am delighted to welcome you to this edition of our fabulous magazine – my first as President. Following another positive Year End position I look forward to embarking on another phase of new business support which we are working on for our members and I also look forward to meeting as many of those members as possible and hearing more about their businesses. November sees the first of our new knowledge sharing events where some of the Board Directors will introduce themselves and share their business stories, but most importantly, Directors will hear from members in attendance on their businesses. This will be an ideal way to unearth potential areas of required and available support and ideally result in a more effective use of the valuable experience and expertise that we have within our Chamber network. Our first event focuses on Family Businesses and Succession Planning. If you would like to see a particular business issue addressed, please do contact the Chamber office to let them know. These events are focused on the county as a whole and are held throughout the area we represent. I primarily represent the Aberfeldy area but our Chamber and Board support Perthshire in its entirety. As ever, the Chamber operates an “open door” policy. It is your Chamber. Your ideas and input are always welcome. I look forward to working closely with you in my new role as President. am delighted to be working with new Chamber President Mike McDiarmid who brings a strong set of skills to the table and a wealth of knowledge and contacts from the worlds of farming, exporting, research and development. We are working on the launch of several new initiatives covering Exporting, Training, Start-Up Support and Network Support in response to requests from our members and the drives from Government in line with business and private sector recovery ambitions. We enjoy working in partnerships and are delighted to be part of this year’s Business Month. Bookings are flooding in for our Annual Dinner & Business Star Awards which closes this series of worthwhile business events and takes place on Friday 21st November at Crieff Hydro Hotel. I wish all our finalists the very best of luck with the next stage of the judging process and am delighted that they are already making the most of reaching the shortlist. The main aim of the Chamber’s Business Star Awards is to provide a tool for companies to use to market and promote themselves and it’s great to see them all making the most of it through social media and other avenues for the purpose of developing their businesses and raising their profiles. The Annual Dinner always proves to be a fabulous night of celebration and fun even if you’re not directly involved with the Business Star Awards. FROM WEE PIES COMES BIG SUCCESS Not content with winning the Perth Chamber of Commerce Business Star Award for Excellence in Food and Drink production last November with head judge Chef Andrew Fairlie, The Wee Pie Company has recently won further acclaim having been chosen to supply their wee supper pies to Jamie Oliver’s Fabulous Feasts at The Ryder Cup 2014 at Gleneagles. With a new team of staff the Company has gone from strength to strength, also supplying Perth Race Course this season and repeating its collaboration with The Royal & Ancient Golf Club at St. Andrews supplying their range to its Members. Commenting on the events, company Director Rose Martin said: “it is a real accolade supplying to such iconic companies. We feel very proud and privileged to have been involved with such great sporting events this year. It underlines the quality of our products and allows us to share our passion for making great pies! “This is a really exiting time for our business and we’re very keen to get customers on board with the range and quality of the pies we create. “We are passionate about provenance and source all game and specialty meats locally within Perthshire – or as close to Perthshire as possible – which is great for our suppliers around the county. “We were extremely fortunate to catch up with Chefs Nick Nairn and Paul Rankin (pictured below) at The Dundee Flower & Food Festival and wondered if they might join the Company as our two new Sales Assistants!”

GOLD STAR FOR CRAIGCLOWAN FROM SCHOOL INSPECTORS In a glowing report made public by Education Scotland recently, Craigclowan School in Perthshire has won high praise from school inspectors for all round excellence. The traditional, co-educational school for children aged three to thirteen has an enviable record of achievement over the last 62 years. The inspection took place in June this year and the report speaks extremely positively about all aspects of school life. The inspectors were particularly impressed with the school’s “welcoming, caring and stimulating environment for learning” and praised its purposeful leadership and visionary plan for the future. The report commended its broad curriculum and inspirational extra-curricular programme, highlighting achievements in music and sports where the school is focused on actively encouraging enjoyment in out-of– class activities and celebrating individual excellence. The children themselves received recognition as articulate and enthusiastic learners at all stages, producing “work of a very high standard across different areas of their learning”. Craigclowan offers a modern and distinctive education but also places much emphasis on learning beyond the classroom, having over 50 extra-curricular activities on offer each week. This combination has resulted in Craigclowan children receiving 115 scholarships to leading senior schools in the last eight years.

