N EW S BR IE F S PUBLIC ADVOCATE WANTS TO REFORM PROCESS FOR DOE SCHOOL CO-LOCATIONS The city’s public advocate wants to reform the way the Department of Education co-locates charter schools. Speaking in Downtown Manhattan Wednesday, Public Advocate Bill de Blasio said he wants to reduce future conflicts between charter and public schools over colocations. He also calls for the DOE to put easy-to-understand information online and create an independent school space evaluator, among other things. His requests comes as a court is expected to rule on the legality of 17 charter school co-locations and expansions that the DOE wants to initiate next year. “These decisions around school co-locations are done the wrong way. They’re done with no real effort to tell parents what the results will be for their kids, without objective opportunities for parents to comment and without any evidence that those comments lead anywhere,” de Blasio said. “These problems are just seeping out. I think they’ve been there already, but I think now with the charter schools coming in, it’s just now a big issue because of the space that they need,” said parent Regina Castro. In a statement, DOE officials said they always look to refine their processes and hear suggestions, and in a city where space is at a premium, they are going to continue to ensure buildings are being used effectively. LAWYERS’ SUIT AIMS TO SPEED UP PCB REMOVAL EFFORT IN PUBLIC SCHOOLS A lawsuit has been filed against the Department of Education and the School Construction Authority to expedite the removal of polychlorinated biphenyls from city schools. The suit was filed by New York Lawyers for the Public Interest (NYLPI) on behalf of the organization New York Communities for Change. The suit alleges that thousands of light fixtures across the city are leaking highly toxic PCBs in violation of federal law and endangering the health of students. Last year, several schools were found to have elevated levels of the toxic material. A DOE spokesperson said department officials believe their plan to remove PCBs from 754 school buildings is aggressive, environmentally responsible and will cause minimal disruption to classes. PCBs were once used as insulation but were banned in the 1970s.

U.S., Canada power grids ready for heatwave By SCOTT DISAVINO Power grid operators in the U.S. Northeast and Midwest and Ontario, Canada said Thursday they have enough power resources to meet expected high demand as consumers crank up their air conditioners to escape a brutal heatwave. Power usage this week has already been higher than the grids expected for this summer and set a new demand record in the Midwest but was not expected to break records in the U.S. Northeast or Ontario set in 2006 before the economic recession, the grids said. In the U.S. Midwest, the Midwest ISO said demand for power on reached 103,975 Wednesday megawatts, breaking the 12-state region’s previous record of 103,246 MW set in July 2006. Power companies across the region said they had enough electricity to meet the demand, but warned heavy usage could stress some power lines and generating facilities, which could leave some customers in the dark temporarily. The U.S. National Weather Service (NWS) issued excessive heat warnings and watches for cities from the Midwest to the East Coast with temperatures expected to top 100 degrees F in many places. The mercury in New York City, the biggest metropolitan center in the United States, was expected to reach 100 degrees F, which matches the record set on this day in 1991. The humidity meanwhile will make it feel more like 108 degrees, according to weather forecaster AccuWeather.com. Thunderstorms on Friday will break the heatwave in the Midwest, while the East Coast will have to wait until Sunday for temperatures to return to near normal levels in the upper 80s and low 90s, AccuWeather

PJM, which operates the biggest power grid in the U.S. Mid-Atlantic and Midwest, forecast electric usage would peak at 154,300 MW on Thursday, which is much higher than the 149,000 MW peak the grid forecast for this summer but still below the 158,448 MW peak record set in August 2006. New York ISO, which operates the state’s grid, forecast the peak would top 33,200 MW Thursday, which is higher than the 32,700 MW peak the grid forecast for the summer but still a little shy of the 33,939 MW peak record set in August 2006. In New England, ISO New England forecast demand this week would peak on Friday at about 27,400 MW, which is just below the grid’s 27,500 MW peak forecast for the summer and the 28,130 MW peak record set in August 2006. In Ontario, the grid operator forecast demand Thursday would top 25,900 MW, which is much higher
than the 23,500 MW peak the grid forecast for this year summer but still below the 27,005 MW peak record set in August 2006. One megawatt powers about 1,000 homes in the United States and Canada. Several utilities, including New York power company Consolidated Edison, have already asked customers to conserve power on Thursday to make it easier to keep the lights on and air conditioners humming for everyone. Some utilities and energy service companies have also activated their demand response programs, which pay customers to reduce usage during peak demand times when needed. Customers can reduce their power usage by turning up the air conditioner thermostat, turning off lights, elevators and other electrical equipment, and for those with backup generators on site, producing their own electricity.
New poll carries warning signs for Obama in 2012 By STEVE HOLLAND WASHINGTON — A poll released on Wednesday carried warning signs for President Barack Obama’s re-election chances in 2012. The Public Policy Polling survey found that for the first time since last July, Obama does not lead Republican front-runner Mitt Romney in the group’s monthly national poll on the 2012 election race. Romney has pulled into a tie with Obama at 45 percent. Obama’s overall approval rating was at 46 percent, with 48 percent of voters disapproving of him, and this is in line with other recent surveys. But independents were split against Obama 49 percent to 44 percent, and the president will need independent voters to help carry him to victory in November 2012. Independents broke solidly for Obama in his 2008 election but helped Republicans win the U.S. House of Representatives in last November’s congressional elections. Obama’s approval rating has been
in the doldrums because of the 9.2 percent U.S. jobless rate and prolonged wrangling with Congress over raising the U.S. debt ceiling. The polling organization said on its website that Obama’s position appeared worse than meets the eye. “There’s a very good chance Barack Obama would lose if he had
to stand for re-election today,” said Dean Debnam, president of Public Policy Polling. “This is his worst poll standing in a long time and he really needs the economy to start turning around.” The pollsters said if there is a silver lining for Obama it is that he trailed Romney in the same poll last July and then regained the lead for each of the next 11 months. Most political analysts believe Obama will be in a strong position for re-election given the relatively weak Republican field, a huge financial advantage in campaign contributions and the potential for an economic recovery. An NBC News-Wall Street Journal poll released this week found that Obama led Romney 48 percent to 41 percent but when judged against a generic Republican presidential candidate the margin was tighter at 42 percent to 39 percent. Separately, the Gallup polling organization’s three-day rolling average of its daily poll put Obama’s job approval at 42 percent with 48 percent disapproving.

Operation Backpack gives school supplies to children It’s Christmas in July as youngsters in the city’s shelters are set to receive free backpacks filled with school supplies thanks to the agency that sends out Santas during the holiday season. Operation Backpack hopes to distribute the grade-specific supplies this year to more than 9,000 children, 2,000 more than in 2010. “Through this campaign, children living in homeless shelters are able to begin school with confidence, just like other children who live in regular homes,” said Rachel Weinstein, vice president of Operation Backpack. The operation itself is being conducted by Volunteers of America, one of the nation’s oldest and largest service organizations. The organization also sends out Sidewalk Santas at Christmastime as another seasonal drive. For the past four weeks, Operation Backpack has solicited donations for this project, Weinstein said, with support from more than 70 companies and community groups. The public has been asked to drop off the supplies — pencils, crayons, paper, etc — at Duane Reade stores. The donations will be picked up and sorted on Sunday and later the backpacks will be filled and readied for distribution. “We are expanding our program this year to insure that no child who needs a backpack will be left out,” Weinstein said. “Operation Backpack works because it gives everyone in the community the opportunity to help these children in need.”
House ethics panel brings in outside counsel for Waters case WASHINGTON — The House ethics committee announced Wednesday it has hired a prominent Washington attorney to review and help complete its investigation of Rep. Maxine Waters, D-California. The panel — comprised of an equal number of Democrats and Republicans — voted unanimously to bring in Billy Martin, a partner in the firm of Dorsey & Whitney. Martin represented former White House intern Monica Lewinsky, NFL quarterback Michael Vick and the parents of murdered Washington intern Chandra Levy, among others. Waters has been accused of seeking federal assistance in 2008 for OneUnited Bank, a minority-owned bank in which her husband held a financial interest. The bank ultimately received $12 million in bailout
funds. Waters, an 11-term Los Angeles congresswoman, has vehemently denied any wrongdoing. She has repeatedly demanded a conclusion to the committee’s roughly two-year
investigation. Waters insists the panel — officially known as the House Committee on Standards and Official Conduct — has mishandled her case. “Serious allegations have been made about the committee’s own conduct in this matter,” Reps. Jo Bonner, R-Alabama, and Linda Sanchez, D-California, said in a written statement. “The committee has not taken these allegations lightly. ... The entire committee has therefore directed that a thorough review of all of these serious allegations will be the very first task of the outside counsel’s engagement.” Bonner is the chairman of the committee; Sanchez is its top Democrat. Waters responded to the develop-
ment by releasing a statement arguing that the decision to hire Martin is a vindication of her position. “Today’s action is a recognition by the committee that its investigation of me was misguided, flawed and could go no further,” Waters said. “Given what’s already in the public domain, it’s hard to imagine that a deeper review into the committee’s conduct would do anything but reveal more troubling information. “In the name of transparency, the counsel’s findings should be made public,” she argued. In a speech on the House floor last December, Waters noted that two of the committee’s attorneys leading the case against her had been accused of misconduct. She also railed against the secrecy surrounding the committee’s proceedings.
Homeland Security warns of potential threats against utilities By SUSAN CANDIOTTI A bulletin the Department of Homeland Security sent to local law enforcement officials this week warns of possible threats to private utility facilities in the United States. Officials said, however, that there is no intelligence suggesting a specific threat. The bulletin, obtained by CNN, says disgruntled current and for-
mer employees have in the recent past been able to use their insider knowledge to disrupt operations at water, gas and waste facilities. It also notes that if “violent extremists” were able to “gain access to an insider or acquire an insider position, this increases the likelihood of success and impact of an attack.” The bulletin did not talk about a current threat to these sensitive facilities. But the document did
detail a case in 2010 when a U.S. citizen was arrested in Yemen during a round-up of suspected al Qaeda members. The person had worked “for several contractors performing non-sensitive maintenance at five different U.S. nuclear power plants from 2002 to 2008,” the bulletin said. “While DHS has no specific, credible intelligence of an imminent threat posed to the private-sector utilities, several recent incidents
highlight the ongoing threat to infrastructure in the utility sectors from insiders and outsiders seeking facility-specific information that might be exploited in an attack,” DHS spokesman Matthew Chandler said. The department will work closely with state and local officials including utility companies “to take steps to best protect from potential threats, including protecting our nation’s infrastructure,” he said.

