ome of the old methods of managing water are overdue for change, as declining snowpacks and aquifer levels are making increasingly apparent across the West. For advocates of permaculture and other holistic approaches to agriculture, this predicament offers a chance to reshape the way farmers and ranchers think about water. “What if we saw water as an abundant resource? Flipping the script may reveal all kinds of opportunities,” Don Tipping, a permaculture expert and seed farmer near Williams, Ore. Regulators have effectively “promised out more water than actually exists” when irrigation demand is high in summer, creating an “atmosphere of scarcity,” Tipping said. However, innovative strategies for farming with scarce water have been progressing for decades — people must simply be willing to use them imaginatively, he said. See Water, Page A8

Ingredients 2 pound boneless blade pork roast OR sirloin, cut into 1/2-inch cubes 1/3 cup flour 1 1/2 teaspoons salt 1/4 teaspoon ground black pepper 2 tablespoons vegetable oil 4 large onions peeled and sliced 1/2-inch thick 1 clove garlic crushed
1 teaspoon caraway seed 1 bay leaf 1 14 1/2-oz can chicken broth 1 12-oz can beer 2 tablespoons red wine vinegar 1 tablespoon brown sugar 1/4 cup fresh parsley chopped Directions In shallow bowl toss together flour, salt and pepper. Dust pork cubes with seasoned flour. Heat oil in deep skillet or Dutch oven over
medium high heat; brown pork cubes slowly, about 10-15 minutes, turning to brown evenly. Add onions and garlic; cook and stir 5 minutes, until onion is limp. Stir in caraway seed, bay leaf, chicken broth, beer, vinegar and brown sugar; bring to a boil. Lower heat, cover and simmer for 1 hour, until pork is very tender, stirring occasionally. We shot pool and the breeze, surrounded by Grandfather’s collection of western memorabilia. There were rusty branding irons in the corner, dusty old hats hanging from the ceiling (even one signed by Roy Rogers himself), and everything western on the wall. tion in the musty downstairs room where guests would not see the dust and the rust. I took a friend to see the collection once and he thought it was a bunch of junk. But I didn’t care, because on Sunday mornings Grandpa and I would enter that room and live in another day and another time, if just for awhile. Grandpa never threw anything away if it was old. Maybe that is how it should be. As Grandpa’s collection grew it got tougher to shoot pool. You would pull your cue stick back and hit something on the wall. “What the heck is that?” I’d say. “Oh, those are some new old spurs I got. Aren’t they beauties? They called them “Mexican Gut Robbers.” I could believe it. They had rowels on them three inches long. But if the horses had to be tough back in the good old days so did the cowboys. Grandpa’s got a pair of brass knuckles and a pearl handled derringer on the wall ... and they belonged to a banker! I will admit that one man’s junk is another man’s gold, but even Grandma would have to concede that part of the collection is valuable.

There are two handmade violins that took a lot of time and talent to make. But I guess the craftsman had a lot of time. He was in prison for murder. But even the cowboy’s tools, like the braided horse hair rope, stand as testimony to a time when things were done right no matter how long it took. One of the more interesting pieces in the collection is a long tube of thin metal with a large cupped opening at one end and a small opening at the other. “It’s a hearing aid,” joked Grandpa. “Actually they were called ear trumpets. You put the big end up to the deaf person’s ear and you yelled like hell into the other end.” There was always great excitement whenever Grandpa got something new for his collection. “Look at this,” he said one Sunday. It looked to me like an old piece of wood with a bunch of square nails in it. “It’s a piece of wood from a county courthouse that the government actually built in the wrong county.” In the story of human progress some things never change. The pool room turned into a family museum, a symbol
of our heritage. There is the number that Grandpa wore on his back when he won the team roping at the county fair. There are my brother’s first cowboy boots that eventually got handed down to me. The room was full of hand me downs, from one generation to another. I think my Grandpa always wanted me to be a lawyer or something upper crust but it was his fault I always dreamed about being a cowboy. We don’t shoot pool anymore because Grandpa is gone. I miss him terribly as he was the father-figure in my life. I like to think that Grandpa knows I did grow up to be something important... I became a cowboy. I’d like him to know that the dream never died. Grandpa left everything in that room to me and I’ve added to the collection, so much so that’s it’s taken over every room in our house. And when guests are invited to shoot a game or two of pool on that same pool table invariably someone will pull back their cue stick and hit something new. At least it’s new to my collection. In reality it’s probably 150 years old. You might be surprised to learn I have another collection that’s way more valuable than all my old cowboy stuff, at least to me it is. It’s my collection of memories. Memories of those long-gone Sundays when I fell in love with the romance of the cow business. Thanks Grandpa! This country already had enough lawyers ... and not nearly enough cowboys.

