, out? “They don’t want to deal with the people that mishandled this so badly. Who they get rid of or resigns is their business,” one bochinchero said. A third bochinchero told B&B that some of the sponsors saw that the public turnout for the parade was noticeably lower this year: “That gives them a way to stay out of next year’s parade.” I was told by three members of the parade board that there will be news soon. FTER YEARS OF toiling in relative obscurity, just another finely tailored suit roaming the halls of the U.S. Capitol among the congressional rank and file, Chris Collins had finally made it big time. As the first member of Congress to endorse Donald Trump for president, at the time a long shot for the Republican nomination, Collins’ status skyrocketed. The Republican congressman from a sleepy, sprawling district in Western New York was all over the airwaves, with networks seeking him out as Trump’s grip on the party nomination tightened. And by the time the party was ready to christen Trump as its standard-bearer – even as procedural skirmishes were breaking out on the floor of the Republican National Convention and the Never Trump movement was in full swing – Collins had been lifted into the inner circle of the all-but-inevitable nominee, spending time in the Trump family’s private box at Cleveland’s Quicken Loans Arena and offering a second to his nomination. “We, in Western New York, know Donald Trump is not merely a candidate,” Collins told the raucous convention crowd. “Donald Trump is a movement.” But now, as the political machines start to gear up for next year’s midterms, Collins is facing a mounting opposition, the likes of which he has not faced since first winning his seat in 2012, a development no doubt spurred by his proximity to the president. So, while the benefits of helping Trump were clear last year, the question remains: Will that relationship help or hurt Collins as he seeks a fourth term? Over the first six months of the year, it has become plain that Democrats see the congressman as a symbol of everything that’s gone wrong in Washington and a convenient foil in their efforts to make up

for the devastating losses in 2016 that left them with no tangible power. The Democratic Congressional Campaign Committee has listed his seat as a target for 2018 – one of 59 nationwide – despite the congressman’s convincing 35-point victory last year in a district where Trump also won big. Not all of the attacks have to do with Trump. Democratic politicians and left-leaning advocacy groups filed complaints with the House Ethics Committee that spurred an investigation this year after reports surfaced that Collins had been heard bragging about making people in the Buffalo area rich through a stock deal. It has come out since that he was also pushing a biotech stock, which has shot up in
lins’ campaign, told City & State. In addition, the congressman’s unwillingness to hold town hall meetings in his district has drawn the ire of constituents. Some even raised money to post billboards shaming him and formed a coalition of grass-roots groups that are hellbent on ousting him. Collins has repeatedly argued that town hall meetings are a waste of time, amounting to opportunities for partisan activists to shout down representatives, with no productive discussion to be had. “I feel by meeting with, and talking to, literally tens of thousands of my constituents during the course of the year in different gatherings and going to high schools, I have a give-and-take that’s

value since, to fellow members of Congress, including now Secretary of Health and Human Services Tom Price, just prior to a private stock sale last summer where Collins bought an additional 4 million shares. At the heart of the investigation is whether Collins’ vote on a bill, months before the private stock sale, was improper because the legislation would have directly benefited the Australian biotech company, Innate Immunotherapeutics. Collins has been mum on the investigation, though staffers and political advisers have characterized it as a “witch hunt” pushed by political enemies, noting that Collins has held stock in the company for more than 15 years. “In the end, when the facts come out … this will all be exposed for the witch hunt that it is,” Chris Grant, the top adviser to Col-

And just this month, Collins was criticized for blaming Democrats for the mass shooting at a congressional baseball practice that left House Majority Whip Steve Scalise, two Capitol Police officers, a staffer from Rep. Roger Williams’ office and a lobbyist seriously injured. Collins took to the radio just hours after the incident, and before any official information on the nature of the attack had been released, to lambaste his minority party colleagues, drawing attention from national news outlets like The Hill, Politico and CNN. “I can only hope that the Democrats do tone down the rhetoric,” Collins told WBEN, a radio station that hosts many

right-leaning talk shows. “The rhetoric has been outrageous ... the finger-pointing, just the tone and the angst and the anger directed at Donald Trump, his supporters.” Collins later walked back those statements, saying that he had been caught up in the emotions of the shooting. “It’s time for all of us, including myself, to tone down our rhetoric and recognize that we are all of one country and all proud Americans,” he said in a statement. Then he published an op-ed in The Washington Post reasserting earlier statements that he would now be carrying a gun while touring his district. “I owe it to the people in my community, God help me, to try to stop a threat to