ROSY FUTURE FOR SOMETHING SPECIAL FLOWERS Something Special Flowers entered an exciting new chapter recently when they started trading from their newly refurbished premises in Blairgowrie’s Allan Street. This is a fresh new start for the former Chamber of Commerce Business of the Year Winners, with their first owned shop and a complete rebranding. The business has built up its reputation from its Wellmeadow shop over the last 11 years, but the opportunity to purchase their very own premises was an opportunity not to be missed and the move has been warmly accepted by the local community, who have acclaimed this new addition to what is one of the town’s busiest shopping areas.

Since winning the Chamber of Commerce Star Awards in 2009 the team at Something Special have gone on to achieve great success at RHS Chelsea with medals in the last three years including three Golds and the VOWS title of best wedding florist in 2012. This latest move will enable the business to realise the ambitions of bringing floristry classes to Perthshire – and even floristry holidays in the near future. Already Stephen, Jillian and the team have been encouraged by the public’s enthusiasm to their new gift ranges and positive remarks about the ambiance for their new surroundings. All looks rosy for the future at Something Special Flowers.

SCONE PALACE OPENS ITS DOORS TO OVERNIGHT GUESTS After months of renovation and conservation works, this summer saw Scone Palace open its doors to overnight guests for the very first time, adding an accommodation offering to their portfolio. The refurbishment of the apartment was the collaboration of Perthshire Architects, Harry Taylor & Co, Marshall Construction and interior designer, Louisa Gordon Cumming – all of which was personally overseen by Lady Stormont. CEO, Sarah Butler commented: “The estate is constantly looking for new ways in which to diversify and this is just one of a series of developments we have planned over the next five to ten years.”

The new Balvaird Apartment is set within the Palace itself and has been finished to an exceptionally high standard and recently graded 5 Star by VisitScotland. It is an ideal gathering place for families or colleagues celebrating a special occasion, for golfing breaks, country sporting holidays, wedding parties and short breaks. The apartment has been designed to accommodate up to six guests on a self-catering basis, and each of the three luxury ensuite bedrooms have been individually styled and named after family members. Guests can relax in the comfortable sitting room with magnificent views over the parklands to the River Tay or make use of the Sky television and Wi-Fi facilities. And it goes without saying that each stay will include a tour of the Palace and Grounds.

GLENEAGLES UNVEILS NEW EVENTS ARENA AND TENNIS CENTRE Hot on the heels of hosting a successful Ryder Cup, Gleneagles has announced plans for a new 2500 square metre event space – The Gleneagles Arena. Located within Gleneagles’ 850 acre estate, as part of its Activity School complex, the Gleneagles Arena will transform one of its current equestrian arenas into a modern and versatile event space which also doubles as a 4-court indoor tennis centre. Due to launch in Spring 2015, the new space will be perfect for conferences, exhibitions, product launches, concerts and team-building events. With capacity for 500 – 2000 guests, the five star resort will now be able to accommodate much larger groups. SCOTTISH THISTLE AWARDS The Scottish Thistle Awards are designed to discover and celebrate excellence and innovation by the Scottish tourism industry for visitors. For the first time, the Scottish Thistle Awards are being managed by several organisations, including VisitScotland, the Hospitality Industry Trust Scotland Scottish Tourism Alliance, Highlands & Islands Tourism Awards and the Scottish Licensed Trade Association. The Scottish Thistle Awards are based on regional champions from four areas around Scotland: • Highlands and Islands • North East & Tayside • South Central East • South Central West At time of going to press several Chamber members had been shortlisted. The second Perth and Kinross Business and Enterprise Month offers an innovative and exciting programme of free events designed to assist, encourage and inspire local businesses to become success stories. A spokesman for the group said the Perth and Kinross Business and Enterprise Month aims to offers something of value to every business, regardless of size or nature of their activity. He said: “Perth City Region is one of Scotland’s fastest growing areas. RYDER CUP

