N E W S B RI E F S NEW POLICE TECHNOLOGY IDENTIFIES CAR INVOLVED IN HIT-AND-RUN Using new security cameras, police have tracked down a car that struck a traffic enforcement officer in a Lower Manhattan hit-and-run accident last month. Authorities say the license plate of the involved BMW was first caught by a camera at the Manhattan Bridge seconds before the May 17 accident. Then, a special plate-reading camera mounted on a police car caught the license was scanning vehicles on the Upper East Side on Friday when it identified the BMW. The car’s driver was released as police continue to investigate, but the BMW was taken and found to have damage consistent with a hitand-run accident. The traffic agent who was struck suffered a separated left shoulder and injuries to both knees, was treated at a hospital and then was released. The cameras that captured the license plate are a part of the New York City Police Department’s Lower Manhattan Security Initiative. LEGISLATION PROPOSED TO TEACH HIGH SCHOOLERS ABOUT SAFE HAVEN LAWS New legislation was proposed that would require high schools to teach students what to do if they have an unwanted baby. The course would educate students about Baby Safe Haven and other programs which allow a parent to abandon a newborn anonymously and without fear of prosecution. Parents don’t face criminal charges if their newborn is dropped off at a hospital, firehouse, or police station. Supporters of the bill said the safe haven law is useless if teens don’t know about it. “If we go into the schools, high schools, and even the junior high schools and educate young people about this law, we could prevent the loss of a life,” said Ronnie Jaus of the Brooklyn district attorney’s office. “We take for granted as adults that information trickles down to young people, but they don’t use the same communication forms that we do,” said State Senator Eric Adams. “So we want to start using classrooms and the social media as a way of getting the information out to young people. We gotta reach them, not expect for them to find out what we know.” The bill’s announcement came after a mother was arrested for allegedly tossing her newborn down an eighth floor garbage chute. The baby boy survived.

NYS sues U.S. gov’t over gas drilling New York State sued the U.S. government on Tuesday to demand a ban on gas drilling in the Delaware River Basin until an environmental impact study has been conducted to protect New York City’s water supply. The Delaware River Basin Commission has proposed rules that would allow up to 18,000 gas wells within the basin — which sits in Delaware, New Jersey, New York and Pennsylvania, and includes parts of New York City’s watershed. Its proposals include allowing horizontal hydraulic fracturing, or “fracking” — a controversial drilling technique that involves blasting millions of gallons of water, sand and chemicals into deep shale rock to free the gas trapped inside. But in a lawsuit against the U.S. Environmental Protection Agency and others, New York Attorney General Eric Schneiderman said

those regulations should not even be considered until the environmental impact of the drilling has been studied. “Before any decisions on drilling are made, it is our responsibility to follow the facts and understand the public health and safety effects posed by potential natural gas development,” Schneiderman said in a statement. Environmentalists say fracking can contaminate groundwater with dangerous chemicals, but the industry insists it is safe. A spokesman for the Delaware River Basin Commission was not immediately available to comment on the lawsuit, which was filed in the U.S. District Court in Brooklyn. Schneiderman’s lawsuit demands that a U.S. study consider risks including the “withdrawal of large volumes of water ... potential contamination of drinking water supplies, waste generation, increased

noise, dust and air pollution, and potential harms to community infrastructure and character from increased industrial activity.” Fracking has unlocked vast potential for a relatively clean energy source that would reduce U.S. dependence on foreign oil. The Marcellus Shale, which underlies much of Pennsylvania and parts of surrounding states including western New York, could meet all U.S. natural gas demand for decades. But while Pennsylvania is experiencing a gas drilling boom with widespread fracking in the Marcellus Shale formation, New York state has been more cautious, saying the economic benefits must be weighed against environmental concerns. In December, New York announced a moratorium on issuing permits for fracking, and the state Department of Environment Conservation is in the process of an environmental review.

Megachurch founder Long says Bernice King leaving By ERRIN HAINES The youngest daughter of civil rights leader Martin Luther King Jr. is leaving the Atlanta megachurch where the pastor has been embroiled in scandal, months after she turned down a leadership role with the organization her father co-founded. In January, Bernice King announced she would not lead the Southern Christian Leadership Conference, which her father headed during the height of the civil rights movement. Four months later, she is announcing her departure from her mentor and spiritual father, Bishop Eddie Long, and the church home where she has served for nearly a decade, New Birth Missionary Baptist Church. King’s decision comes days after Long reached a settlement in the sexual misconduct lawsuits he has fought since September. King is expected to address her future ministry plans Tuesday on a local gospel

radio station. Long confirmed Tuesday that King has left New Birth. In a statement e-mailed to The Associated Press by his spokesman, Long said that he and King have been “in discussion and prayer” for some time about her decision to leave the church to continue the legacy of her parents. King has said her need to do so has grown stronger since the death of her mother, Coretta Scott King, in 2006. “I am in full support of her decision to leave New Birth in pursuit of this worthy endeavor,” the statement reads. “Reverend Bernice King has made tremendous and profound contributions to New Birth as an elder and faithful servant. We ask that you join us in extending unequivocal support and love for Reverend King as she embarks on this new calling.” Long said a farewell tribute for King is planned, but a date has not been set. Top Democrat hopeful debt deal reached within 30 days WASHINGTON — A top Democrat said on Tuesday that he was hopeful Congress would reach within 30 days a deal to increase the country’s borrowing authority. Congress has about two months to hash out an agreement before the U.S. Treasury will be unable to pay government bills, including interest on U.S. debt. Steny Hoyer, the No. 2 Democrat in the House of Representatives, said he was “hopeful in the near

term, within the next 30 days, that we can come to an agreement on doing something that everybody understands is essential.” Later on Tuesday, Republican leaders in the House are due to hold a vote to raise the debt limit by $2.4 trillion. The vote, to be held after markets close, is expected to fail because it won’t be accompanied by spending cuts. Republican lawmakers and some Democrats have refused to raise the

U.S. files new charges against September 11 accused By JANE SUTTON MIAMI — U.S. military prosecutors have filed new charges against the selfdescribed mastermind of the September 11 attacks in Khalid Sheikh 2001, Mohammed, and four alleged co-conspirators held at the Guantanamo

detention camp. The conspiracy and mass murder charges were expected to be announced later on Tuesday, according to sources involved in the war crimes tribunals at the U.S. naval base in Guantanamo Bay, Cuba. During President George W. Bush’s administration, all five defendants had been

charged in the tribunals with plotting the attacks, which killed nearly 3,000 people in the United States. The charges, which carried the death penalty, were dropped while President Barack Obama’s administration tried to move the trials into the federal civilian court in New York, near the site of the World

Trade Center, which was destroyed in the attacks by hijacked aircraft. Obama yielded to political opposition and announced in April that the prosecutions would be moved back to Guantanamo. The official overseeing the Guantanamo tribunals, retired Vice Admiral Bruce

MacDonald, must sign off on the charges before the case can proceed to trial. In addition to Mohammed, an al Qaeda leader captured in Pakistan in 2003, the defendants include his nephew, Ali Abdul Aziz Ali, as well as Walid bin Attash, Ramzi Binalshibh and Mustafa Ahmed al Hawsawi.

‘Remember Me’ works to memorialize missing, murdered Black Women By SHERNAY WILLIAMS Special to the NNPA from the AFRO-American newspapers Like so many around the country, Victoria Kent was horrified by the disappearance of 16-year-old Phylicia Barnes. But, while many residents merely followed Barnes’ story, Kent, 23, was inspired into action. It was at a local vigil for the teen that Kent decided Barnes and the countless other Black women who had experienced similar tragedies deserved better. “The ceremony was poorly organized and very few people showed up on time,” she said. “I’m a young AfricanAmerican female and I grew up in Baltimore and it was heartbreaking [to learn about Barnes]. I thought that there must be a lot of girls who have been raped and murdered and she got some coverage, but there are a lot that didn’t.” This month, the Loyola

following week, everyone has “forgotten about her,” and she is merely added to the police’s missing or murdered statistics. “That’s a tragedy,” Kent said. “If something were to happen to me or someone I knew, God forbid, I wouldn’t want

to be just a statistic.” According to the police department, four Black women have been killed this year and 18 were murdered in 2010. The group plans to highlight one missing or murdered woman a month, holding vigils for the dead and a gathering called “Honk for Her” for the missing. During “Honk for Her,” the organization, along with supporters and the victim’s family members, wield signs and photos at the location of the disappearance and urge passing drivers to honk their horns to bring attention to the woman. Remember Me’s first vigil, held earlier this month outside City Hall, attracted support from Police Commissioner Frederick Bealefeld and state Del. Mary Washington, who both spoke while supporters waved placards in honor of several brutalized women. Police spokesman Kevin Brown said groups like Kent’s are “very helpful” as

police conduct investigations into disappearances. “The commissioner is committed to working hand in hand with the community,” he said, “and groups like this do lead to many tips being received that help in the investigations of missing person cases.” Tanise Ervin, a 19-yearold killed by crossfire outside a Better Waverly carryout last March, will be the first woman officially spotlighted by the group in June. Kent is working on obtaining non-profit status for Remember Me and is teaming up with other groups with similar missions, including the human rights organization Power Inside, which supports women and girls who have experienced gender-based violence and oppression. Kent’s ultimate goal is for the group to maintain a national database of missing and murdered Black women and keep the memory of the victims alive. “We have a lot of work to do,” she said.

