Influencers may seem to be a creation of the social media era—a natural outgrowth of living in a digital world. But IRL, influencers were around long before iPhones, the internet, and Instagram. There just wasn’t a name for them, probably because it wasn’t a profession before we all became interconnected via our phones. For those who might be unfamiliar with what a social media influencer is, let me enlighten you: it’s someone who has established credibility or knowledge in a specific industry or field, has consistent access to or reach of a huge audience, and has the authenticity to persuade and motivate others to act based on their recommendations. Brought on by the virality or virility of digital marketing, influencers use endorsements and product placement to sell or promote a product or service. The influencers we profile in this issue are the OGs of social media influencers. By simply sharing their lifestyles, these original influencers (OIs) were not just setting the trends but shifting paradigms long before there was an official name for it. There’s no question that Martha Stewart is the OG of lifestyle branding, it’s right in the name of her magazine and tv show, Martha Stewart Living. The first issue of her magazine debuted in 1990 and her tv show was on the air from 1996-2004, making her the originator of sharing and promoting a life that became much coveted by legions of followers. The magazine and tv show featured lifestyle content centered around food, baking, home decorating, entertaining, crafts/DIY, and travel—all glamourized with the simplistic Martha touch. With her expertise in the cooking/baking space, it would only make sense that

Stewart would lend her influence to legitimizing CBD by starting her own brand of confections and soft gels. Releasing her first workout video in 1982, Jane Fonda pioneered the celebrity-as-fitness-instructor model. Following the publication of her bestselling fitness book (which itself spawned a whole new genre, “self-help”) the video built upon the popularity of Fonda’s Beverly Hills workout studio. Opened in 1979, the space itself was a novelty for the time. “Back then, if women went to a health club, there’d be a gym for men and nothing for women,” Fonda remarked in 2014. “We weren’t supposed to be strong and fit.” She’s clearly a natural to enter the CBD space with her trailblazing approach to health and wellness. You most definitely are an OG to have a strain of weed named after you and nobody epitomizes the rebel spirit of marijuana the way country legend Willie Nelson does. Probably America’s best known pot head, Nelson has two strains named in his honor, a sativa and an indica-based hybrid aptly named Willie Nelson O.G. Although he stopped smoking in 2019 that does not mean he’s stopped using cannabis altogether. From singing about weed to multiple arrests, Nelson has never apologized for his love of marijuana—making an eponymous line of cannabis products a natural extension of the “It’s All Going to Pot” singer’s influential brand. Now this trio of original influencers is lending decades of well-earned credibility, expertise, and reputation to cannabis, and, in turn, legitimizing a product and an industry that is just finding its mainstream influence.

GROCERY TRIP Meow Wolf brings its Omega Mart multimedia shopping experience to Area 15 By Josh Bell

When Omega Mart opens on February 18, it will be the culmination of more than three years of work from New Mexico-based art collective Meow Wolf, realizing the promise of the cutting-edge Area 15 complex that was first announced back in January 2018. Of course, no one at Area 15 or Meow Wolf expected the immersive, interactive exhibit to be opening in the middle of a global pandemic, but despite restrictions and adjustments (including required masks and social distancing, UV filters, hand sanitizers and touch-free options), Omega Mart will provide the same trippy escape from reality that it would under more “normal� circumstances (whatever those may be, someday).

“There are several things that we’ve been wanting to explore creatively that we’re able to do on this project for the first time,” says Meow Wolf founder and Las Vegas executive creative director Corvas Brinkerhoff. “For the first time in our 13-year history, we’ve had the funding and the resources and the team to really go big with this concept.” The Omega Mart concept is one that Meow Wolf has explored twice before, in temporary exhibits in the group’s home base of Santa Fe, New Mexico. It’s a multimedia art exhibit in the form of a grocery store, in which patrons explore the items for sale and discover a gateway into alternate artistic dimensions. “We’ve always been interested in this idea of creating an art installation that’s presented not as art, but as a store, and the opportunity for social commentary that comes with that,” Brinkerhoff says. “It’s an exhibition that begins with this familiar place, a grocery store, and then as you explore, you might come to find portals into another world.” The 52,000-square-foot Las Vegas version of Omega Mart is a permanent exhibit and the anchor tenant for Area 15, which opened in September 2020 and currently features experiencefocused businesses including Dueling Axes axe-throwing, Haley’s Comet zipline-style ride, Particle Quest augmented reality game, and more. “We’re going to, in a lot of ways, set the tone for what people expect from Area 15,” Brinkerhoff explains. “Their whole philosophy is, there’s a generation of people who value experiences over buying more stuff. So let’s create a public gathering space for those kinds of businesses to be in one place, these kind of experiential businesses.” Omega Mart, however, is all about buying stuff, or at least about using art to comment on the concept of buying stuff. “Well, that’s the irony of it all, right?” Brinkerhoff laughs. “It turns out the experience that we’ve created is a store.” Unlike in the previous temporary versions of Omega Mart, the Vegas exhibit will be full of real products that people can actually buy, although they’re not quite the same as the groceries you’d find at local grocers Smith’s or Vons. “One of my favorite products is called Salt After Dark, and it’s real salt,” Brinkerhoff says. “You can take it home and season your food with it.” Other offbeat products include Wake Up Please energy drink, Whale Song antiperspirant/antidepressant, and Nature’s Canvas Tattoo Chicken. The store is just the first part of the experience, and various portals within the space open up into different areas that further explore the story of Omega Mart’s fictional parent company

