TERMS AND CONDITIONS BOOKING All Bookings must be made in written form, via e-mail or fax. PRICES Prices are net (unless otherwise specified) included VAT and quoted in Euro. Il Maestrale reserves the right to make amendments to the rates quoted herewith, whenever a price variation will occur, in the exchange rate, or anything beyond it's control. Prices are quoted for group made up by 30 persons. Every difference will be quoted on demand. PAYMENTS 25% of any rate will have to be paid in advance at the booking confirmation. If payment is not received by the due date, Il Maestrale reserves the right to cancel booking. HOTELS AND HISTORICAL HOUSES Every hotels and historical houses, classified in 3 and 4 stars, have been carefully super visored by our staff. FREE One person free every 25 settlements in double room. COACH Coach are normally operated by a 44-42 seat coach. Due to seasonal fluctuation, a smaller coach may be used. Due to luggage capacity on coach, all passengers are restricted to one checked and one carry on bag per person. Smoking is not permitted on motor coach however. The conditions of carriage of that carrier are incorporated into this contract. You may ask for copies the relevant condition of carriage from our office. Day 2 - Pitigliano and Grotte di Castro After breakfast in hotel, transfer to Pitigliano, ancient Tuscan village close to the Latium border and guided visit of magnificent Orsini Castle, now Museum of Sacred Arts. Then guided city tour and visit to the Jews Ghetto. Transfer to Grotte di Castro where the group will have lunch at Santa Cristina Castle, a manor built in 1800. In the afternoon free time to enjoy the Maremma landscape in the big park surrounding the castle, where it will be also possible to practise horse riding. Dinner and overnight stay in Viterbo. Day 3 - Viterbo and Bagnaia After breakfast in hotel, the morning will be dedicated to the discovery of Viterbo: city tour and visit to the major monuments of the town: Piazza del Gesù, Palazzo Farnese, Palazzo dei Papi, Rocca Albornoz, Palazzo dei Priori, Palazzo del Podestà, Quartiere S. In the afternoon visit to the famous Sacred Grove (or Monsters’ grove, where “monster” must be understood in the Latin meaning of monstrare, which means to show and demonstrate), garden wanted by Vicino Orsini, Duke of Bomarzo, to honour his dead wife Julia Farnese. den, Vicino Orsini called on one of the greatest landscapers and architects of his time, Pirro Ligorio. The structure of the Sacred Grove means that from stop to stop, from stage to stage, each element is a component of an immense, very neoplatonic poem to the Duke of Bomarzo lost love. After this latter no refund can be given to the customers. Besides, No refund can be agreed for those customers who do not present themselves for departure, who cannot participate in the holiday because the required documents for expatriation are lacking or invalid or insufficient, and who withdraw during the holiday itself.
General conditions for the sale of tourist packages
GENERAL CONTRACT CONDITIONS 1. TOURIST PACKAGE CONCEPT Il Maestrale S.r.l organises travels, holidays, and all inclusive tours which are sold through its own Travel Agency or by different Travel Agencies. In compliance with Art. 2.1 of Decree 111/95: “the tourist packages cover travels, holidays and “all-inclusive” circuits, and are the result of a predefined combination of at least two of the following elements, sold and offered for sale at a flat-rate price, and which last for more than 24 hours, that is to say, at least one night’s accommodation is included: a) transport; b) accommodation; c) tourist services not included in transport or accommodation (in comp. with Art. 7 letters l and m) that constitute a significant part of the tourist package. 2. LEGISLATIVE SOURCES The contract of sale of a tourist package is regulated not only by these general conditions, but also by any clauses indicated in the contract given to the customers, and by Law no. 1084 dated 27.12.1977 for ratification and application of the International Convention regarding Travel Contracts (CCV) signed in Brussels on 23.4.1970; as well as Legislative Decree 111/95 actuating the Directive 90/314/CEE (dated 13th June 1990) relating to travels, holidays, and all inclusive tours, in order to cover the customers, states that: - Tour operators and Travel Agencies can organise and sell tourist packages with full Italian state authorization only; - customers have the right to receive a copy of the sales contract for the package holiday purchased (Art. 6 of Legislative Decree 111/95) and the sales contract is a necessary document to permit the customers the applying to the Guarantee Fund (see the art. 18th of this general contract conditions). 3. BINDING INFORMATION The organiser writes out (for tours in catalogue and extra programmes) e technical list which features are detailed below: a- No. of the state authorization b- No. of the policy for civil liabilities c- The currency of catalogue and extra programmes d- Referring exchange for currency adaptations (day or value) 4. RESERVATIONS The contract of sale of the tourist package is written out clearly and with precision. The customers receive copy of the contract agreed upon, signed or stamped by the travel organiser or agent. Il Maestrale S.r.l will accept the reservation according to the availability of accommodations communicated by supplier only. Besides, acceptance of the booking is intended as finalised and the contract consequently concluded only when Il Maestrale S.r.l confirm it to the customer, by the Travel Agency too. Indications relative to the tourist package not contained in the contract, in the brochures or in other media of online communication, will be provided by the Organiser in good time and before the start of the holiday. 