NEW DEPARTMENT OF PUBLIC WORKS + WASTE WATER TREATMENT PLANT “SMELL” To the village residents: Here are some TRUE facts.

When reading the Livingston County News a few months back an article stated “Dansville to spend $19 million on new WWTP.” That was the first public notification that I was aware of.

I talked with Les Bowen from the Express and asked him if he had heard any reports on the new WWTP (Waste Water Treatment Plant) at the board meetings. He said he had only missed a couple of meetings but there was no mention of a new plant.

How could a $19 million sewer plant along with a $1.25 million new DPW be kept so quiet? Do the taxpayers and sewer rate payers not have the right to a few public information meetings to explain when and how we are asked to make the two biggest combined purchases of Dansville’s history in tough economic times such as these? How do the mayor and administrator feel they are judge and jury on this issue? Why do we only have one engineering firm? (MRB)? Wouldn’t a second look by a different engineering firm be beneficial? After all, who is watching MRB???

On Jan. 12, I went to the mayor’s office to talk with them about placement of the plant because two years earlier Bill Dixon told me he was going to place the plant on the north side of town (Industrial Park) so we could bring on more users, Sparta, West Sparta, etc. He also told me that day, that he and Keith Petti still favored the north side but then they told me they had purchased the Carpenter property for $1.25 million because they figured this was a cheaper deal for the village....? The next day I asked Don Sylor and Dick Whitenack about this project and purchase and they both told me they were kept out of the loop. I talked with Kirk Walker. He said he relied heavily on Keith’s opinion and expertise and told me he had NOT read the $80,000 study in detail. Kirk, it only takes a little over an hour to read the study!!

When the board members were asked for the first time to vote on a Bond Resolution, they voted unanimously for it. If you were kept out of the loop, why vote yes? According to Whitnack, Sylor, and Walker they felt pressured by the DEC. After talking with them, they all agreed more info was needed to be comfortable with moving forward.

At the board meeting on Feb. 8, Don Sylor wanted to have a public meeting on the new sewer plant but Deputy Mayor Kershner wanted to wait until after a meeting with the engineering firm MRB, the following Tuesday. It turned out to be a bond revote and workshop meeting. Why a revote?

Before this meeting on Feb. 15, I talked with trustees Sylor, Walker, and Whitenack. They all stated they had changed their minds and wanted to give the new incoming board a chance to look over this project. Walker told me at least 15 times he was going to “kick the can” on this issue and vote no on bonding. He also told Pete Vogt he wanted to let him have a say on this issue because it will be built under Pete’s watch (approximately three years to build). When it came time to vote Kirk Walker kicked my can!! And voted “Yes” on bond resolution. Trustee Sylor tried to table the motion but couldn’t muster the votes. Only Dick Whitenack voted against it stating “I’m uncomfortable about 19 million. I feel it is too much money”. Sylor voted yes, his reasoning being he was afraid the vote could not be brought back up. And, he did not want to totally halt the project.

So, Kirk Walker derailed any chance for the new board to look over this project. Remember, up to this point... No public meetings, No information period, and No public input. It is only right taxpayers should be informed and not have to read in the paper “Sticker Shock.”

At the workshop meeting the question was asked of the engineer “Can you guarantee us the new plant will not smell?” He said he could not but if run properly it should not smell. (I hope the past is no influence on the future of how our plant has been run.) Whose responsibility is it to oversee the plants operation? I believe it is the administrator’s.

SMELL. This is what has the DEC knocking at our door.

Many upset residents have called the DEC complaining about the odor. MRB told me the plant has not been operated correctly and they are trying to solve this issue. But remember, this plant has to function until a new plant is built and running.

I want to stress that it is not the operator’s fault. He has not had the training as stated in the DEC report “The chief operator would do much better at operating and maintaining the treatment plant with some hands on training.” I feel the administrator should have attended to this problem and gotten the odor under control before it got out of control.

The original plant was built in the 1930s and the placement now does not suit our future needs because let’s face it, sh** flows downhill. The town has grown and expanded to the north end thus putting the plant right in the middle. So why would we want to build a $19 million plant with this location? Furthermore, do we want to place the plant next to I-390, our food establishments, and our grocery stores as the greeting to our town and the first thing we see?

