The Howonquet Village & Resort and has created an opportunity to “cut the cord, return to the ancient art of verbal communication” and find a reprieve from city stresses.

The resort operators want to “help with your electronic detox.” That’s the goal of Julie McHenry, Manager of the resort.

Situated on the shores of the estuary where the Smith River joins the Pacific Ocean, the Tolowa Dee-ni’ Nation knows the locale as Xaa-wan’k’wvt.

“Along-There Upon-It, once the location of the Xaa-wan’-k’wvt municipality that provided us with governance, food, housing, and worship,” the tribe describes on the website. For years it was Ship Ashore and Salmon Harbor Resorts. The Tolowa Dee-ni’ nation reacquired the 60 acres in November 2016,

and have undertaken a restoration project.

At the resort there are 14 newly remodeled cabins on the shore of the estuary where they invite visitors to enjoy the placid beauty of the estuary, where otters frolic and sea lions sun themselves on the rocks, and you can kayak among them.

The attraction of nature, McHenry and company hope will be enough to convince visitors to deposit their phones in the baskets provided in the rooms for that purpose.

Although the site does have internet, the idea is to put the phones and tablets aside for a while, recognizing the need to spend time apart from those captivating devices.

County revises ‘pet mill’ ordinance

The Curry County Board of Commissioners has repealed and revised the county’s Ordinance 23-03, which is intended to prevent the sale of puppies, kittens, and rabbits from cruel and unhealthy commercial breeding mills.

The ordinance is set to become effective in October.

Emergency Conflagration Act declared for Smith River Complex

Oregon Gov. Tina Kotek has invoked the Emergency Conflagration Act for the Smith River Complex to allow the Oregon State Fire Marshal (OSFM) to mobilize structural firefighting resources to protect life and property.

The OSFM is mobilizing additional firefighters, equipment, and an incident management team to provide structure protection for homes threatened by the Smith River Complex.

The Smith River Complex began in California and has now burned across state lines into Oregon. Level 3 evacuation orders are in place.

Last Thursday, OSFM mobilized two structural

task forces through immediate response to protect communities near the Smith River Complex ahead of a conflagration declaration.

In accordance with ORS 476.510-476.610, Governor Kotek determined that the fire poses a threat to life, safety, and property, and the threat exceeds the firefighting capabilities of local firefighting personnel and equipment. The governor’s declaration cleared the way for the state fire marshal to mobilize firefighters and equipment to assist local resources in battling the fire and further support a coordinated response.

The additional task forces are coming from other counties around the state through the Oregon

Fire Mutual Aid System to protect life and property.

Preparing for the aftermath of lightning strikes

As the weather changes, lightning strikes are possible, and those strikes can lead to wildfires.

First, the public is encouraged to use their eyes and their noses. If you see or smell smoke, call 911 immediately. Often, lightning strikes can occur, but a fire triggered by the strike may not develop for hours or even days after the storm.

Oregonians are urged to actively practice wildfire prevention, prepare their home and a go-bag for evacuation and know where to sign up for alerts.

How can people help prevent wildfires?

Additional human-caused fires on the landscape will draw the firefighting efforts away from the lightningcaused fires and put extra strain on ground and aviation resources. You can help prevent large wildfires by:

This month children are returning to local schools and classrooms in Curry County.

Motorists need to get back in the habit of slowing down near neighborhood schools.

Each morning and afternoon when school is in session, children are walking to and from school and when there’s a chance they may be present, a school speed zone is in effect. The speed limit is 20 mph in a posted school zone between 7 a.m. and 5 p.m. on a day when school is in session. If the school zone is equipped with a flashing yellow light(s), then the speed limit is in effect when flashing.

It’s vital that we obey these speed limits as our children’s safety is at stake. These schools include

kindergarten through 12th grade. Some of these children are five years old and very small. A parked car can obscure their view of you and your view of them. These young people often fail to realize the importance of looking before they walk or run out into the roadway. Driving at 20 mph will give you more time to react and avoid striking them.

As citizens we must protect our children. Traffic crashes are one of the deadliest hazards our children face. Let’s do our part when we pass these schools by slowing down, watching, and expecting the unexpected. Everyone needs to do their part to ensure the safety of our children.

Prohibiting sex discrimination in schools

Title IX, which prohibits sex discrimination in federally funded schools, requires that schools act to prevent discrimination and harassment on campus.

A coalition of 19 states and the District of Columbia, led by Oregon Attorney General Ellen Rosenblum, announced Aug. 29, that the states have filed an amicus (also known as a friend of the court) brief with the U.S. Ninth Circuit Court of Appeals in a class-action case entitled Hunter v US Department of Education.

