Age Discrimination Fact Sheet Your best defense against age discrimination is information. It’s worth your time to learn how the Age Discrimination in Employment Act protects you against age bias in the workplace. You also need to learn about the limits of the law. The ADEA is a federal law that protects workers age 40 and over from age-based discrimination in hiring and in every other aspect of employment.

What the ADEA Covers •

The ADEA makes it illegal for employers, employment agencies, and the federal government to discriminate against employees and job applicants who are age 40 and over and work for employers with at least 20 employees.

The ADEA also prohibits age discrimination by local and state governments. In addition, it covers employment agencies and labor organizations, such as unions, that have at least 25 members.

In addition, every state also has a law prohibiting age discrimination in employment. Most state laws apply to employers with fewer than 20 employees.

How the ADEA Protects You The ADEA prohibits employers from discriminating against individuals because of age. This includes decisions about hiring, firing, layoffs, pay, benefits, promotions, demotions, performance reviews, or any other condition of employment. Specifically, the ADEA says: •

Job ads or recruitment materials cannot mention age or say that a certain age is preferred.

Employers cannot set age limits for training programs.

Employers cannot retaliate against workers who file charges of age discrimination or who help the government investigate age-discrimination charges.

Except for a few very narrow exceptions, employers cannot force employees to retire at a certain age.

An important note about firing: We have what’s called “employment at will” in this country. This means an employer can fire you for any reason, as long as it’s not based on a prohibited factor such as age, race, color, national origin, religion, sex, or disabilityThere does not have to be a lawful reason; there simply must not be an unlawful reason.


“Disparate Impact” Employees can challenge policies and practices that do not mention age, but in fact fall more harshly on older workers. Example: A school district announces that it will not hire any new teachers with more than 10 years of experience. This type of case is known as one arising out of “disparate impact.” Policies or practices that have a significantly adverse impact on older workers are unlawful unless the employer can prove that they are based on a “reasonable factor other than age.”

What About Benefits? •

Employers may not deny individuals the opportunity to participate in the employer’s benefit plans because of their age.

Employers may not reduce benefits based on age, unless the cost of the benefit increases with age. In those instances, the employer must incur the same cost for providing the benefits to older workers as it does for younger workers. An example is life insurance. The cost of providing life insurance increases with age. Therefore, an employer does not violate the ADEA if it spends the same amount to buy life insurance for younger and older workers, even though the younger workers will receive greater coverage.

Filing a Claim If you believe you have been discriminated against based on your age, you have the right to file a charge with the Equal Employment Opportunity Commission. This is the federal agency responsible for enforcing the ADEA. •

The EEOC will notify the employer that a charge of age discrimination has been filed against it and will investigate the charge.

If the EEOC determines that the charge has merit, it will attempt conciliation. This means the EEOC will try to persuade the employer to voluntarily eliminate and remedy the discrimination.

If conciliation fails, the EEOC could pursue your claim on your behalf. However, the agency does so in very few instances.

Important Information About Filing a Suit •

Keep in mind that you have the right to proceed to federal court to pursue your age-discrimination claim, regardless of whether or not the EEOC finds merit in your claim.

In addition, you don’t have to wait for the EEOC to conclude its investigation before you file a lawsuit. You need only wait 60 days from after you file the charge. However, if you opt to wait for the EEOC to conclude its investigation, a lawsuit must be filed within 90 days after the agency notifies you that it has terminated the proceedings.


Know the Deadlines There are strict time deadlines for filing claims. The EEOC can help you only if you keep to all the time requirements. •

If at all possible, file a charge with the EEOC within 180 days of the discriminatory action or when you first became aware of the discriminatory action, whichever occurred first. In many states, the time limit to file an ADEA charge is extended to 300 days.

Call the EEOC toll-free at 800-669-4000 or visit www.eeoc.gov for information on time limits. Get details on exactly what you have to do to file a charge.

