LET’S TEA TALK with JESUS The Promise Seed From the Editor Pastor /Evangelist Gail

Genesis 17

When Abram was ninety-nine years old the Lord appeared to Abram and said to him, “I am God Almighty; walk before me, and be blameless, 2 that I may make my covenant between me and you, and may multiply you greatly.” 3 Then Abram fell on his face. And God said to him, 4 “Behold, my covenant is with you, and you shall be the father of a multitude of nations. 5 No longer shall your name be called Abram, but your name shall be Abraham, for I have made you the father of a multitude of nations. 6 I will make you exceedingly fruitful, and I will make you into nations, and kings shall come from you. 7 And I will establish my covenant between me and you and your offspring after you throughout their generations for an everlasting covenant, to be God to you and to your offspring after you. 8 And I will give to you and to your offspring after you the land of your sojournings, all the land of Canaan, for an everlasting possession, and I will be their God.” 9 And God said to Abraham, “As for you, you shall keep my covenant, you and your offspring after you throughout their generations. 10 This is my covenant, which you shall keep, between me and you and your offspring after you: Every male among you shall be circumcised. 11 You shall be circumcised in the flesh of your foreskins, and it shall be a sign of the covenant between me and you. 12 He who is eight days old among you shall be circumcised. Every male throughout your generations, whether born in your house or bought with your money from any foreigner who is not of your offspring, 13 both he who is born in your house and he who is bought with your money, shall surely be circumcised. So shall my covenant be in your flesh an everlasting covenant. 14 Any uncircumcised male who is not circumcised in the flesh of his foreskin shall be cut off from his people; he has broken my covenant.” Voices of the Wind

The Promise Seed 15 And God said to Abraham, “As for Sarai your wife, you shall not call her name Sarai, but Sarah shall be her name. 16 I will bless her, and moreover, I will give you a son by her. I will bless her, and she shall become nations; kings of peoples shall come from her.” 17 Then Abraham fell on his face and laughed and said to himself, “Shall a child be born to a man who is a hundred years old? Shall Sarah, who is ninety years old, bear a child?” 18 And Abraham said to God, “Oh that Ishmael might live before you!” 19 God said, “No, but Sarah your wife shall bear you a son, and you shall call his name Isaac. I will establish my covenant with him as an everlasting covenant for his offspring after him. 20 As for Ishmael, I have heard you; behold, I have blessed him and will make him fruitful and multiply him greatly. He shall father twelve princes, and I will make him into a great nation. 21 But I will establish my covenant with Isaac, whom Sarah shall bear to you at this time next year.” 22 When he had finished talking with him, God went up from Abraham. 23 Then Abraham took Ishmael his son and all those born in his house or bought with his money, every male among the men of Abraham's house, and he circumcised the flesh of their fore-skins that very day, as God had said to him. 24 Abraham was ninety-nine years old when he was circumcised in the flesh of his foreskin. 25 And Ishmael his son was thirteen years old when he was circumcised in the flesh of his foreskin. 26 That very day Abraham and his son Ishmael were circumcised. 27 And all the men of his house, those born in the house and those bought with money from a foreigner, were circumcised with him.

The Lord has shown a major thief in the body of Christ!!!! Its name is sluggard!!!!! Its only purpose is to stop the body from awakening to who they are in Christ and fulfilling the word..As he is so are we in this world! When I heard this word I looked it up and it is only in the book of Proverbs...6 TIMES!!!!!!!!!!!! THE NUMBER OF MAN!!!!!!!!!!!!!!! Proverbs is the book of wisdom, so here is a major step of walking out of humanity and into being the wisdom of God in the earth! Proverbs 6:6-11Amplified Bible (AMP) 6 Go to the ant, you sluggard; consider her ways and be wise!— 7 Which, having no chief, overseer, or ruler, 8 Provides her food in the summer and gathers her supplies in the harvest. 9 How long will you sleep, O sluggard? When will you arise out of your sleep? 10 Yet a little sleep, a little slumber, a little folding of the hands to lie down and sleep— 11 So will your poverty come like a robber or one who travels [with slowly but surely approaching steps] and your want like an armed man [making you helpless]. verses 6 and 9 Proverbs 10:26Amplified Bible (AMP) 26 As vinegar to the teeth and as smoke to the eyes, so is the sluggard to those who employ and send him. (Wow here I have to add the scripture that we will give an account to every idle word spoken! Idle means unemployed!!!! words of flesh!!!!) Proverbs 13:4Amplified Bible (AMP) 4 The appetite of the sluggard craves and gets nothing, but the appetite of the diligent is abundantly supplied. Proverbs 20:4Amplified Bible (AMP) 4 The sluggard does not plow when winter sets in; therefore he begs in harvest and