The brief supports arguments that a 2020 rule adopted during the tail end of the Trump administration is invalid. The lawsuit was brought on behalf of students opposing the Department of Education’s implementation of a new regulation governing Title IX’s religious exemption from anti-discrimination laws. The new regulation significantly weakened protections from discrimination on religious grounds, according to a release from Rosenblum.

“When Congress enacted Title IX, it included a narrow exemption for schools controlled by religious institutions that have tenets incompatible with Title IX,” the release stats. “However, during the Trump administration, the Department of Education used administrative rulemaking to vastly expand this narrow religious exemption.”

One such rule, adopted in August 2020, makes it more difficult for prospective students to tell which schools are claiming

a religious exception,”

According to Rosenblum. The DOE eliminated the requirement that educational institutions advise the Office for Civil Rights in writing if they wanted to invoke a religious exemption. As a result, schools could invoke the exemption, without notice, in response to a student’s complaint.

“During the Trump administration his Department of Education gutted protections for women, members of the LGBTQ+ community and other classes of students that had been in place for four decades,” Rosenblum said. “Title IX needs to be strengthened, not systematically weakened. Students ought to know before they get to campuses whether their academic institutions will protect their rights or undermine them.”

As the brief states, students “… should not have to wait until after they become a victim of discrimination to learn that their school considers itself exempt from Title IX’s anti-discrimination, anti-harassment, and antiretaliation rules. Nor should schools be allowed to wait to assert their exemption from Title IX until after a complainant comes forward with an allegation.”

The amicus brief was led by Rosenblum, and joined by the Attorneys General of California, Colorado, Connecticut, the District of Columbia, Delaware, Hawaii, Illinois, Maine, Massachusetts, Maryland, Michigan, Minnesota, New Jersey, Nevada, New York, Pennsylvania, Rhode Island, Vermont, and Washington.

Let’s talk about your feelings.

There is a specific, yucky feeling emotion that happens when we’re facing a circumstance unfamiliar to us and we don’t yet know what to do about it. There’s a lack of information and foundation to our moves. I call it yucky, but it’s sciency name is Structure Loss.

Our collective experience of structure loss includes, but is not limited to, when we went into a worldwide quarantine during the pandemic (Is it over yet? Asking for a friend.). We were doing a

thing, it was a big thing. We’d never done that thing before and we weren’t exactly sure how to do it. Other people, doing the thing, often irritated us with how they did the thing, or they got judgy about how we were doing the thing. And frankly, it was difficult to say who did it wrong and who did it right. That describes a lot of circumstances, but it was on high octane as we all tried to navigate a worldwide experience on a personal level. We had no real structure to build from. We were all starting fresh. We still are in many ways. But what can you do with that feeling, it’s an underlying imbalance with a little fear? I find putting a label on something helps, knowing everyone has the feeling even if we manage it differently also feels nice. But the best

thing I learned about yucky feelings, is simply that they are “designed” to move us to action. Our emotions are drivers. They are designed to help us identify what we want and what we don’t want.

I can tell you this, no one wants structure loss and structure loss knows this. It gets up in your business and it yells at you, “BUILD SOMETHING!” It begs you to act in your own behalf and restabilize. It would be cooler if it felt more like happiness, the emotion that says, “Ohhh yeaaaaahhh, love me some of this. ‘Second helpings, please.” But such is life, not everything is happiness.

But my clients find, when they can properly identify the yuck that they would like less of, or the structure they would like to feel grounded in, they can easily figure out some ‘next right

moves.’

We’re still feeling the effects of a world and circumstances we couldn’t have seen coming. But we all know there have been some great things that have come of it. Those are things we built, new ways of doing things and being in the world. We have new “structures” we couldn’t have had if we hadn’t learned what we learned. Not every emotion feels good. Not every circumstance does either. But there’s possibility in everything and when we’re willing to learn, we’re make new structures and ideas to add to those we already have. And maybe that adds a little more happy into the world as we go along the path.

Republican senators, state attorneys seek Oregon Supreme Court review of anti-walkout law

Five Republican senators and attorneys representing the state are seeking a quick resolution from the Oregon Supreme Court on the senators’ challenge to a voter-approved state law intended to block them from running for reelection after they ground the legislative session to a halt for six weeks.

Last year, voters frustrated with Republican lawmakers’ increasing reliance on quorumblocking walkouts passed a constitutional amendment to bar any senator with more than 10 unexcused absences from serving another term.

Ten conservative senator passed that point in May, and they stayed away for another month as they protested bills on abortion, transgender health care and guns.