To File or Not to File? It takes a strong commitment to pursue an age-discrimination suit. While it’s important to know your rights under the ADEA, the law in itself is not the solution to all problems. Consult your lawyer and family before proceeding. •

Legal costs could run into the tens of thousands of dollars, and the legal process could take many months or even years.

A lawsuit can take an emotional and personal toll on you and your family.

You may never have your day in court. In those cases where employees have solid evidence of age bias, research shows that employers are inclined to settle outside of court.

Boost Your Transferable Skills If you are changing careers, you can use your previous work experience to show your potential to succeed in this new role. What are transferable skills employers desire? If you worked in a customer service occupation, a transferable skill could be your resilience. In a busy coffee shop in New York City, it might be common for a customer to say “hurry up with my order,” and being shorttempered and belligerent in your response is not acceptable. It takes resilience to remain pleasant and calm in the moment and for the rest of your shift. A standard interview question is, “Tell me about a situation when you had to use resilience?” First off, the definition alone can cause a candidate to stumble, but be prepared to explain this transferrable skill. WRITING A GOOD RESUME The most basic principle of good resume formatting and design? Keep it simple. Use a basic but modern font, like Helvetica, Arial, or Century Gothic. Make your resume easy on hiring managers’ eyes by using a font size between 10 and 12 and leaving a healthy amount of white space on the page. You can use a different font or typeface for your name, your resume headers, and the companies for which you’ve worked, but keep it simple and keep it consistent. No matter what resume format you choose, your main focus here should be on readability for the hiring manager.

Ditch the Resume Objective Statement “THE ONLY OCCASION WHEN AN OBJECTIVE SECTION MAKES SENSE IS WHEN YOU’RE MAKING A HUGE CAREER CHANGE AND NEED TO EXPLAIN FROM THE GET-GO WHY YOUR EXPERIENCE DOESN’T MATCH UP WITH THE POSITION YOU’RE APPLYING TO.”

CAREER FAIRS WORK… FOR CANDIDATES Don’t Be Shy. This is your chance to shine. As you approach each employer table, be friendly, be confident, and be prepared with something to say. Introduce yourself with a smile, eye contact, and a brief, firm handshake. Often, the recruiter will take the lead and ask you questions, but you should also have your elevator pitch ready—a 30-second soundbite of what you want the company to know about you. (Here’s how to craft one if you’re unsure.) To really use your time wisely, you should be able to concisely convey why you’re interested in the particular company and how your skills or qualifications suit the position. But at the same time—don’t go too fast! Job seekers have a tendency to speak quickly, which comes across as rushed or nervous. You want to speak slowly and with interest. Follow-up is important; do not drop off your resume and forget to follow up. Seriously, that is a waste of a good career fair.

Older adults from all walks of life are returning to the workforce— or joining it for the first time. Many employers value older workers’ knowledge, maturity and work ethic, but finding a job can be difficult, particularly for adults over age 50. Studies show that entering or re-entering the workforce at later ages is more difficult than at younger ages. Older adults, however, have something that younger workers do not have: experience. Even if you have not been steadily employed, you have picked up transferable skills just by living your life. If you are an older adult who has not applied for a job in many years, this guide provides a framework for you to increase your odds of finding employment.

KNOWING YOURSELF AND YOUR SKILLS Start by taking an inventory of the skills and experience you have acquired through jobs and activities in your life. Work, parenting, hobbies, part-time and seasonal work, volunteering—all require skills that can be readily applied to the employment you seek. Describe the main duties for each activity and list the skills you used to accomplish them, then think about how these skills could apply to a job that interests you. For example,

FINDING JOB LEADS The Hidden Job Market Many job opportunities are never listed online, in the newspaper, or in a job bank. Some experts say 80 percent of openings are never advertised. Many businesses do not need to advertise or prefer to hire someone referred to them. Unadvertised openings make up the hidden job market. Your best source of leads for these jobs is your network, people you already know— your friends, neighbors, relatives, former co-workers, church members. Tell them about your job search and ask for ideas about organizations that may be hiring or people they know who can offer information about job openings. Consider adding to your existing network by joining organizations, volunteering, or attending meetings related to occupations or industries that interest you. Make a list of potential employers and learn as much about them as you can. What are their needs and how can you fill them? You can increase your odds at every step in your job search by learning as much as you can about a specific job lead, including the skills and prior experience the job requires. Use your network, newspapers, newsletters and magazines as sources. Once you know about the company and the job, determine the best way to approach it: Send a résumé, complete an application, call the business directly or schedule an informational interview.

