Letter from the Editor

Hooray! Cannabis is now legal in California. It’s what we have all been praying and working for, over decades worth of time and combined efforts of advocates and activists worldwide. But it is a weary road ahead. We watched, and personally experienced, the ripple effect of hardships cannabis cultivator and manufacturers went through in Colorado and Washington states. As they sorted out their regulations from legalization in their states in 2013 to where we are now in 2016, a plethora of changes occurred. California is going to go through some extensive changes over the next few years. We can only hope that the lawmakers at be, will learn from some of the mistakes, setbacks and roadblocks Colorado and Washington have gone through, cutting down the extent of the kinks the California legal system will have to eventually work out. A warning to our lawmakers, Washington’s overregulation with cannabis, grouping medical and recreational under one roof and taking away the right to grow at home, in turn drives the black market. The only defense I heard from California’s Bureau of Cannabis Regulation, in regards to cost inflation concerns was, “Colorado’s competitive market kept prices low, maintaining after legalization,” which is a moot statement because California did not implement the same taxing system or licensing structure as Colorado. Instead of a 3-tiered system for permitting, California has 17 classes of licenses, mandating use of a distributor and a transporter. The plant will get taxed at every level of the production process, until it meets the consumer, where they get met with an additional city and state marijuana sales tax on top of everything else. I’m foreseeing the end of the $35 eighth cap. In Colorado, at least there is a different tax rate for medical than recreational cannabis sales, allowing for the 100,000 (give or take) resident patients of the Mile High state, to obtain cannabis for themselves, and all of their friends, so they don’t all have to get medical cards. California residents will have a ceiling on what inflation rate they are willing to pay due to taxes for their weed. Once the average cost of cannabis surpasses $60 an eighth (3.5 grams), it benefits the consumer to turn to the black market. If California can’t get a feasible cohesive system together that flows throughout the state, black market sales from unauthorized, unlicensed grows will run rampant.

That’s not the only thing to worry about. Now that Donald Trump is going to be President, there is fear and speculation about his actual stance on cannabis and what cabinet members and advisors he will pick to join him in The White House. I think the threat to try to keep cannabis a Schedule I Drug is a complete and utter joke. There is the one in a million, unlikely possibility of Barack Obama rescheduling cannabis on his way out, which I would love because we’re both from Honolulu, Hawaii where smoking cannabis is commonplace, as we saw in his Punahou High School yearbook. However, regardless of what happens with Trump or his advisors positions, the United States Government owns the patent on CBD and has licensed it to a New York pharmaceutical company, which happens to be a subsidiary of GW Pharmaceuticals. GW is one of the largest big pharma companies in the world, and they currently produce Sativex, in the UK and Canadian markets, which is a 1:1 CBD to THC ratio for pain management with multiple sclerosis patients and other severe conditions. They are now in clinic trials for Epiodilex in America, a CBD based anti-seizure drug for epileptic patients. They are doing so well, each time they announce success with each Phase of the trial their stock jumps up on NASDAQ.

My point is, more change is coming. I predict that by 2020, GW Pharmaceuticals will have already had applied for their conditional use of cannabis as an orphan drug, which will give them conditional rescheduling of CBD or cannabis. In this case, it wouldn’t matter what Trump or his advisors do to make cannabis a target. Even if California’s legalization drives the black market, there’s no way California is going to go back to being “illegal.” Have a safe a Happy Holiday Season! B. Le Grand