Now, half of the affected senators are arguing that the voter-approved law wasn’t written clearly, and that they should be able to run for reelection. They sued Secretary of State LaVonne Griffin-Valade late Friday, seeking a court order that would allow them to file for reelection.

The suing senators, including Senate Minority Leader Tim Knopp, R-Bend, represent districts

that span the state, from the northwest coast to the far reaches of eastern Oregon and up and down the Cascade range. Some have years of experience in the Legislature.

They filed the case with the Oregon Court of Appeals, but attorneys for the senators and state Department of Justice lawyers representing Griffin-Valade submitted a joint request to skip the appeals court and go straight to the state Supreme Court.

“A definitive ruling on the issue presented by this case is needed before the March 12, 2024, candidate filing deadline (and, ideally, far enough in advance of that deadline to give meaningful notice to candidates),” the attorneys wrote. “The filing deadline is less than seven months away; as a result, even with an expedited briefing and argument schedule there is not enough time to seek judicial review in both the Oregon Court of Appeals and Oregon Supreme Court.”

They asked for an expedited schedule before the Supreme Court, with the senators filing their first brief by Sept. 29 and all written arguments submitted by Nov. 10. Oral arguments, if they happen, should occur on or before Dec. 8, the parties requested.

Three of the Republican senators who sued –Knopp and Sens. Dennis Linthicum of Klamath Falls and Lynn Findley of Vale – have terms that end in January 2025. The other two, Sens. Daniel Bonham, R-The Dalles and Suzanne Weber, R-Tillamook, won’t face election until 2026 if they’re allowed to run.

Sens. Brian Boquist, I-Dallas; Bill Hansell, R-Athena, and Art Robinson, R-Cave Junction, also collected more absences than allowed and would face election in 2024.

Hansell announced his retirement earlier this year and Robinson, who missed the entire 2023 legislative session for medical reasons, isn’t expected to run again.

Boquist has indicated he plans to run if allowed.

The senators’ argument rests on how the court interprets the end of the single sentence voters added to the state constitution with last year’s Measure 113: “Failure to attend, without permission or excuse, 10 or more legislative floor sessions called to transact business during a regular or special legislative session shall be deemed disorderly behavior and shall disqualify the member from holding office as a senator or representative for the term following the election after the member’s current term is completed.”

Griffin-Valade, Senate President Rob Wagner and most observers interpreted that to mean lawmakers who miss 10 or more floor sessions can’t run for reelection. But because elections happen in November and legislative terms end the following January, the Republican senators contend it doesn’t apply to the next term but the one after that. That would mean Knopp, for instance, could serve another four-year term but would be barred from election in 2028 because of his absences in 2023.

The Oregon’s 13 Constitutional Defense Fund, a political action committee Knopp set up this spring to fund the senators’ legal fight, is nearly $60,000 in the hole after minimal fundraising and a $63,000 bill from Davis Wright Tremaine LLP, the Portland-based law firm representing the senators, according to state campaign finance records.

Jane Duff Cain 12/11/1930 – 7/9/2023

Jane Duff Cain, 92, of Crescent City, CA and most recently Brookings, OR, passed away July 9, 2023. Jane was the youngest of four, born December 11, 1930, to Louis Dunlop Duff, Sr, and Cyra Sweet Duff of Kansas City, MO. She graduated from Southwest High School where she was a proud member of the basketball team and swimming club and vice president of both the school choir and literary magazine. Jane graduated from the University of Missouri in Columbia where she was an active participant of Kappa Alpha Theta. This began her lifelong commitment to volunteering which included stints as President of the Junior League of Princeton, NJ in 197071 and President of the Women’s Club of Crescent City, CA in 2015-16. Jane was also a successful businesswoman throughout her career, initially as a real estate agent in various places she lived (Kansas City, San Diego, and San Francisco) and then as the founder of Almost Like a Daughter, which provided personal services for the elderly and disabled for over three decades.

Known for her decisive wit as well as her ability to count, Jane was an avid bridge enthusiast, skilled seamstress and talented knitter. Her dogs were constant and loyal companions. Jane had a keen ear, loved to sing and was one of the founding members of the Grace Notes, an a cappella group on Old Greenwich, CT and sang in various a cappella groups across the country.

