CEG Founder, Ed McKeon, Passes Away at Age 91 Edwin M. McKeon, founder of Construction Equipment Guide (CEG), died peacefully Dec. 31, 2021. He was 91. Mr. McKeon was born in Philadelphia on Jan. 17, 1930, and was the eldest child of the late Edwin A. and Mary Houlihan McKeon. He was raised in the Mount Airy section of Philadelphia and graduated from Holy Cross Catholic Grade School. He was a graduate of St. Joseph’s Prep (1947) and St. Joseph’s University (1953). Upon graduation, he enlisted in the U.S. Marine Corps OCC program and proudly served his country as a Marine for nine years, rising to the rank of captain. On St. Patrick’s Day 1954, Mr. McKeon married the love of his life, Joan Gallagher McKeon; they enjoyed more than 65 years of marriage until Joan’s passing in 2020. Mr. McKeon was the proud father of five children, 10 grandchildren and four great grandchildren. While starting their family, the McKeons also were getting a new business running. In 1957, 27-year-old Mr. McKeon was working for his father-in-law, who owned Roxboro Cinder Co. in Philadelphia. The company needed to update its equipment and put Mr. McKeon in charge of the search. Local newspapers published special sections on equipment on Sundays but didn’t meet the market’s need. And thus, an idea was born for a publication that circulated in the construction industry that would be a big motivator between buyer and seller. Mr. McKeon took his idea of a shopper-type publication, and with the help of Gene DiMezza, started Construction Equipment Guide in his Pennsylvania home. The first issue, in May 1958, was all construction equipment ads. Editorial didn’t appear in the papers until 1970. By the mid-1980s, CEG was publishing articles describing the history, growth and products of equipment dealers and manufacturers. After laying out the pages and pasting them up in the rec room, that first issue was printed on both sides of a single black-and-white 11-in. by 17-in. flat, which folded to make four pages. It was then addressed and mailed from his house to about 10,000 dealers, contractors and other construction people in the Delaware Valley area. Names came from personal contacts, directories, telephone books and other sources. Mrs. McKeon typed up the bills on a portable typewriter, purchased from a neighbor who sold typewriters. As the business and family grew, the publication began its odyssey to a series of new locations, all providing more space: in 1959, CEG moved from the McKeon rec room to part of a building in Willow Grove, Pa., owned by Walter Blair, who had taken over the printing. In 1960, CEG moved again, to half of a twin home, also in Willow Grove. This provided about 2,000 sq. ft. of space. The next big move was in 1966, when Mr. McKeon purchased a three-
story office building in Glenside, Pa. The publication would stay there for 20 years before moving in 1988 to a morespacious one-story former printing company building, also in Glenside, Pa. Today, CEG is published out of its 22,500 sq.-ft. office building in Fort Washington, Pa. That same year, CEG also began its expansion to a nationwide publication when it published its Southeast Edition. It then began publishing a Midwest Edition in 1994, a Southwest Edition in 1999, and a Western Edition, which includes Alaska and Hawaii, in 2005. CEG purchased Superintendent’s Profile magazine in 2003. This monthly publication profiles a specific New York State highway superintendent or public works commissioner in each issue. Further strengthening the business, in March 2007, CEG purchased the assets of Contractors Equipment Guide. Previously a competitive publication in New England, it is now a biweekly supplement to the Northeast Edition.
