The 2nd Annual Forest Moon Festival kicks off May 31-June 2 in Del Norte and Humboldt Counties.
The Forest Moon Festival is a celebration that the Redwood coast was the film site for the Forest Moon of Endor and final battleground between the Rebel Alliance and Galactic Empire in Star Wars: Return of the Jedi. Will There Finally be a Proper Burial for Tri-Agency?
by ROGER GITLIN Country Media, Inc.Board Chairman Dean Wilson opened the discussion to consider and vote on the request to conduct and participate in a Joint Meeting of the entire Board of Supervisors, City Council and Harbor District Board of Commissioners and discuss the dissolution of Tri-Agency.
3rd District Supervisor Chris Howard expediently made the motion to approve attendance to the, as yet, unscheduled meeting.
1st District Supervisor Darrin Short made the second and praised the work Tri-Agency has contributed to economic development of Del Norte County. “It just makes sense for all three entities (to) get together on what could be the cusp of ending this (Tri-Agency) Board,” said Short.
2nd District Supervisor Valerie Starkey directed her question and
comment to County Counsel, Jacqueline Roberts. “If we get together at a joint meeting to discuss ending Tri-Agency, we’re still at a standstill…an impasse, because we could not suspend the by-laws and reintroduce the discussion. This Board has had four or five bites at the apple.” Counsel Roberts stated, “Perhaps some might change their minds.”
The Joint Meeting conundrum focuses on off-shore wind power development. Both the City and Harbor embrace wind power development; the County has rejected the discussion.
Chairman Wilson reminded his colleagues the City and Harbor are not precluded from exploring off-shore wind power discussion, independently. “Either governance may proceed with individual efforts on wind power,” Wilson emphasized.
The County has chosen not to participate.
Public Speaker Sam Strait painted a much different picture of the perceived successful efforts of Tri-Agency. Strait disputed Howard’s praise of the efficacy of Tri-Agency. “I beg to differ with Supervisor Howard but stirring the pot again seems ludicrous when you are battling against a public that says No to Tri-Agency. This agency should be dead.” Strait referenced failure of off-shore wind development on the Atlantic Coast.

Matthew Rickner Murder Trial Begins
by ROGER GITLIN Country Media, Inc.A trial is indeed a rare event…a murder trial even less common, occurs about as often as a solar eclipse. In 2023, from some 2000 Del Norte cases about a quarter of those cases were felonies. there were just seven cases that went to trial. Mostly for cost expediency, plea deals are almost the rule, again with rare exceptions. The Second Degree Murder and Drug Trial of Matthew Earl Rickner, 30, is one of those rare solar eclipse cases.
Rickner entered a Not Guilty plea to several felony counts associated with the shooting death of his mother, last December. He
entered his plea during his arraignment in January. Jury selection began Monday, May 20 in Division 2, Superior Court Judge Darren McElfresh presiding. Rickner is represented by Public Defender Karen Olson. Del Norte Assistant District Attorney Todd Zocci is the prosecutor for the state.
Rickner is charged with killing his mother, Phyllis, 68 in the home the family was residing in the 500 block of Humboldt Avenue. The incident took place, December 29, last year. Suspect Rickner reportedly fled the scene and was arrested by CHP officers about a quarter mile from the scene of the crime. The Jury selection process was tedious but very efficient

allowing for a fair unbiased jury to listen to and process all evidence. The 12 jurors from the community were screened and selected for this assignment. The trial is expected to run about one week.

We have two major parties in America, the Democrats and the Republicans. It is not surprising that these two parties disagree on what form of government we have. Are we a democracy or a republic or some combination of both? I found a story on this topic from Jefferson Public Radio that has some interesting insights.
“Since the election of 2020, supporters of former President Donald Trump have become notably more willing to assert their belief that voting in America is suspect. That Trump won an election he lost. That millions of ballots were uncounted or miscounted. That voting by mail was fraught with abuse.”
“Despite the lack of evidence, election denialism has become not only a thing, but a movement. When critics call this an attack on democracy, some election deniers respond by saying the U.S. is not a democracy, it is a republic.”
Democratic Republic
“The Athenian democracy in Greece around 500 BCE denoted the right of the people (demos) to personify power (kratos) and meant it to include an entire polity – or at least its males. Something like 5,000 citizens were enfran-
chised to participate.”
In a pure democracy all the people vote on all the decisions. This would be unworkable with the current U.S. population of more than 335 million people. As a result, we have adopted a republican model of government where the people elect representatives who are empowered to make decisions on behalf of the people.
“The American experiment has harmonized democratic and republican models, each of which drew its legitimacy from the people and depended on rule by the people. The essential difference was the role of representatives to substitute for the gathering of all the people at one point in time and space.”
The Constitution To ensure that the majority does not trample the rights of the minority, our country has also adopted a constitution, which defines the protected rights of all the people. This has led to the description of our form of government as a constitutional republic or a constitutional democracy.
In addition to a constitution our system has built-in checks and balances to ensure that no one part of our government has too much power. The legislature is charged with passing and

