Purpose and Project Scope As requested, I provide an assessment of archaeological values within the Normanby Road Early Works project area and the archaeological management procedures that must be followed during the early works.

The project area is shown in Figure 1 (shaded area) and I understand the works include: the establishment of a CSA at 14-22 Boston Road, 11 Water Street and partly within 28 Mt Eden Road; utilities diversion including wastewater and stormwater lines; construction of retaining walls at 32 Normanby Road and at the southwest corner of the Normanby Road/ Boston Road roundabout; and construction of a temporary pedestrian and utility bridge across the Normanby Road rail crossing.

Archaeological Values within Project Area The archaeological values of the properties within the project area off Boston Road, Water Street, Mt Eden Road and Normanby Road have previously been assessed by Clough & Associates for consent and authority purposes as part of the wider CRL project (Macready, Burnett and Clough 2017) and for the Nikau Street Stormwater Realignment works (Macready and Clough 2016). The assessments identified that the proposed CSA at the bottom of Water Street was the location of a former spring known to Maori as Te Ipupakore, said to be one of the main water sources for Maungawhau Pa (Mt Eden). In the late 19th century this area was taken for railway purposes and the area subsequently infilled and modified. There was no pre-1900 European development within the car park area at 14-22 Boston Road, the first structures being a commercial building and accommodation for railway employees c.1930s. The car park area was modified further in 2018 by the construction of the Water Street Shaft and associated clearing and levelling for the Nikau Street Stormwater Realignment. No archaeological remains were exposed during these works and the potential for unidentified subsurface archaeological remains to be exposed during project works is low.

However, the significance of the water source is to be acknowledged within urban design feature at the Mt Eden Station.

The properties at 11 Water Street and 28 Mt Eden Road were occupied by small residential properties in the 1940s and 1950s (based on aerial photographs), but it is not known whether these dated back as early as the 19th century. Most if not all remains of these are likely to have been removed by subsequent commercial development of the properties.

The affected area within 32 Normanby Road south of the railway line is a modified area previously used as a railway siding and for goods storage and is unlikely to contain any archaeological remains, while archaeological remains would not generally be expected beneath modern roads (Normanby Road and the driveway to 24 Normanby Road) due to the modification that has already occurred from service installations, road formation and maintenance.

The Normanby Road early works project area therefore has no known archaeological value. However, the possibility that subsurface archaeological remains may be exposed during the early works cannot be excluded. These might include remains associated with Maori settlement in the area of the car park (artefacts or shell midden), the bases of wells or buried rubbish deposits associated with early residences at 28 Mt Eden Road and 11 Water Street, or elements of historic infrastructure beneath the roads.

Scheduled Historic Heritage Places There are four scheduled historic heritage places outside of, but in close proximity to, the proposed works (Figure 2, Figure 3). These are: •

•

49 Normanby Road – Colonial Ammunition Company Office (former) (AUP Schedule 14.1: ID 02752, Category B

•

26 Normanby Road – CAC Bulk Store (former) (scheduled with immediate effect via Proposed Plan Change 31, Category B)

None of the proposed early works extend into the scheduled extents of place of any of these items. Although the south sewer diversion will be located close to the CAC Bulk Store (former) at 26 Normanby Road, it will be within Normanby Road and along the driveway to 22 Normanby Road and will not extend into the scheduled property or the pavement in front of it which is included in the extent of place (Figure 3).

Statutory Requirements Any pre-1900 archaeological remains relating to Maori or early European settlement are protected under the Heritage New Zealand Pouhere Taonga Act 2014 (HNZPTA) and may not be modified unless an Authority has been granted by Heritage New Zealand Pouhere Taonga (HNZPT). In addition, the Auckland Unitary Plan includes an Accidental Discovery Rule (E12.6.1) requiring that works are halted in the event of an archaeological discovery and specified actions are taken. However, the Rule no longer applies in respect to archaeological sites if an Authority from Heritage NZ is in place.

An Authority has been granted by Heritage NZ (no. 2017/793) covering all works associated with the construction of the City Rail Link from Wyndham Street to Mt Eden/NAL, including utilities relocation and other early works. It requires that work must be carried out in accordance with an approved archaeological management plan (Macready and Clough 2017) which sets out procedures to be followed if archaeological sites are exposed. The discovery procedures set out below are consistent with the procedures in the plan, as well as those set out in Delivery Work Plans previously prepared for City Rail Link works in accordance with the designation conditions.

There are no statutory requirements under the Auckland Unitary Plan relating to the scheduled historic heritage places in the vicinity of the proposed works as there will be no impacts on their scheduled extents of place.

