1. Introduction 1.1 Overview The City Rail Link (CRL) project comprises the construction, operation and maintenance of a 3.4km twin-tunnel underground passenger railway, running between Britomart Station and the North Auckland Line (NAL) in the vicinity of Mt Eden Station. The CRL involves the construction of two new underground stations at Aotea and Karangahape, and a redeveloped station at Mt Eden. The design and construction of the CRL infrastructure between the Aotea and Mt Eden Stations is being delivered by the Link Alliance.

In 2017, City Rail Link Limited (CRLL) submitted an outline plan for canopy removal and utility relocation works within the Aotea Station area, along the western side of Albert Street between Victoria Street West and Wellesley Street West (Auckland Council ref. OPW60310921). This outline plan was accepted by Auckland Council without changes.

Additional utility relocation and canopy removal works are required beyond the footprint of the approved works. As such, the Link Alliance is seeking authorisation for works that are beyond the scope of OPW60310921.

This addendum updates the “Albert Street Canopy Removals and Utilities Relocation Contamination Delivery Work Plan”, prepared by Golder Associates (Doc Ref CRL-PAT-RME-000-RPT-0098) dated November 2017 (“the Approved CDWP”), and is submitted to Auckland Council to support the authorisation of the additional works.

This addendum must be read in conjunction with the Approved CDWP.

1.2 Report Structure The structure of this addendum is based on the Approved CDWP.

1.3 Purpose of the CDWP No changes are proposed to this section of the Approved CDWP.

2. Project Description 2.1 Overview The project site applicable to this addendum is in Auckland City Centre, within the road corridors of Albert Street, and the adjoining streets, between Wyndham Street and Mayoral Drive (as illustrated in Figure 1). The site area also includes the formation of a Construction Support Area (CSA) within the car park of Bledisloe House. The site adjoins the project area of the canopy and utility relocation works authorised by consent number OPW60310921.

The area surrounding the project site is a dense urban environment with a built form comprised of medium to high rise buildings. Common land uses in the project area include commercial offices and services, residential apartments, retail, civic, hospitality, hotel accommodation and car parking. Along Albert Street multiple active construction sites are present including for the CRL and private development. Buildings adjoin much of the project site boundary (road corridor) forming active frontages that provide access to private property and businesses.

The area of works is highly utilised by pedestrians and vehicles, both for private and business purposes.

Albert Street, Victoria Street West, Wellesley Street West and Mayoral Drive are classified as primary arterial roads. Kingston Street and Durham Street West are classified as local roads.

2.2 Proposed works The Stage 4 and 5 utility relocation works, canopy removal works and Construction Support Area establishment (herein referred to as the ‘Stage 4 and 5 works’) involves the following main activities: • • • • • • • •

Canopy removal; Utility relocation activities via trenching; Utility relocation activities via micro-tunnelling within Victoria Street West; Closure of the Albert Street / Wellesley Street intersection to undertake east-west and north-south trenching works for utility relocation; Closure of the southern slip lane from Durham Street to Albert Street for approximately 4 to 6 weeks to allow for utility relocation; Closure of Kingston Street for approximately 4 to 6 weeks to allow for utility relocation; Directional drilling along Wellesley Street between Albert Street and Federal Street, and; Establishment of a construction compound to support the subsequent main station construction works.

2.3 Construction Methodology The methodology for utility relocation and canopy removal proposed during the Stage 4 and 5 works is essentially the same as set out in Section 2.3 of the Approved Construction Environmental Management Plan (CEMP). A full description of the methodology associated with the Stage 4 and 5 Page 6

This includes a description of the Stage 4 and 5 works which are beyond the scope of works described in the Approved CEMP. Staging plans and site layouts for each stage of the works are provided in Appendix C of the CEMP addendum.

2.3.1. Project Programme The Stage 4 and 5 works are anticipated to take approximately 9 months to complete based on current knowledge of underground utilities. Should unforeseen ground conditions or additional utilities be encountered during the course of the works, then the project duration will extend beyond the 9 month time period, by up to 3 months.

2.3.2. Hours of Operation It is anticipated that construction work will be undertaken between 0700hrs to 1900hrs Monday to Saturday. Limited construction works may be undertaken beyond 1900hrs, however this would not be a general occurrence and any such works would be done in accordance with the relevant CRL designation and resource consent conditions.

3. Summary of Soil and Groundwater Quality No changes are proposed to Section 3 of the Approved CDWP.

4. Roles and Responsibilities No changes are proposed to Section 4 of the Approved CDWP. Critical roles described include the Construction Contractor, Environment and Sustainability Manager (ESM) and Contaminated Land Specialist (CLS).

5.