WHO says cell phone use ‘possibly carcinogenic’ By KATE KELLAND Using a mobile phone may increase the risk of developing certain types of brain tumor and consumers should consider ways of reducing their exposure, World Health Organization (WHO) cancer experts said on Tuesday. A working group of 31 scientists from 14 countries meeting at the WHO’s International Agency for Research on Cancer (IARC) said a review of all the available scientific evidence suggested cell phone use should be classified as “possibly carcinogenic.” The classification, which puts mobile phone use in the same broad IARC cancer risk category as lead, chloroform and coffee, could spur the United Nations

health body to look again at its guidelines on mobile phones, the scientists said. But more lengthy and detailed research is needed before a more definitive answer on any link can be given. The WHO had previously said there was no established evidence for a link between cell phone use and cancer. “After reviewing essentially all the evidence that is relevant... the working group classified radiofrequency electromagnetic fields as possibly carcinogenic to humans,” Jonathan Samet, chair of the IARC group, said in a telebriefing. He said some evidence suggested a link between an increased risk for glioma, a type of brain cancer, and mobile phone use. The WHO’s position has been keenly awaited by

mobile phone companies and by campaign groups who have raised concerns about whether cell phones might be harmful to health. Industry groups immediately sought to play down the decision, stressing that the “possibly carcinogenic” category also includes substances such as pickled vegetables and coffee. “This IARC classification does not mean that cell phones cause cancer,” said John Walls, vice president of public affairs for the United States-based wireless association CTIA. He noted that the IARC working group did not conduct any new research, but reviewed published studies, and said other regulatory bodies such as the U.S. Food and Drug Administration have stated that “the weight of scientific evidence has not linked cell phones with

any health problems.” John Cooke, executive director of the British-based Mobile Operators Association, said IARC had only found the possibility of a hazard. “Whether or not this represents a risk requires further scientific investigation,” he said in a statement. The IARC remarks follow a study published last year which looked at almost 13,000 cell phone users over 10 years and found no clear answer on whether the mobile devices cause brain tumors. Many previous studies have also failed to establish any clear cancer link, but a U.S. study in February found that using a mobile phone can change brain cell activity. Use of mobile phones has increased hugely since their introduction in the early- to

mid-1980s. About 5 billion mobile phones are currently in use worldwide. Christopher Wild, IARC’s director, said it was important that more research should be conducted, particularly into long-term and heavy use of mobile phones. “Pending the availability of such information, it is important to take pragmatic measures to reduce exposure such as hands-free devices or texting,” he said. Malcolm Sperrin, director of medical physics and clinical engineering at Britain’s Royal Berkshire Hospital, said he thought the IARC move was appropriate because it reflected the “anecdotal evidence that cancers may be associated with phone usage.” But he added: “It is vitally important to fully understand that there is no definitive correlation.”

Part Two Somewhere along the way, my board membership was terminated without notification. When I observed that I was no longer getting correspondence from the organization, I inquired as to the reason. I was informed that I was no longer a member of the board. “How could that be?” I asked. “You resigned,” I was told. “I did not resign from the board, but as the chairperson,” I said. In fact, I reminded them that I continued attending the board meetings until I no longer received correspondence. I took the matter to the Attorney General who was, at that time, Mr. Eliot Spitzer. The major reason I raised the issue with the Attorney General was because the Black United Fund (B.U.F.), of which I was a founding member, was being dismantled by Mr. Spitzer, with the installation of a Board of Directors of his choosing. of goodness.” My friendship with Reverend Bullock was as such that there was no action, plan, or important idea that I didn’t share with him. Every time we organized, he was always included. The many marches and demonstrations always had his blessings although he couldn’t physically participate in them. During the later years, even though his legs had become bent, and his mighty heart was failing, he would be at every meeting I organized. Sometimes, we had to help him from the car, into the church, and to his seat, and back again to the car. He was there when we organized the African American Clergy and Elected Officials. His wife, Sister Mary Bullock, told me, “He would fight to get to the meeting, and he would fight to get back home.” Dr. Gardner Taylor, the venerable and retired Pastor of Concord Baptist Church in Brooklyn, New York, initiated the call to former Assemblyman Al Vann and me, to co-chair a clergy effort to support the mayoral candidacy of David Dinkins. Looking back, I guess Mr. Spitzer had something else on his mind. I take no pleasure in discussing this piece of history, but it was necessary to show the kind of person Reverend Bullock was. To appreciate the depth of Reverend Bullock’s courage, commitment, and affection for me, let us remember that he went against the ministers of his denomination. This meant that there were repercussions in the conferences and churches of said denomination. During and after that time, my friendship with Reverend Bullock grew deeper. If it were not for him, I might have lost faith in some of my fellow ministers. It would have not been very disillusioning if these individuals were not ministers — men and women who were supposed to be paragons of moral and ethical behavior. It called to mind a saying: “We can endure the evil that men do in the name of evil, but Lord save us from the evil that men do in the name

The Fannie Mae and Freddie Mac betrayals By HARRY C. ALFORD It was such a great program that helped establish a great American Middle Class. Homeownership was elusive to the masses until after World War II and through the concept of subdivisions, homeownership became part of the American Dream. The millions of veterans started enjoying the new GI Bill of Rights, including the VA home mortgage. Each and every veteran (with decent credit) can now get a mortgage through the Veteran Administration for one time during his/her life. I still have mine in reserve but probably will never use it as the dollar threshold for mortgage sizes is too small for my family right now. But, for a young vet or one returning from a battle zone it is very attractive. The Federal National Mortgage Association, AKA Fannie Mae, was founded in 1938 as part of the New Deal (under President Franklin Delano Roosevelt). In the beginning, it was a Government Sponsored Enterprise. But, in 1968 it turned public and started acting like a private business entity. That was the beginning of a new “monster” as it no longer was acting with juris prudence and slowly started to take risks. As time went on, the risks grew in size. The Federal Home Loan Mort-

gage Corporation, AKA Freddie Mac, was founded in 1970 to meet the rising demands for mortgages as housing costs significantly rose, even faster than inflation. Together with Fannie Mae these entities jump started the greatest growth in home ownership that has ever been known to the world. Freddie and Fannie operate in the secondary market. They buy mortgages from the generators of these loans such as banks, mortgage houses, financial houses, the VA, etc. They buy the mortgages and that allows the generators to transfer their risks or free up their debt and continue to generate more mortgages. When I was in real estate it was important to follow the rules so that the initial paper will be accepted by Freddie or Fannie. The first thing you did was evaluate the customer. Is his credit history acceptable to the bank? The best way was to pre-approve a prospective homeowner through whichever entity was going to provide the loan. You find him eligible for a mortgage at a fixed price. The fixed price was the “bar” and you could not go over it. If a customer qualifies for a $200,000 mortgage than you shopped for homes priced at $200,000 or less. There would be a requirement of some down payment so that you started immediate equity usually

He was present at the creation, and he remained steadfast and loyal until he entered the hospital to come home no more. He brought wisdom, consistency, dependability, and integrity. He was very generous to me. When he won his lawsuit, to my surprise, he slipped a sizeable monetary gift to me. It is worth noting, and perhaps, it carries a meaning that is deeper than I first thought, that Reverend Bullock died during the time of my operation and recovery. It may be that God intended to bring us home together. We had had many celebrative times, and it seemed right and proper to be together in the heavenly celebration that awaits all faithful servants of the Most High. For some reason, perchance, we will understand by and by, God changed the plan. It may be that God, in His infinite wisdom, concluded it wouldn’t be wise for the two of us to enter heaven at the same time. The first things Reverend Bullock and I would want to do is sit together, and we would probably find something to fix, criticize, or re-arrange. I will miss Reverend James Bullock very much. It will be a long time

before I get used to being in a meeting and not seeing him present, and not being greeted with his broad smile. I called him my big brother for that is what he was like to me. He was always present in the time of need. He always came to my defense. The lines of Lord Byron’s narrative poem, “Childe Harold’s Pilgrimage,” come to mind: What is the worst of woes that wait on age? What stamps the wrinkle deeper on the brow? To view each loved one blotted from life’s page And be alone on earth, as I am now. … to be continued. No one could get around that back then and it made the housing industry strong and constantly reaching new levels. Something happened along the way after I left the real estate business. Together Fannie and Freddie had assets of about $1.7 trillion dollars and somehow those assets started getting compromised. The executives of the Government Sponsored Enterprises started taking bonuses and salaries like they were Fortune 100 corporations. The worst thing became the waving of the credit requirements. Mortgage brokers started easing back credit standards and the secondary markets were allowing it to happen. Freddie and Fannie had a fiduciary responsibility to this great nation of ours and they arrogantly decided to ignore it. Our unemployment is triple that of the national average and no one overseeing Fannie and Freddie seems to know how to right this listing “ship”. Executives at Fannie and Freddie seem to be doing all right though. They have gotten to keep the big bucks they raked in while deceiving the American economy. Why haven’t we gone after them as it is clearly malfeasance and, in fact, criminal recklessness? There has been a massive fleecing of millions of Americans and justice should be served. What assurances do we have that the perpetrators can no longer sit at the “switch” to cause more harm? What action have we taken to prevent a repeat of this historical theft and financial harm to America’s middle class? We need efficient prosecution and “perp walks” all over the place. It has been Enron, MCI, and the “Dot Com” scandal all wrapped into one. Let’s act accordingly.

