A WORD FROM THE EDITOR
Welcome to the first issue of 2015. Whether or not it has anything to do with resolutions, a new year typically brings with it a few changes mixed in with business as usual. A great start to 2015 begins with a brief, upbeat look at the year gone by— a summary of what we’ve learned, what we’ve achieved and where Peter Sackett Editor we need to set our sights for the dozen months that lie ahead. It’s a healthy practice, both grounding and orienting, and one that helps build an appetite for adjustments to routine. Some of those adjustments—however small—appear here in the pages of Master Builder. I’ll be with you for the next few editions as the new editor. During my tenure, I’d like to collect and share more of the stories that make the construction and building industry an interesting place to work and, I hope, to read about. For example, on page 20 Kelly Ambrose begins to explore the Master Builders archives. For her, it starts with a brief look into the origins of our East Melbourne headquarters, sifting through official records and a hodgepodge of photos, documents and institutional memory. Winning an award is terrific, but what happens after a builder takes home the plaque? We thought you’d like to know, so we’ve asked Armadillo Homes, the 2014 Builder of the Year, to

Being a member of Master Builders ensures you, too, are part of a great legacy. The building and construction industry has delivered the homes, workplaces, edifices and infrastructure our state has relied on for more than 200 years. While some of today’s construction methods and materials vary significantly Peter Picking from those in the Nineteenth Century, President our distinctive product remains essentially the same. Our sector is of vital importance in providing the homes, transport links and community facilities that will ensure Melbourne remains the world’s most liveable city and that Victoria remains a highly liveable state. Being a member of Master Builders ensures you, too, are part of a great legacy. This organisation was initially formed to represent the needs of our society’s best builders and has secured outcomes to benefit both builders and the community alike. Whether you are a sole trader focusing on home renovation projects or a multi-national construction firm, you can be assured we will continue to campaign for reforms that will strengthen our industry and your business. Our industry faces challenges – like the cancelling of East West Link contracts, planning and red tape barriers, a Royal Commission reinforcing our position that certain union representatives take pride in disregarding our laws, poor consumer sentiment and a struggling national economy. These matters require the positive resolution by our state and national governments.
I am, however, certain that ours is a resilient industry. Our sector has always risen to the challenges confronting it. I remember all too well the upheaval our industry encountered during the turbulent final days of the deregistration of the BLF by the then state Labor Government in the 1980s. Reform is still needed to make sure everyone in our sector, including builders, specialist contractors, employees and unions comply with the law and that the law is enforced. While there are challenges we all must face, there are also significant opportunities ahead. Technology continues to offer new solutions that will change our industry, through advanced project management tools like building information model (BIM) systems, the rapid rise of prefabrication products or the development of new construction methods. Master Builders will continue to help members prepare and utilise these new technologies to help your business thrive. It is important Master Builders helps future proof our industry. Likewise, it is also vital we future proof your association as well, to make sure it is positioned to support building companies to grow for years to come. This will be a major focus of Master Builders’ next strategic workshop, held in February. I look forward to reporting back to you on the outcomes of this workshop as we focus on how your association can continue to support your business.

Getting Victoria moving again. Victorians elected the Andrews Labor Government to stand up for local jobs and build the projects our state needs. We’re not wasting a single minute. The first piece of legislation introduced into the Parliament under the Labor Tim Pallas Government was the Back To Work Bill. Treasurer of Victoria This $100 million plan – which will provide payroll tax relief to companies who hire retrenched workers and unemployed youth – will help create 100,000 jobs. TAFE cuts meant that youth unemployment rates increased to record levels, especially in regional Victoria. It was so much harder for young people to get skills and find a job. That’s why the Labor Government’s $320 million TAFE Rescue Fund has been fast tracked, so campuses on the brink of collapse can get the resources they need to grow and thrive.
Over the last four years, work on our state’s biggest transport priorities ground to a halt. Today, the Labor Government has a pipeline of projects to create thousands of jobs and get Victoria moving again. We will remove 50 of our most dangerous and congested level crossings, because they lock up our streets, slow down trains and put lives at risk. We will also double the size of the City Loop with the Melbourne Metro project, and take 5000 trucks off the West Gate every day with the West Gate Distributor. Governments may come and go, but our long term infrastructure needs will always remain. That’s why we will establish Infrastructure Victoria – an independent body to advise on our priorities. By creating jobs, saving TAFE and focusing on our priorities, the Andrews Labor Government will restore our strength and get our state back to work.

Pre-registration for free access to 2015 National Construction Code Members can now pre-register for free access to the 2015 National Construction Code through the Australian Building Codes Board website. As Master Builders noted in June last year, the NCC transitioned from print to an online-only format as of February 2015. This comes after the Australian Building Ministers’ Forum agreed in May 2014 to make the future editions available online at no charge. The decision to eliminate the cost of purchasing the NCC will make it more accessible to the building industry.
The ABCB will cease production of the hardcopy version of the code on 1 May 2015, instead providing digital downloadable files that can be used for printing. Master Builders welcomes the changes, having previously called for easier, free access to the National Construction Code. Pre-registration for the 2015 NCC is available through the ABCB website at www.abcb.com.au.
MORE VICTORIANS PREFER NEW HOMES OVER EXISTING ONES In good news for home builders, new figures show a rise in the number of loans provided to Victorians buying offthe-plan or newly built homes. The latest information from the Australian Bureau of Statistics shows there were 2374 loans ticked off for new homes last November, an increase of 3.3 per cent compared to the previous year. Over the same time, 11,387 loans were approved for purchases of existing homes, which was a drop of 1.8 per cent against the same time a year earlier. “There are 170 more loans being approved for new homes every month in Victoria compared to what we saw in 2013,” said Master Builders Chief Executive Officer, Radley de Silva. “That is stimulating investment, generating new work and creating more jobs for home builders right across the state.” “Record low interest rates are helping drive activity in the home building sector, with buyers keen to seize the moment and build their dream home.” According to the latest data, loans for new homes between January and November 2014 have climbed 7.4 per
cent compared to the previous year, while loans for existing homes went up just 1.4 per cent. The figures follow recent news that a record 6600 new homes received planning approval for the same month and with confidence surging throughout the industry late last year. First home buyer rates stay low Meanwhile, just 11.9 per cent of homes financed in Victoria were for first home buyers last November. New South Wales saw just 8.1 per cent of loans provided to first home buyers, while it was 10.8 per cent in Queensland for the same month. “It is becoming harder and harder for builders to secure work from first home buyers, who are battling increasing cost of living pressures and less affordable housing options,” Mr de Silva said. “That’s why Master Builders wants to see the new State Government hold an independent inquiry into housing affordability, so we can review the way government charges, levies, taxes and policies add unnecessary costs on to home building projects.”
VBA AUDITS OF DEMOLITION SITES The Victorian Building Authority has announced its commencement of performance audits of demolition work in both metropolitan and rural areas. The audits will examine documentation prepared by registered builderdemolishers and relevant building surveyors leading up to, and including, the issuing of the building permit. It will also examine building sites to assess compliance with legislative requirements. The audit will look closely at areas identified as presenting a risk, including relevant protection measures taken and ensuring the appropriate registration of building practitioners involved in the work in place. The VBA monitors building work by registered building practitioners to ensure that it is carried out competently and to a professional standard, and that it does not pose any risk of injury or damage to people. The audit will continue from late 2014 to early 2015, with findings to be released by the middle of 2015. Challenges aplenty for incoming government Master Builders congratulated incoming Victorian Premier Daniel Andrews on his election victory and called for the new Labor Government to get behind initiatives that will drive jobs and investment in the building and construction industry. “We look forward to working together with Mr Andrews and his team to help deliver real outcomes and reforms that will create new opportunities for our members,” said Mr de Silva. Mr de Silva outlined the top priorities Master Builders believes the new government need to commit to, being: • Funding more major construction projects • Establishing an independent infrastructure umpire • Enforcing the rule of law on construction sites • Requiring tradespeople to be registered • Cutting red tape faced by builders • Clamping down on owner builder and unregistered builder activity. Supporting non-residential companies “We want to see a pipeline of stateshaping infrastructure, which will benefit our industry and provide great long-term outcomes for our community too.” said Mr de Silva.
“There’s been lots of debate about what Victoria’s infrastructure priorities should be, which is why we need an independent umpire established to help remove the politics from road, rail and other major projects. “With the Heydon Royal Commission hearing damning evidence into the conduct of the CFMEU, it is also vital for the new government to uphold the rule of law in our industry. “Caving to union demands will add massive costs to our projects and risk the competitiveness of our industry, so it’s vital that Labor commit to help roll out the findings that come from the Royal Commission.” Supporting residential builders “Our top priority for residential builders will be to tackle the concerns we have previously raised with proposed legislation that threatens to make the Victorian Building Authority the judge, jury and executioner of building practitioners,” said Mr de Silva. “Consumer protection measures should not unfairly punish honest, hardworking builders and any policies that add red tape to registration processes or add costs to domestic building insurance will be vehemently opposed by Master Builders.
“We want to work with the new government to tackle the rising problems caused by unchecked owner builder and unregistered building activity and drive up standards by requiring tradespeople to be registered, like what happens today in Queensland and New South Wales. “Residential builders are spending more time today complying with red tape than they have in the past, and one of the big challenges for the new government will be to help cut this back.” Information on Master Builders’ comprehensive plan to support builders can be found at: www.buildingourfuture.com.au.