Throughout his long career in the industry, Mr. McKeon was for decades a recording secretary for the Delaware Valley Associated Equipment Distributors, a member of the national AED organization and an active member in many other industry associations. Today, CEG is managed by Mr. McKeon’s sons, Ted, Joe and Richard McKeon, and his grandson, Edwin “Teddy” McKeon III, the third generation of the family to begin making his mark on the business. “Our father was a true entrepreneur … a visionary who identified a need in the construction industry and set out to fulfill it,” said the McKeon family. “But he was never complacent. Although CEG had become and remains very successful, he was always thinking of new ways to grow the publications, to further develop content and to evolve to continue to better serve readers and advertisers.” “He was deeply passionate about CEG and he expected the same passion and dedication for the publications from everyone at the company,” Ted McKeon, president of Construction Equipment Guide, added. “He was like a tough coach where he thought that you could always be better today than you were yesterday. He could see potential in us and all CEG team members that we couldn’t always see in ourselves. He knew what he wanted and it was a pleasure to help him achieve those things. “Among his most important achievements was that he founded and built CEG on relationships,” McKeon added. “And this principle remains as vital today as it did back in 1958. My father’s customers became his lifelong friends. How we treat our advertisers and readers today is completely directed and influenced by how he treated people … with respect and gratitude. Everyone at CEG will greatly miss him.” Mr. McKeon is survived by his five children, Pamela (Michael) McDonald, Edwin (Peggy) McKeon Jr., Joseph McKeon, Richard McKeon and Elizabeth (Neil) Rohrer. His beloved 10 grandchildren, Christen (Brian) Meyer, Michael McDonald Jr., Caitlin (Marc) Murphy, Edwin (Caitlin) McKeon III, Joseph “Tripp” McKeon, Kayla and Lindsey Rohrer, Elinor, Katherine and Susan McKeon. His cherished four great grandchildren, Patrick and William Meyer, Harrison and Beau Murphy. His two brothers Thomas (Madeleine) McKeon and Barry (Maria) McKeon, survive him. He was preceded in death by his sister, Mary Ellen McKeon Harvey. A funeral Mass was held at St. Philip Neri Catholic Church in Lafayette Hill, Pa. Interment followed at Holy Sepulcher Cemetery. In lieu of flowers, memorial contributions may be made in Mr. McKeon’s memory to St. Joseph’s Preparatory School, 1733 W. Girard Ave., Philadelphia, PA 19130. CEG

Will You Be Left Holding the Bag? OSHA Specifies Contractor Safety Responsibilities On Job Site By Lucy Perry CEG CORRESPONDENT
Who does OSHA look to first when multiple contractors are at work on a job site where safety is called into question? If your company has any control over the work process, the agency’s Multi-Employer Worksite Policy specifies that the responsibility likely falls on you. Have you done everything you could to prevent an accident? OSHA uses the policy to assess responsibility on a construction site where there are likely many different companies at many different contract levels. The four employer categories are creating contractor, exposing contractor, fixing contractor and controlling contractor. As the name implies, the creating contractor creates a hazard resulting in an incident or accident. The exposing contractor puts his or her employees in harm’s way whether they created the hazard or not. The fixing contractor, who may or may not be the creating contractor, is responsible for fixing the safety violation. Finally, the controlling contractor holds contracts with and has authority over the contractors on site. “An exception may come when a creating contractor has already demobilized from the site, and the correction of a hazard has been assigned to another entity,” said John Braun, CEO of EHS consulting firm Signature Safety. He gives as an example a steel erection company which has left the site with perimeter cables in poor condition but a concrete company has been contractually obligated to maintain the cables. “The controlling contractor is the one that needs attention here,” said Braun. “If they are not exerting enough control over their contractors, OSHA can and most likely will cite them for their inaction.” How much control is enough is certainly up for interpretation, he said. “Control is one of the most hotly contested points of clarification I’ve seen in expert-witness cases.” What is the Multi-Employer Worksite Policy? Did the

general contractor or construction manager perform enough inspections? Did they provide any training or, at the very least, ensure that proper training had been conducted? Did they clearly communicate expectations? Did they even do any prequalification of their contractors? “Questions like these will be considered when determining how responsible the controlling contractor is. You need to be asking yourself if you are responsible, what can you do to ensure your contractors’ safety is up to par,” continued Braun. While creating, exposing and correcting employers may have clear responsibilities to prevent hazards, the standards for controlling employers are more confusing, said Stan Liang, health and safety consultant of Tetra Tech. “But controlling employers also carry a higher responsibility for compliance, so it’s important to understand what a controlling employer’s obligations