EDITOR’S NOTE Last week, President Donald Trump officially endorsed Roy Moore, the controversial U.S. Senate candidate from Alabama who stands accused of sexual misconduct. Many Republicans were already dismayed about Trump’s tacit support for Moore, given the salacious allegations against Moore, not to mention the long-standing sexual harassment allegations against the president himself. But the latest development points to another problem within the Republican Party: Trump endorses whoever he wants, whenever he wants, making it difficult for other party officials to plan ahead and coordinate funding in what could prove to be a pivotal election cycle in 2018. As leader of the Democratic Party here in New York, Gov. Andrew Cuomo hasn’t been nearly so haphazard in making endorsements or campaign funding decisions. But like Trump, he has insisted on backing only the candidates he wants, even when the party is asking for more. This week, City & State looks at Cuomo’s track record when it comes to congressional contests, and whether he can turn things around in 2018.

Latest MURPHY’S LAW Whatever can go wrong, will go wrong – which, for New Jersey Gov.-elect Phil Murphy, means likely becoming entangled in the ongoing feud between Cuomo and de Blasio. Murphy joined Cuomo in a friendly telephone press conference to denounce the Republican tax reform plan along with California Gov. Jerry Brown, but Murphy’s progressive ideals could soon be at odds with Cuomo’s pragmatic politics. Murphy has more in common with de Blasio, whom he met at Gracie Mansion on Wednesday, and with whom he shares several campaign goals. If Murphy finds a greater ally in de Blasio than Cuomo, it could spell trouble for the neighboring states.

GILLIBRAND TAKES A STAND U.S. Sen. Kirsten Gillibrand became the first Democratic senator to call for U.S. Sen. Al Franken, who has been accused of sexual harassment by eight women, to step down on Wednesday morning. Her Facebook post denouncing him kickstarted an avalanche of statements from her Senate colleagues calling for Franken’s resignation, including her fellow New Yorker and U.S. Senate Minority Leader Charles Schumer. Gillibrand is widely seen as positioning herself to run for president in 2020 – which, if she were joined by Gov. Several Democrats have thrown their hats into the ring in anticipation of a special election, including Yonkers Mayor Mike Spano, Assemblywoman Shelley Mayer, Bedford Supervisor Chris Burdick and People for Bernie co-founder Kat Brezler. Republican Sarmad M. Khojasteh has also filed to run. The special election could affect the balance of the state Senate, either strengthening the Republican majority or bolstering the Democratic ranks.

C&S: What is going on with the Democratic Party at the national level? CQ: I don’t know. I recently became a member of the Democratic National Committee. I went to the first “regular” meeting for business in October. I was very disappointed. The general session got dominated by the fact that (Chairman Tom) Perez removed or demoted members of the DNC who had been ardent supporters of (Rep.) Keith Ellison. The gentleman who’s the chair of the New Hampshire Democratic Party was removed from the rules committee. And Perez removed a member of the DNC from New Jersey, a transgender woman who’d been on for quite some time. The response I heard was, “Well, it’s OK because we brought on an African-American transgender person who’s a millennial.” Well, we could have two! We don’t have time to be mired in this kind of politics.

C&S: What is happening right now with the New York City Council speaker race? What’s important and what isn’t? CQ: What I think is happening right now is candidates are trying to court votes from their colleagues. And even if somebody is from Queens and they’re committed to vote with (Rep.) Joe Crowley, you want them to call Joe and say, “Look Joe, I’m with you, but I really don’t want to vote for X. And I really love Y.” Those calls matter because I think there’s this vision that Joe Crowley wants to just, from a wand on high, touch somebody on each shoulder. He’s listening to people because you would prefer to move forward with a choice that makes your delegation the happiest it can be. Individual members will also care about agendas and whether they see their bills and their districts as a part of that. And they’ll convey that to their leaders.