Dear Gar, I have had great success with medical marijuana for back pain issues. I currently use edibles and a topical cream instead of pharmaceuticals. I am now having a problem with shingles. Will anything in topicals help? The pain is very intense. Bill, San Diego, CA Hi Bill, There is limited research on the topical use of cannabis for shingles. I have received several success stories from medical cannabis patients, however. A strong external oil can be applied to the inflamed area(s) and covered with a towel or gauze. This is done several times daily until pain and inflammation disappear. Hello Gar, I went to my local dispensary to get some infused topical cream for an old wrist injury. They said that they had a CBD only cream that I should try. What do you think? Pat, Berkeley, CA Hi Pat, Your question is one that I'm starting to hear a lot. THC contained in topicals does not get you high, so it should, in my opinion, be viewed as a beneficial necessity in a topical product. The benefits of THC are well known, with the only drawback being the psychedelic effect. Since the head high is not an issue, there is very little reason to exclude it. CBD only creams seems to work very well on pain, as well as several other conditions, and they are great if you live in a "CBD only" state. But, since both are available to you, why use only one cannabinoid when you can have them all? For those readers in CBD only states, look for a product containing a generous amount of CBD. Check the milligrams on the package and compare.

Getting to Know Mary + Jane’s Scout Durwood Scout Durwood is probably best known to mainstream audiences for playing Jordan on MTV’s cannabis themed comedy program, MARY + JANE produced by Snoop Dogg. Jordan is a perpetually stoned, free spirited, polyamorous, twentysomething, self-proclaimed “ganjapreneur”, cooperating a mostly legal medical marijuana delivery business in a somewhat fictionalized version of modern day Los Angeles. Certain elements of Mary + Jane will leave real live cannabiz people asking a lot of questions, and they’ll wonder what the girls do concerning: sourcing, buying, banking, transportation, safety, storage, and the LA City Attorney - but that’s true of most any TV show based on an actual specific career, and cops, firemen, politicians, etc have similar thoughts. Jordan is highly likeable and especially endearing to users of cannabis. The role lends itself very well to Durwood’s slightly raspy voice, acting talents, energy, and natural comic abilities and physicality, but actually only begins to showcase the skills of a fascinatingly funny and friendly young performer who’s sure to do great things in the world of entertainment. She was kind enough to spend a day with us at the wonderful Beverly Alternative Relief Center (BARC) Collective in Beverly Hills shooting photos for our Holiday Ganja Gift Guide (featured in this very issue). Join Edibles Magazine for a few moments, and begin to get to know about the lovely and truly talented Scout Durwood. Scout Durwood is named after Scout Jean Louise Finch, the narrator and central character of Harper Lee’s pulitzer prize winning novel, To Kill a Mockingbird, and has even dressed up as

the character on Halloween. Although she enjoys cannabis quite a lot, and is enjoying it more and more since being cast on Mary + Jane, her real life tolerance is much lower than that of her character Jordan, who is super high almost all of the time. She also happens to be a Story Pirates teacher and Moth Storytelling Slam Champion. The Moth Story Slam is a live, open-mic, storytelling competition performed in the style of slam poetry, and being champion is no easy task. The Huffington Post named her one of the top “20 Burlesque Stars to Know” and she is a former staple of the New York City Cabaret Scene. Sometimes she is known as Lady Scoutington, and was featured on the Oxygen Network’s show, FUNNY GIRLS before being cast on Mary + Jane. Scout is also an accomplished musician, singer, and songwriter. She plays the ukulele with great skill and has a lovely singing voice. Her first album, Whimsy, was released in the Spring of 2015, and her second album, Take One Thing Off, is coming out soon. In addition to Mary + Jane, Scout has also been featured on well known shows like House of Lies, Justified, and The Mindy Project, where she played gynecologist Doctor Zandra Fiore in the episode Girl Crush along with Anna Gunn. She’s also acted in good, but not-so-well-known shows like Snuggle Pup, Tackle Girl, Parkour Anarchy, and Burt Paxton: Private Detective. I’m actually a fan of Burt Paxton and had already seen Scout’s Episode a couple of years ago. In 2007, she was the very first contestant eliminated on MTV’s A Shot at Love with Tila Tequila, the bisexual dating competition that pitted boys against girls as they tried to win the heart of Ms Tequila.