BUSINESS BENEFITS AND IMPACT As part of the business and community toolkit, Ryder Cup materials were available for businesses to order, free of charge. A business display competition attracted a number of entries throughout Perth and Kinross. Entries were creative and had a high visual impact which helped to create a sense of place and occasion. The winning entry was Marian’s of Perth and the runner up was Whisper Lingerie in Auchterarder. A dedicated section on the Council Ryder Cup website was developed with business information including information on tendering for contracts and engaging with Visit Scotland on promotional opportunities. THE 40th Ryder Cup was held at The Gleneagles Hotel, Perthshire, 23rd-28th September 2014. The Ryder Cup is one of the biggest sporting events in the world and drew a daily on-site audience of 52,500 from 75 different countries and an estimated TV audience of 600 million viewers across 183 countries. Perth and Kinross also hosted the Junior Ryder Cup at Blairgowrie Golf Club and attracted the highest ever audience for this event, 6,200 spectators over 2 days. The international nature of the event gave Perth and Kinross a unique opportunity to promote itself on a global scale. In order to capitalise on this, Perth and Kinross Council carried out a number of activities to maximise the business benefits from hosting the event. Golf Perthshire is an industry led initiative which will provide a lasting legacy from the Ryder Cup by growing the golf tourism sector in Perth and Kinross. Key activities include the development of a website www.golfperthshire.com, social media and online marketing materials, branding, communications, and membership recruitment. Ryder Cup and Junior Ryder Cup Business Briefings and Seminars were delivered to businesses in Auchterarder, Perth and Blairgowrie. The briefings provided businesses with information on the events, and highlighted the initiatives Perth and Kinross Council carried out, as well as the opportunities that are available to businesses from these global events. Marketing support was given to businesses in Auchterarder and Blairgowrie, promoting the areas as open for business throughout the events. This included promotional leaflets and press coverage.

The Council promoted Perthshire as a place to visit and invest in through marketing on Park and Ride buses and big screens located at Park and Ride sites. 15 buses were branded, both internally and externally, with Perthshire messaging and footage and images of the area were featured on screens at Park and Ride sites. Perthshire was also represented on the Visit Scotland Exhibition Stand at the Ryder Cup. A number of golf related activities took place in Perth City during the week of the Ryder Cup. These included musical and entertainment performances, golf simulator and crazy golf and a big screen showing the tournament. The economic benefits from the Ryder Cup are significant. The estimated benefit is a predicted £100m for Scotland and £25m for Perth and Kinross. An assessment of economic impact is underway and the results of this are expected by March 2015.

PRESIDENT POST FOR HIGHLAND PERTHSHIRE DIRECTOR

A

berfeldy businessman farmer Mike McDiarmid has been appointed President of Perthshire Chamber of Commerce.

Mike (47), whose family has farmed in Highland Perthshire for generations, takes over the reins from Crieff hotelier Stephen Leckie. Married with three children, Mike has helped drive his family’s diversification projects forward into internationally acclaimed seed potato and fertilised chcken egg production, House of Menzies coffee shop, gallery and retail centre and Castle Menzies self-catering holiday cottages. A director of PCC for the last four years, Mike takes a keen interest in exporting and is anxious to encourage fellow members to tap into the potential of foreign markets for their products. “I am lucky enough to have recently become a Director of Caithness Potatoes in Perth which is a market leader in breeding and exporting, supplying direct into many foreign markets,” explained Mike. “Through our Mak Farmers company we also see our fertilised hatching eggs sold all round the world,” he added, “so I am acutely aware of the potential for all sorts of products to find new markets overseas and this is something I would like to progress during my term in office.” Mike will also help represent the agricultural and tourism sectors of Perthshire’s business community locally, nationally and internationally but stresses he will be an equally forceful mouthpiece for all types of local businesses.