Green light for jobs as more buildings get approved Data released in January by the Australian Bureau of Statistics shows building activity in Victoria climbed to $2.68 billion in November 2014, up 20 per cent compared to the same time the previous year. “There are very pleasing signs right across our sector, with approvals steadily ticking up throughout the year in home building, renovations and non-residential construction activity,” said Master Builders Chief Executive, Radley de Silva. “The healthy rebound in building projects approvals should kick-start activity this year, meaning our industry can secure more investment and generate new job opportunities too.” A bumper month for new home building activity led the charge, with a record 6600 new homes given the green light. The previous record for home approvals was set in 2010. “Approvals for both detached houses and multi-units like townhouses and apartments have been trending up throughout most of the past year,” Mr de Silva said. “In fact, new home approvals have been better in 10 of the last 11 months when compared to 2013 figures.
“We are also seeing approvals ramping up for home renovations, extensions and alterations, which climbed 16.1 per cent in November alone.” The value of non-residential building approvals fell by 1.1 per cent in November, but approvals for the total year to date are up 3.9 per cent. “Non-residential approvals do fluctuate fairly dramatically, but approvals for the whole year are $317 million greater than the year before,” said Mr de Silva. “It is very much welcomed news for the construction industry.”
Highlights • Around 6600 new homes were approved in November, compared to 5500 the previous month and 4500 a year earlier. • Home building approvals for the month were up for both detached houses and apartments/townhouses. • Home renovation approvals climbed $27 million (or 16.1 per cent) for the month. • Total building approvals were $530 million higher than October and $450 million higher than November 2013.

Engineering construction works hit five year low Activity volumes for building roads, railways, water, electricity and telecommunications infrastructure in Victoria has hit its lowest point since 2009. It comes amid a national slowdown in engineering construction works.
Of the mainland states, Victoria had one of the biggest declines in engineering construction work volumes during the quarter, with our 6.8 per cent drop only eclipsed by Queensland (down 9.6 per cent) and South Australia (7.4 per cent).
New figures released show that there was a $174 million drop in Victorian engineering construction works in the three months to September 2014. The volume of work was also $283 million lower than the same time a year earlier. Engineering construction work volumes have now declined for three successive quarters and are far below the levels seen in 2011 and 2012.

In fact, the annual volume of engineering construction work in Victoria has fallen by more than $2 billion in the past two years – from $12.1 billion in the year to September 2012 to $10.0 billion in the year to September 2014.
“What we need to see here though is more infrastructure projects funded, so we can get more Victorians back to work and provide the facilities our community needs to thrive.”
“Despite Victorians crying out for better roads, improved rail connections and more infrastructure, we are seeing activity in these sectors dry up,” said Radley de Silva, Chief Executive at Master Builders. “These types of works are crucial in protecting our community’s liveability and creating construction jobs right around the state. “This situation will not be helped by cancelling the multi-billion dollar East West Link project. “It also highlights the need for the new State Government to fast-track its plans to remove dangerous level crossings, build a cross-city rail tunnel and invest in new outer suburban road upgrades.”

The building industry has returned to work from its summer hiatus, with many feeling ready to hit the ground running. That’s certainly how it feels here at Master Builders, at least. With 2014 behind us, it’s time to look at what lies ahead for our sector. A cut to interest rates has already been announced by the Reserve Bank, with many economists tipping that further reductions to record low levels will take place in the near future. Home builders welcome this news, which will help spur on activity for their businesses. With new home approvals reaching four year highs in 2014 and new cuts to interest rates, we will see activity ramp up this year. Likewise, we forecast that work will continue to ramp up in the home renovations, extensions and alterations sector. While activity in multi-unit apartments and townhouses will continue to be strong over coming months, the biggest
upswing in activity we will see from now through to at least mid-2016 will be in new detached houses market. The non-residential construction sector begins the new year with the recently elected Labor Government in Victoria ripping up our much needed Construction Code as well as halting the investment of billions of dollars into the East West Link project. This comes at a time when nonresidential companies have already been battling falls in activity. In fact, in every year since 2011/12 the volume of work in this sector has continuously declined, not helped by the changes in economic conditions or our state’s previous Coalition Government failing to fund major projects for most of its term. Master Builders forecasts that work volumes in non-residential construction will continue to fall this year, which is why it is important that new infrastructure projects are funded to plug the gap
caused by abandoning East West Link. There are plenty of other options, including the proposed cross-city rail tunnel, the removal of 50 level crossings or maybe even an alternative to the West Gate Bridge to support the fast growing suburbs to Melbourne’s west. The key point here is that our state is battling an infrastructure deficit and our industry is well placed to deliver the projects our community needs if our governments are willing to roll up their sleeves and provide the funding needed. Many construction companies and specialist contractors will be hearing from us this year about the next round of enterprise bargaining agreement (EBA) negotiations, which will see Master Builders advocating for productivity gains to be delivered across the industry. The current EBA passes its nominal expiry date on 31 March 2015 and our first industry briefing will take place in late February.

At the same time, we will all be keeping a watchful eye out for the proceedings of the Royal Commission into Trade Union Governance and Corruption. Stories of union thuggery, intimidation and coercion in the construction sector dominated news headlines last year and, unfortunately, may again this year. The Royal Commission is expected to complete its work by the year’s end, but has already demonstrated why we require a tough watchdog for our industry. Unfortunately, legislation to reintroduce the much needed Australian Building and Construction Commission has stalled in the Senate, blocked by the hodgepodge of vested interests from minor parties. Meanwhile, new Premier Daniel Andrews appears to be enjoying a honeymoon period, but will face a hostile upper house set to test his patience and resolve. The balance of power in Victoria’s equivalent of the Senate has been handed to the Greens, the
Shooters and Fishers Party, the Sex Party, the Democratic Labour Party and a representative from Vote 1 Local Jobs in western Victoria. Introduction of the USI Are you a student who stumbles over your answer Katie Tunnah when asked for Training Operations Administrator your qualifications? Does your memory fail you when needing to list the courses you’ve completed? This information is often requested when applying for a job or registration, and too seldom can students produce it without struggle. “I get lots of students wanting to apply for credit transfer or recognition of prior learning,” Tyson Imms, Master Builders RPL Coordinator, says. “This is helpful to them, as they don’t always have the time to complete another course. These guys have clearly done the required study before, but often they cannot find their records to prove it, so they have no choice but to attend classes and complete the same work over again.” The Australian Government has rolled out a new system, called the Unique Student Identifier (USI), for tracking records pertaining to Nationally Recognised Training. The system will enable students to find their Vocational Education and Training (VET) achievements from one source, and collate them into a single authenticated transcript. It will also ensure that students’ VET records are not lost. The USI was created to make it simpler to keep all of a student’s training records in one location. It’s also useful if you plan to make use of the numerous government funding opportunities that exist. Funding is often dependent on any previous qualifications you might have; imagine the nuisance of having to pay a full course fee unnecessarily because you couldn’t remember the details of qualifications you already hold. “The introduction of USIs means students won’t have to worry about losing their records,” Tim Wedding, Master Builders Assistant Training
Manager, says. “Students will be able to view, send and print out their training records when applying for jobs or further training. This means they will no longer have to contact their previous place of study and pay fees to have qualification records re-printed. “We receive calls regularly from people who have misplaced their White/Red Card and need a replacement card,” he says. “These guys are often unsure if they actually studied with Master Builders; it often turns out a good number of them did not, but they can’t remember where they did, in fact, study. So we are unable to issue a new card. With the USI, this problem is eliminated.” Effective 1 January 2015, any student undertaking Nationally Recognised Training will need to have registered for a USI. What is a USI? The USI itself is a unique alpha-numeric reference number that gives students access to their USI account. Think of it as a Tax File Number, but for educational training. All training completed from 1 January 2015 will be electronically recorded against a student’s USI. It costs nothing to receive a USI and, once obtained, it remains valid permanently.
How do I register for a USI? Getting a USI is easy. You can apply online at www.usi.gov.au and obtain your USI in about 10 minutes. It pays to be prepared before commencing study in Nationally Recognised Training with any Registered Training Organisation (RTO), as they will ask you for your USI at the time of enrolment into a course. Before starting the online application process, make certain you have the appropriate identification documents handy, as you will be prompted to provide specific information. Examples of acceptable identification include a passport, driver’s licence and Medicare card. What happens if I don’t register for a USI? If you don’t have a USI prior to taking Nationally Recognised Training, Master Builders will not be able to issue training results upon completion. This may result in not receiving a Statement of Attainment or Certificate/Diploma until you have provided your USI to Master Builders. To learn more about the USI, visit www.usi.gov.au