are.” To determine whether a controlling employer is subject to citations under OSHA’s MECP, it must be determined if the actions of the employer were enough to meet its obligations. OSHA expects controlling employers to exercise “reasonable care” to prevent hazards, including inspections of the work site, noted Liang. “How often the employer should be inspecting the workplace is determined by many factors: the nature of the work being performed, the scale of the project, what the employer knows about the potential hazards and what the employer knows about the safety practices of the other employers at the site,” he said. “For example, if a subcontractor is known to have a history of frequent safety violations, it is expected that the controlling employer will perform more frequent worksite inspections.” Failing to exercise reasonable care to prevent safety violations could cause the controlling employer to receive an OSHA violation, even if they did not directly cause the hazard, he stressed. see OSHA page 68

New Tech Helps Paragon Site Solutions Increase Efficiency Paragon Site Solutions LLC — a full grading and site work contracting company for the Charlotte, N.C., area. — is currently completing work at the Bretagne subdivision. It will take the site from first cut to final grade. “The Bretagne project is right in our wheelhouse,” noted Stephen McCarthy, managing member. “We have self-performed every aspect of the project, except for clearing the vegetation and installing the silt fence. The biggest challenge we’ve run into with residential projects like Bretagne are the continually shorter schedules to complete the job. “At the end of the day, we’re in the customer service business,” added McCarthy. “To meet the shorter schedules and keep our clients happy, we continually search for new ways to increase our efficiency. One way we’ve been able to do that is through the addition of Komatsu dozers with integrated GPS technology.” Paragon Site Solutions’ fleet of Komatsu intelligent Machine Control (iMC) equipment includes D51PXi-24 and D65 dozers. It also utilizes multiple Komatsu D61 dozers, Komatsu excavators ranging from the PC30 to the PC490LC-11, and multiple HAMM rollers. “The D61 is the most popular dozer in our fleet,” McCarthy said. The balance and weight of the machine, hydrostatic drive, slanted nose, and GPS precision allow our operators to use the dozer for bulk earthmoving and fine grading. “We try to keep a minimum of two dozers equipped with GPS technology on each of our active projects,” he continued. “The GPS technology allows our operators to fine grade from the earliest stages of the rough grading process. That means we’re able to cut our pads to grade while mass bulk dirt moving, and take roads to finish grade in anticipation of the next crew coming in and working on top of it.” When it comes to bulk earthmoving, Paragon Site Solutions relies on its Komatsu PC490LC-11 excavator.

“The PC490 is part of our production earthmoving and grading crews,” commented McCarthy. “We have to move 5,000 to 7,000 cubic yards of dirt a day. The parts and service departments at Linder have been exceptional as well. Their service techs work around our schedule to perform routine maintenance without interrupting our production.” Empower Employees While McCarthy says Paragon Site Solutions doesn’t necessarily need to expand, internal company growth is encour-

He believes in efficiency in every part of the business, from the machines to the management structure. “Middle management is the bane of our existence,” stated McCarthy. “We try to limit it and empower our people to grow within the company. It’s important that everyone understands that we’re all equal regardless of what paycheck you make. There’s no one that’s too good for a shovel. There’s nothing that prevents anyone that’s using a shovel today from running this company tomorrow if you show the aptitude to do it. Central N.C. to Become Home to $1.2B Lithium Battery Plant Toyota USA will invest $1.2 billion into a new automotive battery plant in central North Carolina — a project that amounts to the largest capital investment in state history. The company plans to produce enough traction batteries from the factory each year to power up to 1.2 million vehicles. The lithium battery manufacturing plant will be built at the 1,800-acre Greensboro-Randolph Megasite, in Randolph County near U.S. Highway 421, and become known as Toyota Battery Manufacturing, North Carolina (TBMNC). Gov. Roy Cooper formally welcomed Toyota at a Dec. 6 news conference. “It’s tremendous that Toyota has selected North Carolina for such an important part of its electric vehicle future, creating good-paying jobs and moving us toward a healthier environment,” he said. “It’s clear the world is beginning to embrace a clean energy future and today’s decision puts North Carolina front and center.” Electric vehicles account for nearly 25 percent of Toyota’s sales volume, according to HotCars, an online news service, and the company estimates that number will increase to 70 percent by 2030. “The future of mobility is electrification, and the Greensboro-Randolph Megasite is the ideal location to make that future a reality,” noted Ted Ogawa, CEO of Toyota Motor North America. “North Carolina offers the right conditions for this investment, including the infrastructure, highquality education system, access to a diverse and skilled workforce and a welcoming environment for doing business.”