Earthmoving is a common tool, with farmers building berms or digging basins and swales — basically recessions in the ground — to prevent rapid runoff. “What these structures are really doing is slowing the flow through the watershed and recharging groundwater tables,” said Andrew Millison, a permaculture instructor with OSU’s horticulture department. Reducing tillage and growing cover crops offer a relatively undemanding way to help the ground soak up water, he said. “More important than all those structures is having soil with a high organic matter content,” Millison said. “Absorbing organic matter into the soil is the first line of defense, and it doesn’t require the changing of any laws.”

Apart from negotiating physical obstacles, farmers must ensure permaculture tools don’t conflict with water rights. Theoretically, slowing water’s downhill flow benefits farmers and environmentalists alike by preventing erosion, which causes soil loss and stream pollution. Filtering water through the ground also removes impurities and lowers its temperature, enhancing fish habitat.

Reservoir trouble
In one famous case, a Southern Oregon landowner built several dams intended to collect water flowing over his land, claiming the state government lacked jurisdiction over rain and melting snow before it enters a defined stream. State regulators said the reservoirs deprived a nearby creek of water and ordered them torn down. The government prevailed in court, ultimately leading to a monthlong jail sentence and $1,500 fine for the landowner. Earlier this year, Sen. Dennis Linthicum, R-Klamath Falls, proposed broadening Oregon’s water rights exemption for storing snow and rainwater. The exemption now

ping the flow of water or just slowing it?” Spriet said, adding that regional water availability plays into the calculation. “A structure in one area may cause an issue whereas in another it may not.” Oregon law does shield well-meaning landowners if their land management practices are intended to “save soil and improve water quality by temporarily impeding or changing the natural flow of diffuse surface water.” They shouldn’t expect that protection to be limitless, though. “It’s not an open-ended exemption,” said Priestley of Waterwatch. “It’s tied to a purpose. It’s clear that storage cannot be the purpose.” Farmers have leeway to reuse flows from water they’ve legally diverted for irrigation, but only as long as it stays on their property, said Spriet of OWRD. Runoff from neighboring landowners remains off-limits under this principle.
“Once they lose control, it’s basically the public’s water again and goes back into the system,” he said.
Guidance needed
Without a consistent rule of thumb, landowners should seek guidance from local regulators about any project they’re unsure about, Spriet said. “The best thing you can do is talk to your local watermaster and get their opinion.” Even this advice comes with a caveat, because the opinion of a watermaster doesn’t carry the weight of black letter law, said Liljefelt, the agricultural water rights attorney. Informal approvals can be especially vulnerable if they occurred long ago, when “you had things that were a lot looser than they are today,” she said In general, agency guidance is less reliable than actual regulations, which also aren’t set in stone, Liljefelt said. Government incentives can foster cooperation among landowners and overcome the hurdles posed by a fragmented landscape, said Millison, who’s helped organize the Permaculture Land Users Group, or PLUG, to explore and advocate such ideas. “What we’d like to see is full watershed-scale water systems,” he said. While roadways can be destructive, they can also provide water solutions, said Tao Orion, who designs permaculture sites with her husband, Abel Kloster. Harvesting and storing water from roads, including those made from gravel, could filter out pollutants while increasing irrigation supplies, Orion said. “A lot of that water is contaminated and you don’t want it to go directly into the stream,” she said. “Most engineering is trying to get that water away as fast as possible. In permaculture, we’re trying to get it to stick around for longer.” Permaculture and keyline systems often rely on a row of gravity-fed ponds that distribute irrigation water at various elevations and capture overflow from each other. To reduce the burden on landowners, regulators could issue a single water right that encompasses the entire series of ponds, rather than require separate permits for each of them, Kloster said. Likewise, regulatory barriers could be lowered for reservoirs that serve an ecological purpose. “If there was something more streamlined, it would lead to more adoption,” he said. “There are ways we can work with water that are not purely extractive.”