If the new plant is moved to a new location and the old plant is completely demolished leaving no traces of what was previously there it would allow room for new businesses to develop such as restaurants, motels, etc.

This brings me to consolidation in whatever form. When we merge the two governments, the two DPW will become one. After talking with Supervisor Mahus, he informed me that he (along with the town board) had not been informed, invited, or otherwise been allowed to have any input on the new DPW or Plant. Wouldn’t you think if we are going to merge you would at least want to see how the town felt? After all, the people in Cummingsville have no sewer whatsoever. Mahus informed me that he would have no intention of moving his crew to the new location as he feels they need to be at the airport. He also said and has told the current village board, there is plenty of room to put the village crew down at his location. Yes, some upgrades would be needed to do this but it would be a much CHEAPER proposition.

I also feel the town shouldn’t be in the business of closing down businesses. By purchasing Carpenter’s property, you will have removed $460,000 off the tax rolls per year along with eliminating needed jobs. There are plenty of options available at the current site for expansion along with better options on the north side of town.

The town is spending an astronomical amount of money to purchase the Carpenter property when we would only be using a tiny portion of it for the plant, thus using the existing portion of the property for the new DPW and adding an even larger eyesore at the entrance of our town.

If we were to build a new plant down by the 4M complex we would have to build a new 36-inch sewer main 4, 500 feet at a cost of approximately $2 million, estimated by a reputable contractor. This is a far cry from the $5 million MRB Engineering and the mayor have been reporting. After all, MRB was going to build an extra two miles of 36-inch sewer main to go to White bridge road??? Also, we would have to pay the Town of West Sparta property taxes ???

The cost of the 4,500 feet sewer main extension would be offset by selling existing plant property and not purchasing the Carpenter property for $1.25 million. We could also add 120 customers from Arby’s to Cummingsville, all with no pumps needed.

Not to mention being able to service Sparta and West Sparta in the future.

Here are a few quotes from the MRB study: “It would be most cost effective for any expansion to the collection system to consist mainly of gravity sewers and the number of pump stations be limited.”

“The advantages to selecting a new location not associated with existing WWTP include more flexibility about site conditions that could lead to lower capitol and operational costs through WWTP hydraulic grade that minimizes or simplifies pumping needs as well as

the potential for future expansion.”

“The most viable location based on the mapping that does not encroach on designated wet lands would be the vicinity of Meter Road and Zerfass Road owned by the Marks. However, the village has indicated their ‘belief’ that acquisition of this property may be difficult.”

I went and talked with Roger Mark and he told me that nobody had contacted him on buying some of his property but he did tell me his father always said the plant should have been built on the north side of his farm. Amazing! Mr. Mark was not even an engineer!

I also spoke with Larry Mehlenbacher from the 4M Complex and asked him if anybody from the village had contacted him about placing the WWTP on his site. He said, “No” but would entertain the idea of putting it down there.

Now let’s talk “Sticker Shock.” Ryan Colvin from MRB engineering says we need to move fast before interest rates rise. I agree to a point.

Right now there are no grants, no low interest loans, etc. We as rate payers will be on the hook for a 38-year loan because interest rates have risen. Ryan estimates them to be at 5- 5.5 percent at construction.

I’ll be conservative and use the 4.5% interest at 38 years: Total Project Cost = $18,708,905.12 Operations &Maintenance Cost Etc = $1,681,088.82 Annual Cost There are 2131 Equivalent Dwelling Units (EDU) $1,681,088.82 divided by 2131 EDU=788.87 Per Year

Total Payback... $64 Million...

“Sticker Shock” (These numbers from MRB study) MRB keeps stating they will bring construction costs in at $13 Million. Yes, I agree with that, but unless MRB is willing to work for free what he forgets to tell us is MRB Engineering Bidding

Check out land easement purchase price. If you add in new land purchase of $1.25 million, no matter how much goes to the sewer project or gets added to the general fund we still have to pay for it.

That pushes the project just shy of $19 million.

