Hitler (May His Memory Be Blotted Out!)

A
friend of mine, Rabbi Arnold Resnicoff, gave his senior sermon in 1976 at Rabbinical School on Shabbat Zachor, the Sabbath before Purim when we read in the Torah the command to remember the Amalekites, the biblical enemies of Israel (Zachor=remember). As Rabbi Resnicoff pointed out in his sermon, the biblical text gives conflicting commands to remember what the Amalekites did while also commanding the blotting out of their memory. Remember and blot out?! Rabbi Resnicoff said these conflicting commands reminded him of an incident from the Navy. A young yeoman (clerk) is assigned to the Admiral. When he arrives for work the first day, the Admiral’s Chief of Staff informs the young clerk that it is his job to open all mail the Admiral receives and date it with the date of receipt, and initial the date. On his second day on the job, a letter stamped “Top Secret: For the Admiral’s Eyes Only” ar8 October 12, 2011
rived. The clerk thought, should I open the letter? But it says “For the Admiral’s Eyes Only.” But he had been told that every letter had to be opened, dated, and initialed. So the clerk opened the letter, dated it, and put his initials after the date. The Admiral arrived in his office only to find this “Top Secret” letter opened and dated and initialed. In anger he called the yeoman into his office and demanded to know whether he had indeed opened the letter. The Admiral ordered the yeoman: “I want you to erase initials and to initial your erasure.” Many see Hitler as a descendent of the Amalekites, the enemies of Israel who attacked the women and children and elderly when the Israelites traveled through the wilderness in biblical times. The enemies of Israel, all those who have sought Israel’s destruction, from the wicked Haman through Hitler, are seen as the descendents of the Amalekites. We want to wipe out the memory of Haman

while recalling each Purim his dastardly acts. So it is with Hitler. We want to wipe out his memory. Indeed, the name Hitler is followed by most Jews with the words “Y’mach Sh’mo,” may his name be blotted out. And yet, we pledge to remember the Holocaust he caused so that it will never happen again. While pledged to destroy the memory of Hitler, we dedicate each year new museums and memorials to the Holocaust and the events surrounding Hitler. The Museum of Tolerance in Los Angeles is an outgrowth of the work of Simon Wiesenthal and the Simon Wiesenthal Center which expanded Wiesenthal’s search for Nazi War Criminals to include documenting the evil acts of the Nazis. While still associated with the Wiesenthal Center, the Museum of Tolerance seeks to expand the work of the Center to include other acts of inhumane behavior toward a variety of peoples, while taking on the positive goal of promoting tolerance among people. I am sure that the leaders of the Wiesenthal Center deal regularly with the dilemma as to how do you keep alive the memory of the horrors of the Holocaust so that an event like that never happens again, while helping to strike the memory of the evil criminals who perpetrated the acts involved in the Holocaust. During the past week before this article was written, Hitler was in the news twice. Here we are 66 years since Hitler met his end in a bunker near the German capital, and yet the very mention of Hitler brings headlines. The first incident involved a statement on a morning news show said by the country music singer Hank Williams, Jr. With an extremely poor choice of words, Hank compared the odd couple of President Obama and Speaker Boehner golfing together to being similar to Prime Minister Netanyahu golfing with Hitler. I am not totally sure what Hank Williams, Jr., wanted to say, but he violated a basic rule of our current civil society. We simply don’t make comparisons with Hitler within our language expression. This is taboo. Williams was immediately banned from Monday Night Football where his song had opened the football broadcast for years. Williams’ proclamation “Are You Ready for Some Football?” had become a familiar part of our culture. With one comparison to Hitler, Williams will no longer be part of the American cultural scene. The entire topic of Hitler has become radioactive.

