After meeting with District Attorney Katherine Micks, Sheriff Garrett Scott has released homicide suspect Jeremiah Kirsch from jail custody. Harbor District Resolves Lengthy Litigation The Harbor District has settled a long-standing lawsuit that will deliver a $1.4 million dollar award to the District. Here’s the background: The lawsuit originated out of the rebuild of the Harbor (CCHD) resulting from the 2011 Tsunami. A lawsuit was filed by CCHD, the plaintiff, in 2016 against eight different defendants. The suit was filed against Dutra, the general contractor et.al. Over the years parties have either been dismissed from the case or settled out. Of the defendants, only two remain: Wayne Maples Plumbing and Heating and Ward Stover Engineering. Maples insurance covered under a $1 million dollar liability policy. Ward Stover won the right to the Harbor rebuild. Stover also had a $1 million liability policy. The length of the lawsuit was exacerbated by the Covid pandemic. The Del Norte Planning Commissioner denied a use permit, March 6, to Towers LLC/ Verizon Wireless for a proposed cell phone facility camouflaged as a 136’ high pine tree. The proposed site is 2801 Railroad Avenue, located in the undeveloped portion of Railroad Avenue and is owned by the Lesina Family Trust. The Planning Commission decision to deny the permit is being appealed by Verizon and will be placed on the Board of Supervisors agenda for Tuesday, April 23 at 10am. Those opposing the erection of this tower maintain the tower is unsightly and the faux pine tree camouflage is visible over a radius of many miles, bounded by Boulder and Railroad Avenues to Malone and Alder Roads, Moore Place and Downing Street. Some Neighbors of the planned facility claim the tower poses a threat to the public health. Neighbor property owners contend the tower will deter buyers from the area. microphone, two Harbor Commissioners, unrelated, separate and distinct from one another, stepped away from their respective seats and addressed the other four commissioners. Commissioners Gerhard Weber and Brian Stone expressed frustration and dissatisfaction on different issues to their colleagues and the public audience. Commissioner Weber spoke first. Weber distributed to those in the audience what appeared to be campaign literature. Weber said he stands for integrity, transparency, competency and common sense. Weber was not announcing his candidacy, quite the contrary. It became clear why he chose to address from the public speakers

I attended the Del Norte County Board of Supervisors meeting on April 9 to see what they would do with the Joint Powers Agreement for the Tri-Agency Economic Development Authority.

The question for the Supervisors was whether to concur and adopt the same version of the JPA that the Crescent City Council and the Harbor Commissioners approved or refuse to change their minds. The only difference is a clause that the County added that disallows activities involving offshore wind.

For Tri-Agency to resume leading our regional economic development effort, the same JPA must be adopted by each of the member agencies. If the County continues to refuse reconsideration and does not approve the revisions made by their partners, Tri-Agency will likely be stalled.

CEDS I think it is unfortunate that so much time and energy has been spent debating the pros and cons of offshore wind energy. This has resulted in a stalemate. The County is highjacking the agenda before Tri-Agency can be assembled to choose the best economic development programs to pursue.

I testified at the Supervisors meeting and suggested that Tri-Agency should focus on implementing the Comprehensive Economic Development Strategic Plan (CEDS), which is an action plan for collaboration to accomplish shared goals for economic development in Del Norte County. The CEDS was prepared under a joint effort of Crescent City, Del Norte County, and the Crescent City Harbor District, and contains an action plan with unrealized goals and objectives that Tri-Agency could take on. I highlight below a few examples of goals and projects that Tri-Agency could work on.

Create New Jobs

CEDS Goal 1 is to “diversify the regional economy to include technology-based firms, light manufacturing and health care enterprises that provide at least living wages to local workers.”

Two good ideas in the CEDS are to “attract internet commuters and ensure adequate capacity and redundancy in the broadband network.” There is a section that focuses on healthcare with interlocking objectives. “Attract and expand a greater range of specialty health care services, create an inventory

of health care services available in Del Norte County, identify existing health care gaps and engage a group of industry representatives to determine the constraints to filling the gaps.”

To help fill these gaps, the CEDS recommends we “coordinate with workforce education and training agencies to maximize the opportunity for local healthcare training programs.”

Workforce Support CEDS Goal 5 is to “enhance education, workforce training, housing and healthy lifestyle opportunities in the County to support existing residents and businesses as well as the workforce of the future.”

The CEDS proposes to “support expansion of career technical education programs in the K-12 school system and attract or develop additional vocational education programs, focused on skills needed by local industry as well as future technology industries.”

