On July 9 officials in Nashville, Tenn., broke ground on Phase II of the Interstate 40 White Bridge Road Interchange Improvement Project. Phase I was finished during the summer 2005. Since then, the project has been stalled for four years because of lack of funding. Now, the $32million project is being totally funded through money from the American Recovery and Reinvestment Act of 2009, which the President signed into law in February. Many dignitaries, including Gov. Phil Bredesen and Tennessee Department of Transportation (TDOT) Commissioner Gerald Nicely, were on hand for the groundbreaking ceremony. “This project will enhance Nashville’s already excellent transportation system,” said Bredesen at the ceremony. “It will improve access to Interstate 40 and Briley Parkway and will contribute to continued economic development in West Nashville.”

Bell & Associates Construction is the prime contractor for the $32 million project. The company has all-terrain cranes by Lorain hard at work on the job site.

The contract also includes construction of two flyover ramps to and from I-40 and Briley Parkway, plus the replacement of the White Bridge Road Bridge over I-40. In addition, three noise barriers and five retaining walls will be built and a pedestrian bridge located just west of the interchange will be replaced. “The project is just over a mile long,” explained Jeremy Mitchell, project manager with Bell & Associates. There will be “three lanes west and three lanes east on I-40 and two auxiliary lanes for the new ramps.” The Interstate will be constructed of asphalt, and the ramps will be concrete paving. There will be more than 20,000 cu. yds. (15,200 cu. m) of concrete used on this project. The two major bridges being built are the White Bridge Road Bridge and the pedestrian bridge. The White Bridge Road Bridge, measuring just over 1,500 ft. (457 m) long, is being constructed of single-column hammerhead piers and structural steel plate girders. The pedestrian bridge is approximately 230 ft. (70 m) long and see TDOT page 40

Florida’s go-slow approach to spending federal recovery money earmarked for highway projects and schools. Even so, Florida’s overall stimulus spending is a bit ahead of schedule, said czar Don Winstead, whose official title is special adviser to the governor on economic stimulus. Federal officials in February said they expected the state to spend about 20 percent of its estimated $15 billion in stimulus money by the end of September. “I think we will be ahead of that sched-

ule,’’ Winstead said. “We are seeing rapid deployment and we’ll see over the next couple of months additional rapid deployment of some of the larger projects.’’ In letters to state lawmakers and members of Florida’s congressional delegation, Crist cited a Government Accountability Office report that focuses on stimulus spending for education, transportation and Medicaid. Winstead spoke about it in a teleconference with reporters. In August, U.S. Rep. James Oberstar, a Minnesota Democrat who chairs the House Transportation and Infrastructure Committee, sent Crist a letter chiding Florida for ranking last in spending stimulus money designated for highway projects and urged him to “refocus your efforts.’’ see STIMULUS page 22

Health care reform in the United States has been beaten nearly to death this year by advocates and critics alike. Yet as the debate moves into October, the final shape of “reform” remains elusive and elastic with construction industry executives anxious about its impact on their companies. Any change in the system definitely will have impact on contractors and a sweeping change could upend smaller firms — and most construction companies are small-to-medium-sized. Pinnacle Entertainment to Start Piling Work for $407M Sugarcane Casino LAKE CHARES, La. (AP) Pinnacle Entertainment Inc. expects to begin millions of dollars in piling work in October on a proposed $407 million Sugarcane Bay casino-resort in Lake Charles. The tropical-themed gaming complex will be built next to the L’Auberge du Lac casino-resort, and the two will be connected by a covered walkway. The state Gaming Control Board earlier this year gave Pinnacle until October to begin work on Sugarcane Bay after the company asked for a delay to wait on credit markets to get better. Kerry Andersen, a L’Auberge spokesman, said that once Sugarcane Bay is constructed Pinnacle will have a $1 billion investment in Calcasieu Parish. It also will become the second-

largest employer in the parish, with a minimum of 2,000 jobs being generated by the Sugarcane Bay project, Andersen said. “This is a result of the credit markets easing up. The contracts for the piling pole production and pile driving will go to local companies,’’ she said. “We are finalizing the contracts right now. They are well-known companies. The pile production contract is worth $6 million. We are still finalizing the pile-driving contract.’’ Andersen said Sugarcane Bay will feature a 400-room hotel with window balconies, a one-story casino riverboat, an entertainment arena, restaurants and retail outlets, and a pool area. She said it will take 18 to 24 months to construct the facility. “The new hotel is being built with expansion in mind such as we did with

our L’Auberge resort. We will be doing the same thing in the design phase of Sugarcane Bay. We are absolutely feeling optimistic about this market,’’ she said. Pinnacle is negotiating with two contractors about the Sugarcane Bay project: Manhattan Construction of Houston and Yates Construction of Mississippi. Manhattan built L’Auberge. Yates is building a casino complex for Pinnacle in St. Louis A decision will be made on the general contractor by December or January, Andersen said. Pinnacle also is building a casino in Baton Rouge. In Louisiana, Pinnacle also owns Boomtown riverboat casinos in Bossier City and the New Orleans suburb of Harvey.

