ERRATUM TO THE RECOMMENDATION REPORT OF THE INDEPENDENT COMMISSIONERS
1. The Auckland Council appointed us as the Independent Hearings Commissioners under the Resource Management Act 1991 to hear and make a recommendation to Auckland Transport in relation to six Notices of Requirement for designations by Auckland Transport for its City Rail Link project. Our Recommendation report was completed on 28 February 2014. 2. Following the release of the Recommendation report, Mr Richard Brabant, legal Counsel for submitters Samson Corporation Ltd and Stirling Nominees Ltd, contacted the Council to advise he had been incorrectly quoted in the report in relation to the discussion about the lapse period for the proposed designations. The Recommendation report states he “submitted that 5 years would be sufficient and appropriate” when in fact his written legal submissions stated 10 years. We accept that was the case and therefore issue this Erratum to amend the Recommendation report. 3. We record that this amendment has no bearing on the recommendations we have made in relation to the lapse period or more generally for the designations. 4. This Erratum is to replace “5 years” in paragraph 108 of the Recommendation report with “10 years”.
