The June 2023 edition of China Fastener World Magazine has already revealed the sign of that ambition. The intention is to protect the environment while achieving corporate growth. Global warning endangers the survival of polar bears. Hisener is striving to use its own power to build ESG-compliant fasteners, so that even small screws can play a key role in rescuing polar bears. Three ESG Guidelines of Hisener

Simon announced three ESG Guidelines of Hisener in this cover story.

On environment(E), the company’s impact mainly derives from energy consumption, waste emissions and resource utilization. To reduce negative impact on the environment, measures are taken to improve the efficiency of energy use, reduce waste emissions, and promote the use of renewable energy.

On the social(S) front, employees are provided with a safe and healthy work environment to secure their rights and benefits, fostering diversity and inclusiveness. Meanwhile, Hisener puts a focus on social responsibility for the supply chain to ensure suppliers’ compliance to securing labor rights and human rights.

On governance(G), a transparent and regulated corporate governing structure is gradually being established through continuous improvement. Hisener strengthens internal governance and risk management and complies with the law to ensure that corporate ethics and ethical codes of conduct are formulated and enforced.

Four Carbon Reducing Measures

The EU will set out to impose carbon border tax in 2026. Hisener has drawn up the following tangible measures in response to future carbon reduction requirements:

(1) Increasing the use of clean energy. At present, solar power can already meet 30% of Hisener’s electricity consumption, and more renewable energy will be purchased in the future.

(2) Investing more in optimizing product design and craftsmanship to increase energy efficiency.

(3) Reducing energy and material consumption by implementing recycling production methods. Recovering energy from waste, such as filtering waste water and oil and reusing it.

(4) Focusing on green procurement to build a green supply chain. Encouraging suppliers to optimize logistics, reduce packaging and use more environmentally friendly packaging materials.

Hisener’s Vision for Carbon Reduction

Simon thinks that reducing carbon emissions and achieving carbon neutrality is a must for every enterprise. The imposition of carbon tax will accelerate the pace of carbon reduction. “For Hisener, we will establish our own carbon emission verification system as soon as possible, use digital means to complete sustainable carbon verification, and establish a whole process to monitor raw materials and all the way to products through carbon footprints. Meanwhile, we will continue to identify and develop suitable emission reduction technologies to reduce emissions and achieve carbon neutrality,” said Simon.

Provide EU Clients with Carbon Emission Data

Simon added that Hisener has followed CBAM requirements to carry out carbon emission calculation for 2023. The data has been provided to EU clients. The company will calculate quarterly emission according to the requirements and report them in time. EU importers and clients can have peace of mind purchasing products from Hisener.

Hisener is Up for Harvesting Global “Green” Opportunities

Many global major economic indicators suggest that technology and low carbon will be the twin driving forces behind corporate profits and industry growth this year. CBSA Initiates Anti-dumping Re-investigation on Certain Carbon Steel Fasteners from China

The Canada Border Services Agency (CBSA) has initiated a re-investigation to update the normal values and export prices of certain carbon steel fasteners originating in or exported from China, and the amounts of subsidy of certain carbon steel fasteners originating in or exported from China.

The products subject to the CITT’s injury order (falling within HS codes 7318110000, 7318120000, 7318140000, 7318150010, 7318150042, 7318150045, 7318150049) are listed as below.

An exporter will be considered co-operative if the requested information is submitted on time and the exporter permits verification of the data. A complete listing of dates of interest is detailed as below.

Where an exporter of subject goods does not provide sufficient information to determine specific normal values or does not permit verification of information submitted, anti-dumping duties will be assessed at the rate of 170% of the export price of the subject goods imported into Canada.

Similarly, in cases where the Government of China or exporters in China fail to provide complete and accurate submissions enabling the determination of specific amounts of subsidy, the amounts of subsidy will be determined in accordance with a ministerial specification pursuant to subsection 30.4(2) of Special Import Measures Act (SIMA).

Exporters that are not the manufacturer of the subject goods (e.g. trading companies, vendors, etc.) will receive normal values and specific amounts of subsidy only to the extent that their suppliers/manufacturers provide sufficient information to the CBSA to permit the determination of normal values, export prices and amounts of subsidy.