Golfers again snapped up places in record time to embrace the magic of one of the world’s greatest sporting events at Perthshire Chamber of Commerce’s very own tournament on the Rosemount Course before it saw the cream of the golfing world’s juniors take to the fairways. Teeing off after lunch, players enjoyed a terrific afternoon of golf with fabulous scenery and perfect weather conditions. Growing Agritourism

Go Rural is leading an initiative to help grow Agritourism in Scotland with the overall objective of improving the profitability, productivity and sustainability of the farm, estate or croft business and create a more vibrant

and mainstream Agritourism industry. Perthshire-based Go Rural business manager Sheena Howden outlines the exciting new initiative to InCommerce.

G

o Rural came out of a Scottish Enterprise Rural Leadership Programme and was originally run as a pilot covering only a small part of Scotland but is now national and has members from the Shetland Islands down to Dumfries and Galloway. Although it is a young business, it has enormous potential for growth. The reason being that the Agritourism sector is seen as a real growth sector for various reasons which include future CAP reforms, succession planning and farms, estates and crofts requiring to look at other income streams to ensure the viability of the business. The other main reason for this being a growth sector is that there is an established International Agritourism consumer taking holidays in countries where Agritourism is established and where this is marketed effectively. Scotland is not known for Agritourism at present and is not marketed internationally in for this sector. Go Rural is working to establish what the market potential from worldwide consumers may be. Scotland’s domestic leisure sector also have an increasing awareness about farming, food and the countryside and this is also a key growth sector.

Businesses operating in this sector are some of the leading businesses in Scottish tourism and leisure. Go Rural invited Julian Pace, Director of Rural For Scottish Enterprise to visit Tuscany and Umbria with them in July to


ECONOMIC DEVELOPMENT see how Italy, the world leader’s in Agritourism is fairing in this market. Since Caroline visited Tuscany in 2012 for her Nuffield Scholarship research, the Agritourism market in Italy has increased by 200 million Euros to a value of 1.2 bn Euros for on farm tourism alone, not including downstream activity or the multiplier effects in the economy. In 2012 this value was 1bn euros, so this confirms that Agritourism policies in Italy have continued to ensure growth for this important market for the Italian agriculture and tourism sectors. In order to understand what Scottish agritourism could achieve, we have compared Tuscany, one region of Italy to Scotland across a number of factors. We believe, given Tuscany’s market share is around 300 million Euros, with a lower population and lower land mass than Scotland, it is fair to give Scotland a target to achieve a market worth £200 million per annum, directly to farmers, estate owners and crofters from on farm agritourism within the next 3 to 5 years. In September, Go Rural returns to Tuscany and Umbria with 10 of Scotland’s leading Agritourism businesses for a learning journey. We will also be looking in the future at other learning journeys and visiting other countries to look at best practice. Go Rural have recently met with various representatives of the Scottish Government to discuss how the Government can best support the growth opportunities which Agritourism presents for Scotland. The SRDP funding pot will be considerably reduced and it is likely that there will be a lower number of grants available for farm diversification and that the amount of capital grant in itself will be lower. Some of the most successful agritourism businesses in Scotland were supported by previous rounds of SRDP funding and have since expanded, are employing an increasing number of people and are having a significant impact on the rural economy. We want to see new businesses offered support to allow the sector to grow. Our aim is to bring the sector together through digital connectivity, cross-selling and through a series of member

