The waste management horizon: key policies to watch under the new Labour government

“Labour is committed to reducing waste by moving to a circular economy”, but this manifesto statement left a lot to the imagination. As Kier Starmer settles into Number 10, Grant Thornton’s Net Zero team considers some of the upcoming policies on the waste management horizon.
1/ UK Emissions Trading Scheme (ETS): In 2023, the Government confirmed its intention to include Energy from Waste (EfW) facilities in the UK ETS from 2028. The implementation is still under consultation (closing 2 August 2024). This additional cost of operating an EfW would likely lead to an increase in Carbon Capture Usage and Storage (CCUS) uptake at EfWs to reduce carbon emissions. Labour’s manifesto committed “£1 billion to accelerate the deployment of carbon capture”, however, this funding is likely to cover a wide range of industrial emitters.
2/ Biodegradable Municipal Waste (BMW) to landfill: From 31 December 2025 there will be a ban on BMW going to landfill in Scotland. The Welsh Government has also set limits on the amount of BMW that can go to landfill. But rules applying to England are still under consultation. 61 consultation responses have been received, which are currently being analysed. The interaction with the UK ETS is critical – incorrectly calibrated and the ETS change (above) could push more waste to landfill unless bans are in force.
3/ Extended Producer Responsibility (EPR): UK organisations responsible for packaging waste (e.g. those who supply packaged goods, import products in packaging or supply empty packaging) will be required to collect and report packaging data and pay EPR for packaging fees. These fees have been deferred for a year so will be payable from October 2025.
4/ Deposit Return Schemes (DRS): A DRS is currently under development with plans to be in place across the UK by October 2027, meaning that a small cash deposit would be placed on drinks containers incentivising their return to a collection point. The scheme was meant to go live in Scotland in 2023 but has been delayed.
5/ Simpler Recycling: In May 2024 the Government proposed new rules in England that will allow the collection of municipal waste in a minimum of three bins: one for all dry recycling, one for garden and food waste and one for residual waste. Councils will be expected to collect residual waste at least fortnightly, alongside weekly food waste collections from March 2026, unless transitional arrangements are in place.
6/ EfW capacity: The previous Government was considering the role of EfW plants in the management of residual waste, which included a temporary suspension of any new permits for EfWs in England earlier in 2024. The new Labour government is yet to share its intentions on this point.
How will these policies fare under an expected spending review? At this critical juncture in the approach to waste management in the UK, Labour must not be short sighted; it has the opportunity to be bold, to embed and to improve upon policies which will deliver over the long term, promoting a circular economy, addressing the climate crisis and paving the way for a global movement towards sustainable waste management.

Embracing flood adaptive technology is a paradigm shift for sustainable development

As a densely populated island nation, the United Kingdom faces complex challenges from competing land uses. Meanwhile, the threat of flooding looms large, posing a threat to 5.7 million properties in England alone, as highlighted recently by the UK National Audit Office (NAO).
With our changing climate increasing the level of flood risk that we face, how can we effectively manage flood risk; protect communities and infrastructure; and, at the same time, support new development?
The statistics from the NAO neatly illustrate the stark reality; millions of properties and crucial infrastructure are at risk of flooding. The challenge becomes even more daunting when we consider the need for increased economic development in flood-prone areas. Conventional wisdom might suggest that we avoid development in floodplains altogether, but that is neither practical nor realistic.
The planning process is at the heart of managing flood risk and supporting sustainable development. Local decision-makers play a crucial role in determining the suitability of locations for development. However, this approach has its limitations. The rigid nature of the planning process does not always provide the flexibility needed to address evolving challenges. It also fails to take into account innovations within the built environment sector, including the transformative potential of rapidly evolving flood adaptive technology.
The solution involves effective risk management and a forward-thinking approach that puts flood adaptive technology at the heart of the planning process. Integrating smart technologies into our infrastructure is a game-changer. Sensor networks, data analytics and real-time monitoring can provide invaluable insights into changing weather patterns and water levels, empowering local authorities to implement proactive measures, alert communities in advance and optimise the performance of flood defences. At the same time, climate resilience measures, including structures with the ability to elevate about rising water and the use of flood-resistant materials, can eliminate the risk of flooding or reduce the damage caused when it does occur.
Recognising the need for a more dynamic approach, Flood Technology Group was formed last year. We firmly believe that flood adaptive technology should be central to our efforts to manage flood risk, while still allowing economic development activity to take place. It

