Government Affairs Update Legislative Day Brings Realtors
to Sacramento
Over 2,000 Realtors and affiliates from the state of California gathered in Sacramento on Wednesday, June 6, for Legislative Day. Over 30 Realtors and affiliates from SAMCAR, including members of the Board of Directors, joined their counterparts at the state capital for the event, which is organized by the California Association of REALTORS® (C.A.R.) every year. Legislative Day is an opportunity for Realtors from across California to meet with their state legislators and discuss issues that affect the real estate industry. All Realtors and affiliates first gathered at the Convention Center in the morning to listen to greetings and a C.A.R. Hot Issues Briefing from C.A.R. officials. California Governor Arnold Schwarzenegger, who was out of town, also greeted Realtors via live satellite feed. See Legislative Day, continued on Page 2

speaks to SAMCAR members Councilwoman Gina Papan has aspirations for the city of Millbrae, as well as the state of California. She appears to be following her father’s footsteps– currently on the Millbrae City Council and with 15 years of public service under her belt, she intends to do more about improving the quality of life for all Californians and is setting her sights on the state Assembly. At this week’s Combined Marketing Meeting, SAMCAR’s Bob Marshall introduced Papan as the daughter of the late Lou Papan, who was “a good friend of our association.” Paying tribute to her father, who just passed away a few weeks ago, Marshall said the late Papan, a former Realtor himself, “didn’t agree See Papan, continued on Page 3

“Attending Legislative Day is a tremendous investment in your business. … It’s an opportunity to let our legislators know what works and what doesn’t work,” said Badagliacco. C.A.R. Senior Vice President Alex Creel briefed Realtors on hot issues that legislators need to be aware of, and Senator Lou Correa, whose bill SB 670 sought to prohibit private transfer taxes did not make it through the Senate Housing and Transportation Committee, also spoke to C.A.R. members. The impact of political participation was emphasized during the morning gathering. “Let them know we represent people looking for the American dream. Let them know we are watching and we are not going to go away,” C.A.R. officials said.

Realtors make up one of the largest groups that hit Sacramento every year. A SAMCAR/SILVAR/SCCAOR Joint Legislative Luncheon at the Sheraton Grand Hotel followed the briefing, with political strategist and analyst Donnie Fowler as guest speaker. After lunch, Realtors and affiliates headed to the State Capitol to meet their respective Senators and Assembly representatives. The day proved to be one in which Realtors got the opportunity to witness legislators at work, and because of this, Realtors were not able to personally meet with all of their representatives. The Assembly was in session; legislators had to decide on over 400 bills by the end of the week and were scheduled to discuss 125 bills that day, which meant they would be working till late in the evening. Staff members of Assembly representatives met with SAMCAR members and assured them that they would bring back their concerns to the representatives. They also noted it’s important to let the legislators know about their concerns. One staff member said a legislator was impressed when her office received 60 phone calls regarding her need to oppose SB 464 (Kuehl). SAMCAR members met with staff members of Assemblymembers Ira Ruskin and Gene
Mullin, although Mullin was later able to get a five-minute pass and hurried down to meet the Realtors and update date them on developments in the Assembly floor. SAMCAR members were also able to personally meet with Senators Leland Yee and Joe Simitian. Hot topics pressed by Realtors included opposition to the following bills
AB 1574 (Houston) which would allow the use of private transfer taxes, which would in essence, add to the cost of owning a home and would encourage developers and private entities and others to impose these fees with no restrictions. AB 239 (DeSaulnier) which would authorize the Contra Costa County and San Mateo County Boards of Supervisors to impose a document recording fee on all real estate recordings to generate funds for affordable housing. While the goal is good, Realtors are concerned the bill targets just one group to pay for affordable housing; it would basically create a tax and runs counter to Proposition 13; and it would ultimately add to the cost of buying a home and penalize the very people affordable housing policies seek to help. SB 464 (Kuehl) which forces landlords to stay in business for at least five years and requires them to give all tenants a one-year notice of termination of tenancy should ANY of their tenants be a senior or disabled. C.A.R. believes this bill is an attack on private property rights and an affront on business – landlords should not be told how long they should stay in business. The bill would also discourage investment in rental housing and could ultimately lead to landlords evicting tenants before putting their property on the market and discriminating against seniors and the disabled. Senator Joe Simitian thanked SAMCAR, SILVAR and SCCAOR members for meeting with him and addressing the hot issues. He noted, with 900,000 constituents in 13 cities and towns, “it’s tough to stay in touch. You make it easier for me to do it by coming to me and expressing your views. Is anyone listening, and does it matter? The answer is yes and yes.”

Ed Rogers G. Edgar “Ed” Rogers Jr., 84, a former member of the North San Mateo County Association of Realtors, who helped shape Millbrae into a prominent city, died May 16 from a heart attack. He is the father of SAMCAR member Dan Rogers. Ed Rogers was born in San Francisco in 1923 and moved with his family to Millbrae at the age of 12. He devoted himself to working at the Millbrae Sun, and after graduating from the College of San Mateo, he joined the Navy during World War II, serving in the South Pacific.

with the Realtors all the time, but he always listened. … He was a dedicated politician who knew how to get things done and would always listen to both sides of the story.” Gina Papan, in turn, told SAMCAR Realtors, “Your profession is greatly respected in our household,” and since her father embarked on a career in real estate after he left the FBI, she said he kept his family informed as well as entertained with many real estate stories. Papan briefed SAMCAR members about latest developments in the city of Millbrae. “We are doing great things for a little city and will continue to do so,” she noted. Some exciting developments include $1.5 million in funds for the city’s parks, a number of new housing projects, one of which will include 37 single family units to be constructe in partnership with HEART (Housing Endowment And Regional Trust) by the BART station, a $30 million waste water
Following the war, Rogers enrolled at UC Berkeley, where he met Marilyn Newell, whom he married in 1947. The couple settled in Millbrae and started an accounting office specializing in tax consulting. Rogers also took a leading role in incorporating Millbrae as a city and served as city treasurer from 1948 through 1980. He is survived by his wife Marilyn; three children, Dan Rogers of Millbrae, Craig Rogers of Hillsborough and Sue Goetter of Belmont; and five grandchildren. Services will be held Saturday, June 9 from 3 p.m. to 7 p.m. at Green Hills Country Club at the end of Ludeman Lane in Millbrae. Memorial donations may be made to Mission Hospice of San Mateo County, 1900 O’Farrell St., San Mateo, CA 94403.

She also spoke about the re-opening of the 16-Mile House, as well as planned mixed development in the vicinity of the lumberyard, which will feature underground parking, movie theaters, commercial with residential above and close to transportation. She noted, while Millbrae has a tight budget, but she believes the city’s development policies and other future plans will take the city into the future. “Millbrae is really progressing,” she said. Papan, who serves as deputy general for the California Department of Justice by day, says she is looking to the future, namely a state assembly seat that will soon be open. She talked about the need for experienced representatives who arrive in Sacramento and “hit the ground running.” With the forecast of 24 million more residents joining the already 37 million residents in California, Papan said, “The burden is going to be put on all of us and puts our future at

We need to take advantage of all the resources … San Mateo has to fight for its share of its bond measures.” Papan wants to work on energy saving measures like increasing public transportation, creating a universal transportation pass that resident can use for all types of public transportation; improve California’s education system by recruiting and retraining teachers, improving on school facilities, and retaining graduates in the state; focus on affordable housing to enable workers to live in the area; and focus on finding alternative effective environmentally safe energy. “We have not reached our potential,” Papan said. “We need to be progressive.”