only business events and business suppers throughout the whole of Scotland, as well as Go Rural at the Parliament. The annual conference will be held in February 2015 which will bring everyone together to network and develop ongoing relationships. Go Rural has launched a range of business services packages which will promote the best quality rural businesses in Scotland and bring businesses together to cross-sell and network. The idea is to promote the talent that exists in the rural sector in Scotland. www.goruralforbusiness.com. Go Rural are also faciliators for the Scottish Enterprise Agritourism Monitor farm project. The aims of the project will be to improve the business performance and offering of the two Monitor Farm businesses and encourage participation by attendees which will lead to measurable improvements in their own rural tourism businesses. The two monitor farms chosen were Peel Farm, Angus and Laggan Outdoors, Dumfries and Galloway. The information gained from the project will prove invaluable in helping steer and advise future Scottish rural tourism initiatives and the improved business acumen of attendees will contribute towards the performance goals set out in the Tourism Scotland 2020 strategy. This is a tried and tested way to share knowledge, generate ideas and provide peer group support so that business owners have the confidence to invest and grow their business. In the summer we successfully ran a crowdfunding campaign raising £16,000 to raise funds to contribute to employing a talented Communications Graduate to help tell the story of Scottish Agritourism to the world. We were one of the first tourism businesses to raise money through crowdfunding and are now in the proceeds of employing a new member of staff. Over the coming months Go Rural will be working with others in the public and private sectors including the estimated 1000 Scottish Agritourism businesses to agree a strategy for growth in Scottish Agritourism and to tap into the worldwide Agritourism consumer market. Go Rural believes the Scottish market is currently worth £100 million, Go Rural is working to double this direct economic impact within the next three to five years. Insulate pipework – it’s advisable to insulate any pipework that’s exposed (even in loft space) and this includes condensate drain and cold/hot pipework. Fit a magnetic filter – a filter system will retain debris and ferrous material that accumulates in the heating system. Sediment could have settled due to the system not being in operation over summer months. A filter should be used to not only loosen sediment but collect it as well. Check radiators – make sure that you bleed radiators, especially those at the highest points of your system and ensure that when the system is on, heat is distributed evenly across the surface of the radiator. LAW EATS INTO FOOD WASTE FAILURES Every day in Scotland we throw away the equivalent of 2.6 million slices of bread.

Every year Scottish households throw away £93 million worth of dairy waste – enough for everyone in Scotland to have milk on their cereal for the next six months.

We throw away £70 million worth of fresh fruit every year in Scotland – the equivalent of an apple a day for every schoolchild and teacher in the country for 18 months.

THE Waste (Scotland) Regulations 2012 have already impacted on many food and drink operations across Perth and Kinross. With the second phase about to bring the vast majority of local eateries within the new laws on January 1, 2016, waste management specialist Jim Brown, commercial manager with BInn Group, talks to InCommerce about the legal requirements to segregate food waste and the repercussions for local businesses.

I

n January this year the Waste (Scotland) Regulations 2012 legislation became law, requiring any business that prepares, produces or sells food and generates more than 50 kg of food waste per week to separate their food waste for collection. (* There are exemptions.) On January 1, 2016. that 50 kg will reduce to 5 kg effectively capturing all food businesses even if you are just a small cafe producing teabags and coffee grinds. Extensive publicity leading up to January 1, 2014, means all businesses should be meeting their legal obligations and have their food waste collected as a separate waste stream. If not, they risk falling foul of the law and SEPA has the power to prosecute with fines of up to £10,000. Businesses producing more than 50kg per week of food waste were encouraged to comply well in advance of the law becoming active and those who face similar legislation in 2016 are being urged to think about getting into the way of segregating food waste now. As Jim Brown, commercial manager with Binn Group points out, the new law makes sound environmental sense. “In the past, food waste was collected with general waste, mixed in and gone pretty much to landfill,” he explained. “Food waste contaminates everything so it ruined good recyclable materials meaning more went to landfill by default.