amending the laws. The executive branch is responsible for implementing and enforcing the laws. The judiciary independently interprets and evaluates the laws.
California Initiatives
In California we have a very democratic process whereby the people can collect signatures to place a topic on the ballot for all voters to decide in a direct vote. If our elected officials fail to address a specific problem or we don’t like their decision, we can bring this issue directly to the people to decide.
While this is a very useful process to ensure that our issues are represented, it is also subject to abuse. Anyone with enough money can hire signature gatherers to get a proposition qualified for the ballot. A weakness to this approach is that voters must inform themselves about complex issues to make good choices.
Some ballot measures are written in a way that is intentionally or unintentionally misleading. Occasionally there are two competing ballot measures that will result in the opposite outcome. It looks like there may be as many as 15 ballot measures in the November election. This many can be overwhelming for most voters.

2024 Ballot Measures
I recently attended a meeting of the Executive Board of the California Democratic Party where we adopted positions on the ballot measures that will be on the November ballot. The Democratic Party uses its own type of republican structure.
There are more than 10 million Democrats in California, so the Democratic Party has a process to elect representatives to vote on behalf of all California Democrats in these proceedings. Representation is proportionate to the number of Democrats in each county. Del Norte has 4394 Democrats out of 10 million.
Each county elects a local Central Committee, which then elects delegates to the State Central Committee. We have six delegates and one Executive Board member. Statewide there are 4000 delegates and 400 Executive Board members who are empowered to represent the interests of 10 million California Democrats.
Positions Adopted
The process for considering positions on proposed ballot measure is very thorough and inclusive. First there is a committee meeting and public hearing to receive

input from the members in attendance. The hallways teem with advocates carrying signs, wearing t-shirts, and distributing flyers promoting their position pro or con.
After the Committee formulates recommendations, the slate is voted on by the full Executive Committee. Occasionally a recommendation is pulled for further debate and a separate vote. This year a ballot measure proposing to “add one semester personal finance course to high school graduation requirements” was pulled for debate.
It seemed like a good idea, until I heard the concerns from others. They claimed the proponents didn’t consult with educators on the impacts.
One person cautioned, “it is a slippery slope to have initiative driven curricula.” Another argued that resources are limited, and this is an unfunded mandate with no extra funding provided.
Passed By One Vote By the time this came for a vote at the Sunday General Session, the 322 registered Executive Board members had dwindled down to 135 that were present to vote whether to support this proposition. Once an item is pulled from consent, the rules

I voted to support this proposition despite an appreciation for the concerns expressed by the opponents. This barely passed with 81 yes votes, exactly 60 percent. If I had voted the other way, this vote would have failed. This is just another reminder that every vote matters.
However, the votes that really matter are the votes that will be cast in November. In future columns I will provide more information on the propositions that qualify to be on the ballot and the Democratic Party recommendations to support or oppose. With 15 ballot measures we have some homework to do.