their safety, should it ever occur because of my presence,” he wrote in the opinion piece. His stance was criticized on social media and elsewhere for what some viewed as hypocrisy. For many, though, Collins’ chief vulnerability is his loyalty to the president. Michelle Johnston Schoeneman, a teacher from Collins’ district, has emerged as a leader of the grass-roots movements after spearheading efforts to put up the anti-Collins billboards. The billboards display a photoshopped image of the congressman throwing his hands in the air and the message, “Where’s Chris Collins? WNY would like a word … .” As she visits towns and villages organizing against Collins, she has heard a common refrain that gives her confidence that the congressman can be de-
feated: buyer’s remorse for the man to whom he hitched his wagon, President Donald Trump. “With every passing day of his presidency he becomes more of a disaster and, therefore, so does Collins,” said Johnston Schoeneman, who is now running for county legislature as a first-time candidate. The Collins camp is showing no signs of worry. Collins declined to be interviewed for this story, but Grant, the congressman’s political adviser, was dismissive of the early noise from Democrats. “The Democrats are really good at bluster,” Grant said. “What they aren’t really good at is action and moving the ball forward.” Nick Langworthy, the Erie County Republican Committee chairman who has helped Collins win campaigns for Erie County executive and Congress, said the extra scrutiny is all part of being in the spotlight. Given Collins’ work for the Trump campaign, his spot on the transition team and his status as the president’s top liaison on Capitol Hill, it was expected that he would become fodder for Democrats, and the media writ large. What’s different this year, Langworthy said, is the current “period of political warfare” akin to what is normally reserved for the heart of campaign season. “He was going to become a target, especially after the exposure he received as a national surrogate,” Langworthy said. “He is a very easy target for Democrats to use to raise money, to raise their rallying cry amongst their core base.”

ESPITE THE DEMOCRATS’ saber rattling, defeating Collins would take a great plan, a tremendous candidate, exquisite execution, ideal political circumstances and at least a little luck. Across the board, experts and insiders agree that even if all of those elements were to come together, the Democrats, who are still in the process of picking a candidate, would also need for the current conditions working in their favor to hold – Trump’s low approval rating, dismay over efforts to scale back Obamacare and scant progress on other major legislative goals. Brad Blakeman, a Beltway GOP strategist who was a member of former President George W. Bush’s senior staff, said the Democrats’ best chance of gaining significant headway in the House and Senate at the midterms is if Republicans

fail to accomplish any of their major goals from the campaign season – health care, infrastructure and tax reform – by the end of the year. Senate Republicans have been hammered for crafting their own recently released health care bill in private, and it remains unclear whether the controversial measure will have enough votes to pass. Trump’s tax plan amounts to little more than the list of bullet points he presented during his campaign and substantial details are not expected until at least the fall. His $1 trillion infrastructure plan, which he dedicated an entire week to promoting, also has little detail. “If they cannot produce legislation, specifically on health care, infrastructure, taxes, then there’s going to be hell to pay in 2018,” Blakeman said. Even if all those stars align for the Democrats, history paints a bleak picture for their party in New York’s 27th Congressional District. In 2012, Collins, who had served one term as Erie County executive before losing to Mark Poloncarz, barely defeated incumbent Kathy Hochul. Despite a Republican voter registration advantage, Collins won by fewer than 2 percentage points. And to even keep things that close, Hochul had to spend nearly $5 million to his $1.4 million, according to campaign finance filings with the Federal Election Commission. Collins routed political neophytes in his two successful re-election bids, far outpacing the roughly 10 percentage point registration advantage Republicans enjoy in the district. On top of all that, local Democrats have yet to name a candidate, though a coalition of the district’s county committee chairs and some grass-roots organizations called Turn NY-27 Blue is in the process of interviewing a list of 10 people – the group has kept the names secret – who want the opportunity to take on Collins. The two initial frontrunners, Hochul and Poloncarz, declined to run for the seat. Neither lives in the district now. “If they had a rock-solid candidate, there wouldn’t be the need for the charade of a process,” Langworthy said. Still, Jeremy Zellner, the Erie County Democratic Committee chairman, is as optimistic that Democrats can retake the seat as he has been since Collins first won. “Two years ago, we didn’t have anyone,” at this point in the cycle, he said. Zellner, who is part of Turn NY27 Blue, said the group has been hearing from constituents who are passionately