Site Management Goals

Site management goals for the works are as follows: • • • •

To ensure that the land disturbance activities associated with the works are completed in accordance with designation and resource consent requirements.

To manage and mitigate potential risk to the health of the workers and neighbouring parties during proposed land disturbance activities.

To manage and mitigate potential environmental effects that may be generated because of the land disturbance activities.

To ensure that any spoil generated for off-site disposal is managed appropriately and is disposed to a licensed facility authorised to accept such materials.

6. Environmental Site Management Practices 6.1 Overview This section details the procedures for the management of potentially contaminated soil and groundwater during land disturbance activities. It includes control measures for management and mitigation of potentially adverse human health effects associated with exposure to contaminated media, and the control of discharges to air, land, and water.

6.2 Surface Water and Sediment Control Erosion and sediment control shall be implemented by the Construction Contractor as described in the Approved Erosion and Sediment Control Plan (ESCP) and associated addendum for the Stage 4 and 5 works. All surface water and sediment control and monitoring will be managed by the Construction Contractor in accordance with the Approved ESCP and addendum.

6.3 Soil Excavation and Disposal 6.3.1. General Investigations of soil contaminant concentrations completed in support of this project (AECOM, 2012 and Golder 2014) identified that significant soil contamination was unlikely to be encountered during land disturbance works. There is however, the potential to encounter gravel type fill materials for which soil contaminant concentrations (metals and heavy end hydrocarbons) are above applicable standards defined by the ‘National Environmental Standard for Assessing and Managing Contaminants in Soil to Protect Human Health’ (NES CS) and Auckland Unitary Plan (AUP) Permitted Activity Criteria.

At that stage, there is no requirement for a remedial action plan to be produced for works within the project area. It is however possible that unexpected soil contamination or hazardous materials could be discovered during the land disturbance works. If unexpected soil contamination is identified the management practices outlined in Section 7 of the CDWP addendum shall be implemented.

6.3.2. Classification The majority of spoil material generated as part of the land disturbance works will likely be removed from the project area and disposed off-site. Any natural soil materials including Tauranga Group sediments and East Coast Bays Formation (ECBF) materials have been assessed as suitable for disposal as cleanfill. Any material required to be removed from the works area will be removed from the site to the nominated off-site disposal immediately, or temporarily stockpiled in covered and/or bunded areas onsite. Any decision regarding immediate disposal or temporary site stockpiling will be dependent on the requirement for additional testing, if requested by the disposal facility. The disposal facility shall nominate the additional testing requirement which would be completed by the CLS. A summary of preliminary soil classifications for the project is provided in the following sub-sections.

Cleanfill Cleanfill is defined in the Auckland Unitary Plan Operative in Part (AUP) (2019): “Means natural material such as clay, gravel, sand, soil and rock which has been excavated or quarried from areas that are not contaminated with manufactured chemicals or chemical residues as a result of industrial, commercial, mining or agricultural activities. Excludes: •

Hazardous substances and material (such as municipal solid waste) likely to create leachate by means of biological breakdown;

•

Product and materials derived from hazardous waste treatment, stabilisation and disposal practices;

•

Materials such as medical and veterinary waste, asbestos, and radioactive substances;

•

Soil and fill material which contain any trace element specified in Table E30.6.1.4.2 at a concentration greater than the background concentration in Auckland soils specified;

Combustible components;

•

More than 5% by volume of inert manufactured materials (e.g. concrete, brick, tiles); and

•

More than 2% by volume of attached biodegradable material (e.g. vegetation)”

A facility where cleanfill material is accepted for deposit, excludes: •

Storage and use of cleanfil material within an earthworks site for the purpose of engineering contours for specific activities,

•

Placement of cleanfil material associated with road construction and maintenance activities, and

•

Onsite storage and use of overburden or aggregate by-product that is cleanfill material associated with mineral extraction activities.

Natural soil materials including Tauranga Group sediments and ECBF would be suitable for disposal as cleanfill and may be disposed of at a consented disposal facility such as the Ridge Road Cleanfill (Pukekohe, Auckland), or to other project sites in the region (depending on their resource consent requirements). Please note that classification of cleanfill may vary in regions outside of Auckland.

Managed Fill Managed fill is defined in the AUP as follows: “Cleanfill type material but where the material may include soils which exceed permitted activity contaminant concentrations that will not result in any significant adverse effect on human health, surface water, or groundwater quality, including potatble water sources.”

Disposal of managed fill must be to a facility authorised (by regulatory bodies such as Auckland Council or Waikato Regional Council) to receive the material.

Fill materials (likely to be encountered at shallow depths) within the Project area are likely to be suitable for disposal as managed fill pending pre-approval before disposal at a particular facility.