Joplin tornado leaves thousands with no place to call home By KEVIN MURPHY JOPLIN, Missouri — It’s been four shelters in eight days for Rosalee Wilson, one of thousands of Joplin residents left homeless by the massive May 22 tornado. “I don’t like it,” Wilson, 71, said Monday as she stood by her cot in a gym-turneddormitory at Missouri Southern State University. “You never know where anything is and just when you get familiar with a place you get uprooted again.” Wilson was among about 175 people who spent Sunday night at the Red Cross shelter, one of the many landing places for those who lost their homes and apartments in the tornado. City officials estimated that about 8,000 houses and apartment buildings were destroyed by the tornado, which was rated an EF-5, or the strongest possible, and the deadliest single twister in the United States since 1947. The official death toll was last reported at 139 as of

The plan is to find rental property within 55 miles of Joplin for displaced residents, said Susie Stoner, spokesperson for in the tornado recovery effort of the Federal Emergency Management Agency (FEMA). She said the city of Joplin will determine if trailer homes are an interim solution. Joplin City Manager Mark

Rohr said trailers are among options being considered. But he said he would prefer residents stay in or near the city rather than 50 or more miles away. Wilson had lived in her house for 50 years and plans to rebuild. On Monday, she received word from her insurance adjuster that her house was a total loss and would be fully replaced. She is not sure where she will live in the meantime. The demand is expected to be strong for apartments. “I can’t imagine trying to

find a place, there are so many individuals and families without a home,” said Michele Nichols, who is providing a temporary home for her uncle, Robert Cole. His apartment was destroyed. A Federal Emergency Agency Management (FEMA) representative told him on Monday he is eligible for two months’ rent plus reimbursement for belongings in the tornado. FEMA provides assistance based on several factors, including whether the resident has insurance, Stoner said. Homeowners with a mortgage almost always have insurance through their lenders, but renters often may not have any coverage. Some tornado victims are staying with friends and family, some are in hotels, and a few are trying to stay in their houses despite severe damage. Terri and Rich Weisensee are living in the dining room of their 106-year-old house, which may or not be salvageable. “We’re kind of camping out in here,” Weisensee said,

preferring that to being away. “It feels more normal here. Well, not normal, but I’m home. We are extremely fortunate. So many houses are gone.” Weisensee said she saw a neighbor on Sunday whose house was a pile of rubble. But he was still sweeping up. “It’s just sad,” she said. For people who have lost their homes, the hardest time is probably still ahead, said Jacob Hefner, a crisis intervention counselor at the Red Cross shelter. The first week has kept them busy cleaning up and applying for insurance or FEMA aid, but they face an uncertain future, he said. “They are keeping their emotions close,’” Hefner said. “In a couple weeks when they reflect. It will affect them more.” But the strong presence of FEMA as well as state emergency management agencies has so far managed to keep the spirits up of people in the shelter, said day supervisor Angela Staton-Hunt. “It’s given them a lot of hope and that they can move on,” she said.

Illinois House approves bill U.S. ‘to view major cyber attacks as acts of war’ allowing casino in Chicago By MARY WISNIEWSKI CHICAGO — The Illinois House of Representatives on Monday passed a gambling expansion bill that would bring a casino to Chicago. The measure passed by a vote of 65-50. New Chicago Mayor Rahm Emanuel supports having a casino in the city and urged the state’s Senate to “act swiftly to pass this bill.” “A Chicago casino will spur local economic growth and provide jobs to Chicagoans, both needed to get our city moving again,” Emanuel said in a statement. The senate sponsor of the bill, Democratic Sen. Terry Link, said the senate already passed a version of the bill “a few times” so he expects it will pass again when the senate takes it up on Tuesday morning. “I don’t think the state’s going to turn down an extra billion dollars a year in annual revenue, plus

putting a lot of people to work,” Link said, adding that he thinks Governor Pat Quinn, another Democrat, will “take a long hard look at this.” The bill will allow four additional casinos in Illinois and slot machines for racetracks and at Chicago’s two airports. The sponsor, Rep. Lou Lang, a Democrat, has said the legislation would generate $1.5 billion up front in licensing fees, plus $500 million to $1 billion in annual gambling revenues, according to published reports. The money could be used to pay down the state’s bills. Quinn is open to proposals to raise revenues and create jobs to protect funding for education, according to his spokeswoman, Annie Thompson. “At this point we are monitoring that legislation,” Thompson said. Quinn has said he was open to a Chicago casino, but has expressed concerns about further gambling expansions.

WASHINGTON — The Pentagon has adopted a new strategy that will classify major cyber attacks as acts of war, paving the way for possible military retaliation, the Wall Street Journal reported. The newspaper said the Pentagon plans to unveil its first-ever strategy regarding cyber warfare next month, in part as a warning to foes that may try to sabotage the country’s electricity grid, subways or pipelines. “If you shut down our power grid, maybe we will put a missile down one of your smokestacks,” it quoted a military official as saying. The newspaper, citing three officials who had seen the document, said the the strategy would maintain that the existing international rules of armed conflict — embodied in treaties and customs — would apply in cyberspace. It said the Pentagon would likely decide whether to respond militarily to cyber attacks based on the notion of “equivalence” — whether the attack was comparable in damage to a conventional military strike. Such a decision would also depend on whether the

precise source of the attack could be determined. The decision to formalize the rules of cyber war comes after the Stuxnet attack last year ravaged Iran’s nuclear program. That attack was blamed on the United States and Israel, both of which declined to comment on it. It also follows a major cyber attack on the US military in 2008 that served as a wake-up call and prompted major changes in how the

Pentagon handles digital threats, including the formation of a new cyber military command. Over the weekend Lockheed Martin, one of the world’s largest defense contractors, said it was investigating the source of a “significant and tenacious” cyber attack against its information network one week ago. President Barack Obama was briefed about the attack.

Yemen truce ends in blasts, stokes civil war worries By MOHAMED SUDAM & MOHAMMED GHOBARI SANAA Street fighting raged in Yemen’s capital on Tuesday after a tenuous ceasefire between tribal groups and forces loyal to President Ali Abdullah Saleh broke down, edging the impoverished Arab state closer to civil war. Global powers have been pressing Saleh to sign a Gulf-mediated deal to hand over power to stem spreading chaos in Yemen, a haven for al Qaeda militants and neighbor to the world’s biggest oil exporter, Saudi Arabia. The turmoil was a factor keeping up oil prices on Tuesday, traders said. “The ceasefire agreement has ended,” a government official said on Tuesday, adding that tribal groups had seized a government building.

U.N. human rights chief Navi Pillay said her office had received as yet not fully confirmed reports that more than 50 people had been killed by Yemeni government forces since Sunday. On Tuesday, there were three main flashpoints in the troubled country — street fighting in the capital, government troops gunning down protesters in Taiz and a battle with al Qaeda and Islamic militants in the coastal city of Zinjibar. Later on Tuesday, heavy explosions rocked a northern district of Sanaa that houses the headquarters of an army division headed by Ali Mohsen, an influential general who has joined the opposition, residents said. “I think it is the first time missiles are being used in the street battles,” a resident said, referring to the loud blasts. A government spokesman earlier sug-

gested breakaway army units had attacked the ruling party’s headquarters in Sanaa. “What was new in today’s clashes is the use of armored vehicles ... which the Ahmar (tribesmen) don’t have,” Abdu al-Janadi, a deputy information minister, told Reuters. Sporadic fighting with tribesmen continued in the nearby Hasaba district, where residents took refuge in basements. Battles in the capital overnight brought an end to a truce between Saleh’s forces and tribesmen brokered at the weekend after more than 115 people were killed street battles last week. Saleh has defied calls from global leaders, elements in his own military and tens of thousands of protesters to end his 33-year-rule, which has brought Yemen close to financial ruin. He has also exasperated his rich Gulf Arab neighbors by three

The newest element is the street revolution while the power struggle among the elites and fragmentation of the Arabian Peninsula country have been playing out for some time, she said. “Saleh’s departure could be seen as the beginning of a contested and potentially lengthy process,” she said.

European food contamination kills 16, sickens 1150 By DAVID RISING & MARIA CHENG BERLIN - A massive and unprecedented outbreak of bacterial infections linked to contaminated vegetables claimed two more lives in Europe on Tuesday, driving the death toll to 16. The number of sick rose to more than 1,150 people in at least eight nations. Nearly 400 people in Germany were battling a severe and potentially fatal version of the infection that attacks the kidneys. A U.S. expert said doctors had never seen so many cases of the condition, hemolytic uremic syndrome, tied to a foodborne illness outbreak before.

