It Ainâ&#x20AC;&#x2122;t That Easy You may recall an article a few weeks back in which we discussed a recent trial verdict we won for $2,315,000 for a client injured in a car accident. Now, common sense might tell you that the case is over and done and the client simply gets her money, right? Wrong. Like many things in the legal world, it ainâ&#x20AC;&#x2122;t that easy. See, there is a law in New York (thanks to the insurance industry lobby) that says after a jury makes an award in an injury case, the amount of that award must be reduced to â&#x20AC;&#x153;present valueâ&#x20AC;?, meaning, the value in todayâ&#x20AC;&#x2122;s dollars of what the jury awarded to the injured person for loss of income in the future, etc. For example, if a jury says Peter plaintiff is awarded $40,000 per year for thirty-five years for lost income because he can never return to work, the defendant would theoretically owe $1,400,000 to Peter. But because of this special law in New York, the amount Peter would actually get today must be the present value of the stream of $40,000 payments, which, depending on interest rates at the time, might reduce the amount Peter actually receives today to something as low as $800,000 or $900,000. The higher the current interest rates, the less money Peter actually receives. But that is not the end of the analysis (thanks to the trial lawyerâ&#x20AC;&#x2122;s lobby). The reduced amount must then be increased to take into account inflation, which uses a historical average of about 2.5% per year. Pretty crazy, huh? As for our young client who received the $2,315,000 verdict, because interest rates are so low right now, it only reduced her award by about $975!