It was clearly stated in her schedule. In fact, it was the only public event for that day. New York City Council Speaker Melissa Mark-Viverito would speak at the street co-naming for Richie Pérez at 1 p.m. on Dec. 3 at East 172nd Street and Ward Avenue in the Bronx. But the bona fide activists for justice that are comrades and disciples of the late Richie Pérez were not having any of Melissa’s posturing. “We didn’t want her there and definitely didn’t want to hear her speak,” a bochinchera said. “Her sitting on the Right to Know Act is disrespectful to Richie’s life’s work against police brutality,” another bochinchera told me. The Right to Know Act is a legislative package before the New York City Council that aims to protect the civil and human rights of New Yorkers while promoting communication, transparency and accountability in everyday interactions between the NYPD and the public. Various bochincheras with whom B&B spoke said Melissa’s council adviser Erica Gonzalez was informed that “we didn’t want her to speak.” Organizers of the street naming event were led to believe that the speaker would not be presente. “When she showed up, there was some scrambling,” another bochinchera said. “Erica was told that Melissa could speak, but that she should expect some of the justice warriors to call her out for killing the Right to Know.” There was an in-your-face response from Erica to one of the organizers. “Melissa joined in the verbal assault,” a bochinchera told me. Under those terms, Melissa opted not to speak. Which leads me to speculate that Melissa, who’s used to having her way, was so pissed off that she took it out on the City Hall press corps by banning them from the council side of the building. I do know that all the women that I spoke with separately opined that if Richie were alive, he’d be denouncing Melissa. It appears the speaker has lost her activista credentials with these neoyorquinos.

WHAT’S BARRON UP TO AT CUOMO’S SOS? I’m hearing buzz about what Assemblyman Charles Barron is planning to do to raise his objections to Gov. Andrew Cuomo at the governor’s State of the State show on Jan. 3. “He’s trying to get other members to be bold,” is what a source inside the belly of the Albany monster told B&B. Barron is credited with having been the reason Cuomo took his 2017 State of the State on the road. “I don’t think Charles is going to disrupt the governor,” an elected bochinchero said. Word is that Barron is “busting our balls asking us what we’re going to do to let Cuomo know our displeasure,” the legislator bochinchero said. Barron is putting pressure on the Black, Puerto Rican, Hispanic & Asian Legislative Caucus to either interrupt the guv or just boycott the event. “I don’t think Cuomo has to worry about Charles,” the same bochinchero said. “I expect him to boycott the SOS.” I don’t think the governor is really worried. However, expect one of the hombres to drop out in the next 10-12 days. Both wannabes are from the same borough. If Monty Hall were alive, he would love the dealmaking that’s in the works among these players.

O GOV. ANDREW CUOMO, Rep. Chris Collins is a “Benedict Arnold” for backing the Republican Party’s sweeping federal tax reform plan and the peddler of a “political Ponzi scheme” that would shift New York’s Medicaid costs from the counties to the state as part of the Affordable Care Act repeal. Rep. John Faso has also faced withering criticism from Cuomo for supporting the Obamacare repeal, with the governor recently calling on him resign in protest over the GOP’s controversial tax plan, even though the Hudson Valley congressman voted against the House version of the bill. Cuomo has been treating most of the state’s House Republicans with similar contempt. He branded nearly half of the GOP congressional delegation – Collins, along with Reps. Claudia Tenney, John Katko and Tom Reed – as “treasonous” for voting for the tax plan, saying it would “rape and pillage” New York communities. And he pledged to knock out of office half a dozen New York Republicans – including Reps. Elise Stefanik and Lee Zeldin – for their votes to repeal and replace Obamacare. “They said they would help their districts. They said they would help the struggling middle class,” Cuomo said this summer as he stood alongside House Minority Leader Nancy Pelosi to announce a campaign targeting six New York House Republicans over the Obamacare repeal bill that ultimately failed. “They’re doing the exact opposite. These are not moderate, responsible public officials. They’re not taking reasonable positions. These are political pawns to the ultraconservative puppet masters in Washington.”