Earlier in the fall, the automaker said it would invest approximately $3.4 billion in automotive batteries in the United States through 2030. Specifically, the investment is for developing and localizing automotive battery production, including those for battery electric vehicles, and is part of the global total of approximately $13.5 billion set aside for investment in battery development and production announced in November by Toyota. North Caroliina will reimburse Toyota for up to $79.1 million over 20 years, and if the automaker invests the full $3.4 billion it could receive up to an estimated $315 million. The new plant is slated to start production in 2025 and lead to the creation of 1,750 jobs, reported WTVD-TV in Durham. The factory will produce batteries for every hybrid and electric vehicle in Toyota’s inventory. TBMNC will have four production lines, each capable of delivering enough lithium-ion batteries for 200,000 vehicles — with the aim of expanding to at least six production lines for a combined total of up to 1.2 million vehicles per year, according to HotCars. In addition, as the company continues its efforts to reduce the carbon footprint of its vehicles and operations by 2050, Toyota will be using 100 percent renewable energy at this new facility to produce the batteries. Selection of North Carolina Is Significant for Toyota The North Carolina Department of Commerce coordinated the state’s recruitment of Toyota’s new battery plant, which involved an extensive network of state, regional and local organizations. “Toyota’s commitment to establish its North America clean energy efforts in North Carolina shows that preparation pays off enormously,” said State Commerce Secretary Machelle Baker Sanders on Dec. 6. “The hard work of preparing any site for business development involves not just moving dirt and laying infrastructure but investing in education, workforce development and the collaborative networks that pull resources together. I’m proud of the people and organizations that have worked closely together over many years to make today’s announcement possible.” The automaker’s selection of North Carolina for its battery manufacturing plant is significant
for several reasons, including its proximity to its vehicle manufacturing plants in places such as Missouri, Kentucky, Indiana, Alabama and Texas. The Tar Heel State also is home to several lithium mines in the near west, which given recent global supply chain issues, creates a direct line between the raw material and a manufacturing plant. Toyota’s project is estimated to grow North Carolina’s economy by at least $9.5 billion over 20 years, state officials said, the period when the grant’s first phase could be active. Salaries for the new jobs at the battery plant will vary by position but will average $62,234, increasing the regional payroll by more than $100 million every year. Randolph County’s overall average annual wage is currently $37,865. Both State, Automaker Seem Happy North Carolina House Speaker Tim Moore lauded the collaborative effort to bring Toyota to the state’s central region. “North Carolina consistently ranks as the nation’s top state business climate,” he said. “We have a balanced budget, have invested in a strong workforce and we’ve maintained a AAA credit rating. As [the state] continues to grow, Toyota’s investment is a sign that we are doing the right things to attract people and businesses to our thriving state.” Piedmont Triad Partnership CEO Stan Kelly told WTVD that there were many “leaders behind this win,” but gave special mention to former Greensboro Mayor Jim Melvin. “I’ve said, ‘A win for one is a win for all,’ and today, thanks to the hard work, collaboration and persistence of leaders like Jim Melvin, our entire region and state wins,” Kelly remarked. “Successful regions invest in themselves for long-range, transformational growth and this announcement is the result of hundreds of leaders and millions of dollars invested with confidence in the Carolina Core’s manufacturing excellence.” He added that Toyota’s announcement builds on the “significant momentum” of more than 20,000 new jobs added in the region since 2018. The so-called Carolina Core is a more than 120-mi.-long stretch of central North Carolina from west of WinstonSalem running east-southeast to Fayetteville and is defined by state economic leaders as an area built by the assets that make the state’s mid-section a globally competitive market. WTVD reported that it includes a talent pool of more than two million people, several prestigious colleges, universities and urban research parks, as well as four certified industrial megasites.