Yancey Observes 95th Anniversary; Plans for Growth Past 100 The “Nation’s Oldest Caterpillar Dealer” moved one year closer to reaching the century mark when Yancey Bros. Co. celebrated its 95th birthday this year. Founded in 1914 by brothers Goodloe and Earle Yancey, Yancey Bros. Co. began as the Yancey Hardware Company, selling hardware, picks, shovels and prison uniforms (stripes) to government agencies for road construction. Machines sold and serviced by Yancey Bros. Co. were used to build the first north-to-south and east-to-west paved roads in Georgia, the first paved airports in the state, and the interstate highways that now carry billions of dollars of commerce across Georgia each day. From its first location on Peachtree Street in Atlanta, Yancey has grown to 27 machine and engine service centers across the state today. Yancey continues to build on the past and invest in the future as it approaches its 100th anniversary. “Caterpillar would like to congratulate Yancey Bros. Nortrax Holds Grand Opening of Its New Facility in Fort Myers, Fla.

ortrax held a grand opening Oct. 2 for its new facility at 3005 Hanson Street, Fort Myers, Fla., showcasing the fullservice dealership. The day’s activities included lunch, a brief program and ribbon-cutting at noon; and refreshments, music, prizes and hands-on equipment previews throughout the day. “We want Southwest Florida to know that Nortrax is here to stay,” said Dave Walsh, Nortrax general manager in Fort Myers. “We are committed to working with the area’s business community. While many dealers are struggling to stay afloat given the depressed market in Florida, Nortrax is investing in this key market. We believe in its long-term importance to Florida’s construction industry.” The new 22,630 sq-ft. Nortrax store was built adjacent to the company’s current location. “The biggest difference is in the service area,” said Walsh. “The new shop is 11,880 square feet, which is 22 percent larger than our old one. Our parts warehouse consists of a two-story rack system which effectively doubles its parts storage capacity.”

By one measure, the GAO report shows that Florida is ahead of the national average, having committed 74 percent of its $1.3 billion in highway money compared to a 68 percent national rate. But the report said Florida has lagged in getting projects going, with only 155 jobs created in June and July. The report also acknowledges, however, that Florida is focused on widening and building roads, rather than tackling quicker repaving projects, which may explain its slowness in awarding contracts. Florida has earmarked 40 percent of its highway dollars for road widening compared to 16 percent nationally, 21 percent for new roads and bridges compared to 8 percent nationally and only 17 percent for resurfacing compared to 48 percent nationally. “Florida’s emphasis on building roads and bridges is exactly the right strategy for our state and will result in more sustained economic development and more substantial job creation,’’ Crist wrote to legislators and members of Congress. Winstead said Florida’s existing roads are generally in good shape so they don’t need resurfacing but they are overcrowded. “Congestion really strangles commerce,’’

Winstead said. “This money is really focused on using those dollars in a way that is going to go specifically at the needs of our state.’’ New construction and widening projects, however, take longer to get started than resurfacing because they often require new right of way and must have environmental and other permits. Florida also has spent only 1 percent of its $2.2 billion allocation for education, compared 36 percent in 15 other states covered by the GAO report. It means Florida will be able to spread the stimulus money over two budget years — half this year and half the next — before having to find a way to replace it with state dollars. “That’s good news,’’ Winstead said. A couple other large states already have spent more than 90 percent of their education stimulus and a couple others are close behind, Winstead said. They’ll soon face what’s known as the “cliff effect’’ when the federal money suddenly runs out. Florida’s cliff won’t be so sudden or steep. “Showing great prudence and foresight, we took a different approach,’’ Crist wrote.