Proverbs 26:16Amplified Bible (AMP) 16 The sluggard is wiser in his own eyes and conceit than seven men who can render a reason and answer discreetly. I looked up the meaning in the Hebrew no. 6102 indolent, slothful, sluggard from 6101 to lean idly, to be indolent or slack,-be slothful!!!!! Since indolent was the main word I looked it up in the dictionary (study the words of the Word..there is always more understanding) it means habitually idle or lazy, slothful, habitual love of ease!!!!!, laziness, idleness. Amos 6:1 Woe to those who are at ease in Zion and to those on the mountain of Samaria who are careless and feel secure, the notable men of the chief [because chosen by God] of the nations, to whom the house of Israel comes! People I don't know about you but with so much pain and loss of these last 2 1/2 months I've found myself watching crazy shows at times to take my mind off things!! Everybody loves Raymond God has shown the light on you haaahahhaha!!! All this came as I was praying with Judah Alexander this morning over things. I prayed it off everyone that came to mind, including anywhere it could be hiding in me!, and off the body of Christ. Do you find yourself eating when you're not really hungry, trying to find comfort in anything other than Jesus the Christ? This is the purpose of the sluggard spirit. In your getting get understanding so I'm passing this on for all to understand and stand against it!!!!! As we were praying over this I heard the AWAKENING OF THE CHRIST! Until we awaken we are still living in the deep sleep of Adam! Deep sleep means loss of hearing, stunned perception!!! Ephesians 5:14King James Version (KJV) 14 Wherefore he saith, Awake thou that sleepest, and arise from the dead, and Christ shall give thee light. This is the scripture that the Lord boomed out of me at the Sept 27th meeting and he has been doing it! He said as I spoke he was released in my voice. That the vibration of his Spirit had hit earth and it was shaking! PRAISE YOU MOST HIGH GOD!!!!!!!!!!!!!!!!! WE LOVE YOU!! WE HONOR YOU!!! WE EXTOL YOU IN THE HIGHEST!!!! YOU ALONE ARE GOD FOREVER AND EVER AND WE ARE THE WORKS OF YOUR HANDS! THANK YOU ALMIGHTY GOD FOR REVEALING THE THIEF AND YOU SAID IN YOUR WORD THAT IF THE THIEF IS UNCOVERED IT HAD TO RESTORE BACK SEVEN FOLD!!!!!!!!!!! HALLELUYAH!!!!!!!!!!!! WE RECIEVE!!! GIVE US THE GLORY THAT WE HAD WITH YOU LORD BEFORE WE CAME INTO THIS WORLD AND ALLOW US TO BE YOUR IMAGE IN THIS WORLD!!!!! SO MUCH LOVE TO ALL..................

These are the Destruction of Satan's Sting Continue..................

We are not Super Natural, No!No! No! Therefore we can not, repeat, We cannot fight the devil unless we have the power to defeat the Wiles of Satan and his demons. Ephesians 6 is not there for looks. Satan fights with lies, and sometimes his lies, sounds like the truth; but only believers who have God's truth, which can defeat Satan' lies.We are engaged in a spiritual battle-(all) the time. Believers find themselves subject to Satan's attacks because they no longer is on Satan's side. Though Paul tells us to use every piece of God's armor to resist Satan's attack and to stand true to God in the midst of those attacks. Can you do it? You bet you can. But only with God's strength and power. As children of God He gives us this power over every dominion. Satan only attacks our heart the seat of our emotions. He uses the media, newspapers, people, family and friends. Your self worth, is important to you only if you love yourself enough to keep from being deceived. How about Trust, well God's righteouness is the breast plate that protects our heart and ensures his approval. He approves of us because he loves and sent His Son to die for you and me. He gives us time to come around His way, but we never know when that time is up. That's What Satan wants, and if he can keep you distracted with your emotions, stuberness, selfishness, I wants, etc. then he has you locked in and then the bottom falls out. Your judgement begans when your eyes are shut and your spirit has left and you are in the Presence of the Lord. What then? What can you do? Nothing, you can't even plead your case. Jesus is doing that right now for you, but you have to be the one to say yes.