Jane is predeceased by her former husband, John Joseph Cain, and her youngest daughter, Cyra Jane Cain, as well as her sister Sibyl Duff Tilson and brother Louis D. Duff. She is survived by her sister Cyra Duff Sanborn of Lexington, MA, her children, Constance Cain of Crescent City, CA and Douglas Cain of San Francisco, CA and her grandson Nathanael (Laura) of Bend, OR and her great grandchildren. Jane was beloved by various nieces and nephews scattered around the country, including Athelia Ann Tilson of Watertown, MA, Sibyl Louise Tilson of Alexandria, VA, Patricia Woodbury Miller of Prairie Village, KS, Cyra Sanborn Dumitru of San Antonio, TX, Peter Sanborn of Lexington, MA, and Noel Sanborn of Palo Alto, CA. Jane brought color and energy to the lives of those she loved.

The family would like to thank the staff at Bright Creek, the memory care unit of Sea View Senior Living for the wonderful loving care she received there, especially Ruby Howard, Karen Rickerson, Barbara Jimenez RN, and Jordan Landers. Also, thanks to Glenda Vierow for previous care.

Services will be private. In lieu of flowers those who wish to honor Iane’s memory may do so by contributing to the Puli Club of America or a dog rescue in your area or to the Brookings Presbyterian Church.

William John Goergen

Like the song says, Bill Goergen lived hard, died hard and left beautiful memories. A native Oregonian, he lived and attended schools in McMinnville, Roseburg, and Port Orford, and then lived in Coos Bay before settling in the early 60’s in Brookings. However, that doesn’t count all the fishing towns up and down the Pacific, chasing tuna, crab, bottom fish, shrimp, black cod, salmon, and more.

After graduating from Pacific High School in Port Orford, Bill majored in Business at Oregon State University, then worked various jobs including fishing, before enlisting in the U.S. Army in the early 60s, serving in the electronics field in Germany. After returning home in 1964, he took his Army savings and purchased the fishing vessel “Takli”, going back to his first love on the sea. Author Salvadore Genoves once said “…there are three kinds of men: those who are alive, those who are dead and those who go to sea.” Commercial fishermen in those days fit that example, especially Willy the Fox, so named by his fellow fishermen in his early Port Orford days. His wife Peggy and eventually 6 children fit into that life, running up and down the coast with camping gear and kids piled into the car to wherever Dad was delivering his catch.

After fishing the “Takli” for a number of years, Bill set his sights on the “Karen”, a multi-purpose boat that let him expand into drag and shrimp fishing. The family was well settled into the home they still occupy in Brookings, so life expanded into school and sports activities.

In the early 90s, a group of fishermen formed a partnership to take on the lack of ice needed to expand fishing trips and marketing. Bill led the way to finding grants and loans to build the facility that became Harbor Ice and which still serves the fishing industry at the port. Issues in seafood marketing led the group to also lease a facility at the Harbor to sell their own products. Bill went back to school to gain the skills required to process and license their catches. What became Chetco Seafood Co. expanded to include a seafood market and small restaurant. Gradually Bill bought out the other partners, and the business became a buyer for fish brought in by small local boats, providing fresh product for the business. When he retired, the business changed hands to his son and his partner and exists today as Catalyst Seafood.

Bill’s life was filled not only with business, but also his children’s activities and his love of hunting in all forms. Trips to Eastern Oregon for big game alternated with bird hunting with his well-loved dogs. He especially enjoyed trap shooting and reloading his own ammo. He and wife Peggy tried to get away each year for a vacation to special places in Hawaii, Mexico or to visit family. As the family expanded with grandchildren and then great-grandchildren, and expanded again with special groups of friends, Christmas, holidays, and camping trips up the Chetco were

well attended and exciting events.

Bill was preceded by his parents, Leo and Louise Goergen, brother Richard (Dick) Goergen, son Michael Goergen, and a great number of family and friends, including his fellow fishermen. He is survived by his wife Peggy, and children Terese Britt and daughter Amie’s family, Bryan (Tammie) Goergen and sons Mark, Daniel and Christian and families, Anella (Tony Gaffke) Ehlers and sons Adam and Izak and families, Willy (Mandi) Goergen and Jessie, Andrew and Hannah and families and granddaughters Cnaushua Madere, Chanda Sollinger and daughter Corinna. His sisters Donna (Ron) Terzenbach and children Penny and Aaron, Patsy Gunther and son Eddie and family, nephews Todd and Matt Goergen and mother Bethna and families and much-loved cousins also survive as well as all of Peggy’s family, which became his family too. In addition, there are a great number of friends who are family, especially all those that called him Grampa.

Services were held at Star of the Sea Catholic Church in Brookings with the assistance of Redwood Memorial Chapel. Memorials may be made in his name to his favorite charities, Wounded Warrier Project, St. Jude’s Hospital for Children, or Catholic Charities USA.