But as the governor tries to flip a half dozen or more congressional seats in New York from red to blue, an effort that is key to a national Democratic bid to retake the House of Representatives, he faces a nagging question: Why didn’t he bring the fight to New York Republicans earlier? On the basis of sheer numbers alone, the governor’s track record appears weak. Since Cuomo’s first run for governor, the number of Republicans in New York’s House delegation has tripled, from just three in 2010 to nine today – even as the total number of House seats in the state declined by two, to 27. A year after taking office, Cuomo allowed a redistricting plan to go through that made a number of Democratic House incumbents more vulnerable, and several would go on to lose key seats. And while the governor has raised money for Democratic candidates and made appearances with them on the campaign trail, he has earned a reputation for keeping his distance from congressional races across the state. Take Collins’ Western New York district. In 2011, Republican Rep. Chris Lee was caught up in a sex scandal and abruptly resigned. Kathy Hochul, the popular Erie County clerk, jumped into the race as the Democratic nominee. Despite a significant Republican voter registration advantage in the district, Hochul prevailed. However, her victory was short-lived. In 2012, as Cuomo and the state Legislature were negotiating over redistricting, the governor wanted lawmakers to approve a plan to make the process more independent. But as is the custom in Albany, he allowed the Democratic Assembly and Republican state Senate to push through the plans they wanted for their own houses. Congress, as usual, was an afterthought, and it was ultimately left to the courts to draw the lines. Hochul, who was already at a disadvantage, saw even more Republicans added to her redrawn district, and narrowly lost to Collins later that year. Overall, the new congressional districts were seen as reasonably fair and independent, with incumbents in both parties losing ground. But Cuomo’s relative disinterest and lack of involvement was in stark contrast to what was going on in other states. In many Republican-controlled states, elected officials deliberately redrew the congressional lines to maximize their party’s representation in Congress.

Some Democratic governors fought back, like Missouri Gov. Jay Nixon, who vetoed a Republican-drawn congressional map only to be overridden by the state Legislature. Illinois Gov. Pat Quinn, who approved a congressional map that threatened the state’s majority Republican congressional delegation, was taken to court. Meanwhile, in New York, there were reports that Pelosi was alarmed about Cuomo’s inaction and the risk to incumbents like Hochul and Rep. Louise Slaughter – who was nearly ousted in 2014. Cuomo did get through a constitutional amendment on independent redistricting in the end, although it’s debatable how independent it actually is. But to be fair, the governor would have been criticized by good government groups and editorial boards had he tried to ram through a new congressional map with blatantly partisan boundaries. “Did he not put his thumb on the scale to try to make it so the congressional lines were pro-Democratic? Yes, he was guilty of that,” said Bruce Gyory, a Democratic consultant. “But on the other hand, that’s what we say we want – we want a less partisan process for that.” Gyory added that he doesn’t think it’s “fair to ding the governor much on the congressional lines,” suggesting that the bigger issue is the state’s lackluster voter turnout. While some observers applauded Cuomo’s push for independent redistricting, when it comes to Hochul, drawing a more favorable district – or at least preventing the addition of more Republican voters – might have been the only realistic shot at keeping the seat in Democratic hands. A source involved in Hochul’s 2012 reelection campaign, who only spoke on the condition of anonymity to speak freely, said that the new lines undoubtedly made for a tougher re-election fight. The tougher odds also made it harder to get national Democrats to fund Hochul. “It was still close. It was more indicative of the candidate than the district itself, which is a pretty conservative district,” the source said. “She just happened to be there for a long time and was pretty well-known. I don’t know if the district will ever be won by a Democrat again as it currently stands, unless Collins goes down in flames for some reason.” Nor is Hochul’s case an isolated example. When Cuomo was running for his first term, congressional Democrats were

bound to lose seats in the 2010 midterms. But with then-Gov. David Paterson as a lame duck and Cuomo widely seen as the heir apparent, he arguably could have done more to assist fellow Democrats that year. In the wake of further losses in 2014, then-Rep. Steve Israel, who headed the national Democratic Congressional Campaign Committee’s efforts that year, suggested that Cuomo had been of little help. “I have no comment on Governor