Investigators across Europe were frantically trying to determine how many vegetables were contaminated with enterohaemorrhagic E.coli - an unusual, toxic strain of the common E. coli bacterium - and where in the long journey from farm to grocery store the contamination occurred. The highly politicized mystery over the source of the E. coli contamination deepened in the light of new evidence that two strains of the bacterium may be involved. German officials said they were still looking at Spanish produce but Spain said the discovery was proof its farms were not the source. E. coli is found in

large quantities in the digestive systems of humans, cows and other mammals. It has been responsible for a large number of food contamination outbreaks in a wide variety of countries. In most cases, it causes nonlethal stomach ailments. But enterohaemorrhagic E.coli, or EHEC, causes more severe symptoms, ranging from bloody diarrhea to the rare hemolytic uremic syndrome. In Germany, at least 373 people have come down with the syndrome, or HUS, in which E. coli infection attacks the kidneys, sometimes causing seizures, strokes and comas. “The idea of an outbreak of over 300

hemolytic uremic syndrome cases is absolutely extraordinary,” said Dr. Robert Tauxe, deputy director of foodborne, waterborne and environmental diseases at the U.S. Centers for Disease Control. “There has not been such an outbreak before that we know of in the history of public health,” Tauxe said, adding that the German strain of E. coli has not been seen in the United States. German officials say that investigations including interviews with patients have shown people were likely infected by eating raw cucumbers, tomatoes or lettuce, and they are warning consumers to avoid those vegetables.

Afghan president wants NATO to stopBy bombing houses HEIDI VOGT KABUL, Afghanistan - Afghanistan’s president on Tuesday ordered NATO to stop bombing homes, citing the risk of civilian casualties and putting him on a collision course with his Western protectors who insist the attacks are an essential weapon and will continue. It was Hamid Karzai’s strongest-ever statement against alliance airstrikes and further complicated a difficult relationship with the Obama administration as it prepares a troop drawdown in the increasingly unpopular war. Karzai’s remarks were prompted by a recent air attack that mistakenly killed a group of children and women in southern Helmand province. Karzai declared it would be the last. “From this moment, airstrikes on the houses of people are not allowed,” Karzai told reporters in Kabul. Ordering airstrikes is a command decision in Afghanistan, where NATO spokeswoman Maj. Sunset Belinsky insisted they would continue. “Coalition forces constantly strive to reduce the chance of civilian casualties and damage to structures,” Belinsky said. “But when the insurgents use civilians as a shield and put our forces in a position where their only option is to use airstrikes, then they will take that option.” In Brussels, NATO spokeswoman Oana Lungescu insisted NATO airstrikes are still essential. She said the alliance takes Karzai’s concerns very seriously and would continue to make every effort to avoid civilian casualties. She said airstrikes on houses are coordinated with Afghan forces and “they continue to be necessary.” “In many of these operations, Afghans are in the lead,” she said, refusing to comment on the recent raid in Helmand province. Belinsky sought to soften the alliance rejection of Karzai’s directive. “In the days and weeks ahead we will coordinate very closely with President Karzai to ensure that his intent is met,” she said. Karzai has previously made strong statements against certain military tactics, such as night raids, only to back away later. Karzai’s spokesman said the president plans to stand firm on this issue, regardless of the fallout with NATO. “The president was very clear today about the fact that bombardments on Afghan homes and Afghan civilians are unacceptable and must be stopped. There is no room for back and forth on this,” Waheed Omar said. “The president was clear in saying that any such strikes in the future will make the Afghan government react unilaterally.” Karzai did not explain what his threat of “unilateral action” but said he plans to discuss it with NATO officials next week.

South African regulators allow Wal-Mart deal By DONNA BRYSON JOHANNESBURG - Regulators have approved WalMart’s 17 billion rand (about $2.4 billion) bid to buy a controlling share of a South African chain in a ruling Tuesday that culminated a fierce debate over protectionism in the country with the continent’s most promising economy. Unions and government officials are worried the arrival of the world’s biggest retailer will hurt jobs and local manufacturing. In its ruling, the Competition Tribunal, the government agency charged with promoting competition and protecting consumers, said WalMart and South African retailer Massmart could not lay off any workers for two years, must respect Massmart’s existing labor agreements for three years and must invest in training South African suppliers. Wal-Mart and Massmart had already agreed to take the steps regarding layoffs and union agreements. They also pledged to spend 100 million rand (about $14 million) over the next three years to help farmers and other South African suppliers gear up to do business with Wal-Mart. Opponents called the

conditions inadequate. Powerful South African unions have threatened boycotts and strikes to keep Wal-Mart out. The tribunal said WalMart was likely to bring lower prices and “benefit consumers by strengthening rivalry and improving choice.” It said there would be inevitable losers among South African retailers and producers as a result of the decision, but that it chose a path it hoped would make South Africans more competitive, instead of choosing to insulate local industry. Arkansas-based WalMart operates in Europe, Asia and across the Americas. Its interest in coming to Africa for the first time has been seen as a vote of confidence not just in South Africa’s economy, but in the continent’s potential. The unions and the government departments of trade, agriculture and economic development had argued WalMart would flood South Africa with cheap foreign goods, forcing other retailers to do the same and putting local manufacturers out of business. They also argued during a week of public hearings before the tribunal earlier this month that Wal-Mart was anti-union, and that that would lead to lower wages and fewer jobs. Mubarak unfit to be moved to prison: pr osecutor By INES BEL AIBA CAIRO (AFP) - Ailing former Egyptian president Hosni Mubarak is not well enough to be moved to prison from his hospital in the Red Sea resort of Sharm elSheikh, the country’s public prosecutor said on Tuesday. “After having examined (Mubarak’s) medical file and evaluated (facilities) at the hospital in Tora prison, the committee has decided not to transfer the patient outside Sharm

el-Sheikh for the moment,” the prosecutor said. Mubarak has been in custody in hospital since April 13 after reportedly suffering a heart attack during questioning about the killing of anti-regime protesters and fraud. The 83-year-old is said to be suffering from “episodes of unconsciousness due to circulatory problems and low blood pressure,” the statement said.

He also suffers “an irregular heartbeat which could lead to a sudden heart attack,” it added. The former president is described as “generally weak and depressed, and he has trouble getting out bed without help.” The prosecutor also said Mubarak had suffered from “bile duct tumours which have been operated on abroad,” without elaborating. In March 2010,

Mubarak went to Germany for surgery. Doctors at the time said he had suffered from chronic calculus cholecystitis — an inflammation of the gall bladder accompanied by gall stones — and a duodenal polyp. They said he also had a growth removed from his small intestine. In an interview with CNN on Sunday, Mubarak’s lawyer said the former president was in “very bad health.”

“The president has serious heart problems and complications with his stomach from the operation he had in Germany last year,” Farid El Deeb said. The spectacular fall of one of the region’s most powerful leaders after 18 days of nationwide anti-regime protests was followed by repeated calls for his trial. The Supreme Council of the Armed Forces, which took power when Mubarak was ousted on

February 11, has vowed to bring to justice all those found guilty of abuse, but has been criticised for its handling of the transitional phase. Mubarak and his two sons were last week referred to a criminal court on charges of ordering the killings of anti-regime protesters and graft. The murder charges may lead to a death sentence if Mubarak is found guilty, the justice minister said earlier this month.

North, south Sudan agree to demilitarized border By MAGGIE FICK JUBA, Sudan - North and south Sudan have agreed to establish a jointly patrolled demilitarized border zone between the two sides as the south prepares to declare independence in July, the African Union said Tuesday. Such a buffer could lower the chances of an accidental northsouth clash. But its implementation depends on the two sides reaching an agreement over the demarcation of the border, an issue that has long been contentious. The deal could also be disrupted by other outstanding issues, such as the sharing of oil rights between north and south. AU adviser Alex de Waal, who has facilitated negotiations on security issues between Sudan’s north and south regions, said the parties agreed Monday during talks in Ethiopia’s capital to form a common, demilitarized zone stretching across the 1,300-mile (2,100-kilometer) north-south border. It’s not yet known when the zone will go into effect. The zone will stretch 6 miles (10 kilometers) north and south from the 1956 border, the tentative line drawn when Sudan became independent from

Security Council and a host of Western nations have repeatedly condemned the act. President Obama’s special envoy to Sudan called it a disproportionate response to an attack by the southern army on a U.N.-escorted northern military convoy in the area on May 19. The Security Council has called for the immediate and unconditional withdrawal of the northern army from Abyei, but the government of President Omar al-Bashir has not made any concessions. On the evening of May 26, the northern army bombed and destroyed the strategic bridge across the Bahr el Arab, called the River Kiir by southerners, which forms the 1956 border in the area.

Researchers call for firm stance on Zimbabwe polls By GILLIAN GOTORA HARARE, Zimbabwe - A tougher stance already taken by regional leaders toward reforms on Zimbabwe can prevent a repeat of bloody, disputed elections, a pro-democracy research group said Tuesday. The Institute for a Democratic Alternative for Zimbabwe said Southern African leaders for the first time have the will and capacity to ensure credible, free elections in the country. Former Southern African Development Community secretary-general Prega Ramsamy reported that the regional bloc has made it clear it will no longer tolerate rogue members such as Zimbabwe that flaunt its guiding principles on elections and democracy. He said SADC recently “put its foot down” to stop President Robert Mugabe calling early

elections this year. Mugabe, 87, who is in a shaky coalition that was brokered by the regional body after violent elections in 2008, wants elections this year to end the troubled power sharing agreement with the former opposition of Prime Minister Morgan Tsvangirai. But regional leaders at a summit in March ruled that the nation was not ready to go to the polls until work on rewriting the constitution and several other coalition disputes were resolved, along with an end to political violence. “This is the first time SADC has clearly put its foot down on Mugabe which shows its determination to adapt to global change,” Ramsamy said. The region’s previous soft approach toward Zimbabwe stemmed from old-guard leaders alongside Mugabe who led the fight against colonial rule. “There are new political leaders ... looking for economic development, security and sta-

Tsvangirai’s party denied the allegations and in a statement cited witnesses saying the police inspector was killed when he was hit on the head with a chair as police intervened to stop a dispute in a township bar on Sunday.

