Property Condition – What to Expect Welcome to Eview Conveyancing This week we are discussing what condition a property should be in on the day of settlement. There are a lot of assumptions out there and many different views. We will discuss the obligations created by the contract of sale which outlines the rules. When you are about to sign a contract you are no doubt very excited. However when it comes to the settlement time, you were sure the house was in a better condition when you purchased it. We call this the “rose coloured glasses effect�. When situations like these arise the parties will run for the contract to see who has to do what to make things right. The General Conditions contain the guidelines on how a property is to be delivered. Close to the settlement, the Purchaser (or another party authorised by the Purchaser) can inspect the property, this is called the final inspection. The arrangement and inspection is to be reasonable on all grounds and may even be conducted on the actual settlement date. The obvious reason for a final inspection is to ensure the property is delivered in accordance with the contract. General Conditions in the contract state the Vendor must deliver the property in the same condition it was as at the day of sale with the exceptions of fair wear and tear. Sounds simple enough, right? However there are some common misconceptions concerning the condition of the property and these can create confusion.

Same Condition as Day of Sale The rule here is, on the day of sale, whether the property is clean and tidy or it is a mess with a kid’s old swing set in the backyard, this is the way the Purchaser can expect the property to be at settlement. Assumptions made by some Purchasers are they expect carpets to be steam cleaned, rubbish removed and ovens cleaned prior to settlement. If these things were not promised in a Special

Condition then the Vendor is under no obligation to do them. However the Purchaser can attempt to get the Vendor to make good on the contract when the property was not left in the condition it was as the day of sale. The Purchaser would insist the fault is remedied by the Vendor and even the threat of money being held back at settlement can be made.

Special Conditions If the Vendor commits in a Special Condition to do something prior to settlement, such as repair a hole in a wall or clear the rubbish from under the house, the Purchaser would have a very hard time delaying the settlement. These types of Special Conditions are regarded as warranties and generally the Purchaser’s right is to sue the Vendor after settlement should the Vendor fail to honour the conditions. Sounds unfair but in most cases the Purchaser cannot hold back money or delay settlement under these conditions. In summary when a Vendor is unwilling and won’t do the right thing when it comes to delivering the property as promised there is not a lot a Purchaser can do in regards to holding up the settlement as ransom. The right to sue for damages is available; however the cost of litigation usually far outweighs the expense of the breach. The best advice for a Vendor is to do the right thing and respect the Purchaser by delivering a house clean and tidy, the way you would expect to. However, sometimes this does not happen, when buying a property we suggest you note down the condition in detail or even take photos when buying your next property. Buyers’ rights to cool-off change on 1 March If you are a buyer of residential real estate you will find that, beginning on 1 March, the cooling-off rules have changed. On that date you will no longer lose your right to cool off just because you sought and obtained advice from your lawyer before you signed your contract.

Seaford is located on Port Phillip Bay, 5 kilometres north of the city of Frankston which is the gateway to the Mornington Peninsula and surrounding beaches. The Nepean Highway follows the coast through Seaford, with shops and residential areas on one side, and the coastal foreshore and beaches on the other side. The Seaford Pier is located opposite Seaford’s main commercial precinct and is a popular spot for fishing or swimming in the surrounding calm waters. Seaford has over 5 kilometres of sandy beaches which are clean and safe for swimming along an essentially straight

section of coastline. As well as the beach, Seaford offers visitors a number of other natural attractions. The Kananook Creek Reserve is a lineal park which follows the route of the creek and features native bushland and a 6 kilometre walking track. The extensive EdithvaleSeaford Wetlands features 300 year old river red gums and a large collection of rare and endangered migratory bird species. Walking and cycle tracks surround much of the wetlands, with an elevated viewing platform accessible via Austin Road.