Contaminated Fill For the purposes of this CDWP contaminated fill1 comprises: •

Hazardous materials in the form of household and industrial waste, organic waste or asbestos containing material.

•

Soil with contamination present above managed fill criteria.

It is proposed that all contaminated fill disturbed as part of the earthworks will be removed from site to a licenced facility. Disposal of contaminated fill must be to a landfill authorised to receive the material. Landfill acceptance criteria vary between waste facilities and these should be confirmed prior to the removal of soil from site.

Any spoil materials generated within the project area which cannot be accepted at a managed fill (due to site specific restriction) must be removed to a contaminated fill facility. Examples include Hampton Downs (Hampton Downs, Waikato) and Redvale landfill (Silverdale, Auckland) facilities. Pre-approval will be required for these disposal locations.

6.3.3. Record Keeping The following off-site soil disposal management and record keeping measures will be implemented by the Construction Contractor: •

A record of the soil location, depth, and volume of the material removed shall be kept for the purpose of being included in the Works Summary Report (WSR) to be prepared by the CLS, refer Section 8.

•

Records will also indicate whether the material was removed as cleanfill, managed fill or contaminated fill.

•

Irrespective of the disposal facility nominated, all vehicle movements including registration, estimated weight, and disposal location will be recorded.

•

Tracking documentation is to be signed prior to leaving the project area and checked at the waste disposal facility to track all material leaving project area.

•

Transporting subcontractors are required to cover loads and take appropriate measures to control dust.

•

Trucks will be inspected prior to departing the site to ensure the load is adequately covered and any spillage is contained.

•

All trucks will be required to travel on a designated route between the site and the selected waste disposal facility.

Receipts summarising soil disposal will be collated and provided to the CLS at the completion of the land disturbance activities for the Project.

A record of any contaminated soil left in-situ including the soil location, depth and estimated volume shall also be recorded for the purpose of being included in the WSR.

6.4 Groundwater and Perched Water Contaminated groundwater is not anticipated to be encountered as part of the works. Groundwater and perched water will be managed by the Construction Contractor in accordance with the approved Groundwater and Settlement Monitoring and Contingency Plan (GSMCP).

6.5 Dust Control and Monitoring Dust control shall be implemented by the Construction Contractor as described in the Project Air Quality Delivery Work Plan (AQDWP).

6.6 Materials Importation 6.6.1.

General

Materials will be required to be imported to the works area to complete the subgrade. Two sources of material are proposed, clean quarry materials and recycled crushed concrete aggregate. Material sourced from a certified quarry or supplier does not require testing. This material is considered to meet the definition of a cleanfill (refer Section 5.3.2.1).

6.6.2.

Crushed Concrete

Prior to materials acceptance the contractor will request the following information from the supplier: • • •

Address of source site.

Copies of pre-demolition asbestos surveys.

Copies of asbestos clearance certificates prepared prior to demolition.

This information will be reviewed by the CLS, who will advise the Link Alliance/Construction Contractor regarding suitability. Additional testing of crushed concrete materials may be required to be undertaken to approve suitability. This will be agreed between the CLS and Link Alliance/Construction Contractor on a case by case basis.

The following verification and testing regime will be completed by the CLS in support of the acceptance of recycled crushed concrete aggregate.

The CLS will complete daily site walkovers.

Visual observations will be made for the presence of plastic, metal, or other waste fragments such as potential asbestos sheeting.

Testing will be completed from stockpiled materials at the site at rate of one sample per 500 m3.

Bulk samples of suspect asbestos-containing materials will be analysed via an appropriatelyaccredited laboratory.

Soil samples will be analysed via New Zealand Guidelines for Assessing and Managing Asbestos in Soil (BRANZ 2017) methodology.

Samples may be analysed for asbestos presence/absence as a screening measure, at the discretion of the CLS.

The Link Alliance/Construction Contractor and the CLS will retain records pertaining to materials importation completed. These will be provided to the Project Contaminated Land Professional for inclusion in the WSR (refer Section 9).

7. Health and Safety Plan No changes are proposed to Section 6 of the Approved CDWP.

8. Unexpected Discovery of Contamination 8.1 General It is possible that unexpected contamination or hazardous materials could be discovered during the excavation works – including but not limited to the following: •

Intact or broken drums and containers.

•

Soil materials with unusual odours.

•

Indicators of coal tar, e.g. strong naphthalene odour and texture ranging from viscous tar to low density clinker rock.

•

Discoloured or stained water seeps and soils.

Hydrocarbon contaminated soil and/or free product.

•

Liquid waste and any material that normally would be sent to a licensed landfill.

During land disturbance works site workers will actively monitor project areas for the conditions/materials specified above. In the event that one of these is identified, the following actions shall be taken: •

Work will cease.