When he was examined, we were informed that his intelligence bordered on genius. The problem was that whatever the teacher taught, his mind would quickly grasp the information. Thus, whenever he was bored, he looked for other things to set his mind on. I had an interesting experience with our son. The teacher constantly complained that he didn’t pay attention and played with his own toys. One day, I made an unexpected visit to the school. His classroom door was open. I saw him seated in the front row. Indeed, he was playing with his own games. The teacher put the alphabet on the blackboard. She inquired the class, “What kind of word is this?” Most of the class shouted, “It’s a B-word.” My son looked up from his games, and he said, “No, that’s a D-word,” and he went black to playing. the principal, and the insistence that Leah be tested. Her reading score was at a third grade level. Then, they wanted to skip her to the third grade. We rejected their suggestion. However, we accepted her acceleration to the second grade. Among her many achievements, Leah later became the Chief of Staff for the Democratic National Committee (DNC) and the CEO of the 2008 National Democratic Convention. Likewise, our other children, Sharon, Dawn, and Herbert, Jr., had problems with the school system. In addition to being a professional artist, Sharon is now the administrator for our non-sectarian nonprofit organizations. Dawn is a principal as well as a pastor. Herbert, Jr. is an attorney and a principal. Of course, all of them are college graduates. Leah and Sharon graduated from Dartmouth; Dawn, from Syracuse; and Herbert, Jr., from University of Chicago and Georgetown Law School. I learned from my experience with my baby brother that we should not trust school evaluations of our children’s behaviors and intellect. A teacher once said that my baby brother’s behavior suggested that his intelligence was at a

Who is Michele Bachmann and what is she saying now? By LINDA TARRANT-REID As you probably have read in press accounts and seen on TV, Michele Bachmann, the Republican Congressional Representative from Minnesota, has declared that she is running for president. Michele has stumbled several times out of the gate, on her road to the White House, but don’t tell her that. Bachmann’s “American Girl” dazzling looks and her status as the “darling of the Tea Party Movement” seems to be keeping her in good stead with her vocal constituency, and may be adding to her “teflonness,” similar to the Ronald Reagan phenomena. You remember the “Gipper”? The more he stumbled and bumbled; the more they loved him. All he had to do was hang his head sheepishly, give an aww shucks face and America forgave his missteps. Bachmann, who announced her candidacy in Iowa at the end of June, according to Florida’s St. Petersburg Times’ fact-checking Web site, politifact.com, has not gotten it right at least 19 times in recent statements. The Congresswoman’s inaccuracy quotient includes a statement about how many barrels of oil President Obama released from oil reserves. Bachmann claimed the President released all of the oil reserve to abate escalating prices at the pump, when in reality the President approved a release of a mere
4% of the oil in storage. Bachmann also got it wrong when she told conservative Iowan conference attendees that Obama’s administration had only issued one drilling permit since he came into office. The fact is that before the Gulf oil spill, the Obama Administration had issued 217 drilling permits, after the spill and with new regulations in place; the Administration announced that they had granted more than 35 shallow-water permits, and since the moratorium on issuing deepwater well permits was lifted in October, 2010, seven have been approved. For me, Michele Bachmann’s most egregious gaffe was when she signed the The Marriage Vow: A Declaration of Dependence upon Marriage and Family to get the support of Bob Vander Plaat’s group, THE FAMILY LEADER, their spelling not mine. Did she read the preamble? Her people say that she only signed the “candidate vow” page, so does that mean she didn’t read the whole document? That’s a problem. But the bigger problem is surely the words on the first page of the marriage pact; that were subsequently deleted when the blogosphere went wild, which stated:

In order to slam the first Black President of the United States of America, this conservative Christian organization took slavery, the vilest institution that was ever propagated in the USA, and twisted the facts to make slavery a family-friendly experience for enslaved Africans. Not so for Black Americans who are still struggling against the residual effects of slavery four hundred years later. Anyone with just a little bit of knowledge about slavery knows that the families of the enslaved were deliberately wrenched apart by slaveholders to erode family support and destroy the kinship networks that made Black people strong. It was essential to the success of the British Mercantile Empire that slave families – men, women and children – be separated and distributed to far flung plantations throughout the colonies, in order to serve as the backbone of their well-developed economic system. Enslaved women were repeatedly raped and impregnated by the white slave owners creating a bastardized family unit, into which more enslaved children were born. I don’t think Bachmann’s team did their homework or, maybe, it just doesn’t matter to her campaign what African American voters think of her and her views. Michele Bachmann’s fast and loose interpretation of facts, including her January gaffe in which she stated that the Founding Fathers “…worked tirelessly until slavery was no more in the United States” speaks volumes about her study habits and her knowledge base. This of course is a ridiculous statement since George Washington and Thomas Jefferson had slaves and were dead by the time slavery ended in 1865, more than 75 years after the U.S. Constitution (1787) was adopted in which slaves were counted as 3/5ths of a person. That said, if she’s getting basic American history wrong, how will she, if elected, get the Briefing Books right – the debt ceiling, immigration, the economy, the crisis in the Middle East, and China’s stranglehold on American debt. Atlantis has landed, ending NASA’s shuttle era By IRENE KLOTZ CAPE CANAVERAL, Florida — The space shuttle Atlantis glided home through a clear moonlit sky on Thursday to complete a 13-day cargo run to the International Space Station and a 30-year odyssey for NASA’s shuttle program. Commander Chris Ferguson gently steered the 100tonne spaceship high overhead, then nose-dived toward the swamp-surrounded landing strip at the Kennedy Space Center, a few miles (kilometers) from where Atlantis will go on display as a museum piece. Double sonic booms shattered the predawn silence around the space center, the last time residents will hear the distinctive sound of a shuttle coming home. Ferguson eased Atlantis onto the runway at 5:57 a.m. EDT, ending a 5.2 millionmile (8.4 million-km) journey and closing a key chapter in human space flight history. “Mission complete, Houston,” Ferguson radioed to Mission Control. Astronaut Barry Wilmore from Mission Control answered back, “We’ll take this opportunity to congratulate you Atlantis, as well as the thousands of passionate individuals across this great space-faring nation who truly