Mexico Announces Preliminary Resolution of the AD Investigation on Imports of Threaded Steel Rod Originating in China

On May 24, 2023, Clavos Nacionales Me xico, S.A. de C.V. (“Clavos Mé xico”) and Clavos Nacionales CN, S.A. de C.V. (“Clavos CN”), requested the initiation of the procedure Administrative investigation for unfair international trade practices, in the form of price discrimination, on imports of unhardened low, medium carbon or alloy threaded steel rod, with a diameter equal to or greater than 6.4 mm (0.25 inch), but less than 38.1 mm (1.5 inches) and length equal to or greater than 152.4 mm (6 inches) originating in China, regardless of country of origin.

On June 9, 2023, the “Resolution” accepting the request of the interested party and declaring the initiation of the administrative anti-dumping investigation procedure on imports of threaded steel rods originating in China, regardless of the country of origin, was published in the Official Gazette of the Federation (DOF) (“Initiation Resolution”), in which the period under investigation was set from 1 January to 31 December 2022 and the period for injury analysis from 1 January 2019 to 31 December 2022.

The administrative investigation procedure in the area of unfair international trade practices, in the form of price discrimination, continues, and provisional countervailing duties are imposed on imports of threaded steel rod originating in China, regardless of the country of origin, which are paid under tariff headings 7318.15.99 and 7318.19.99 of the TIGIE, or any other, under the following terms:

a. 8.02% for imports from Jiaxing Chinafar Standard Parts, Co. Ltd.;

b. 17% for imports from Haiyan Wandefu Precision Hardware, Co. Ltd., Lianyungang Xincheng Hardware, Co. Ltd., Jiaxing Longyu Machinery, Co. Ltd., and Zhejiang Junyue Standard Part, Co. Ltd.

c. 48.08% for other exporting companies.

This Resolution shall enter into force on the day following its publication in the Official Gazette.

EU Harbor Carbon Tax

EU planned to include ships traveling to European ports in the ETS program starting January 1, 2024, which is estimated to bring in US$3.6 billion in the form of carbon emission compensation for Europe in 2024. In other words, shipping companies will have to purchase carbon offsets for the emissions produced by ships traveling between two EU ports; for ships traveling between EU and non-EU ports, they will have to bear 50% of the emission fee.

However, seven EU countries, including Spain and Italy, sent a letter to the European Commission calling for a suspension of the program to prevent shipping companies from avoiding European routes and shifting trade to nearby Mediterranean ports such as Tangier in Morocco, or Port Said in Egypt, which are less than 300 nautical miles from the EU coast. According to the latest estimates by Shipping Consultants, assuming a carbon price of € 90 per ton, the ETS cost for a container shipping between Europe and Asia in 2024 is estimated to be as high as €810 thousand.

Despite the high cost of ETS, it is reported that Maersk, the container leader, made a profit of US$30 billion in 2022. The bill generated by ETS is only a drop in the bucket when compared with the revenue of international shipping, so it may not have much impact on the end price. However, some EU countries on the Mediterranean coast, including Portugal, Greece and Cyprus, have publicly said that the ETS program, could shift carbon emissions to other parts of the world, and that companies may take longer routes to avoid stopping at EU ports, and may even increase greenhouse gas emissions as a result.

Chin Well Holdings Reports Earnings Results for Q4 and Full Year Ended June 30, 2023

For the fourth quarter, the company reported sales were MYR 95.61 million compared to MYR 196.87 million a year ago. Net income was MYR 5.08 million compared to MYR 27.61 million a year ago. Basic earnings per share from continuing operations was MYR 0.0177 compared to MYR 0.0964 a year ago.

For the full year, sales were MYR 456.45 million compared to MYR 657.84 million a year ago. Net income was MYR 39.46 million compared to MYR 95.99 million a year ago. Basic earnings per share from continuing operations was MYR 0.1378 compared to MYR 0.335 a year ago.

Yuxing Fastener to be Listed on Beijing Stock Exchange

Yuxing Fastener (Jiaxing) Co., Ltd. of China announced on January 8 that it has planned to be listed on Beijing Stock Exchange. The company has long been committed to the R&D, production and sales of a series of nuts. In addition to providing standard fasteners, it also supplies medium to high level nuts mainly for the wind power, automobile, engineering, machinery and many other downstream industries.

