July 2012 Issue 10 REAL ESTATE PARTNERS

pr vi w

From the directors Dear Reader, The team at Eview Real Estate Partners is proud to bring to you our tenth edition of “Preview,” an exclusive publication of the Eview Group of Professional Estate Agents. It is our goal to provide you with relevant real estate information to keep you fully informed on the state of the market, and tips on how to maximise your profits through real estate. So how is the market? Probably the most asked question of a real estate agent! Despite a softening of retail spending and sluggish confidence levels in recent times, property owners should take comfort with reports from the Federal Reserve Bank and media outlets that interest rates will more than likely stay on hold for the remainder of this year. Coupled with a decrease to the Victorian First Home Buyers stamp duty rates, we should start to see a slow return to normal levels of clearance rates as buyers begin to re-enter the market place in the lead up to the Spring selling season. The near future looks very promising and this is a great time to be out there with prices at levels that could look terrific in a years’ time. What should I do? Probably the second most asked question of a real estate agent! Personal circumstances vary between one client to another. If you are a potential buyer or investor, the buying time line should purely be based on personal financial circumstances. The right time to buy is always when you can best afford to; not trying to pick the lowest point in the market. By waiting, you risk paying far more as the market always bounces back far more quickly and steeply when it is rising. We hope you enjoy our tenth edition. We also like to thank our local sponsors and contributors to the publication, as without their assistance, it could not be possible. We welcome your feedback and encourage community contribution; if you are having a community or charity function, be sure to register with us and receive free internet & editorial listing to promote your event. Many of our team are expert auctioneers and would be more than happy to support worthwhile causes. Email your requests & comments to news@eview.com.au or visit our website for more information. We look forward to assisting you in all your real estate needs,

In the Spotlight Andrew Batty Andrew Batty currently oversees his company, Competitive Greatness Training, which focuses on coaching, mentoring, motivating, and training people to tap into their true potential. Previously, he was a senior executive in a large organization. After fifteen years in that role, he was not satisfied that he was using all of his Godgiven talents and abilities. In operating his own business, Andrew is now doing what he was born to do, and is passionate about showing others the journey to do the same. On a daily basis, he now coaches and mentors people to live the life they were born for. Clients include business owners, business professionals, university and school students starting on their life journey, the unemployed who feel that there is no way forward, and people who have gone through the correctional services system and want a new start. Andrew has coached others at all levels of life to reach for their dreams.

In his recently released book, ‘Born for This’, Andrew reveals how to wake up every morning, live the life of your dreams, and say with passion, “I was Born for This.” He challenges you to envision your ideal life. He encourages you to discover the things are you passionate about and how you would spend your time in an ideal world? Property news IDEAS TO HELP YOU WHEN YOU’RE BUYING OR SELLING

End of Financial Year Checklist Tax time has arrived once again and for some the experience may appear a little daunting, but if you streamline the process and know what you can claim for in advance, the task can become a lot easier. Below is a list of tax deductible items that you can claim for your tenanted rental property: • advertising costs • bank charges • any body corporate fees that apply • council rates including sewerage and water • gardening and lawn-mowing costs • insurance (such as landlord insurance) • property agent fees or commissions • interest expenses (such as those incurred on a loan to purchase the property) • decline in value of depreciating assets (such as air-conditioning, lights, rugs, dishwashers, freezers, fridges) • legal expenses (for example, costs incurred for a defaulting tenant) and • travel undertaken to inspect the property or to collect the rent. Other items that are claimable include the cost of any repair work which includes, for example, replacing a damaged fence caused

by a storm or a falling tree, maintaining the property in its current state or work which prevents deterioration of the property, such as painting the property or maintaining the plumbing. (However, please remember that you cannot claim expenses you incurred whilst renovating/decorating to make the property rentable.) You can also claim your borrowing expenses associated with the property such as: • stamp duty which was charged on the mortgage • the cost of establishing the loan • valuation fees • mortgage insurance • any title search fees charged by your lender and • mortgage fees and document costs. This is not an exhaustible list and advice should be sought from your accountant or the Australian Tax Office.