TEXT C O VHERE ER STORY Tila recently had her twitter account suspended after proclaiming herself the “Alt-Reich Queen” (so weird how the world changes). “She’s a nazi now. She was not a nazi then.” It’s a real pleasure to see Scout return to the MTV screen under such better circumstances and conditions.

I personally had the honor of techdirecting UNDER THE WATER, a one person musical play written and performed by Scout Durwood. It’s where I first met Ms Durwood, and is a brilliant piece of theatre about love, mermaids, and murder, and has been performed at The Improv Olympic West, The Upright Citizens Brigade, and as part of The Hollywood Fringe Festival. Along with acting, music, playwriting, and storytelling, she’s a gifted stand up comedian and improviser, well known and much beloved throughout the Hollywood comedy scene. When she isn’t too busy being on television, she is often performing live at clubs and theaters throughout Los Angeles. Seeing her perform live at any opportunity is highly recommended.

Although a lover of fine edibles, she needs to be very selective when choosing infused foods, due to suffering from a serious gluten intolerance. Her favorite edibles are BREEZE brand mints, which are conveniently 100% gluten-free. Thanks to her role on Mary + Jane, she has technically handled more fake cannabis, than actual marijuana. The joints on the show are Honeyrose Herbal cigarettes, which she doesn’t too much mind the taste of. The bricks of weed are really oregano, which was initially a problem for the sound engineer on set, who happens to have a food allergy. They gave him a Claritin and thankfully it was no longer an issue. Interesting to note that oregano can be more dangerous

than cannabis. Collaborating with Emmy nominated writer Heather Anne Campbell, she is the creator of LOVE IN THE LAST 5 DAYS, a short romantic comedy horror thriller “Set at the intersection of love, death, and laughter”. It’s the story of Kat and Ellie, who “rekindle the spark in their failing relationship when Ellie is afflicted with a zombie-like infection that will ultimately lead to her death”. They’re currently raising funds on Seed and Spark. Sounds like a very original, and entertaining piece of work. We are sure hoping to see the finished product sometime in the near future. Even though she was cool enough to spend the day with Edibles Magazine shooting these great pictures for our Holiday Ganja Gift Guide in Beverly Hills, she’s honestly not that enthusiastic about the Christmas Season, and is a little bit of a Grinch. That’s why we’re extra appreciative that she was so gracious and spent the day wearing the LET’S GET BAKED ugly christmas sweater and Santa accessories, and assisting us in putting together the gift guide. She even helped us out decorating the BARC Collective. Guess she’s not much of a Grinch after all. There’s much more to say about her, so we hope to be talking to her again real soon. It was a pleasure to have her as a special guest speaker on the diversity panel at this year’s Infused Expo in downtown Los Angeles, and we’re very much looking forward to her being a presenter at The Best of Edibles List Awards ceremony coming in 2017. A second season of Mary + Jane is coming to MTV next year, and in the meantime the entire first season is available for streaming and binging on Hulu. Scout: I was 16 at Spirit Fest, which is a festival in Kansas City, where I'm from, and my friend went up to a group of total strangers and was like, "Hey, my friend has never smoked pot before. Can she take a hit?" And they said yes! EL: We’re all so glad they did! So - What is your earliest, fondest memory of watching MTV? Scout: Man, getting to watch MTV was a big deal in my house. It was a sign of true adulthood. My ultimate dream was to be on SINGLED OUT, which sadly never happened. That and Spring Break. Man, those were the days. EL: Ha ha - they certainly were. And funny enough we still have Chris Hardwick and Jenny McCarthy in our lives, sorta’. What is your absolute favorite way to consume marijuana? Scout: With friends! I like being social and passing a joint.