LONG BEACH, Wash. — Oregon and Washington cranberry farmers are starting to harvest berries without carrying the burden of a huge U.S. surplus that dragged down prices for several years.

The cranberry industry ended the 2022 crop year with 3.5 million barrels in storage, according to the Cranberry Marketing Committee. Inventory peaked in 2017 at 9.6 million barrels. Growers approved volume controls in 2017 and 2018. Wisconsin, the top-producing cranberry state, has not come close to its record 2016 crop, which drove up the surplus. As the surplus has gone down, prices have gone up. Average prices bottomed out below $30 a barrel, or 30 cents a pound, in 2018. The average price in 2022 was $38.12 a barrel, according to the USDA.

Oversupply isn’t a problem this year, said Gale Turner of Turner Cranberries in Bandon, Ore. “Not like before, where we had a year-plus still in the freezer prior to harvest,” he said. “From what I’ve been hearing, they’re looking for fruit. We haven’t got a price yet. We sometimes don’t get a price on the independent stuff until we almost deliver,” Turner said. The USDA in mid-August predicted a good to average cranberry crop for Oregon. The USDA does not forecast Washington’s crop, which is smaller than in the other top-producing cranberry states of Wisconsin, Massachusetts, New Jersey and Oregon. McPhail started harvesting Sept. 25, about two weeks later than usual. Because of the dry summer, the farm was short of water to irrigate and flood bogs, he said. McPhail’s goal is to average 200 barrels an acre. The first bog harvested yielded 384 barrels per acre, he said. “We haven’t hit that high (of a yield) in sometime.” Cranberry farmers on the southern Oregon Coast said they were concerned with the size of fruit, which is smaller this season, but the harvest appears above average.

Kamren Koompin was reminded what a normal potato crop looked like this fall as he surveyed his harvest. “Size is better than it has been in the last two years,” the American Falls, Idaho, grower said. “It’s probably back to the five-year average. The last two years were definitely below, so that’s good.” Idaho potato growers are wrapping up their harvest of what looks to be their first normal crop in a while. Last year and 2021 had below average yields because of unusual weather and smoke impacts. In 2020, yield and quality were above average offset to an extent by a drop in planted acreage. In 2019, there was a drop in production and slight decrease in harvested acres, hurt by early frost.

field to another, but overall quality looks good and yields seem to be decent.” The supply of irrigation water was adequate to get through harvest, he said, adding that “we hope we have a good, wet winter.” “We’re really happy with our crop over here, but I’m hearing a lot of areas got smaller potatoes, so yields are off,” said farmer Bryan Searle of Shelley, in the east region. He received reports of smaller potatoes to the north, though some farmers there had good size and quality, he said. Last year on Searle’s farm, “we were upset by weather on our quality,” he said. Prolonged high heat was a factor. In 2023, “potatoes had a good summer, and a really good growing season,” he said. The set was good, which bodes well for maintaining quality. Set refers to the number of potatoes per stem, per plant. Some of Searle’s potatoes are the best-looking ever, though “they’re not all like that.” See Potato, Page B5

Late harvest of other crops tied up equipment and delayed work on some potatoes, letting certain varieties add bulk, Koompin said. “Now we’re trying to get as much done as possible before the next storm comes Saturday night,” he said Sept. 27, referring to anticipated conditions Sept. 30. Rain in southern Idaho during the Sept. 30-Oct. 1 weekend slowed harvest progress a bit, “but nobody is really concerned yet,” said Travis Blacker, the commission’s vice president of research and industry relations. Rain expected early in the Oct. 2 week could slow progress a bit, depending on volume. Quality is good, and better than it was in 2022, he said. As for yield, more will be known at seasons end, “but it’s safe to say that yields for this crop are better than last year’s. Growing conditions for this year were favorable.”

Near Wilder, in the southwest, potato yields are mostly average and quality is “very good,” said Angie Rader, a partner in Doug Gross Farms. “They have been very beautiful potatoes.” Yields are average, particularly for later-maturing varieties, Gross said. One earlier variety for the fresh market showed yield that was a bit lighter than average, but good quality. First-year potato grower Miguel Villafana, also of Wilder, produced yellows and reds for the fresh market. He finished harvest in mid-August. Yield and quality were good. After the spring planting delay, growing conditions were good, he said. At season’s end, “everything about the harvest went well and was favorable.” Idaho leads the U.S. in potato production. Planted acres totaled about 330,000, up 12% from last year, according to USDA’s National Agricultural Statistics Service.