Last Friday, the CCPD with

Pelican Bay CERT Team served a search warrant on a residential property on the 2500 block of Roy Avenue in the Bertch tract.
During a search of the residence, close to a pound of methamphetamine packaged for sales, numerou
items of drug paraphernalia, several firearms and stolen property were seized.
Several stolen tools were located as being linked to a burglary that occurred on Cushing Ave reported earlier in the morning. Del Norte deputies were able to seize the items and return them to the owner.
During the incident, Sonny Ortman, 51 was arrested for possession of a controlled substance for sale, maintaining a residence for the use and sales of controlled substances, possession of a loaded firearm while in possession of a controlled substance and possession of drug paraphernalia and felon in possession of a firearm.
Also arrested were Jolene Hanson, 40, John Pires, 47, Katherine Fitzpatrick, 45, for assorted felony charges of possession of drug paraphernalia and possession of controlled substances for sales.
Suspect Roshieak Stuart, 34, was also arrested on an outstanding warrant and for being in possession of stolen property.
Coast Guard urges preparedness during National Safe Boating Week
In support of National Safe Boating Week, held from May 18 to 24, the Coast Guard urges all recreational boaters and recreational paddlers throughout the Pacific Northwest to exercise caution and become knowledgeable on water safety in preparation for the 2024 boating season.
As the weather improves, and many members of the public return to the water, the Coast Guard reminds all residents that weather conditions remain variable. Many of the accidents and deaths on the water can be prevented with simple and effective measures: boaters’ education, life jacket usage, and trip preparation.
The highest group at risk are boaters and water sports enthusiasts exposed to the elements on small crafts, especially paddleboards and kayaks. The vulnerability to the elements and physical demand of their activity can cause even experienced sportsmen and swimmers to become exhausted and unable to return to shore, with long exposure being a potentially fatal risk factor.
Education and foresight are the biggest determining factor of safety on the water. In all accidents, the five primary contributing factors are operator inattention, operator inexperience, improper lookout, machinery failure, and excessive speed.
To enjoy a safe day on the water, the Coast Guard recommends the following steps:

· Wear the appropriate attire. Boaters and paddlers should always wear the proper protective clothing for the water temperatures they are recreating in (such as a dry suit). The waters of the Pacific Northwest are deceptively colder than the air temperature, especially in the early spring and summer months. This risk is not often recognized by inexperienced paddlers until they find themselves in the frigid water after capsizing or falling overboard.
· Wear a life jacket. The Coast Guard urges all boaters and paddlers to wear (not stow/bring) a properly fitted Coast Guard-approved lifejacket. Donning a life jacket is much harder once you’re in the water, especially if you’re fatigued or injured. Wearing an improperly fitted life jacket is just as deadly as not wearing one at all.
· Mark your craft. Placing an “if found, please call” sticker on your paddle craft, with your contact information, can not only get your craft returned to you quickly should it accidentally drift away, but it can also help rescuers to determine the type of response needed. If you’re looking for stickers you can contact your local marine law enforcement agency, U.S. Coast Guard Auxiliary, U.S. Power and Sail Squadron, or local Coast Guard unit. · Take a boater safety course. Research shows that boaters believe they are boating safely if they have proper equipment and training, though statistics show that safe boating is a matter of their own behavior. · Get a Vessel Safety Check. Get a free Vessel Safety Check inspection from the Coast Guard Auxiliary. VSCs are offered by experienced members of the U.S. Coast Guard Auxiliary. A VSC is your best way of learning about problems that might put you in violation of state or federal laws, or worse, put you and your passengers at risk when out on the water. · File a float plan. Always let a friend or family member know when you will be recreating on the water. When going on longer ventures, creating a detailed itinerary of your plan; when you are arriving and departing, a means of communicating, the number of passengers, and where you are traveling to; will enable the Coast Guard to initiate an expedient response in the event of an accident. If you’re unsure about what information to share, use a Coast Guard template! Float Plan (uscg.mil)
· Boat sober. Never boat under the influence. It is illegal to operate a boat while under the influence of alcohol and drugs. Alcohol use is the leading known contributing factor in fatal boating incidents.
· Know who to call in an emergency. Your first call when in distress, 9-1-1 and they will connect you to Coast Guard unit or equivalent agency that can initiate a response. If outside of a cellular servicing area, carry a VHF radio set to channel 16, the International Hailing and Distress channel. When hailing out distress, use the signal word “Mayday!” and provide the following: your location, the number of people in your party, the nature of your distress, a description of your vessel/craft, and if everyone in your party is wearing life vests. These are the most essential pieces of knowledge for the Coast Guard to initiate an effective response.

