In the recent Presidential Primary debates, in recent court decisions, and in Obama Administration rulings regarding the implementation of health care law, there has much focus recently on the First Amendment's Freedom of Religion clause. Some have come to see recent court decisions, such as barring references to G-d in school assemblies, and new administration rules for healthcare which limit "religious" activities to those activities addressed only to members of their own religion as part of an orchestrated War on Religion. Others strongly disagree. What is going on? And to quote the classic question, "Is it good for the Jews?" The Obama Administration is in the process determining the rules which will govern the new health care system under “Obamacare.” In an effort to balance the interests of certain religious groups against the proponents for all kinds of women’s reproductive health care, including birth control and sterilization, the Administration has come up with a compromise. “Direct” religious activities, such as churches, synagogues, and mosques, would be exempt from requirements to provide in the health care insurance they offer employees things which the religion opposes. Roman Catholic churches, for example, would not be required to provide birth control to women employed in the actual churches. However, other activities owned or sponsored by the churches, such as church-owned hospitals or colleges, would not be exempt from providing for all kinds of women’s reproductive health care in insurance policies to employees, even for birth control, even if the sponsoring church is the-
ologically opposed to such care. This would apply to any church-owned programs which also accept or provide services to non-members of their church. Catholic hospitals would have to provide services opposed by the religion if non-Catholics are served by the hospital, as just one example. It seems that the only way out for the Church would be to close Catholic hospitals to anyone not Catholic.

As a former rabbi in North San Diego County where there were few Jewish resources, many newly unemployed Jewish parents and their families would have been denied the temporary shelter they needed if barred from being sheltered by the Salvation Army. The new regulations would also bar Jewish religious groups from helping Center City children or children in East Los Angeles with reading instruction, such as that provided in the highly popular Koreh L.A. program, if the literacy program is to be viewed as a religious activity with religious protections.

Think of the most famous hospitals, nationally and locally. New York Presbyterian. Mt. Sinai. Maimonides. Cedars-Sinai. St. John's. Loma Linda. Providence Hospitals in Burbank, Tarzana, and Mission Hills. All of these are not-for-profit hospitals established by religious charities and maintained in large part through donations and volunteer activity from the religious communities. Caring for the sick, including the sick of other religions, is seen by many religious groups as a biblical requirement. All major religions see caring for the sick as a religious duty.
s”xc find this move to be a major attack on religion. There is no protection of freedom of religion when religion becomes defined by the government. I certainly can see why many groups see this governmental redefinition of religious activities as an affront to religion, “A War on Religion.” This particular health care regulation may have a greater impact on Catholics than Jews because of the clear restrictions on the use of birth control within the Catholic Church. Ordering the Catholic Church to pay for birth control for employees is a violation of its underlying religious dictates. But the impact goes far beyond healthcare. The whole idea of the First Amendment’s guarantee of freedom of religion disappears if the government restricts what constitutes religion. Because of the potential negative impact for the Jewish community from governmental interference in religion, this proposed regulation is not “good for the Jews.” This proposed regulation is just part of what is going on regarding new governmental restrictions on religion. There is a recent court ruling which not only excludes invocations and benedictions at public activities, such as school graduations, but prohibits the use of the word/name G-d in such assemblies. A judge went so far as to threaten a public school district superintendent with jail time if G-d were to be mentioned by any student or school staff. While some Jews hail this kind of decision as actually protecting Jews from mentions of Jesus, this restriction of religious expression cuts both ways. Imagine an Orthodox Jew giving a valedictory address without saying words such as Baruch Hashem, or thank G-d. Barring individuals from such free expression 11 F e b r u a r y 1 0 , 2 0 1 2
go beyond the elimination of prayer from school assemblies. These rulings bar everyday speech and expression impacted by religious background. Only the speech of the non-religious who never make reference to the Almighty is protected. For the past 40 or more years, there have been attempts to rid the military of chaplains. Having the government pay for ministers, priests, and rabbis is seen by many not just as providing for freedom of religion, but actually funding the practice of religion. But those who oppose the funding of chaplains are blind to the role of chaplains in the military. There is a popular, probably true expression: There are no atheists in a foxhole. In an environment where people question their faith or seek out in prayer to a higher authority, if there were no chaplains in the military, there would be no access to religion, and therefore no freedom of religion. When I was stationed at Camp Pendleton Marine Corps Base as a Navy chaplain, I soon realized that the only access to organized religion available to most of those stationed at the base was provided by chaplains. The nearest synagogue for many housed at the base if there would be no rabbi or Jewish chapel at the base was 30-40 miles away, or even a greater distance off base. Marines and sailors who have no cars or other transportation to these far away synagogues could not attend Shabbat or holiday services. New recruits undergoing basic training are not even permitted to leave the base. In the trying and difficult times of the grueling training period, these recruits often question their faith and commitments. Denying access to chaplains would be denying access to their religion. Those who seek to eliminate the role of the chaplain probably never served in the military. They shout out about separation of church and state, but ignore the religiously charged environment of the military where ultimate issues of service and the meaning of life permeate the daily activities of those who serve. What kind of society have we become when we protect the right to listen to or “sing” rap music at school, including degrading terms for women, but we outlaw the saying of G-d’s name within the same school? We permit and promote groups supporting different forms of sexual expression, but restrict prayer