from Hitler where Hitler presents for the first known time a complex plan to do away with the Jews. This letter will be the centerpiece of a new exhibit at the Museum focusing on the early efforts in Germany that eventually led to the Holocaust. The early date of Hitler’s letter is quite important. This shows that the desire to eliminate the Jews predated the horrendous economic times for Germany which occurred in the years following World War II, especially during the periods of economic and political change of the 1920’s. Before the post-war economic crises in the 20’s that history has highlighted as the period which brought Hitler eventually to power, Hitler had already come to his stance that the Jews had to be eliminated from the German scene. While I understand the historic significance of the document that the Museum of Tolerance acquired, I am troubled by the fact that the Museum had to pay $150,000 for this two-page letter. Imagine that, the Wiesenthal Center may be bidding against neo-Nazis, skinheads and others who conclude that Hitler did not do enough in trying to get historic documents for the Museum. There are websites and organizations that are dedicated to memorializing Hitler and finishing the work he started. The individuals in these groups raise Hitler to martyr status. They cherish what he stood for. They wish to get a hold of any piece of history connected to Hitler. Is the Wiesenthal Center, and its affiliated Museum of Tolerance, now going to enter bidding wars against today’s Nazis in order to acquire Hitler memorabilia? While on one level I sincerely
understand the historicity of the document in question and the desirability of having this document to highlight the insanity of Hitler in regard to his hatred of Jews. We now know that Hitler had already put together his plans to get rid of the Jews long before the economic events which previously had been credited for laying the groundwork for the Holocaust. It all comes down to the dual command to always remember, while simultaneously being commanded to blot out the memory. We have to deal with Hitler, what he stood for, and what he did as we try to never forget. But does the Jewish community have to spend $150,000 to acquire Hitler memorabilia to accomplish this? In the perfect world, Hitler would have lost his importance now 66 years after his death. The world is not perfect, however. In our efforts to always remember, we often keep Hitler’s memory alive, even as we wish that ultimately his memory will be blotted out. Sometimes I wish there was a little more blotting out of both his memory and the memory of those like him who perpetrated the Holocaust. Yet, we are learning new things about the period which led up to the Holocaust. This one letter causes us to rethink our assumptions about the origins of the Holocaust. But I do wish that the Jewish community did not have to spend hundreds of thousands of dollars to create an exhibit housing a single Hitler letter. And I do wish Hitler stopped being in the news.

n Simchat Torah we rejoice with the Torah. We celebrate the joy of being a Jew—the joy of a life defined by and permeated with the divine wisdom and will communicated to us at Mount Sinai. But where is the Torah? Where is the all-embracing wisdom of the Five Books of Moses, the inspiration of the Prophets, the music of the Psalms? Where is the brilliance of the Talmud, the guidance of the Shulchan Aruch, the mystique of the Kabbalistic writings? Where are the laws, the ethics and the philosophy that have molded our

lives and served as a beacon of light to all of humanity for 33 centuries? It’s all rolled up. It’s all rolled up in a scroll of parchment, girdled with a sash, clothed in an embroidered mantle. This is the Torah we grasp in our arms as we dance away the night and day of Simchat Torah in synagogues across the globe. Is this how we should celebrate our relationship with the Torah? By embracing a velvet-draped scroll and expending calories and shoe leather on synagogue floors? Surely the People of the Book could have devised a more appropriate way to rejoice with

the essence of all wisdom. Would not the festival be more appropriately observed by immersing oneself in a page of Talmud or a work of Torah philosophy? The Second Time Around Actually, there are two annual festivals which celebrate our receiving of the Torah: Shavuot and Simchat Torah. Shavuot is the day on which the entire Jewish nation experienced the divine revelation at Mount Sinai, where G-d communicated the Torah to us and summoned Moses to the top of the mountain to receive the Two Tablets of the Covenant. These

Tablets, however, were broken as a result the violation of their contents by the Jewish people with the sin of the Golden Calf. It is the Second Tablets, granted us on Yom Kippur, over which we rejoice on Simchat Torah. In other words, the First Tablets of Shavuot represent the “conventional” aspect of Torah - Torah as the study of G-d’s wisdom and the fulfillment of His will. On this level, a person’s relationship with the Torah is determined by his individual talents and behavior: the more one studies, the more one knows; the greater one’s mind, the deeper one’s comprehension; and if one acts contrary to the Torah’s commandments, one is no longer worthy of it - worshipping an idol of gold leads to a shattered Tablets and covenant. But there is also a deeper dimension to Torah, which transcends the externalities of conduct and understanding. This is the essence of Torah, the quintessential bond between G-d and Jew which is actualized by, but not dependent upon, the Jew’s study and observance of it. No sin or transgression can weaken this bond; on the contrary, it was the breaking of the First Tablets that uncovered its power and invincibility. This is the Torah of the Second Tablets, the Torah we celebrate on Simchat Torah.