“Our business is geared round landfill diversion so we look at putting everything through our materials recycling facility but food waste contaminates other waste that could have been recycled. “Now segregating at source means we can do something with that food waste,” explained Jim. “We are actually generating electricity from people’s discarded food. It shows what can be done if material is handled properly at source.” The other benefit to food and drink businesses is focussing the mind on how much waste they generate. Legislation is not geared to increasing volumes of waste but rather to try and reduce them. The cost of throwing waste away is significant and when businesses see the volume they produce in a separated bin it brings home the terrible waste of food. It focusses a business to look at food preparation, portion control etc. all of which leads to less tonnage of material being thrown out into the bin. “We want to see food waste tonnage reduced and also do something better with it,” said Jim. “This shouldn’t be seen as a hassle for businesses or a drain on their resources. It should be seen as a positive step for everyone.” In November 2013, a report carried out by Zero Waste Scotland identified the scale of food waste in this country – most of which could have been eaten.

In the hospitality sector alone, the total annual mixed waste was 266,200 tonnes – food waste accounted for 85,600 tonnes of that total. Over 32 percent. Of that food waste, 75% was avoidable and could have been eaten. It arises from three main areas – 21% spoilage, 45% food preparation and 34% from customers’ plates. The cost of food waste to Scotland hospitality and food industry is currently £166 million a year (from same 2013 research). “There are huge financial savings to be made by businesses reducing food waste by understanding how and why that waste is created in the first place and take action to reduce or prevent it occurring,” said JIm, “and everyone in Perthshire can play their part.” As part of the Waste Scotland Regulations it is mandatory for all businesses to have recycling separation for paper, cardboard, plastics, glass and cans – and now food. All of this ties into the endgame that by 2025 only 5% of waste in Scotland will be allowed to go to landfill. Seventy percent must be recycled and 25% can go for energy recovery, anaerobic digestion, composting etc. “It’s an ambitious target – but achievable. I think the Waste Scotland Regulations point the way ahead,” said Jim. “They are stealing a march on the rest of the UK and they are viewed as being both ambitious and progressive. “In many ways, however, we are just catching up with other parts of Europe but people are sitting up and taking notice of what we are doing in Scotland. “This is essential legislation. Until it came in people only paid lip service to waste management. Many signed up to best practice before legislation kicked in but others have been driven to do it only by law.”

Some businesses may feel they don’t have room for segregated waste bins but Jim points out that instead of having one large bin for all your waste, have three small ones for segregated waste – taking up the same footprint. “We do encounter issues with customers who don’t do it properly and contaminate their waste,” he explained. “But we have people here who go out to speak to businesses, engage with them and look at ways to encourage staff and reduce contamination. In long term this will reduce a business’s costs because the cost of general waste disposal is continuing to rise at a very high rate. “There are also issues (particularly with bigger operations) where there is a transient workforce, changing all the time. But we encourage them to make it part of their employee induction process so that they know the segregated bin system operating in the kitchens and the demands of the business’s own standards and the law of the land.” Segregated food waste is now seen as a useful energy resource. Through an anaerobic digestion plant, one tonne of food waste can generate about 300 kw hours of energy. TEG Environmental handles around 30,000 tonnes of food waste a year through its plant at the BInn Group waste management and recycling complex at Glenfarg. And according to the Renewable Energy Association, if all of the UK’s DOMESTIC food waste was processed by AD it would generate enough electricity to power 350,000 households.

* Exemptions – In Perth and Kinross there will be many businesses exempt from the new laws because of their geographical location. Legislation is based on population size or how close a business is to a “major” settlement. Businesses should check through the rural postcode search on the Zero Waste Scotland website.

WELLBEING AT WORK Marliese Richmond, Planning and Policy Officer with Perth and Kinross Council, takes a look at what’s being done locally to promote good mental health in the workplace.