6630507 and 9095554: Dawn of the Green Rush Two seven-digit magic numbers are circulating around the Internet right now, both of which may induct cannabis as a legitimate industry and open the floodgates for pouring marijuana patents. First off is Patent No. 9095554, which is for a plant containing significant amounts of THC. 9095554 made its unsung historical achievement by being approved by the U.S. Patent and Trademark Office on August 4th, 2015. This patent was issued to a group of breeders in California, stating, “There is a real need for cannabis varieties for potential medical use that produce modulated THC concentrations and varying concentrations of other pharmacologically active substances. There is also a need for healthier cannabis for recreational use with reduced negative side effects from THC. The inventions described herein meet that long-felt need.” With this approval, the federal patent office is now open to patent applications for anything marijuana-related, bolstering the cannabis industry to a project value of up to $40 billion. The other is Patent No. 6630507 which covers the use of non-psychoactive chemical compounds found in stevia, which can protect the brain from degenerative or damaging diseases such as cirrhosis. This was approved and granted to the U.S. Department of Health and Human Services in 2003, making this the first and only government-owned patent on a cannabinoid. In wake of the U.S. Drug Enforcement Administration’s refusal to reschedule cannabis, critics have cited 6630507 in order to point out the agency’s hypocrisy in condemning a drug that the U.S. government owns a patent for. Unfortunately, patent lawyers point out that despite the legitimacy of the patent, it has no bearing on the Controlled Substances Act nor does it

have any sway on the DEA’s decision. The patent doesn’t yet prove that the chemical compound is effective in its stated benefits. It will have to be purified, synthesized in a lab environment, thoroughly tested in animals and humans, and given approval by the Food and Drug Administration in order demonstrate its safeness and efficacy. There is also concern that cannabinoid chemicals could exhibit toxicity at high doses, which warrants the need for more research. Regardless, these two patents will finally take America into the long-awaited era of widespread acceptance of cannabis. As applications for cannabis-related patents come rolling in, so will possibly endless disputes over ownership of the most potent and innovative strains. As with all growing industries, competition will be even more fierce as cultivators will have to put in extra money in lawyers in order to legally own the unique strains they worked so hard to develop. Longtime grower and founder of the annual Cannabis Cup, Tim Blake, predicted the turmoil soon to come from small businesses and big corporations fighting tooth-and-nail for dominance. “It’s going to be a mess,” he says, “These small farmers think they’re going to compete against these big brands. but they’re either going to have to scale up or be satisfied being the little honey stand on the side of the road.” As the oncoming patent war looms, concern is spreading among legal-pot growers as they are looking into legal counsel in order to protect their creations from imitators and patent trolls. Even bigger concerns involve the coming of big corporations such as Monstanto which growers admit they fear more than the Justice Department. They believe that Monsanto’s mastery of patenting will enable it to monopolize the entire cannabis industry much like in the same

Rumor has it that the company is developing its own genetically-modified strain of cannabis, which Monsanto outright denied on its website. Representatives of big tobacco companies have also confirmed that they too are not interested in cannabis. Of course, these denials do not curb the worries of the cannabis community as Dr. Reggie Caudino, the Intellectual Property Director of a cannabis testing firm Steep Hill Labs called out Monsanto’s denial by claiming, “This kind of confusion is exactly what Monsanto wants. They want their access unfettered so they can take over without having to pay anybody.”

Regardless, breeders who have been growing their own creations in the shadows with their unique little names such as Blue Dream, Northern Lights, Death Star, God's Gift, Purple Urkle, Skywalker, White Rhino, Chemdawg, and Blue Cheese are finally coming out of the woodwork to get patents for their own strains alone. A speaker for the Patent and Office explains that in order to get a patent, “the claimed strain must be new and unobvious over existing strains,” as well as, “exhibit markedly different characteristics from its naturally occurring counterpart in its natural state.” With this requirement, the existing cannabis strains that already exist in the public domain should, theoretically, be safe from patent trolls, but consequentially, the true creators of those strains may not be able to stake their claim through the patent office.