Industrial Relations at the forefront for 2015 In 2014, the building industry saw a strong and repeated focus on aspects of unlawful behaviour and misconduct on building sites. Now, at the start of 2015, we’ll see the continuation of the Royal Commission into Trade Union Governance and Corruption, legislation before the Senate to re-establish the ABCC, and a renewed focus on code compliance, particularly as the standard Industry EBA passes its nominal expiry date. Correspondingly, the Building Leadership Simulation Centre (BLSC) has been inundated with queries about the content of our course “Managing Onsite Industrial Relations” (MOIR) and its applications for site management. In addition to ensuring that participants’ industrial relations knowledge is up to date, attending an MOIR course at the BLSC will allow them the chance to apply their knowledge in a simulated work environment, giving them both
the confidence and fundamental skills required to deliver better outcomes on-site. The many homes of Master Builders Over the course of 145 years, Master Builders Association of Victoria (or Builders Exchange, as it was occasionally referred to in earlier years) has been situated in a variety of fine buildings in and around Melbourne’s CBD, changing locations multiple times since the 1900s mainly to make way for various Government infrastructure requirements.
In a 1966 issue of our previous official publication, Australian Builder, President WT Morris announced that these quarters, too, were to be demolished to provide space for the new ring road which, for whatever reason, never materialised. President Morris realised securing a permanent site close to the CBD was important for our both Master Builders members and the public. So, with a donation from members of A£10,000, he coordinated the purchase of two properties at 332-333 Albert St, East Melbourne.
Builders quarters was performed by the architectural firm of Perrott, Lyon, Timlock and Kesa, the construction was undertaken by E. A Watts PTY LTD. In the December 1966 issue of The Australian Builder, President W T Morris said, “I refer to the Association’s new building, on the construction of which good progress has been made, and which will be finished early in the New Year. It’s [sic] conception, and its taking shape, mark 1966 as the year of a great step forward by the Master Builders Association. It is not a step leading to a “Mark Time.” It is but the first step in a march of progress which will be nourished by the many facilities which the Association’s modern headquarters will provide, and which will enable the M.B.A to become an increasingly beneficial force to the Association Members, Exchange (MMS) Members and the Industry—thus the community--in general.” On the 4th of July 1967, Sir Henry Bolte K.C.M.G, the Premier of Victoria, opened the new building.
In 1911, when J W Swanson was Master Builders’ president, the organisation decided to invest in a property at 380 Flinders Lane; this became the new Builders Exchange. In 1952, the Commonwealth Government purchased the building to make way for the Batman Hill telephone exchange, and Master Builders moved to 23 Clarendon St in East Melbourne.
This site had been the home of John Alfred Porter, Prothonotary (Chief Clerk) of the Supreme Court; he’d built the home for himself first at 332 Albert Street, and then, two years later, a matching house next door as an investment property. Demolition of both houses started in March1966 by Whelan the Wrecker. The design and planning for the new Master
The premises were not only the Melbourne headquarters of the Master Builders Association but also housed the Building Development Display Centre, the Australian Institute of Builders, the government’s Home Finance Advisory Bureau and the administration department of the CSIRO. The original design of this new building was noticeably different from the building we see today, and covered a total of 54,554 square feet and introduced modernising features including electric lifts and air conditioning.

The first floor housed a lightrefreshment kiosk, auditoriums one and two, and a large courtyard garden accessible through the auditorium. Auditorium one was used for film screenings, lectures, seminars and meetings and was attached to auditorium two by way of a sliding wall. Auditorium two was essentially a carpeted meeting area used for smaller meetings and some training classes. A notable design feature was the use of second-hand, 19th century Hawthornmade bricks included in a feature wall that separated the two auditoriums. The ground floor Building and Display Center was a commercial showroom area popular with builders and consumers alike. It featured 300 cubicles, each one displaying mainstream industry products, kitchens, modern gas/hot water services, and fire- rated materials. The centre remained until 2006. The fourth floor, which was occupied by the CSIRO, included a covered outdoor walkway that connected to the adjacent building to the east. All good buildings evolve over time, and this is certainly the case with our East Melbourne offices. The building underwent its first modernisation in 1991, and a second thorough renovation in 2006, yielding to the needs of a significantly expanding membership requiring training facilities, infrastructure upgrades and cosmetic facelift aligned with 21st Century standards. Awards for sustainable home construction: excellence in housing and beyond Dr Phillip Alviano
Housing Awards This year, we saw another excellent group of entries for the Best Sustainable Home category. Each of these entries was of an notable quality and could easily have been selected as a winner in previous years. And choosing a winner was made more difficult by the fact that each one conveyed such warmth during the winter judging period. That, combined with the abundance of natural light, made them very livable homes.

Winner, Best Sustainable Home – Positive Footprints For the second year in a row, Positive Footprints produced a house with not only a Nine-Star NatHERS rating, but also a host of features that will further reduce ongoing energy use. The house included a standby switch, external awnings to the north to keep out the summer heat and phase-change materials in the second storey. These materials act like thermal mass to moderate temperatures; they absorb heat from the air in summer and release it as the temperature inside the house cools. In winter, they absorb warm air during the day and release it as the indoor temperature cools overnight. The requirement for air conditioning was also reduced with the use of an earth cooling tube that ran underground through the garden and delivered cooler subsurface air with the aid of only a small fan. Considerable thought also went into both the selection and use of materials,
as well as their environmental impact. The concrete used contained recycled aggregate, fly ash and recycled reo. Polished concrete floors added to the thermal mass and their look was highlighted with the integration of polished recycled glass pieces. All the timber was either radially sawn, laminated, FSC-certified or TanE treated pine. Indoor air quality was protected by the use of formaldehyde-free and FSC-certified cabinets, and VOC free waterproofing and glues.
Homes who managed this with a house with a raised timber floor on stumps. Other features included a standby power switch at the front door, eavevented exhaust fans with dampers, zero-formaldehyde joinery and lowVOC paints. The entry from the Profine Group again showed that it is possible to deliver an Eight-Star home for the volume builder market. Interface Constructions wins Premier’s Small and Medium Enterprises sustainability award One of our Master Builders Green Living Builders, Interface Constructions, was announced as a winner in the 2014 Premier’s Sustainability Awards for their work in becoming Australia’s first carbon neutral building company. It’s a great recognition of their efforts. Sustainability Victoria CEO Stan Krpan congratulated the Interface Constructions team for their innovative work and said they are an excellent example of leadership in sustainability.
Special Commendation – GJ Gardner Homes, Geelong This year a special commendation was awarded to GJ Gardner Homes in Geelong recognising the achievement of designing and building a NineStar house for the volume builder market. Showcasing this as a display home alerts potential clients to the possibilities and benefits of an energy efficient home, bringing them into the mainstream market. Finalists The two finalists were both Eight-Starrated homes, which again shows the ability of our builders to really push past the minimum Six-Star requirements. Energy Efficient Windows: Air Infiltration A few editions back we talked about one aspect of an energy efficient window, that being “frame conductivity”. This month’s focus is the effective sealing of windows. No matter the thermal qualities of the frame or glass, if the product doesn’t seal the inside from out when required, performance is compromised. Also known as “air infiltration”, this measure is used by the Window Energy Rating Scheme (WERS) when calculating star ratings. To achieve high performance windows – and effectively exclude draughts and water – Rylock products typically feature two seals on every opening element. Standard on all AA Series hinged doors are multipoint lever compression locks, which offer excellent seal compression. Home Warranty Eligibility - changes in trading structure Failure to advise your broker of a change in trading structure may affect your ability to access your Home Warranty Insurance. Joe Keiper