Dramcorp, which Brinkerhoff describes as a combination of “Elon Musk, the Church of Scientology and Walmart. Somehow those have merged into this one entity and story.” The space is set up like an open-world video game, allowing patrons to take as long as they want to investigate every aspect of the story and its characters via interactive exhibits (including some live, socially distanced performers). Brinkerhoff estimates that a typical visitor will spend three hours immersed in this environment, but that might just scratch the service of what Meow Wolf and their artistic collaborators have created: “Just on the video content alone, there’s more than a feature film’s worth of high production value video content embedded in the show. Then we also have things like, you can go in our characters’ homes and read their diaries and get on their computers and read their blogs and look at their family photos.” Brinkerhoff predicts that some people will want to spend even more time exploring every detail. “We have what we call our deep-divers, who are the people that really want to uncover every detail of the narrative and really get to know this world that we’ve created really well,” he says. “Those people might come back four, five or six times and spend the better part of a day there each time.” For deep-divers, “this show was designed and built with the explicit intention to expand it and update it over time,” and Meow Wolf has collaborated with dozens of local artists to create individual elements of the exhibit that express those artists’ unique styles. Major names from the Las Vegas art community including Jerry Misko, Justin Favela, Heather Hermann and Brett Bolton contributed to the overall world of Omega Mart and Dramcorp. “For us it’s about creating work that the local community can feel like is part of the fabric of their community, and not just some outsiders coming in and dropping some new spectacle into their city,” Brinkerhoff explains. And if anyone is interested in enhancing this already mindbending experience with some actual mind-altering substances? It’s not necessary, but Brinkerhoff isn’t going to say no. “We’re going to help you achieve an altered state of mind by way of the immersive artwork that we create,” he says. “But if that’s something that you want to combine with your experience, you certainly wouldn’t be the first or the last.” Omega Mart at Area 15, 3215 S. WHITE HOUSE WORTHY A Review of Cannabis Deserving of the Presidential Seal of Approval

n honor of Presidents’ Day on February 15th and with a handful of U.S. presidents purportedly to have partaken in cannabis, we thought it was high time we celebrated the national holiday with a selection of products deserving of an Oval Office occupant. During the early days of the nation, Presidents Thomas Jefferson, George Washington and James Madison all farmed hemp. While serving in the Mexican-American war, our 14th West Winger Franklin Pierce wrote in a letter that smoking marijuana was the only good thing about his time in combat. Before becoming president, James Monroe while serving as ambassador to France openly smoked hashish, A biography on JFK claimed he used marijuana while in the White House to help deal with a back injury he suffered in WWII. Modern-era Commander-in-Chiefs Barack Obama, George W. Bush (43), and Bill Clinton also fessed up to trying cannabis despite it being federally illegal. “When I was in England,” Clinton detailed of his time at Oxford when he was a Rhodes Scholar from 1968 to 1970, “I experimented with marijuana a time or two, and didn’t like it. I didn’t inhale and I didn’t try it again.” When Barack Obama was running for president, he admitted to using drugs and alcohol while in high school but unlike Bill Clinton, Pres. Obama said he inhaled marijuana, noting, “that was the point.” Whether leaders of the free world have tried it or not, cannabis offers plenty of advantageous and powerful benefits for those with a strenuous workload including providing focus, relaxation and stimulating a good night’s rest.