On Shavuot we spend the entire night studying. We read selections from the Five Books of Moses, the Prophets and the Scriptures; we study the first and last paragraphs of each of the Talmud’s 60 tractates, selections from the esoteric works Sefer Yetzira and Zohar, and Maimonides’ list of the 613 mitzvot. We are celebrating the manner in which Torah is realized in our live s- by study and implementation. But on Simchat Torah we celebrate our bond with the quintessence of Torah. So the Torah remains scrolled and covered - we are grasping it rather than its words and precepts. We dance with the Torah rather than study it, because we are relating to that dimension of Torah which embraces each and every Jew equally, regardless of knowledge and spiritual station. In dancing, we all relate equally to the Torah: the sweat of the scholar is no more profound than that of his illiterate brother, and the feet of the saint move no more piously than those of the boor. On Simchat Torah we are all equal: equal in our inability to fathom the essence of Torah, and equal in our intrinsic and inviolable connection to it.. •

This month I visited my dear father at a nursing home. He is frail and nearing his ninetieth birthday. Presently he is weak but very determined to become stronger than ever. He was widowed and had been living at home for the past few years with 24 hour care. At this time he is not able to live at his home as more care is needed. So, by choice, he is a resident at the Sephardic Nursing and Rehabilitation Center located in Brooklyn, New York. His message seems to be that “I am getting older, not old. And to prove the point he runs his live as always. He stays in control. He made the choice and it was a wise choice indeed. My father is the President of the Rabbinical Alliance of America. For over sixty five years he has lead the Jewish community and rabbinical organizations. He still sees hundreds of people that come for advice or socialization. His room at the nursing center is his new office and temporary home. This month he participated in a special program for the Rabbinical Alliance of America. The organization has over eight hundred Rabbis and many came together meeting for inspiration, Torah and rabbinical direction. If you can’t make it to the program then bring the program to you! The way he pictures his predicament of living away from home is that it will prolong his life and not, G-d forbid, as some think, otherwise. If you want to live then take the courage and enter a home where they can help you.

Let me explain with a four-hundred year old story attributed to Rabbi Zechariah Alshari. A man dreamed that he saw an angel standing over him with a sword. “Who are you, my lord?” he asked in alarm. “I am the Angel of Death, and I have come for your soul.” “Have pity on me, I have my little sons and daughters. Wait until they grow up and then come back.” The Angel of Death pitied the poor man, returned his sword to its sheath, and said, “I’ll let you off. But the next time I come for you, no excuses will help.” The man thanked him and requested that he send a messenger before coming again, so that he could prepare himself and not have to live in constant fear. The Angel of Death agreed. When the man awoke, he realized it was only a dream. Little by little, his dream about death was forgotten. In the course of time, he married off his sons and daughters, grandchildren, and even some great grandchildren. At last he grew old and fell fatally ill. Now the Angel of Death arrived and was ready to take him. “How could you have come like this without a warning? Didn’t you promise to send me a messenger first?” “O man,” said the Angel of Death, “I sent you not one messenger, but many.”

The first was your eyes, which used to be sharp and grew dim. Then were your teeth, which once could grind stones and then fell out of your mouth. There is a lesson to be taught. We must educate the communities about the good things about nursing homes. How they can help nurture and preserve life in a quality fashion. Most of all it is up to the families to show a strong interest, support, by preserving the love and bond between those entering nursing homes. Unfortunately when this is not done feelings of abandonment are experienced and become a detriment to their health. Remember a nursing home is a home away from home providing better care, love and nourishment which cannot be given in a home setting. You can provide a great mitzvah in sharing this message with families facing the decisions of placing loved ones into dignified nursing or retirement homes. Meanwhile we pray for the health of my father, Rav Avraham Dov ben Sara.•