Yes, MRB wants to act quickly because they know if interest rates rise over 5% it will push us over the states affordability of $860.

That’s an increase for each of us of roughly a $150 per quarter. If we could have received a low interest loan or grant, this project would be feasible but who could predict these tough economic times that we are in. We need to stop this project, get another engineering opinion (a fresh set of eyes) that gives us some options. Why give away millions of dollars in interest each year.

Interest alone the first year is over $1 Million!!! Let’s put those dollars in our pocket. What happens if something else in the town needs updating! Where would that money come from? Raise taxes? Dansville is already a very expensive place to live now. If we do not want to keep losing residents, we need some sound, long term financial planning. This should have been done years ago!! I commend Don Cosimano and the Town of West Sparta. They are adding on to their town hall with the cash in hand!

With the current interest rates so high we should look at raising our annual cost per edu to the level of the new WWTP. So, instead of building a new plant now, put $2 million into the existing plant.

According to MRB that could buy us 10 years or so. Then, take the time as a community working “together” and make the correct decision for our future needs. See what the new DEC regulations will be in the future and build up a capital reserve fund to build a new plant so that we are not so far in debt.

I understand we have been borrowing from the general fund to pay the sewer account. Why were rates not raised to account for repairs, etc.?

When reading the DEC report 4/28/2009 it states it is mostly neglect of the existing plant “units off line, peeling paint, number two tank down for gear drive replacement since July of 08” “Primary clarifier distribution box has corroded away. Inflow and infiltration has been documented to be an issue at this plant.” The DEC wants a plan to minimize the impact of Inflow & Infiltration this facility has been subject too. (there is not even an operator or maintenance manual at the plant). This was just a sample of the DEC report. There was no mention that we had to build a new plant . We just need to maintain the current one. It is very evident after reading the report that very little preventive maintenance has been performed at our plant.

There is close to half a million gallons a day infiltrating our sewer system. That’s a monumental task to bring that volume under control alone. Fixing the 300,000 gallons a day that our water lines are leaking might also help the situation.

Instead of giving millions of dollars away each year in interest, let’s pay as we go or borrow as little as possible for now. Let’s take the time to form a plan and not be on the hook for the next 38 years.

Now, for the liberal side of our current board, Kirk Walker has been the deciding vote on a lot of important issues and when it really matters, he goes liberal. He voted “Yes” for Keith Petti’s contract, voted “Yes” on the $19 million sewer plant, and voted “Yes” for the new multiyear village employee contract that gives a 2 percent raise per year, for the next three years. Whitenack and Sylor wanted to at least read the new contract but were not given a copy. Kirk was the deciding vote on all the above issues. The current CSEA contract does not expire until June 2011. What was the rush?!

I do not believe any of the candidates are running on personal vendettas, half-truths, deceits, or false information as stated by others.

I know the Republican team has been attending board meetings regularly. They are informed on the issues and they recognize the problems facing our community. They WILL move us in the right direction in these tough economic times. I believe in voting for the best candidate regardless of party lines. I voted Democrat in the last election because I was falsely promised a change in a new direction.

Unfortunately, this did not happen. This election, I feel the best candidates to honestly keep our villages best interest as their main priority is the Republicans.

We all have a choice on March 15th to get out and vote!

A New Direction For Dansville On March 15 the voters of Dansville will have an opportunity to shape the future of our community. The challenges before us are many, but they are not insurmountable.

What is required of us is a positive attitude and a can-do spirit. We must dare to dream of a better tomorrow. We need to be proactive, not reactive. We need to address 21st-century problems with 21st-century solutions. Above all, we need to know where we are going; we need a vision; What do we want this community to be? The following are some of my thoughts about what we ought to do.

Strategic planning is the road map for bringing the vision to fruition. It is the long view. It is about harnessing the full potential of all residents, being open and receptive to a broad range of ideas, and working toward the common goal of making Dansville a better place to “live, work and play”. All voices will need to be heard and all ideas entertained, screened and coalesced into a framework with which to go forward, to take advantage of opportunities to build a new and better Dansville.

But let us not fool ourselves, it will take time to develop a strategic plan and the problems are here today.