Recent changes to the VMIA’s administrative processes have further increased the importance of ensuring that your domestic building contracts are signed as the same entity that holds your current Home Warranty Insurance Eligibility facility. Your business may be registered in the name of a sole trader, in a partnership of two or more individuals, an incorporated company, or any one of these three as trustee for a trust. This is dictated by the Australian Business Number (ABN) attached to the business. Any discrepancies between entities listed in your Letter of Eligibility and any contracts will result in delays. In the event that you are looking to change your trading structure (e.g. from a sole trader to a company, a company to a trust, etc.) you will need to advise your insurance broker in order to ensure that the Home Warranty
Insurance is not void when signing domestic building contracts with home owners. Your broker will work with you to submit the necessary information to the insurers. Depending on the annual turnover requested, the insurers will take from eight to 40 business days to respond; the majority of applications are assessed within eight to15 business days. Following the completion of the assessment, eligibility will be held under your correct trading entity name and ABN. Please note that depending on the information supplied initially there may be a request for further information which your broker will contact you to discuss. If there is a change in the entity name, but no change in ABN, you are still required to advise your broker and provide them with the ASIC Name Change Certificate. This ensures that the entity name in which you are signing contracts will be identical to the entity name displayed on your Letter of Eligibility. Depending on the timing of your previous assessment, you may be required to provide updated financial and business information to support this change.

The date on which works reached completion is relevant to the following matters (amongst others): • the limitation period for Building Actions • satisfying the requirements of the Building Act 1993 (Vic) and Domestic Building Contracts Act 1995 (Vic) • satisfying the requirements of a building contract • the period of cover under a VMIA Builders Warranty Insurance Policy (for domestic works valued at more than $16,000). The period of time in which an owner can bring a legal action (including a counterclaim) for damages for loss or damage arising out of, or concerning, defective building work (“Building Action”) is set out in section 134 of the Building Act 1993 (Vic): “Despite anything to the contrary in the Limitation of Actions Act 1958 or in any other Act or law, a building action cannot be brought more than 10 years after the date of issue of the occupancy permit in respect of the building work (whether or not the occupancy permit is subsequently cancelled or varied) or, if an occupancy permit is not issued, the date of issue under Part 4 of the certificate of final inspection of the building work.” Importantly, section 134 uses the date of issue of a Certificate as the trigger for the period of time in which a Building Action can be brought (sometimes called a “limitation period”). In such circumstances, once the limitation period has expired it is too late for the owner to commence a Building Action (although there may exist some exceptions to this rule, which are beyond the scope of this article).
Builders should not, however, interpret this article to mean that they provide a comprehensive 10 year warranty/ guarantee for their work. A limitation period refers to the period of time an owner has to bring an action, and if an owner does so, it must still prove the legal elements of its case if it is to be successful. The application of section 134 has recently been considered in the Victorian Supreme Court of Appeal decision of Brirek Industries Pty Ltd v McKenzie Group Consulting Pty Ltd [2014] VSCA 165. This decision confirmed that a Building Action, including claims founded in contract (for example, breach of an express or implied warranty) and claims founded in tort (for example, negligence) can be brought within 10 years from the date of issue of an occupancy permit. Sometimes builders delay obtaining or handing over a Certificate as leverage for securing payment of a final claim by the owner. Domestic builders should be aware that this behaviour is prohibited under section 42 of the Domestic Building Contracts Act, which says that a Builder is not allowed to demand payment until: a. the work carried out under the contract has been completed in accordance with the plans and specifications set out in the contract; and b. the building owner is given either— (i) a copy of the occupancy permit under the Building Act 1993, if the building permit for the work carried out under the contract requires the issue of an occupancy permit; or (ii) in any other case, a copy of the certificate of final inspection. In addition to the requirements of section 42, both domestic and commercial builders should be aware that it is highly likely the provisions of their building contract will require a Certificate to
be issued in order for the works to have reached completion (or practical completion as the case may be). In such cases, the Certificate is a trigger for any entitlement to payment and also commencement of any defects liability period under the building contract. Owners have an incentive to obtain a Certificate in order to legally occupy a building under the Building Act and to obtain home insurance for the works. This is because section 39 of the Building Act prohibits an owner form occupying a building without an occupancy permit (in circumstances where the building permit states that an occupancy permit is required). The penalty for breaching section 39 is up to: • 120 penalty units for a person; and • 600 penalty units for a body corporate, where the value of one penalty unit is currently $147.61. Domestic Builders have an incentive to obtain a Certificate as soon as possible in order to be sure about when the period of cover under the VMIA Builders Warranty Insurance Policy commences. This is because that policy describes the period of cover with reference to “completion” of the works and the definition of completion incorporates the issue of a Certificate. Domestic Builders may also have an incentive to obtain the Certificate in order to “close off” a job for the purposes of maximising their eligibility for builders warranty insurance (subject always to QBE/VMIA’s policies and procedures). SWMS feature in VWA prosecutions The Victorian WorkCover Authority (VWA) brought about John Darcy Manager, OHS 31 constructionindustry-related OHS prosecutions during 2014. The construction industry represents more than one-fifth of the OHS prosecutions (126 in total) during 2014. The 31 prosecutions related to a variety of OHS breaches. Incidents involving falls from heights, unlawful asbestos removal and work in close proximity to powerlines (‘no-go zones’) were particularly prominent. OHS breaches are indictable offences (i.e. providing for a criminal conviction). Convictions were recorded by the courts in nearly half of the construction prosecutions and, as a consequence, those companies now have criminal convictions against their names, in some instances potentially affecting their ability to tender for work. The VWA used the absence of adequate Safe Work Method Statements (SWMS) for evidentiary purposes in a number of prosecutions, highlighting the importance for both builders and subcontractors to produce SWMS from a legal perspective but, more importantly, from a safety perspective. The VWA prosecutions included three Principal Contractor (i.e. builder) prosecutions. These prosecutions
involved charges against the Principal Contractors for failing in their duties as ‘persons with management and control of the workplace’. These prosecutions highlight how builders can be prosecuted as a consequence of the safety failings of their subcontractors. The list of prosecutions also included three multi-party prosecutions with three defendants charged in relation to a single incident (i.e. builder, subcontractor and pyramid subcontractor) and two defendants charged in the two other matters. A self-employed subcontractor was also prosecuted for failing to meet his duties. There were no employee prosecutions. The VWA prosecuted two construction entities for failing to notify the VWA of notifiable incidents. The OHS Unit urges members to call for advice as to whether an incident is notifiable as early as possible should an incident occur. The VWA have advised that they are now starting to track in-patient hospital admissions as a means of recording notifiable incidents, and that incident notification will be a strategic area of focus in 2015. The largest fine issued to a construction business (specialist contractor) in the last twelve months was $350,000, with another construction company fined $100,000 in relation to the same incident.
Master Builders continues to lobby the VWA to educate small business subcontractors and builders around the requirements for SWMS. A significant portion of the incidents, and subsequent prosecutions, relate to the housing construction industry where compliance with the requirements for SWMS and OHS Coordination Plans remains low. Members are reminded they are entitled to free safety audits as part of their membership. The OHS team at Master Builders have extensive experience in construction safety, offering a fresh set of eyes when it comes to identifying hazards. Businesses with fewer than 20 employees and a current Victorian WorkCover insurance policy can also take up the free, VWA-funded three-hour small business consultancy service provided by the OHS Unit. More than 1350 members have already utilised this service. Members are urged to call the OHS Unit on (03) 9411 4555 for advice following any major incidents. Clearly, it is our preference to assist members with advice and guidance in advance of something going wrong.

