Proposal: To change condition 1 of resource consents R/LUC/2016/5464, R/REG/2016/5466, R/REG/2016/5473, R/REG/2016/5474, R/REG/2016/5477, R/REG/2016/5478, and conditions 23, 27a, 29, 29a, 34 and 36 of resource consents R/REG/2016/5466 and R/REG/2016/5473 in order to reflect changes in the construction methodology for part of the City Rail Link (CRL) project. This part of the CRL project is to enable construction of the future CRL tunnels by realigning the Nikau Street Stormwater Main. The appointed contractor for the works has proposed a slightly different design and construction methodology to that originally proposed. The relevant conditions of the consents then require consideration to being changed to accommodate the revised construction methodology. To be considered in terms of section 127 of the Resource Management Act 1991.
Decision on notification I have read the application, supporting documents, and the report and recommendations on the application to change conditions of the resource consents. I am satisfied that I have sufficient information to consider the matters required by the Resource Management Act 1991 (RMA) and make a decision under delegated authority on notification.
Public notification Under section 95A of the RMA this application shall proceed without public notification because: 1.
Under step 1, public notification is not mandatory as: a.
the applicant has not requested it
b.
there are no outstanding or refused requests for further information, and