The last accident investigation board recommended the shuttles be retired after construction was finished on the space station, a $100 billion project of 16 nations. That milestone was reached this year, leaving the orbiting research station as the shuttle program’s crowning legacy. Details of a follow-on pro-
gram are still pending, but the objective is to build new spaceships that can travel beyond the station’s 250-mile (400-km) orbit and send astronauts to the moon, asteroids and other destinations in deep space. The final shuttle crew included just four astronauts — Ferguson, pilot Doug Hurley, flight engineer Rex Walheim and mission specialist Sandy Magnus — rather than the typical six or seven astronauts, a precaution in case Atlantis was too damaged to safely attempt the return to Earth. With no more shuttles available for a rescue, NASA’s backup plan was to rely on the smaller Russian Soyuz capsules.
For-profit colleges sue Dept. of Education over new rule By GOPAKUMAR WARRIER An association of for-profit colleges in the United States has sued the Department of Education to block the implementation of a controversial rule, saying the rulemaking process was flawed and the agency was overreaching in its capacity to frame such rules. The Association of Private Sector Colleges and Universities (APSCU), representing more than 1,650 colleges, filed a lawsuit in the federal District Court in Washington DC seeking to block the department’s final ‘gainful employment’ regulations. In June, the department finalized the rule which threatens to cut off federal aid — a key source of rev-
enue — to colleges if they do not meet certain student debt criteria. The final version of the rule is a much softer one than the draft published earlier as the industry fought back the strict rules through lobbying. The rule is part of a larger package of regulations framed by the Obama administration to reduce student debt at for-profit colleges and make them more accountable for the taxpayers money they get to fund student loans. “By issuing the gainful employment regulations, the Department of Education has clearly exceeded its statutory authority,” APSCU’s interim CEO Brian Moran said in a statement on Wednesday. The department could not
be immediately reached for a comment. The group had sued the department in January over a different set of rules, and had won one claim while losing two. APSCU members include Career Education Corp, Corinthian Colleges, DeVry Inc, Education Management Corp, ITT Educational Services and Lincoln Educational Services. Sector leader Apollo Group is not a part of APSCU. The colleges, accused of having high student default rates, had made changes to their admissions policies as they braced for a more stringent set of rules, leading to sharp declines in enrollment numbers. They had also cut jobs and scaled back on expansion plans.
At Cape Canaveral, 2,000 workers, journalists and VIPs waited by the runway to cheer the shuttle landing and greet the “final four” astronauts as they emerged from their ship. “The things that you’ve done will set us up for exploration of the future,” NASA Administrator Charles Bolden told them. Ferguson thanked the thousands of workers involved in the program over the years and said he hoped “this fantastic vehicle” would inspire a new generation of space explorers. “Although we got to take the ride, we sure hope that everybody who has ever worked or touched or looked at or envied or admired a space shuttle was able to take just a little part of the journey with us,” Ferguson said. Thousands more employees gathered with their families to watch the landing on a giant television at the Johnson Space Center in Houston, home of Mission Control and NASA’s main astronaut training facility. As the shuttle touched down, a cheer arose through the crowd that gathered outside the center’s head-
quarters building. But now that Atlantis is home, 3,200 of the shuttle program’s 5,500 contract workers will lose their jobs on Friday. Within about a month, the contract workforce that totaled about 16,000 five years ago will tail off to about 1,000 who will oversee the transfer of Atlantis and sister ships Discovery and Endeavour to museums. The shuttles’ retirement opens the door for a new commercial space transportation industry, with NASA relying on U.S. firms to deliver cargo to the station starting next year and to fly its astronauts there by about 2015. Until space taxis are available, Russia will take on the job of flying crews to the station, at a cost of more than $50 million per person. The primary goal of Atlantis’ flight was to deliver a year’s worth of supplies to the station in case NASA’s newly hired cargo suppliers, Space Exploration Technologies and Orbital Sciences Corp, encounter delays preparing their new vehicles for flight.
Only seven Atlanta educators quit amid cheating scandal By DAVID BEASLEY ATLANTA — Just seven of 178 Atlanta educators implicated in a standardized test cheating scandal resigned or retired on Wednesday to avoid being fired, a school spokesman said. The remaining teachers and principals will now face termination proceedings, Atlanta Public Schools spokesman Keith Bromery said. Atlanta’s interim school superintendent Erroll B. Davis Jr. had told the educators accused of cheating they had until Wednesday evening to voluntarily step down or they would be fired. But the Georgia Association of Educators, a teacher advocacy group, advised its members not to resign, saying the school system was taking action before all the evidence has been uncovered. A state report issued this month identified 178 teachers and principals accused of cheating on state standard-
ized testing in 2009 as a way to inflate student scores. Prosecutors in three Atlanta-area counties are weighing whether to file criminal charges. The school system’s actions against the educators are unrelated to any criminal proceedings, Bromery said. Bromery would not comment on whether the number of educators who accepted the superintendent’s offer to leave voluntarily was more or less than expected. “All the superintendent wanted to do was give people the opportunity to resign or retire without having some sort of termination notice on their record,” Bromery said. Termination notices to the remaining educators will include detailed information about their alleged involvement in the cheating scandal, the spokesman said. Educators are entitled to hearings to challenge their firings, Bromery added. He had no time frame for the firing process. “It’s going to take a while,” he said.

Israel torn on apologizing to Turks over Gaza ship By DAN WILLIAMS JERUSALEM - Israel is debating whether to say sorry for storming a Gaza-bound Turkish activist ship last year, after its jurists recommended satisfying Ankara’s demand for an apology to help fend off war-crimes lawsuits. Minister Prime Benjamin Netanyahu has so far voiced only “regret” for the navy’s killing of nine proTurks Palestinian aboard the Mavi Marmara, but Israeli officials say support for a stronger show of contrition is spreading in his government. Spurring the debate has been the imminent publication of a U.N. report on the seizure, which Israel predicts will mostly vindicate its Gaza blockade strategy while infuriating the
Turks, who have said they would reject any such finding. Hoping to avoid deepening the crisis, the former allies have been discussing a reconciliation deal, with Turkey insisting it include an Israeli apology. The exact phrasing of an Israeli apology, should one be forthcoming, would have to be in “language that both sides can live with,” a senior Turkish official told Reuters in Ankara. Turkish Prime Tayyip Minister Erdogan has demanded Israel also compensate Mavi Marmara survivors and end Gaza’s blockade. Yaalon said Israel was willing to pay into a “humanitarian fund” for those bereaved or hurt aboard the ship. But Israel, having eased land crossings into Gaza, has signaled no change to a sea closure it says stems gun-running by Hamas militants. Officials from both sides have been involved in the preparation of the
Palmer report and are familiar with its contents. Yaalon, Israel’s senior envoy in the talks, said the Palmer report “actually supports the Israeli position regarding the legitimacy, the legality of the naval blockade and, as a result of it, the legality, the legitimacy of the interception.” The report would also “criticize the use of force by us,” he said, but added this would not be tantamount to questioning the case-by-case conduct of marines who inflicted casualties. Turkish officials have declined to comment on the specific content of the report. Yaalon, a former chief of Israel’s armed forces who in 2006 narrowly avoided an attempt by proPalestinian activists to have him arrested while
on a visit to New Zealand, played down the importance of any Turkish help in averting legal actions. Indemnification by Ankara, he said, would not be relevant in other countries where such lawsuits “annoying” can be pursued. China’s most wanted man fights to stay in Canada By GREG JOYCE VANCOUVER, British Columbia - A lawyer for China’s most wanted fugitive told a Canadian court on Thursday he did not trust Beijing’s assurances that his client would not be executed or tortured if extradited from Canada. Lawyer David Matas is trying to block the deportation of Lai Changxing, accused by Beijing of running a multibillion-dollar smuggling operation in China in the 1990s. China has assured Canada in a diplomatic note that it would not put Lai to death or torture him, and that Canadian officials would have access to him. “The Chinese government says it is assuring safeguards,” Federal Court Justice Michel Shore told Matas during an Ottawa court hearing that was relayed by teleconference to British Columbia, where Lai is in detention.
Shore said these were “extraordinary” assurances from China, and he asked if the high profile of this case would not guarantee Lai’s safety. “These are not adequate assurances. They don’t amount to anything,” Matas replied. Lai fled to Canada with his family in 1999 and claimed refugee status, saying the allegations against him were politically motivated. Canada rejected his refugee claim, and he was taken into cus-
tody and nearly deported two weeks ago. His deportation date is tentatively set for July 25, but that could be pushed back by months if he succeeds in his legal challenges. China says Lai bribed Chinese officials to avoid paying taxes and duties on goods ranging from fuel to cigarettes that were shipped into China’s southeastern Fujian province. Lai admitted in a 2009 interview with the Globe and Mail newspaper that he had avoided
taxes by taking advantage of loopholes in the law, but he denied bribery charges. He said if he were not in Canada he would have been executed by now. Matas said that Lai’s brother and his accountant had both died in prison of unexplained causes and that the same fate could await Lai. “He too could die in prison without an autopsy and without any explanation. The assurances do not provide for an autopsy, or
even a viewing of the corpse,” Matas said in a written submission. “The notion that criminal procedures or the death penalty are easily verifiable is misplaced. The death penalty and criminal procedure assurances suffer from the problem that the courts in China are not public.” Matas said China has only assured that when the court holds open hearings into his case, Canadian officials may attend. He quoted the U.S. State Department
as saying that Chinese courts use state-secret provisions to keep politically sensitive proceedings closed to the public, to counsel and to foreign observers. Mexico seizes over 800 tonnes of meth chemicals By ELINOR COMLAY & DAVE GRAHAM MEXICO CITY - The Mexican army has seized just under 840 tonnes of chemicals used for making methamphetamine in a raid in central Mexico, one of the biggest finds of its kind ever made in the country. The seizure took place in a warehouse in
an industrial area in Queretaro, about 125 miles north of Mexico City, the Defense Ministry said in a statement late Wednesday. According to local media and a leading analyst, it was the largest seizure of meth chemicals since President Felipe Calderon launched an army-led crackdown on Mexico’s drug cartels shortly after taking
office at the end of 2006. “This is the biggest seizure there’s been of precursor chemicals (in Mexico),” said Alberto Islas, a security expert at consultancy Risk Evaluation. It may even be the biggest seizure ever made worldwide, Islas added. The seizure, which the army made Monday, included 787 tonnes of phenylacetamide and
52.5 tonnes of tartaric acid, all in 25 kilogram (55 pound) packets. Both chemicals can be used in the manufacture of meth, a stimulant that is smuggled across the U.S. border and sold in crystal or powder form. Government photos of the warehouse showed chemicals piled high in hundreds of white sacks, long rows of 200-liter (53-gallon)