By CAROL RYAN DUMAS Capital Press A preliminary investigation by a Washington, D.C., law firm has found insufficient evidence for the American Sheep Industry Association to move forward in pursuing action against lamb imports from Australia and New Zealand. “ASI leaders met five times this year to complete the investigation. The numbers are either there or not to proceed,” Peter Orwick, ASI executive director, told Capital Press. The investigation by the Kelly Drye and Warren law firm does not document subsidies or product dumping to support filing trade petitions. This is the third investigation into trade violations regarding lamb imports in six years, Orwick said. “So we have been aggressive in monitoring the trade. For the time being, all worthwhile routes have been exhausted on this front other than Senator (John) Barrasso’s effort on a USDA rule that we are actively working,” he said.
Lifting import ban
Barrasso introduced legislation on Sept. 21 to stop the Biden administration from lifting a ban on imports of sheep and goat products until studies show the possibility of contamination or transmission of diseases have been completely eliminated. The legislation also calls for a costs and benefits analysis as well as the impact on domestic markets. ASI’s executive board in April approved a preliminary investigation into dumping and countervailing duties. In May, the executive board hired the law firm to perform the investigation. ASI contends the volume of imported lamb has increased during the last several years along with consumer demand. As a result, domestic lamb has lost market share to imports, with the vast majority of gains in consumer demand going to imported lamb. Lamb imports in 2022 totaled 278 million pounds, with 207.8 million pounds from Australia and 64.9 million pounds from New Zealand, according to USDA Economic Research Service. Total lamb imports

sue remedies to alleviate the long-term market pressure created by imported lamb meat in the United States,” they said in an April 14 letter. The groups noted Australia and New Zealand have historically undercut prices for U.S. lamb. ASI’s executive board unanimously agreed to schedule an informational virtual meeting in October to fill in the full board of directors and executives of state affiliate associations on the investigation.

Washington FFA convention to return to WSU in 2024 By MATTHEW WEAVER Capital Press
The Washington FFA state convention will return to the Washington State University campus in 2024, after four years away. The convention will be May 9-11 in Beasley Coliseum. “I think it’s really cool for the kids and the teachers overall,” Jesse Taylor, executive director of the Washington FFA Foundation, told the Capital Press. “It is our land-grant college, the majority of our FFA advisors and agricultural education instructors went to college there. For the teachers, for the FFA community as a whole, I think it’s a great thing that we can all go back to the place where FFA has always been. ... I suspect we’ll be holding it there for the foreseeable future, too.” The convention had been in Pullman every year since the state organization formed in 1930, Taylor said. Organizers pivoted to a month-long virtual convention in 2020 due to the COVID-19 pandemic, then switched to a virtual hybrid in 2021. In 2022, the convention relocated to Kennewick in the Tri-Cities due to WSU’s policy requiring proof of COVID vaccination. Record membership
As of the 2022-2023 school year, Washington FFA has more than 14,000 paid members, a record, Taylor said. Before the pandemic, membership was about 12,000, he said. During COVID, membership dropped to less than 8,000. “I figured it was a fiveto 10-year stretch to get us back to 12,000,” Taylor said. But, “There’s an absolute hunger out there among the kids for an outdoors, hands-on education experience,” he said. That materialized this summer in the number of youths participating in county fairs, he said. During COVID, “I think kids were cooped up and they couldn’t play sports and clubs and all that stuff,” Taylor said. “After it opened up, it was like, ‘Let’s go.’”
Showcasing education
The only current Washington FFA members who would recall a convention in Pullman would have attended as a seventh-grader, Taylor said. “I’m thrilled,” said new Washington FFA executive director Andy Zahl, who began Oct. 2. “Pullman was where all my state conventions were as a member, as a state officer. It makes the most sense for logistics, in terms of an on-site convention.” “We are delighted that the Washington State FFA Convention is returning to WSU,” Elizabeth Chilton, provost and executive vice president and WSU Pullman chancellor, said in a press release. “It provides a chance to showcase and build on the partnership between our two organizations. It also enables participants to experience events on the WSU Pull-