Cuomo’s effect on this election. Quote me on that,” he told The New York Times, adding: “We had conversations several months ago with the governor’s staff about helping to organize and coordinate a campaign and I didn’t see the fruition to those conversations.” And in 2016, Cuomo eventually endorsed Zephyr Teachout, the Democratic nominee running against Faso. But the governor, who had been embarrassed by Teachout’s strong

challenge against him in the 2014 Democratic gubernatorial primary, wouldn’t even endorse her by name. Now, in response to President Donald Trump’s policies – and perhaps to pave the way for his own potential presidential campaign – Cuomo is positioning himself as a leading voice on the national stage. Will 2018 prove to be a turning point for the governor’s support of Democratic congressional candidates, or will it be more of the same?

EARLIER THIS YEAR, Republican efforts to repeal the Affordable Care Act so outraged New York Democrats that they launched a campaign to defeat local GOP House members. Gov. Andrew Cuomo took a lead role in the campaign, which is targeting six GOP incumbents: Reps. Chris Collins, John Faso, Tom Reed, Elise Stefanik, Claudia Tenney and Lee Zeldin. While the effort to end Obamacare failed, the stakes were raised when a sweeping Republican tax reform package advanced through both houses of Congress. The U.S. Senate and House still must be reconcile their versions of the legislation, but New York is among the states expected to bear the biggest fiscal burden as a result of the changes. Collins has been dogged by an investigation into allegations of insider trading, but he enjoys a sizeable voter registration advantage in his district and saw one potentially promising Democratic challenger, Erin Cole, already drop out. As of September, Collins had raised nearly $630,000 and spent more than $320,000 this election cycle.

Assemblyman Anthony Brindisi of Utica has been in the Assembly since he won a September 2011 special election. As of September, Brindisi had raised $454,000, while Tenney had nearly twice that. However, Brindisi outpaced the incumbent in the most recent fundraising cycle. An October poll showed Brindisi with a narrow lead, though the poll was conducted by the Democratic Congressional Campaign Committee.

IN MARCH, Collins and Rep. John Faso added an amendment to the House Republicans’ Obamacare repeal legislation that would have shifted Medicaid costs from New York’s counties to the state. New York Democrats have been on the attack ever since. While Faso voted “yes” on the Obamacare repeal, he bucked the party by voting “no” on the GOP’s tax reform legislation. Nonetheless, he is seen as vulnerable in the 19th Congressional District, which has slightly more Democrats than Republicans. Faso has already drawn a crowd of opponents in the Hudson Valley, although two Democrats have already dropped out. Like last year, when Faso was first elected to Congress by beating Zephyr Teachout, the contest could be one of the most expensive races in the country.

THE MOST IMPORTANT QUESTION in front of the state Legislature’s racing and gambling committees this year won’t be decided in Albany, but several hundred miles south of the state Capitol in the U.S. Supreme Court. On Dec. 4, the justices heard oral arguments in Christie v. NCAA – a case that could open the door for sports betting nationwide.

“It’s already in the (state) constitution, and enabling legislation has already been written, and everything is set up,” said Assemblyman Gary Pretlow, chairman of the Racing and Wagering Committee. “We’re ready to go.” Pretlow has been one of the most prominent advocates for expanding gambling in the state. He helped write the state consti-

tutional amendment that allowed a number of commercial casinos to open and included a provision that would allow sports betting at those casinos if it were ever legalized nationwide. That could be on the verge of happening, with SCOTUSblog reporting that the U.S. Supreme Court justices at oral arguments seemed to lean in favor of sports betting.

