

High court rules in favor of St. Timothy’s
BY NATE SCHWARTZ Country Media Inc.Medford, OR - A decision was handed down in the case of St. Timothy’s Episcopal Church (plaintiff) v. City of Brookings (defendant) this week after being heard in the US District Court in Medford. The court ruled in the church’s favor, granting a motion for summary judgment to St. Timothy’s, while denying the city’s motions for summary judgment and dismissal.
Background
The City of Brookings enacted an ordinance in late October 2021, which changed the zoning code to require conditional use permits for ‘benevolent meal service’, and restricted the frequency with which meals could be served. St. Timothy’s, which is technically located in a residential zone, was directly affected by the new ordinance.
St. Timothy’s, who have operated at 401 Fir Street in Brookings since 1953, predate the city’s original residential code and we’re therefore grandfathered in. They have provided free lunchtime meals since 2009. Then overseen by Ron Hedenskog, the meal service continued to grow during his Mayoral stint from 20122018.
The church increased the frequency of its meal service as homelessness numbers rose in Brookings. When the Covid-19 Pandemic reached Brookings, many other churches stopped serving meals. St. Timothy’s increased their meal service again to compensate, offering five to six meals a week.
In early 2021, the City issued St. Timothy’s a permit to host individuals living out of their cars on their property, as part of a City-sponsored program

Waterspout spotted off Cape Farrelo
An uncommon weather phenomenon was captured on video on Wednesday, March 27th, 2024, by multiple Curry County residents. A waterspout was spotted about a quartermile offshore at Cape Ferrelo at around 7:45 PM, and quickly reported by RogueWeather.com.
Two videos, captured by Andy Martin and Mark Unger of Curry County, show the impressive size and rotation of the waterspout. We spoke with Ryan Sandler, Warning Coordination Meteorologist for the National Weather Service branch in Medford, Oregon, to get some more information.
Waterspouts can fall into one of two categories. There are fair weather waterspouts, which form in relatively calm conditions and are generally less dangerous. The waterspout seen on Wednesday was a tornadic waterspout.
Functionally identical to a tornado, a tornadic waterspout is simply a tornado that forms over water or moves from land to water. The source of the rotation comes from up in the clouds and
works its way downward to the water. This is a tricky thing to track off-shore, as the rotations form below the zone typically detectable by radar, hence why reports of waterspouts are few and far between.
“They are a little more common on the Northern Oregon coast. I would say there may be one a year, or one every couple years, that we know about,” said Sandler on their rarity, “We don’t issue many special marine warnings. They’re unusual partly because our radar… as you get to the coast, the radar beam goes higher and higher.”
In the videos, you can clearly see the rotation originating from the upper and middle portions of the storm. The funnel descends from the dropping supercell cloud wall and is picking up water from the surface and taking it upwards. This had weather enthusiasts of the South Coast very interested.

Curry Health Network receives $2 Million to launch chemotherapy services in Curry County

Shelby Mickelson’s poignant account of the challenges she and her late husband encountered during his cancer battle left a profound impression on the delegates, with Congresswoman Hoyle, in her announcement call, specifically praising Shelby for her courage and the significant impact of her story.
If all goes as planned, construction could begin in Spring 2025. The new chemotherapy facility will adjoin Curry General Hospital in Gold Beach, with an anticipated opening in January 2026. The center will feature 8 chemotherapy chairs and clinic space for an oncologist, aiming to serve over 100 patients annually. Ballot snapshot for Curry County May
Primary
The May Primary for Oregon is quickly approaching in what is shaping up to be a divisive and contentious election cycle. In order to cut through the rhetoric and over-promising ever present in any election, here are the basics that you need to know for your Curry County primary election.
Ballots
In Oregon, no voter will see all the candidates on their ballot. Instead, the spring primary is set up to allow major political parties to nominate contenders for the General Election ballot, where pivotal positions like the presidency are decided. To cast a vote in a major party’s nominations, individuals must be registered with that party at least 21 days before the May 21st election date, which is April 30, 2024. This deadline also applies to new voter registrations for those who hope to partake in the May Primary Election. Those aligned with minor parties, or unaffiliated voters, will exclusively receive ballots for nonpartisan races.
Starting May 1st, 2024, all active registered voters in Curry County will receive their ballots via mail. For those who haven’t received their ballots by May 9th, the Elections Office can be reached at (541) 396-7610 or via email at elections@ co.coos.or.us. Additionally, voters can monitor the status of their ballots online approximately 45 days before the election at www. oregonvotes.gov/myvote.