The lending landscape in 2015 In the face of a faltering economy, the Australian Prudential Harry Pontikis Director, MBA Financial Regulation Services Authority (APRA) will clamp down on lending to property investors. The APRA suggested banks need to keep the rate of growth in loans to property investors below 10 per cent a year. It warned that it’s ready to force banks to hold more capital, which would lessen the banks’ profits. The steps represent a dialling up of the intensity of the APRA’s supervision proportionate to the current level of risk and targeted at specific high-risk lending practices. The APRA formally asked banks to ensure new borrowers can cope with mortgage repayments when interest rates are two per cent higher than they are now. In a separate but related announcement, the Australian Securities and Investments Commission (ASIC) said it is conducting a probe into banks that provide interestonly loans as part of a broader review by regulators into home lending standards.
The actions by the ASIC and APRA, as well as David Murray’s Financial System Inquiry, attempt to introduce tighter controls and scrutiny on banks’ capital reserves and lending, and are likely to have a massive dampening impact on the market in 2015. Among Murray’s key recommendations are two which may negatively impact property prices and access to loans: • The banning of self-managed super funds from borrowing to buy assets, such as shares and property • A request for the banks to hold more equity (or shareholder capital) relative to their loans, supposedly making the big banks safer and more durable in the event of another financial crisis. The RBA Governor Glenn Stevens said that the introduction of tough new constraints on investment property lending raises the RBA’s scope to cut official interest rates without fear of overinflating the property market. All the commentators and experts seem united in their endorsement of the proposed changes. There is, however, an alternate view to consider—one where all the additional costs borne
by the banks are not passed on to shareholders but, instead, to their customers and, more specifically, to businesses with loans. If the Reserve Bank decided to further reduce the cash rate, the banks may choose not to pass on all, or any, of the drops and just use the fall to further bolster their profit margins. This strategy would be typical of the banks as shown in the downward cash rate cycle over the last five years, in which banks significantly increased their profits, retained their standard variable interest rates and only selectively passed on discounts to clients introduced by brokers or their selected clients. In this cycle, some consumers benefited from reduced home loan interest rates and banks benefitted from higher profits; the only losers were businesses, which carried the greatest burden, paying high fees, charges and interest rates and faced greater lending scrutiny. Benefitting from today’s easy access to credit, cheaper-than-usual loans and buoyant property prices would be more favourable than waiting for all, or some, of the proposed changes that are forecast to come into play during 2015.

Chris gets compo assistance For many years, Chris from Case Study Construction enjoyed the good fortune of never having an employee absent from work on workers compensation... until today. Chris knew the moment he saw his carpenter, Charlie, step awkwardly off his ladder and twist his knee that he was going to be off work for at least a couple of weeks, and would require a fair amount of medical treatment. A phone call from Charlie the next day confirmed that he had been given a fortnight off work, and that he was going to need arthroscopy and some physio. Chris knew he had a worker’s compensation insurance policy, but he had no idea about the process of making a claim. So he picked up the phone and rang David Muller in the OHS Unit at Master Builders. David advised Chris to make sure Charlie obtained a WorkCover Certificate of Capacity for his absences and talked Chris through the process of helping Charlie to lodge his claim for compensation.
“Wouldn’t it be easier if I just paid Charlie for his few weeks off work and his medical expenses?” Chris asked. “There are a lot of employers who make that mistake,” David advised. “Unfortunately, when a worker is injured you have no idea how much their injury might end up costing. Covering Charlie with a WorkCover claim protects both of you. We always recommend that members should manage work-related injuries through the WorkCover system. “Under the WorkCover scheme you will be liable for the first ten days of missed work and the first $660 in medical expenses; anything after that is covered by your WorkCover insurance policy. “The WorkCover scheme covers you for all costs associated with your employee’s injury beyond your excess, including all expenses for reasonable medical services, legal fees and even common law. “The amount of cover that your WorkCover insurance policy provides is actually very significant, and could
potentially save you hundreds of thousands of dollars,” David said. Chris knew he could talk to his WorkCover Agent for advice about the claims process, but he felt confident that he could also get advice about his worker’s compensation obligations from Master Builders. “For a small business in Victoria, a worker’s compensation claim is a oncein-a-nineteen-year experience,” David advised. “We can talk you through the process of managing a worker’s injury from day one right through to the end of the process, and can help you understand your obligations and the associated risks.” Chris was pleased to know that in addition to industrial relations and occupational health and safety advice he was also able to access guidance on worker’s compensation as part of his Master Builders membership.

BENDIGO The Bendigo Section celebrated the end of a very busy 2014 with Christmas drinks and nibbles at the Hibernian Hotel in Golden Square. Craig Webster, chairman of the Real Estate Institute of Victoria Bendigo division, believes the strong housing growth in the City of Greater Bendigo region will continue in 2015. The city’s economic growth rate is at 3.4 per cent, having outperformed other key regional centres in Victoria, NSW and Queensland since 2006. With around 4,200 approvals over the past four years, Council Strategy Manager Trevor Budge believes the local housing construction sector is expected to remain strong into the foreseeable future.

In 2015, we look forward to another busy year of events and training in all areas. Mildura will see the first of these with a six-day course for Certificate III in OHS to be held at the Hotel Mildura on 28-30 January and 4-6 February from 9.00AM – 5.00PM. This course forms part of the knowledge required to obtain a Commercial License in Victoria. Funding may be available. A Certificate IV (Building) will again be commencing in February in the Wodonga Office and running through until June. We held a Trade Night in Bairnsdale, a Sector Breakfast Meeting in Cowes, and Traralgon was the site of our AGM, a Certificate III WHS course, and the world famous Gippsland Golf Day. At 10am on the first day back from her Christmas holiday, cadet building inspector Catherine Larkin was already mid-stride in addressing a minor crisis for one of the local builders who rely on the Wodonga Master Builders team for their expertise. Prior to pouring a slab, the builder had performed the excavation in the wrong spot. “Definitely a worry, but not unheard of,” Catherine said good-naturedly. Indeed, these days, she seemed to attract some troublesome projects. Catherine, who has been with Master Builders for three years, began as a building services coordinator, performing the myriad clerical and organisational tasks involved in helping members shepherd their projects through council approval, and to completion. Last year, eager for a fresh challenge, she enrolled in distance learning to qualify as a building inspector. Thanks to ample previous experience, including work as a qualified draftsperson, a two-year program was fasttracked by half; this was the eve of her completed studies. “Until then, I’m performing as many inspections as I can,” Catherine said. “The comforting part is that I’m still always with another building inspector while we do the site checks. But I like a good challenge, and there are so many people who are openly supportive of me. And I really enjoy my work.” Outside of office hours, and especially during the hot spells, she and her partner head to the river with their dog for decidedly unstructured frolicking time. Catherine worries that it sounds trite to say so, but she takes pride in the level of service she and her colleagues provide to the building community. “We really do go out of our way to help them,” she says. “With new builders especially, we can almost become project managers. You can feel the stress they’re under to get things done, and we do a lot of hand-holding to get them through their projects. And with that level of assistance they come back to you continually. That’s pretty gratifying.”

When someone tells you they work in insurance, seldom do they follow it with “and I love what I do”. But that’s exactly how Master Builders Insurance State Manager for Victoria Joe Keiper feels. Joe started at MBA Insurance Services (MBAIS) just six months ago, but this follows a 20-year career that began with his first dip into the cloudy waters of the insurance industry in 1995. Back then, Joe was working at a cafe when a friend from his baseball club asked if he knew anyone who would be interested in a job at NRMA Insurance. It struck Joe as a good prospect, and he decided to apply for the position himself. Securing the job, he moved up through the ranks, happily immersed in the details of a career that has few convincing public advocates. So what exactly is it about the insurance business he appreciates so much? “I really enjoy that I’m dealing with such a variety of clients,” Joe says, “—from those who have $100 millionplus businesses right down to those who build only one or two homes per year. Each of their expectations is different, and what they do is different. “Consequently, what we do for them is different, too. And to me, that’s really interesting. So when it comes to claim time, it’s fascinating because something has gone wrong, so how do we get the client looked after as quickly as we can? It’s the diversity of what we do. Every day is different.” Few of us would have guessed that the business of insurance offered such variety. When asked what he’d be doing for a living if he wasn’t in the insurance industry, he didn’t have a ready answer – other than musing he’d like to play more baseball. And while his three children keep him busy, he still manages to play reserve grade baseball for St Kilda. MBAIS is a specialist construction insurance broker that invests all its profits back into the building and construction industry. It has been in operation for over 25 years and currently employs 38 people specifically dedicated to the Industry.