South African officials have accused Libyan leaders of misinforming them about Hammerl, assuring them for weeks after his death that he was alive. Hammerl’s death was confirmed May 19 by journalists. Hammerl’s colleagues had been held by Gadhafi’s forces since the shooting in early April, and had been afraid to speak of his death until they were safely out of Libya in May.

Nigeria gets its first freedom of information law ABUJA, Nigeria - The Nigerian president’s office says he has approved a law that gives citizens of Africa’s most populous nation access to public records for the first time. The Presidency said in a statement Monday that Goodluck Jonathan signed the Freedom of Information bill into law Saturday. The new law gives government bodies seven days to produce requested information. It also makes it a criminal offense to destroy records. The National Assembly passed the bill on May 24 and civil groups raised fears that it could lose its validity if not signed before the start of the president’s new term Sunday. Former President Olusegun Obasanjo refused to sign the bill into law in 2007. Amnesty International said Wednesday that the Nigerian government could “not repeat history and allow this opportunity to pass.”

Cuba condemns US sanctions against Venezuelan state oil company HAVANA, Cuba — The Cuban Ministry of Foreign Affairs has issued an official declaration strongly condemning recent sanctions imposed by the government of the United States against Venezuela’s state oil company, PDVSA. The declaration, published by Juventud Rebelde newspaper on Sunday, read: “Cuba’s government and people express their solidarity with President Hugo Chavez and with the Venezuelan people, and fully support a resolution passed by the National Assembly of Venezuela on this issue.” The declaration claimed that, with these sanctions, the United States has violated international law and implemented unilateral and extraterritorial regulations. The note from the Cuban Ministry of Foreign Affairs added that the economic aspect of these punitive measures is not the essential issue but the risk that, with this decision, Washington might be trying to provoke new conflicts in the region as part of its efforts to divide Latin America and the Caribbean. “By attacking Venezuela, you’re also attacking Cuba,” the text noted. PDVSA is one of seven companies penalized by the US for providing gasoline and other refined petroleum products to Iran in violation of a US law that aims to pressure Tehran into dropping

its nuclear program. The State Department said PDVSA supplied Iran with “at least two cargoes” of a blending component used to improve gasoline. The sanctions bar PDVSA from seeking US government contracts, obtaining US export licenses, and from obtaining financing from the ExportImport Bank of the US, but leave untouched the flow of an estimated 1.2 million barrels a day of Venezuelan crude oil to the US. WHO: Smoking could kill 8 million a year by 2030 By KATE KELLAND LONDON — Tobacco will kill nearly six million people this year, including 600,000 non-smokers, because governments are not doing enough to persuade people to quit or protect others from second-hand smoke, the World Health Organization (WHO) said. Since there is often a lag of many years between when people start smoking and when it affects health, the epidemic of tobacco-related disease and death has just begun, the WHO said. But by 2030, the annual death toll could reach 8 million. The United Nations health body urged more governments to sign up to and implement its tobacco control treaty, warning that if current trends persist, tobacco could cause up to a billion deaths in the 21st century, a dramatic rise from the 100

million deaths it caused in the previous century. So far, 172 countries and the European Union have signed up to the WHO’s Framework Convention on Tobacco Control (FCTC), which came into force in 2005 and obliges them to take steps over time to cut smoking rates, limit exposure to second hand smoke, and curb tobacco advertising and promotion.

The WHO noted some encouraging recent moves — Uruguay now requires health warnings that cover 80 percent of the surface of tobacco packs, and China last month implemented a ban on smoking in public places such as restaurants and bars. But it said that if the FCTC was to achieve its full potential as the “most powerful tobacco control tool”, more

needed to be done. “It is not enough to become a party,” WHO director-general Margaret Chan said in a statement. “Countries must also pass, or strengthen, the necessary implementing legislation and then rigorously enforce it.” Tobacco kills up to half its users and is described by the WHO as “one of the biggest public health threats the world has ever faced”. It causes lung cancer, which is often fatal, and other chronic respiratory diseases. It is also a major risk factor for cardiovascular diseases, the world’s number one killers. The WHO said smoking is one of the biggest contributors to a worldwide epidemic of non-communicable, or chronic, diseases such as heart attack, stroke, cancer and emphysema, which accounts for 63 percent of all deaths worldwide, nearly 80 percent of which occur in poorer countries.

To mark World No Tobacco Day on May 31, the World Lung Foundation (WLF) campaign group launched a website of graphic and gruesome images of the health effects of smoking that health officials can download for use as warnings on tobacco packaging. The WLF said that on average, smokers see images on tobacco packs 15 times a day, adding up to almost 5,500 times a year which makes pictures “a highly effective channel to inform smokers about the dangers of tobacco.” One image shows a cutopen human chest in full color with black lungs protruding from inside. “Countries that mandate large graphic pack warnings are not only fulfilling their legal obligations, they are taking a big step forward toward better informing smokers of the deadly harms of tobacco,” said Peter Baldini, the WLF’s chief executive.

More evidence for PTSD, heart disease link By GENEVRA PITTMAN People with post-traumatic stress disorder may be at a higher risk for heart disease, according to researchers. In a study of U.S. war veterans, they found that those with PTSD were more likely to have fatty buildup, or plaque, in the arteries leading to the heart, called coronary artery disease. The disease had also progressed farther in the mentally troubled vets, and they were more likely to die of any cause over the next three and a half years than their peers. Joseph Boscarino, an investigator at Geisinger Health System in Danville, Pennsylvania, told Reuters Health the new results confirm earlier findings. Studies “keep showing this link between PTSD and various forms of cardiovascular disease,” said Boscarino, who was not involved in the current work. “Something needs to be done in terms of better interventions” for these individuals, he added. The military has already been under pressure to better address PTSD in returning troops, as accounts of vets plagued by combat flash-

backs, fearful and avoidant behavior, and depression have been piling up. According to the National institute of Mental Health, about 1 in 30 adults in the U.S. suffer from PTSD in a given year — and that risk is much higher in war vets. The new results highlight the importance of integrating medical and psychological care in vets, and quickly identifying those who are at risk for PTSD and thus heart disease as well, the researchers write in The American Journal of Cardiology. Dr. Ramin Ebrahimi of the Greater Los Angeles Veterans Administration Medical Center and colleagues screened a group of 637 vets suspected of having heart disease for PTSD and signs of coronary artery disease.

The vets were an average of about 60 years old, and most were men. Eighty-eight of them fit the criteria for PTSD. Calcium scans of their hearts showed the majority of participants had some sort of plaque buildup in their arteries. More than threequarters of the vets with PTSD had narrowed arteries, compared to 59 percent of those without PTSD. After their initial tests, the researchers followed participants for an average of three and half years. Over that time, 17 percent of the vets with PTSD died, compared to 10 percent without PTSD. Even among those with the same degree of plaque buildup, participants with PTSD died at a higher rate. Although the study doesn’t mean that PTSD necessar-

ily causes heart disease, it does suggest that it’s not enough to worry about the mental toll of the disorder. “For the longest time (PTSD) was basically known as a psychological or psychiatric disorder,” Ebrahimi told Reuters Health. “Little by little we understood that these patients actually do have a fair amount of other medical problems.” Boscarino said that it’s still unclear what exactly is behind the link between mental and physical health. It’s possible that stress hormones related to PTSD could affect the chance of getting heart disease or that the behavior of people with PTSD — such as higher rates of heavy alcohol use and smoking — puts them more at risk, he explained. It could also be that cer-

tain genes influence a person’s risk for both PTSD and heart disease, rather than PTSD causing heart problems, he added. Ebrahimi emphasized that PTSD strikes not only people involved in combat or other violence, but survivors of rape and natural disasters as well. Often, it can be treated successfully with psychotherapy. According to Boscarino, screening for heart disease and trying to prevent it is key in people with PTSD. But addressing the psychological problems may be even more important. “If you treat someone for PTSD early on...you should prevent not only the psychological problems, but you’re also potentially preventing the medical problems” that may come later, he said.

Stress doesn’t boost risk for multiple sclerosis Although stress can exacerbate multiple sclerosis (MS), it doesn’t actually increase a person’s risk for developing the disease in the first place, new research indicates. Researchers followed two groups of more than 100,000 nurses each, ranging in age from 24 to 55, from the Nurses Health

Study at two separate intervals. Those examined were asked about their levels of stress both at home and at work, as well as any stress stemming from childhood physical and sexual abuse. After taking other factors into account, such as age, ethnicity and smoking, researchers found stress did not increase the women’s

risk for developing MS. The study, published in the May 30 issue of Neurology, did find the risk of MS is particularly high among young women. Researchers noted their findings could help guide future research into the specific causes of the disease. “This rules out stress as a major risk factor for MS.

Future research can now focus on repeated and more fine-tuned measures of stress,” study author Trond Riise, of the University of Bergen in Norway, said in a news release from the American Academy of Neurology. Riise conducted the research while he was a visiting scholar at the Harvard School of Public Health.

