THE VILLAGE BOARD OF THE VILLAGE OF MARTIN, COUNTY OF ALLEGAN, STATE OF MICHIGAN HEREBY ORDAINS:

Section 1 Granting of Franchise to Use Highways, Streets, Alleys and Public Places The Village of Martin, County of Allegan, State of Michigan, (hereinafter called "Village '), hereby grants to Michigan Gas Utilities Corporation, a Delaware corporation (hereinafter called "Grantee"), its successors and assigns, a franchise to use the highways, streets, alleys and other public places of the Village of Martin, County of Allegan, State of Michigan, for the purpose of constructing, maintaining and operating a gas distribution system in said Village with full right, power and authority to establish, construct, maintain, extend and operate a plant, stations, mains, pipes, conduits, valves, drips and all other appurtenances, apparatus and appliances within the corporate limits of the Village of Martin, County of Allegan, State of Michigan, for the purpose of supplying and distributing to said Village and its inhabitants gas for heating and other purposes and, for such purposes, to enter upon and use the highways, streets, alleys, and public lands of said Village and lay, maintain, operate, repair and extend therein, through and thereunder such mains, pipes, conduits, valves, drips, apparatus, appliances and other appurtenances as may be necessary and proper for the distribution of gas throughout and beyond said Village and for the purpose of conducting and operating a gas business in said Village subject to the terms and conditions hereinafter provided

Section 2 Non-Disturbance of Public Travel: Restoration: Construction Maintenance In laying its pipes, mains and other appurtenances and repairing and maintaining the same, Grantee shall interfere as little as possible with public travel After opening any portion of the highways, streets, alleys or other public place, Grantee shall within a reasonable time restore the same as nearly as possible to the same condition as prevailed before opening While any portion of the highways, streets, alleys or other public place is open, Grantee shall maintain reasonable barriers and lights at night and other warnings to the users of said highways, streets, alleys or other public place

Section 3 Hold Harmless Grantee shall at all times hold Village harmless from any loss, damage and expense of any kind on account of the laying, constructing, maintenance, and use of said mains, pipes, conduits and other appurtenances However, Grantee need not save Village harmless from claims, losses and expenses arising out of the negligence of the Village, its employees, contractors or agents

Section 4. Rates Established by Michigan Public Service Commission The rates to be charged by Grantee and all rules of service shall be those which are established from time to time by the Michigan Public Service Commission or such other body which shall succeed to the jurisdiction, rights, powers and authority of said Commission

Section 5 Term: Effective Date The rights granted in this franchise shall continue in full force and effect for a period of thirty (30) years from the effective date thereof The effective date of this franchise shall be the latter of the date of the acceptance of the franchise by Grantee, which acceptance shall be filed by the Grantee, in writing, within sixty (60) days after the enactment of this ordinance or the day following the date of publication of the ordinance

Section 6 Franchise Revocable; Irrevocability Upon Approval of Electors The franchise herein granted shall be revocable at the will of the governing body of this Village, PROVIDED, however, that the same shall become irrevocable if and when confirmed by a majority of the electors voting upon the question at the next general election or at any special election called for that purpose Such special election shall be held at the request of said Grantee

Section 7 Expenses of Election Paid by Grantee In the event of a special election, the expenses thereof shall be deposited with the Clerk of this Village by the Grantee

Section 8 Repeal of Prior Ordinance The Franchise Ordinance adopted on September 19, 1994 by this Village, known as Ordinance Number 52 and all amendments thereto, are hereby repealed The repeal of the above Ordinance and its amendments does not affect or impair any act done offense committed or right accruing, accrued, or acquired or liability, penalty, forfeiture, or punishment incurred prior to the time enforced, prosecuted, or inflicted

Section 9 Publication The Village Clerk is hereby directed to cause a true copy of this ordinance to be published in the Shoppers Guide newspaper circulating within the Village within thirty (30) days hereof

David Wayne Hermenitt, passed away peacefully at home on November 11, 2024, at the age of 66 Dave was born on June 24 1958 in Plainwell, the son of Kenneth and Bessie (Like) Hermenitt