Louisiana Agency Begins Dredging for New Marsh Project The Louisiana Coastal Protection and Restoration Authority (CPRA) announced Dec. 2 that it had started dredging activities on the Cameron Meadows Marsh Creation and Terracing Project. The restoration work will take place northwest of Holly Beach in Cameron Parish and see the addition of 308 acres of marsh by pumping in 1.9 million cu. yds. of sediment from the Gulf of Mexico. The agency aims to address the loss of a large area of marsh because of subsidence, saltwater surge from Hurricane Rita and other storms, excessive drought, and saltwater retention due to silted-in canals which prohibited adequate drainage, according to a news release from CPRA. “Large scale marsh creation plays an integral role in our state’s multiple lines of defense strategy,” CPRA Chairman Chip Kline said in the statement. “The Cameron Meadows project will fortify the natural buffer that protects southwest Louisiana from storm surge while restoring hundreds of acres of coastal marsh habitat lost due to hurricanes and other factors.” The $32 million project is funded by the Coastal Wetlands Planning, Protection and Restoration Act (CWPPRA) and is a joint effort by CPRA and the federal sponsor, the
National Oceanic and Atmospheric Administration (NOAA). “We are excited to get dredging started on another project in southwest Louisiana,” noted CPRA Executive Director Bren Haase. “The project will restore critical habitat for fish, wildlife, and the people and communities who depend on those resources.” The project’s first phase, involving the construction of earthen terraces 12,150 ft. in
length, was completed in June, according to CPRA. The terraces serve to reduce wave erosion and allow sediment deposition for land building. The collaboration between local, state and federal entities in bringing the project to construction was greeted as welcome news by Laurie Cormier, coastal zone manager of the Calcasieu Parish Police Jury. “After the four federal declared disasters

Felling Enhances Fender Design for EZ-Tilt Trailers Felling Trailers has released an enhanced fender design for its ground-level loading, EZ-Tilt trailers. The new EZ-Tilt fender design offers a similar profile to Felling’s drop deck equipment trailer fenders, opening from the top to allow clearance for the wheels when the trailers in lowered to the loading position. The mechanism for lifting the top of the fender is the wheels/tires themselves. As the axles (rotating torsion axles) rotate, lowering the tilt bed to the ground, the wheels/tires push up against the top of the fender, lifting it and providing the needed clearance. Sand, Gravel Wash Plant Offers All-Star Solution for Ala. Biz When commissioned, the new wash plant, which features CDE’s M2500 and CFCU technology, will process natural sand and gravel raw feed material at a rate of 250 tph, producing six in-spec products, including three grades of washed gravel and three washed sand products for the construction and golf industries.
All Star Sand & Gravel, a family-owned and operated business based in Winfield, Ala., has announced plans for the development of a new CDE wet processing solution for its sand and gravel pit in Marion County. Established in 2017, All Star Sand & Gravel, co-owned by Richard Jones and his father, Roger, was incorporated into the family business to supply a range of sand and gravel for its construction activities in the Greater Birmingham metropolitan area and neighboring counties. This mine site is situated in an older pit that processed a natural river deposit. All Star Sand & Gravel acquired the pit as the family business sought to integrate into its operations a consistent and reliable supply of construction materials. When commissioned, the new wash plant, which features CDE’s M2500 and CFCU technology, will process natural sand and gravel raw feed material at a rate of 250 tph, producing six in-spec products, including three grades of washed gravel and three washed sand products for the construction and golf industries. While much of its sand and gravel output will supply the family construction business, the plant also will generate new revenue streams as the business begins producing highquality washed construction aggregates and graded golf bunker sand.
To date, the family construction business has used dry screened products processed by the family business and other local suppliers operating traditional sand and gravel processing plants. All Star Sand & Gravel Co-Owner Richard Jones said the development of this natural deposit marks the beginning of a new era for the business. “We knew the raw materials in the deposit had enormous potential. Historically, we have purchased — and produced — construction materials processed with traditional dry screening equipment. For this mine we wanted to also have high-quality washed and approved products to open new high-end markets.” A modern solution, he explained, was required to maximize the potential of the extracted materials. “We could achieve the same specification of any dry screened product available in the local market, we knew that. However, by washing the product we could offer sand and gravel products that were of a superior quality while simultaneously maximizing material retention and our reserves. “We explored another wet processing plant, but [it] did not have the washing expertise we needed to produce both construction aggregates and golf course sand. After a long discovery and decision process we decided to partner with