W

ellbeing Week has just been celebrated here in Perth and Kinross, with an extensive programme of activities taking place in October. Many employers were involved: from large scale companies such as SSE and Aviva; to projects such as the Biodynamic Vegetable Garden at Camserney; to individual therapeutic practitioners; organisations from across the voluntary sector such as Wisecraft, Giraffe and Six Circle; organisations with a focus on physical health such as Live Active Leisure; and statutory bodies such as NHS Tayside, Police Scotland and Perth and Kinross Council. These employers and employees recognise the importance of good mental health. Some people call mental health ‘emotional health’ or ‘wellbeing’ and includes: • How we think and feel about ourselves and other people • How we enjoy life and cope with its challenges

• How we react to and cope with events and our surroundings at home and at work • How we deal with change • How we communicate, form and keep up relationships, and learn. Recent survey statistics show that one in four people experience a mental health problem and more than a third of absences from work are mental health related. Each case of stress-related ill health leads to an average of 29 working days lost per person per year. Over half a million people report that work related stress made them ill and one in five people say they find work very or extremely stressful. Mental health problems at work cost Scottish employers over £2 billion per year.


BUSINESS ADVICE

In the course of a year, the total cost of mental health problems per employee for Scottish employers is £970. Employers have a duty of care to look after the wellbeing of their staff. The Healthy Working Lives programme provides information, advice, and other services to help create healthier workplaces. They can provide awareness sessions for staff and support health promoting activities in the workplace, and it is possible for employers to enrol in an Award Programme. In relation to Wellbeing, for example, Healthy Working Lives can provide guidance on managing stress, and can assist employers to carry out a ‘stress audit’. Email hwl.tayside@nhs.net for more information. They also run ‘Mentally Healthy Workplace Training’ which covers lots of different issues. Some of the things that help promote mental wellbeing in the workplace – like allowing adequate breaks and keeping an eye on staff workloads – are obvious to most and should be on any manager’s watch list. But beyond that, what works and what doesn’t? What about accommodating staff who have a disability relating to a mental illness? How should managers and work colleagues behave towards staff members who have become ill? Undertaking this nationally accredited course is a practical step employers and managers can take towards promote good wellbeing within their work place. Employers and colleagues can also play an important role in suicide prevention. The Choose Life Suicide Prevention programme aims to tackle the stigma and taboo around suicide. The ‘Read Between the Lines’ campaign calls

on everyone to be alert to the warning signs of suicide in their employees and workmates, as well as family and friends. The message is that if you’re worried about someone, asking directly about their feelings can help to save their life. Serious talk about suicide does not create or increase risk; it can help to reduce it. Openly listening to and discussing someone’s thoughts of suicide can be a source of relief for them and can be key to preventing the immediate danger of suicide. If a person does feel suicidal, encourage them to contact Breathing Space on 0800 83 85 87 or Samaritans on 08457 90 90 90, or visit their GP. One example of employers taking an active role in suicide prevention are those pubs which are members of the Pubwatch scheme. During Suicide Prevention Week, they distributed colourful beer mats which promote the key suicide prevention message of “Suicide. Don’t hide it. Talk about it.” and highlighting the Samaritans and Breathing Space helplines as well as useful webpages. The staff members of the Old Ship in Perth, for example, are very aware of mental health issues and are caring and considerate towards their customers. They have been making use of the beers mats on all their tables, where they have received good feedback. People read them and have even been taking them home. Change is coming, we’re just not sure what yet On 18 September, the people of Scotland voted in an historic referendum and the result was to remain part of the UK with the additional powers pledged during the final week of campaigning being sought. The question now on many people’s minds is “what next for Scotland?”.

All five political parties in Scotland are in agreement that Holyrood should be given further powers, with greater control expected over finance, welfare and taxation, but the proposals all vary subtly. The timetable for determining additional powers has been set, and it is tight; a command paper, setting out the process, is due by the end of this month, a White Paper (setting out proposals) by the end of November and a draft Bill by Burns Night 2015. With a general election taking place in May 2015, it is unlikely that the Bill will make it through the full legislative process before the elections. Only time will tell the effect of the elections on the Bill’s content but each party clearly has proposals they may look to include in the draft Bill after the elections. Tax is one of the main areas touted for change and an area which presents a key concern for businesses in Scotland. Whilst some parties have suggested wider tax powers across a variety of taxes, all parties have promised further income tax powers.