As a result, here are 7 options you can use to start the process of getting some assistance as quickly as possible.
1. Contact your doctor: Your doctor is a great source in finding available mental health resources in your area. Explain your situation to your doctor and ask if he or she knows of anyone that can help you. Chances are your doctor will be able to give you some referrals.
2. Go to the nearest hospital: Your local hospitals can give you immediate assistance for your mental health issues. The people who work at a hospital know of other professionals in your area that can provide you with additional treatment. In addition, some hospitals may offer various mental health services that are available to the public.
3. Talk to the insurance companies: Your insurance company can provide a list of mental health services and other treatment programs that are covered in your health plan. If you do not have health insurance, you could still contact some of those companies and see if they can point you in the right direction regarding your current circumstances. There could be some affordable programs in your area that you do not know about.
4. Talk to the local churches: Your local churches may know of
programs in your area that you could go to in overcoming your anxieties and stresses. Many churches offer mental health and addiction programs that anyone can take advantage of. A priest or minister can also provide additional advice to your situation.
5. Find a support group: There are all kinds of mental health support groups that can help you with your issues. Go to a support group in your area and meet people who are also struggling with addiction and depression. A person can go on the internet or talk to some of the local mental health organizations to get more information about what is in their area.
6. Network with others: Many people have dealt with fear and anxiety sometime in their life. Talk to the people that you trust to see if they have any suggestions on where you can go for some assistance. Make sure that your friends can keep things confidential and do not get into the habit of giving out too much personal information to others.
7. Contact your local mental health organizations: There are many private, public, nonprofit, and governmental organizations that specialize in various mental health services that you can talk to for some assistance. The people at these places can give you some ideas on where you can find some mental health programs and counselors that can help you right away.

Pride-in-the-Park returns for a second year
Southern Oregon Coast Pride (SOC Pride) is returning to Brookings on June 1, 2024 for its second-annual Pride-in-the-Park celebration! The festival is hoping to bring in another large turnout and continue that enthusiasm through additional events taking place all month long.
“The park is FILLED with attendees. Last year was our first big event and drew a lot of, ‘I never thought this would happen here’ reaction from both 2SLGBTQIA+ community members and allies,” said Southern Oregon Coast Pride Director Laura Erceg.
SOC Pride is inviting the community to engage and participate in the event in multiple ways. They are seeking community members to host activity, information, and vendor tables for the festival. Contributions of in-kind goods, among other things, are also a great way to support the event according to Rev. Sister Cora Lea Rose, another of the event’s organizers.

“I think that the best way the community can help out are through sponsorships, volunteering day-of, donating in-kind goods, and of courseattending! Another important step is to commit to affirming people and being a safe and supportive adult to the young people in your life, all year long,” said Rose.