State Sen. John Bonacic, chairman of the Racing, Gaming and Wagering Committee, agreed with Pretlow that if the court allows it, New York is good to go. “When we did that constitutional amendment, we envisioned that in the event that the sports ban was eliminated federally that they could (start betting on sports) immediately,” he said. “And you know, (New) Jersey is all geared up and Pennsylvania is all geared up, and to a certain extent, we’ve got to keep up.” But Karl Sleight, a member at Harris Beach and the leader of the law firm’s racing and gaming industry team, wasn’t so sure that the dormant betting provision would be enough. He said there would likely need to be, at a minimum, some amendments to that statute based on the wording in the U.S. Supreme Court ruling. “But it’s difficult to forecast without seeing the language in the Supreme Court decision,” he said. “That’s one of the difficulties at this stage.” Even if betting does come soon to the state’s recently opened commercial casinos, it would not be allowed at other locations, such as at racetrack casinos and off-track betting parlors. expansion of gaming in our state based on the advances in technology. It’s bound to happen. And Resorts World being the ultimate business venture in gaming downstate, they’re always looking to see how they could be on the forefront of something like that, and they have the means to do so. We all know now they are a credible, proficient business in our state.

C&S: New York is preparing in case sports betting is legalized nationwide. With Resorts World Casino New York City in your district, would you support it? JA: I wouldn’t want to speak for the casino … Resorts World is very confident in the product it has. It’s had a five-year head start. They have a very successful product. They only see it getting more successful, and I have real confidence and optimism that they will be successful going forward. And we always talk about the future, because it’s inevitable, the

C&S: How successful is Resorts World? JA: It’s one of the most successful gaming sites in the country, and that’s comparing it even to the sites in Nevada. But we just heralded a number that I absolutely love, and that’s $2 billion for education … so in the end, it’s a direct benefit to our children. And that is amazing. For me, locally, it’s about jobs. I’ve got a site that has over 1,000 jobs, mostly for local constituents. The bottom line is it’s hard to find a place that economically (is) an engine for our city and state and that provides jobs. And with this construction, you’re looking at about 1,000 more construction jobs and about 1,200 postconstruction jobs.

has already introduced a bill that would do just that. Resorts World Casino New York City, one of the state’s racetrack casinos, or racinos, would be interested in adding sports betting to its offerings, according to Dan Bank, spokesman for the Queens casino. “If sports betting was allowed under federal and New York state law, Resorts World Casino New York City would work to quickly implement it as part of our gaming experience,” he said. But as a racino with certain limitations, the company would have to wait. State constitutional amendments need to be passed by two separately elected legislatures and then approved by voters, so the soonest it could go into effect would be January 2020. Bonacic said sports betting could help raise revenue at the racinos and OTBs, which helps fund education and supports county budgets. With the state comptroller projecting a more than $4 billion deficit heading into 2018, “the state’s going to need money,” Bonacic said. “And my thinking is let all three do it (casinos, racinos and OTB) if the people will allow it for the racinos and the OTB.” But Sleight is cautious when it comes to talk of revenue. If the Supreme Court decision allows states to legalize gambling, it might become an “ultracompetitive market.” “New York will need to be competitive,” Sleight said, “because if they put together a model that’s not competitive, then the

folks who want to wager will just go to another outlet.” It’s also not clear on how the Supreme Court’s ruling in the Christie v. NCAA case could affect New York’s Native American casinos. A request for comment from the Oneida Indian Nation, which runs casinos in Central New York, was not returned. Industry publication Legal Sports Report wrote that sports betting wasn’t on the radar of most Native American casinos. But predicting when and what the Supreme Court will decide could be harder than picking a World Series winner during spring training. And a decision may not even come until June, when the state legislative session is over, or close to it. “This is all up in the air,” Sleight said.

C&S: The new casinos aren’t hitting their revenue projections. Why not? Were they too optimistic? JB: I think they did put rosy projections in when they did their applications for license. But in all fairness, I do think three years is not an unreasonable time to judge them as to whether those projections were valid or not. I still think they’ve created private sector jobs. They will have been a magnet for other economic vitality coming into the area – businesses that feed off the resort, that service the resort. And I do believe it’s going to help the tourism industry. I know the media keeps writing, “Oh, it