The exact extent of those powers differs party to party but the main focus has been on personal tax rather than, for example, corporation tax or national insurance. That said, any change to income tax could still have an impact on the recruitment and payment of staff by businesses. There are of course changes coming into force in Scotland which will create some divergence in tax regimes – SDLT will be replaced by Land and Buildings Transaction Tax, Scottish Landfill Tax will go directly to Revenue Scotland (both from April 2015) and the Scottish Parliament can vary income tax rate in Scotland by 10p in the pound (from April 2016). If further tax powers are granted as part of devolution talks, the result would be greater divergence between the Scottish tax regime and rest of the UK, with potential for additional compliance costs to operate within Scotland and the UK. There has also been discussion about the creation of Scotland’s own health and safety executive, employment tribunals and consumer advocacy, although this

does not have cross-party support. Businesses should watch with interest here as separate agencies in these areas could result in additional costs and separate rules for businesses to comply with in Scotland. Everyone expected a lot of negotiation if a “Yes” result had been returned, but we should anticipate plenty discussion before further devolution of powers, most likely to happen in 2016. Political and constitutional change can cause market volatility and present unknown risks and issues. While we cannot be sure of exactly what will happen, change is coming and businesses should ensure they are equipped with as much knowledge as possible to keep business strategies and plans on track during this period of uncertainty.

VERDICT ON OBESE EMPLOYEES HANGS IN THE BALANCE

W

ith soaring levels of obesity now the norm, the pending outcome of a European Court ruling may have implications for employees whose weight is causing them problems at work. Alan Matthew, employment law expert at Miller Hendry, tells us what this ruling may mean: Since 1993, obesity levels have doubled, with statistics showing that a quarter of the current UK population is obese, and the problem continues to grow.

Depending on the outcome, it is possible that in the very near future employers may have a duty to make reasonable adjustments to the workplace to help obese employees. That could range from avoiding duties that demand mobility through to bigger desks or chairs, or making sure that other employees don’t make comments about their weight. In fact everything you would be reasonably expected to do for employees with any other disability. A recent Danish case is currently being considered by the European Court, in which an ex-childminder has claimed that his contract of employment was terminated because of his weight, and that this amounted to unlawful discrimination. The Advocate General has suggested that severe obesity could amount to a disability but it would have to be so severe that it prevented someone from taking a full part in their professional life. He also suggested that employers could not claim that the condition was self-inflicted, because by that it would mean that any disability suffered through an individual’s risk taking could be excluded, such as horse riding or skiing injuries.

NATIONAL MINIMUM WAGE INCREASES

F

rom 1 October, workers over 21 earning the national minimum wage saw their pay rise by 3%, taking the hourly rate from £6.31 to £6.50. This is the first time in 6 years that an annual increase has exceeded inflation. Younger workers and apprentices also saw their pay rise by an above inflation 2%. The rise took place against the background of Labour’s promise to increase the minimum wage to £8 an hour by 2019 and the shake-up of the benefit system, which many believe will result in fewer state benefits for workers in employment.

Labour’s view is that the burden of making work pay should be on employers and not on the state. However employers have expressed concern that continued above inflation increases – designed, according to the Low Pay Commission, to restore the value of the minimum wage – will be unaffordable and will put jobs at risk. What is clear is that as the economy continues to recover, more above inflation increases are likely. It seems that better times for employers and employees never get any closer, with employers facing a 3% increase in wage bills and employees still as far away from a better life as ever: on £6.50 per hour an employee will have to work for around 3 weeks solid to buy the latest iPhone6 plus – before even thinking of groceries. etting active and staying active is one of the best things you can do for your health.