opposed to the health care bill and other Republican policies promoted since Trump took office. “You cannot discount the people power that’s in the district right now,” Zellner said. And indeed, historically, midterms have swung to the party out of power, sometimes drastically, with few exceptions in recent decades. After Democrats passed the Affordable Care Act and former President Barack Obama signed it into law in 2010, a very unpopular piece of legislation at the time, Republicans made historic gains in the House, picking up more than 60 seats and gaining a majority that they’ve held since – and expanded in the 2016 election. Dan Hopkins, a political science professor at the University of Pennsylvania, said that trend, coupled with Trump’s low approval ratings over recent months and the unpopularity of the health care bill, will create an environment ripe for another big swing, if those factors don’t change before Election Day. “Recently, usually the swings have been quite marked,” Hopkins said. And there are some indicators that the political mood has already begun to swing. An Assembly special election in May went to Democratic candidate Christine Pellegrino, a schoolteacher and political newcomer, over her Republican opponent Tom Gargiulo for a Long Island seat in a heavily Republican district that Trump won with 60 percent of the vote. In a special election to Congress in Kansas, Republican Ron Estes beat his Democratic opponent James Thompson by just seven points in a district where Trump won by 27 points. In New Hampshire, Democrat Edith DesMarais defeated Republican Matthew Plache in a state legislature district considered a Republican stronghold that Trump won by seven points. Those numbers may bring some comfort to Democrats, but they failed to take a single seat in the four contests to replace members of Congress who left their seats to join Trump’s Cabinet. Still, while special elections are more likely to see upsets, given that neither candidate has the advantages that come with incumbency, analysts see sitting Republicans as increasingly vulnerable in the midterms. And Zellner is hoping that the grassroots opposition to Collins he and allies say is building in the district is enough to make it one of the surprise races next fall. “We believe, from what we’re hear-

HETHER OR NOT Democrats have a real shot at pulling off an upset, Collins’ political machine is gearing up earlier than it has in years past. This could simply be a reaction to the fervor with which Democrats are coming out of the gate, or perhaps due to Collins’ elevated visibility and proximity to the president. But it could also signal some anxiety that his close association with Trump and his vote for the deeply unpopular American Health Care Act may spell trouble. In the last two two-year fundraising cycles, Collins raised about $1 million each time. In the first three months of the current cycle, he reported raising $281,000 and he has planned a more aggressive schedule of fundraisers in Washington, D.C., than in previous years, The Buffalo News reported. Evan Lukaske, a spokesman for the DCCC, claimed that Collins’ early fundraising efforts are a sign of worry. “He
can sense his own vulnerability and we sense it too,” he said. Grant downplayed the fundraising haul, saying that Collins isn’t worried, but also doesn’t take anything for granted. “There’s no question that Washington is a dynamic and volatile place these days,” he said, “and any smart, hardworking congressman is going to do anything in their power to prepare for any eventuality.” While this year’s race is likely to be more heated, Collins has a big advantage in simply knowing that he will be the candidate. As the incumbent, as someone in the president’s inner circle, as someone who has traveled the district countless times, as someone with a sophisticated fundraising apparatus – he has about $1 million on hand – he is well-positioned to fend off any attacks. Grant says that the game plan has not changed from previous cycles – promoting a message of job creation, national security issues and America’s place on the world stage – even if the pace of fundraising has quickened. Voters of the district, he argues, will see through the

