A new client was recently injured after being struck by a car while walking through a parking lot in Monroe County. The driver of the car fled the scene, but was later apprehended by police authorities. The good news is that the accident was caught on security cameras in the parking lot. The bad news is that the car was only insured with the minimum required liability insurance in New York of $25,000/$50,000. Hopefully regular readers of this newsletter will know that means all any one person injured in an accident can collect is $25,000, while the total payable to all persons injured in the accident is $50,000. After meeting with the new client, I asked if it would be okay if I reviewed the declarations page of his auto policy, as I was hopeful that perhaps he had Supplemental Uninsured/ Underinsured Motorist coverage (SUM) adequate to compensate him for his damages over and above the $25,000 available under the driver’s insurance. Yes, even pedestrians can make a claim for SUM coverage on their own auto policy. Fortunately, the client had purchased at least a little bit of SUM coverage, which will provide him with an extra $25,000 of insurance if his injuries warrant it. We don’t yet know the value of the client’s case because his injuries have not had a chance to heal, also known as “maximum medical improvement” in lawyerspeak. For those of you who have not yet purchased SUM coverage, make the call to your insurance agent today, and buy as much as they will sell you. You will have to increase your liability coverage to get appropriate SUM coverage, as your SUM insurance cannot exceed your liability coverage, but it’s worth it. Don’t let yourself get caught in a situation where you have $500,000 worth of damages when injured by someone with the minimum liability coverage, because $25,000 is all you will get.

Address gopher problems in the yard With warmer weather upon us, homeowners take to the outdoors to renovate and revive what winter may have left barren. Part of this rejuvenation process includes resurrecting a tired landscape and making plans for new plantings and other outdoor entertaining ideas. One common backyard nemesis that can foil spring gardening and outdoor enjoyment plans is the gopher. It takes but one gopher to tear up a lawn, burrow through the landscape, devour prized plants and even destroy trees. A gopher is a small animal that feeds on roots and tubers from plants. The pocket gopher that lives primarily in its underground burrows is the species most people find in their yard. The name gopher comes from the French gaufre de miel, or honeycomb. They were likely named as such because of the hole-filled pattern their incessant burrowing creates under the soil, offers gardening site Yardener.com.

The creature is primarily active in the spring and fall. Although relatively unsocial and very good at maintaining a solitary lifestyle, the gopher still manages to have one to two litters of offspring per year, with three or four babies per litter. The potential for yard damage is great. The Montana State University Wildlife Extension says that gophers create burrows anywhere from 4 to 18 inches underground, parallel to the surface. Some parts of the burrow may be as much as 5 or 6 feet underground with several lateral burrows as well. In addition to killing off plant growth, gophers can cause other damage. Their burrows can redirect irrigation, ruining crops. They can also damage underground pipes and irrigation systems. Nibbling on roots of trees may compromise the tree and lead to death and the potential for a tree to fall over. Gophers are clever creatures and getting rid of them can take some time and effort. Some of the best ways to eliminate them

are with natural predators and barriers that will redirect burrows. Natural predators to gophers are gopher snakes and barn owls. However, once the gopher population has been depleted, these predators may move on to where gophers are in abundance. Even one gopher left behind in your landscape can cause damage. Flushing out gophers with a garden hose is not recommended. The gophers can simply hide out in one of their lateral burrows and wait out the water deluge. Also, making the soil wet facilitates burrowing, so you're only making the work easier on the gophers. Some extermination experts recommend devices that are placed in the ground, which emit a sound that gophers find irritating. You may want to experiment with these devices in conjunction with other efforts. It is recommended to install barriers around your landscape. These come in different forms. Most are dug into sever-

al inches of soil around the perimeter of your property. The gopher runs into the barrier underground and gets deterred. Something that requires a little more work is installing galvanized steel mesh underground. Dig several inches below where you would put a planting bed or sod. Put the mesh flat on the ground. Place a layer of dirt several inches deep to accommodate root growth of your plants. Then plant as usual. The gophers who burrow under the mesh will try to come up and meet with the mesh. This can prevent plant damage provided the roots do not extend below the mesh. Remaining diligent and observing gopher burrows will help you stay on top of the problem. Consult with a professional exterminator if you need help determining if you have a gopher situation or a different type of rodent, such as a mole or vole burrowing on your property. He or she may also suggest certain ways to keep gophers at bay.

USED CAR PURCHASE Before searching for a used car, consumers should consider many of the same factors that apply to a new car purchase: including vehicle usage; life expectancy of the car and expenses, including insurance, operation, maintenance, and repairs. The State of California Bureau of Automotive Repair also recommends prospective buyers run through the following on-the-lot checklist before finalizing a deal. * Body -- Look for rust, particularly at the bottoms of fenders, around lights and bumpers, on splash panels, under doors, in the wheel wells and under trunk carpeting. Check for paint that does not match, gritty surfaces and paint spray on chrome -- all possible signs of a new paint job, masking body problems. Look for cracks, dents and loose bumpers -- warning signs of a past accident. * Tires -- Uneven wear usually indicates bad alignment or suspension damage. Check the condition of the spare tire. * Doors, windows, trunk -- Look for a close fit and ease of opening and closing. A door that fits unevenly may indicate a previous collision. * Window glass and lights -- Look for hairline cracks and tiny holes. * Tailpipe -- Black, gummy soot in the

tailpipe may mean worn rings, bad valves and expensive repairs. * Shock absorbers -- Lean hard on a corner of the car and release; if the car keeps rocking, the shocks may need replacing. * Fluids -- Oil that is a whitish color, or has white bubbles, can be a sign of major mechanical problems. Check the radiator fluid; it should not look rusty. With the engine idling, check the transmission fluid; it should not smell rancid or look dark brown. Check for leaks and stains under the car, on the underside of the engine and around hoses. * Lights and mechanical parts -- Make sure headlights, taillights, brake lights, backup lights and direction signals work properly. Test the radio, heater, air conditioner and wipers. * Interior -- Check the upholstery for major wear and tear and look under floor mats and seat covers. Inspect the steering wheel, as well. When unlocked with the engine off, it should have no more than two inches of “play.” Finally, a car with low mileage, but with a lot of wear on the driver’s seat or the brake and accelerator, may indicate tampering with the odometer. A musty smell could mean that the car was damaged in a flood, or that rain leaks inside the car.