First home assistance update

Getting Access To Your Deposit This week’s topic is about getting access to your deposit money before settlement day. It’s not as straight forward as you think and you need to be careful especially if you buying another property. Section 27 - The Facts In most property transactions it is normal for a Purchaser to commit up to 10% of the purchase price which is the deposit. The concept of the deposit is to show the Vendor the Purchaser is serious about buying and they pledge a deposit to prove it. The following information details the process and highlights an underling fact your Vendor may not get their deposit released prior to settlement. Victoria law concerning deposit release Victoria has strict guidelines surrounding the release of deposit money held in either the real estate agent’s or conveyancer’s trust account. The law is known as section 27 deposit release and it details the guidelines of the process on how the deposit money may be released. The deposit cannot be released just on the Vendor’s request, irrespective if the Vendor wishes to use the money to buy another property. FREQUENTLY ASKED QUESTIONS ABOUT DEPOSIT RELEASE Who gets the interest earned on the money held? The interest earned is placed into a separate trust which is like an insurance fund. Neither an Agent, conveyancer nor the Vendor can claim this interest. What is the process for the release? The conveyancer will prepare a section 27 statement which relates to the financial position of the property. It will detail any mortgages or caveats (if any) and is in the form of a notice which is served onto the Purchaser of the property. The Purchaser has 28 days to consider the section 27 statement before allowing for the deposit to be released. If the Purchaser is satisfied with the details in the statement then deposit maybe released to the Vendor. If the Purchaser objects to the release of the deposit they must have reasonable grounds to do so. This objection may simply be confirmation of the section 27 statement details from the Vendor’s lender or there is a condition in the contract which allows the Purchaser a valid objection. If the Purchaser fails to respond to the

section 27 statement within 28 days then the deposit maybe released after the 28th day from the notice being served. What if the Vendor needs the money for a deposit to purchase another property? The deposit can only used by the Vendor once it has been released. Upon its release the Vendor then can use it for a deposit on another property or any other purpose. This can cause a great deal of stress especially if the Vendor has committed to paying a deposit under a purchase contract. Eview Conveyancing can assist clients wishing to pay a deposit on a purchase contract upon the successful release of the deposit from their sale. Most agents will understand the position these clients are in and a well drafted Special Condition could see a contract being entered into and getting another sale over the line. However the offer may not be as strong in comparison to other offers with a ready cash deposit. Why does the Purchaser need to see the details of the Vendor’s mortgage? The Purchaser needs to be assured if the deposit is released then at settlement there will be sufficient monies available to discharge the Vendors debts secured against the title. If the Vendor cannot demonstrate to the Purchaser their financial position then most likely the deposit will not be released. Can an agent write a special condition releasing the deposit monies immediately? No, a special condition cannot be used to release the deposit. IMPORTANT THINGS TO REMEMBER ABOUT DEPOSITS • There are NO guarantees that the deposit will be released prior to settlement. Even if there is sufficient equity in the property and the Vendor has followed the correct section 27 release process. • Before Vendors commit to buying another property speak to Eview Conveyancing and get free advice on how structure an offer dependent on the Vendor’s sale deposit release. Vendor’s sell faster with Eview Conveyancing, call us on 9781 7555 to arrange your conveyancing needs.

on the purchase of a $400,000 home they will save $4,911 and on a $550,000 home they will save $9,321.

Enzo Raimondo

The stamp duty cut will then increase to 40 per cent on 1 January 2014 and then to 50 per cent on 1 September 2014.

CEO REIV

The Victorian Government has changed the way in which they will be assisting first home buyers so that more people benefit. The First Home Buyers Grant of $7,000 remains available for all those buying their first home for $750,000 or less. The grant is paid by the State Government and has no scheduled end date. First home buyers also benefit from a 20 per cent reduction on their stamp duty bill. That means that on the purchase of a $400,000 home they will save $3,274 and on a $550,000 home they will save $4,994. The stamp duty reduction is not available for homes priced over $600,000.

From the 1st of July the First Home Buyers Bonus will no longer be available. The Bonus was only for first home buyers of a new home and was introduced a few years ago to stimulate the building of new homes during the GFC. It has done its job and now the government’s preference is to help all first home buyers. Those buying a new home off the plan will still benefit from concessions to stamp duty. There is other assistance available for different groups, including exemptions for deceased estates, family farms, young farmers and pensioners. Details on those programs and the exact criteria for the assistance for first home buyers can be found at www.sro.vic.gov.au.

The good news is that on 1 January the cut to stamp duty will increase from 20 per cent to 30 per cent. That means that