Furthermore, there is too little funding available now and for the foreseeable future for implementing all initiatives of any plan. Given the condition of the federal and state governments, assistance from either is unlikely. The point is, our future is in our hands. In the coming months residents will be asked to step up to help. At the same time, there are several initiatives the village board can take to set the stage: 1) review village operations/services for need, effectiveness and efficiency, following up with a personnel review; 2) examine local laws/policies/guidelines/ethical standards for need and appropriateness; 3) survey municipal infrastructures (parks, streets, water and sewer systems, buildings, technology, etc.) and equipment for condition and need; 4) analyze the village’s financial/fiscal condition, working to keep the tax burden down while getting the most bang for our buck; and 5) conduct village meetings with dignity and respect, building consensus among board members and eliciting trust from the public.

A community with an eye toward the future that is maximizing its resources is headed in the right direction, but that is not enough. The future is about today’s youth, keeping ours here and bringing in others. It means creating opportunity - jobs! We must speak with local high school and regional college students for their ideas. We also might want to think about creating a business incubator.

However self-reliant we might be, one thing we cannot forget is that nothing can be accomplished in a vacuum. We need to put parochial interests aside and think outside the box, or in our case outside the village and this end of the valley. We need to build strong relationships with the surrounding towns, our school district, the Chamber of Commerce and its associated organizations, other local businesses and organizations, Livingston County, and state representatives and agencies. We as a community need to speak with a strong voice about our wants and needs, but it should be a voice that is engaged in a constructive dialogue.

As you go to the polls Tuesday, consider what you will be deciding. It should not be about party, personal and special interests, or state and national issues. It should be about what is right for our community, taking it in a new and positive direction. A “vote for Vogt” will be a ballot cast for the ideas, initiative and leadership to do just that!

THINK TWICE BEFORE GIVING JUNIOR THE CAR KEYS I have a client who was injured in a very bad car accident that has left her (at age 19) with some very severe, permanent injuries. This young lady was a passenger in a car driven and owned by her former boyfriend. The young man apparently had a history of accidents and erratic, reckless driving. The car was given to him by his parents, who were well aware of his terrible driving history. The client’s case was scheduled to go to trial last month, when at the last minute the insurance company for the boy and his parents finally gave in to our settlement demands and agreed to pay my client a minimum of $750,000 up to a maximum of $2,500,000, the exact amount of which to be determined by arbitration.

New York courts do recognize a claim against parents in limited circumstances for “negligent entrustment” of “dangerous instruments,” such as automobiles. This theory only applies when someone other than the parents is the owner of the car, as the owner is always liable for damages caused by the use or operation of their auto, regardless of who is driving. This means that the parents can still be held responsible for the accidents caused by their teenagers when the teenager is the owner of the car if the parents had reason to know that their child did not possess the abilities to drive responsibly. The bar is set very high in such cases, and, naturally, you can’t hold the parents liable without a great deal of hard proof that junior was an accident waiting to happen and that the parents knew it and provided a car for him anyway.

As the father of three teenage boys, these types of cases take on a whole new meaning for me.

Step into fitness Dancing is fun and good for you

"Dancing With the Stars." "So You Think You Can Dance." "Live to Dance."

Since the onslaught of TV shows showcasing fancy footwork, more people have been struck with dance fever — understandably, considering the grace, elegance and athleticism displayed in such shows, not to mention the bodily transformations that take place.

Of course, such dramatic changes are because of extensive rehearsals for hours every day, week after week — a regular and intense exercise routine. However, dance enthusiasts encourage anyone interested in staying active to go dancing.

Gene Weiser of Springfield, Ill., believes he is an example of how dancing can benefit health. He started dancing in 2001 when he was invited to be someone's partner in a dance class. He's been dancing ever since.

Weiser has had knee problems and was expecting to get his knee replaced in 2005. So far he hasn't had to, and he thinks dancing has helped strengthen the muscles around his knees.

Weiser recommends dancing as a form of exercise because "dancing is fun and it won't necessarily wear you out."

People of varying abilities can get on the dance floor and pace themselves so they don't overexert themselves. People who are more physically capable can choose dances that will keep them moving at a fast pace.