Fresh trials for Tunisa’s ousted Ben Ali A Tunisian court on Thursday opened two more trials of ousted president Zine El Abidine Ben Ali, now living in exile in Saudi Arabia, accusing him of corruption and property fraud. The defendants’ courtappointed lawyers immediately requested an adjournment. Ben Ali’s daughter Nesrine and son-in-law Sakher el-Materi are also charged in the first case. The former ruler is accused of having personally intervened to enable his daughter and her husband to buy two plots of land — at well below the going rate — in an upscale district of the Tunisian capital. Al Qaeda-inspired insurgents in Somalia on Thursday abducted and detained a newly appointed woman minister while she was on her way to take up office, officials and witnesses told AFP. Asha Osman Aqiil was named women and family affairs minister on Wednesday. Direct rule was imposed on the TCI almost two years ago in August 2009. One
year earlier, current Governor Gordon Wetherell arrived and began immediately to introduce restraints on the then elected government of the Progressive National Party (PNP). REDJet approved to fly into Jamaica By LATONYA LINTON KINGSTON, Jamaica — Approval has been granted by the Jamaica Civil Aviation Authority for Airone Ventures Limited, which trades as REDjet, to commence operations in the Jamaican market. This was disclosed by Minister of Transport and Works, Michael Henry, at the sitting of the House of Representatives on Tuesday. Henry said that for some time now REDjet has been signalling its interest in providing air services between Jamaica and other countries in the Caribbean. “Within the context of an Open Skies aviation policy, their interest was welcomed as an opportunity for expanded air services for the benefit of the travelling public generally, and the Caribbean region,” the transport minister said. He pointed out that the formal application from REDjet was submitted in March 2010 to the Jamaica Civil Aviation Authority to provide services for a one-year period.

However, following a visit to London last week by a Turks and Caicos Islands delegation, good progress is now being made on the new Turks and Caicos Islands constitution.” In a follow up question, Reynolds asked, “...what recent assessment he (Bellingham) has made of the likely timetable for the restoration of self-government to the Turks and Caicos Islands.” Bellingham replied, “It remains our intention to hold elections in 2012 subject to progress against the milestones.” In fact, elections were originally promised for mid2011 but, in December 2010, Bellingham cancelled them, allowing the Wetherell-led Interim government to con-
tinue its direct rule. Bellingham re-promised the elections for 2012 and this has been reconfirmed by him and Wetherell several times. During a press conference in the TCI last week, Bellingham paid considerable attention to the milestones; in particular, the requirement that a clear path to belongership must be established. Douglas Parnell and Clayton Greene, the leaders of TCI’s two political parties spoke to this issue on the Robert Hall radio show on Friday, expressing their concerns that in his comments Bellingham seemed to be leading away from agreements already reached on this milestone during the constitutional talks. There is some concern locally that the Foreign and Commonwealth Office (FCO) has a hidden agenda to pad the ranks of qualified voters with expatriates, thereby diluting TCIslander self rule when elections are eventually held. There has also been continuing concern expressed by local politicians and other residents that the interim government has been moving very slowly to install the reforms called for by the early-2009 Commission of Inquiry. Only since Bellingham became minister has there been real action on the reform process. Bellingham revealed that
the milestones were necessary to obtain the $260 million loan needed to pay down the debts left by the previous PNP government and to facilitate a move towards a balanced budget, which is itself a milestone. The suggested need for the massive amount of reform called for by the FCO is being viewed here as an underlying distrust of all TCI political entities and the electorate itself. This, it is said locally, has manifested itself in prolonged direct rule, unnecessary reforms and the ongoing recruitment of outsiders to head government institutions. An issue also spoken to by Bellingham, as well as both Parnell and Greene, is the amount and pricing of Crown land sold by the last PNP government. British land consultant, Jon Llewellyn, reportedly told the FCO that he estimated that between $2.5 and $5 billion was diverted from the TCI treasury during the PNP years. Both parties have weighed in on this, saying $5 billion is an exaggeration. The quality of Llewellyn’s advice, land department supervision and understanding of the quantity and qualities of TCI Crown land had long been questioned before his financial estimates were made public.
Trinidad prime minister agrees to meet trade unions next week PORT OF SPAIN, Trinidad — Prime Minister Kamla PersadBissessar on Tuesday wrote to the leadership of Trinidad and Tobago’s trade union movement, expressing her willingness to meet with them on July 26, in response to a letter sent to her on July 7, 2011. The prime minister said her agreement to meet, must be taken in the context that the meeting cannot be a replacement for the collective bargaining process between the trade unions and the employers of the workers they represent. She said also that her agreement to the meeting is notwithstanding the pre-con-
ditions and the demands set by the unions, and of the tone of the letter addressed to her. Meanwhile, Minister of Labour and Small and Micro Enterprise Development, Errol McLeod, said as labour minister there is only so much he can do to lift the five percent wage offer to the labour movement. The Trinidad Express reported that the minister said during an interview with the media on Tuesday that his ability to help is restricted to the guidelines outlined in the Industrial Relations Acts. “If matters are properly reported to the minister of labour, then in his capacity as minister of labour, and in accordance with the Industrial Relations Acts, he
must deal with them as judiciously as he can,” he said. As minister of labour, he is the chief conciliator in disputes between the labour movement and its employer and legally “does not have the responsibility to berate the demand of the union nor to promote the offers of the employer,” explained the minister. “Now even with government as employer I still hold the position of minister of labour and if it becomes necessary at all for me to intervene, then I must seem to be intervening without prejudice to any particular side in the dispute and this is why I will not berate five percent nor will I promote whatever is coming from the other side”.

Trenton city council stalls on residency rule grace period By MATT FAIR TRENTON - The city is hoping to amend its residency ordinance, which mandates that all employees live in Trenton, to allow a 90-day grace period for non-residents to move into the city after being hired, but work stalled this week over the wording of an amendment to the law. Meanwhile, the city adopted a controversial measure that requires landlords to identify their tenants to the city’s inspections department. In the past, out-oftown candidates for city employment have been required to move to Trenton beforehand, a situation that has complicated the city’s hiring process.