"This Is My Torah Scroll" the father that the boy had become a good Catholic. Joseph Foxman took his son by the hand and led him directly to the Great Synagogue of Vilna. On the way, he told his son that he was a Jew and that his name was Avraham.
Henryk was very young in 1945, when the War ended and solitary survivors tried frantically to trace their relatives. He had spent what seemed to be most of his life with his nanny, who had hidden him away from the Nazis at his father's request. There was great personal risk involved, but the woman had readily taken it, as she loved the boy. All the Jews were being killed, and Henryk's nanny did not think for a moment that the father, Joseph Foxman, would survive the infamous destruction of the Vilna Ghetto. He would surely have been transferred to Auschwitz -— and everyone knew that nobody ever came back from Auschwitz. She therefore had no scruples about adopting the boy, having him baptized into the Catholic Church and taught catechism by the local priest. He told his son that he was a Jew and that his name was Avraham It was Simchat Torah when his father came to take him. The heartbroken nanny had packed all his clothing and his small catechism book, stressing to 24 O c t o b e r 1 2 , 2 0 1 1
Not far from the house, they passed the church and the boy reverently crossed himself, causing his father great anguish. Just then, a priest emerged who knew the boy, and when Henryk rushed over to kiss his hand, the priest spoke to him, reminding him of his Catholic faith. Everything inside of Joseph wanted to drag his son away from the priest and from the church. But he knew that this was not the way to do things. He nodded to the priest, holding his son more closely. After all, these people had harbored his child and saved the child's life. He had to show his son Judaism, living Judaism, and in this way all these foreign beliefs would be naturally abandoned and forgotten. They entered the Great Synagogue of Vilna, now a remnant of a past, vibrant Jewish era. There they found some Jewish survivors from Auschwitz who had made their way back to Vilna and were now rebuilding their lives and their Jewish spirits. Amid the stark reality of their suffering and terrible loss, in much diminished numbers, they were singing and dancing with real joy while celebrating • 323-965-1544 •
Simchat Torah. Avraham stared wide-eyed around him and picked up a tattered prayer book with a touch of affection. Something deep inside of him responded to the atmosphere, and he was happy to be there with the father he barely knew. He held back, though, from joining the dancing. A Jewish man wearing a Soviet Army uniform could not take his eyes off the boy, and he came over to Joseph. "Is this child... Jewish?" he asked, a touch of awe in his voice. "This is the first live Jewish child I have come across in all this time..." The father answered that the boy was Jewish and introduced his son. As the soldier stared at Henryk-Avraham, he fought to hold back tears. "Over these four terrible years, I have traveled thousands of miles, and this is the first live Jewish child I have come across in all this time. Would you like to dance with me on my shoulders?" he asked the boy, who was staring back at him, fascinated. The father nodded permission, and the soldier hoisted the boy high onto his shoulders. With tears now coursing down his cheeks and a heart full of real joy, the soldier joined in the dancing. "This is my Torah scroll," he cried. Abe Foxman, the national director of the Anti-Defamation League -- the Avraham in our story -- remembers this as his first conscious feeling of a connection with Judaism and of being a Jew. Helping Renew the Purifying Waters of Arad
ewish women living high above the “lowest place on the planet” this year have faced a tough challenge in properly fulfilling the commandment of family purity. At the point where the Judean Desert meets the Negev, the small Israeli desert town of Arad sits on a ridge overlooking the southern tip of the Dead Sea. Its elevation is approximately the same as the holy city of Jerusalem. But even though the waters of the Dead Sea are famed for their healing ability, one thing they cannot do is serve as a mikvah – a ritual pool of purifying “living waters.” In Jewish law, only natural water from the world's oceans, rivers, wells and spring-fed lakes – water in which life can survive -- can be used for a mikvah. Rain water can also be collected in cisterns that feed into pools adjoining the mikvahs in which Jewish women ritually purify themselves. It is the mikvah that seals the holy bond of Jewish family life in the hours after sunset each month. But for the women of Arad, fulfillment of this key commandment has come at a great price. For Chabad women, it has meant a trip of an hour or more to the city of Be'er Sheva to find the

closest mikvah that adheres to their Chassidic traditions. In recent days, that has sometimes also meant a life-threatening gamble against the terrorists launching rocket attacks on the city and surrounding areas. Arad has a mikvah. Unfortunately it has repeatedly broken down and its kosher legal status has been called into question numerous times for more than a year. Red tape and other issues kept the city's religious authority from attending to desperately needed repairs. Finally, a contractor was secured and the work finally began but there was not enough money to complete the task. “It's not that the repairs themselves are not going to be done,” explained Tzila S., a member of the community. “They are. But that is all. The tiles on the walls, even before this problem existed, were already cracked and decades old. And now that workers have been in there, swinging hammers and all... “ In recent years, most mikvaos have pleasant and comfortable facilities which greatly enhance observance of this mitzva. Arad’s mikvah, sadly, does not come anywhere close. “The contractor is trying to work with us,” Tzila said. “He told us to pick out • 323-965-1544 •
tiles, and explained how to keep the cost down. I wanted to get pretty ones, so that even if we don't have much, at least the walls should look nice.” Since Arad's religious authority refused to pay, a family that could ill afford it took a personal loan to cover the contractor's initial work beyond basic repairs. But the loan must be repaid. Worse, that sum only covered the first week's work. Much more still needs to be done. “I don't know how we are going to do this,” Tzila admitted. “But I believe – I must believe – that G-d will not leave our community without a mikvah.” Funds are desperately needed to complete the renovations. "I missed yeshiva because I was at the Maccabi Tel Aviv football (soccer) finals. In fact," the boy added in embarrassment, "I probably won't be in yeshiva tomorrow as well. It's the final day of the championship."
"Ah!" cried Reb Sholom in absolute victory. Now think a moment! Listen to what you just said! It is no kuntz to come to the yeshiva when nothing is trying to hold you back! It is when the urge to skip class is there, when the Yetzer Harah is crouching in the goal, that it is most difficult to score. That is when you really score points. Come tomorrow, and you can't imagine how much that is worth in Hashem's scorecard!"

