Haiti moves forward with plans for transitional presidential council

A plan to establish a transitional presidential council in Haiti is progressing as a majority of Haitian parties and coalitions have submitted nominations for individuals tasked with spearheading the search for new leadership, Caribbean officials revealed on Thursday

The list of nominees has been forwarded to the regional trade bloc CARICOM, which is playing a central role in guiding the transition process

“It is all up now to the Haitians as they are the ones who want a Haitian-led solution,” Surinamese Foreign Minister Albert Ramdin told The Associated Press “It is for them to pick up the ball and run with it, being responsible for their own destiny ”

Ramdin’s remarks follow a public dispute among Haitian politicians and influential figures over the proposed plan and the selection of candidates, raising concerns about the

formation of the council

Caribbean leaders had initially announced intentions to establish the council following a closed-door meeting in Jamaica on Monday, attended by officials such as US Secretary of State Antony Blinken Prime Minister Ariel Henry subsequently committed to resigning once the council is established

The primary task of the council will be to appoint an interim prime minister and a council of ministers, and to facilitate the organization of general elections, which have not been held for nearly a decade

Former Prime Minister of Jamaica PJ Patterson says a fatal error occurred in the trial of Vybz Kartel and his co-accused Patterson, a King’s Counsel, gave his opinion on the trial and recent Privy Council judgment in a joint statement alongside well-known jurist and lawyer Hugh Small, also a King’s Counsel

The men stated that the trial judge’s decision to continue the trial in light of allegations of jury tampering showed limited knowledge of the law

“The judgment of the Privy Council in the case popularly called the Vybz Kartel appeal has attracted attention because the Privy Council ruled that the Jamaican judges at the appellate stage should have discharged all the jurors from continuing to try the accused persons,” the statement said Patterson disclosed that in 1983, there was a notable case with striking similarities to Vybz Kartel’s situation, particularly concerning the handling of a tainted jury pool

“Neither the trial judge, Justice Lennox Campbell nor the three judges who heard the appeal from the ruling and verdict, were apparently aware that there was a judgment of the Court of Appeal of Jamaica in 1983 that ruled in similar circumstances, that the duty of the court was to discharge the entire jury and order a new trial,” the statement said

“It is regrettable that this case was not brought to the attention of Justice Campbell, the judges of the Jamaica Court of Appeal, Dennis Morrison, Patrick Brooks, and Franklyn Williams or cited in the Privy Council,” Patterson and Small wrote

Last week Thursday, Vybz Kartel, Shawn Campbell, Kahira Jones, and Andre St John, had their 2014 life sentences quashed by the Privy Council on the basis of jury tampering

Voter turnout will be low...unless bread-and-butter issues are addressed

In the 2020 presidential election in the USA, 66 percent of all eligible voters turned out to vote Interestingly, this was regarded as a record turnout, the highest turnout since the presidential elections in 1932, when this data began to be recorded A record? Some might be perplexed by the knowledge that a significant 34 percent of eligible voters didn't turn out But it's indeed a record, as the average voter turnout since 1932 is some 55 percent

Traditionally, the main political parties, and respective candidates for political office in the USA, have had a difficult time generating large voter turnouts despite spending millions of dollars each election cycle in an attempt to garner votes

In Jamaica, the 2020 general elections, and last month's local government elections were also characterized by a significantly low voter turnout; 38 percent in 2020, and 29 8 percent in February

Presidential, general, local, and municipal elections give people who are eligible to vote the right to elect individuals they believe are the best to represent them in meeting their specific dayto-day interests But, despite the importance of this right, very significant percentages of voters do not turn out to vote when these elections are held

Granted, some voters are committed to particular political parties and will turn out to vote for their parties' candidates, no matter what, or no matter who the candidates are These voters make up the base of respective political parties

But some voters are not so committed and need to be motivated to turn out to vote They only vote according to the prevailing issues of the day or just refuse to turn out to vote, regardless

These voters may not be interested in the candidates running for office or the political platform the candidates represent Some of these voters may also be disenchanted by the performance of politicians they previously elected, and/or disappointed by the promises made by politicians that were not kept

Some of the issues include:

• The refusal to increase the federal minimum wage

• A majority of women not receiving the benefit of paid maternity leave

The absence of policies in most states, like Florida, to make property insurance more affordable

• The absence of a broad policy to control increasing residential rentals

The lack of consistent federal policy to assist families to meet the cost of child care

Some voters don't turn out to vote because of illness, disability, or lack of transportation In the USA, in recent years this problem has been addressed with the introduction of mail-inballots One of the reasons for the “record” turnout of voters in 2020 was the sharp increase in vote-by-mail in several states, including Florida

But the top reason why voter turnout is not meeting expectations is that politicians have and are not addressing the bread-and-butter issues affecting voters

Here in the USA, despite the urgings of voters over the past several election cycles, several issues that concern voters directly, have not been addressed by elected officials These issues include the refusal to increase the federal minimum wage A majority of women not receiving the benefit of paid maternity leave A majority of workers not receiving paid leave when they are sick The absence of policies in most states, like Florida, to make property insurance more affordable The absence of a broad policy to control increasing residential rentals The lack of consistent federal policy to assist families to meet the cost of child care No federal policy to cap the cost of college education and to address the cost of prescription medica-

tion (In the past two years under the Biden administration some measures have been taken to address the latter issue) No federal policy, except Obamacare, to address the high cost of healthcare and no federal policy to control the price of basic foods for American families

Frankly, the average voter doesn't vote because of interest in US foreign policy, or in sophisticated economic data they don't even understand The overwhelming majority of voters are interested in attaining a better standard of living Most are willing to vote for candidates who indicate their willingness, or articulate policies, to offer this better standard of living When these candidates are elected to office and stray away from their promises to address these policies, they leave voters bitterly disappointed Thus causing many voters to regard the election process as a charade that they are less inclined to participate in again