message the Democrats are pushing and recognize it as “D.C. spin.” “At the end of the day they don’t care about Washington, D.C., nonsense,” he said. “They care about how this impacts their lives and we’re looking forward to putting Congressman Collins’ record, on that front, against their failed record any day of the week.” Democrats will also have to avoid the infighting of 2016, something Zellner says won’t be a problem, as all the people they have interviewed have pledged to support the endorsed candidate. Still, people from outside the group, including stalking horse candidates, could ruin those plans. And as the Democrats spend time and energy looking for a candidate, while also facing the possibility of a contentious primary, Collins is free to continue fundraising, grabbing headlines and engaging in early campaigning, said Blakeman, the GOP strategist. “All Chris has to do is sit back and enjoy the fight,” he said. At the heart of the battle over messaging will be whether discontent with Trump,
the health care bill, the economy or any number of other factors will be enough to convince Republicans to either flip their vote or stay home on Election Day. Hopkins, the political science professor, said that there are crosswinds in the district when it comes to campaigning on an anti-Trump message. A good predictor for midterms, he said, is often the margin of victory for the president. Districts where a president wins by more than 15 points – Trump beat Democratic nominee Hillary Clinton by 25 in Collins’ district – tend to stay with the president’s party. “These are the kinds of seats that, even in a down year, tend to be hard, but not impossible, for an out party to win,” Hopkins said. At the same time, a key demographic for Trump’s victory, white people without college degrees, could present a problem, as they are more likely to stay home on a midterm year. “It’s also worth pointing out that white, noncollege voters are a bit more volatile, just in that, as a group, they have moved from one party to another from election to

election,” he said. But for the Collins camp, the path forward seems to be clear. Grant mocked the Democrats for believing that tying the congressman to Trump, while also sending Cuomo, who garnered just 35 percent of the vote in the district in 2014, to attack Collins on health care, is a winning strategy. Cuomo and Hochul assailed Collins and Rep. John Faso after the two congressman added an amendment onto the House health care bill that Democrats argue will cost the state nearly $7 billion over the next four years. “I think it tells you everything you need to know about the Democrats’ political acumen,” Grant said.

O, AS THE Democrats work toward choosing a candidate, Collins will go on raising money and using small group events to promote his conservative brand of politics. While Zellner said there is no timetable on an endorsement, he and his fellow Democrats are on the same page in terms of the type of candidate they will need to pull off an unlikely victory. “It can’t be someone who is carrying the liberal torch,” Zellner said. “It’s got to be someone who represents the district.” Johnston Schoeneman declined to name any of the candidates, saying it was their choice on when and how to announce their candidacies. However, she did say there are several people with significant military backgrounds she believes could provide the centrist image needed to get a Democrat elected. Some of Johnston Schoeneman’s fellow teachers who voted for Collins and Trump have already soured on the president, she said. The next step is convincing them that Collins is more interested in serving his donors and his ally in the White House than the people of Western New York. “These are smart people,” Johnston Schoeneman said. “They’re just people who really were hoping that something would change.” Grant painted a much different picture. “The reality is the Democrats don’t have a message, they don’t have a candidate, they don’t have money,” he said. “All they’ve got right now is a lot of hysteria and they’ve shown a complete lack of organizational ability to translate that into anything remotely resembling a competitive campaign.”

Progressives praise the ways in which it can increase transparency and improve government responsiveness. Conservatives seek to use it to cut costs and make government more efficient. And members of both parties see it as a way to spur economic growth and create jobs, both in urban centers like New York City and in less populated regions in upstate New York. Of course, technology is no panacea. Any number of projects have underperformed or been mired in controversy, from the city’s efforts to overhaul the CityTime payroll system to the corruption allegations surrounding the state’s tech-driven upstate economic development initiatives. Yet technology is dramatically changing how we all live, often in ways that weren't anticipated a few years ago. Government officials are scrambling to catch up and figure out the best way to respond to new services like ride-hailing apps and vacation rental websites. They’re deciding whether to embrace innovations like self-driving cars. And they’re confronting the competitive pressures that arise from disruptive new technologies. New York officials fight to protect internet privacy in the Trump era By MIRANDA NEUBAUER
EVEN THOUGH SEVERAL of President Donald Trump’s major initiatives have been blocked by the courts or stalled in Congress, his administration has made progress in changing technology and internet regulations via the Federal Communications Commission. New York officials have sought to block or stall that progress, as they have on immigration, health care and the environment – now adding technology and preserving an open internet to the so-called “resistance.”
Both New York City and the state are trying to figure out how to respond to a recent relaxing of federal internet privacy regulations. While these changes are welcomed by some, their impact may depend on differing interpretations of local and state legal oversight over broadband internet. It’s also entangled in the larger national debate over whether the internet should be regulated by the FCC as a telecommunications service or by the Federal Trade
Commission as an information service. In April, Trump prevented FCC regulations from going into effect that would have required broadband providers to obtain consent before sharing a user’s personal information with third parties. Days later, New York City Chief Technology Officer Miguel Gamiño and Anne Roest, commissioner of the city Department of Information Technology and Telecommunications, announced the city would establish an interagency Internet