I do not fear those who express or promote religious values. In fact, I see our society as having been enriched and strengthened by those who have pursued religious ideals. The works of religious leaders and the expression of religion were basic to the life work of Reverend Martin Luther King, Rabbi Abraham Joshua Heschel, and Mother Teresa, work which has so positively shaped our modern society. We are a better nation because of the impact brought about by the pursuit of such religious values. It is not good for the Jews to have a government which determines what is religious and what is not religious. We must stand vigilant in the protection of Freedom of Religion. The loss of religious freedom or the restriction of such freedom by the government would be a greater loss than any benefit which might accrue from the new healthcare regulations. •

Records of discussion with a psychologist, a psychiatrist, or a physician can be demanded and reviewed by a commanding officer. Only conversations with a chaplain are protected communication. With enlisted and officers experiencing frequent encounters with life and death circumstances, the role of the chaplain is not only protected, but treated as sacrosanct in the military. It is the chaplain who is the only person to turn to when one questions his or her conscience in regard to military service.

The portion of Yisro contains perhaps the most popular of all Biblical treatises The Ten Commandments. But the portion contains much more than commandments. It also contains Hashem's elocution defining his people as the most treasured in the world. What makes Jew chosen? Before giving the Torah to them, Hashem enunciates the prerequisites. Note: Judaism's exclusivity is not dependant on birthright alone. It is dependant on commitment to Torah and Mitzvos. It is not a restricted club, limited only to those who are born as Jews, descendants of Abraham, Isaac and Jacob; it is also exclusive to those who commit to observe, whether, of Asian, African, or European descent. Thus, the Torah clearly states that those who hearken and observe the covenant are worthy to be a beloved treasure.

As a young student in a cheder – private Jewish school, we were discouraged from playing sports. Our teachers, called Rebbes, were from the old country. They displayed an aversion to any kind of organized sport. For many of them sports meant body worship and that was a big no-no. For others, sports meant pitting the weak against the stronger teaching that the deciding factor in life is that might counts and what was right makes no difference. The Rebbe said, “sports-dos is treif – not kosher and not productive. Sports brought out the worst in people. You can get hurt, or worse, pick up violent tendencies.”

the no contact games that are followed by violence while the body contact games have less or no violence. The most violent sport I can think of is boxing. Yet that sport has had many Jewish boxers. Starting way back in England in 1764 with Daniel Mendoza; the father of the art of boxing. He wrote a book on the art of boxing and taught defensive boxing, dubbed “Hit and Hop.” Benny Leonard and Barney Ross were lightweight champions, Lou Tendler, Maxi Rosenblum and Jackie Kid Berg are Jews in the Hall of Fame and so are many others. In December 1911, the Empire Athletic Club, located in Manhattan, reported that Dr. Louis Wallach, known as Leach Cross, “The Fighting Dentist,” won by a knockout in the ninth round. He became the hero of the century A story is told of an exchange that took place between Wallach’s father, Chaim, and a friend. It seems that Louis Wallach had adopted the non-Jewish name Leach so that his father, a very religious person, would not know of his son’s new profession. On the night of Louis’ 26th bout, another knockout, a friend greeted Papa Wallach with, “Gut Shabbos and Mazel Tov”. Mr. Wallach retorted, “My son – a bum! A Yiddish bachur (Jewish young man) does not fight!” Orthodox Jews likened fighting to eating pork. However, he was soon won over to his son’s profession. Why would a seemingly Soccer, a innocent no-contact game cause so much havoc while boxing, the killing machine game, has no such aftermath? I think we may be losing the spiritual message of the games. The idea of healthy and sound winning to share spirit is lost.
We have lost contact with our souls. The late Lubavitcher Rebbe, Rabbi Menachem Mendel Schneerson, once commented on the game of soccer: “When a child has studied Torah and he wants to go out and play ball, he should not be criticized. Rather, we must “educate the child according to his way,” i.e. show him how he can play ball “for the sake of Heaven.” Recreation contributes to his health which will, in turn, give him a greater capacity to learn. Playing ball is like taking a pill. When someone is sick, he must take pills to regain his health. Is taking a pill good? In this context, yes. Similarly, is playing ball good? Since it contributes to the study,yes. The purpose of a Jewish child’s life is to learn Torah and fulfill mitzvahs. Playing ball can also contribute toward this goal. If he wins he thanks G-d for his victory.” The Supreme Court forbidding students to lead in prayer before a game is wrong. The ruling drives home the message that sports are turning players and spectators to worshipping the body and not the spirit. It has become a sad contact sport where players and spectators are only interested in themselves. I believe it would do America well not only to have a prayer before the game but a prayer after the game thanking G-d for giving the human race the capability of competing in a harmonious fashion. The spirit of our competition has to lift the spirits of the spectators towards acknowledging that sports can bring us all together for a good time. If we had prayed before and after the Soccer game there would have no losers only winners!