e all know the story of the flood. The world was bad - very bad. Hashem was enraged. He decided to destroy the whole world except for a tiny righteous family, the Noachs. But what was the actual bad that did the world in? After all, something had to have gone mighty awry for the Almighty to destroy his handiwork and begin anew. And so, the Torah tells us, "Now the earth had become corrupt before G-d; and the earth had become filled with robbery. And G-d saw the earth and behold it was perverse, for all flesh had corrupted its way upon the earth. G-d said to Noah, "The end of all flesh has come before Me, for the earth is filled with robbery through them; and behold, I am about to destroy them from the earth" (Genesis 6:11-13).
According to the "What It's Worth" department of a popular news broadcast, this story actually occurred. In the late 1980s a robber walked into a bank in Oceanside, California, with a gun and a note. He strode up to the teller that looked the easiest target a woman in her fifties with a gentle, grandmotherly appearance. He handed her the note that demanded the money. "Give me all your money or I will blow your … head off" or something to that affect. She reached for the cash drawer to oblige. Then she looked back down at the note and her teeth clenched. She squeezed her hands into tight fists and turned red. Suddenly, in flash she pulled out the metal drawer entirely. She did not give it to him instead she flung it at him.
He handed her the note that demanded the money. "Give me all your money or I will blow your … head off"
It seems that there were two main crimes, corruption and robbery. Robbery is self-explanatory, and the commentaries explain corruption as lewdness and licentiousness in addition to idolatry. In fact, it was so bad that "all flesh had corrupted its way"; not only did mankind cavort in adulterous behavior, even cattle, beasts, and fowl did not consort with their own species" (Rashi ibid.)But what sealed their fate? There seems to be two defining offenses. The Torah introduces Hashem's words to Noach with the statement, "And G-d saw the earth and behold it was perverse, for all flesh had corrupted its way upon the earth." Yet what he tells Noach is " The end of all flesh has come before Me, for the earth is filled with robbery." So what was it that brought the Almighty to the fateful decision, robbery or perversion?
Rashi declares in one verse, "wherever you find lewdness and idolatry, punishment of an indiscriminate character comes upon the world, killing good and bad alike." Yet, later, when the Torah states the sin of robbery, Rashi explains that "their fate was sealed only on account of their sin of robbery." How did these two very different evils forge together to force the end of the world? In addition, what lesson can we take from it?

The she bashed him over the head with it. She hit him once, and again, and again. She began yelling at him in a rage. The money was flying all over the bank. The patrons ran for cover. The dazed thief retreated in fear. Then he ran. Police nearby caught him hiding under a nearby bush. And then they figured out what spurred the heroics of the grandmotherly teller. She was chasing him out of the bank screaming, "Don't you ever use such a foul word again!"
Many commentaries explain a difference between judgment and wrath. They are separate issues. Judgment was meted because of the sin of thievery. But that merits judgment, and payback. Perhaps there could have been repentance. Maybe only certain acts would have been judged. It is strong enough to warrant strict judgment. But to a point. Thievery alone, even wanton brazenness is not enough to destroy a world. Alone, it would not have produced such wrath. But when the desire to gain someone else's property is compounded with the arrogance of lewd licentiousness, depraved morality, and debasing the norms of civilization, then the judgment is meted with wrath. Often people sin. They even steal. Those crimes have to be dealt with even judged strongly. But when unprovoked vices become integrated with the selfishness of theft and greed, then a wake-up call is imperative. Even if it can ruin your entire world.