What we see, the things we see, are Satan's attacks in the form of insult, setbacks, and temptation. Can you control the things you feel when you are at your weakest point. No! you can not control the temptations because that devil knew you too when you were born, but with the help of Jesus and the Lord God and the Holy Spirit Anointing Power. Its the Power of the Anointing is what you need. No you will not stop having problems, but you will not be defeated either. That is once you become a Born again Christian with the Power of the Holy Spirit. that does not stop. You can have help out there and your help comes from the Lord God. If you try to do it by yourself the devil laughs at you. You can not fight Super Natural. Forget about Superman, Wonder Women, Tarzan and the whole bunch. That's silly, and that This Shield of Faith protects us from Satan's fiery arrows. With God's perspective. we can see beyond our circumstances and know that the ultimate victory is ours. Satan wants us to doubt God, Jesus and our salvation. If he can do this, notice (if) he can. He can not do anything unless we want it done, but you will need help if you can not fight against the arrows he throws. Only when we under the protection of the Lord God we can. The helmet protection is to help to protect our mind from doubting God's saving work for us. The sword is the only weapon of offense in this list of armor. There are times when we need to take the offensive against Satan. When we are tempted, we need to trust in the truth of God's Word. So won’t you stop going around that same mountain. Call on Jesus Christ let Him be your Lord and Savior he is the only answer that you have for soon this mountain and everything else will fade away. Then what? Jesus is the Reason and the answer for you this Season. He’s waiting for you Voices of the Wind

Large Candy Wrap Decoration A Project you can enjoy

Supplies Need

Tape Scissors Red (or any color) cellophane wrap Ribbon or twine Clear Plastic Flower Pot Saucers (about 6 inch)

Instructions: 1

2

Cut your cellophane into pieces larger than your saucers. I doubled the diameter of my saucer, so 12 inches square for each 6 inch saucer. Don’t worry if you have too much on the sides you can trim that later. Lay your first saucer in the middle of one of your pre-cut cellophane pieces, open side up.

Pull the bottom half of the cellophane up and over the top of the open saucer. Secure it with tape. Pull the top half of the cellophane down and hold closed with a tiny piece of tape. Now carefully gather one of the ends and tie with a small piece of twine. You could also just use your decorative ribbon but since they will be outside I wanted to tie them with something a bit stronger. Don’t worry if your ends are a bit long, you can always trim them when they are finished. Repeat the gathering and tying process on the remaining side. Now, cut pieces of your decorative ribbon, and tie over the twine to decorate your candy. Voices of the Wind Page 21

THE COMING YEAR OF

2015 Eudora Harrington

NEW SEASON

Eudora Harrington MOVING FORWARD SERIES The word for today in part 5 of our Moving Forward series is "NEW and PREPARATION" for this is a new season. New Season, New Garments. New Wineskins for New Wine. Heaven has open a door for you in this NEW season but you first must go UP to walk through the door that God will reveal to you in this NEW season. What does it mean to be in a New Season? Significance of this prophetic declaration, we should ask ourselves, "What does it mean for me to be in a New Season?" NEW NEW NEW NEW NEW NEW NEW NEW NEW NEW NEW NEW NEW not existing before; made, introduced, or discovered recently or now for the first time NEW NEW NEW NEW NEW NEW NEW NEW NEW NEW NEW NEW NEW In the natural world, we change garments with the change of seasons. To illustrate, we cannot be wearing winter clothings during spring and vice versa. Just as in the natural realm, the same is applicable in the spiritual realm. Hence, it is IMPERATIVE that we catch this truth for us to fully appropriate what God is doing in our lives, families, ministries and nations. We are to PUT AWAY the garments of the past season and to BE READY to PUT ON the appropriate garments for the NEW SEASON. The parable of the wineskins aptly paints the picture of PREPARING for the New Season (new wine) Neither do people pour new wine into old wineskins. If they do, the skins will burst; the wine will run out and the wineskins will be ruined. No, they pour new wine into new wineskins, and both are preserved (Matthew 9:17) And no one pours new wine into old wineskins. Otherwise, the wine will burst the skins, and both the wine and the wineskins will be ruined. No, they pour new wine into new wineskins (Mark 2:22) And no one pours new wine into old wineskins. Otherwise, the new wine will burst the skins; the wine will run out and the wineskins will be ruined. No, new wine must be poured into new wineskins. (Luke 5:37-38) Just as it is necessary to pour new wine into NEW wineskins, it is VITAL for us to remove the old garments and to put on NEW GARMENTS as we step into the NEW SEASON that God has ordained for us. Mr Obama and Mr Castro met a year ago at Nelson Mandela's funeral

