PLANNING Penang is one of the thirteen states in Malaysia located on the northern side of the peninsula. Local Government has existed in Penang since 1856. The Penang Municipal Council was established on 15 December 1976 under the Local Government Act 1976. The Penang State Authority has agreed on 25 June 2010 for the Penang Municipal Council to be upgraded to the Penang City Council based on provisions under Section 4(2) of the Local Government Act 1976 (Act 171). Subsequently, the Penang Municipal Council was upgraded to the Penang City Council on 1 January 2015. The Penang City Council administers an area of approximately 305.77 square kilometers with a multiracial population of approximately 722,300 people. The Council is an organization that provides Local Authority services for Penang (Island). The Council's activities and operations directly affect people's daily quality of life.

Geography With an area of 295 km2 (114 sq mi), Penang Island is the fourth-largest island wholly in Malaysia. It is also the most populated island in the country with an estimated population of 1,740,405. The mainland portion of the Penang state is known as Seberang Perai (Province Wellesley), and together with Penang Island and other smaller islands, form the state of Penang. It is recommended that the Consulting Architect comply with the requirements as follows make an application to start work :-
CONSTRUCTION
(a) The planning permission given by the Council must be valid at the time of submission application to start work; (b) There must be a valid Building Plan; (c) Obtain approval from the State Authority in relation to the plan demarcation of individual property rights (if applicable); (d) Submit a demarcation plan and any agreement to the Council for delivery of land set aside for public purposes (such as open space, plant sites cleaning, road widening and public facilities); (e) Paying all necessary and required contributions (development fees, donation of tree planting, drainage fees, community facilities and places parking); (f) Architects/Developers are required to submit relevant plans and fees to the Council related plans :(i) Road and ditch plan (ii) Street lighting plan (iii) Sanitation and cleaning plan (iv) Earthwork plan unless exempted (v) Landscape plan and tree planting (vi) Reinforcement concrete plan (R.C. Plan) (g) Letter of undertaking to comply with all the wishes and conditions of the Island Municipal Council Pinang and the government agencies mentioned in Paragraph 1(f) before the Certificate Occupancy removed. (h) At least 4 days before given for the start of construction work after the letter of permission to start work is issued by the Building Director.

Building Plan Approval In Malaysia, the approval of building plan is a vital aspect in the development process. This includes, the application for development approval, building plan approval, infrastructure plan approval and other necessary processes to ensure the Principal Submitting Plan (PSP) in charge of the building complies with all the laws and regulations enacted by the government. In fact, no one should be allowed to begin any development projects without a written consent from the local authority. PSP are required to submit all the relevant drawings, reports and designs to the Local Authority, then, Local Authority will have to go through the documents and give relevant comments and recommendations based on their requirements. These procedures are crucial to ensure that the project will be delivered as per law and regulation, thus protecting the public interest and their rights.
Building Plan Approval Procedure -Application shall be submitted to local authority, and shall comply with the uniform Building By-Laws applicable to Penang. -The local authority shall consult other agencies for their comments. Other agencies include : Building Department of the local authority Engineering Department of the local authority Landscape Department of the local authority Health Department of the local authority State Town and Country Planning Department (JPBD) Land and Mine Office / District Land Administrator (PTD) Public Works Department (JKR) Department of Irrigation and Drainage (JPS) Environmental Department Water Supply Department (SYABAS) Tenaga Nasional Berhad (TNB) Fire and Rescue Department Malaysia (JBPM) Telekom Malaysia Berhad (Telekom) Sewerage Services Department (Indah Water Konsortium or IWK) Department of Minerals and Geosciences (JMG) -The documents must be endorsed by the Building Approval committee. -If no further objections or comments are given, the documents are ready for Council Endorsement and Approval. If ammendments are required, the adjustments must be made and submitted again to the local authority.