Lights, Camera, Action in LA! “Good afternoon. I’m calling about your special encounters with the Lubavitcher Rebbe.” “Who are you again?” “My name is Mendy and I am calling from JEM.” “Oh.” Thus began the journey Westward to Southern California. Our goal: to unearth memories and miracles, advice and inspiration. Our team at the My Encounter with the Rebbe project just concluded their third journey in the past six months. Yechiel Cagen, Mendy Alevsky, Yankee Teitelbaum and Eliyahu Benhiyoun were the brave troopers who made the ten day marathon –from 8:30AM to 10PM every day – during which over forty people were interviewed. Along the roads of Los Angeles and the mountains of the Valley a very tired but determined interviewer called into a Google voicebox noting some memorable discoveries from each day’s interviews. Here are some of his notes: A twenty-some year old man turned to the Rebbe for assistance in realizing his dream to open the first Yeshiva in Mexico. “This was the early 1950’s. Who else could I turn to who’d be open to such an idea?” A young woman related how the Rebbe helped her find closure after her father’s passing. She was 16 years old in 1972 and threatening God with rebellion. She was also having dreams that disturbed her sleep and tormented her soul. The Rebbe looked

deep in her eyes – “straight to the back of my head,” in her words – and gave her soul the peace it sorely needed. Since then, no more tormenting dreams. Now she’s a mother of a beautiful family of fine Jewish children. We interviewed another woman who was told six months after her marriage, “We’re sorry ma’am, your womb is infertile. There’s nothing we can do.” Devastated and sobbing in the sterile hallways of the doctor’s clinic, she looked into the eyes of her young husband, searching for some hope. They were shining. He knew just the address. He was not a Lubavitcher but the Rebbe had helped them once before. A short while later, they were told by a specialist of a different kind, “don’t worry, G-d will help you.” And He did.. Many years and 15 children later that declaration of gloom is long forgotten. But wait, her story isn’t over! Years later in a different city, she paid a visit to a different doctor. After examining her, the doctor addresses her in a sympathetic tone, “Ma’am, you must be very unhappy.” Bewildered, she asks him, “Why?” “Well,” he tells her, “your womb is sterile!” Forty-two people interviewed and over 50 hours of footage later, the My Encounter with the Rebbe team is riding on toward its next project. Rabbi Dovid Misholuvin spoke about the self-sacrifice the Lubavitcher Chassidim in Russia went through behind the Iron Curtain. Mrs. Sterna Citron (a cousin of the Rebbe) spoke about her memories of the Rebbetzins. Day 8: My Encounter presentation for Beis Rebbe girls’ school. The girls got a behind-the-scenes look into the My Encounter project and they interviewed Mrs. Raizy Schmukler! Rabbi Meshulam Weiss spoke about the many directives he received from the Rebbe. Day 9: Mr. Yisroel Horowitz spoke about his meeting with the Previous Rebbe and life in Crown Heights in the 1940s and ‘50s. Dr. Meir Abhesera, “the Rebbe’s whistler” spoke about his unique conversations with the Rebbe. Dr. and Mrs. Leonard Lovitch spoke about the Rebbe’s directive to drink red wine for Shabbos Kiddush and Havdalah, which miraculously restored his eyesight and saved his career.

Babies & You A Halachic and Medical dialogue This new series of articles from the Puah Institute is meant to educate and inform about the complex issues involved in building families. As 1 out 6 couples face some type of fertility challenges, we hope that this forum will be helpful to all our readers. 1 out of 6 reflects a large segment of the community, and each and every one of us knows someone who faces some problem in having children. The good news is that 95% of the problems do have solutions. Please be sensitive and caring when you decide to share this information with anyone. This article reviews questions about prenatal testing: a medical and halachic view Question: What are the available tests to be done before becoming pregnant? Are these tests really necessary? Dr. Ben-Ozer answers: Prenatal testing is an option available to couples prior to conception or during the pregnancy. Healthy couples may have a child affected with a disease if they both carry a silent DNA error. Being aware of the presence of such mutations affords couples the ability to check the health of their baby prenatally, or their embryos prior to implan-

