We hope you have had some time off to relax and enjoy the hours of sunshine which Perth and Perthshire offered us this season – more would have been nice! This time of year, when the school term has resumed, is a traditionally busy time for us and a month when many people, who were stalling putting their home on the market, take the plunge. PSPC: Ticking More than the Property Box!

The chances are that you are reading this guide because you have a property to sell, are hoping to buy or possibly both – either now or in the near future. You couldn’t have chosen a better place to start as PSPC is the leading Perthshire property network. Wills and Estate Planning Peace of mind is invaluable. Whether you’re 18 or 80, it’s never too late to arrange or update your Will. The law relating to succession and inheritance can be complex, particularly in relation to second families, unmarried couples and single parents. You can’t assume that everything will automatically pass to your spouse, partner, or children (or that it won’t, if that is what you expect!) You may have already made a Will but have since divorced, separated, or experienced bereavement or some other life-changing


5 Having a Power of Attorney prepared in advance gives reassurance that your affairs will be taken care of by people you appointed and trust. Powers of Attorney can be for either Financial or Welfare powers, or typically a combination of both. If you don’t have one in place and are incapacitated and no longer able to look after your affairs, your family or loved ones’ only option may be to apply for Guardianship, which would have to be applied for through the Court system, and can be a lengthy and costly process.

Your personal circumstances It can sometimes be easy to assume that we understand how the law applies to our own personal circumstances. This can be a costly assumption. The introduction of the Family Law (Scotland) Act 2006 heralded a new level of recognition for those who live together but choose not to marry or enter into a civil partnership. Unmarried (opposite-sex or same-sex) couples who separate now enjoy similar rights to married couples and civil partners. It won’t hurt you to know the facts about your personal rights, and what the implications will be if things don’t work out, especially if you are buying property together. Depending on your circumstances at the time of a purchase, consideration should be given to the Family Law Acts and to the status of your relationship if you are buying along with another person. They could be a spouse, partner, relative or a friend. The law in relation to married couples is well versed but it is still important to take advice particularly if one party is putting in a larger sum of money to fund the purchase price. As regards co-habitees, in terms of the 2006 Act, some rights have been created for couples who are living together but have not married, however before entering into a purchase, which is a form of contract, thought should be given to how any money is contributed to the purchase price and then also to the mortgage repayments during the relationship. It is important to know your rights and consult a solicitor who specialises in this area. It can often be too late to deal with matters, after the event, if provision is not made at the outset of a transaction. If a property is bought in the name of two or more people who are not in a relationship, for example as an investment, then the Family Law Acts would have no relevance and therefore it is important to take advice in order to avoid there being any dispute and, inevitably, a falling out!

Power of Attorney Powers of Attorney are generally used when someone loses the capacity to make decisions about, or manage their own affairs, whether financial or relating to health and welfare. Most consider that this usually only applies in old age or as a result of some debilitating illness such as dementia. However, have you ever considered who would look after your legal and financial affairs if you were involved in an unexpected accident, became seriously ill, or suddenly incapacitated, such as following a stroke?

Your children’s future Guardianship can also apply to children below the age of 16 where both parents have died. Although nobody wants to think of this possibility, our member firms can offer advice on the options available to you to ensure that it is clear who will be responsible for looking after your child(ren) in these circumstances. Guardians can also be appointed to look after the affairs of, and make decisions on behalf of adult children (age 16+) who do not have the capacity to do so themselves.

Long-term care planning People are generally living longer, increasing the propensity for debilitating conditions such as dementia and strokes. Nobody wants to think about the prospect of long term residential care (and especially the likely cost!) If this is a concern for you, or you would just like to be aware of the risks, particularly with regard to your home, our member firms can advise on the potential financial impact of care costs, and the options that you have to try to reduce them.

Going back to property Although most of our readers are buying or selling property for themselves and/or their families, circumstances may change. You may be thinking about renting out a second home, a room or part of your own home in the future. Or you may be thinking of renting a property instead of buying.