The CEDS recommends housing actions to “prepare market information that can help attract developers to build more workforce housing, as well as evaluating local zoning and permitting processes to remove barriers for all types of housing.”

Lack of affordable workforce housing is a major impediment to economic development. This must be addressed with more urgency.

I asked the Supervisors to consider this question, “If not Tri-Agency, who will do this work?”

Do Over

Since the Board of Supervisors previously voted on this decision, the second time was harder. Three independent yet interrelated actions were necessary to be taken in order, for each of the subsequent items to be considered.

First, a motion to suspend the rules of order must be approved to allow the Supervisors to reconsider the Tri-Agency JPA. This action requires 4 votes to pass. Contingent upon the passage of the first item, next they need to approve a motion to reconsider the Tri-Agency JPA.

Contingent upon the passage of the first and second items they could vote to adopt the Tri-Agency JPA, Amendment, removing Section 5.05.E of the Board’s previously approved version of the JPA which restricted the Tri-Agency’s ability to “support or pursue activities involving the off-shore generation of wind energy.”No

Compromise

After public comment, when it came time to take action, Supervisor Starkey made the motion to “suspend the rules of order” to reconsider the Tri-Agency JPA. Supervisor Howard seconded the motion. Supervisor Short stated that he “was not willing to waiver on protection of fishing and was not willing to suspend the rules.”

Supervisor Borges seemed annoyed that this issue was before him again. He said, “What’s the point of having rules if we’re not going to follow them. Let them (the City and Harbor) change their votes!” The first motion failed. Short, Borges and Wilson voted no, Starkey voted yes, and Howard abstained. The die was cast.

Technically, the Tri-Agency still exists with the current, outdated joint powers agreement, but if the County refuses to contribute the $70,000 that they previously committed, Tri-Agency will be hobbled. The City has already contributed $30,000 and Harbor met their commitment to pay $10,000. The County is holding out.

The Electoral College

As so many have said “It needs to go away.” I have completed an analysis of the actual minutes of the Federal Constitutional Convention of May 25, 1787 through September 17 1787, which set out the arguments for and against the Electoral College. The following arguments, which can quickly be identified as no longer valid, pertain to the establishment of the Electors: Argument #1: James Madison-pg. 57, July 19, 1787 “There was one difficulty however of a serious nature attending an immediate choice by the people. The right of suffrage was much more diffusive in the Northern than the Southern States; and the latter could have no influence in the election on the score of the Negroes. The substitution of electors obviated this difficulty and seemed on the whole to be liable to the fewest objections.”

Since the institution of the 3/5ths compromise, the Representatives could now count 3/5ths of their slaves.

Argument #2: Mr. Gerry: - pg. 57, July 19, 1787 “He was agst. a popular election. The people are uninformed and would be misled by a few designing men.” As we know - with the advent of radio, television, and the internet, “the people are now informed.”

The Supervisors are developing a Strategic Action Plan which they say will set priorities for what the County should do. If they are going to do nothing, this will be easy. We don’t need another plan. We need action.

Ironically, the Supervisors had a discussion of a proposed new Strategic Action Plan earlier in the agenda when staff recommended that the County should “add economic development services” to the County staffing. The County currently has no one working exclusively on economic development.

Arguments #1 and #2 were the major issues that decided our current Electoral system. Since those arguments are no longer legitimate and as we have seen from the January 6, 2021, fiasco what can happen regarding the Electoral College, it is time to put an end to this archaic method and “let the people choose their President and Vice President directly. Exciting Days are Here

A pack of activities come for Juniors and Seniors now. For instance, Del Norte High School will have prom on April 20. I missed many teenage joys, like prom, because a drunken driver hit me when I was 16 in 1992.

I graduated in 1993 in a wheelchair with hearing difficulties. After 32 years, my hearing is still damaged, and I can walk as best as I can. I am used to my daily challenges, but I am trying to prevent others from facing this. No one wants to live with these difficulties: I guarantee that. Believing you can drive like a pro after a beer or two is foolish. I’ve been trying to make that clear for 15+ years. Unforeseen injuries or death can come to yourself and others if you are not sober when driving. I know.

Teenagers have a long road ahead of them. If drinking, please designate a sober driver first. It is the best choice for all. Drinking and driving can bring a dead end to their future, as well as others.

Though disagreeing with the District Attorney’s decision, Sheriff Scott told The Triplicate he respects the DA’s decision and hopes new evidence will surface to persuade felony prosecution of Kirsch.