Quinoa researcher aids African farmers By MATTHEW WEAVER Capital Press
PULLMAN, Wash. — Cedric Habiyaremye made a pinkie promise with his brother when he was 11 years old. His family fled the 1994 genocide in Rwanda of the Tutsi minority population by extremists in the Hutu majority. More than 800,000 civilians were killed, and 2 million Rwandans fled the African nation during or after the genocide. The family found aid through various humanitarian programs for three years, then returned to Rwanda — during a famine. “We would go two, three days with nothing to eat,” Habiyaremye said. “There was people dying from hunger and disease; basically we were surrounded by that kind of chaos.” Habiyaremye’s mother told her children that one day they would be able to do big things for the country. He had a hard time believing it, given the harsh circumstances all around them. His mother comforted him, telling him he would go to school and study.
Shortly after, he and his brother decided their life goals. His brother, 12 at the time, wanted to become a pharmacist and asked Habiyaremye, “What about you?” “I told him, ‘We are hungry, we don’t have food, maybe I’ll go to school and study and we will never go to bed hungry any more,’” Habiyaremye recalled. “Then we did a pinkie promise to stay connected to our dreams no matter what.” Today, Habiyaremye oversees quinoa research and collaboration at Washington State University in countries outside the U.S. He’s working to introduce the crop to farmers in Rwanda and other African countries to fight hunger and malnutrition. About 700 small-scale farmers are now raising quinoa in Rwanda as a result.

agronomically competititve” staples, including quinoa, proso millet, food barley, amaranth, red kidney beans and soybeans. “We wanted to be able to work with farmers beyond the research component,” Habiyaremye said, likening it to a university extension-style service. QuinoaHub creates a localized market for the crops. After the pilot program’s success in Rwanda, they replicated the model in the other countries. Ten to 15 farmers in Zimbabwe are now growing the quinoa varieties released by WSU to Rwandan farmers earlier this year. Those farmers will branch out and train their peers, Habiyaremye said. its success to putting farmers in the driver’s seat, and letting them take ownership of the project. “That grassroots approach is a major part of the reason quinoa is taking off in Rwanda,” said Kim Kidwell, the former WSU spring wheat breeder and executive associate dean in the College of Agricultural, Human and Natu-
ral Resource Sciences. She is now at the University of Illinois. “Cedric and Kim Kidwell his partners have created fair and equitable opportunity for farmers to produce quinoa in Rwanda, which is impressive. He is (doing) what he told me he intended to do in agriculture so many years ago — support Rwandan farmers
with growing more nutritious food for their families and communities.”
Building capacity

So far, they’re close to having a processing unit in Rwanda and expect to add Zimbabwe in the next three years, gradually expanding into other countries. One small machine cleans, processes and packages roughly 2.2 tons per hour. A milling machine would also process up to 2.2 tons per hour. QuinoaHub co-founder Olivier Ndayiramije was Habiyaremye’s college roommate. He joined QuinoaHub “from day one.” Ndayiramije was “the boots on the ground,” managing farmers and research and meeting potential collaborators in Rwanda while Habiyaremye was in the U.S. Ndayiramije is now a graduate student at WSU, studying crop science. “Cedric is a man with a good heart — he is the one with nationally big dreams, and internationally,” Ndayiramije said. “(He’s) the one who is ready to support others, either his friends or not. He is still doing everything he can to support his society/community, as one of his goals is to eradicate malnutrition and children stunting, starting in his country Rwanda and even worldwide.”
Coming to WSU
When Habiyaremye was studying agriculture in college, Kidwell spoke to his class as part of a student trip to Rwanda. “Cedric was the one who facilitated everything for us on that trip,” Kidwell told the Capital Press. “He was our interpreter, problem solver, supply finder, etc. He was ever present, always engaged, always willing to help, always approachable. He worked harder than any of us and was 100% reliable.” While scouting, Kidwell and another professor looked over the mountainous terrain and wondered aloud if quinoa would grow there. They thought the crop would be a good addition to a WSU program that helped families build gardens to produce food. Kidwell had enough dis-

Funding needs
To help establish and expand research in other countries, Habiyaremye launched the global participatory quinoa research fund. His goal is to raise $700,000, enough to fund the project for five years. Habiyaremye expects quinoa’s momentum to continue to grow, as consumers become more aware of its nutritional benefits and adaptability to various climates. “So far we are in eight countries,” he said. “If we manage to secure the funding, we can be in around 25 countries in Africa.”