Pasquale J De Magistris • Housing member • Based in Moe • Member since 1983
Pasquale (Pash) De Magistris had held a safe and secure job at the State Electricity Commission of Victoria (SECV) for 13 years when he decided to take a huge change of direction and begin his career in the building industry. It was in the 1980s that Pash’s friend, a local bricklayer, asked for his help with building residential units in Moe. It was a tough decision at the time, and one that made Pash’s parents uneasy; he and his wife were supporting a young family, and finances were tight in those early days. But, more than 30 years later, Pash remains active in the building industry, with a great deal of enjoyment and satisfaction to look back on. Pash’s career has included a diverse range of projects, including new homes and renovations, commercial buildings and retail fitouts. He specialises in maintaining a small, talented crew that addresses a broad spectrum of tasks for every build. And Pash himself has taken on nearly every aspect of the trade, including carpentry, concreting, tiling, painting and concrete tilt panels. If you can name it, Pash has done it.
When asked what aspect of the industry has changed since he started his career, Pash identified the pace at which work gets completed. “With the widespread use of nail guns and roof trusses, everything is expected to be complete within a much shorter time frame,” he said. “This creates a very hectic pace, and can make it harder to make the time to train people, especially apprentices. With time pressures always significant, it‘s difficult to teach the first and second year apprentices the basics of the trade.” Pash celebrated his 30th year as an enthusiastic Master Builders member last year. David Watson prides himself on having built his company with innovative design, trustworthy and upfront advice, and great support throughout the entire building experience as his guiding principles. Growing up and living in Apollo Bay on his parent’s dairy farm, it became apparent at a young age that it was a lifestyle that David did not envisage for himself, so he moved to Melbourne to pursue his ambitions. In 1990, he began an Associate Diploma of Applied Science in Building Construction on a part- time basis, first at Swinburne University and then completing his studies at Holmesglen TAFE. He gained the necessary practical experience in and around the Bayside suburbs with a close friend and mentor at ARJ Constructions. In order to consolidate and update his knowledge of the construction industry, David also completed the Master Builders Domestic Registration course, which gave him the necessary preparation and confidence to achieve his aspirations and become a registered builder. After living in Melbourne and building his family home at Hampton, it was in 2007 that David and his family decided it was time for a change of lifestyle and made the move back to the country, citing the “high quality of life you get from living and working in that setting” he felt was important. They now reside at Lake Modewarre. Elementary Building & Design Pty. Ltd caters for all types of domestic construction. At this stage, it is all clientbased work, most of which comes by word of mouth.
“The greatest part of being a builder is working closely with your client—understanding their needs, communicating at all times and then transforming their dreams into a reality,” David says. “It really gives you such a sense of satisfaction! I believe it’s a privilege to have a career that keeps you active and interested with such a variety of projects, each with their own challenges, and knowing that you have been able to turn something on paper into a reality. And then you get to see the client’s reaction to their finished product!” “The construction industry is an everevolving landscape with continual changes to legislation, processes and products,” he observes. “Ït would be great to see all trades registered, which I think would reflect an industrywide professionalism.” David believes joining Master Builders has given him leverage and an edge with business opportunities, as the brand is very strong with consumers. “I like the designation ‘Master Builder’, he says. It means something to me, as it communicates that we know what we’re doing! I love being able to include the logo on my business cards and advertising; it means I am a part of a strong and professional organisation.”
It’s a great industry, and it needs young people. It’s a life skill to take with you. I enjoy the variety of locations I get to work in; some days it doesn’t even feel like work”! In his spare time, David loves to fly microlight aircraft, and has done so for the past 16 years. “It’s like riding a motor bike with a fantastic view,” he says. And living close to the water gives him easy access to fishing and windsurfing. The pride and passion David brings to both Master Builders and his own practice is reflective of the spirit he brings to the work he undertakes. They distinguish him as a businessman, a builder and a valued member.

Premium Showers and Robes launched in 1998 as a small factory in KeaIba in Melbourne's North West Suburbs. Its original three directors—cousins Oscar and Michael Dudok, and exCarlton Football Club Premiership player Peter Brown—each remain active in the business today. From humble beginnings, Premium has grown to become a market leader in Victoria. Its head office and manufacturing facility are now located in Laverton on a 15,000-square-metre site, and the number of employees and subcontractors has bloomed to 250. Products manufactured at this facility include shower screens, wardrobe doors and internal shelving, splash backs, mirrors and, most recently, kitchens. Kitchens offered Premium an exciting opportunity to grow and develop the products and service they offered to customers. What began as a small endeavor with a couple of existing builder clients has blossomed into a fullydeveloped business within the business. With branches located in Springvale, Geelong, Bendigo and Albury NSW, Premium is well positioned to service all sections of the builders market which
includes the trade, retail and commercial sectors such that at any given time, Premium has approximately 5000 jobs "live" in its system. The company has a particularly strong commercial market presence supported by a dedicated team of estimators and fitters who are highly experienced and equipped to facilitate supplying and fitting products in high-rise developments. These projects often come with their fair share of programmatic challenges, with occupational health and safety considerations a major and continuing facet. general feature AUSTRALIA HAS AMONG THE MOST DESTRUCTIVE TERMITES IN THE WORLD. EACH YEAR, TERMITES CAUSE DAMAGE WORTH MILLIONS OF DOLLARS TO BOTH HOMES AND BUSINESSES. One in five Australian houses have encountered termites at some stage. Importantly, brick, steel-framed, concrete panelled and timber-framed buildings are all at risk of termite attack. Whether damage is structural or decorative, building owners are the ones who must endure treatment and repair costs. Termites are secretive by nature. They are almost never seen until damage has already been done. Termite management product manufactures and professional pest managers have developed a wide range of technologies and strategies to help prevent and treat infestations by different species of termites attacking a variety of types of buildings, under a wide range of environmental and climatic conditions. The main strategies employed these days include: 1. Liquid termiticides Liquid termiticides have been the basis of tried and trusted termite management in, on and around millions of Australian properties over many years. There are two main classes of liquid termiticides: non-repellent and repellent. Repellent and non-repellent termiticides both kill termites, but they act in different ways. Both are applied to soil, generally surrounding premises, either as a drench into a purpose-dug trench or via injection through surrounding paving in sufficient quantities to saturate the soil. The product of such a treatment is commonly referred to as a ‘treated zone.’
Non-repellent termiticides are also often used to inject, direct into termite nests or infested trees. Non-repellent products cannot be detected by termites. By and large, they are relatively slow acting, allowing many if not most termites which have entered a treated zone sufficient time to return, with termiticide on their skins or in their guts, to their colony. After a time, affected termites become disorientated, stop grooming (an essential element to termite health) and die. Currently, only repellent products are registered for pre-construction open hand spraying. 2. Physical barriers Australia has registered a significant number and wide range of what are generally termed, ‘physical barriers.’ Such barriers include stainless steel mesh, ant-capping shields, graded stone aggregate, flashing shields, termite-resistant plastic barriers and termite-resistant sealants. Properly installed, all registered physical prevent termites from gaining undetected entry to buildings. Importantly, they do not prevent entry, only undetected entry. That is why they must be expertly installed, with the full help, cooperation and involvement of builders, to avoid gaps or cracks or ‘cover overs’ or bridges, because termites are extremely cunning when it comes to finding chinks in even the toughest armour. 3. Non-soil matrix chemical barriers By design, non-soil matrix chemical barriers and ‘blankets’ are very similar to physical barriers in that they force termites into areas that can be readably inspected. On top of that, however, they can also act as moisture barriers.

Non-soil chemical barriers and blankets currently come in two formats. The first is a synthetic fibre incorporated with an active constituent (long lasting, repellent termiticide) glued between two plastic sheets. The termiticide is applied during product manufacture. The other, newest, format is a single sheet of plastic with an active termiticide incorporated during the manufacturing process. 4. Reticulation systems Reticulation systems comprise a series of interconnected pipes or conduits that are either perforated or have closely spaced emitters that release either repellent or non-repellent termiticides into the soil under or around buildings. They are generally installed by professional pest managers during the early part of the construction phase. Properly installed, the piping releases liquid termiticide into areas where, normally, drilling or cutting would be required to apply termiticide for a post-construction treatment. 5. Termite monitoring and baiting systems Termite monitoring and baiting systems are a more recent development in the professional pest management armoury but have quickly become the preference for both pest managers and their clients in the postconstruction market due to their safety profiles and effectiveness. Monitoring stations can be strategically installed around the external perimeters of properties, and other areas such as frequently watered garden beds or around out-buildings.