didn’t meet the projections,” but I still say it’s a little early. And the people wanted it! You’ve got to keep that in mind. The people wanted this form of recreation. So I don’t see it as a black eye if they’re not meeting projections now. There’s a lot of good things happening as a result of the three casinos. C&S: What’s your top priority this year with the Racing, Gaming and Wagering Committee? JB: I would like to see online gaming, for poker and all. We’ve passed it two years in a row in the Senate and the Assembly hasn’t moved on it, although Gary Pretlow, who

chairs the Assembly Racing and Wagering Committee, wants it. But apparently he couldn’t get it through his house and I’m hoping he’s going to be more successful in 2018. And the other thing, and not in the same glitz, is charitable gaming, to allow American Legions and Veterans of Foreign Wars posts to do charitable gaming. They need a new stimulus to get the people back there spending money. And these were always places where veterans could go or people from the community could go who were lonely and you would have people there to share experiences with, socially.

C&S: You’ve asked state Comptroller Thomas DiNapoli to investigate why the new upstate casinos are not meeting their revenue projections. Why do you think revenues are low? GP: The revenues that the casino operators projected were all based on what they thought – or they claim they thought – what the actual revenues would be. But I’m of the suspicion that they boosted those revenues and offered more than they should have offered based on the real numbers just to get the license. And then within a year they want to turn around and say now lower the tax rate – more like a bait and switch.

They have not asked yet for a tax reduction. But I’m just assuming that that’s the next step. And they’re going to threaten us with loss of jobs and yadda, yadda, yadda. And I just want to make sure that everything is on the up and up. C&S: Are there any states with gambling industries that you look to emulate? GP: No. I think that New York is in the forefront of casinos. Before we had the commercial casinos open, New York’s general income from the racinos surpassed Nevada’s. And Nevada has dozens and dozens of casinos, but New York was taking in more money in the state than all

those casinos combined. I pride myself on trying to do the best for the state of New York. And of course every dollar that comes in from these casinos and racinos goes to education. C&S: The debate ended a year ago and daily fantasy sports was legalized in New York. How’s that going? GP: There’s revenue for the state. Now it’s regulated and I have heard no complaints from the DFS operators. I’m still looking at some of the other fantasy sport operations like Yahoo and those types and see if we can get some revenue out of them also.

Gaming USA Corp.’s Alan Woinski on what the state’s casinos need to do to survive NEW YORK’S NEWEST commercial casinos have failed to meet their projected revenues, creating uncertainty around the opening of a fourth casino early next year. In an interview with City & State, Alan Woinski, president of Gaming USA Corp., a New Jersey-based gambling consultancy group, weighed in on the future of the state’s casinos and racinos. The following is an edited transcript.

C&S: How likely is it that the casino revenue projections will be met for the three casinos that are currently open? AW: No way. The only way that happens is if you close up a bunch of the racetracks. That’s probably the only way they have a shot at making it. The reality is, there’s just not enough business to go around. There’s a very big problem in the industry, and that is, they seem to think that if you build a

bigger casino, you will get all the customers. But when you talk about regional or convenience gambling, the majority of people will just go to the nearest slot machine or table, not the one in the nicest property. C&S: Do you think that this is part of a larger trend? AW: Absolutely. Ohio opened – their four casinos were $1 billion below what the rev-

to wind up eliminating the one thing that they have been doing correctly. That’s what the state has to understand. Sometimes you cater to the ones that make the big investment, not the ones that have been there the longest. I said a few years ago that any new casinos that open in the Northeast, it becomes a zero-sum game. And what I meant by that is, what gets taken away from the others kind of offsets whatever benefits you get from the new properties.

enue was expected to be. The first property opened in Massachusetts, which was a racetrack casino, it was well below expectations. So there’s really a few ways of looking at this. The casinos have been very successful in creating jobs. For example, the Rivers Casino and Resort – what they’ve done in that entire Albany area up there. The problem is the gaming revenue. Now, it’s easy for lawmakers to sit there and say, “Well, we’re not going to give these new casinos a break” (by providing revenue to struggling casinos). But what they don’t realize if they don’t give them a break, they’re going to have to start laying people off. They’re going