5. PAYMENT At the moment of the booking the entire registration fee and a deposit of 25% of the total amount shall be paid. The balance will be paid by the customer no later than the 30th day prior to the day before the start of the stay. For registrations occurring in the 30 days preceding the date of departure the entire amount and the registration fee shall be paid at the time of registration. 6. EXPRESS CLAUSE FOR LEGAL TERMINATION The non-payment by the agreed dates and the non-observance of the aforementioned formalities constitutes an express clause for legal termination of the contract, with the possibility that Il Maestrale S.r.l may seek compensation for damages suffered. 7. PRICE VARIATIONS The total amount of stays, trips, and tourist packages is assessed in basis of the catalogue and the programmes extra- catalogue; it may vary up to 21 days before the date of departure and only if justified by variations in: transport costs, including cost of fuel, foreign correspondent services, air travel costs; rights and taxes for some types of tourist services such as taxes, landing taxes, embarkation and disembarkation taxes in airports and ports; exchange rate taxes applied to the all inclusive package. If the price increase exceeds 10%, the customer may withdraw from the contract by giving to Il Maestrale S.r.l communication within no more than 8 days from the time of being informed of the increase. In the aforementioned case the customer may have the alternative right to a refund of the cost already paid or the possibility to take advantage of another tourist package of an equivalent or, if none is available, higher cost. The price of the offers cannot vary in the 20 days preceding the date of departure. 8. CUSTOMER WITHDRAWAL a) The customer may withdraw from the contract, without paying penalties, under the following circumstances: if the price increase exceeds 10%; if a significant change (this means any variation in elements objectively configurable as fundamental for the fruition of the tourist package considered overall) occurs to some essential element of the contract after the conclusion of the contract itself, but before departure and not accepted by the Customer. In the aforementioned case, the customer may have the alternative right: to take advantage of another tourist package of an equivalent or, if none is available, a higher or lower cost (in this case the price difference will be reimbursed); to ask for a refund of the cost already paid within 7 working days from the time of being informed of the modification. The customer will be required to give communication of the decision (to accept the modification or withdraw) within no more than 2 working days from the time of being informed of the increase or the modification. Should no such written communication be forthcoming within the aforementioned date, the proposal will be understood to have been accepted. b) With the exception of the cases disciplined by the DTL 111/95 (to which reference is made) and the above mentioned hypothesis, the customer who withdraws from the contract before departure will be charged of the entire registration fee, and the following the penalties: - 10% of the agreed tariff up to 30 days prior to the date of departure; - 30 % of the agreed tariff from the 30th to the 21st day before the date of departure; - 50% of the agreed tariff from the 20th to the 11th day before the date of departure; - 75% of the agreed tariff from the 10th to the 3rd day before the date of departure;

9. MODIFICATION OF THE CONTRACTUAL TERMS If the organiser communicates before departure that it has become impossible to provide the necessary services required for the tourist package (except in the case where the cancellation has been caused by reasons attributable to the customer), the customer may accept the new proposals or withdraw from the contract without paying penalties, and availing himself/herself of the rights as indicated at the letter a of preceding art. 8. If well-founded reasons exist the organiser shall be allowed to modify the programme with alternative of equal or higher value only If the organiser is unable to provide an essential part of the services indicated in the contract after departure for whatever reason except any attributable to the customer, alternative solutions will have to be offered, with no extra charge to the customer. If the services provided are of a lower value that those originally offered the cost difference will be reimbursed. Should it not be possible to offer any kind of alternative solution, or the solution offered by is refused by the customer for serious and valid reasons, the organiser shall offer transport at no extra charge of the same quality programmed for returning to the point of departure, or different place, as agreed, compatible with the availability of the transport and seats, and will reimburse the difference in cost between the services booked and those actually provided at the time of early return. If the tourist package has to be cancelled owing to the lack of participants for the minimum required by the offer description and the organiser communicates the cancellation before the 20th day preceding the date of departure, the customer has the rights indicated at the letter a of the aforementioned art. 8. 