price growth will be sustained and that realistic asking prices will be achieved, and we can definitely expect the pattern of shortages of stock in the mid price ranges in the main metro regions to continue. Although political and economical conditions do impact on the industry, we do stand firm that property still remains your best investment as housing is not an optional extra.

As this is our first edition for 2015, I would like to take this opportunity to wish all our readers a very prosperous new year and wish you only the best with whatever may cross your road. We at Engel & Völkers did not see the normal traditional trend of slowing down towards the end of the previous year, and then slowly picking up in the new year. 2015 started off at an extremely fast pace and there are no signs of it slowing down, which is a very positive indication of what the year might bring. The first quarter of this year is going to be extremely eventful for us with January seeing yet another sales record, February is the launch of the latest South African Film, Mooirivier which Engel & Völkers are partners with, and we have our annual licence partner meeting and national rewards function coming up in March. We have also seen a record number of applications for franchising with the Engel & Völkers brand in the first month of the year. On the industry side of things, the markets are still remaining strong, with many people looking for that right property. We are confident that the current house

Engel & Völkers achieves highest turnover in the company's history in 2014

T

he Engel & Völkers Group increased its Group commission revenues in 2014 by 10.1% to 300.3 million euros (2013: 272.9 million euros). In doing so, the company has set yet another record for the highest turnover in its history stretching back more than 35 years. “We are extremely pleased to report our most successful year to date once again. This significant rise in revenues shows that we are on the right track with our expansion strategy,” said Sven Odia, Co-CEO of Engel & Völkers AG. He attributes the strong growth in core markets above all to the good positioning of the company in desirable international cities and second home markets.

2,000 new sales advisors sought for expanding foreign markets Engel & Völkers is gaining market share at a continuous and rapid rate, especially in the Mediterranean region, the USA and

South Africa. This is due to the strong presence of the brand in these markets. In North America, the company recorded a 46% turnover growth in 2014, whilst turnover rose by 102% on the Spanish mainland. South Africa is not far behind with a 35% growth reported. This rate of growth also entails a very high need for qualified employees, which is why Engel & Völkers is currently in the process of expanding its personnel on an immense scale. “We are looking to hire 2,000 new sales advisors worldwide by the end of the year. The focus here will be on Spain and North America in particular,” said Mr. Odia. Engel & Völkers is also anticipating additional, strong growth in all business divisions throughout the course of 2015. “The good development in the markets will continue and our worldwide network will grow further. There is no end to this upward trend in sight,” Mr. Odia added.

Ins and outs of the

NHRBC

After much consideration and thought, you and your spouse have decided to build a brand new home. Immediately friends and family will start recounting their unfortunate experiences in this exercise, and you will know you are taking on a daunting, yet hopefully, rewarding task.

T

he search for the perfect builder starts, and soon you realise this must be seen as a project managed by a professional builder, and not by the cheapest quote received that very likely, would be using unskilled

labour.

That is exactly the time to contact the NHBRC (The National Home Builders Registration Council) who is the regulator statutory body of the home building industry which began operating in March 2001. This Council was established to protect the housing consumer from fly-by-night contractors, and this they do by regulating the home building industry. From the www.homeplace.co.za website you can view the complete Housing Consumers Protection Measures Act which has been created to provide protection to owners building new homes against the so-called "fly-by-night" builders. That is, builders who either build to an unacceptable quality standard or builders who refuse to get involved in the rectification of built-in defects in the home. The Act does this through the creation in law of a regulatory body known as the NHBRC. The processes of the Act: 1. Ensure that every builder must be registered with the NHBRC. 2. Every builder must construct a house in accordance with the technical requirements and technical standards of the NHBRC. 3. All new enrolled homes are provided with a "deemed warranty", requiring the builder by law to: ¡ Rectify any workmanship related defects that occur in the first 3 months after occupation. ¡ Rectify any roof leaks that occur in the first 12 months after occupation. ¡ Rectify any major structural defects that occur in the first 5 years after occupation. 4. Every house must therefore be enrolled with the NHBRC and the builder will then receive an enrolment certificate. The home owner must request a copy of the enrolment certificate from the builder. It is the responsibility of the builder to enrol the new home, but you are advised to ask for a copy of the enrolment certificate. 5. The first recourse on default or non-compliance is that the builder must be requested in writing to fix these defects. But if he is not capable or able to rectify the defects, the NHBRC will use its own warranty funds for repair. The defining line: ¡ Workmanship defects (eg loose door handles, peeling paint, cracked sinks, etc) have a warranty for up to 3 months – and to be repaired by the contractor. After that period it is considered normal wear and tear that needs maintenance by the home owner. If the contractor does not carry out such repairs, the house consumer should report the builder to the NHBRC who can take action such as suspend his registration with the Council, or withdraw the registration of the builder ¡ Any issues relating to the structural defects of the house (if the house has serious cracks that would affect the integrity of the house) will be fixed by the NHBRC if they occur within a period of 5 years. The consumer does not have to employ lawyers, architects or engineers to assist them in the event of a defined structural defect. ¡ To remedy the faults, the home owner needs to go back to the builder which

may not be easy due to the negative relationship, but this is the channel that you need to follow. Due to the NHBRC enrolment process however, several benefits can be achieved for the consumer: ¡ All homes to be built, must comply with the specifications as prescribed in the NHBRC's Home Builders' Manual, which sets minimum quality standards. ¡ The NHBRC must ensure that foundations have been correctly designed to match the existing soil conditions. ¡ All homes must be inspected by the NHBRC Inspectorate to check that the home builder is actually complying with the NHBRC requirements on site. If the builder has already closed his business the NHBRC may use its funds to pay another builder to fix the structural defects. The Standard Bank website has a practical article on their website highlighting the main specifics and important processes, such as the types of homes covered by the warranty: ¡ Houses ¡ Sectional title units (flats, townhouses) ¡ Employee and company housing schemes ¡ Builder and developer housing projects This NHBRC warranty is strictly only for new homes being built - alterations and additions to existing homes are not covered by the warranty. Wendy Williams, a director of Engel & Völkers Southern Africa points out that the home owner should draw up a detailed list of all visible defects and ensure the builder gets a copy of this before signing off the home. Do not occupy the home before doing this. As Wendy concluded: “It is essential for the home owner to ensure that the appointed builder is actually registered firstly, and that there is a NHBRC written enrolment certificate so that you have some recourse should he not be compliant in following the building regulations and workmanship. If you don't check compliance and problems arise with his workmanship or structural defects, you cannot rely on any warranty benefits from the NHBRC. Every builder that is registered with the Council will appear on their website www.nhbrc.org.za or call them on their toll number 0 800 200 824 to confirm if your builder is registered or not. Also ask to see the builder's registration certificate which is valid for a period of one year. It is advisable to visit this website before making any choices or decisions.” Additionally, the NHBRC will publish and distribute lists of any builders who have been de-registered or suspended. These lists (also on the internet) will give the details of the home builder, the number of homes they have built and the number of serious complaints laid against them. All of this will assist the consumer in the correct choice of their home builder. When buying a new or relatively new home today most buyers would want to know whether the house is still covered by a NHBRC warranty. So this is a huge advantage when you need to sell and we would advise you strongly to request this information.