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Crescent City REQUEST FOR RELEASE OF FUNDS
On or about June 14, 2024, the City of Crescent City will submit a request to the California State Department of Housing and Community Development (HCD) for the release of $3,150,000 of Home Investment Partnerships Program (HOME) funds under Title II of the Cranston-Gonzales National Affordable Housing Act of 1990, as amended, for a project located at 911 Pacific Avenue in Crescent City, California (APN #118-020-027-000), for the purpose of partially funding the rehabilitation of a 45-unit affordable housing project in Crescent City, CA. The Valhalla Townhomes complex was initially built in 1980 and consists of 8 two-story apartment buildings containing 45 two-bedroom units, including one manager’s unit, and a one-story office and laundry room building. The two-bedroom units are 900 square feet. A community building is proposed to be constructed as part of the rehabilitation of the project, and five (5) units will be rehabilitated to be made ADA-compliant which includes adding a bedroom and full bath to each unit and converting an existing bedroom to a den or non-bedroom use. The resulting project will have a unit mix of 45 2-bedroom, including one 2-bedroom managers unit. Projected sources of funding include the following: Permanent Loan- $3,000,000; City of Crescent City HOME funds$3,150,000 (includes City funds of $75,000 Admin and $75,000 Soft Costs); Crescent City LIMHF loan $300,000; Seller Note$2,200,000; MGP Loan$1,238,782; 4% LIHTC Equity$4,093,609 and GP Equity-$100 for a TDC of $13,832,491. The project currently has 20 years of 25 Project Based Vouchers with an estimated value of: $7,230,000.00.
FINDING OF NO SIGNIFICANT IMPACT
The City of Crescent City has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the City of Crescent City offices located at 377 J Street, Crescent City, CA 95531. PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the City of Crescent City at the above address. All comments received by June 13, 2024, will be considered by the City of Crescent City prior to authorizing submission of a request for release of funds to HCD. Comments should specify which Notice they are addressing.
ENVIRONMENTAL
CERTIFICATION
The City of Crescent City certifies to HCD that Eric Wier, City Manager, in his capacity as certifying officer consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HCD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Crescent City to use Program funds.

Harbor Seeks Equitable Fishing Regulations
by ROGER GITLIN Country Media, Inc.The Crescent City Harbor District Board of Commissioners (CCHD) voted to send a letter to the Pacific Fisheries Management Council, the California Dept. of Fish and Wildlife, The National Oceanic and Atmospheric Administration and other relevant agencies addressing disparities in fishing regulations, at its regularly scheduled meeting, last Tuesday. The vote to send the letter was approved 4-1.
The CCHD expressed its primary concern with the persistent and inexplicable disparities in fishing regulations and enforcement that are apparent when comparing (the Crescent City Harbor) with neighboring regions. Most notably, the letter states, these disparities are evident with the Oregon port of Brookings, 10 miles north of the Crescent City Harbor.
“Despite our proximity,
Crescent City Fishermen face significantly restrictive fishing regulations, starkly contrasting with those allowed in Brookings. Notably, Oregon permit holders are allowed a monthly open access limit of 5,500 lbs of Ling cod whereas California has set this limit at zero for our waters. For this species alone, the missed revenue opportunity for each boat approaches $200,000, annually,” states the letter.
Other disparities include:
• Pacific Marine Management Council has sanctioned a nearly unrestricted salmon season in Brookings, Crescent City has been excluded from salmon fishing entirely.
• Fishermen from Oregon are allowed to purchase a daily California fishing permit and subsequently land their catch in Brookings.
Boats departing from Brookings can enter California waters, catch their Oregon rockfish limit and their Oregon salmon limit (outside
of three miles from the coast) and return to Brookings. Conversely, fishermen operating out of Crescent City are barred from similar reciprocal activities.
The letter claims Oregon fisherman have been caught by law enforcement by ignoring the requirement a California license.
As a secondary concern, Commissioners shared their concern in the inadequacy of the current data system. CCHD has and continues to lobby for hook and line method, rather than computer model in acquiring accurate data.
The PFMC meets June 6-13, in San Diego.
In other Harbor news, CCHD Harbormaster Tim Petrick announced comptroller Thomas Zickergraf is no longer employed with the harbor. No details of the termination were released.
The Harbor meets again, Tuesday, June 4th at the Harbor Office 101 Citizens Dock Rd. The meeting is scheduled at 2pm.

Rev. John Lee Hooker, Jr. has built a formidable entertainment career singing and preaching his message to those behind bars. This past Saturday, Hooker, Jr. presented two inspirational shows at Pelican Bay State Prison (PBSP). Pastor Hooker, Junior began his message by telling the 50 or so inmates in the attendance at the first program, “I’ve been through the mill, shot twice stabbed, homeless and have done time in San Quentin, Soledad, Avenal, Tracy and a few others. The ordained minister and Chaplin at Pelican Bay State Prison (PBSP) is the son of world-renowned Blues guitarist / singer John Lee Hooker (Boom, Boom, Boom, Boom) has an exceptional background on his own merit. “ My goal is to change hearts through music and God,” says Hooker.