Archaeological Management Plan Briefing to Contractors •

Prior to the start of the Normanby Road Early Works, the Link Alliance Project Manager/contractors will arrange an on-site meeting with the Project Archaeologist1 and Mana Whenua representatives, who will provide a briefing on archaeological and cultural requirements for the works, including the type of archaeological remains that might be exposed during works.

•

The Project Archaeologist will attend toolbox meetings as required by the Link Alliance Project Manager during the course of the works, the purpose of which will be to remind staff of the Project’s archaeological requirements and to ensure that any new staff joining the Project team are fully briefed prior to the commencement of works.

Procedures if Suspected Archaeological Remains are Exposed •

If suspected archaeological remains (of pre-1900 or early 20th century date) are encountered, works will stop in the immediate vicinity of the find (within 20m) until the Project Archaeologist can assess the site.

•

If in situ archaeological features or deposits (of pre-1900 or early 20th century date) are confirmed the Project Archaeologist will advise the Project Manager and works will not resume in the immediate area until the necessary archaeological investigation and recording has been completed.

The Project Archaeologist will investigate and record the remains, in accordance with accepted archaeological practice and the requirements of the HNZPT Authority.

•

If significant archaeological features or deposits that were not anticipated are identified during the early works the Auckland Council (Cultural Heritage Implementation Team Leader and Compliance Monitoring Officer), HNZPT and Mana Whenua will first be notified by the Project Archaeologist, and the remains will then be investigated and recorded in accordance with accepted archaeological practice and as directed by HNZPT, if of pre-1900 date. Any significant remains of 20th century date will also be investigated and recorded as directed by the Auckland Council (Cultural Heritage Implementation Team Leader).

•

If remains indicating Māori occupation are exposed the Project Archaeologist will inform the appropriate Mana Whenua representatives prior to investigation.

The Project Archaeologist is the archaeologist approved under the HNZPT Authority 2017/793, or other qualified archaeologist acting under his direction.

•

If human bone (kōiwi tangata) or Maori artefacts (taonga tūturu) are exposed, the protocols below will be followed.

Kōiwi Tangata (Human Remains) If bone material is identified that could potentially be human, the following protocol will be adopted: •

Earthworks/investigation will cease in the immediate vicinity while the Project Archaeologist establishes whether the bone is human;

•

If it is not clear whether the bone is human, work shall cease in the immediate vicinity until the Auckland University reference collection and/or a specialist can be consulted and a definite identification made;

•

If bone is confirmed as human (kōiwi tangata), the Project Archaeologist will immediately contact the Mana Whenua representatives, HNZPT, the NZ Police Auckland Central crime squad and Auckland Council (Cultural Heritage Implementation Team Leader and Compliance Monitoring Officer);

•

The site will be secured in a way that protects the kōiwi as far as possible from further damage;

•

Once the NZ Police and HNZPT are satisfied that the remains are archaeological, consultation will be undertaken between the Mana Whenua representatives, the HNZPT Regional Archaeologist, the Auckland Council Cultural Heritage Implementation Team and City Rail Link Limited (CRLL) to determine and advise the most appropriate course of action. No further action will be taken until responses have been received from all parties, and the kōiwi will not be removed until advised by HNZPT;

•

The Mana Whenua representatives will advise on appropriate tikanga and be given the opportunity to conduct any cultural ceremonies that are appropriate;

•

If the Mana Whenua representatives are in agreement and so request, the bones may be further analysed by a skilled bio-anthropological specialist prior to reburial, in line with the HNZPT Guidelines Kōiwi Tangata Human Remains (2010); and

•

Activity in that place can recommence as soon the bones have been reinterred or removed and authorisation has been obtained from HNZPT.

Taonga Tūturu (Māori Artefacts) Māori artefacts such as carvings, stone adzes, and greenstone objects are considered to be taonga (treasures). These are taonga tūturu within the meaning of the Protected Objects Act 1975. Taonga may be discovered in isolated contexts, but are generally found within archaeological sites. If taonga are discovered the following protocols will be adopted: •

The area containing the taonga will be secured in a way that protects the taonga as far as possible from further damage, consistent with conditions of the HNZPT Authority;

•

The Project Archaeologist will then inform HNZPT, Auckland Council Cultural Heritage Implementation Team and the nominated Mana Whenua representatives so that the appropriate actions (from cultural and archaeological perspectives) can be determined;

•

The Project Archaeologist will notify the Ministry for Culture and Heritage of the find within 28 days as required under the Protected Objects Act 1975. This can be done through the Auckland War Memorial Museum; and

•

The Ministry for Culture and Heritage, in consultation with Mana Whenua, will decide on custodianship of the taonga. If the taonga requires conservation treatment (stabilisation), this can be carried out by the Department of Anthropology, University of Auckland (09-373-7999) and would be paid for by the Ministry for Culture and Heritage. It would then be returned to the custodian or the Auckland War Memorial Museum.