Health and Human Rights working group, which it described as a first-of-its-kind municipal entity that would aim to limit any harm to “protected classes” from the collection of their personal information by internet providers. In a following City Council hearing, Gamiño announced that he had asked the city’s Law Department to explore what authority the city may have over internet service providers’ privacy policies. In an interview, Gamiño said franchises weren’t the city’s sole focus. “The specific question posed to legal is more general ... what are all of the avenues that we might be able to take to create more privacy protections for New Yorkers as they use the internet?” On a panel at the recent Personal Democracy Forum, Gamiño and DoITT highlighted how the city’s LinkNYC free public Wi-Fi system allowed the city to negotiate a stricter privacy policy to address community concerns. He contrasted the choice consumers have to use or not use a particular social media website with their inability to consent to other uses of their personal data by ISPs. Additionally, the city is also aiming to train public library staff to offer internet privacy guidance and is partnering with Mozilla to provide dig-

It’s easier for people outside to understand who to contact or the technology conversation. It’s not so much about what Sree did or didn’t do, or a comparison about him or me. Having one person to go to for all of these different elements of a broader technology conversation just makes a lot of sense.

But Falk said Charter does not believe the common carrier approach, which would treat the internet like other utilities, is the right way to regulate the internet, arguing that private cable networks were fundamentally different from the telephone networks built by utilities with a guaranteed rate of return. On the state level, bills prohibiting the disclosure of personally identifiable information by an ISP without customer

What role does the DoITT play in encouraging internet service providers to expand to New York? AR: New York City sued Verizon because the company failed to live up to its promise to bring fiber-optic cable to every household in the city – by a number of years and millions of households. Generally, we’re always thinking about ways to attract more internet service providers, especially encouraging smaller companies to explore becoming a franchisee

the federal internet privacy regulations created uncertainty with “a lot of blank spaces and unknowns (so) that states are trying to fill the void.” But Berin Szoka, president of TechFreedom, a group that opposed the privacy rules, wrote in an email that ISPs sharing browsing history without consent had already been illegal and would continue to be so if authority returns to the FTC. “(This bill) starts down a well-trodden road of states trying to regulate the internet – something that is generally problematic,” he wrote. “(It’s) generally better to leave things like this up to the federal government.” In statements, industry group USTelecom and conservative think tank Free State Foundation also expressed concern about a “patchwork” of local regulations that could disrupt broadband operations. Falcon, of EFF, argued that such concerns are disingenuous, considering how the tech sector arrived at this point. “As much as I’m sympathetic with the concern that the patchwork exists, then they should not have lobbied to repeal the federal law,” Falcon said. “They had a uniform approach, now we’ll have to go state by state.”

AR: It’s very unfortunate that this dispute has gone on for so long, with so many work-

ers on the picket line. DoITT is very carefully monitoring the situation and has been in communication with both the union and our franchisee. The franchise agreement explicitly permits the right of workers to bargain collectively through their union, and the administration is equally explicit in its desire for the workers to swiftly receive a fair contract. Our contract mandates that Charter negotiate in good faith, but we don’t have legal standing to force a particular resolution. We are very hopeful that this will be resolved and the workers will get their due very soon. It’s time for them to go back to work.