CDE. Metso Outotec Eliminates Process Water During Screening Metso Outotec will supply unique sustainable screening technology for an iron ore project in the Southern Hemisphere. The order value, which is not disclosed, has been booked in Minerals segment’s Q3 2021 orders received. The start-up of the project is scheduled for the first half of 2024. The order for the product screening and scalping application covers 12 Metso Outotec BSE Series (Banana Screen Elliptical) tandem screens and 4 MF Series screens, all equipped with 305PS screening media. Rubble Master Ramps Up Its North American Strategy After nearly 20 years in the North American market, an Austrian manufacturer of material processing equipment appears poised to step it up a notch. With a new managing director for the Americas and a recently opened retail location in Texas, Rubble Master expects to make waves in the North American crushing and screening space. Jackson McAdam, a former CAT Power Systems executive, was recently hired to head up the company’s sales and operations in the United States and Canada. Strategic Planning After a lengthy COVID-19-related delay in Europe, McAdam arrived in the United States in April. Previously he held positions with Caterpillar and Caterpillar dealers in both New Zealand and Ireland. He also served seven years as Power Systems director of the Cat dealer in the Russian Far East. McAdam said Rubble Master’s current strategy in the United States began taking

a full line of equipment for the first time. “Once we became a full-line supplier, we needed to look at our distribution,” McAdam said. He added that their analysis showed that Rubble Master had developed a fairly strong distribution network on the East Coast of the United States, had made some progress on the West Coast, but had little or no business in mid-America. “Further analysis showed that Texas was by far the most active market in the U.S. for both crushing and screening,” he said. “From that, we arrived at Texas being the center of our operations for North America.” The new retail facility, located in Ennis — just outside Dallas — will serve customers in Texas on a direct basis. In addition to this, the company will continue to expand its dealer base throughout the rest of the United States and Canada. Whole New Ballgame “Previously we had a very grassroots approach in terms of distribution. Now, as we have evolved into a strong full-line supplier, we are seeing interest grow from major dealers around the country.” Some of those new “major dealers” that have taken on the Rubble Master line include Century Equipment, a Case dealer in the Rocky Mountain region based in Salt Lake City, and James River Equipment, a John
Deere dealer with branches in Virginia and West Virginia. McAdam said he expects the network expansion to be at the rate of about two to three dealers per year. “Word is getting out,” he said. “We are now offering the tools that other major suppliers offer, like floor planning and other dealer incentives.” In addition to an overhaul of the distribution network, the company is focusing on the supply side as part of what the company calls its “localization project.” This means that in addition to the current system where parts are available on an overnight basis from the company’s parts hub in Memphis, by mid 2022, key parts will be manufactured in the United States. Putting Waste to Work Part of Rubble Master’s mission is education. McAdam said there are many contractors not currently recycling materials and missing the opportunity to make money in doing so. “There is so much recyclable product out there waiting to be processed,” he said. “In many cases, it is a matter of education. We’ve seen that some contractors have enough material in their yard to justify the cost of a machine. Not only can they then process their own product but they can go on to make more money processing materials for others.”

Specifically, it will merge production and assembly functions from one factory into two, simplifying workflow processes, increasing efficiency and reducing logistics costs, the company said. Choi Cheol-gun, CEO of HCE and a production expert in the area of construction equipment who also heads Hyundai Heavy Industries Group’s Global Production Innovation Center, recently declared the necessity of improving the efficiency of the Ulsan facility and set out to execute a plan to create both synergy and friendly competition with Hyundai Doosan Infracore.
Choi said, “Strengthening the competitiveness of the Ulsan factory is the first challenge that needs to be addressed to reach the global top five,” a stated goal of the construction equipment division of Hyundai Heavy Industries. “With this investment, we will further raise our brand competitiveness by producing and delivering construction equipment with increased efficiency.” New Production Facilities to Reflect ESG Factors Additionally, Hyundai Construction Equipment plans to reflect ESG (Environmental, Social and Governance) factors, through measures such as the use of eco-friendly sub-materials in interior and exterior finish work and configuring production lines in a way that further improves worker safety. This is in keeping with completion of construction last November, at a cost of $65 million, of HCE’s technology innovation center. With 16 laboratories employing 100 researchers, the center will execute research and development projects focused on ecofriendly technologies, energy efficiency and noise reduction. activity and analyze operational efficiencies in near real time. Reports generated by Smart Construction Field can track daily job site conditions and task progress can be broken down by labor, equipment and materials, including machine utilization and fuel distribution, receipts, timecards and subcontractor work. Regardless of equipment brand, Smart
Construction Field can collect machine data from an entire fleet. Smart Construction Drone Collecting accurate topography is easy with Komatsu’s Smart Construction Drone survey technology. This drone solution captures quantities for production tracking and billing, without personnel walking the job