The exemption which would’ve allowed the city to hire out-oftown employees only after conducting an exhaustive search within the city first - was proposed at the same time the administration moved to hire David Rousseau, a Hamilton resident, as its chief financial consultant. The measure was aimed at allowing the city to hire Rousseau, who served as state treasurer under former Gov. Jon Corzine, as its finance director. He remains on Trenton’s payroll as a full-time consultant working out of City Hall after a contract renewal earlier this month. It’s unclear how his future employment may be affected without the exemption clause. “I would just let him do his work now and we’ll face that when we come to it,” Caldwell-
Wilson said. “David’s doing a great job and I would love for him to be part of the administration because he’s very smart and he really gets it, but if you make an exemption for one person then you’re going to have to make exemptions for other people and it defeats the whole residency requirement.” Administration officials did not return calls for comment yesterday. Meanwhile, council approved an ordinance that required city landlords to submit the names of their tenants to the city’s inspections department. The requirement was rolled into a larger ordinance mandating that landlords conduct annual inspections of the heating systems and chimneys in their properties and submit certifications as such to the city.
A vote on the ordinance was delayed in June after council members expressed objections that having landlords submit copies of their leases to the city could compromise tenants’ personal information, including Social Security numbers, and infringe on their privacy rights. Since then, Cleveland Thompson, acting director of inspections, has said that landlords will only be required to supply a list of their tenants’ names, not copies of their leases. Landlords came to Tuesday’s council meeting in force to voice their objections to the measure, saying it was an onerous and expensive burden for them to bear. Thompson said yesterday that the heater and chimney certification requirement is simply the codification of a long-existing policy
within the department. What’s new is the requirement to submit certification of inspections and tenants’ names, he said. Caldwell-Wilson said that, in a city where there is an abundance of rental properties, it’s important to hold tenants and landlords accountable if their dwellings become a nuisance to neighbors. “We need to start things up tidying around here because so far it’s been just everybody does whatever they want,” she said. “We have to start holding them accountable and enforcing these ordinances. We need to clean up this city.” Councilman Zach Chester and Councilwoman Phyllis Holly-Ward both voted against the ordinance. Neither could be immediately reached for comment yesterday.
N.J. seniors struggle to stay cool as hazardous heat wave continues NEWARK - Bob Dickens laid on the bed in his fifth floor studio apartment. The windows were open, the Newark air was hot. Sleep finally came at 5 a.m. A rough night for Dickens. A rough night for anyone without air conditioning. When he awoke at 9 a.m. Wednesday, the 69year-old fled to the building’s cooler “rec room,” where he spent most of the day and did a little scheming: How do I get an air conditioner? “Tell Obama we all need air conditioning,” he quipped, then thought more pragmatically: “Well, we only got a month to go.” Maybe so, but the next few days might feel like a month as New Jersey bakes under near 100-degree heat and relentless humidity. “By the time this is over, we may have some locations that will go 10 straight days of 90 or above,” said David
Robinson, the state climatologist. “That’s pretty unusual.” Today through Saturday will be the toughest, with urban areas from Newark to Trenton to Camden pressing toward 100 or above. It may feel like 115 degrees in some locations, said Carl Erickson, an AccuWeather meteorologist. It’s been hot enough already that some especially those without air conditioning - have struggled to stay healthy. In a heat wave, it’s seniors who are among the most vulnerable. Without air conditioning, they can struggle to keep their bodies cool and hydrated. “The longer the heat wave goes, the higher the risk, because of the prolonged exposure. You can convince people to rest, stay in doors, take it easy for a day or two,” but that doesn’t last, said Robert Eisenstein, the chief of emergency medicine at Robert Wood Johnson University Hospital in
New Brunswick. “As the duration of the heat wave continues, people are likely to get back to activities.” That’s not a good idea for anyone who isn’t used to these temperatures, Eisenstein and weather experts say. The human body can’t adjust to the heat in just a few days, they say. “People shouldn’t be lulled into complacency and think, ‘I can drink alcohol,’ for instance,” Robinson said. “Your body doesn’t acclimate
that well. It’s your lifestyle that acclimates.” For anyone without air conditioning, it can be hard to do that. Over repeated nights without relief, the body temperature can rise. Most people will be fine, with their bodies compensating - but seniors have to be careful. Swollen joints can quickly turn into muscle spasms and eventually heat exhaustion, characterized by dizziness, rapid heart rate,
nausea and headaches. In the most severe cases, heat stroke can occur. With that, there’s neurological involvement and the possibility of death. To keep New Jersey’s most vulnerable from facing those symptoms, municipalities, community groups and churches across the state are opening cooling centers - in libraries, houses of worship and in the lobbies of government buildings. Of course, the local pool is
always beckoning. Most of the state has been experiencing heatwave temperatures for a few days now, but things are just now turning for the worst, weather experts say. A high-pressure system that spanned the midwest, keeping moisture in and the sun blaring down, is now expanding eastward. By this afternoon, parts of the Garden State - especially urban areas - will have temperatures in the mid- to upper-90s.

Webb Park yesterday, and a 15-year-old boy and a second man were also shot, officials said. Officers responding to reports of gunfire at Van Horne and Maple streets at 12:22 a.m. found no victims, but soon learned they were at the Jersey City Medical Center and
responded there, reports said. The most seriously wounded was a 25-year-old Palisade Avenue man who was shot in the lower back with the bullet passing through a kidney and lodging in his liver, reports said, adding that he refused to cooperate. A 21-year-old Virginia Avenue man arrived at the hospital with a bullet wound to his left forearm, reports said. He told police he was at the party when a person began firing into the crowd, reports said. A 15-year-old boy was being treated for a gunshot wound to
his upper thigh and his mother told police the boy said he ran when he heard gunfire and then felt the bullet bite into his leg, reports said. The mother is being cited for allowing the teen to be out after curfew, police said. Lt. Edgar Martinez said police are continuing to enforce the 11 p.m. curfew for minors and said parents will be held responsible for children on the street after 11. “There will be no tolerance in this and we will be enforcing the curfew rigorously,” Martinez said.

Clear Channel taps Nicki Minaj to headline ‘I HeartRadio’ music fest

Now with a brand new record deal, the Atlanta native is following the same successful path as Ne-Yo and Keri Hilson transitioning from songwriter to artist. Eariler this year, Crystal Nicole won a Grammy Award for writing Rihanna’s “Only Girl (In the World)” featured on the ‘Loud’ album. After learning the business and working with award winning artists and producers, Crystal Nicole moves into the spotlight with the release of her first single “Pinch Me.” With the launch of her artist career she is using her voice to talk about the importance of having a “voice against domestic violence.” The plot between Bow Wow and the mother of his child, video model Joie Chavis, thickens as more drama is revealed to the world. According to TMZ, Joie decided to exclude Bow Wow’s name from the birth certificate of their child, Shai, since he did not show up to the hospital during the birth of their daughter after Joie had to undergo an emergency c-section back in April. In fact, it is reported that Bow Wow didn’t show up until six days after the baby was born! Joie is also stating that Bow Wow is a fake, and is acting like he’s a devoted dad from the open letter he wrote to his fans earlier this week but was absent during their daughter’s birth. Although she obvisouly seems to have ill feelings toward the rapper, it’s reported that Joie is willing to move on and let the courts name Bow Wow as baby Shai’s father,
legally, although that will be up to the discretion of the judge. American Idol alum Jordin Sparks, who is currently touring with the Backstreet Boys and New Kids on the Block, says she feels “lucky” that she continues to find success in her career. The 21year-old tells Parade, “”I just feel lucky that five years later I’m still touring and people still want to talk to me. For me, I just keep going and say yes to things that I think are going to be really important.” Sparks also says having a good foundation and picking the right songs has helped her longevity. “I don’t want to get bogged down saying yes to things just because I can,” she says. “I want it to mean something. Trying to keep your head on straight and having a good foundation and base back at home and around you is key.” Five classic albums created by Tupac Shakur are being rereleased digitally for the first time ever, representatives for the late rapper’s family confirmed. Tupac’s first three solo albums are being made available digitally for sale on iTunes for the first time. The albums that are being re-released include 2Pacalypse Now, which produced the singles “Brenda’s Got A Baby” and “Trapped.” His second album, Strictly For My N.I.G.G.A.Z., will also be digitally rereleased. That album produced the singles “Holler If You Hear Me” and one of Tupac’s best-known songs, “I Get Around.” Other albums hitting the Internet for the first time include Thug Life - Volume 1, Me Against The World and R U Still Down?. ly been certified Diamond by the RIAA, having sold over 10 million copies since its original release on November 24, 1998. Michelle Williams is making a musical comeback with her new song “Love Gun.” Much like her Destiny’s Child counterpart Kelly Rowland, Michelle has gone the techno-pop route on this tune. It’s been three years since her last solo album was released and “Love Gun” is quite different from it’s preceding material. With heavy synths and Casio keyboard-striking, the upbeat record is for the lucky in love. “My album will be ‘inspirational pop.’ Think of Katy Perry’s ‘Firework’ or Natasha Bedingfeld’s ‘Unwritten.’ I want to give people a message of hope while at the same time get them moving with dance inspired tracks.” Andre 3000 was originally tapped to play Jimi Hendrix in a biopic last year, but it’s been silent on the news front since. But according to actress Hayley Atwell, the Outkast member is still slated to be in the flick. Speaking with Esquire, the Captain America star explained that Three Stacks is signed on to appear as Hendrix in the independent flick. “Next up is possibly a Jimi Hendrix biopic — an independent film with Andre 3000 from OutKast playing Jimi Hendrix. But I don’t know, really. The Atwell team is like, Let’s just wait and see,” she said. Andre previously appeared in the 2008 flick Semi-Pro, though has relatively quiet since then. He is supposedly working on a solo album to be released this year in anticipation of an Outkast LP to drop in 2012.

It’s the first announcement ever to roadblock all Clear Channel Radio platforms and the teasers and the announcement have reached an estimated 100 million people.” The IHeartRadio Festival will take place at the MGM Grand in Las Vegas from September 23rd-24th.
Rapper Nicki Minaj will be one of a number of celebrities who are slated to perform during Clear Channel Radio’s “IHeartRadio Music Festival.” Hollywood A–Lister Ryan Seacrest is hosting the two-day festival, which also include performances by Bruno Mars, The Black Eyed Peas, Jennifer Lopez, Alicia Keys, Lady Gaga, Kelly Clarkson, Sublime, John Mayer, Usher and Sting. The artists will appear on stage at the MGM Grand in Las Vegas this September, where the festival will also serve to launch clear channels IHeartRadio digital product. The mega Eastern Baptist Association of New York, Inc. held its 90th Session Celebration July 8-15. It was held at the Union Baptist Church, Hempstead. Rev. Alvin Barnett, pastor at West B.C., was the moderator and Rev. Jeffrey Thompson, pastor at the Amity Baptist Church, Jamaica, the recording secretary. He is a newcomer. Rev. Sedgwick Easley, pastor at Union Baptist, was a gracious host. There were far too many activities during the Session to do justice to each one in this column’s allotted space. However, here’s a small list of the events. The Ushers Auxiliary met July 10; the Women’s Department, Sister Rosalyn Johnson, president, met July 13. And then there was the
Layman’s Auxiliary. I attended in the afternoon on July 14. Rev. Calvin Rice, pastor at the New Jerusalem Baptist Church, Jamaica, was the main preacher. His sermon came from Deuteronomy 31:1-8. His topic: “The Courage Within You.” By example, reference was made to “The Wizard of a Real New Version of the Oz.” At 7 p.m., it was the Moderator Hour. I should have remained At the church. But being that I am so brainy (smile), oh, no, I went shopping. He is what took place. I lost my way back to UBC. But worst of all, when I did get back to the church, guess what! No parking space for blocks and the street was blocked off. No better for me. Final-
ly, I was very happy to be inside the church, the spirit was already in high gear. The Moderator Barnett was introduced by his brother, Rev. Ernest Barnett, pastor at the Friendship Baptist Church, Springfield Gardens. When Moderator Barnett stood, he was received with a standing ovation. After he made formal remarks, he went into a message, one with many directions. He is indeed an attention keeper. Following the service, an informal, no program social buffet banquet was held in the Church Fellowship Hall. Glad I attended the EBA Session. I even forgive myself for such a bad decision.