Some have already begun to take steps in protecting the integrity of cannabis innovation. There is an organization known as the Open Cannabis Project which collects DNA samples of cannabis strains in order to classify and catalogue them into a massive database. The goal of the database is to use genetic information to prove a given strain was available to the public before someone

can take a patent out on it. A microbiologist who is a board member of the Open Cannabis Project explains, “You can't use that data to patent plants. But you can use it to show that something is in the public domain.” However, some growers have been hesitant to share samples of their strains with the Open Cannabis Project’s database as they intend to have their creations patented in the future. While the nightmares of patent trolls and corporations may still linger in everyone’s minds, Dale Hunt, a life sciences patent attorney has assured that should legalization become widespread, so should IP protection for all aspects of the industry. “I think there will be a greater emphasis on innovation,” says Hunt. Some observers have theorized that the cannabis industry may take the same route of the software industry in which creators from different companies held meetings to swap ideas and share stories which may lead to corporate secrecy. Others expect it to be similar to the beer market where big companies dominate in mass production and distribution while smaller companies produce better quality products. With marijuana’s overwhelming victory in this year’s election, the industry may indeed be following down the path that’s been foretold by the cannabis community. While cannabis entrepreneurs are trekking ahead in the search for fortune, corporate influence will eventually become a big bridge that needs to be crossed. According to Mr. Hunt, it is now up to the growers to decide whether to work with big businesses in order to ensure their success or to stay self-sufficient and self-reliant to maintain the purity of their work. He asks, “The question is, do you want to be on the sharp end of that spear, or do you want to be on the handle?” With that, the cannabis industry is quickly becoming a game of chance and skill; we can only trust that the growers know how to play their cards right.

Canadian Veterinarian Treating Pet Pain with Cannabis CBD Products B. Le Grand

We’ve known for a while that you can use CBD to treat your cats and dogs suffering from pain or disease. Now we have actual veterinarians supporting this cause, recommending cannabis treatments to pets to help them find relief. Dr. Janice Huntingford is a veterinarian and a certified pain practitioner working at Essex Animal Hospital in Vancouver, Canada. Dr. Huntingford has been giving cannabis oil to some pets dealing with issues like chronic pain, arthritis, seizures and cancer. She recommends her patients use CBD oil made from hemp because it does not contain THC, which can be toxic to animals. "You would like to get a product that... has very little THC because dogs and cats are so susceptible to THC," Huntingford said.

She went on to confirm it can reduce pain, decrease seizures and can shrink tumours in pets with cancer.

Dogs and cats have extreme sensitivity to THC, the psychoactive component of cannabis sativa, which is why she uses CBD (cannabidiol) for pain management. "Cats are very sensitive to the CBD, so you have to dose them differently than dogs," she said. "There's not a lot of pain

meds that we can use for cats, because they're sensitive to so many things. This is one thing that we can use." Earlier this year, Huntingford traveled to the U.S. to take part in a short pain course at the University of California, San Diego campus. She said one afternoon was dedicated to the use of cannabis with dogs, including the use of medical marijuana and other products. "Pain management is a huge amount of what I do," Huntingford said. ​ et owners were traveling to another P veterinarian in the U.S. to get hemp CBD oil, because Huntingford was not able to find a product in Canada. Ask any food scientist what they do in between their new product development projects and they will typically answer… “cost reductions”. Food manufacturers are under constant pressure to lower their ingredient, packaging and processing costs and the responsibility usually falls over into the Research and Development group. Cost reductions are challenging because the goal is usually to keep the product tasting the same, keep the ingredient statement the same, preferably keep the “order” of the ingredients the same – but at the same time, make the product less expensive.