10. REPLACEMENTS Before departure, the customer may find other persons to take his/her place as long as the replacement satisfies all the conditions for utilisation of the service and the organiser is informed, in writing at least 4 working days before the date indicated for departure, about the need of replacement and the necessary information regarding the replacement. In any case the withdrawing customer will pay the registration fee and the substitute shall be jointly liable with the cessionary for payment of the amounts, and the costs sustained by the organiser for proceeding with the replacement. 11. ORGANISER LIABILITIES a- The damages suffered by the customer because of total or partial failure to provide tourist services are refunded according to the Italian and European laws. The damages have to be refunded within three years after the date of return journey, except of the non fulfilment of services of transport covered by the tourist package which have to be refunded within 10 or 12 months after the return (see the art. 2951 C.C.). b- The contracting parties may fix in writing the limits of compensation for damages (but not for harms done to person) caused by total or partial failure of the organiser in providing the services covered by the tourist package, but according to the art. No. 13 of Bruxelles Convention of 13th April 1970 (CCV) and executed with the L. no. 1084 (29th December 1977) and its modifications; in any case in compliance with the Art. No. 1341 comma 2 C.C. The prescribed term for refund is 1 year after the return in the same place of departure. 12. EXEMPTION FROM LIABILITIES Il Maestrale S.r.l is liable for damages suffered by the customer because of total or partial failure to provide services as laid down in the contract, whether Il Maestrale S.r.l. is not liable for events extraneous to the supply of the services envisaged by the contract, act of God, fortuitous events, and events of force majeure. After compensation for damages, the organiser and the agents are subrogated toward third parties. The customer is obliged to provide Il Maestrale S.r.l all the documents, information and elements in his/her possession for exercising this latter’s right of subrogation towards third parties responsible for damage. 13. ASSISTANCE OBLIGATIONS The organiser is under the obligation to offer the Customer the measure of assistance imposed by criteria of professional diligence with exclusive reference to personal obligations as laid down by law or by contract. 14. CLAIMS AND COMPLAINTS The customer must make a complaint to the organiser at the time the problem arises or, if this is not immediately recognisable, no later than 10 working days of the date programmed for return to the place of departure. The complaint shall be made by registered letter with return receipt. If the complaint is presented on the site of the tourist services, the organiser must offer the Customer all the assistance indicated in aforesaid article 13 in order to seek a prompt and fair solution. Customers cannot ask for compensation for lost, damage or stolen baggage, money or valuables which have not been insured before departure. 15. OPTIONAL INSURANCE If insurance policies are not included in the tourist package, Il Maestrale S.r.l recommends that you ask for the following types of insurances: trip cancellation, accidental disabilities, and lost of luggage. It’s also possible to stipulate policies covering the expenses for medical assistance and emergency repatriation. 16. HOTEL CLASSIFICATION The official classification of hotels is formally provided by regional authorities according to the terms of the Law no. 203 of 30th May 1995. In the absence of officially classification recognised by competent public authorities Il Maestrale S.r.l reserves the right to offer its own evaluation of the accommodation’s quality level. 17. GUARANTEE FUND In case of the Organiser’s or The Travel Agency’s neglect or failure to safeguard, the Prime Minister’s office has founded a National Guarantee Fund to which the customer may apply the following requirements: refund of amounts paid; return journey home for trips abroad. The Fund shall also provide an immediate economic availability for tourists forced to return home from nonEuropean Community countries due to emergencies whether attributable or not to the Organiser’s behaviour. 18. ORGANISER’S INSURANCE POLICY Il Maestrale S.r.l is covered by the policy no. 552593865 of the company Carige Assicurazioni for liability insurance as in art. 15 and 16 of Legislative Decree 111/95. 19. PLACE OF JURISDICTION Whatever controversy may arise between the customer and Il Maestrale S.r.l the place of jurisdiction will be that of Civitavecchia only. *** Art. 16 of Law 269/98 Italian Law punishes with term of imprisonment the crimes concerning juvenile prostitution and pornography, even if these crimes are committed abroad. *** TECHNICAL FILE Authorization of Region Lazio no. 1980 given on the 9th October 1986. This catalogue was published on March 2008 and the programme will be valid until 31st December 2008. The fees are indicated in euro and the non mentioned centesimal fractions mean ,00.