Bed sores afflict more Blacks in nursing homes than whites Among nursing home residents at high risk for bed sores, Black patients are more likely than whites to develop the potentially serious condition. Bed sores, also called pressure sores or pressure ulcers, greatly increase a patient’s cost of care and the risk of illness and death. They can almost always be prevented through proper care, such as helping a patient change position every few hours. For this study, researchers analyzed 2003 to 2008 data on bed sore rates in 2.1 million white residents
and 346,808 Black residents of 12,473 certified nursing homes in the United States. The patients included in the study were at high risk for bed sores. Overall rates of bed sores decreased over the years, but Black patients had consistently higher rates than white patients. The rate among white residents decreased from 11.4 percent in 2003 to 9.6 percent in 2008, while the rate among Black residents decreased from 16.8 percent to 14.6 percent. The highest rate of bed sores in 2008 (15.5 percent) occurred among
Black residents in nursing homes with the highest concentrations of Black residents. The lowest rate (8.8 percent) was among white residents in nursing homes with the lowest concentrations of Black residents. The researchers also found that residents of both races in nursing homes with the highest concentrations of Black residents were at least 30 percent more likely to develop bed sores than residents in nursing homes with few or no Black residents. The study appears in the July 13 issue of the Journal of the American
Medical Association. Nursing homes with higher concentrations of Black residents tend to have lower staffing levels of registered nurses and certified nurse assistants and to be larger for-profit and urban facilities, noted Yue Li of the University of Iowa, Iowa City, and colleagues in a journal news release. Because differences in mattresses and disposable briefs can influence bed sore rates, the authors of an accompanying journal editorial said more research is needed to explain disparities and correct them.
Doctor’s group: Offer women mammograms from age 40 By GENEVRA PITTMAN Doctors should offer all women in their 40s the chance to get annual screenings for breast cancer, according to new guidelines from an organization of women’s health professionals. The recommendations from the American College of Obstetricians and Gynecologists (ACOG) will add to the debate over when screening should start, and how often it should be done, based on the chances of catching an early cancer and the risks inherent in any screening. “We believe it is our job to help women make the best health decision for themselves,” said Dr. Jennifer Griffin of the University of Nebraska Medical Center in Omaha, one of the authors of the new recommendations. “We believe that many women will choose to have a screening mammogram every year, (and) of course there are women that will choose not to.” Other organizations such as the American Cancer Society and the National Comprehensive Cancer Network recommend that women start
getting the breast scans at age 40. But the U.S. Preventive Services Task Force, a federally -supported expert panel, said in 2009 that screening before 50 should be an individual decision because the benefit is very small compared with the risks. Even at age 50, it only recommended screening every other year. Any screening decision is about balancing the benefits and harms of a test, said Dr. Michael LeFevre of the USPSTF. One in eight women will get breast cancer during her life, experts agree. For every 1,000 women who are 40 years old, LeFevre said, 30 would be expected to die of breast cancer if they never have a mammogram. If those 1,000 women are screened every other year between age 50 and 75, that number drops to 23 deaths. Starting screening in the same group at 40 would save one additional life, meaning 22 would die of breast cancer, on average. But, LeFevre told Reuters Health, “that small benefit comes with a significant false positive rate, which results in additional testing, including unnecessary biopsies and associated pain and anxiety.” Half of women screened annually
in their 40s will have a false alarm on a mammogram, he said, meaning the test shows something suspicious that turns out to be harmless. Follow-up biopsies can be painful, expensive and carry a small risk of infections or other adverse effects. With his patients, LeFevre said, “my bottom line is that I will discuss mammography at age 40, I will recommend and encourage at age 50 and I will strongly encourage at age 60.” He added that screening every other year, instead of annually, gives women most of the benefit of yearly mammograms, but significantly cuts back on the risk of harm. The new guidelines only apply to women who are at average risk of breast cancer — not those with a gene that predisposes them to the disease, for example. ACOG recommends that doctors perform regular breast exams on women and says that women should know what their breasts normally look and feel like. “As with any screening test, there are cancers that are missed by screening,” Griffin said. “Women should be aware that if something changes in their breast, even if
they’ve had a normal screening mammogram, they should let their doctors know.” LeFevre said there isn’t clear evidence that “breast awareness” can prevent breast cancer deaths, but that he would not discourage it. The ACOG group did not analyze the cost of screening women for an extra decade, but Griffin said that mammograms compare favorably to other screening tests, such as Pap smears and colonoscopies, in their cost effectiveness. Mammograms typically cost about $100, but in most cases are covered by insurance. Groups including the American College of Radiology, the Society of Breast Imaging and Susan G. Komen for the Cure came out in support of the new ACOG guidelines. “When we think about women in their 40s we think about moms, we think about women who are active in the workforce,” Griffin said. “I think they deserve the opportunity to really benefit from this test.” LeFevre concluded that women in their 40s should discuss the possible benefits and harms of mammography screening with their own doctors, and make a personal decision about when to start getting screened.

John Legend denies stealing song A few weeks ago, news reports surfaced regarding a lawsuit against Grammy-winning crooner John Legendfor allegedly stealing a song. In the copyright-infringement lawsuit, New Jersey singer-songwriter Anthony Stokes claims that he gave Legend his demo tape in 2004, although never hearing back from him. Two years after, Stokes realized that his song “Where Are You Now?” was ripped off in Legend’s song “Maxine’s Interlude” off of the ‘Once Again’ album. Stokes is suing for unspecified damages and is attempting to prevent the sale of the track. Once news broke out, Legend took to his Twitter to address the situation right away to his fans. Jobless claims rise above expectations WASHINGTON — The number of Americans filing new claims for unemployment benefits rose more than expected last week, pointing to a labor market that is struggling to regain momentum. Initial claims for state unemployment benefits increased 10,000 to a seasonally adjusted 418,000, the Labor Department said on Thursday. Economists polled by Reuters had forecast claims rising to 410,000 from a previously reported 405,000. “We’re just stuck in this trend between 410,000 and 430,000. Acer to buy cloud computing firm iGware for $320 million By CLARE JIM and ARGIN CHANG TAIPEI — Taiwan’s Acer Inc will buy U.S.based cloud computing firm iGware Inc for $320 million, the fifthlargest ever Taiwanese buyout of a U.S. company, as it seeks to move beyond its core hardware manufacturing business. The world’s No.2 PC maker said it was also in initial talks with Japanese game firm Nintendo, a major client of iGware, over potential cooperation after the deal, but did not give details. Acer has been refocusing on mobile devices to drive future growth after a troubled first half that saw the acrimonious departure of its chief executive after a row over the company’s strategy and a series of cuts to its shipment forecasts. The company has been a dominant force in the PC business, particularly in the low-cost notebook segment, but has failed to counter the
runaway success of tablets such as Apple’s hot-selling iPad, that have cut into PC sales and hurt profits. “This (the acquisition) is the right direction for Acer,” said Tracy Tsai, an analyst at IT research company Gartner. “Companies can no longer rely only on hardware; they have to bring new values to customers through providing applications and software services, and by that to increase their margin.” Acer has opened a new global R&D center in Chongqing, China, on Monday to enhance development of smartphones and tablet PCs. Acer will also make a further $75 million performance-based payout to iGware as part of the deal. The total $395 million makes the deal the largest Taiwanese buyout of a U.S. company this year, according to Thomson Reuters data. The largest such deal on record was Acer’s purchase of U.S. PC maker Gateway Inc for $761.5 million in 2007.
At a separate media briefing, Chairman J.T. Wang said the company will report a loss in the second quarter before returning to profit in the third and post a small full-year profit. “Acer was in ICU (intensive care unit) but it has been discharged now. It will be more comfortable in the fourth quarter and return back to normal next year,” said Wang. Analysts have cut their net income estimate for Acer by 13 percent over the past 30 days and now expect the company to report mean net income of T$5.33 billion for the year to December 2011, down 65 percent from a year ago. As of Wednesday’s closing price, Acer shares had fallen 56 percent so far this year in a broader market down nearly 3 percent, while Asustek has gained 6.5 percent and Quanta is up 13.4 percent. Wang said Nintendo is supportive of the deal and will pay Acer a $2030 million service fee every year after the
acquisition. Nintendo spokeswoman in Tokyo Yuka Tanegashima declined to comment on whether Nintendo was a client of iGware. She said she was not aware of any talks with Acer. Some analysts were skeptical about the synergy iGware or Nintendo would bring to Acer. “Acer is wasting its money. It’s spending almost $400 million on
a small software company,” said Vincent Chen of Yuanta Securities. “Why does it need a client like Nintendo, which doesn’t have a cloud or data center? Acer has been wanting to do online gaming and server business, but it doesn’t have a clear vision in the cloud business.” Acer said, “As a midto long-term investment objective, the valuable
core technology and capabilities will help create uniqueness for the Acer brand.” Acer will start integrating iGware into its cloud software and platform after completion of the deal by late September, and will launch an Acer Cloud product some time in 2012. The acquisition will not add to short-term profit, the company said.
Daimler to invest more than $2 billion in Alabama plant By MARIA SHEAHAN FRANKFURT — Daimler said it would invest more than $2 billion in its car plant in Tuscaloosa, Alabama, to build more M-Class SUVs. The German maker of Mercedes-Benz cars did not say over what period it would invest the money. Daimler is investing heavily in production
outside its German home market as it banks on growing demand for cars and trucks in North America and emerging markets. Last month, it said it signed a contract with Chinese joint venture partner BAIC to invest about 2 billion euros ($2.84 billion) in an engine plant in China. It also has a partnership with Russia’s Kamaz and has announced it will add
staff at its truck plants in North America and Brazil to meet growing demand. The plant in Tuscaloosa, which Daimler founded in 1995, has almost 3,000 workers and makes more than 90,000 vehicles a year. Daimler makes all of its M-, GL- and R-Class SUVs at the Tuscaloosa plant and ships them to markets around the world from there, according to its website.