PRESENTING YOURSELF TO EMPLOYERS Potential employers will want to see your skills and experience in writing (in a résumé or job application) and in person (during a job interview). Target your potential employers’ needs in your application, résumé and interview.

In Writing Whether you submit a résumé or complete an application, tailor it to the position—when it comes to résumés, one size does not fit all. Use words from the job description, if there is one. It is important to describe your skills in a way to motivate the employer to interview you. Many companies require applications to be submitted online. If your computer skills are weak, find someone to help you fill out and submit your online application.

Résumé Tips Write a summary of your skills and experience targeted to the requirements of the job. Emphasize experience within the last 10 to 15 years. Keep information brief and to the point. Mention volunteer work, training and certifications only if pertinent to the position. Avoid including personal information. Include your education. If you have a GED, list yourself as a high school graduate. If you have a college degree, it is not necessary to list your high school education. Have someone review your résumé for errors.


Application Tips Make a list of your work-related information to take with you when you apply, including dates and positions held, employer addresses, salaries, skills and duties. Read the entire application before you begin and follow directions carefully. Double-check your answers. Type or print neatly and avoid errors. If possible, take the application home, so you can take your time filling it out and seek assistance if necessary. Avoid negative information, such as personal, legal or financial problems. Do not volunteer unnecessary information.

In Person An interview lets you and your potential employer learn about each other. Prepare by learning as much as you can about the company and the position. Practice what you will say, so you feel comfortable and can make a positive impression. Illustrate that age is an asset by discussing your skills and experience in a way that targets the position for which you are applying and shows employers you

are adaptable and willing to learn. Keep in mind that the overall goal of the interview is to describe your skills in a way to motivate this particular employer to want to hire you.

Interview Tips Anticipate questions; prepare answers for each one. Practice with a friend. Review your accomplishments. Anticipate difficult questions about gaps in your employment history, career changes, and so on. Where possible, mention your willingness to learn new skills (such as technical skills) and to work with diverse co-workers and customers. During the interview, listen. Take your time responding. Don’t dwell on topics unrelated to the job. Ask questions about the job to show your interest, but avoid asking about benefits or salary until you are offered the job. By law, interviewers may not ask your age, marital or family status. Do not discuss race, religion, age, national origin or gender.

Production Team Member (1 and 2 Starting Rate: $17.00/hr

 Select appropriate parts to load into welding fixture or cells.  Clamp work pieces into holding fixture on machine bed, or turntable.  Start machine, observe welding action, and examine weld for defects.  Label exhaust system or component, then load onto leak testing fixture.

Basic Qualification / Work Experience:  High school diploma or general education degree (GED).  Minimum three (3) months related experience and/or training in a production manufacturing environment preferred. nd

Hilo Driver (2 shift) Starting Rate: $18.00/hr

 Communicate material request in a timely manner  Coordinate repacking of empty totes  Remove all empty totes, boxes, and recyclables from each cell and properly locate  Responsible to follow procedures for the cleaning and maintenance of the tugger/cart and the HI Lo if used.

Basic Qualification / Work Experience:  High school diploma or general education degree (GED)  Minimum one months’ related experience in Material Handler setting.  Forklift Certification st

1 shift: 4:00am – 2:30pm nd 2 shift: 3:00pm – 1:30am (.50/hr shift differential) The plant runs Monday – Thursday, with overtime on Fridays and Saturdays.