"You're not in one spot the entire time; you're constantly moving. And dances require different levels of movement," Weiser said.

However, don't assume you'll experience the kind of same kind of weight loss as dancers on TV shows if you only go dancing once or twice a week.

"My wife and I dance three to four times a week, and we also give private lessons in our home, so with all that you're going to see the benefits of exercise through dancing," says Weiser, who also does water aerobics.

Not just physical benefits Dr. Careyana Brenham, an associate professor of family and community medicine at Southern Illinois University School of Medicine, says the fun factor is important.

"If you tell people to do something they don't enjoy, they don't do it. If I can get patients to do a form of exercise they enjoy, then they'll go back to it," she says.

Brenham points out that dancing can do more than get people in better physical shape.

"Dance includes not just exercise," she says, "but it includes stretching and balance. It helps with memory and cognition skills because dancers have to remember step combinations."

It also provides emotional benefits. Dancing is a way to unplug and connect with people.

Marilyn Ferry, president of the Prairie Land Dance Club in Illiopolis, Ill., says dancing helped her after her divorce.

"I started country dancing because some friends took me, but I never wanted to go after I got off work," she says. However, after she spent an evening dancing, she said she would leave feeling much better than she did before she arrived.

She had more energy, too.

"It's like it transforms you without you knowing it. It makes you feel better. It involves more than just the physical. It involves the emotional and spiritual as well," she says.

"I'm not a teaching expert on that, I'm a product of it. There's a social aspect that helps you to make friends, and you feel like you belong. Just having fun is really important."

Now she gives weekly lessons, and she has even learned to dance lead so she never has to sit out if there aren't enough men to serve as partners.

Newbies welcome For dancing newcomers, Ferry says not knowing how to dance shouldn't be a deterrent.

"The lack of knowledge shouldn't keep someone from trying it. It's just a matter of finding your niche in the group that doesn't interfere with the other dancers and doesn't hinder your own efforts," she says.

For example, if a new dancer wants to learn line dancing, he or she can start off in the back of the group to get a feel for the movement and music, and gradually blend in with the more experienced dancers.

"When a lot of people come, I think they get discouraged because it looks so easy," she says. "It takes a little bit of effort, and a big part of the effort is to show up."

And any effort to get the body moving is an effort worth making.

"I really believe it's one of the healthiest things people can do, Ferry says. "Any time we get up and get moving is a good thing. I know that you need to get your heart rate up, and I know that you need to breathe and all those things, and you can get those things with dancing and still have fun."

This study analyzed Medicare beneficiaries who had elective primary total hip replacement for osteoarthritis between July 1, 1995, and June 30, 1996.

The risk of revision was higher in men than women, and the risk was higher in patients 65-75 when compared with patients older than 75. Patients operated on by surgeons who performed fewer than six total hip replacements annually in the Medicare population had a higher risk of revision than those whose surgeons performed more than 12 hip replacements a year.

Daylight saving time is a way of getting more light out of the day by advancing clocks by one hour during the spring and summer months. One of the original goals of daylight saving time, which was controversial upon its introduction in the early 20th century, was to save energy. This would be achieved mainly by reducing the use of incandescent lighting by adding more sunlight to the end of the day, when most people are home and awake, and taking some away from early morning hours, when people are typically asleep.

However, daylight saving time remains controversial even to this day. Research has indicated that retailers benefit from daylight saving time, and recreational activities, such as sporting leagues for children, also benefit from the added sunlight at the end of the day. However, research has also indicated that the farming industry has been adversely affected by daylight saving time, because farmers need extra sunlight in the morning. While farmers may have a pointwhen it comes to daylight saving time not being good for business, they have some considerable foes when it comes to proponents of the time change.

Perhaps none are more notable than United States founding father Benjamin Franklin, who first suggested something similar to the current daylight saving time way back in 1784. Over the years, daylight saving time has changed depending on a host of factors, including state of the economy and energy consumption. In 2007, the date for daylight saving time was changed once again. This year, daylight saving time starts on the second Sunday in March and ends on the first Sunday in November.