Intel backs off PC market outlook, shares slide By NOEL RANDEWICH SAN FRANCISCO — Intel Corp trimmed its forecast for 2011 personal computer unit sales, warning of softness in mature markets and sending its shares down more than 1 percent even as its revenue outlook beat estimates. The top maker of microprocessors for PCs now expects 8 to 10 percent growth in unit shipments of computers this year, down from the low double-digits it had stuck to earlier in defiance of fears that market momentum was decelerating. Intel’s processors are used in 80 percent of the world’s PCs, but mobile devices from Apple Inc’s iPad to Google Inc Android smartphones are eating into laptop sales and Intel is struggling to gain a foothold
in the fast-expanding mobile market. Its Atom division, which caters to a mobile computing market, saw revenue slide 15 percent to $352 million. “The mature market consumer segment is still soft, but the emerging-market consumer segment is healthy and growing,” CEO Paul Otellini told analysts on a conference call. Intel’s tepid PC forecast and concerns about the economy overshadowed a solid quarter for the chip giant, with quarterly results and revenue forecast both trumping Wall Street’s expectations. The Santa Clara, California expects average selling prices for its chips to increase as families in China and other emerging markets that buying their first evercomputers choose fairly high-quality PCs that are built to last.

While many consumers buy e-readers with connections to cellular networks such as AT&T’s so they can download books on the run, others make do with cheaper devices that only support Wi-Fi short-range networks found in homes and cafes. This could be why Amazon announced on July 13 that AT&T would sponsor Kindles with cellular connections — reducing the price to $139 from $189, Clement said.

Nielsen gathers and analyzes sales information from a variety of U.S. chain stores, giving manufacturers, Wall Street analysts and others a glimpse at how products such as food and detergent are selling — everywhere from grocery stores such as Kroger Co to mass merchants such as Target Corp. However, Wal-Mart’s U.S. discount stores had not shared its data in more than a decade, which meant that Nielsen’s widely used metrics were missing
the country’s largest retailer in terms of revenue. Walmart and Sam’s Club stores will now report their sales information to Nielsen, and Nielsen will become Walmart’s primary provider for market information, tools and training, the companies said in a joint announcement. League MVP Derrick Rose of the Chicago Bulls, the Los Angeles Lakers’ Kobe Bryant, Kevin Durant of the Oklahoma City Thunder and New Orleans Hornets guard Chris Paul are among those who will be playing exhibition games in the Philippines this weekend, according to multiple media reports. The games benefit the MVP Sports Foundation, which helps youth sports programs. “The (foundation) over there is all about giving back and helping out kids,” Paul told the New Orleans Times-Picayune Wednesday. “That’s something I feel strongly about also. I’m going over there with a few other guys, and we’re going to play. I found out about this through D-Fish (Derek Fisher). He let me know about it.” According to reports, Fisher also will play, along with Sacramento Kings guard Tyreke Evans, Minnesota Timberwolves draftee Derrick Williams and Washington Wizards big man JaVale McGee. According to reports, Bryant will be arriving from Shanghai, where he was taking part in Nike’s Asian Tour. He kicked off that tour in the Philippines. In addition to playing the exhibitions against Philippine all-stars, the NBA players will get a tour of the country.
Jordan, Magic and Bird to cover ‘NBA 2K12’ game ATLANTA - This time, Michael Jordan won’t be the only one to cover a 2K Sports basketball video game. The game company announced on Thursday that NBA Hall of Famers Magic Johnson, Larry Bird and Jordan will be featured in three separate covers on the front of “NBA 2K12,” the latest installment of the best-selling basketball video game franchise. Last year, Jordan was the cover athlete for 2K’s NBA game, which sold more than 5 million units. Jordan also worked closely with the game’s developers for last year’s game, providing his input on details such as a player’s shot technique. For the upcoming “NBA 2K12,” which is expected to go on sale Oct. 4, the company didn’t specify how each of the three basketball legends will be incorporated into the game.
Former 49ers C Blue dies at 65 SAN FRANCISCO - Forrest Blue, a four-time Pro Bowl center who helped the San Francisco 49ers win three straight division titles in the early 1970s, has died. He was 65. The 49ers announced Tuesday that Blue died Saturday at an assisted living facility in Carmichael, Calif. No cause of death was given. Blue was selected in the first round of the 1967 draft by the 49ers, 15th overall. He played on both the football and baseball teams at Auburn after going to high school in Marfa, Texas. He didn’t miss a game for the 49ers from 196974 and finished his career with four seasons with the Baltimore Colts.

Don’t expect world record this season, says Bolt By LUKE PHILLIPS Reigning world and Olympic double sprint champion Usain Bolt has warned his legion of fans not to expect him to better his own world record for the 100 meters. Bolt stormed to Olympic gold at the 2008 Beijing Games in a world record time of 9.69 seconds and then bettered that to 9.58sec when winning the world title in Berlin a year later. Incredibly, he mirrored that feat in the 200m, also setting world records, latterly of 19.19sec in the German capital. But the 24-year-old Jamaican insisted that attaining that level would not be happening this season as he works on regaining his fluency and technique following a slowly-slowly approach to his comeback from injury. “I’m a long way off 9.58sec,” Bolt admitted ahead of the Diamond League meeting here on Friday, when he will run the 100m. “I could get to 9.6 or 9.7, I’m working on it. I’m taking my time and every day it’s coming together better.
“But 9.58 is not a joke. I’m not going to lie to myself and say that I’ll get there. It’s not going to happen this season. “I didn’t have enough time to get back in shape.” Recalling the ill-fated comeback of American rival Tyson Gay, ruled out of the next month’s world championships in Daegu, South Korea, because of a hip injury, Bolt argued that reestablishing yourself on the track was not easy. “It’s very hard to come back from injury,” he said. “You have to take your time and work your way back up.” He added: “I want to run fast and I always run as fast as pos-
sible. I’m always up to the challenge and no matter how slow I run I’m always at the front of the pack. “I’ve not got to prove to anyone that I’m still the world’s fastest man, blah blah blah. It’s always been about the world championships, never about the times. “It’s all about getting everything right. If the technique is right and I run 10sec flat, I’ll be happy.” Bolt also insisted that he never feels under pressure from fans’ expectations of him. “The only pressure I feel is from myself. I never worry about what people want. I’m doing it for myself, and for me the key is the world championships. I’ll work my way to that and if I lose I’ll feel bad.” Bolt will only have one more race before Daegu, running the 200m at Stockholm next week before further honing his technique in training. “It’s always about executing, making sure the execution is right. We work on things in training but my coach doesn’t send me out to race with specific instructions, he just sends me out there.”
Bart Scott: No 2-a-days makes NFL soft New York Jets linebacker Bart Scott was not happy when told that the league may eliminate two-a-day practices in training camp as part of a new collective bargaining agreement, according to the Newark StarLedger. “I think it’s wimping out, making football more soft,” Scott said, according to the newspaper. “No reason to try and make camp easy. “I get concerned you’re making football players weaker because you don’t push them past that threshold. ... I get concerned with the same thing with the quarterback stuff, that they turn it into flag football; they turn it into
little pansy stuff.” Scott sang a little different tune during informal workouts during the lockout. After a workout at Rutgers on Wednesday, Jets linebacker Jamaal Westerman said that Scott had been one of the most conservative players when it came to contact during the Jets workouts in New Jersey a few weeks ago. “I was talking to Bart and he was like, ‘Make sure you don’t hit anybody,’” Westerman said. “Cause like anything else, no one is under contract so you don’t want to get anybody hurt. There’s no pads, no equipment. Of course you get your reads, of course you try to get the
movement down, but at the end you always pull up and let the offense make the catch.” It’s not just the hitting that Scott says will be missing if two-a-days are eliminated. “You’re stealing reps from coaches,” Scott said, according to the Star-Ledger. “Even if you put those reps into the front of practice, what’s the quality going to be? Eventually that cuts down on the quality of the product, (when) we’re already behind. Now you’re trying to go full-speed running, when you’re absolutely dog tired, and that’s when you get pulls and stuff like that.” Scott said he might do extra work on his own if
he feels that practices without two-a-days aren’t giving him what he needs. “Two-a-days, it’s what football is all about,” he said, according to the newspaper. “It’s about endurance, pain, will, putting yourself through something when your body is telling you it doesn’t want to go. Your mind controlling your body. That’s what camp is all about. With one-a-days, guys might not be in as good of shape as they would have been. Camp tears you down, and then a smart coach starts pulling back in enough time that allows players’ bodies to build back up.”