US President Barack Obama has hailed a "new chapter" in US relations with Cuba, announcing moves to normalise diplomatic and economic ties. Mr Obama said Washington's current approach was "outdated" and the changes were the "most significant" in US policy towards Cuba in 50 years. Cuban President Raul Castro said he welcomed the shift in a TV address. The move includes the release of US contractor Alan Gross and three Cubans held in the US. Wednesday's announcements follow more than a year of secret talks in Canada and at the Vatican, directly involving Pope Francis. US-Cuba relations have remained frozen since the early 1960s, when the US broke off diplomatic relations and imposed a trade embargo after Cuba's revolution led to communism.

The US is looking to open an embassy in Havana in the coming months, Mr Obama said on Wednesday.

DECEMBER 2ND EDITION 2014

As the number of women accusing Bill Cosby of sexual assault continues to grow, there is one who won't leave his side… his wife of 50 years, Camille Cosby. Camille, who has five children with Bill, released a new statement in support of her husband on Monday. I met my husband, Bill Cosby, in 1963, and we were married in 1964. The man I met, and fell in love with, and whom I continue to love, is the man you all knew through his work," she begins. "He is a kind man, a generous man, a funny man, and a wonderful husband, father and friend. He is the man you thought you knew.View gallery "A different man has been portrayed in the media over the last two months. It is the portrait of a man I do not know. It is also a portrait painted by individuals and organizations whom many in the media have given a pass. There appears to be no vetting of my husband's accusers before stories are published or aired. An accusation is published, and immediately goes viral.". Today, the number of "accusers" who have come forward are close to two dozen. Just last week, supermodel Beverly Johnson wrote a chilling and detailed account of an alleged altercation with The Cosby Show alum three decades ago in which he supposedly drugged her. However, Camille goes on to compare coverage of her husband to the Rolling Stone University "We all followed the story of the article in Rolling Stone concerning allegations of rape at the University of Virginia. The story was heart-breaking, but ultimately appears to be proved to be untrue," she says. "Many in the media were quick to link that story to stories about my husband — until that story unwound. Virginia rape story. "None of us will ever want to be in the position of attacking a victim," she concludes. "But the question should be asked — who is the victim?" For the most part, Cosby has remained mum during the past two months as the scandal continued to unfold. On Friday, he briefly broke his silence when speaking to freelance journalist Stacy Brown. “Let me say this. I only expect the black media to uphold the standards of excellence in journalism and when you do that you have to go in with a neutral mind,” Cosby, 77, said, neglecting to specifically address any of the rape or sexual assault allegations. Bill was also asked how his wife was holding up under the strain. “Love and the strength of womanhood,” he replied. “Let me say it again, love and the strength of womanhood. And, you could reverse it, the strength of womanhood and love.” Stacy Brown appeared on Good Morning America today to discuss her brief phone call with the actor. "He didn't sound like a person under any stress," she noted. "In fact, I'd say that he sounded upbeat." As for Camille, Brown told GMA, "He spoke with such reverence and such appreciation that I have to believe that she's standing by him." That she is. By Taryn Ryder Voices of the Wind