Del Norte senior commits to play for top JC program after graduation

After an outstanding and very successful high school career playing multiple sports for the Del Norte Warriors, senior McKenna Curtis recently announced that she will join one of the top community college programs in the state after graduation.

Curtis is a two-time Big 5 MVP in volleyball and helped lead the Del Norte girls to back-to-back undefeated conference championships in 2022 and 2023.

In the fall she will play for Feather River College in Quincy, a perennial powerhouse program that made it all the way to the state championship game last year.

Curtis has long wanted to play college volleyball, which she admits is her favorite sport, and she received plenty of interest from multiple schools.

Last spring, she opted not to play high school softball — another sport she excels in — in order to focus on volleyball and prepare her better for the jump to the college game.

She spent much of the early part of 2023 play-

ing for The Rise National 18U team out of Medford, one of the most respected travel team programs on the West Coast, and it was an experience she believes helped develop her game and prepare her for the next level.

She visited multiple California JCs and admits Feather River was an easy choice.

“My coaches Debbie and Petra (Lorenzi), they were talking to me about the school and how good they are,” Curtis said. “I thought JC was the best for my skill level, so I emailed the coach (at Feather River) last year and we kept in contact.

“And once I got to visit the school and meet the coaches and players, I knew it was the place for me. It definitely felt like this is where I belong.” Curtis held a recent letter signing at Del Norte High School, with family and teammates in attendance.

And she says it is her teammates and the time they spent together that she will remember the most from her time at Del Norte. “I’m going to remember

the team,” she said. “We worked so hard over the last couple of years to really build a strong core team environment, and I think that’s the reason we were so successful.

“We were so tight knit with each other and I think that’s what separated us from the rest of the league.”

The Del Norte girls certainly enjoyed plenty of success over the past two seasons, including a perfect run through the Big 5 in 2023 where they did not drop a single set in conference play.

Curtis was named conference MVP as a junior and co-MVP with teammate Lili Nunez this past fall.

But she’s quick to credit her teammates for all of that success.

“We all had the same goal and we were all there for the same reason and I think that’s something very special to me,” Curtis said.

One of the things that Curtis liked about Feather River is the style of head coach Sarah Ritchie.

really nice, not too big and it kind of reminds me of home. It’s kind of like a really cool small-town vibe.” Feather River also is a school well-known for sending its volleyball players on to Division-1 programs with scholarships, something Curtis hopes she can achieve.

“That is my goal,” she said. “If I go through the program and work as hard as I can, I know that could be the outcome for me.

That’s the level I’m aiming for.”

Curtis will likely play either as a defensive specialist or libero for her new team, roles she feels comfortable with.

But she added she’s grateful for the opportunity to play anywhere on the court for such a respected program.

“I think they’re looking at me as a defensive specialist or libero,” she said.

“It’s a similar coaching style to what I’m used to,” the Del Norte senior said. “They’re no nonsense and very competitive and I know that’s where I thrive as an athlete. I don’t mess around.”

She also immediately liked the town of Quincy when she visited the campus. “The school is the first thing you see when you drive into Quincy,” she said. “It’s a small town, smaller than Crescent City. “The school itself is

To no avail… Weber’s requests have frustratingly not been addressed, until now! Thomas Zickgraf is Harbor Comptroller and the person responsible in keeping Weber and his colleagues well- informed; this responsibility falls upon his shoulders. Zickgraf responded by expressing his appreciation of Commissioner Weber’s commitment to transparency, “ I regret Commissioner Weber chose to raise his concerns through an act of political theatre rather than discussing them with me. I look forward to continuing to work closely

and collaboratively with Commissioner Weber to ensure his and the community’s concerns are addressed. (As of April 3) The Harbor District has updated its website and is working to improve it as a community resource. Weber underscored his ability to keep constituents advised and make intelligent well-informed decisions was severely compromised due to this lack of information. Appar-

ently this “public shaming” worked. After Tuesday’s meeting, much of Weber’s requests, Tuesday suddenly appeared on the Harbor website, Wednesday. Coincidence? Maybe, but, alas, Commissioner Weber was partially satisfied. Stone was also prepared to look at his colleagues eye to eye. First, he moved the dais a few feet away from Harbor president Harry Adams. Apparently, Stone was adhering to some kind of order To be no closer than 10’ from Adams. There was no record of a court order of physical separation on record.