Khan fight is Judah’s last shot at the top By KEVIN IOLE LAS VEGAS - A small crowd of about 100 onlookers has gathered in the lobby of the posh Mandalay Bay Hotel & Casino to see what the fuss is about, as photographers rush toward a limousine that sidles up to the front door. Boxer Zab Judah emerges with a group of six or seven men. There is no shouting, as there often is at these staged “arrival” ceremonies. Judah is scheduled to fight British star Amir Khan in the hotel’s events center on Saturday in a 140pound title unification bout being broadcast on HBO; promoters are desperate to drum up some interest and sell a few tickets. As boxing entrances go, this one is fairly dignified. There is no ear-splitting music. Judah isn’t adorned head to toe with bling. He smiles wanly, his son at his side, as a fan shouts “Super Judah!” As the photographers click away, Judah briefly raises his index finger before quietly ascending onto a small stage, where a gaggle of television reporters await him.
Judah is a 33-yearold man with a long, notorious history in Las Vegas. In 2001, when he was just 24, he was loud, boastful and arrogant as he entered the MGM Grand to prepare to fight Kostya Tszyu for the undisputed 140-pound championship. Judah not only was knocked out in the second round that night, but he lost his cool when the bout was stopped. He shoved his gloved fist into referee Jay Nady’s throat and, in a fit of rage, hurled a stool. For that, the Nevada Athletic Commission suspended him for six months and fined him $75,000. Five years later, he returned to Las Vegas for another massive fight. This time, he was facing Floyd Mayweather Jr., widely recognized at the time as the sport’s best pound-for-pound fighter, for a welterweight belt. Judah was doing surprisingly well in the early going, and there was a palpable sense in the arena that a massive upset was brewing. Inexplicably, though, Judah seemed to lose his composure as Mayweather increased the pressure. In the 10th round, as Mayweather trainer Roger Mayweather
entered the ring to complain about a foul, Judah’s father, Yoel who was his trainer entered the ring and fired a punch at Roger Mayweather. A wild brawl ensued, with Zab Judah gleefully getting involved. All the while, Floyd Mayweather Jr. moved to a neutral corner, calmly avoiding the brawl while waiting for order to be restored. For Zab Judah’s role in that, Nevada boxing officials smacked him with a $250,000 fine and revoked his boxing license. Judah now lives in Las Vegas. He said he’s converted from Judaism to Christianity and told an interviewer that one of the reasons he moved to the city is because of the large number of churches there. “I came to Vegas to party and have fun and I wound up living here,” Judah said. “I realized I needed to change my life and the way I was going. To do that, I had to find God. It’s funny, but a lot of people ask how I serve God while living in Sin City, but I can do a great job of it. This city is not all about gambling and clubs and what is going on at The Strip. The secret here is that there are more churches per capita in
Las Vegas than in any other city in the U.S.” That’s an old wives’ tale, but the point is that Zab Judah 2.0 at least knows where the churches are located. A few years ago, he would have been hard-pressed to provide directions to anything besides the town’s hottest night clubs and strip joints. He’s trying to resurrect a career in the 11th hour because, despite all his physical skills the fast hands, the quick feet, the powerful punches - he’s repeatedly come up short in his biggest fights. Judah was blasted by Tszyu in his bid for the undisputed title. He was outboxed by Mayweather. He was battered by Miguel Cotto. He was outworked by Joshua Clottey. He was outslicked by Cory Spinks. Ten years after the debacle with Tszyu, the roles are, in a way, reversed. It’s Khan who is 24 and filled with promise, looking to unify titles and ascend the pound-for-pound rankings. It’s Judah who is the veteran hoping to remain relevant and extend his career. Judah has always been able to talk a good game, and he hasn’t changed in that regard. He’s kept up a war with Khan on Twitter and he’s played his share of
mind games with the 2004 Olympic silver medalist. On a recent conference call, Judah refused to speak to British reporters because he isn’t getting a cut of the revenues coming out of the United Kingdom. Seeking to create doubt in Khan’s mind, he’s tried to cast the fight as a battle of wills as well as a battle of skills. “[Saturday’s bout] is about this: What can you bring as far as your skills?” Judah asked. “What can you bring as far as your brains? What can you bring as far as your knowledge of boxing? What do you do when you look across that ring and there’s a hungry lion named Zab ‘Super’ Judah looking you dead in the eye, anxious for the bell to go ‘Bing!’? You either fold or you play cards. Me? I’m going to play to win.” Khan is a 5-1 favorite, which is more a sign of bettors’ disdain for Judah than it is for any deeply held belief in Khan. Judah’s skills are obvious, but so, too, is his history of checking out when the going gets rough. He’s over that, he insists. Judah swears he’s a new man, personally and professionally. He told a group of reporters that if they
searched the Internet for his name, they’d find not only stories detailing his boxing career, but plenty of street fights and brawls. With a young son parked next to him, clutching one of his title belts, Judah shook his head. “That happens to a lot of us when we’re young,” he said. “I’m sorry for those situations, but I’m moving forward now.” He knows that a loss would probably end his shot at any more big fights - and bring the big paydays to a halt. He’s got six children and, he’ll tell anyone who will listen, a newfound commitment to living life right. And so, he’s trying to position himself as somewhat of an elder statesman. Judah praised Khan for accepting his challenge but said Khan’s bravado will ultimately be his undoing. “Amir Khan deserves a lot of credit and he’s shown great heart, putting his world title on the line in a major fight against someone like me,” Judah said. “But this is a gamble for him. He’s good - real good, one loss - but I have more knockouts than he has had fights. He’s like I was when I was in my early 20s: a guy who believes he can beat anybody.
Group sues over Title IX high school enforcement By FREDERIC J. FROMMER WASHINGTON - A group of coaches, parents and others is suing the Education Department over how it determines whether high schools are complying with the federal law that bans sex discrimination in schools that receive federal money. At issue is a threepart test to judge a
school’s compliance with the 1972 law, known as Title IX: having male and female athletes in proportion to their enrollment; showing a pattern of expanding opportunities for females; or proving the sports interests of females have been met. The American Sports Council argues in the lawsuit, filed Thursday by the Pacific Legal Foundation, that the test, as applied to high
schools, violates the equal protection clause. The group claims it will lead to quotas and the elimination of boys’ sports teams, and is seeking a court order to stop the department from using it. E d u c a t i o n Department spokesman Jim Bradshaw called the test a “valuable tool” for ensuring a level playing field for all students. “It plays a critical role in ensuring a fundamental level of
fairness in America’s schools and universities,” he said. Title IX has helped open more academic and sports opportunities for women and girls. The council, formerly the College Sports Council, was one of several groups that also challenged the threepart test for college sports. A federal judge dismissed the case in 2003, saying the plaintiffs didn’t have the
right to sue. Before the law, less than 300,000 girls participated in high school sports, compared with 3.5 million boys, according to the department. In 2007-08, the number of girls participating increased to 3 million, compared with 4.4 million boys. The council’s chairman, Eric Pearson, said his group was concerned about complaints filed with the department last fall by
the National Women’s Law Center, which claimed that 12 school districts violated Title IX by not offering equal opportunities for girls. The center cited double-digit gaps between the percentage of female students and the percentage of female athletes. The center said many sports weren’t offered to girls in the districts, and that the gaps had gotten worse in recent years.