Andy Zahl, a former Washington FFA state officer, is the new executive director of the organization. He began Oct. 2. “Having a background in agriculture, FFA and student leadership — those are the three basic things that raised me and got me through where I am,” Zahl told the Capital Press. When the job became available, Zahl, 28, said he thought it was the perfect blend of his background and passions. He was state secretary during the 2013-2014 year. “I got to see all the doors that FFA opens up to others,” he said. His favorite memory from that time is visiting the many FFA chapters. “Spending that time on the road, meeting people where they are, eating dinner with their families in their homes — you really get to meet the diverse ag youth that Washington has, north, south, east, west,” he said.

Yakama tribe seeks to talk to biologists about wind project By DON JENKINS Capital Press The Yakama Nation on Sept. 27 asked the Energy Facility Site Evaluation Council to overrule its chairwoman and let the tribe ask state biologists how the Horse Heaven wind and solar project would impact wildlife. A motion filed by the tribe seeks to reopen hearings on the proposed energy project in southeast Washington so that the council can hear directly from Fish and Wildlife biologists James Watson and Jason Fiddora. Watson and Fiddora warned in separate depositions in July that the project as proposed would be a problem for wildlife, particularly for ferruginous hawks, which are listed as endangered under state law. EFSEC Chairwoman Kathleen Drew turned down the tribe’s request in mid-September to have Watson and Fiddora testify in front of the council. Their testimony is unnecessary because Watson and Fidorra are advising EFSEC as it prepares a final report on the project’s environmental impact, according to Drew. Drew overstepped her authority by unilaterally dismissing the tribe’s request, rather than putting the request to the full council, according to a motion filed by tribal attorney Shona Voelckers. The biologists’ testimony would be critical for council members to hear before they decide whether to recommend Gov. Jay Inslee approve the project, according to the tribe’s motion. EFSEC spokesman Karl Holappa said in an email

Ferruginous hawks would be disturbed by the proposed Horse Heaven wind and solar project in southeast Washington, according to Washington Department of Fish and Wildlife biologists. Tuesday the council had no comment. Scout Clean Energy has proposed installing up to 244 turbines and more than 6,000 acres of solar panels near the Tri-Cities. It would be the state’s largest renewable energy installation. EFSEC held eight days of hearings in August as Scout and the project’s opponents — the Yakama Nation, Benton County and citizens group Tri-City C.A.R.E.S. — questioned witnesses about Scout’s plans. The tribe was not allowed to call Watson and Fidorra as witnesses, though they were interviewed in July
by Voelkers and other attorneys. Watson, Fish and Wildlife’s raptor specialist, said livestock grazing helped ferruginous hawks by exposing rodent prey, but in general it was a species particularly sensitive to human disturbance. The project could allow other more-adaptable species, such as ravens and great horned owls, to take over hawk territories, he said, according to a transcript of the meeting. Asked whether the project as currently designed would protect the environment, Watson answered, “Not for ferruginous hawks.” Scout on Tuesday responded to a request to comment by referring to a memo the company sent EFSEC in early August outlining changes to its proposal. The changes include eliminating six turbines to remove “approximately 30%” of the turbines within 2 miles of the Coyote Canyon ferruginous hawk territory. Watson said in his deposition that the department recommended no turbines be within 2 miles of 16 ferruginous hawk territories.