PET TALK with PHil Tralls and Best Friend Rusty

Phil Tralls and Best Friend Rusty

Good Day . My name is Phil Thralls and my partner in this writing venture is Mr. Rusty. Permit me to tell you something about us. Mr.Rusty is my RESCUE DIXIE. He is 8 years old and my permanent FUR BABY. He has been with me for 5 years and I wouldn't know what to do without him. Myself I am a BORN AGAIN CHRISTIAN. I belong to HIGHER PRAISE WORSHIP CENTER here in Connersville, IN. The Church is a non-denominational Church. If you were to visit my Facebook page you would see 3 things that I post about and share pictures about and that praise God is my FATHER GOD, DOXIES, other dogs, and Trains. I have a passion for those things. Dogs have always been part of my life as well asTrains. I have had small dogs and big dogs. I remember one time it was back in the early 50‘s , 60’s. My Grandfather was assigned to a house fire and the Mennonite’s knew my Grandfather . So they obtained a German Shepard and gave it to him as a gift and he named it Shep. Well GRANDPA would take Shep and get with the milking cows in the late afternoon. I was, always after Grandpa to let me lead Shep so I could go and get the cattle. Yes you guessed it he finally let me. Now you have to understand my Grandfather he was a jokester. So we were going through the field and he would ask Shep do you see the cattle. Well if Shep didn't bark he didn't see them. Well this one time he did and Shep bark without any hesitation. Grandpa said go get em. Here I am having control of the lead and Shep takes off running and I in turn felt Shep running so fast that he was pulling me onto the ground and finally Grandpa said let go of the lead. You get the picture I am sure. Ha!, Ha!, Ha! Therefore been sometime since Mr. Rusty has been sick with lime. All of us that have any kind of Fur Baby we ask Father God to help our baby. As I said I am a Born again Christian. I do that myself but I go one step further. I anoint Rusty in oil and rub his body since they can't tell where they hurt. So I pray and ask the Father God to please heal him. The next morning Father God has healed him. I have no doubt. You see anything we have that is living come from Father God and it is a gift from him and we have to take care of that gift. I know my son has horses and he has done the same thing. Father God will hold us accountable for that just as he will anything else he has given charge over. I will in the next Edition share more things about what I know of FATHER GOD, DOGS and TRAINS. MAY FATHER GOD BLESS YOU and KEEP HOUSE IN THE NEW YEAR 2015 THAT FATHER GOD IS GIVING US. One thing more PLEASE PLEASE PRAY FOR ALL LAW ENFORCEMENT and FIRE FIGHTERS. Means a lot to me and I am sure Most of you may have family members and love ones that are. God Bless You BY PHIL TRALLS with THANKS from my good friend MR RUSTY and Me. Voices of the Wind

Jerusalem

Jerusalem

From 1945-1948, there was a groundswell of public support for the State of Israel by Jews world-wide, and in the United States in particular. Meanwhile, in Palestine, bombings and retaliatory murders are daily occurrences, as the British were unsuccessful at keeping the peace between Jew and Arabs. Eventually British Prime Minister Bevin decided that England would give up its rule over Palestine and handed the problem over to the United Nations to solve. At the same time, the Cold War between the Soviet Union and the Free World escalated. Stalin closed the doors on Soviet emigration which prevented 3 million Jews from leaving. Furthermore, with the official policy of atheism, being enforced, Jews were forbidden from practicing their religion. We find today that the Jewish Culture continue to have problems in the neighboring land. voices of the Wind

The people of modern day Israel share the same language and culture shaped by the Jewish heritage and religion passed through generations starting with the founding father Abraham (ca. 1800 BCE). Thus, Jews have had continuous presence in the land of Israel for the past 3,300 years.

The name Israel derives from the name given to Jacob (Genesis 32:29). His 12 sons were the kernels of 12 tribes that later developed into the Jewish nation. The name Jew derives from Yehuda (Judah) one of the 12 sons of Jacob (Reuben, Shimon, Levi, Yehuda, Dan, Naphtali, Gad, Asher, Yisachar, Zevulun, Yosef, Binyamin)(Exodus 1:1). So, the names Israel, Israeli or Jewish refer to people of the same origin. Hopefully this will wet your interest and find out more. Where can you find this information and a clear History. A CELEBRATION OF HOME COMINGS

THE leader of Bahamas Faith Ministries, Dr Myles Munroe, and his wife Ruth have been killed in a plane crash in Grand Bahama. The crash took place this afternoon and killed all nine people on board the private jet. The plane reportedly struck a crane at the Grand Bahama Ship Yard, exploding on impact and crashing into the ground near a junkyard area. The Department of Civil Aviation reported that the plane was a Lear 36 executive jet which departed the Lynden Pindling International Airport (LPIA) for the Grand Bahama International Airport. photo The plane left LPIA at 4.07pm with nine people on board and crashed while making an approach for landing at Grand Bahama International Airport at 5.10pm, the Department of Civil Aviation said. photo This satellite image shows inclement weather over Freeport on Sunday.#‎A police on source on the island previously said two were feared dead. However, police sources later confirmed that all those on board had been killed. The police source also said it was believed the group was heading to a conference hosted by Pastor Munroe. The identities of the other people on board have not yet been confirmed. The statement said while the department was advised of fatalities, it was awaiting confirmation from police on if there were any survivors. The Grand Bahama Airport Company Crash Fire Rescue Department responded to the incident, and the Police and Bahamas Air Sea Rescue (BASRA) are presently on the scene. The department said a full scale investigation will start tomorrow morning at daylight, which will include the Department of Civil Aviation Aircraft Accident Investigation Prevention Unit.