•

The Construction Contractor will contact the CLS.

•

Health and safety restrictions will be implemented including limiting access to the area, shut down equipment to reduce potential ignition sources and move workers to an upwind location.

•

The CLS will advise on the appropriate course of action. This may include the completion of additional soil testing. All sampling and testing shall be completed in general accordance with Contaminated Land Management Guidelines, No.5 – Site Investigation and Analysis of Soils, Ministry for the Environment (revised 2011).

•

The Link Alliance/Construction Contractor will notify (in writing) the Team Leader of Central Monitoring of the identification and the proposed course of action recommended by the CLS.

•

Work shall not resume unless authorised by the Construction Contractor under advice of the CLS.

•

Record all details on an incident form, including GPS of location.

•

If the CLS considers it appropriate, the suspected contaminated material may be excavated into a covered bin to allow works to continue with minimum delay.

•

If excavation into a covered bin is inappropriate, construction work should proceed to an area clear of contamination indicators until material testing as necessary defines the material characteristics.

•

When the material characteristics have been established, soil remediation and management options will be assessed and implemented in accordance with the ISCA Lan-3 sustainability hierarchy (Note: An additional resource consent is likely to be required to reuse contaminated material on site). A rating tool (multiple category assessment table) will be utilised as part of this decision-making process (refer Appendix C of the Approved CDWP).

•

If unsuitable material is to be directly loaded into trucks for disposal at a licensed landfill, all appropriate information such as location, quantity and off-site weighbridge dockets must be recorded.

8.2 Asbestos Should asbestos be observed or suspected during the land disturbance works, all work shall cease, and an appointed asbestos professional will be provided by the CLS. The following regulations and guidelines should be followed with respect to asbestos management: • •

Health and Safety at Work (Asbestos) Regulations 2016.

New Zealand Guidelines for Assessing and Managing Asbestos in Soil, BRANZ (2017).

Works can recommence once asbestos has been appropriately managed/safely removed as advised by the asbestos professional provided by the CLS.

9. Works Summary Reporting No changes are proposed to Section 8 of the Approved CDWP.

10. Review and Updating of the CDWP The Approved CDWP and this addendum will be updated by the CLS as required to provide for project conditions. The revised CDWP will be updated as required by the process set out in the CRL designation conditions.

Auckland Council review Comment Section 4.3.8 (Contaminated Soils) of the CEMP Addendum This section notes that Section 5.3 of the CDWP addendum has been revised to include a reference to the WasteMinz Technical Guidelines for the Disposal to Land (2018) for the classification of managed fill.

However, Auckland Council has not yet adopted this document, and follow a review of Section 5.3.2.2 (Managed Fill) of the CDWP Addendum (see below) we have requested that this section is revised to reference the definition of managed fill as provided under the Auckland Unitary Plan (Operative in Part) for any materials to be disposed of within the Auckland region.

Section 5.3.2 (Classification) of CDWP Addendum We note that the following statement is made in this section:

Noted, the report has been updated with this reference removed.

Any fill material required to be removed from the works area will be temporarily stockpiled, either in covered and/or bunded areas onsite or at a storage location provided by subcontractors.

Could the consent holder please provide further information regarding the proposed storage locations provide by subcontractors.

Please note it is Council’s position that any contaminated material taken off-site may only be stored at or disposed of to a site that holds the appropriate consents under Chapter E13 of the AUP (OP).

Section 5.3.2.2 (Managed Fill) of the CDWP Addendum

Noted, and updated accordingly.

Auckland Council has not adopted the document Waste Management Institute New Zealand (WasteMinz) Technical Guidelines for Disposal to Land (2018) in part because it is still being revised and has not been endorsed by Ministry for the Environment.

Accordingly, the description provided under the subsection Managed Fill/ Soil Material is not considered to be relevant for materials being disposed of within the Auckland region.

Accordingly, could the consent holder please revise this section to reference the definition of managed fill as provided under the Auckland Unitary Plan (Operative in Part) for any materials to be disposed of within the Auckland region.

Section 5.6.2 (Materials Importation) of the CDWP Addendum

Noted, and updated accordingly.

As requested in review comments for the CDWP documents for other components of the CRL project we consider that crushed concrete material imported to site should be sampled at a rate of no less than 1 sample per 500m3 for asbestos.

Could this section please be revised to reflect this.

Section 7 (Unexpected Discovery of Contamination) of the CDWP Addendum Whilst we’re generally satisfied with this section of the CDWP, it is noted that no reference is made to the requirement that the Team Leader of Central Monitoring is notified upon the unexpected discovery of contamination, and that the works in the area containing the unexpected contamination should not recommence until this is done.