C&S: Do you think the planned Resorts World Catskills will meet its revenue projections? AW: Well, if it does not, then the whole state is sunk. That casino cost more than the other three combined. Resorts World – you’re spending over a billion dollars on a market that’s probably going to be four months out of the year. It’s going to be like Atlantic City. Nobody from northern New Jersey or New York City is driving out to the Catskills in the winter just to gamble. There’s no way. With a one-lane highway? There’s no way that’s going to happen. So, I think everybody in New York has to kind of get a little realistic on what this market is

and then other ones will go where they’re treated the best. They’ve kind of got three different customers and everybody’s going after the same one. I totally understand the racetracks being concerned. They can’t market like the casinos because they pay too much. At this point, what’s the sense in keeping them around? Granted, you’d lose a lot of jobs, but you’d have to kind of figure out whether you want jobs, whether you want tax revenue or whether you want both. And to get both these days, from a casino, it’s not going to happen because somebody else in the state is going to get hurt. And they’ll wait for Resorts World Catskills, but I don’t think they’re going to be pleasantly surprised by what happens there. C&S: Would a solution be to just make more realistic projections? AW: Here’s the problem: The commission subs it out to consultants. And unfortunately, in this business, consultants usually tell either the company or the state what they want to hear. A consultant isn’t going to be hired again if they give bad predictions. So, if a consultant comes in and says it’s going

If this new governor here in New Jersey is able to convince lawmakers to put a casino in the Meadowlands, it’s all over for New York. They’ll be able to drive 100 trucks through the hole in their budget because it will wipe out Resorts World in Queens, Yonkers and Resorts World Catskills all in one shot. C&S: Why do casinos struggle with competition? AW: Gambling customers are kind of fickle at times. Some of them will only go where there’s marketing and promotions, other ones will just go to the ones closest to you

to make X amount, and the casino comes in with a more realistic amount, they’re just not going to get the bid. So what incentive does the casino have to come in with a really realistic number? Because somebody else is going to be coming in with an unrealistic one. And a lot of them don’t do it on purpose. I’m sure these three casinos had to base their opinion on the fact that they were going to be in noncompetitive markets, just like the state had promised. Now, if the state really wanted a noncompetitive market, why didn’t they pick one in Orange County, New York? That would’ve been the best location for a casino.

“We need to make sure every high-rise building has fire drills. It’s required by law,” said Joseph Pfeifer, chief of counterterrorism and emergency preparedness at the FDNY. “But how about we also throw a 30-second video on to the people in these buildings on how to stop the bleeding?” Pfeifer added, “What about next to the fire extinguishers and the defibrillators that we have, why not throw some tourniquets in there?” Although there is little that civilians can do to stop the violence, those who are trained may be able to limit the number of casualties. Whether that is applying a tourniquet or some other first aid, civilians can receive simple training to buy time for first responders by preventing someone from dying.

“That starts with the first person who is stopping the bleeding,” Pfeifer said. “Medical personal will come in to continue that – stopping the dying, and that continues all the way to the hospitals. So it’s the entire spectrum of care, from a co-worker, to the first responders, all the way to the operating room. … We’re all part of that.” By posting on social media and using new apps, people can call for help and aid in law enforcement’s response to terror attacks and mass shootings. Parrino said the New York State Police plays on the classic slogan, “If you see something, say something” to make it “If you see something, send something.”

But all of these measures are reactionary rather than proactive. State Sen. Thomas Croci, who was also on the panel, said those agencies need proper backing and, ultimately, a balance must be struck between individual freedoms and the overall protection of the society in order to prevent these attacks. “I don’t ever want to live in a country or a city where you have to fear getting on a bus because it might blow up,” Croci said. “And if Americans don’t think that’s a potential here, that’s a real problem.”

The Building Trades Employers’ Association is New York’s largest Contractor Association. It represents 26 individual construction contractor associations and 1,000

trade subcontractors. In 2016, BTEA Member Contractors had construction revenues of $35 billion in commercial, residential, interior renovation, healthcare, education, cultural, transportation, infrastructure and other projects while achieving the City’s best safety record in NYC.