Before you start replacing all your tomato paste with starch, there are some tricks and techniques that can be done that will save money and not affect flavor or ingredient statements. One technique is commonly referred to as “concentration”! This is when you remove the water from your product (like a sauce for example), sell it to the customer in a concentrated state, and you then save money because you are no longer shipping water all over the place on a refrigerated truck. Of course there are some drawbacks surrounding the end user knowing how much water to add back but if instructions are clear then the savings will be worth that extra bit of store level training. Concentrated products can be found in beverages,

sauces and “dry mixes” which need water added to them to consume. Another cost reduction technique (typically with dry spice blends) involves removing the sugar and salt from your spice blend. Both sugar and salt are fairly inexpensive but when your seasoning supplier adds it before shipping directly to you , you are not only paying their premium price on commodities, but you are also paying them to blend it, mix it and put it on a truck. Since many spice blends have quite a bit of salt in them, that’s going to be a regular heavy load to ship around to the storefronts. You are better adding the salt and sugar to your final batch at the production facility. It will save you money and the time cost of adding in those ingredients will be minimal. A third cost reduction method to consider is to replace some of the expensive ingredients with a natural or artificial flavor. For example- if you have created a strawberry beverage with an expensive natural strawberry puree- you may want to cut the cost of the product by reducing the fruit puree and adding back some natural flavor to maintain strawberry notes. Need to lower the pH of your sauce or want to just give it more of a tangy flavor? Adding lemon, lime and other fruit juices can work well but can get expensive. Using citric, malic or acid will allow you to maintain tangy flavors without affecting your final cost. The goal is always to maintain your products flavor and quality but saving some money on cost. Always be aware of the impact of your ingredient switch outs to make sure they don’t affect your products marketing message. For example don’t switch out molasses with high fructose corn syrup since many consumers may not want to eat high fructose corn syrup.

Preheat the oven to 325 degrees F (165 degrees C). Season the brisket on all sides with salt and pepper, and place in a glass baking dish. Cover with a layer of sliced onions. In a medium bowl, mix together the beer, chili sauce, and brown sugar. Pour over the roast. Cover the dish tightly with aluminum foil. Bake for 3 hours in the preheated oven. Remove the aluminum foil, add the kief, and bake for an additional 30 minutes. Let the brisket rest and cool slightly before slicing and returning to the dish. Reheat in the oven with the sauce spooned over the sliced meat.

Instructions:

Combine canna-milk, cloves, 1/2 teaspoon vanilla, and cinnamon in a saucepan, and heat over lowest setting for 5 minutes. Slowly bring milk mixture to a boil. In a large bowl, combine egg yolks and sugar. Whisk together until fluffy. Whisk hot milk mixture slowly into the eggs. Pour mixture into saucepan. Cook over medium heat, stirring constantly for 3 minutes, or until thick. Do not allow mixture to boil. Strain to remove cloves, and let cool for about an hour. Preheat oven to 425 degrees F. Whisk pumpkin, sweetened condensed milk, eggs, spices and salt in medium bowl until smooth. Pour into crust. Bake 15 minutes. Reduce oven temperature to 350 degrees F and continue baking 35 to 40 minutes or until knife inserted 1 inch from crust comes out clean. Cool. Garnish as desired. Store leftovers covered in refrigerator.

Graham Cracker Pie Crust Pie Crust Ingredients:

1 1/2 cups finely ground graham cracker crumbs 1/3 cup white sugar 6 tablespoons canna butter, melted 1/2 teaspoon ground cinnamon (optional)

Mix graham cracker crumbs, sugar, melted canna butter and cinnamon until well blended. Press mixture into an 8 or 9 inch pie plate. Bake at 375 degrees F (190 degrees C) for 7 minutes. Cool. If recipe calls for unbaked pie shell, just chill for about 1 hour.