C&S: The Select Committee on Technology and Innovation was announced in January. What was the reason for creating the committee? GA: We are living in a digital economy and we should be a leader when it comes to technology. The select committee was formed so that we could focus on what barriers exist, what current laws and statutes prohibit the advancement of technology or creation of business.
GA: Our main goal is to support the growth and development of tech-related businesses, also to encourage new innovation, which will generate economic growth and career opportunities for New Yorkers. The committee has been and will continue to meet with the various stakeholders within the industry to identify what steps we need to take legislatively that will help these industries thrive.
C&S: Are there any specific initiatives that the committee is planning on undertaking in the coming months?
C&S: Will the committee plan any initiatives specifically for upstate New York? GA: I represent The Capital Region area and Hudson
C&S: Gov. Andrew Cuomo announced regulations for ride–hailing services throughout New York earlier this month. What will the state Department of Motor Vehicles’ role be in monitoring ride-hailing companies? TE: It’s a fairly extensive statute. DMV has promulgated regulations that have been posted to our website and are available for viewing that will enable ride-sharing to be operational by June 29, the effective date of the legislation.

In the event that a law enforcement vehicle that has the LPR technology observes one of these vehicles, alarms go off and it will alert one of these law enforcement so they could pull that suspended or revoked vehicle over and then issue the appropriate citations. It’s a different way to use technology that will have the benefit of making New York roads safer.

WHEN IT COMES to state lobbying, there’s a new king in town. Err, make that a new queen. Suri Kasirer’s Kasirer LLC took the top spot in 2016 in terms of total lobbying compensation and reimbursed expenses, according to the latest annual report published by the state Joint Commission on Public Ethics. While Kasirer’s growing revenue, which surpassed the $10 million mark last year, was certainly a factor, another part of the equation was the exit of the longtime state leader, the law firm Wilson Elser, from the lobbying business. In 2015, three Wilson Elser partners – Cynthia Shenker, Theresa Russo and Douglas Clark – left to form their own firm. Then, last summer, Wilson Elser’s entire lobbying practice, led by Kenneth Shapiro, joined Jackson Lewis, a law firm specializing in workplace law. While Wilson Elser dropped down to the No. 10 slot – and will be out of the running entirely this year – Brown & Weinraub and Bolton-St. Johns each moved up a slot to round out the top three in 2016. We saw that coming and we built a team with a broad depth of expertise and that’s important. It’s not just about relationships anymore. C&S: What is unique about Albany in terms of lobbying?

We really make sure that we are clearly thinking through how to articulate the best possible case with an understanding of what is important in New York City and New York state to the various stakeholders. C&S: What areas do you specialize in? SK: We have about 25 nonprofit clients. We help advise them on accessing capital and expense funding. We also help them on legislative and policy initiatives. We also have a significant real estate business. We have a significant presence and expertise in everything real estate-related. We deal with everything from interacting with varying agencies to dealing with tax policy issues, helping out on major land use initiatives, special permits, uniform land use review and landmark issues. In addition, we also represent lots of folks in health care and education. C&S: Where do you think you’ll rank next year? SK: I would say that while lists and rankings are an important part of our business, that to me is not how I measure success. My objective is to make sure my clients achieve the results they’re looking for and hopefully in that process make the city a better place.

DW: It’s a very diverse state. So the people from around the state that come up here to get representation in the capital have a great diversity of interests. We also represent a number of disruptive technology companies, disruptive in that they are changing the way business is conducted in their various fields. Airbnb is a good example of one of those disruptive technology companies that we do a lot of work for. C&S: How is the business changing? DW: The biggest change is the need to be well-versed, if not an expert, with whatever it is you’re trying to move forward. Technology has forced everybody to compete more. While relationships are still important you also need a very good understanding of the position of your client.

C&S: Where do you think you’ll rank next year? EG: We are focused on serving our clients and we hope to continue to grow.
DC: One thing that was a big deal is that we represent one of the five dispensaries licensed for medical marijuana. That was complicated and required a lot of understanding of the process and challenges. It was obviously very competitive, and we’re pleased we were able to help our client secure one of those licenses.
C&S: What’s one way the lobbying business is changing? DC: The biggest one is obviously the legal one with respect to registration and public relations, where it’s now registered activity to talk with editors. There’s also a continued trend of a need for expertise and professionalism and higher standards, especially with any conflicts and ethics. The bar is continually raised, and that’s a good thing. There is value to firms like Park Strategies that have a lot of depth and a lot of intelligent people who have experience, and that is a trend that values knowledge.