Another presidential election is fast approaching in the US, and again it seems the bread-and-butter issues affecting voters are not being addressed Instead, the focus is on the presidential candidates' ages and mental capabilities

Again, voters risk being short-changed if they don't insist the political candidates seriously address the issues that directly concern them

Increasingly, several voters have had enough of the irrelevant grandstanding and showmanship by political candidates They have had enough of negative politics with candidates spending millions and wasting precious time in trading insults, trying to malign each other Voters want candidates to debate policies, and articulate their plans to improve their lives If this cannot be done the likelihood of any significant improvement in voter turnout will be slim or non-existent in the US next November, and in Jamaica when the general election is held

Until everyday citizens realize policies are being implemented to directly improve their lives now, or in the near future, they will continue to be less inclined to vote

to impact Florida’s Caribbean-American

The recent immigration laws signed by Florida's Governor are expected to have a significant impact on the state's sizable Caribbean-American community, specifically those who are undocumented

On Friday, Governor Ron DeSantis signed legislation aimed at addressing issues such as driving without a license, the use of “ nonofficial ID cards,” and increasing penalties for certain crimes. These measures are specifically intended to create obstacles for undocumented immigrants residing in the state

“We do not tolerate illegal immigration, let alone lawlessness committed by illegal aliens who shouldn't be here in the first place The bills I signed (Friday) further enhance Florida's capabilities to uphold the law,” DeSantis said Notably, two-thirds of Caribbean immigrants in the United States live in Florida and New York

Community IDs

DeSantis also took aim at community IDs, often utilized as a form of identification by undocumented immigrants or individuals lacking official identification

Three years ago, former Broward Commissioner Dale Holness and Miami-Dade Mayor Daniella Levine Cava proposed community IDs for residents in their respective counties However, immigration legislation enacted last year halted local government funding for these documents

Despite this, nonprofits in South Florida continued to issue them for a nominal fee Nonetheless, the bill signed on Friday prohibits both state and local governments from recognizing non-official ID cards

Driver's license

One of the bills signed increases the maximum sentence for individuals convicted of driving without a license twice or more from 60 days in jail to a year This change applies to both U S citizens and immigrants legally residing in the country Notably, undocumented immigrants are not permitted to obtain driver's licenses in Florida According to the National Conference of State Legislatures, 19 states and Washington, D C , issue driver's licenses to immigrants who are in the country illegally

Increased penalties for crimes

Another bill proposes increasing the maximum prison sentences for immigrants convicted of felonies after having been previously deported from the country for illegal entry

Jamaica’s DPP to seek retrial forVybz Kartel

Jamaica’s Director of Public Prosecutions, Paula Llewellyn, has announced that her office intends to seek a retrial for Vybz Kartel and his three co-accused

Last Thursday, the imprisoned dancehall artist and his three co-accused: Shawn Campbell, Kahira Jones, and Andre St John, had their 2014 life sentences quashed by the United Kingdom-based Privy Council on the basis of jury tampering

The four men were sentenced to life in prison for the 2011 murder of Clive “Lizard” Williams

In its judgment, the Privy Council ordered that the case be returned to Jamaica’s Appeal Court to decide whether to order a retrial for Vybz Kartel and the three men or set them free

On a Jamaica radio program this morning, the DPP said that the next course of action would be to pursue a retrial

“I believe we would be obliged to [pursue a retrial] given the strength of the case for the prosecution that was put up, and given the authority and the case law,” Llewellyn said “As I reflect going forward to my retirement next year, I have been too successful in seeking to sensitize the public and the media, to try to explain a lot of complex issues Very often when you have knowledge of the state of the law, the prosecutors are obliged to go on a particular path,” she added

Last week, following the judgment, Vybz Kartel said he was confident that he would be home with his family soon, insisting that there was no point in a retrial

“I am confident that the Court of Appeal in Jamaica will do the right thing in the name of equity, fairness and justice and free us Some people have expressed their concern to me that a retrial may be ordered but to them I say (albeit with my limited knowledge of the law) ‘What is there to retry’?” he said in his first official statement

Llewellyn said factors influencing a retrial include the seriousness of the crime and public interest

“The public has to be aware that the issue of retrial, as far as prosecutors are concerned, has nothing to do with emotions It has nothing to do with who the accused is It has to do with the seriousness of the offense, the public interest, [or] how extensive it may be to mount the retrial It doesn’t even have to do with what the likely verdict may be,” she said

As for Vybz Kartel’s lawyer Isat Buchanan, his next order of business, he said, would be to seek bail for his client

Buchanan, however, admitted that he could not predict when Kartel would be released on bail

He was denied bail the first time around after being charged with the murder of Williams

“We await the orders from the court to be sent to the Court of Appeal and we will take it from there I know that the Privy Council acts expeditiously given the fact that it was an expedited hearing so we will get word from the court That’s all I can say right now,” Buchanan said

Under this bill, immigrants convicted of low-level felonies such as simple burglary or car theft would face a maximum sentence of 15 years, compared to the typical maximum sentence of five years for these crimes For midlevel felonies like aggravated battery, the maximum sentence would increase to 30 years from the usual 15 years Additionally, higherlevel felonies like armed robbery could result in a life sentence for such immigrants, instead of the standard maximum sentence of 30 years

The signing of these bills coincides with Florida's government bracing for a potential influx of Haitian migrants fleeing the crisisstricken country Although a migrant surge has yet to materialize, Florida has already deployed over 250 law enforcement officers and soldiers to the Florida Keys to “protect” the state