Fully Medicated Comfort Easy Grilled Cheese Ingredients: 4 slices bread of your choice (we used white/sourdough bread) 3 tablespoons canna butter, divided 2 slices Cheddar cheese, or other preferred melting cheese like American or Swiss Prep Time: 5 minutes Cook Time: 15 minutes Ready In: 20 minutes browned and flip over; continue grilling until cheese is melted. From Scratch Homemade Canna Tomato Soup Ingredients: 2 tablespoons canna butter 2 tablespoons canna olive oil 1 large onion, chopped 1 tablespoon minced garlic 2 tablespoons flour 3 1⁄2lbs ripe roma tomatoes, chopped 2 tablespoons tomato paste 1 teaspoon sugar 3 cups fresh vegetable broth 1⁄8 teaspoon ground cloves salt and pepper, to taste 1⁄2 cup half-and-half

Cannabis Project

Launched in Tasmania

In an attempt to encourage its use, two medicinal cannabis education trailers are now operating in Tasmania, an island state of the Commonwealth of Australia. The group who organized the project is called Medicinal Cannabis and Hemp Tasmania and raised about $3,000 via crowdfunding. Heading up the campaign is organizer Andrew Irving, who said the idea was modeled after one developed in Queensland. "I thought we could do something like that down here," he said.

The two trailers will travel Tasmania, delivering educational material, with people on staff available to answer questions from the general public. The trailers will be equipped with information about cannabis, its uses and legal history. They aim to dispel myths about the plant. "One for the north, one for the south [of Tasmania] to try to help people understand cannabis better, help remove the stigma that has been attached to it since prohibition 1937, and all the misinformation that has been spread." The Tasmanian Government announced in April that as of 2017, they would allow certain doctors to prescribe medical cannabis for people with serious or chronic illnesses. Andrew Irving dedicates his life to his wife, Marilyn, who has a neurodegenerative condition and uses medicinal cannabis. He commented that despite national moves to legalize cannabis, he fears the approval process in Tasmania will be lengthy and licensing fees prohibitive. "That could take six months [for approval], the person is still suffering and in pain if they're not operating illegally and treating themselves. We need to have private growing rights to treat our loved ones without fear of prosecution. We've still got a long way to go." Tasmanian labor senator Carol Brown was at the launch of the educational trailers and welcomed the initiative. "He [Andrew Irving] has worked tirelessly on the trailer which is designed to educate people and dispel the myths surrounding medicinal cannabis," she said. In November, it became legal to cultivate and manufacture medicinal cannabis in Australia, which means people can apply for a license to grow their own cannabis crop. But like the USA, it still remains up to the states to decide whether the drug will be allowed and who will be able to use it, dispense it, who will be able to approve it, and what dosage and form of medical cannabis is appropriate. This is just one hopeful example of the efforts being put forth internationally in our budding cannabis industry to bring out the truth and demystify the lies. Can I smoke in public? No. While the new laws are an outline of what to interpret, any officer of the law may serve you with an infraction of public intoxication if caught smoking cannabis out in the open. Can I drive and smoke? No. Consuming cannabis and operating a motor vehicle are considered illegal and extremely frowned upon by law enforcement. A large portion of the tax fund created by cannabis legalization is going to the California Highway Patrol to create a study that outlines how a cannabis DUI should be determined. Can I start a cannabis business? Yes and no. You can create an ancillary cannabis related business or find a city/county offering medical cannabis licenses for cultivation or manufacturing, but only a few exist currently. You can not just start selling weed to everyone you know or open up a dispensary. You are allowed to possess up to one ounce of dried cannabis or 8 grams of concentrate, any more than that is considered a felony.

Is my felony now a misdemeanor? If you were a felon convicted of growing more than six marijuana plants, transporting more than an ounce, selling without a license or possessing cannabis with the intent to sell it, now they're all misdemeanors. As of November 9th, 2016 at midnight when Prop 64 passed, all non-violent cannabis offenders can now apply for appeals or expungements.

Can I grow my own weed legally now? Yes. Under the new law you can, without permits, grow up to 6 plants privately in your residence. To be clear that is 6 plants per residence, and you are allowed to keep all that you harvest from those plants. So if you’re a great grower, able to grow giant trees in your second bedroom you might be able to stock up enough for the year. Even if your city or county bans dispensaries or the licensing of cannabis businesses, you are still allowed to grow your 6 plants at home.