HI: I think it’s becoming more important that lobbyists do have areas that they spe-
cialize in. There’s so much going on in each area that it’s very difficult to stay on top of all the developments and also manage many different subject areas. I think across the board you’ve seen many lobbying firms try to develop expertise in certain areas. C&S: Where do you think you’ll rank next year? HI: Well, we hope we will go up. We’re hoping to move up a spot or two, but we’re also very focused on maintaining and serving well the business that we have. Growth is nice but if you look at our numbers and our client base, we are very stable. Rarely do we lose a client. We have very strong continuity with our clients and that, to us, is more important than being up a spot or down a spot.

what it takes to get to the outcome you’re looking for. I think the second thing is you certainly need to have an enthusiasm and passion for what you’re advocating for and be knowledgeable about what you’re trying to achieve and make sure that that enthusiasm comes through.
C&S: What does it take to be a successful lobbyist in Albany? TT: I think the first thing is credibility. You definitely need to have command of the issues that you’re lobbying on as well as an acknowledgement of the political arena. You also need the experience of just knowing

One is real estate and we have experts on our team that help with everything from zoning and construction permits to community relations. The second area is nonprofits, so we do a lot of work in public policy, legislation and budget. The third area is business strategy. Capalino is well-known for its lob-
bying, but we also do a fair amount of strategic consulting for businesses and that could be everything from government opportunities to public sector opportunities to general business strategy on how to run a successful business in New York City looking at both the public and private sector and creating corporate responsibility practices, MWBE compliance and all the things that make a business successful. C&S: How is the business changing? TT: I think the biggest change has been technology, specifically in two areas. One is the speed at which things become news and the impact of social media and how that impacts how government and elected officials react. The other area is the need to utilize technology to help be a successful lobbyist. We actually do a fair amount of digital strategy work in our firm as it relates to our advocacy campaigns and we also just launched our first app called MWBE Connect NY, which helps connect MWBE companies to city and state procurement opportunities. So we have really given a lot of thought to the ways in which technology can improve our services.

JL: It’s a combination of assembling a great and experienced team and developing a substantial amount of expertise, particularly around certain relevant topic areas like education, health care and environmental issues. To a large extent, it also requires being as responsive as possible to clients and then working very hard on their behalf. C&S: What is unique about Albany in terms of lobbying? JL: One of the challenges is the divided Legislature. Assembly Democrats have a firm control of the Assembly while Repub-
C&S: What is unique about lobbying in Albany? SD: Two somewhat unique qualities come to mind: One of the unique challenges in Albany is that we have such a diverse state demographically, geographically and ideologically. The interests of New York City may not necessarily be aligned with the suburbs, which may vary from the mid-Hudson region, the Capital Region, Central or Western New York. Aligning the various stakeholders on an issue with statewide implications can be challenging and, while prevalent in other state capitals, we have one of the more diverse and parochial states in the country,
which can make it uniquely challenging. Two, frequently we are forced to explain what may be a very irrational process to very rational people. When dealing with clients in the private sector they oftentimes have a very rational, very linear view of the world and their issues. The legislative process in Albany, at times, is less than rational when measured against the private sector’s view of rationality. Bridging that gap and explaining that to clients is certainly unique, especially when compared to other aspects of our practice. C&S: Who are your major clients? What areas do you specialize in? SD: The firm has nearly 100 clients. We have a strong subject matter expertise in a wide variety of areas, such as health care, human services, higher and lower education, energy and telecommunications, and labor. C&S: How is the business changing? SD: Social media is playing a far more significant role in the legislative process and that has contributed to a changing profession. Real-time responsiveness, real-time action and reaction partially driven by social media is far more critical today.

licans are in control of the Senate. Therefore you have to be bipartisan to have the ability to move between both houses. Another thing that makes Albany unique is the extraordinary authority of the executive. It requires that lobbying firms must be able to work very closely with the governor.
C&S: Who are your top clients? What areas do you specialize in? JL: We represent a significant number of very important clients, many of which are leaders in their fields. While we remain very involved in representing prominent health care clients, our clients now include prominent universities, energy companies, environmental clients, a public sector union and transportation companies. C&S: How is the lobbying business changing? JL: First, there has been ever-increasing scrutiny on lobbying, and appropriately so. There is an increased emphasis on making sure we’re compliant with the requirements imposed on us with respect to reporting and other issues. Second, there is a closer connection between lobbying and media advocacy and public relations generally. We find
ourselves either partnering with firms that are experts in those areas or undertaking it ourselves with more attention to our client’s media and public relations strategy.