It is known that Yuxing is one of the leading enterprises in the domestic Chinese fastener industry specializing in production of nuts with a wide range of varieties and specifications. It strictly controls the quality of its products and insists on adopting high quality steel and advanced cold forging technology. Its products have passed the ISO:9001 quality management system, CE, and automobile industry quality management system certifications, and it is capable of producing Chinese GB standard, international ISO standard, German DIN standard, U.S. ANSI standard, British BS standard, Italian UNI standards compliant and special nuts.

Tong Ming: Market Began to Stabilize After Q3, 2023

Tong Ming’s revenue last year was still lower than 2022 due to selling prices dragged down by raw material costs. However, the company observed that China’s fastener market demand gradually stabilized since the third quarter of 2023. Under the fierce competition in the whole market, Tong Ming’s market share of fasteners in China has not decreased but increased instead, and Tong Ming continues to play a leading role in the industry.

Tong Ming pointed out that since the second half of 2022, the fastener industry had turned conservative and inventory levels had been high. However, by the third quarter of 2023, inventory adjustments in European, American, Oceanian, and Chinese markets were made, and the overall transaction was more than in the first half of 2023. In the export market, China continues to be suppressed by trade tariffs and affected by the Russia-Ukraine war, so Tong Ming views this market conservatively.

Tong Ming’s consolidated revenue in the first three quarters of 2023 was RMB 10.1 billion, a year-on-year decrease of 13.71%; net profit after tax was RMB 258 million, a year-on-year decrease of 64.51%; EPS was RMB 1.27, lower than RMB 3.6 in the same period last year. The company plans to sustainably increase its production capacity in the next 3 to 5 years, which is expected to be up to 80,000 tons.

Tengda Technology Has been Listed on Shenzhen Stock Exchange

On January 19, Shandong Tengda Fasten Tech Co., Ltd. has been officially listed on the Shenzhen Stock Exchange main board, becoming the first enterprise in Shandong Province listed on the Shenzhen Stock Exchange main board after the registration system was adopted.

NAFCO to Build a Malaysian Plant

NAFCO, a leading Taiwan-based manufacturer of fasteners for aerospace and high-end industrial applications, announced on October 27 that it plans to invest in a Malaysian subsidiary in response to the company’s future operational development and planning. The initial investment is expected to be approximately US$5 million and the plant will specialize in the production of automotive and aerospace fasteners.

Founded in 1977, NAFCO currently has two production bases in Taoyuan, Taiwan and Jiangsu, China. The completion of the Malaysian plant will further enhance its production capacity in the automotive and aerospace fastener fields. Sundram Fasteners Limited Enters into MoU with Government of Tamil Nadu for INR 1,411 Crore Investment

Sundram Fasteners Limited, one of the largest suppliers to OEMs and automakers globally, entered into a Memorandum of Understanding (MoU) with the Government of Tamil Nadu for a proposed investment of INR 1,411 crores during the Tamil Nadu Global Investors Meet 2024, Chennai.

The investment is proposed to be made in Sundram Fasteners Limited factories across Tamil Nadu situated at Padi; Mahindra World City, SEZ; Velappanchavadi; Gummidipoondi; Hosur; Aviyur, Madurai and Mittamandagapattu, Villupuram. Among the aforementioned, the investments made in Mahindra World City, SEZ fall under both the Industrial Policy and the EV Policy.

The planned investment spans up to 2027–2028 and will be used for capacity expansion of existing products, including components for electric vehicles. This strategic move solidifies the company’s commitment to the state’s economic development,

generating employment opportunities for over 1,500 individuals in Tamil Nadu.

Bulten Establishes Operation in India Through Joint Venture Company

Bulten is establishing manufacturing operations in India through a newly formed joint venture company – Bulten Radium Industries Private Ltd. – alongside two partners: Radium Fasteners Private Ltd. (Radium) and ZJK Precision Parts HK (ZJK). The driver is an increased need for domestically produced micro screws among international customers in the electronics sector with production in India.