If a picture’s worth a thousand words, how come this one didn’t convince twenty-three grand jurors? That is the question being asked in New York City and throughout the country today in the wake of a grand jury’s failure to indict Officer Daniel Panteleo in connection with the death of Eric Garner last summer. All of us have seen the video of the encounter. In it, one uniformed officer — not Panteleo — is standing in front and to the left of an obviously irate Garner, who repeatedly complains that he has been and is being being harassed. Garner and the officer obviously know each other. Garner excitedly tells the officer that “It stops today” and that he “did not sell nothin’,” apparently referring either to the policeman’s claim that he was selling illegal cigarettes — “loosies” in the parlance of the street — at that time, or to prior encounters where that charge was made. When the cop appears to ask why Garner is screaming (the audio on the police officer is hard to pick up), Garner explains that “Every time you see me, you want to harass me, you want to stop me . . . I’m minding my business officer.” He then says, “Please just leave me alone. I told you the last time, please just leave me alone.” Voices of the Wind

At that point, there appears to be a break in the tape. Then, two more officers approach Garner from his front, and Panteleo, who is dressed in street clothes — shorts and a green jersey with the number 99 on its back — moves toward and touches Garner from the right and behind. Garner raises his hands and says, apparently in response to Panteleo (who Garner does not seem to think is a cop), “Please don’t touch me.” Panteleo then grabs Garner by placing his left arm around Garner’s neck with his right arm under Garner’s right arm near the armpit. Panteleo rapidly moves backwards, more or less parallel to the store window at which Garner was standing, turns Garner around slightly and moves back toward where they all started, and then takes Garner down. All this time Panteleo’s arm remains on Garner’s neck; as Garner is prone on the sidewalk, Panteleo is spread lengthwise over Garner’s back and legs. As the other officers — three of them — secure Garner’s legs and torso against the sidewalk, Panteleo moves to his knees and Garner’s head, and then compresses Garner’s head against the sidewalk with his hands. Garner then says, “I can’t breathe.” In fact, he doesn’t just say he can’t breathe. He repeats the statement . . . Voices of the Wind

Seven more times. Meanwhile, the guy with the cell phone who is taking the video of the encounter is told by still more police (by this time , two or three additional officers appear to be on the scene) to “back up”. While doing this, and continuing to video the event, the guy says “All he did was try to break up a fight.” Shortly after repeatedly telling them he couldn’t breathe, Garner, according to a witness, “went limp.” He apparently went into cardiac arrest. EMS arrived and took him to Richmond County Hospital, where he was pronounced dead. As a matter of policy, the police in New York City are prohibited from using choke holds. The policy was inaugurated in the early ’90s after there had been at least one fatality following use of the technique during an arrest. In that case, unlike here, the police were actually indicted. Though they were acquitted in the subsequent criminal trial, the family later prosecuted a civil rights claim against the City and the City paid a seven figure settlement.

Why no indictment here? There really does not appear to be a credible answer. Grand jury proceedings are secret, so we have no idea what the jurors heard or saw during the month long investigation. The Staten Island prosecutor who presented the case to the grand jury has petitioned the court to release some of the contents of the proceeding, but it is not clear what portions — if any — will be made public. Moreover, unless everything is disclosed, any type of selective unveiling will just contribute to the already widely shared view that the police are immune from accountability. Is that view accurate? It is always dangerous to make assumptions or conclusions without the benefit of seeing the full record. But in this case, all of what we do know makes it virtually impossible not to conclude that at least some law was broken and a trial should have occurred. First, though his lawyer says that Officer Panteleo was not applying a choke hold, the video evidence refutes that claim. The officer clearly puts his arm around Garner’s neck and keeps it there until Garner is on the ground and he can move to his knees and compress Garner’s head . If, as his lawyer is claiming, Panteleo was just using an authorized take down procedure, that arm Voices of the Wind