UK businesses take swipe at the credibility of carbon offsetting schemes
80% of environmental professionals have concerns around the credibility and transparency of carbon credit offsetting schemes
Businesses across the UK have expressed concern at the credibility and transparency of carbon credit offsetting schemes.
In a report presenting the outcomes of the National Environmental Services Survey – run in association with the Chartered Institution of Wastes Management (CIWM), The Environmental Services Association (ESA), Groundwork, and ESS Expo (Environmental Services and Solutions Expo) – 80% of respondents stated that they had serious concerns around the integrity of carbon credit offsetting schemes. While almost a third of those questioned (33%) believed carbon offsetting is a viable strategy for achieving net-zero emissions, just 37% have employed it as a strategy to reduce their businesses’ environmental impact. Greenwashing also remains a major concern among industry insiders, with 94% of respondents believing it is prevalent in the UK. In 2023, a quarter (25%) of respondents to the same survey stated that greenwashing was the one thing they would change about the environmental sector as Rob Mowat, Managing Director of ESS Expo, explains:
“It is alarming to hear that so many sustainability experts believe carbon offsetting schemes are actually failing the environment. While there are some businesses entering into highly certified programmes, there are concerns from many across the industry that these schemes are simply another form of greenwashing and can, in some instances, cause more harm to the environment than good.”
Overall, perhaps unsurprisingly, climate change and global warming (32%) were cited as the biggest issues within the environment and sustainability today, followed by environmental policy and governance (15%) and waste management and the circular economy (13%). Crucially, as we head into a general election, 37% of those asked believe current government policies are unsupportive when it comes to achieving net zero goals, with just under a third (32%) stating that they are one of the biggest barriers to their organisation achieving net-zero, surpassed only by financial constraints (44%). Worryingly, only 3% of those interviewed said their organisation was currently at net zero.
Achieving net zero
When it comes to achieving net zero emissions across sectors, collaboration and partnerships are key, with 85% of respondents reporting that working together is either essential or very important. Further, nearly all respondents (99%) believe innovation and technology will play a role in accelerating the pathway to net zero emissions, with almost everyone (87%) agreeing it will play a significant part. The five biggest focusses will lie in the expansion of the circular economy (20%), advancements in clean energy technologies (16%), public awareness and engagement in sustainability (15%), followed by strengthening policy and regulation and green infrastructure at 14% and 9%, respectively.
Lee Marshall, Director of Innovation and Technical Services at the Chartered Institution of Wastes Management (CIWM), said: “It is always valuable to get insights from those who work in the sector. The concerns about off setting show that resources and waste professionals want to do the right thing and take meaningful steps to support climate mitigation. The UK has made good progress, but it is no surprise that people feel policies on net zero and circular economy are not strong enough.
“We need policies that will accelerate the transition to a more resource resilient and circular economy capable of meeting future material demands and supporting the battle against climate change, and this is something CIWM is calling for in our ten policy recommendations for the new government.”
Head of Climate and Energy Policy at The Environmental Services Association (ESA), Charlotte Rule, said: “Clearly, from these alarming survey results, there remains significant work to be done across the business community to demonstrate credibility and build trust in efforts to reduce carbon emissions, mitigate climate change, and achieve net-zero targets.
“Achieving net-zero must be a collaborative exercise, which is what the ESA has sought to achieve through its Net-Zero strategy – aligning organisations across our sector through a shared roadmap; speaking with a unified voice to Government to achieve a supportive policy environment and being mutually accountable to each other as a membership body.”

Upcoming changes to UK WEEE EPR & divergencies from EU WEEE EPR

Why should we care about e-waste? There are a lot of reasons why we should care! 62 million tonnes of electronics worth £72 million were wasted during 2022, less than ¼ of which was recycled. The production of 1kg of electronics results in the emission of 25kg of carbon into the atmosphere and it is projected that 74 million tonnes of e-waste will be generated annually by 2030.
WEEE EPR in UK & EU
The current UK WEEE (Waste Electrical & Electronic Equipment) EPR (Extended Producer Responsibility) regulations were published in 2013 to transpose the EU WEEE Directive (as recast). Thus, the current UK WEEE EPR regulations are very similar to WEEE EPR regulations in the EU. The regulations require product ‘producers’ to finance the management of the products they place on the market once they arise as waste. With planned changes to both the UK and EU WEEE EPR systems, notable divergence between the systems is inevitable which causes significant challenges for product ‘producers’.
From June - September 2023, the European Commission launched a public consultation on the revision of the WEEE Directive and Commission adoption was planned for 2024. The UK Government’s 2023 Environmental Improvement Plan (EIP) committed to consulting on improvements to the producer responsibility scheme for WEEE in 2023, with the aim of making it easier for people to properly dispose of their electrical waste. The proposed changes involve extending current regulations to drive up levels of separately collected WEEE for reuse and recycling.
What is changing?
It is planned that reforms to the UK WEEE EPR system will be phased, with new obligations for online marketplaces, free collection of large appliances by retailers, and a new EEE category for vapes starting as early as 2025, with the start of household collections anticipated from 2026.
Other notable changes to the system include potential removal of the 5-tonne exemption threshold, the promotion of product eco-design via the introduction of eco-modulated fees whereby producers of easier-torecycle products are charged discounted EPR fees, and the potential introduction of new mandatory labelling obligations.