to assist the homeless community. The neighbors were not happy with this development and issued a ‘Petition to Remove Homeless from St. Timothy Church’, citing vagrancy and concerns for public safety and property value.
The sentiment toward the church seemed to turn during this period, and the City seemed to overcorrect. After ceasing the car camping program and cooperating with law enforcement during that period, the City reported the plaintiffs to several public health agencies. In response, the Church applied for and received
a license from the Oregon Health Authority to serve meals.
On October 25th, 2021, the City enacted an ordinance which created a newly required conditional use permit specifically aimed at ‘benevolent meal services’ and the ability for residentially zoned facilities to provide them. The ordinance restricted meal service to two days a week.
The Suit
In January, 2022, the plaintiffs filed a suit against the City claiming the ordinance as unlawful and requesting an injunction against its enforcement. The plaintiffs invoked the Religious Land Use and Institutionalized Persons
Act of 2000 (RLUIPA) and the First Amendment of the Constitution.
Following a long period of discovery, both the plaintiff and defendant filed motions for summary judgement, meaning they both aimed to have the Court rule in their favor without need for trial, with the decision made based on the evidence already submitted.
Based on this information, the Court decided to grant summary judgement to the plaintiff, and denying it for the defendant. This is a comprehensive victory for St. Timothy’s. The Court explained its decision in a release on March 27, 2023.
“As a preliminary matter, there can be no genuine question that St.
Timothy’s feeding ministry is a sincerely held religious belief… as a general, practical matter, feeding the hungry and caring for the most vulnerable members of a community is at the very heart and foundation of the Christian tradition,” stated the Court, alongside citations from the bible supporting this statement.
The legal basis for the decision was that the City’s ordinance violated RLUIPA, stating that the ordinance greatly burdens the plaintiff in exercising its religion, and does not serve a compelling government interest.
“RLUIPA prohibits the government from implementing a land use regulation that imposes a substantial burden on religious exercise unless

Redwoods and after a short courtship they married on May 26, 1989. Together they raised their girls, Amber and Ashley.
In 1999, Jerry moved to Nevada and after a lifelong career as a heavy equipment operator he retired in July 2013. In 2017, Jerry and Pamela moved back to the coast where they were active in their church and enjoying spending time with their children and grandchildren. Jerry could once again be found with their dogs, Georgi and Rogue fishing in the river or enjoying a walk on the beach. Jerry thoroughly enjoyed retirement and living so close to his daughters and their families.
Jerry is survived by his mother Valerie; his wife Pamela; his brother Mike; his sisters Jeannie (Don) and Suzie (Dan); his daughters Amber (Alan) and Ashley (Jerimiah); his granddaughters Emily (Taylor), Aubrey, Lindsay, Madison, Alexa, Ruby, and his grandsons Aidin and Jace. Jerry was preceded in death by his son and father.



A celebration of life service will be held on April 6th, 2024, at 3 p.m. at the Brookings Church of the Nazarene, 1600 Chetco Avenue Brookings, Oregon. There will be food and refreshments immediately following the service. Purple was Jerry’s favorite color, so please come and support the family wearing your favorite purple attire.
















the government can show that the regulation is the least restrictive means of achieving a compelling governmental interest,” stated the Court’s decision.
The Court continued to describe why the City’s claims were not seen as substantive enough. The City claimed that protecting public welfare and preventing crime should serve as ‘compelling government interest’, yet never specified how restricting meal service would accomplish this interest in practice.
The Court also cited the fact that the city had not tried to restrict the meal service of other nonsingle-family residential facilities that serve public meals (golf courses, day
cares, hospitals, etc).
This indicated to the Court that this ordinance was specifically targeted toward St. Timothy’s, despite the fact they had conducted meal service for over a decade with City knowledge.
Conclusion With US Judge Mark D Clarke presiding, St Timothy’s convincingly retained its right to religious land use, and its ability to continue meal service. Clarke stated that Brookings is ‘very fortunate’ to have Reverand Lindley their congregation in the community.
“The clergy and the congregation at St. Timothy’s have shown that they have been prepared to work with the City to care for those in need, and at the same time preserve the livability of the area for their neighbors by cooperating with law enforcement when necessary. The homeless are not ‘vagrants,’ but are citizens in need. This is a time for collaboration, not ill-conceived ordinances that restrict care and resources for vulnerable people in our communities,” stated Clarke in conclusion.
The question remains as to why the folks at City Hall thought this was a hill worth dying on. Surely the time and resources that went into restricting religious charity could have been better allocated toward actually attempting to abate the issue of homelessness in Brookings, rather than arbitrarily restricting their access to crucial services.