In monitoring and lobbying Congress for meaningful health care reform, Associated General Contractors complained as late as September about the “failure of legislation to address malpractice reform.” So far none of the health care bills have touched on the issue. Essentially, the threat of lawsuits has driven up the cost of medical care with doctors and hospitals ordering often-unnecessary procedures as protection against being sued. Reducing liability in medical practice is part of a national tort reform movement, which seeks higher legal thresholds for filing of suits and lower limits on settlements. Studies show that reforming liability rules along those lines would reduce health care costs, directly and indirectly, without barring genuine victims of medical malpractice from pursuing effective legal recourse. • Enactment of tax laws that will truly enhance reform without injuring businesses. It is difficult to stay current on health care tax proposals because they change week to week. Generally, tax laws that business executives resist are the ones that impose taxes to (1) help pay for a mandate, (2) penalize a company for not meeting mandated requirements, or (3) raise costs of a company program to prohibitive levels just to force compliance with a preferred government alternative. Such taxes generally do not increase productivity and, thus, are viewed as anti-business. Kenworth Unveils New Diesel-Electric Service Truck Kenworth Truck Company introduced its first diesel-electric hybrid truck in a service application at the recent World of Concrete Show in Las Vegas. Kenworth’s goal is to enhance fuel economy by up to 50 percent with the new Kenworth T270 hybrid service truck, which is expected to draw interest for use in various service applications in construction and other industries, according to the company. “Service applications are perfect for the hybrid due to the various onboard tools and diagnostic equipment mechanics use and the stop-and-go pace of moving from location to location to fix equipment,” said Gary Moore, Kenworth assistant general manager for marketing and sales. “Instead of idling the engine to run the crane and other equipment, a mechanic can operate them on electric power, which reduces emissions. That allows companies to go ‘green,’ helping the environment.” The Kenworth T270 hybrid is powered by a 260-hp (194 kW) PACCAR PX-6 engine, and features an integral transmission-mounted motor/generator, a frame-mounted 340-volt battery pack and a dedicated power management system. The power management system provides electricity to run a 10,000-lb. (4,536 kg) hydraulic crane. Navistar, Caterpillar Form Global Truck Joint Venture NC2 Navistar International Corporation and Caterpillar Inc. closed a joint venture transaction resulting in a new company, NC2 Global LLC, to serve the global commercial truck market. Navistar and Caterpillar first announced plans to form a joint venture in June 2008 and have identified the leadership team of the new entity that will establish its headquarters in the Chicago area. “Together, Navistar and Caterpillar have moved this project from concept to reality in little more than one year,” said Al Saltiel, president of NC2. “We now have a dedicated and experienced leadership team that will hit the ground running.” Saltiel brings a wide range of global distribution and marketing experience to NC2. As vice president of marketing and head of Navistar’s marketing efforts since 2004, Saltiel was responsible for all brand, product and pricing strategy. Prior to joining Navistar, he held key senior marketing posi-

tions at Sony Electronics, Jaguar, and Ford’s Premier Automotive Group. Key Executive Team in Place Bob Iacullo has been named chief financial officer for NC2. Events took place in the United Kingdom at Sandvik’s Swadlincote factory, a nearby hotel and a recycling facility. This event formally marked the integration and re-branding of the Extec and Fintec products lines as part of Sandvik’s product offering. The occasion also helped to create greater awareness of the Sandvik product offering throughout the United Kingdom, and to publicize the new global center of excellence that has recently been created at the former Extec factory in Swadlincote. More than a thousand visitors participated traveling from a variety of places such as Venezuela, China, Spain, Ireland, Norway and Scotland. When the Deal Started In the spring of 2007 Sandvik acquired the two manufacturers of mobile crushing and screening equipment — Extec Screens and Crushers Ltd, and Fintec Crushing and Screening Ltd. After the presentations attendees were taken to the demonstration areas, where they were able to see live-action demonstrations of the mobile screening and crushing equipment, drill rigs and breakers, in both recycling and aggregate production set-ups. The actual demonstrations included: • Quarrying demonstration of a QJ340 (C-12+) tracked jaw crusher, feeding a QH330 (F1080) tracked cone crusher, and then feeding directly into a QA450 (S-7) tracked triple deck screener. • Demolition and Recycling: with a variety of feeds showing the QE330 (F640) tracked scalper, QA330 (F542) double deck tracked screen, and a QI430 (F1440) tracked impact crusher feeding a QA440 (S-6) tracked doublescreen. A variety of materials were processed, producing differing sizes, in

order to highlight the inherent flexibility of the product range, whatever the application. In order to provide an over view of the full Sandvik product offering a static display also was in evidence. The QE440 has been developed over the last 18 months through Sandvik’s R&D program. Based on in-depth customer and market analysis, the QE440 has been developed in order to deal with real operating requirements, which traditional screening solutions are unable to adequately cater to, according to the manufacturer. Following the demonstrations, participants visited Sandvik’s Swadlincote factory, which used to be the Extec

