Whereas in an Opinion and Order dated May 19, 2016, this Court having found in
favor ofplaintiff on his breach ofcontract claim; specifically, the Court found that the personal services contract ("Contract") between the plaintiff and defendant was effective July I, 2012 and
June 30, 2014 and that defendant owed plaintiff commission under the Contract of $549,776.85; the Court instructed the parties to propose ajoint form oforder; however, the parties disagreed as to the date from which prejudgment interest should be calculated, and the matter having come before the Honorable Katherine B. Forrest, United States District Judge, and the Court, on June
27, 2016, having rendered its Memorandum Decision and Order finding that based on the record at trial, June 30, 2014 is the earliest date that this Court can "ascertain" as to when the cause of action existed, therefore, the Court finds that pre-judgment interest accrued from June 30, 2014,
and directing the Clerk of Court to enter judgment for plaintiff in the amount of $548,776.85 with prejudgment interest calculated at 9%from June 30, 2014;
And, further, there being no dispute that under the terms of the Contract plaintiff is entitled to an award of reasonable attorneys' fees and costs; and the Court having considered
plaintiffs application for attorneys' fees and costs, defendant's objections thereto, and all the FIRM;3754l045vl

factors regarding the reasonableness of the award, the Court awards plaintiff $359,628.50 in attorneys' fees and $35,389.71 in costs.
ORDERED, ADJUDGED AND DECREED: That for the reasons stated in the
Court's Memorandum Decision and Orders dated June 27 and 29, 2016, judgment is hereby
entered for plaintiff as follows: in the amount of$549,776.85 plus prejudgment interest at 9% from June 30, 2014 of $98,688.71; and in the amount of $395,018.21 for attorneys' fees and costs, for the total sum of $1,043,483.77.