The Garden State’s closest neighbors, New York and Pennsylvania, both have strict rules for home-school families, said Keyport resident Rich Millward,

president of Education Network Of Christian Homeschoolers of New Jersey. “I am concerned, and I don’t think homeschool families here would want to see more regulations,” he said. The law giving New Jersey parents the right to home school says parent or every guardian must ensure their children “regularly attends the public schools of the district, or a day (home) school in which there is given instruction equivalent to that provided in the public schools for children of similar grades.’’ Even though state law doesn’t require it, the New Jersey H o m e s c h o o l Association suggests parents notify the school district anyway when withdrawing their children from school or if school officials ask whether their child is truant, according to the association’s website. Home-school supporters could compromise a little more and not lose the autonomy they cherish, said professor Robert Kunzman of the Indiana University School of Education, who has conducted research and written a book on the home-schooling movement.

Police charge teen with murder in fatal shooting of off-duty Newark police officer NEWARK - A Newark man was charged with murder tonight in the shooting of an offduty police officer who was killed while waiting for a slice of pizza at a city restaurant, authorities said. Rasul McNeillThomas, 19, also was charged with two counts of aggravated assault, as well as related weapons offenses, said Thomas Fennelly, Essex County’s chief

assistant prosecutor. Bail for McNeillThomas, who already had been charged with carjacking in connection with the drive-by shooting that killed officer William Johnson last week, was raised to $1.5 million. An altercation at a bridal shower between a group of young women and the bride-to-be appears to be the catalyst that led to Johnson’s death, according to friends, relatives and authorities. The twist: The

betrothed is McNeillThomas’ mother. Ashli Sinclair, a friend of the McNeillThomas family who lives in the neighborhood, said a bridal shower Thursday had extended onto the front lawn of their Leslie Street home when a group of women she described as “troublemakers” started exchanging words with the attendees. The argument escalated, and McNeillThomas’ mother was punched in the face by

one of the women, an account confirmed by sources close to the investigation. They are not being named because they were not authorized to speak about the case. A few hours later, just before 10 p.m., Johnson, a 16-year-veteran of the Newark police, was at the Texas Fried Chicken and Pizza on Lyons Avenue when a flurry of bullets were fired from a passing car into the restaurant. He was unarmed. Johnson, 45, died five

hours later, leaving behind two children, ages 22 and 11. A 21year-old man and 19year-old woman were also struck but survived. Authorities said the target, the woman who allegedly hit McNeillThomas’ mother, was in the restaurant but was not hurt. McNeill-Thomas was arrested late Friday afternoon at his home, less than a half-mile from the scene of the shooting. He was initially charged with carjacking, unlawful posses-

sion of a weapon and possession of a weapon for an unlawful purpose. But she says her goal is not to be a skinny Minnie. “I can lose weight easily and I don’t like to do that. I’m not trying to lose and get small. Is ABC’s ‘Wipeout’ a rip-off? By MATTHEW BELLONI LOS ANGELES — In the 1996 film “Swingers,” Vince Vaughn, Jon Favreau and their fellow wannabe actors debate whether Quentin Tarantino ripped off a slow-motion sequence in “Reservoir Dogs” from Martin Scorsese. “Everybody steals from everybody,” Vaughn’s character announces. “That’s Hollywood.” The Swingers maxim is true throughout showbiz, but perhaps it most accurately describes one particular segment of Hollywood: Reality TV. Since “Survivor” kicked off the U.S. boom in unscripted, narrative programing 11 years ago, the niche has been littered with more copycat shows and derivative concepts than hit original formats. “American Idol,” the official U.S. version of Britain’s “Pop Idol,” spawned countless singing elimination shows. History’s “Pawn Stars” begat “Hard Core Pawn,” “Pawn Queens” and the rest. Producers of ABC’s “Wife Swap” once sued the makers of Fox’s similar family switcheroo series “Trading Spouses.” Owing to what might be a kneejerk reaction against protecting the creativity in a genre dubbed “reality,” as well as a lack of clarity in copyright law, many producers believe there is a Wild West mentality in the unscripted world that has given rise to a culture of rampant, unlicensed borrowing. Not helping matters was a leaked 2008 memo from an ABC executive, urging executives and producers to “carefully scrutinize” whether licensing foreign formats was “necessary or appropriate” before going

forward with similar shows, especially when they might only be interested in the “general, underlying premise.” The memo didn’t specifically target reality shows, but it drew the ire of the Format Recognition and Protection Association, an international group pushing for intellectual property rights for unscripted TV formats. FRAPA suggested that producers consider helping themselves to the “underlying premise” of Disney’s Hannah Montana and Mickey Mouse. Against that backdrop, a lawsuit coming to a head in U.S. District Court in Los Angeles might determine where a court will draw the line on copyright infringement in reality TV. The case, filed in 2008 against ABC by Japan’s Tokyo Broadcasting System (TBS), claims that ABC’s wacky obstacle-course competition “Wipeout” copied original elements of six TBS shows, including “Takeshi’s Castle,” “Most Extreme Elimination Challenge” (MXC), “Sasuke” and “Ninja Warrior.” The suit alleges that ABC and “Wipeout” producer Endemol set out to replicate the TBS shows, lifted popular components and even sought to manipulate Google into sending traffic for search terms “Takeshi’s Castle” and “Ninja Warrior” to a “Wipeout”-sponsored link. The case has a key summary judgment hearing this summer after a May 12 mediation failed to produce a settlement. Crucial to the case is which unique elements of the TBS shows warrant copyright protection (what lawyers call the “protectable” vs.

“nonprotectable” elements). In court papers, ABC argues that TBS “remarkably claims copyright protection in obstacles and obstacle concepts ubiquitous in the public domain, such as ‘rope swings,’ ‘mechanical bulls’ and ‘pole vaults.’” The network points out TV’s history of obstacle-course competitions, from the BBC’s “It’s a Knockout” in the ‘60s to ABC’s “Battle of the Network Stars” in the ‘70s to “Fear Factor,” the 2001-06 NBC series from Endemol, produced by “Wipeout” cocreators Matt Kunitz and Scott Larsen. “Wipeout,” ABC argues, uses only general scenes a faire, rather than any unique, and thus copyrightable, expression. Considering the limited number of reality-TV tropes available to producers, ABC makes a compelling argument. Still, when Judge Margaret Nagle sits down to watch Wipeout and the six TBS shows (a good reason to give federal jurists raises), she will likely notice alarming similarities. “Wipeout’s” “Cookie Cutter” contraption appears nearly identical to MXC’s “Rotating Surfboard of Death,” as do the wisecracking hosts. Ditto “Wipeout’s” “Hopping Blocks” and Sasuke’s “Six Jumps.” And so on. How many similarities are too many? Therein lies the larger question beyond the minutia of the “Wipeout” case: What aspects of any reality show are subject to legal protection? In a genre where the traditional plot and character aspects of scripted works have been replaced by unique formats, the law might need to evolve to protect the creativity that informs this powerful segment of the TV world.

Jennifer Hudson refutes report she cannot sell book Jennifer Hudson is demanding an apology from editors of a gossip blog after they posted an article about her struggle to land a book deal detailing her weightloss - alleging literary agents are more interested in the star’s tragic family murders. The Dreamgirls star was left devastated in 2008 when her mother, brother and nephew were shot dead in her native Chicago, Illinois. Her estranged brother-in-law, William Balfour, has been charged over the slayings. Of the new video Cannon says, “When it comes on, you can dance like you famous, drink like you famous, party like you famous.” “Famous” is lifted off Cannon’s forthcoming album ‘Mr. Showbiz,’ which is scheduled for release later this year. Mariah Carey has been cleared by the child protection services after preliminary interviews. The L.A. County Department of Children and Family Services (DCFS) have concluded there is no merit to the investigation that original stemmed from complaints that Carey was drinking beer while breastfeeding. According to TMZ, the DCFS social workers have concluded the twins are in a healthy and safe environment after interviewing Carey and spending time with the babies. Carey’s lawyer, Laura Wasser, was also present at the meeting. As previously reported, Carey was told by a nurse to drink dark beer to help with her breastfeeding. Carey admittedly told the social workers she drank the Guiness only after she was told to do so. Her husband, Nick Cannon, commented on the matter in an interview with Piers Morgan before, explaining, “It all started when a

nurse suggested to my wife that if you drink Guinness, the dark beer, the yeast improves breastfeeding. I don’t know if someone heard that, but then they were saying my wife was drinking beer. People will do anything to try to conjure up a story.” Carey and Cannon welcomed their first set of twins, baby girl Monroe and baby boy Moroccan, on April 30th at a Los Angeles medical facility at about noon EST.

March home prices suffer double-dip setback U.S. single-family home prices dropped in March, dipping below their 2009 low, as the housing market remained bogged down by inventory and weak demand, a closely watched survey said on Tuesday. The S&P/Case Shiller composite index of 20 metropolitan areas declined 0.2 percent in March from February on a seasonally adjusted basis, in line with economists’ expectations. The price index was below the low seen in April 2009 during the financial crisis. The glut of houses for sale, foreclosures, tight credit and weak demand have kept the housing market on the ropes even as other areas of the economy start to recover.