When asked about fans of his brand Nelson told Vulture: “Most of the people that I know are fans. I’m really not that surprised, especially these days and times when you’re locked in your house for so long. A cannabis enthusiast, Handler teamed up with dispensaries Sweet Flower and The Apothecarium to launch the “America is Back Kit,” a mix of her favorite brands. The kit includes CANN beverages, Pure Beauty pre-rolls, Garden Society chocolates, a Sundae School mask, branded totes and lighters. A look at the cannabis industry’s 2021 goals for the Nevada Legislative Session By Layke Martin, Executive Director, Nevada Dispensary Association The Nevada Dispensary Association (NDA) represents the majority of cannabis dispensaries in Nevada and is the leading advocate for the cannabis industry in our state. As the 81st Legislative Session gets underway on February 1, 2021, to follow are some cannabis-related bills that we are watching, as well as some background on the state of the industry.

STATE OF THE INDUSTRY

The cannabis industry in Nevada looks a bit different than it did during the last legislative session. The industry has established itself as an important generator of tax revenue and jobs, even during the COVID-19 pandemic. The cannabis industry brought the state $105 million in excise tax revenue in Fiscal Year 2020. Those funds go to education, per Senate Bill 545 which reallocated the excise tax on retail sales from the state’s Rainy Day Fund to the Distributive School Account. Lawsuits that arose from the Department of Taxation’s licensing process in September 2018 have been mostly resolved, and additional dispensaries are finally opening. There are currently 79 open dispensaries, and the remaining licenses must open before February 5, 2022. Finally, this is the first legislative session since the Cannabis Compliance Board (CCB) was created. Modeled after the Gaming Control Board, the CCB took over as the state’s licensing and regulatory authority for the cannabis industry in July 2020. The Governor’s impressive appointments to the CCB include former Supreme Court Justice Michael Douglas (who serves as Chair), former Gaming Control Board Chair Dennis Neilander, banking executive Jerrie Merritt, Dr. Bryan Young, and former Nevada Dispensary Association Executive Director Riana Durrett.

CURBSIDE PICKUP

Based on the Bill Draft Requests (BDRs) submitted so far, some of the issues the legislature will be addressing include curbside pickup, packaging and labeling, the illegal market, and social use venues. Governor Steve Sisolak authorized curbside pickup through an Emergency Directive in April 2020. Curbside orders must be placed in advance online or by phone, and then the customer or patient pulls into a designated space to pick up the order. There are safety and security protocols in place, including

cameras and lighting, and the requirement that no passengers in the vehicle are under 21 years old. While curbside pickup was originally designed to allow cannabis retailers to meet customer demand while maintaining reduced store capacity during COVID-19, local customers and patients have embraced the convenience. Clark County and North Las Vegas have gone a step further, allowing drivethrough windows at dispensaries. The CCB, with the NDA’s support, will be bringing a bill to make the option of providing curbside pickup a permanent feature, while maintaining the ability of local governments to regulate land use and determine whether a location is suitable.

PACKAGING AND LABELING

The intention of cannabis product labeling is to provide clear warnings and relevant information such as potency and ingredients. However, many of the packaging and labeling regulations have not been updated in years, and therefore do not reflect modern production, new safety standards, or public health expertise. The NDA is advocating for a comprehensive review of packaging and labeling regulations. While the majority of reforms will be made through the CCB’s regulatory process, the NDA has proposed some statutory changes to give the CCB flexibility in determining how important information and warnings are conveyed on packaging and labels.

TACKLING THE ILLEGAL MARKET

Even though sales of cannabis are legal in Nevada, an illegal market still exists, which is bad for the state for several reasons. Illegal distributors do not pay taxes, so the state loses out on revenue that could go toward education. There are safety concerns as well, as illegal sellers are not subject to the strict regulations protecting underage sales or limits on consumption. The product itself is not tested for potency, harmful chemicals, or additives. At least one bill this session attempts to address the illegal market by imposing civil penalties for advertising and operating a business without a license. Similar to the way the Nevada State Contractors Board imposes penalties for unlicensed contractors, this would provide a tool for reporting and imposing fines on illegal cannabis businesses.


In addition to developing tools such as civil penalties to combat the illegal market, one of the greatest prevention measures is ensuring the legal market can compete for sales. Regulation and taxation must be reasonable, so that high costs of safe, legal products do not drive consumers to the illegal market. Thus, the cannabis industry will also be keeping a close eye on any new taxation measures.