Some diseases are more common in the Jewish Ashkenazi community, and can be checked. These include Cystic Fibrosis, Tay Sachs, Bloom Sydrome, Canavan Disease, Familial Dysautonomia, Fanconi Anemia, Gaucher disease, Mucolipidosis Type IV, and NiemannPick Disease Type A.
1. A nuchal translucency ultrasound in the beginning of the 2nd trimester: A nuchal scan is a sonographic prenatal screening scan (ultrasound) to help identify higher risks of chromosomal defects including Down's syndrome in a fetus, particularly for older women who have higher risks of such pregnancies. High thickness measurements are also associated with congenital heart defect.[1] The scan is carried out at 11– 13.6 weeks pregnancy and assesses the amount of fluid behind the neck of the fetus - also known as the nuchal fold or the nuchal translucency. Fetuses at risk of Down's Syndrome tend to have a higher amount of fluid around the neck. The scan may also help confirm both the accuracy of the pregnancy dates and the fetal viability. Its high definition imaging may also detect other less common chromosomal abnormalities. *
Question: Are there any halachic problems with these tests? Rabbi Weitzman answers: There are no halachic problems with undergoing any of these tests since they involve blood tests that present no problem halachically. A woman is also permitted to take Folic Acid on Shabbat, in the same way that it is permitted to take vitamins on Shabbat. When undergoing genetic testing the couple needs to be aware of the halachic ramifications of the testing and what can be done if they discover that they are carriers of a genetic abnormality. Question: What are the tests that should be done during the first trimester? Dr. Ben-Ozer answers: In addition to the genetic tests we’ve already dis-

prenatal diagnosis to determinechromosomal or genetic disorders in the fetus. It entails getting a sample of the chorionic villus (placental tissue) and testing it. CVS usually takes place 10– 12 weeks after the last period, earlier than amniocentesis (which is carried out as early as 14–16 weeks)* Valuable information can be obtained which can help treat the baby in utero or immediately upon delivery, when necessary. Question: Why should we test at all, isn't it better just to believe in Hashem? Rabbi Weitzman answers: First, it should be stated that pregnancy is not a disease and we do not treat it as such. The reason for undergoing tests is to ensure that all is well. If there are health problems, it is often possible to treat them either during the pregnancy or immediately after birth. While the Midrash (Kohelet Rabba) does say that one of the things hidden from man is what is in the womb, today we have the ability to test easily and without halachic questions. It could be argued that one who does not test is not acting according to faith but is actually going blindly. One has to trust in Hashem, but this does not permit one to drive in a car while wearing a blindfold, this is not faith: it is folly and foolish. Question: Are there any halachic problems with the tests performed during the first trimester? Rabbi Weitzman: There is no problem with undergoing blood tests or an ultrasound test. This test does not endanger the fetus nor does it cause a woman to become niddah. If she sees spotting, she should consult with her Rabbi who will ascertain the source of the bleeding and

her halachic status. It is not permitted to undergo CVS unless specific halachic permission was granted and this will only be given in rare cases. Question: Are there any halachic concerns with prenatal tests? Rabbi Weitzman answers: All tests during pregnancy can be divided into three basic groups; tests that are essential, tests that are forbidden and tests that are permitted but not essential. The first group includes a comprehensive ultrasound to ensure that all of the baby’s limbs and internal organs are in order and functioning. The second group includes amniocentesis and CVS, which are potentially harmful to the developing fetus, and therefore should only be permitted when a specific permission has been granted by the couple’s halachic authority. The third group includes a nuchal translucency or AFP screening. These tests do not give a yes/no answer but a statistical average based on maternal age and the test itself. Sometimes couples tend to get overly worried if they receive an unclear result or a slightly raised statistical average. Therefore, it is always worth consulting with an expert rabbi before embarking on such a test and definitely after receiving a "seemingly problematic" result. It should be stressed that one single finding in an ultrasound is usually not a cause for concern. In addition, it is important to undergo a comprehensive ultrasound with an expert in ultrasound. What are the tests that should be performed during the third semester? Answers Dr. Ben-Ozer: The development of the baby is monitored via ultrasounds, fetal heart tracings, fetal kick counts, and maternal labs, among others. • 323-965-1544 •

What is Livescan Fingerprinting? Livescan is an inkless fingerprinting process where fingerprints are electronically transmitted to the Department of Justice for background screening. Ink fingerprinting is still required in many states. However, as a result of legislation passed in 1997, the California Department of Justice (CA-DOJ) has developed the automated background check process, which requires Livescan fingerprints for criminal history background checks that may be required as a condition of employment.