Vincent (Vince) H. McKinley

On August 21, 2023, Vince passed away, his daughter Kellie, son Mike, and son Rick were by his side. Born in the Bay Area in 1950, Vince had a successful career in the mortgage industry before retiring in his mid-50’s. An avid hunter and fisherman, He moved to Brookings because of its beauty, the Ocean but mostly the fishing. He was a proud grandfather to Josh, Kaylee, Zach, Tyler, Bryce, Braden, and Dylan.

Joy Annette Moomaw

Joy, a longtime employee at McKay’s Market in Gold Beach passed away from lung cancer on August 16, 2023, at the age of 65. She leaves behind her husband, Rex of Gold Beach, sons Jake (Mary) Moomaw of Happy Valley and Brody Moomaw of Gold Beach, her sister, Candy (Ted) Vinson of Toledo and 5 grandchildren that she adored.

A Celebration of Life will be held September 9, 2023 (Saturday) @ 2 PM at the Lutheran Church Youth Center, 94190 5th St., Gold Beach. A potluck will follow.

Federal protection now in place for sand dune phacelia

In response to a petition and lawsuit by the Center for Biological Diversity, the U.S. Fish and Wildlife Service has protected the sand dune phacelia as a threatened species under the Endangered Species Act.

The agency also designated 180 acres as protected critical habitat for this coastal dune plant in 13 units in Coos and Curry counties in southern Oregon, and Del Norte County, California.

“These beautiful and rugged plants are emblematic of our native coastal sand dune habitats and I’m thrilled they’ll get the protection they deserve,” Center for

Biological Diversity Senior Conservation Advocate Jeff Miller said. “Endangered Species Act protections will help sand dune phacelia and our dwindling intact dune habitats recover and thrive. It shouldn’t have taken nine years for Fish and Wildlife to take action, but hopefully it’s not too late.”

Background

Sand dune phacelia has declined to 25 naturally occurring populations, many of them with few remaining plants, including in iconic places like Oregon’s Cape Blanco, according to the Center for Biological Diversity.

The plants are threatened by invasive species such as European beach grass and

gorse, damage from offroad vehicles, and climate change-driven sea level rise. Its small population size makes the species even more susceptible to these

threats.

Phacelia is in the Forget-Me-Not family of flowering plants and grows to be 18 inches tall, with white flowers that are a

rich source of nectar and pollen for native bees. The number of bees and variety of bee species found in dune vegetation is higher in places where it grows.

The plant requires sandy habitats that are relatively free of competing vegetation and is adapted to living on nutrient-poor sand dune areas with high winds, blowing sand and salt spray. Its silvery hairs, an adaptation to the harsh coastal environment, keep salt off its leaves.

The name “phacelia” is from the Greek “phakelos,” meaning cluster, for its clustered flowers; and the Latin “argentea,” meaning silvery, for the appearance of its leaves. The phacelia blooms from March to September.

Court suit

This listing comes in response to a Center lawsuit seeking timely status evaluations and protection decisions for 241 plant and animal species thought to be trending toward extinction, including the sand dune phacelia. The Center and seven other conservation groups including Oregon Wild, Friends of Del Norte, Oregon Coast Alliance, the Native Plant Society of Oregon, the California Native Plant Society, the Environmental Protection Information Center and the Klamath-Siskiyou Wildlands Center) petitioned to protect the phacelia in 2014.

ODFW asking beach visitors to avoid fledgling common murres

Visitors to the Oregon Coast visitors are seeing many dead and dying fledgling common murres on state beaches. Some commercial fishermen report also seeing this at sea, according to the Oregon Department of Fish and Wildlife (ODFW).

“At this time of the year, the young birds are trying to survive on their own for the first time,” ODFW biologists state in a release. “It’s not uncommon to get reports of some sick or dying birds.”

According to the biologists, the severity of this year’s event is uncommon and may be related to a combination of a large production year for common murres and extremely warm ocean conditions along the Oregon Coast.

Warm ocean temperatures generally have a negative impact on the production of food in the lowest levels of the food web. That impact trickles up through the food web affecting many species, including common murres.

The biologists said most

of the young birds they’ve seen appear to be starving or cold, however samples were sent to ODFW’s Wildlife Population Health Lab for further examination.

Without proper nutrition, the young birds cannot maintain their body heat. And while ocean temperatures are warmer, the water is still below the average body temperature of these birds.

The ODFW biologists ask people to refrain from disturbing or picking up sick or dying birds to give them the best chance for survival. With a healthy and thriving population of common murres in Oregon, rehabilitation is not an option.

People can report observations of sick or dead common murres to local ODFW offices.