SOCIAL USE VENUES AND PUBLIC CONSUMPTION

CONCLUSION

The 81st Legislative Session is bound to be unique. Lawmakers will be in Carson City, but due to COVID-19 restrictions, there is limited physical access to the legislative building for everyone else, at least in the first several weeks of the session. This session is unique for cannabis too, in that the industry is more established. As a result, the focus this session is less about setting up rules and regulations to govern the industry and more about making administrative changes and giving the CCB the necessary flexibility to modernize regulations. Additionally, legislators are seeking to address areas left unresolved in earlier sessions, such as locations for people to legally consume cannabis and adding tools to combat the illegal market. The Nevada Dispensary Association’s role this session, as always, is to advocate for reasonable and thoughtful legislation, regulation, and taxation of the cannabis industry.

At least two BDRs will attempt to address the state’s current prohibition on public consumption of cannabis. It is still the case that while cannabis may be purchased legally for adult use, public consumption is outlawed. Some argue that this leaves tourists, in particular, without a legal place to consume. At the close of the last legislative session, the Governor signed a bill creating a moratorium on social use venues until the newly created Cannabis Compliance Board could study and report on this issue. The CCB hasn’t taken a stand on whether social use venues should exist or not, only that the CCB should be the regulatory authority for these venues, as it is with all other cannabis licenses. One proposal would allow for social use venues, also called consumption lounges, to be opened adjacent to

current dispensaries like a tasting room. Another model is for businesses such as a coffee shop or yoga studio to allow cannabis use on site, but not sell cannabis. Also proposed are temporary permits for consumption, and potentially sales, at events such as outdoor concerts.

uring her six years as Executive Director of the Nevada Dispensary Association (NDA), attorney Riana Durrett established the association as the primary resource on best practices in Nevada’s cannabis industry relating to regulatory and government affairs. A graduate of UNLV and the William S. Boyd School of Law, Durrett has left the NDA to pursue a masters in Gaming Law and Regulation at Boyd School of Law to complement her work in cannabis law and regulation. Last fall, Durrett was appointed to a coveted spot on the Nevada Cannabis Compliance Board (CCB).

The CCB is a new regulatory body that started operation on July 1st. As the third regulatory body to oversee the cannabis industry, how is CCB different from its predecessors? One of the biggest differences is that CCB’s primary focus is cannabis regulation whereas its predecessors had other industries they were regulating. The Division of Public Health didn’t really have a broad enough scope to regulate cannabis and the DOT focus is collecting taxes and they had all these other industries so couldn’t give cannabis as much time and attention as it needed. Another big difference is that the chair was a Supreme Court justice, so he’s incorporated more of a thoughtful and analytical tone and applies the law and that’s a big benefit to the program. There are more attorneys involved in general which I think is helpful. Were you surprised when Gov. Sisolak designated cannabis as essential in March? Not at all because it’s medicine. I was grateful that this governor and other policymakers understood—and not everyone would know or understand this—that even if somebody purchases in the retail market, they may be using it as medicine. A lot of people may not want to get their medical card for various reasons. So, we can’t identify who is using it for medical purposes and who isn’t so it’s better to err on the side of letting people have the benefits of being a medical patient and not cutting people off from their medicine, especially at a time where there is potentially going to be a lack of access to medical care. Cannabis enjoyed record setting sales in the last quarter of 2020. Did you foresee that? No, that was a big surprise. During March and April there was a huge dip in sales, 27 percent, so at that time it looked like it was going to be very damaging to the industry which is so new. I did not foresee that, and I don’t know why exactly it’s happening.

Will the Nevada Legislature make progress on consumption lounges this session? I think we will absolutely make headway on the conversation and looking at how that would work in Nevada. I don’t know if at the end of the legislative session it will pass. What’s interesting to me about the consumption lounges is in order for the state to regulate it, it has to be a 2/3rds bill. For the state to regulate it they are going to need to impose fees and you are going to need some Republican support for it to reach a 2/3rds vote. What policy items does the cannabis industry need to address in 2021? I think it’s just really important to let the CCB continue to get its legs. It has hit the ground running but it’s brand new, so we need to continue to let it work toward its one-year anniversary (July 1) and to promote stability in the industry. Big priorities for the industry are the illegal market, social equity, and fixing federal issues like banking. From the state’s perspective, vaping is an issue. Do you believe the illegal market is a problem in Nevada? Yes, I think it’s a big problem. If you talk to any dispensary owner, they will tell you the black market is their main competitor. In this state I don’t think we are going to see a big crackdown on the illegal market and so in the meantime, until there is something to address it, we need to focus on not doing things to the legal market that would impede its ability to compete with the illegal market. They need to compete by having competitive prices, and by providing a good experience when you go to the dispensary. What’s been the most surprising thing you have personally discovered about cannabis? That there is a topic that can actually get me interested in taxes and administrative law.