The 20-city composite index was at 138.16, falling below the 2009 low of 139.26. “This month’s report is marked by the confirmation of a double-dip in home prices across much of the nation,” David Blitzer, chairman of the index committee at S&P Indices, said in a statement. “Home prices continue on their downward spiral with no relief in sight.” Eight cities fell 1 percent or more in March, while Washington was the only city where prices increased on both a monthly and yearly basis. Prices in the 20 cities fell 3.6 percent year over year, topping expectations for a decline of 3.3 percent. “The declines sustained in the last 12 months have almost

erased the gains of the previous 12 months. The housing market is treading backward, but not drowning,” said Cary Leahey, economist and managing director at Decision Economics in New York. In the first quarter, the national index fell 1.9 percent on a seasonally adjusted basis, compared to a decline of 1.8 percent in the previous quarter. On a nonadjusted basis, they fell by 4.2 percent in the quarter. Nationally, home prices are back to their mid-2002 levels, the report said. Financial markets saw little reaction to the data, with U.S. stock index futures pointing to a higher open on optimism that new aid for Greece from the European Union was on the horizon.

Google says Chrome to power only notebooks for now By LEE CHYEN YEE TAIPEI — Google Inc will keep the focus of its Chrome operating system on notebooks, and has no immediate plan to make it available on tablets or to merge with its popular Android software for smartphones, said a senior executive. operating system can be found on 90 percent of the world’s PCs. Google had seen Chrome user numbers double over the past year to about 160 million, Sundar Pichai, Google’s senior vice president for Chrome, told a news conference on Tuesday during the Computex PC show in Taipei. “Chrome OS is a computer model designed with various form factors in mind, but we are entirely focused on the notebook form factor for now. other plans at this time,” Pichai said in response to a question on whether Chrome would also be available for tablet PCs. Web-centric PC laptops, made by Samsung Electronics Co Ltd and Acer Inc using Chrome will go on sale in June, challenging Microsoft and Apple Inc. With the number of original equipment manufacturers still small, Google had set up a Chrome center in Taiwan, hoping to engaging more partners in the region,

Intel unveils laptops that include tablet features By CLARE JIM and NOEL RANDEWICH TAIPEI/SAN FRANCISCO — Intel unveiled a new category of laptops that it says will include the best features of tablets as the world’s top chipmaker struggles to find its footing in the exploding market for mobile gadgets. Netbook pioneer Asustek showed its first new PC in Intel’s “Ultrabook” class, the UX series, on Monday at the Computex computer show in Taipei. Intel said models made by other manufacturers would go on sale by

Christmas and cost under $1,000. Ultrabooks will be svelte and lightweight but still pack high-performance processors. They should account for 40 percent of laptop sales to consumers by the end of next year, Tom Kilroy, a senior vice president at Intel, told Reuters in an interview in San Francisco. “We’re shooting for ultra responsive. You’ll have always-on, always-connected, much more responsive devices, similar to what you would see with a tablet today such as an iPad,” he said. In Taipei on Tuesday, Intel’s vice president Mooly Eden called

Such a device would be a major test of Oak Trail, Intel’s first chip designed specifically for tablets and able to support the widely popular Android platform. The Ultrabook is not the first PC category that Intel and Asus have promoted together. U.S. should ban rentals of recalled cars Sen. Charles Schumer called for legislation that would prohibit the rental of cars that had been recalled for safety reasons. Schumer said car rental customers would be endangered if rental agencies were granted a request to decide whether a safety recall warranted taking a vehicle out of service. The American Car Rental Association (ACRA), which represents nearly 100 agencies, in April proposed a system that would allow agencies to decide the seriousness of auto recall issues, and whether or not to take a vehicle out of their fleets. “Under the proposal ... we sadly could see

more tragedies,” Schumer said in a statement, citing a case of two California sisters who died while driving a rented vehicle under recall. Schumer said legislation he introduced in March would require car rental companies to operate under the same restrictions as automobile dealerships, which are banned from selling any recalled vehicle until the relevant safety issue is addressed. He called that a “common sense proposition.” Schumer said the association’s proposal would “create a vague double standard that defines some recalled cars as safe and others as dangerous,” allowing “these companies

to shirk their responsibility to consumers’ safety.” Schumer said ACRA’s proposal would allow each rental car company to set its own policy, which would lead to unsafe cars being rented out. A National Highway Traffic Safety Administration audit last year of ten recalls on Chrysler and GM vehicles found that rental companies fix only half of recalled vehicles within a year, according to car manufacturers. Rental companies dispute the findings, saying the data is incomplete and does not include rental cars sold to third parties before the official recall date.

NFL sees no need to open books to players: Goodell By GENE CHERRY RALEIGH, North Carolina - The NFL has no plans to open its financial books to the players despite frequent requests, Commissioner Roger Goodell said. The players say the information is needed to evaluate comments by the league that its nonplayer costs have increased significantly. But Goodell said that is not going to solve the labor dispute that is threatening the 2011 season for America’s most popular professional sport. “We saw it frankly in the NBA where there were so-called ‘open books’ for the last two years and a filing earlier this week with the NLRB said there was not enough financial disclosure,” he told Tennessee Titan fans in a telephone chat on Thursday night. Goodell was referring to an unfair labor practice charge against the NBA that the NBA Players Association filed with the National Labor Relations Board on Tuesday. The union accused the NBA of making harsh and regressive demands, a charge the NBA denied.

Goodell said the NFL does not need to open its books for the players to have full knowledge of the economic situation of the league. “They understand that costs are rising faster than the revenues,” he said. “They have our revenue down to a penny.” Owners originally asked for an extra billion dollars off the top of league revenue to help finance new stadiums and other needs. The figure was later reduced during bargaining sessions. The league currently receives $1 billion before the $9 billion in annual revenue is divided with the players. The players’ stake topped 50 percent under the previous collective bargaining agreement, but would decrease if owners’ take increases. Goodell said a March proposal by the owners would slightly increase player compensation from 2010 to 2011 with a 14 percent increase coming over the next three years. How to divide the money is a major roadblock in resolving the labor dispute, which has resulted in the owners locking out the players for more than 70 days. The lockout, which forbids contact between players and teams, began on March 12, a day after bargaining talks broke

down and the players union, the NFL Players Association (NFLPA), decertified. Nine players then filed an antitrust lawsuit against the league, resulting in several court decisions and mediation sessions. The feuding parties will be back in court on June 3 for a hearing on the legality of the lockout. Among the groups siding with the players in the case is the NFL Coaches Association. “Coaches are already experiencing hardship from the NFL’s lockout and are vulnerable to irreparable injury if league operations are suspended for a significant period of time,” the group said in a brief filed with the Eighth U.S. Circuit Court of Appeals. But Goodell downplayed the filing. “The Coaches Association is housed in the NFLPA building,” he said. “They are funded by the NFLPA.” Goodell said the league did not have a “drop-dead date” for canceling events but said earlier this week the time was fast approaching when decisions needed to be made. He admitted the league had contingency plans but did not elaborate.

Frustrated Ozzie Guillen vents White Sox manager Ozzie Guillen has grown tired of White Sox critics so he voiced his displeasure about it Sunday ... and that was before a brutal 13-4 defeat to the Blue Jays. It was the second consecutive day Guillen went off on a passionate tirade. He laid into his team Saturday for their lack of clutch hitting in a 14-inning defeat to Toronto, but clarified a day later that he wasn’t questioning their effort but bemoaning a lost opportunity. Guillen, who uses social media outlets probably more than any

other manager in baseball, has clearly heard the negative comments coming from the most frustrated and computer-savvy segment of White Sox followers. The club boosted payroll over the $125 million mark for the first time in franchise history and in the process raised expectations. But the team has been one of the worst in baseball this season. After Sunday’s defeat the White Sox are 24-31 and 9 1/2 games behind the first-place Cleveland Indians. Only one team — the Minnesota Twins — has a worse win percentage

in the American League. “Are (the critics) going to feel sorry because we’re going to get fired? (Heck) no,” Guillen told reporters before Sunday’s game. “They only remember us from (the World Series title in) 2005. In 2020 we’ll come here in a wheel chair all (messed) up. As soon as you leave the ballpark they don’t care about you anymore. They don’t. The monuments, the statue they got, they (urinate) on it when they’re drunk. That’s all they do. If any players from Ohio State decide to apply for the NFL’s supplemental draft in the wake of Jim Tressel’s resignation, they will have the chance to be drafted despite the lockout. An NFL official on Tuesday told ESPN NFL Insider Adam Schefter that the supplemental draft will be held sometime in July — if there are applicants. “So far, there have been no applicants,” a league official told ESPN. The official said no deadline for applying for the draft has been set. “If there is one, the supplemental draft would be held mid-to-late July, no later than 10 days before the first training camp opens,” the official told ESPN. Forty players have been selected in the NFL supplemental draft since its inception in 1977. The draft is intended for players who missed the filing deadline for the NFL draft or had other issues develop that affected their college eligibility. Teams submit picks to the league and if their bid is the highest, they receive the player but lose the corresponding draft pick in the next draft. For example, in last year’s supplemental draft, the Chicago Bears picked Brigham Young running back Harvey Unga and the Dallas Cowboys selected Illinois defensive end Josh Brent. Both players were selected in the seventh round, meaning the Bears and Cowboys forfeited their seventhround picks in the 2011 NFL draft.