Termite detection (monitoring) devices within the stations are checked for termite attack (hits) on a routine basis. When a station becomes active, slow acting termite-specific toxicant bait is placed in the station awaiting contact and consumption by termite workers.
Unlike baits, termites do not ingest dusts as a food source. Rather, they rely on contaminating the skin of termites and their social tendency to groom and pass food to each other and therefore transfer minute amounts of lethal toxicant.
Once termites have consumed the bait, they return to their colonies where they transfer the toxicant to other workers, soldiers, immatures and the queen … eventually, depending on size, species and time of the year, producing colony elimination.
Neither monitoring and baiting systems nor termite dust are employed during building construction. They are, however, often called on very early in the life of many buildings which either have no pre-construction system in place or where, due to poor installation or inappropriate breaches of installed defences, or inadequate inspections, termites have been able to infest.
6. Termiticide dusts Termiticide dusts have made a comeback in recent years with the release of some new and highly termite-specific formulations and active ingredients. One dust is similar to baits in that the active ingredient is an insect growth regulator. Another recent development uses a similar active to that employed as a non-repellent soil and nest treatment termiticide. Another dust still being used is an old formula relying on arsenic.
The first three approaches are ideally taken during the construction phase of a building project and should be planned in consultation and conjunction with builders to produce reliable, comprehensive and complete termite management systems, customised to the specific requirements of each site. Such systems, designed, installed, and maintained professionally, and backed by strong and extensive warranties, have
the potential to add significant value to construction projects of all sizes and, positioned the right way, are perceived by consumers as offering significant value for money. Working together Without doubt, the number one key to the success of any pre-construction or ‘during construction’ termite management system or program is a strong working relationship between the builder and the professional pest manager. Too often, we find termites gain entry where otherwise sound systems have been damaged or not completed. Damage sufficient to allow undetected termite entry can be a simple tear in a barrier or disturbance of soil in an otherwise complete chemically treated zone. Lack of completion can range from: a failure to reseal or reapply sealant where a penetration has been moved or removed; making stake or level peg holes; failure to apply boundary construction joints; to building paths around or setting gardens up against the structure above the inspection zone or barrier level.

Waterproofing – it’s worth getting it right the first time

MOISTURE CAN BE THE ARCH NEMESIS OF ANY BUILDING STRUCTURE. RAIN OR WATER INGRESS DURING CONSTRUCTION CAN CAUSE LENGTHY DELAYS AND ADD UNFORESEEN AND UNBUDGETED COSTS. HOWEVER, IT’S CRUCIAL TO ASSET OWNERS THAT STRUCTURES ARE EQUIPPED TO DEAL WITH THE THREAT OF MOISTURE DAMAGE OVER THE LONGER TERM, AND NOT JUST FOR THE BARE MINIMUM OF DEFECT WARRANTY PERIOD. Water ingress is the most significant root cause of building remediation costs. Aside from the immediate damage to contents, repairing defective waterproofing can be a particularly intrusive, labour-intensive and costly process. Spending on remediation can skyrocket the longer the damage is left unaddressed, as the structural integrity of the building can be compromised. Moisture can enter structures in a variety of ways so it’s necessary to comprehensively safeguard against all possible circumstances. All building structures, from residential properties to world-class commercial high rise developments require effective waterproofing systems that have been specified and installed to meet the particular demands of the structure.

Waterproofing system technologies for balconies, decks, and roofs can all have differing requirements depending upon their intended use. Will areas be subject to constant direct foot or vehicular traffic? Are they directly exposed to UV?
particularly important in designs that incorporate natural materials and technologies as well. Forest Lodge House Eco is an exceptional example of all players implementing best practice design to achieve this.
Successful design and installation of waterproofing technologies within all buildings is critical. Buildings incorporating living and green roof technologies are becoming more commonplace in Australia with shining examples like Forest Lodge Eco House, which received multiple accolades in the New South Wales Master Builder Excellence in Housing Awards and was featured on the popular Grand Designs TV show.
Design guidelines and standards, such as those found within the Building Code of Australia and appropriate AS/NZ Standard provide direction to design and installation of appropriate waterproofing systems. AS 37402010 and AS/NZS 4588-2004 provide guidance on the waterproofing requirements for domestic wet areas and wet area membranes respectively.
The relatively recent trend in Australia towards ‘transport oriented development’ inner city living, along with building requirements for sustainable, energy efficient buildings has helped to promote the demand of green roofs and walls. These buildings help to reduce demand on infrastructure through storm water capture and reuse systems, as well as act to reduce the Urban Heat Island affect that is associated with urbanised lifestyles. People now have a higher expectation of their ‘living space’ requirements where the outside and inside environments merge. Collaboration among all stakeholders regarding waterproofing systems is
The AS4654.2 regulation on waterproofing membrane systems for aboveground design and installation provides direction in the appropriate design and installation methodologies of waterproofing systems. While some damage to waterproofing does occur during construction, a large proportion of waterproofing failures can be attributed to either incorrect or insufficient attention to detailing. Belowground waterproofing presents its own unique set of parameters. Consideration of external factors such as soil geology, hydrological conditions, environmental factors and intended use of the space will aid in determining which of the various waterproofing technologies can be required for

belowground parts of structures such as basements, and cellars, as well as retaining walls. Waterproofing structures that are water retaining or subject to hydrostatic pressure require careful design, shrewd selection of materials, as well as skilled workmanship. Onsite quality control has a big part to play in ensuring optimal waterproofing results. Careful attention must be given to concrete mix design with consideration for use of hydrophobic pore blocking or crystalline growth type admixtures. Joint design is also critical, as consideration must be made for construction realities such as occurrences of poor concrete placement, as well as geological factors. Interestingly, Australian standards don’t cover all facets of waterproofing requirements. Given that some elements remain unregulated, there exists no clearly defined standard for below ground waterproofing. British Standard [BS] 8102:2009 is a code of practice for protection of belowground structures against water from the ground. This code of practice promotes a holistic approach to achieving successful waterproofing outcomes, which involves all stakeholders working together to develop a strategy and robust specification during the design stage, which is followed right through the construction process. During the requirements analysis phase it is recommended to assess geological conditions of the site for presence of contaminants that may compromise the integrity of the concrete as well as for the presence of hydrostatic pressure. Consideration should also be given to future developments, which may impact on the waterproofing requirements of the structure. BS8102 further states that typically waterproofing failures are due to construction issues and lacking attention to detail. Due to these factors, secondary and even tertiary levels of redundancy are recommended to be
included during the specification stage for areas within the structure that have higher levels of requirement. As previously stated, the cost of remediation far outstrip those of new installation so any savings in time and budget made during construction are quickly lost by not correctly assessing the waterproofing requirements within the building. In summary, the key to the success of a waterproofing installation is to thoroughly understand all of the various
requirements of a project. Specific waterproofing systems should be included at the project design phase. Materials suppliers should be Quality Assured, and have a long track record of providing quality products that are compliant with the various national, or international standards. Only waterproofing applicators that have been approved by the material supplier and have proven project experience that is relevant to both the scale and scope of works should be engaged.

general feature Installation continues to be the major problem for the performance of windows and glazed doors throughout Australia. Stories are commonly heard about window and door systems that have not failed; however their installation has. Large amounts of time and money are spent investigating what has been thought a failed window system, only to discover the issue is installation. In fact, around 80 per cent of all window complaints are attributed to installation and care issues during the construction period. There has been an increase in failures with the introduction of light weight construction methods, highlighting that we may have, in fact, had issues with installation for a considerable time. Our normal methods of construction have been fairly forgiving and may have hidden this fact. We constantly see damage to ceilings, floors and walls and the blame for these issues unfairly being attributed to window systems. It is also becoming more common in the commercial building sector to remove sub frames from windows and glazed doors. This can be a recipe for disaster. Correct practice is to use a sub frame to isolate the window system from the building, to ensure the functionality of the system and improve water penetration resistance. Facts • Severity of exposure to wind is the most important factor in the specification and installation of windows and doors in openings. Components and installation practices acceptable in sheltered situations may

quickly fail when exposed to the full force of the wind and rain. • Follow the window manufacturer’s installation specification for the appropriate Terrain Category and height of building; many manufacturers’ brochures provide information for sheltered buildings no more than one storey high. Failures that occur as a result of poor installation: • Water ingress into the building around the window and door systems causing damage • Leaking window systems • Windows blowing out of openings creating dangerous conditions and building damage • Window or door system functionality failure Common causes of failures: • No flashing, poor flashing or poor wall penetration preparation • Blocked drainage holes of the window or door system not allowing drainage to the outside • Inadequate fixing of window or door system • No packing between building structure and window or door system • Window and door systems installed out of square and plumb • Poor construction methods or no clearance creating loads on the window and door systems Windows must be installed square and level, they must have packers between
the window frame and house frame, they must be fixed appropriately to comply with the specified wind loads, and they should, in most situations, be flashed to ensure any water penetrating around the window or door is not allowed to enter the inner skin of the building and cause damage. They should be installed according to the manufacturers’ instructions or to the AWA’s generic installation and fixing guides if there are no manufacturers’ instructions. Many site failures would be avoided if the industry would spend a little bit more time and care while installing windows and doors. National Construction Code Requirements The Building Code of Australia is not as clear as it could be when it comes to installing windows and glazed doors. The clauses that referred to flashing of windows and doors in Volume 2 with some diagrams are Parts 3.3.4 and 3.5.3, in Volume 1 with clear instructions under FP1.4. A roof and external wall (including openings around windows and doors) must prevent the penetration of water that could cause: a. unhealthy or dangerous conditions, or loss of amenity for occupants; and b. undue dampness or deterioration of building elements. Then there are the energy efficiency requirements. The sealing of gaps and cracks is an important part of this.