Washington breaks biodiesel law for 14th straight year By DON JENKINS Capital Press
Washington state government went backward last year in complying with a climate-change law that requires agencies and universities to buy biodiesel. The state purchased 18 million gallons of diesel fuel in 2022, but fewer than 1.5 million gallons were biodiesel, missing the legislative mandate by more than 2.1 million gallons. Greenhouse gas emissions from biodiesel are 74% lower than from petroleum diesel, according to the U.S. Department of Energy, citing a study by the Argonne National Laboratory. Jeff Earl, director of state governmental affairs for Clean Fuels Alliance America, said he wasn’t aware of any biodiesel shortage that would prevent the state from buying more. “Washington kind of prides itself on being a leader on the environment,” Earl said. “It would be nice
if they showed that with their state fleet.” Since 2009, agencies and universities that buy diesel fuel are supposed to make 20% of it biodiesel to lower greenhouse gases from heating state buildings, and fueling diesel vehicles, ferries and equipment. The law has never been followed or enforced. Each year, the Department of Enterprise Services issues a report. According to the report for 2022, the state fell short for the 14th straight year. Biodiesel made up 8.28% of the state-purchased diesel fuel, down from last year’s 9.13%. State biodiesel purchases peaked in 2015 at 13.1%, according to previous reports. The Department of Transportation bought 96% of the state’s diesel supply, mostly to fuel ferries. The ferry system bought 1.2 million gallons of biodiesel in 2022, down 15% from the year before. Washington State Capitol supply chain issues.” The state Department of Agriculture, which monitors fuel quality, reported that it is increasingly hard for its inspectors to find retail stations offering fuel with more than 5% biodiesel. The state report, however, focuses on state agency purchases of bulk diesel fuel through statewide contracts. The state could buy more biodiesel, according to Enterprise Services’ report. The University of Washington and Washington State University buy “substantial amounts” of diesel for campus power plants. “Both universities could easily increase their use of biodiesel blends,” the report states. The Pullman campus is the only one in the WSU system that has a power plant
and on-campus fuel station. The nearest fuel suppliers stopped carrying biodiesel, WSU spokesman David Wasson said in an email. A potential supplier was found in the Tri-Cities, but WSU’s storage tank was too small to handle minimum deliveries, and the extra shipping cost for a “short load” was cost-prohibitive, he said. WSU is looking at expanding its diesel storage for on-road and off-road heavy equipment, which could provide enough capacity to take biodiesel shipments from the Tri-Cities supplier, he said. WSU is also looking using renewable diesel to cut greenhouse gas emissions, Wasson said. The University of Washington did not respond to a request to comment. The Corrections Department buys diesel fuel for 10 facilities, but mixes in biodiesel at only two. The department could increase biodiesel use at several prisons, according to the report. cies have been ordered by Gov. Jay Inslee to reduce greenhouse gases when possible. Inslee spokesman Mike Faulk said in an email the state’s low-carbon fuel standard is encouraging biodiesel use and there are more ways to reduce carbon-emissions than in 2009. “Biodiesel is still a great alternative for large vehicles where there may not be readily available battery electric or hydrogen fuel cell options,” he said. Earl said other states have biodiesel mandates. “It’s really, in my opinion, the leader of an agency has to make the effort to acquire and utilize the fuel,” he said. Unlike climate laws that apply to the private sector, such as cap-and-trade, lawmakers did not provide for penalties for not complying with the 20% biodiesel standard. “If there’s no teeth in the law, it’s up to the agencies,” Earl said. “Do they want to put the effort into it?”

As his sugar beet harvest continued, Zach Patterson of Paul, Idaho, liked much of what he saw — considering the challenges of the early season. “The beets that escaped the hailstorms did exceptionally well,” he said. Amalgamated Sugar’s more than 700 grower-owners expect to har-
vest 186,884 acres of sugar beets in Idaho, Oregon and Washington, officials with the Boise-based cooperative said. Growers planted about 180,000 in 2021 and 2022. Harvest for long-term storage started Oct. 2 in the Magic Valley of south-central Idaho and the Upper Snake River Valley to the east, said Brodie Griffin, vice president of agriculture. Last year, sugar content for all beets delivered in September averaged 16.19% after increasing sharply in the final week. Amalgamated harvests some beets early to optimize processing operations and quality. In the Treasure Valley, early harvest continued as of Oct. 3 and the company expected harvest for long-term storage to start Oct. 9, Griffin said. Justice Department files antitrust suit against Agri Stats By CAROL RYAN DUMAS Capital Press
The U.S. Department of Justice filed a civil antitrust lawsuit against Agri Stats Inc. on Sept. 28 for organizing and managing anticompetitive information exchanges among broiler chicken, pork and turkey processors. The complaint alleges Agri Stats violated Section 1 of the Sherman Act by collecting, integrating and distributing competitively sensitive information related to price, cost and output among competing meat processors. “This conduct harms customers, including grocery stores and American families,” DOJ stated in a press release. The complaint, filed in the District of Minnesota, alleges Agri Stats has for years produced comprehensive weekly and monthly reports for participating meat processors, which use the data to set prices and output levels. The reports contain recent data relating to sales prices, worker and farmer compensation and output that are often detailed by facility or company. Participating processors accounted for more than 90% of broiler chicken sales, 80% of pork sales and 90% of turkey sales in the U.S.