Kotek’s wife gets aide, office space as governor considers creating ‘Office of the First Spouse’
BY JULIA SHUMWAY Oregon Capital ChronicleGov. Tina Kotek is hiring a temporary aide to assist her wife, Aimee Kotek Wilson, as the governor considers expanding Kotek Wilson’s role and creating a new “Office of the First Spouse.”
Kotek spokeswoman Elisabeth Shepard confirmed that Meliah Masiba, the legislative director for the Department of Administrative Services, joined the governor’s office on a six-month rotation that began Monday. Masiba will explore creating the new office and “assist and support the current first spouse in her official capacity in support of the administration,” according to the governor’s office. Kotek’s plan, first reported by Willamette Week, comes as three top staffers left the governor’s office, departures some sources speculated were due to conflicts with Kotek Wilson. The governor’s office has declined to say why Chief of Staff Andrea Cooper, Deputy Chief of Staff Lindsey O’Brien and special adviser Abby Tibbs are leaving the office and have not yet turned over public records requested by the Capital Chronicle that could provide clarity. Shepard said Monday the three employees have not turned in resignation letters.
Cooper will leave Friday. Tibbs, a longtime lobbyist for Oregon Health & Science University, will return to the university on Sunday. O’Brien will go on leave April 5, and the governor’s office declined to say Friday whether O’Brien will return from that leave.
The governor’s office will pay Masiba her DAS salary of $11,984 per month, or nearly $72,000 for her six months in the governor’s office. She’ll report to acting Chief of Staff Chris Warner.
One of her first tasks will be joining Kotek Wilson at the National Governors’ Association’s annual first spouses retreat, which will be held in Salt Lake City Tuesday and Wednesday.
Mary Rowinski, the state employee who manages Mahonia Hall, will also attend, as will officers from Oregon State Police’s Dignitary Protection Unit. The association will pay for Kotek Wilson’s travel and lodging and reimburse most costs for state staff, according to the governor’s office.
Kotek ordered state police beginning in March to consistently provide security for Kotek Wilson when she attends events as a representative of the governor’s office. Thus far, Kotek Wilson has averaged less than one event per month, according to the governor’s office.
The governor’s office plans to cover the costs of increased security with its existing budget, which totaled nearly $31 million in the current two-year budget cycle.
Kotek Wilson has an office in the governor’s office that’s approximately 8 feet by 8 feet, the same size as other offices, Shepard said. She has attended several of Kotek’s standing weekly meetings with staff about behavioral health initiatives. Kotek Wilson has a masters in social work from Portland State University and has worked on social justice and social welfare issues.
Governors’ spouses typically take a back seat in Oregon, but they have held more prominent roles in other states. In California, for instance,
First Partner Jennifer Seibel Newsom leads campaigns focused on children’s mental and physical health and women’s equality. And in Washington, a state employee serves as First Lady Trudi Inslee’s assistant. According to the National Governors Association, many states have staff supporting the governor’s spouse.
Former Gov. Kate Brown’s husband, Dan Little, joined her at some public events and state travel but overall kept a low profile. Brown took over after former Gov. John Kitzhaber resigned because of an influencepeddling scandal involving
his fiancée, Cylvia Hayes. Before Kitzhaber’s resignation, top staff in his office were concerned about conflicts of interest involving Hayes and tried to minimize her role in the governor’s office, according to reporting from Willamette Week at the time.
Kotek Wilson has been more visible, including accompanying Kotek to most stops on her 36-county tour of the state in 2023 and sitting in on discussions about housing, behavioral health and education during the tour. During a December interview with the Capital Chronicle, Kotek said it was helpful to have Kotek Wilson with her both to show Oregonians that they were a family and because of Kotek Wilson’s social work experience.