We have found that having multiple areas of expertise best serves our clients rather than a concentration in one particular industry. First, it’s much easier to avoid conflicts, which we are very careful about. Second, we’ve found that clients are looking for expertise on state government and how to get things done, not necessarily on the nuances of their particular field. C&S: How is the business changing? RO: I started the firm in 1995 after working for Gov. Mario Cuomo for 12 years. I was what you’d refer to as one of the last people out the door turning the lights off. We’d just lost the election and I wasn’t sure if I’d even get a client. But I applied what I learned working for Gov. Cuomo – hard work and honesty – and before long clients started coming in. I’ve seen the business change a lot in the last 20 years, but the same principles still apply. Lobbying can open doors, but once that door is open you must present the facts, provide data and use solid arguments to make your case. A sophisticated lobbying campaign today may consist of grass-roots lobbying, polling, paid media, social media and a number of other strategies that weren’t expected or didn’t exist 20 years ago.

OR NEARLY 50 YEARS, the Fund for the City of New York has worked to innovate how the city works, with the goal of improving how governments and nonprofits meet their targets. The fund offers awards to accomplished city workers and educators, offers bridge loans to nonprofits awaiting government or foundation dollars and a partner project program that offers back-end support for startup organizations. Mary McCormick, president of the fund, had a long career in city government, served on the Robin Hood Foundation’s board of directors and helped co-found the Food Bank for New York City. NYN: How does the Fund for the City of New York work? MM: The fund was created by the Ford Foundation when they built a wonderful
issues and help to make it better or whether we see an opportunity and we step forward to be really catalytic. If you were to look at the universal pre-K program, a major initiative of Mayor (Bill) de Blasio, we thought in advance after he was elected that the money we had and the city had to make these contracts – allow them to operate early – was not enough. So we went and privately borrowed $20 million. So people in government would say that without the borrowing that we did, the (universal pre-K) program would not have gotten off the ground so smoothly. So that’s one way where we get behind a city initiative and help to make it work. NYN: The cash flow loan program is so vital to nonprofits – what trends have you seen? MM: Ninety percent of the money we lend (to nonprofits as a bridge loan) has

subjective. Even if you go through 15 questions, protocol, totally objective – it comes down to a little bit of subjectivity at some point. And what we realized was that to be an effective nonprofit you have to have a superb program, but that’s not enough because you have to have the management infrastructure that is equal to that program. And you’re never going to get enough money from individuals or government to have your infrastructure, because if you’re going to give money (as a donor) you want it to go to programs. All of us do. You don’t want it to go to a bookkeeper or to the technology. So after we worked in this area for quite a long time we created this partner project. If you have an idea and you want to do it and you're committed and you're smart and you know what you’re doing and you can raise the money, you can join our partner program. And then we take

They created it to seed innovation in New York City. They started by putting it within the government and after a year they realized you could not really innovate from within government as easily as from outside government. We work to find issues where we can make a difference in either government or in the nonprofit community because it really is one large organization working towards the same goals. NYN: How does that relate to city government? MM: There are two ways of looking at things, one is whether we are responsive to
no interest or no fees. And we work really hard to not charge any interest because the nonprofits that need these loans do not have a revenue stream for interest. We step in and make grants against box office (receipts), sometimes pledges. We actually extend ourselves to do whatever we can to keep an organization going because we know how hard it is to create a nonprofit and how easy it is to have them not be able to be sustained. NYN: What kinds of results or metrics are you looking for when you’re looking to improve outcomes for New Yorkers? MM: Many of these decisions are really
care of everything else: the audits, the insurance, the payroll, the COBRA, the (Family and Medical Leave Act), paying all bills, everything. So that frees you to be good in what you can be really good at and not have to worry about compliance or have a staff of people where you can't pay them what they deserve to be paid. It’s a very important and efficient way of promoting innovation to improve the quality of life. And more and more to groups that are very valuable but can never really get the money they need for the rest. They’ve been around for 30 or 40 years, they come into the partner project and then they have a new lease on life.

Two years ago, the retired tennis star was tackled to the sidewalk by an NYPD officer.