Correct Installation Four key steps to installing windows and doors are: 1. Square and plumb – This will ensure the functionality of the system. 2. Packing – Packing between the window and building frame ensures the frame remains square and plumb and adds strength to the nail or screw fixing. 3. Fixing – The window or door needs to be fixed to enable the system to withstand the wind loads applicable to the site. 4. Flashing – Windows and Doors should be flashed to stop water penetration around the outside of the system; this is the responsibility of the installer.

Installing Frames Correctly 1. Fit flashing to window surround as required. 2. Measure the frame opening to ensure that there is sufficient room for the product and additional packing. Stud Opening: Height = O/A reveal size + adequate clearance Width = O/A reveal size + adequate clearance Clearance dimensions vary between manufacturer’s products. For adequate clearance refer to window manufacturer’s instructions. 3. Frame must be packed plumb, square and not twisted between the openings. Ensure the sill is fully supported; failure to do so may result in sill roll on sliding windows. Sills on all windows and doors must be straight and level and should be packed and secured. 4. Secure aluminium windows by nailing through reveal in brick veneer applications. Timber windows should be secured by back nailing through stud, not face of frame to stud. Alternatively, on cavity brick construction use galvanized building lugs located at 450mm maximum centres. 5. If it is not possible to backnail, wedges should be installed between the window and the building frame to prevent opening of the frame joints when nailing is carried out.

6. Keep sashes closed whilst installing frames. 7. Sill bricks should be at least 10 mm clear of window frame to allow settlement in brick veneer construction. 8. Do not stand on the windows or doors, or use them as a support for scaffolding, or slide material through the frame. It is important to prevent any damage to windows and doors during construction. 9. Do not permit weight of eaves or arch bars to bear on any window or doorframe. Windows and doors are not load bearing. 10. Remove cement mortar and plaster droppings from windows immediately, taking care to avoid scratching glass and/or frames,
as permanent damage can result. Immediate attention must be given by washing off with water before material sets. 11. To ensure the satisfactory long-term performance of sliding doors, the sill should be fully supported. Where the sill projects during construction the sill should be fully supported with temporary supports until sill bricks or tiles are installed. Battery powered power tools have become the tools of choice in the tradie’s tool bag. But as the number of serious injuries associated with their use rises, it is apparent many users aren’t treating them with the respect they deserve, warns TY GRAHAM It wasn’t that long ago when the apprentice electrician would have to auger holes through wall studs with a brace and bit to run his wiring, or the cabinetmaker would secure cupboards to the wall by screwing in slotted woodscrews with a spiral ratchet screwdriver. Happily, power tools finally consigned such forms of hard labour to history, which meant multiple power leads snaking their way across a construction site became as common as hot pies in a smoko room. But now the next stage in the evolution of hand-held tools has arrived in the form of the battery powered hand tool – the new tool of choice for most trades on a construction site. But while they may be making life far easier for all types of trades, using them still has risks. As the growing number of serious incidents and injuries reported to WorkSafe confirm, operating battery powered hand tools should never be taken lightly. Users must be informed, instructed and in some cases trained to be competent in the operation of the tool. Here are some of the most commonly used battery power tools being used on construction sites and reasons why they need to be treated with respect.
Drills and impact drivers Drills and impact drivers are the most common battery powered tools on any site and there is no shortage of tradesmen wanting to have the biggest and most powerful tools available. But the biggest are also the heaviest. Some 18 volt units fitted with a large capacity battery can weigh more than 2.5kg. It’s not a tool you would want to carry around all day. Why not halve the weight by using a 12- or 14-volt drill or driver with smaller batteries? The high torque in the modern battery drill has resulted in a rise in the number of sprains and fractures to fingers, hands and wrists from the bit jamming and the drill spinning out of a worker’s hand (when drill rather than clutch settings are used). Another common problem with drills and drivers is worn or poor quality driver bits which have a tendency to slip off screw heads and stab the worker, resulting in a puncture wound. Young workers, such as apprentices in particular, suffer more drill and driver injuries than other workers. Impact wrenches Battery powered impact wrenches, also called battery rattle guns, are often the favoured tool for structural steel and concrete panel erectors for tightening fasteners.
Again, the most powerful tools are the most popular, which have led to numerous fastener failures due to over-torque. Some modern trade quality battery rattle guns deliver 1000+ Nm of torque, which far exceeds the maximum torque for most bolts and concrete anchors. Rattle guns are also heavy, and some can weigh more than 5kg. So, when buying one, take advice from specialist power tool suppliers about the most appropriate rattle gun for your application. They may recommend a smaller model, so not only will you have less weight to lug around, it will most probably be much cheaper. Saws Many tradies are opting to buy battery power tool kits, which include tools they have never used before, such a circular saw. But unlike carpenters, most construction trades receive little or no formal training in power saw use. This is despite the fact that being hit with a power saw blade will almost always result in a serious injury. As battery powered circular saws are generally small and lightweight, some workers treat them like toys and often use them without adequately supporting or securing the material being cut.

They may be small but they generally still require two-handed operation and the material being cut needs to be adequately supported, not just held by the operator or another person. Because they are less powerful than mains-operated saws, they are much easier to jam during the cut. Unlike the motor of a 240-volt saw, which will buzz and burn out quickly when stalled, the motor in a battery saw will just stop even if the trigger is held on. A number of workers have suffered serious hand lacerations when they have pulled the jammed battery powered saw free while keeping the trigger on because, once free, the blade has started spinning again and run across their free hand. To reduce the likelihood of saw jamming, always use good quality blades suitable for the material to be cut. And never force the saw - allow it to cut at its own rate. Angle grinders Angle grinders (240V) are one of the most dangerous hand-held tools commonly used in construction and one with the potential to cause fatal injuries for the operator or nearby workers. The most common cause of injury is being hit by flying projectiles when discs shatter, or the operator being struck by the blade when the grinder kicks back. Kickback is a sudden uncontrolled movement of the grinder out of the cut towards the operator when the disc jams or binds. As the operator is frequently bent over or in line with the cut (called the line-of-fire) the spinning disc strikes them in the upper chest, neck or head, which can result in serious or even fatal injuries. Operators should be trained in the safe use of the angle grinder including how to avoid positioning themselves or others in the line of fire. The high torque allows angle grinders to perform a variety of cutting and grinding tasks. This has made the 9” angle
grinder the default tool for steel and masonry cutting, even when there are more appropriate and safer task-specific cutting tools available, such as rebar cutters, concrete pipe cutters and metal cold saws. If angle grinders are appropriate for the task, ensure the smallest grinder practicable is used, any discs fitted are good quality and comply with the grinder manufacturer’s specifications (such as having the correct RPM rating and mounting hole) and are suitable for the materials being cut. Even battery powered angle grinders have potential to cause serious injury and should not be used one-handed as they have enough torque to shatter discs and kick back. Workers should be instructed on and have an understanding of the kickback quadrant of the grinder. Maintenance Battery powered tools must be maintained in a good mechanical condition so they are safe to use. Mains power tools need to be tested and tagged on a regular basis to ensure their safety but battery powered tools don’t have that official safety net to remind their users to have them checked out. However, it is important they are inspected regularly to ensure the safety features operate correctly and the tool has not been mechanically damaged.
Personal Protective Equipment Whatever power tool is being used, appropriate PPE must be provided and used by the operator and others in the vicinity when necessary. This might include: • Safety glasses with almost all power tools, or full face protection where required • Hearing protection when using tools such as grinders, circular saws, hammer drills etc • Non-flammable clothing (for example, remove nylon safety vests when grinding)

And finally Battery powered tools are making life far easier for all types of trades on the building site. However, their use remains a high-risk activity and operating them should not be left simply to common sense. Users must be informed, instructed and in some cases trained to be competent in their operation. Always use the right tool for the job and make sure the material being cut, sawed or drilled is firmly secured, even if the work is only minor. If necessary, workers should be supervised to allow the work to be done safely – especially young or inexperienced power tool users – to ensure shortcuts are not taken Before buying battery powered tools consider and, where necessary consult workers on, the actual work to be done with the tool and select the most appropriate tool for the application.