site to do a manual survey. Contractors can gather and analyze data throughout each project phase with topographic surveys that incorporate hundreds of thousands of data points. Ask the Right Questions When it comes to best practices, it matters not which category of responsibility you fall under on the job site. Regardless of whether you are the general contractor or a subcontractor, there are steps you can take to improve your safety program. As Braun sees it, managing contractors is “exponentially more straightforward” if you hire contractors with a solid track record for safety. That starts at the prequalification stage. Requiring a contractor’s health and safety plan, OSHA logs and experience modification rate is a good approach to the prequalification process, said Braun. “In addition, you can check OSHA’s website to see if the contractor has incurred any fines and citations from OSHA.” Make sure this information is reviewed by someone who knows what to look for, he said, adding “not all incidents and citations are created equally.” The reviewer should know the difference between a de minimus and a serious violation, should check the frequency and severity of a company’s incident record in relation to its safety performance, for instance. “In addition, if you know other companies who have used these contractors in the past, ask about them,” said Braun. Did they perform safely? How was management support for the safety program? Did the company seem to have a safety culture? Did they use well-kept equipment or old, beat-up stuff? “Try to get a big-picture overview of the company rather than a one-off experience.” Next, make sure the contractors and subs you work with know what you expect from them. Even before work commences there are opportunities to spell it out, said Braun. Bid documents should make clear what you want how they expect to meet safety responsibilities. This will give the subcontractor ample time to price necessary equipment and staff to perform work properly on your job, he added. “Once you’ve decided to award the bid to a company, the contract should also include what you expect their safety responsibilities to be. This goes beyond just saying that they must meet OSHA requirements,” said Braun. Are there areas in the job site where going above and beyond OSHA will be necessary? Are there disciplinary policies that they need to know? What are the drug and alcohol screening requirements for the job? “None of this should come as a surprise to your contractor,” said Braun. “But if it does and you had it in the documents, then that’s

on them.” Finally, you should explicitly require all certification and training documentation relevant to the project. For instance, will they be operating aerial lifts? Get training records. Forklifts? Get their licenses. Working on excavation sites? Do they have excavation training? “Also, have your contractor name — in writing — who their competent person will be and justify that designation by submitting that person’s background to you,” he said. “To think that this information will then make it down to the boots on the ground is optimistic at best,” he stressed. “Before the workers step foot on-site, you should ensure that they go through an orientation that clearly lays out what you expect of them.” According to Braun, that orientation should include safety requirements, disciplinary policies, drug and alcohol policies and everything else you addressed at the contract level relevant to the workforce.
“Don’t hesitate to hang conspicuous signs that emphasize some more important points. If your orientation is a checklist or a speech delivered by a disinterested party, you’re squandering an opportunity to set the tone for the project.” Never Assume Anything Maintain some level of oversight. That’s not to say you have to oversee contractors and subs every minute of every day, said Braun. Periodic observation of the job site is key, he believes. Notify the contractor, in writing, of any violations and tell them when you expect them to be fixed, he suggested. Have them reply, in writing, when they are taking care of the issues and verify it. Spot check who is operating equipment and match that up to the records you have on file. Are the contractors diligent about their people being qualified to do what they are being asked to do? “The process of observing your contrac-
tors runs the length of the project,” he said. One final note from Braun: “Don’t be an enabler.” A company that performs poorly from a safety perspective is bound to get somebody hurt or killed eventually, he said. “If a contractor refuses to get on board, the worst thing you could do is reinforce their unsafe behavior by awarding them further work. Make it clear that putting their workers at risk is unacceptable, and you will have no part in it.” And remember, your primary goal is to keep everyone from getting hurt on your project. “But if somebody does, you want to be confident that you have done everything you could to prevent it,” he added. If you are a controlling employer of a worksite, you will want to be careful about which subcontractors you hire, be intentional about the safety practices you enforce at your worksite and perform frequent inspections, concluded Liang. “Making sure your safety program prevents workplace hazards to avoid OSHA citations can include many different actions including safety training, discussing safety with other site employers in advance and having a clear system for reporting hazards.” If you are a subcontractor at a site, make sure you meet all safety requirements and make reasonable efforts to prevent your employees from being exposed to hazards, stressed Liang. “Even if they are not hazards you created, you will also want to make sure you do not create hazards for employees of other employers at the site.” CEG