Stone spoke about the debt the Harbor has found itself mired in and he was not shy on passing along some sobering cash flow issues. He shared these concerns with the public. Here are Stone’s revelations:

Elks Project Tests Eyesight for Del Norte Preschoolers

The California-Hawaii Elks Major Project has been busy this week assessing the vision needs of Del Norte kids, ages 3-6. The Elks of California have sponsored and developed this Vision Care Program to provide emergency financial assistance for eye examinations, glasses and medical care for eligible children with covered eye conditions. The Program was established in 1950 to provide therapy services for children with disabilities who have unmet physical, occupational and speech language therapy needs. In 1965, the Major Project expanded and introduced its Vision Screening Program for kids with vision deficiencies.

Cathy Hallman, Pediatric Vision Screener conducted some 150 eye tests for Del Norte preschoolers within the Del Norte Unified School District.

DEL NORTE COUNTY Jason Fabus Trio in concert The Jason Fabus Trio will be performing a concert on Friday, April 19, at 7:00 p.m., at Crescent Elk Auditorium, 994 G Street, Crescent City. Dawn Kay (Merica) Walker

April 24, 1924 - March 29, 2024

On a brilliantly sunny spring day, Dawn Kay (Merica) Walker was welcomed happily into the world by Donna and Merle Merica in Columbia City, Indiana. She was the middle child of three. At 3 years old, her family (including extended paternal family) moved to Riverside, California, everyone living in close proximity. Dawn was able to grow up with the love and adventures of a large family and held many fun memories of that time. She was a bit of a self-proclaimed “tomboy” in childhood, playing in dirt and using the heads of her dolls for games of baseball. In high school she participated in sports such as track and softball, and worked various jobs including at a chiropractic office and an A&W. In 1978 she graduated from Ramona High School.

Around the year of 1980, Dawn’s father, Merle, had business dealings with a man named Edgar Ronald Walker. Dawn met him shortly after, and despite a large age difference, the two became fast friends. Edgar gifted her a horse, love blossomed, and on June 28th of 1980, they eloped to Las Vegas, throwing caution to the wind. The couple proudly and happily had five children together, living in California near Dawn’s family. In 1990 they sought greener pastures and bought a small farm in Roseburg, Oregon, planting acres of strawberries and tending plums, aged walnut trees, and remodeling an old house to their dreams. Norma J. Pierce, age 95, passed away March 19,2024 at The Rose House in Branson, MO. She was born on September 23,1928 in Garden City, Kansas to John and Iona Boyd. On November 26, 1944, she married Homer S. Pierce, of Garden City, Kansas. He passed away December 28, 2012.

As well as being a housewife and mother, for many years she helped her husband with the farming. Norma and her husband liked to travel, including trips to Canada and Europe. She was also an avid fan of KU and K-State basketball, Del Norte Warrior sports, and the Winnipeg Blue Bombers football

he was able. This resulted in a house that was never completed, but was a castle to its inhabitants, nonetheless. Dawn looked back at this as one of the happiest times in her life, watching children grow and enthusiastically being involved in their many activities and interests. She was the first to volunteer to chaperone school trips, unfailing in her praise of her kids’ accomplishments, and proud of the many miles she drove in her old van as she rushed kids to and from all of their activities. It was such a busy time for her, and she adored it. Dawn held a great affection for her children’s friends as well, making space in the van if they needed a ride, and even welcoming one to live with them for a time.

2001 was a painful year for Dawn beginning with Edgar’s passing in May. Now a grief-stricken widow with very little means, Dawn and her children sold the farm and moved to a small house in Roseburg. She worked various jobs over the years from receptionist in retirement homes, to sales associate in a medical equipment shop, finally to a bus driver for the school district. Dawn loved her family more than anything and worked tirelessly to provide for them.

Three years later, Dawn married David Norman in a small ceremony in Roseburg, Oregon on July 24, 2004. They traveled to Hawaii and also were able to enjoy a cruise to Alaska together. Eventually they moved to Gasquet, California, where they lived for several years. Dawn’s weekly highlight was to visit the community pool

in Crescent City, where she made many dear friends over the years. She passed away on the 29th of March, 2024, at the age of 63, due to a sudden illness of Sepsis.

Dawn will be remembered for her fierce and unyielding love and friendship, gentle compassion, warm personality and big heart. She didn’t care for the conventions of society and was happy to throw caution to the wind, an adventurer in her own way. She was a giver of boisterous laughter, easy smiles, general silliness, and the friend who answers the phone on its first ringunless she was napping, then it was the second or third ring. Her grandchildren will remember her for copious gifts and timely birthday cards, and tight but gentle hugs.

She is survived by her second husband, her two siblings, 5 children, 22 grandchildren, 1 stepdaughter and one stepson. She has 1 great grandchild on the way.