Demetri Goodson transferring to Baylor Demetri Goodson now has a new school to go with his new college sport. The former Gonzaga point guard, who gave up his senior season of basketball to play college football, will transfer to Baylor, he told Houston’s KRIV-TV. He’ll have two years of eligibility remaining in football. “Just get my transcript from Gonzaga shipped over to Baylor,” Goodson told the station. “I shipped it out (Saturday). Once they get all that stuff done, I’ll be there. It’s a great feeling.” Goodson, the brother of Carolina Panthers running back Mike Goodson, hasn’t played football since his sophomore season of high school. He’s expecting to play cornerback at Baylor, according to the report. Gonzaga does not offer football. Goodson, who’s listed at 6 feet and 175 pounds, started all 35 games for Gonzaga as a junior, averaging 5.2 points and 2.6 assists to help the Zags to an 11th consecutive West Coast Conference championship. “I’m excited. A bit nervous because I haven’t played (football) in a while,” Goodson said, according to the report. “Once I go and start hitting the weights and learning their system, I’ll be all right.”

Wade’s decision changed life for Heat By MARC J. SPEARS MIAMI - As a man rode his bicycle about a mile from American Airlines Arena on Monday afternoon, he wore a T-shirt emblazoned with a familiar rallying cry from these parts: “We Want Wade.” With Dwyane Wade and the Miami Heat set to begin their second NBA Finals appearance, it’s easy to forget that a little less than a year ago the locals were nervously wondering whether Wade had already played his final game for the franchise. After Wade entered the league’s most-celebrated free-agent market, not everyone was certain he’d return to Miami. His hometown Chicago Bulls offered an attractive alternative. And the thought of Wade luring both Chris Bosh and LeBron James to Miami was just a dream for most Heat fans. “It was a little bit harrowing for everybody involved in the freeagent process [last] summer simply because we hadn’t experienced anything to that magni-

tude since I’ve been in the league,” Heat coach Erik Spoelstra said. “While you feel confident - and we feel that we have a first-class organization that’s a championship-proven organization - ... still at the end of the day, there was an element of the unknown.” While most of the attention nationally was focused on whether James would stay in Cleveland, Miami was equally nervous about losing Wade. The Heat launched the “We Want Wade” campaign almost two months before Wade officially became a free agent. Fans sent tweets, emails, voice-mail messages and uploaded videos on a Web site encouraging Wade to resign. The team also distributed bracelets, placards and stickers supporting Wade. MiamiDade County commissioners declared on June 25, 2010, that the area would be known as “Miami-Wade County” during Wade’s first week of free agency. Despite all the love, Wade still met with other teams and made a visit to Chicago to speak with Bulls officials. “I was a little nervous about it,” said Heat forward Udonis Haslem,

who also was a free agent. “I knew his decision would affect my decision. I was more so watching what he was going to do before I made my decision with what I was going to do.” Haslem wasn’t alone. Donovan Campbell, a local TV sports anchor who grew up in Miami, said Wade didn’t give many clues about his intentions. “I remember seeing him out one night and saying, ‘You want to leave this? C’mon, this is Miami. You don’t want to leave this,’ “ Campbell said. “He just smiled and didn’t say yeah or nay. The city of Miami was nervous.” To no surprise, the Bulls emerged as Miami’s biggest competition for Wade, a Chicago native who grew up as a Bulls fan. The Bulls also offered Wade the opportunity to play alongside Chicago native Derrick Rose and they had the salarycap room to sign another prominent free agent like Bosh. Wade held a second meeting with the Bulls, which made Heat fans even more nervous. “Going home is always attractive,” Wade said. “And there was the possibility of not knowing what guys were

Dwight Howard: Orlando is first choice Dwight Howard is not planning on following Shaquille O’Neal’s lead and bolting the Orlando Magic via fee agency. Or so Howard is saying a year before the he hits the open market following next season. The center is under contract with the Magic through the 2012-13 season, but can terminate the deal a year early. O’Neal, looking to take his talents to Hollywood, left the Magic for the Los Angeles Lakers after the 1995-96 season. “I’m not trying to

run behind nobody like Shaq or be behind somebody else,” Howard told the Orlando Sentinel Monday. “I want to start my own path and I want people to follow my path and not just follow somebody else’s path. I want to have my own path, and I want to start that here in Orlando. But I can’t do it alone. Not only do I need the right teammates, but I need the city behind me. That’s the only way it’s going to get done. We can change this small city that we have — this small market that we have — and we

can make it a big market.” In order to make that leap it appears the Magic would have to retool their roster to appease Howard. Following a first-round playoff ouster by the Atlanta Hawks, the Magic would have to give the All-NBA center a stronger supposting cast to make the club a bigger threat to win a championship. A deeper run in the playoffs would perhaps give Howard even more reason to stay put in Orlando. “As of right now, I’m a part of the Orlando

Magic and I plan to be here,” Howard told the newspaper. “And I want the Magic to do whatever they can to make sure that we can get our city behind us. At 38, Kidd oldest guard to start in NBA finals By JAIME ARON MIAMI - After all the assists, steals, 3-pointers and triple-doubles, Jason Kidd has an easier path to his next entry in the NBA record book. All he has to do is show up. Kidd will become the oldest guard to start a game in an NBA finals when the Dallas Mavericks face the Miami Heat on Tuesday night. While Dirk Nowitzki calls him a “fossil,” and Shawn Marion described him as being

“almost 50,” Kidd is a few months past 38. That’s two years older than Ron Harper was when he started for the Lakers in 2000. Of course, Kidd would prefer the title of oldest starting guard to win a championship. That also was set by Harper in 2000. Winning it all is among the few things Kidd hasn’t done in his 17-year career. He came close in 2002 and ‘03, reaching the finals with the New Jersey Nets, but they were swept by the Lakers then fell to the Spurs. “I thought we were going to go on a roll in Jersey and make it

three or four in a row,” Kidd said. “But, now we’re here. And hopefully we can find a way to win a championship.” If so, Kidd likely will be the one leading the way. He still starts most fast breaks and controls the halfcourt offense. Leave him open and he’ll hit a 3-pointer; he made six in the firstround opener and buried another in the final minute of overtime to win Game 4 of the conference finals. Defense is where he’s really excelled this postseason. Late in close games, coach Rick Carlisle has assigned

Kidd to cover Kobe Bryant, Kevin Durant and Russell Westbrook. Carlisle has said Kidd will be among those asked to slow LeBron James in this series. So much for taking it easy on the old man. The only concessions to age Kidd seems to have made are playing less minutes and tolerating the flecks of gray in his beard. “He’s playing at a high level, keeping up with a lot of these young guys,” said Miami’s Juwan Howard, who was drafted a few spots after Kidd in 1994-95 and is the only player older than Kidd in this series.

“Normally when you’re our age, people count you out. They say you don’t have anything left in the tank. But as you get older in this league, you get wiser.” Wisdom is a big part of Kidd’s game. After 1,267 regularseason games, and another 136 in the playoffs, he’s pretty much seen it all. He knows what risks are worth taking and when to take them. “We’re always a better basketball team when he’s our facilitator on the court, and he’s getting guys in different positions and leading the offense, and helping us in our flow

OHIO STATE STAR QB FACING SIGNIF ICA NT INQUI RY COLUMBUS, Ohio - On the same day coach Jim Tressel resigned in the wake of an NCAA investigation, The Columbus Dispatch is reporting that the NCAA and Ohio State are looking into whether star quarterback Terrelle Pryor received cars and other extra benefits. Pryor, who will be a senior this fall, has already been interviewed at least once by investigators, the paper reported. The newspaper cited unnamed sources who said this is the most significant inquiry of Pryor. The NCAA and Ohio State are also probing more than 50 car purchases by Buckeyes players, their families and friends. He and four other players have

been suspended for the first five games this fall for accepting improper benefits from a local tattoo-shop owner. Tressel knew of those benefits and did not report it to Ohio State or NCAA officials. Tressel resigned early Monday citing NCAA violations which he said had “been a distraction” for Ohio State. The newspaper’s sources say that Pryor has been connected to at least six vehicles during his time at Ohio State. A university spokesman declined to confirm any reports dealing with individual athletes. The Dispatch reported in January that Pryor had been stopped three times for traffic violations over the past three years, each time driving cars that were owned by a car sales-

man or a Columbus used-car dealership where the salesman worked. The salesman, Aaron Kniffin, told the newspaper that while working at a dealership in 2008, he allowed Pryor to drive his SUV to Pryor’s hometown of Jeannette, Pa., and show it to his mother. Pryor did not buy the vehicle. Kniffin also said he arranged for Pryor to use a 2009 Dodge while Pryor’s car was being worked on at another dealership where Kniffin worked. At least one of the dealerships has dozens of autographed jerseys hanging up inside its offices. Pryor said, at the time, that he doesn’t remember signing his jersey that hangs in the dealership. “I sign a lot of stuff for Buckeye fans - I don’t like to turn down fans,”

Sarniak was a prominent player in the recruitment of Pryor, considered the nation’s No. 1 quarterback recruit when he graduated. Ohio State has refused an Associated Press records request seeking communications between Ohio State officials, coaches, Tressel and Sarniak, citing a federal privacy law that shields students.