The complaint further alleges Agri Stats understood that meat processors have used these reports for anticompetitive purposes and, in some instances, even encouraged meat processors to raise prices and reduce supply. “While distributing troves of competitively sensitive information among participating processors, Agri Stats withholds its reports from meat purchasers, workers and American consumers, resulting in an information asymmetry that further exacerbates the competitive harm of Agri Stats’ information exchanges,”

the press release stated. The complaint alleges Agri Stats’ scheme continues to this day in the chicken processing industry, among others. While Agri Stats paused its turkey and pork reporting after facing several private antitrust lawsuits, Agri Stats has expressed an intent to resume such reporting after these lawsuits’ resolution, according to the Justice Department.
Agri Stats’ rebuttal
Agri Stats contends DOJ’s lawsuit is wrong on the law and bad for consumers. “The lawsuit threatens serious harm to American consumers of chicken, pork and turkey because protein producers depend upon Agri Stats’ reports to help them identify opportunities to reduce production costs to keep prices low,” the company stated in a press release. Contrary to the law and the facts, DOJ’s lawsuit alleges Agri Stats’ reports result in higher prices and lower protein production, the company stated. “Since its inception in 1985, Agri Stats has played a vital role in the United States economy, helping to drive increased efficiency, improved innovation and ultimately provide more chicken, pork and turkey to consumers for less money,” the company stated. DOJ previously recognized there was no evidence of wrongdoing by Agri Stats after it investigated the company for two years over a decade ago and closing the investigation in 2012, the company stated. Instead of its prior investigation, DOJ appears to be relying upon private class actions that have been filed against Agri Stats and protein producers in the chicken, pork and turkey industries. One court has already ruled on summary judgment there was no evidence Agri Stats’ reports contained data that could be used to fix prices or reduce output, the company stated.

The crop started slowly, Shroll said. He planted later than usual, and subsequently had “a decent amount of replants.” His sugar beets caught up, thanks to good midseason conditions, including ample heat units but no long periods with temperatures too high, he said. In the eastern Magic Valley, Patterson replanted about one-third of his crop. “We had a terrible spring here,” including rain and hail in May and June, he said. His early-harvested beets yielded about 32 tons per acre if they were hit by hail and 42 if they were not. “We had quite a few beets affected by those early storms,” Patterson said. “We had a good summer.”

The margin between milk prices and feed costs grew in August to $6.46 per hundredweight. It’s not much to celebrate, but it is up significantly from $3.52 in July — the lowest margin in USDA’s Dairy Margin Protection program, which began in 2019. That margin is the difference between USDA’s calculated milk price of $19.70 cwt. and calculated feed costs of $13.24 cwt. The milk price in August increased $1.80 from July, and feed costs declined $0.61. DMP payments for August are expected to total $120 million. But margins have been below $8 all year, and indemnity payments thus far have totaled more than $1.2 billion.

Idaho producers — 360 and falling — have had to borrow more money than usual and at higher interest rates, he said. Hopefully, things get better in 2024, he said. “But international and domestic demand are nothing to write home about. Correction likely needs to come from the supply side with less milk,” he said.
Indemnity payments
Producers who covered 5 million pounds of annual milk production or less (Tier 1 in the program) at the highest insurable margin of $9.50 cwt. will receive an indemnity payment for August of $3.04 cwt. for the milk they insured. Producers who covered milk above 5 million pounds of annual production (Tier II) at the highest insurable margin of $8 will receive an indemnity payment of $1.54 cwt. Rick for the milk they insured. It’s unlikely much milk was covered at Naerebout that Tier II level, however, given the high price of premiums. Producers can cover their first 5 million pounds of milk at the highest insurable margin of $9.50 cwt. for a premium of $0.15 cwt. Idaho produced 16.6 billion pounds of milk statewide in 2022. While herd sizes differ, average production per dairy across the state’s 360 producers would be about 46 million pounds — well above the 5 million-pound Tier I cap. “With our production and DMC only covering so little of it, Idaho dairymen are utilizing other tools to hedge their risk. Dairy Revenue Protection, contracting directly through a brokerage on the CME and forward pricing through their milk buyer are all typical strategies we see employed,” Naerebout said. USDA is forecasting a margin above $8 in September and October and a margin above $9 in November and December. The agency forecasts an average margin of $6.69 for the year, with the all-milk price averaging $20.47 and feed costs averaging $13.78.