would have been nowhere near Garner’s neck; instead, it would have been under Garner’s left arm and around Garner’s chest or near Garner’s shoulders. Second, the medical examiner who autopsied Garner concluded that the death was a homicide caused by a combination of neck and chest compression. This in itself refutes the claim that a choke hold wasn’t applied. The ME undoubtedly saw what are known as petechial hemorrhages — small burst blood vessels — on Garner’s larynx, which are the common result of fatal neck compressions.Third, the notion that a grand jury — as distinct from a trial on some criminal charge, even one short of intentional murder — is or could be an appropriate vehicle for accountability in this case is itself very suspect. I am a former federal prosecutor, and the conventional wisdom that prosecutors control grand juries is true. The old adage that a prosecutor could get a grand jury to indict a ham sandwich if he or she wanted is founded on the reality that prosecutors — and prosecutors alone — decide what evidence gets presented to a grand jury.Prosecutors also instruct grand juries on the applicable law. Consequently, their control of the process is fairly complete. In the case of most crimes, that structure materially favors indictment. Voices of the Wind

in the case, however, of alleged crimes perpetrated by the police, especially alleged crimes arising out of the use of force, a countervailing pressure is at work. The police and their supporters — the various PBAs and SBAs — are almost universally opposed to these types of claims, and prosecutors for the most part allow them to present their defenses in an unimpeded way to the grand jury, and provide the instructions needed for a “no bill” — law speak for no indictment — if the jurors like what they see and hear. This, moreover, is a dispensation granted no other defendants. Fourth, the prosecutor in this case gave all the police officers on the scene — except Panteleo — immunity. This allowed all of them to testify without fear that they too might be indicted. Had they not been granted immunity, their own lawyers undoubtedly would not have allowed them to testify, so defenders of the District Attorney will naturally claim that the immunity deal allowed the grand jury to get relevant evidence it otherwise would not have heard.Maybe so. The immunity deal, however, also allowed all the other officers to support Panteleo in whatever account Panteleo provided. Without assuming the testifying cops did anything other than tell the truth, it is still hard not to assume they were at least biased in Panteleo’s favor. It is also not clear that they themselves did not violate proper procedure. Voices of the Wind

The arrest and take down in this case was not problematic and irregular simply because a choke hold was applied. The chest compression the other police applied to Garner while he was on the ground telling them he couldn’t breathe — which the Medical Examiner cited as another factor contributing to Garner’s death — itself violated policy. Whether the arrest was irregular for other reasons is also an open question. From the video, it just isn’t clear exactly why the police were interested in Garner that day at that time. If, as some of the backtalk suggests, they thought he was selling illegal “loosies,” a charge which Garner himself vehemently denied, why did they not just give him a summons? Was it because he was then out on bail for that same charge? If so, what evidence did they have of the crime given Garner’s denial — a denial which appears to have been true in that there were no reports of “loosies” on his person, and one which, in any case, makes perfect sense if Garner was then minding his own business and staying on the right side of the law (lots of folks on bail try to avoid committing the crimes for which they are about to be tried).Or was it because this is just what cops do in the era of “broken windows” policing? Continue..................

“Broken windows” policing has been around now for more than twenty years. The theory is that arrests for small crimes — panhandling, subway turnstile jumping, illegal graffiti — stop criminals from moving up the ladder to bigger crimes. Crime has gone down dramatically in New York City over the last two plus decades, so supporters of “broken windows” claim it is working. Whether this is so, however, has been questioned by criminologists who have noted a host of other factors — demographic in the form of an aging population (crime is a young man’s game) and penal in the form of longer prison terms — which might explain the result. Undeniably, however, “broken windows” — along with “stop and frisk,” which NYC only recently ended — disproportionately captures minorities and people of color, and they are rightly sick and tired of that reality. They are also rightly sick and tired of the risks they face when confronted by the police. Whatever Eric Garner was or wasn’t doing on a street in Staten Island last summer when four cops more or less surrounded him, one thing is absolutely clear. He should not have died for it. That is why thousands of New Yorkers took to the City’s street in protest. On Wednesday, as they engaged in “die-ins” at Grand Central Station, protested in Times Square, and took over a portion of the West Side Highway, passers-by gave them thumbs up and shouts of approval. The Mayor appropriately wondered about the risks his own mixed-race son faced in the current environment. And for their part, the police in New York City — unlike the para-militarists in Ferguson a few weeks ago — managed the protests well. As they should have, they let the protest go forward without any undue confrontations. They followed the proper procedures. They were professional. Too bad that wasn’t the case last summer. THE END