headquarters and is now not only Sandvik’s global center of excellence for mobile crushing and screening, but also the center for mining and construction within the United Kingdom and Ireland. The visitors were treated to a light lunch and refreshments, and then given a factory tour showing the production and engineering facilities. A major point of interest proved to be the Global aftermarket center, where visitors were shown the full parts and service operation, together with the newly operational Global Customer Service Centre. Upon completion of the tour visitors were presented with opportunities to participate in interactive seminars hosted by Sandvik training specialists. John Deere’s Construction Equipment Will Use Engines With EGR Technology John Deere will use cooled exhaust gas recirculation (EGR) engines with exhaust filters consisting of a diesel oxidation catalyst/diesel particulate filter in its construction equipment to meet the 2011 Interim Tier IV (iT4)/Stage III B emissions regulations mandated by the EPA and EU for diesel engines 174 hp (130 kW) and above. “We’re looking to provide the simplest iT4 solution for equipment users, all while delivering the productivity, uptime and low daily operating costs that customers expect from Deere,” said Joe Mastanduno, product marketing manager, engines and drivetrains, for John Deere Construction & Forestry. “We believe cooled EGR with exhaust filters is the right technology right now.” Deere’s approach to the iT4 solution builds upon the current clean burning and fuel efficient Tier III/Stage III A PowerTech Plus engine platform manufactured by John Deere Power Systems. A Simpler Solution The John Deere cooled EGR engine platform for iT4 compliance is simpler, more operator friendly and less complex to maintain compared to SCR (selective catalytic reduction) systems, according to the manufacturer. “Unlike SCR, this IT4 solution doesn’t require liquid urea to achieve emissions compliance, so there are no additional fluids to worry about obtaining, filling or storing on remote job sites at proper temperatures,” Mastanduno said. “EGR is

a single-fluid solution, and that fluid is diesel fuel.” Field Proven, Fuel Efficient John Deere was the first manufacturer to widely commercialize off-highway Tier III/Stage III A cooled EGR diesel engines. Extensive testing in key products featuring these engines, such as the 350D excavator, 700J crawler dozer and the new 772G motorgrader, has shown a 10-percent or greater advantage in “material moved per fuel used.” “Our field experience also has proven that John Deere cooled EGR engines operate efficiently with traditional lowsulfur diesel fuels as well as B5 to B20 biodiesel blends,” Mastanduno said. “We’ve seen optimal performance with fuel-choice flexibility.” Total Integration and Support John Deere designs, manufactures and services the engine, drivetrain, hydraulics, electronic control unit, cooling and other vehicle systems as part of the complete equipment package. Port of New Orleans Sells Off Land, Clears Way for Private Job NEW ORLEANS (AP) The Port of New Orleans has sold 27 acres in surplus property, clearing the way for a $10 million private project. France Road Parkway Properties will begin building a 150,000-sq.-ft. corporate office and warehouse for New Orleans-based Transportation Consultants Inc. Port officials said the project will help the port in building the necessary logistical infrastructure to retain and attract new international trade. Construction is expected to be complete in June 2010. Officials said the project will retain and create 150 jobs over the next three years.

Stimulus Funding Reinstates Work on Stalled Project

One of the most-anticipated Phase II improvements will be putting to use a concrete bridge pier that has stood near I-40 since Phase I was finished in 2005. The structure will finally be used to support one of the flyover ramps.

will be built using bulb-tee beams with a concrete deck and an architectural steel fence along both sides of the bridge. “This bridge provides access from a residential neighborhood across six lanes of I-40 to a commercial neighborhood,” Mitchell stated. So far, progress on Phase II consists of work on the bridge substructure, drilling and blasting and mass excavation. Roughly 200,000 cu. yds. (152,000 cu. m) of earthmoving will be performed. Of that, about 170,000 cu. yds. (129,200 cu. m) will be hauled off site. Furthermore, water, sanitary sewer and storm sewer work is moving ahead. Soon, the contractor will begin constructing the retaining walls and the sound absorptive noise barriers. Beam erection also will start before long.