Dave dedicated 30 years of service to JBS before his wellearned retirement His commitment to community shone brightly through his nearly three decades with the Orangeville Fire Department, where he held the respected position of assistant fire chief Dave was a man who found joy and pride in the simple pleasures of life His yard was a testament to his meticulous care, a hobby he loved deeply More than anything, Dave was a caring and helpful soul always ready to lend a hand He remained active throughout his life, driven by a profound love for his children and granddaughter Family was the cornerstone of his world, and he showed his devotion through unwavering support, including the care he provided to his parents Dave s family would like to extend special thanks to the Orangeville Fire Department, especially Danny Boulter for all they have done for them Dave is survived by his mother, Bessie Hermenitt, wife, Jody (Gray) Hermenitt, children, Gabe (Amie Jahnke) Hermenitt and Tonya (Nathan Richmond) Hermenitt, granddaughter, Olivia Richmond; brothers, Tom (Julie) Hermenitt Dennis Hermenitt Ruth Hermenitt and Terry Hermenitt, and several aunts, uncles, cousins, nieces and nephews Dave was preceded in death by his father, Kenneth Hermenitt, an infant sister Deborah, brother, Bobby Hermenitt, sister, Teresa Delaphiano, nieces, Janie Hermenitt-Nagel, and Jessica Faath Dave s family will receive friends on Friday, November 15, 2024, 10:00 to 11:00 AM at the Orangeville Baptist Church where his funeral service will be conducted at 11:00 AM Burial will take place at Oak Hill Cemetery Memorial contributions to the ALS Association Michigan Chapter will be appreciated

Dona Jean Gilson, age 90, passed away peacefully on Sunday, November 10, 2024

Dona was born on November 17, 1933, in Otsego, the daughter of Harold and Pearl (Cole) Miller She was born at her grandmother’s house during a blizzard She graduated from Plainwell High School In 1951 she married the love of her life, Everett “Gil” Gilson They were married for 62 years when he preceded her in death on May 17, 2014 She was also preceded in death by her parents and her brother, Robert H Miller Surviving are her three children: Mark (Doreen) Gilson, Tanya (Tim) Griffioen and Jodie (Sherri) Gilson; brother, Harold “Butch” Miller; 8 grandchildren; 20 great grandchildren; 1 great-great-grandchild; as well as many nieces and nephews Dona taught 4H sewing and classes in porcelain doll making She dressed and repaired dolls for others She was a talented seamstress sewing clothing for ladies and guys alike She helped with little league baseball and gun safety classes with Gil She enjoyed her garden and flowers as well Dona is best known for owning and operating the Martin Hardware Store from 1968 to 2023 The hardware store was a family affair with most everyone involved She lived for family and friends and considered all of you a blessing from God She also loved her church family She was a member of Martin Reformed Church since 1953 A visitation will be held on Thursday, November 21 from 4:00 to 7:00 at the Martin Reformed Church; 1073 W Allegan St, Martin, MI 49070 A funeral service will be held on Friday, November 22 at 11:00 at the same location Memorials made in Dona’s memory can be made to Faith Hospice at Trillium Woods in Byron Center where she received excellent care and compassion The family is being cared for by Avink, McCowen, Secord Funeral Home 120 S Woodhams, Plainwell, MI, 269-685-5881 Please sign the guestbook and/or share a memory www amsfuneralhomes com

We sometimes look at the wor ld we are living in and even our own life situations and wonder what there is to cheer about Go back to the words of Jesus to His disciples who were facing tough times (John 16:25-33) They were facing suffer ing and losses Most of all, they would need to deal with Jesus’ suffer ing and death on a cross Add to that, following His ascension to Heaven, they would be faced with His physical absence In the midst of those realities, Jesus said, “Cheer up!” In the first place, He never softened the message they would face tr ibulation in this wor ld In the second place, as strange as it may sound, Jesus told them to “be of good cheer ” Really? Was He taking them ser iously? Remember those words came from a man “of sorrows acquainted with gr ief ” (Isaiah 53:3) This tells me that Jesus understands our hur ts and sorrows, because He has exper ienced them Himself We can naturally relate to people who have suffered as we have suffered

There is a Greek word (tharseite) for the “be of good cheer” which may also be translated as “be courageous!” There is a reason we can be courageous in the midst of life’s troubles Jesus defeated sin and death by His death on a cross We can claim His victor y (I Cor inthians 15:54, 55) and know that one day we will “no longer see in a mirror dimly, but face to face” (I Cor inthians 13:12)

Think of it this way If, for even a fraction of a second, God would remove God’s grace from the face of the ear th; hope would be absent To the contrar y, we find hope in the words of Apostle Paul, when he said, “I consider that our present suffer ings are not wor th compar ing to the glor y that will be revealed in us” (Romans 8:18) Now, that is something to be cheerful about!

November is National Homelessness Awareness Month

Our mission is to provide local families in need with Food, Emergency Financial Assistance, Skill-Building Education, and other resources offering stabilization.

We have local homeless clients couch-surfing between homes, living in tents, campers, and cars and sleeping in the woods.

How Do We Help?

• We provide food, hygiene, and useful items such as can openers and blankets.

• We assist filling out housing applications and send referrals to our county homeless liaison organizations.

• We help with security deposits and first month’s rent by collaborating with other local agencies and combining resources.

• We assist with paying off old utility bills that prevent people from moving into apartments.