The Guardian Angels have managed "Community Safety Patrols" throughout the world for more than three decades. They are comprised of reliable and responsible volunteers who patrol streets, neighborhoods and community events to safeguard citizens of all ages. In light of recent muggings and burglaries in and around our neighborhoods of Los Angeles, Commissioner Winkler along with other prominent community members is spearheading an effort to set up safety patrols under the auspices of the Guardian Angeles in Jewish communities of Los Angeles manned by both Jews and non-Jews. The Guardian Angeles have the experience and know-how to organize and manage this type of partnership with local law enforcement. It was only a few seconds before the young man slammed the window down, while screaming at the elderly sage for opening it. Rabbi Salanter apologized profusely to the man young enough to be his child, and buried himself in a Jewish book of law.
Upon arriving in Vilna, the young man was horrified to see throngs of people gathered to receive one of Europe's most prominent Rabbis. The man immediately ran to the home where Rabbi Salanter was staying. He began to beg forgiveness. "Don't worry," explained Reb Yisrael, "a trip can make one edgy. I bear no ill will. Tell me," continued the mussar master, "why did you come to Vilna?"

Among the complicated fiduciary matters that this week's portion discusses, the Torah deals ARSHAS with seemingly simple and mundane issues as well. The Torah talks about donkeys. Heavily laden donkeys that belong to your enemy. The Torah tells us, "if you see the donkey of someone you hate and you refrain from assisting him, you shall repeatedly help him" (Exodus 23:5). Obviously the interjected phrase "and you refrain from assisting him" begs clarification. After all, if you mustn't refrain from helping him, why mention it in the first place? Rashi explains that the words are to be read rhetorically, "Would you refrain from helping him? How can you let a personal grudge take precedence over the poor animal's pain? Surely you shall continuously help him." The Talmud (Bava Metzia 32) takes the words at face value and explains that there are actually certain situations where one must actually refrain from helping unload donkeys. I would also like to offer the verse at face value.

The young man explained that he was looking to become an ordained shochet and an approbation from a Vilna rabbi would be universally accepted. Rabbi Salanter smiled. "My own son-in-law, Reb Elya Lazer, can ordain you. He is a Rav in Vilna. Rest up and tomorrow you can take the test.

The next day, it was apparent that the man needed more than rest, for he failed miserably. However, that did not deter Rabbi Salanter. He encouraged the man to try again. For the next several weeks, Rabbi Yisrael arranged for tutors and prepared the young man well enough to pass Reb Elya Lazer's make-up exam along with the tests of a host of other well-known Vilna rabbis. He even arranged for the man to get a job. Before leaving Vilna, the man appeared before Reb Yisrael with tears in his eyes. "Tell me, Rebbe," he cried. "I was able to understand that you could forgive me for my terrible arrogance on the train. But why did you help me so much? That, I can never understand." "Reb Yisrael sat him down, held his hand and explained. "It is easy to say 'I forgive you'. But deep down, how does one really know if he still bears a grudge? Way down in my heart I
actually was not sure. The only way to remove a grudge is to take action. One who helps another develops a love for the one he aided. By helping you, I created a true love which is overwhelmingly more powerful than the words, 'I forgive you'." The Torah tells us that if you see the donkey of your enemy keeling from its burden and you want to refrain from helping, know then, that now is the time to help. The minute your feet falter, then it is time to quicken the pace, overpower your emotions and make a move. The Torah understands human nature all too well. The sub-conscience speaks very loudly and often tells us to take three steps backwards. That is the time to make a move that will heal old wounds and close open sores. Overpowering kindness will not only help ease burdens off a donkey, it will make things a lot lighter for you as well. •

Heat oil in a large saucepot and saute onions, peppers and mushrooms until onions begin to turn translucent and peppers begin to soften. Add tomatoes, tomato paste, tomato juice, shallots, garlic, basil and parsley. Season with salt and pepper. Let simmer 45 minutes until medium thickness. Preheat a grill to high. Season chicken breasts with salt and pepper. Grill on both sides until cooked through. Arrange on serving platter and spoon sauce around. Serve with a side of polenta (as you would mashed potatoes), and remaining sauce in a gravy boat.