Bell & Associates is self-performing approximately 40 percent of the work and there are close to 30 subcontractors on the job site. Sunrise Contracting Inc., LaVergne, Tenn., is performing the grading and LoJac Enterprises Inc., Lebanon, Tenn., was hired to complete the asphalt and concrete paving. According to Mitchell, various pieces of equipment are being used on the project. On hand are all-terrain cranes by Lorain and Terex. There are Cat trackhoes consisting of a Cat 330, Cat 314 zero tailswing and a Cat 321 zero tailswing with quick couplers. Additional trackhoes include the Volvo 330 and 360 plus the Hitachi EX270 and EX135. Cat dozers on site consist of a D8T, D6R, D5 and D3. Morbark 1200 tub grinders are being used as well as Topcon machine control GPS. The project’s scheduled comple-

tion date is summer 2011. As a result of the Phase II project, traffic flow will improve in the area, and the bridge will be a safer, more modern structure. The flyover ramps will help ease congestion along White Bridge Road. What’s more, the noise barriers will improve quality of life by providing peace and quiet for residents and businesses alike along this stretch of I-40, according to the developers. Individual Health Plans More Useful for Transient Industry REFORM from page 24

viewed as business-friendly. The construction industry generally deems the tax proposals contained in current health care bills to be unfriendly. While the aforementioned features of a new system can be shown to measurably benefit construction companies and employees, other features in the reform debate are rooted more in political philosophy than in medical processes or good business practice. One such feature is the so-called “public option.” Supporters of it argue that letting the government compete with private sector insurers in offering insurance will force the insurance industry to offer better deals. They believe true reform will not occur unless government is allowed to compete. Opponents respond that when government enters the marketplace, private sector competitors are automatically disadvantaged despite inherent government inefficiencies and bureaucracy. That’s because when government sets rules and also plays the game, the outcome invariably favors government; after all, if things go badly for government, the rules always can be changed. The same philosophical divide is evident in discussions about other mandates in the reform bills. These include the “pay or play” stipulation, whereby companies either will

offer their employees insurance as ordered by government or will pay an 8 percent payroll tax. Opponents of the tax insist it is regressive and will hurt lower income employees the most, inducing job losses. Other mandates under active consideration would force insurance companies to offer health coverage to anyone who wants it regardless of an individual’s health — without regard to actuarial risk assessments, in other words — and to offer the insurance at uniform cost to employees regardless of the actual state of health of individual applicants. Critics note that such rules of coverage totally disregard the question of cost, both to companies and to the country. Consequently, the almost guaranteed results are job losses, crippling financial burdens for companies and runaway federal deficits. Supporters of unrestricted universal coverage, on the other hand, insist that the true budgetary impact of reform will be minimal. Taking the negative view on the mandates is the Construction Industry Round Table. In a late September statement, the consortium of 100 CEOs across the United States declared that “there is no question that the types of ‘reform’ being discussed are filled with mandates on insurance companies and employers, all of which will drive up the cost of insurance for companies that purchase

policies for their employees.” The latest congressional offering is a Senate compromise bill from a committee chaired by Sen. Max Baucus. Calling it a “good faith effort” and the “best effort to date,” the U.S. Chamber of Commerce still finds it an unacceptable reform vehicle, largely because of tax components. “We have grave concerns over the vast array of new taxes contained in the bill,” the Chamber said in part. “This bill creates a new tax on benefits that may well spiral out of control to become the next Alternative Minimum Tax. It taxes prescriptions, insurance policies, medical devices, clinics and labs … and all of these taxes will increase costs for employers and workers. The bill does not contain health courts or any other meaningful medical liability reform. Not to mention, the bill creates a massive new entitlement in the form of insurance credits that will burden taxpayers now and in the future. Overall, the bill still needs tremendous improvement.” President Obama and leaders of the majority party in Congress are pushing for passage this session of health care legislation, one way or another, probably by trimming features and combining other features of several bills until they craft a product with majority support. Their expressed sense of urgency in passing something stems from

political calculation rather than from any real crisis in health care. Passage of a reform bill this year or next year is all the same — the arc of medical costs is not shooting up that fast. But votes for the controversial legislation will be easier to cobble together in 2009 than in the election year of 2010 and passage will give a sense of forward momentum to a new presidency. Legislators who prefer to examine the details of the sweeping legislation in a more orderly way are hoping to slow what they consider a rush to enactment. They concede the need for changes in the system, but see fiscal or procedural disaster in acting in haste. Companies and business associations — including construction industry groups — continue to lobby for common sense and enduring principles in forging solutions to rising health costs. Lobbying and informing their constituencies is about all the groups can do. In the end, the decision will be made by the two Houses of Congress and businesses will be handed a new system with instructions to make it work. Jerry and Karen Cauthen of Cauthen Transport in Ocala, Fla., hoped to add this Case CK130 to their fleet. Alas, someone else bid a little bit more than they did. This CK130 excavator with 1,430 hours on it was bought for $32,000 and was going to Crossville, Tenn. Jack Lyon gets the auction started.