“Our ambition is to increase sales, primarily of micro screws, to companies in the electronics industry. India is a growing market for this segment, as many international manufacturers of electronics are locating more and more of their Asian production in India. This is the driver behind our new operation in India, and we plan to begin production during the first half of next year,” says Anders Nyström, President and CEO of Bulten. The operation will be based at a new production plant currently being constructed in Jamnagar, in the western Indian state of Gujarat. The aim is to be fully up and running during the second quarter of 2024, and to have about 50 employees. The building will be leased by Bulten Radium Industries Private Ltd. and therefore involves only limited investment costs for Bulten. Bulten has a 51 percent holding in the newly formed joint venture company. ZJK has previously been a partner to Bulten for the manufacture of micro screws in China, and Radium is a newly formed company owned by experienced players in the fastener industry in India. As well as the newly started JV company, Bulten also operates in India through the newly acquired distribution company Exim & Mfr Enterprise.

Optimas Announces Plan to Develop Fastener Manufacturing Facility in Monterrey Mexico to Support Regional Sourcing Strategies

Optimas Solutions, a global industrial manufacturer/distributor and service provider, announced it will open a cold form manufacturing plant in Monterrey, Mexico in the second half of 2024.

The Mexico production center will complement world-class fastener manufacturing facilities in Wood Dale, IL, and Droitwich Spa in the United Kingdom and continue the company’s near-shoring efforts to minimize supply chain risk.

Ningbo Xinfeng Machinery Industry

Self-drilling Screw with Speed Upgrade, Penetrating Ultra-hard Steel Plates

Xinfeng started with expansion screws and developed into a manufacturing and trading company which includes all kinds of screws, with a focus on hex flange head self-drilling screws strictly complied with AS3566.2 Standard. It was founded in 1995 when the Chinese market was in full swing for infrastructure construction. The founder found in his market research that hex washer head self-drilling screws can be widely used in factory construction, so he purchased his first manual punching machine in 1999 to start manufacturing self-drilling screws, and then his first high-speed self-drilling screw forming machine in 2006. He built a 10,000 m2 factory in 2015, and in 2018 and 2019 respectively purchased his first and second carburizing quenching furnaces to take his annual output above 20,000 tons. At present, his factory is equipped with 100 machines including those for cold heading, self-drilling screw forming, thread rolling, shank slotting, etc., with a monthly capacity of over 600 tons of various screws. The company is now able to provide self-drilling screws with hex washer head, modified truss head, countersunk head and pan head, as well as heavy-duty chipboard screws with round washer head and countersunk head. These products are available in materials such as 1022A-10B21-304-410, and in various colors.

The company also has a laboratory where condensation test chambers (coating bonding), environmental test chambers (environmental simulation), and salt spray test chambers (corrosion simulation) were purchased to quickly simulate environmental changes in real-world applications. Product process monitoring equipment includes tensile testers, hardness testers, microscopes and projectors. Quality control can be carried out according to drawings, and customized production is also available for customers.

Satisfying customer's actual demand is the first priority in Xinfeng's production and operation. Especially with hex washer head screws with EPDM bonded washers, Xinfeng keeps improving production process and attaches great importance to customer's requirements on tapping speed. From formerly penetrating within 11 seconds to now within 4 seconds, continuous pursuit of quality and speed yields a good result. In addition, Xinfeng continuously develops new fasteners by adjusting materials, self-drilling screw forming and heat treatment technique. Months later, the company successfully developed a new self-drilling screw for customers which can penetrate through ultra-hard high-strength steel plates.

Xinfeng exports heavy duty truss head and countersunk head wood construction screws to Europe, and hex washer head screws with EPDM bonded washers to Mexico. Particularly, Xinfeng’s Aluminum-Zinc Coated screws production and sales to Southeast Asia hit a record high. General Manager Xufeng Feng said that the company's aim is to manufacture screws that save efforts for customers, "In the future, we will actively innovate and update our carburizing quenching furnace. Geobo Expands Fastener Sales with New Product Release in 2024

In 2023, amidst the global economic downturn and deteriorating trade environment, Ningbo Geobo Hardware Co., Ltd. recorded an over 20% growth in annual sales against the trend, which could be attributed to its technological/product/cost advantages accumulated over the years in the industry as well as its excellent sales team.

Replicating Precision Engineering Concepts to Fastener Manufacturing

GM Ying studied at Harbin Engineering University, and after graduation, he joined a shipbuilding company to work as a designer. Nevertheless, he seized the opportunities to learn from his classmates in the field of foreign trade and searched for information to familiarize himself with the products, and then set up a trading company 5 years after the establishment of Xintai, successfully transforming it into an enterprise that can do both manufacturing and trading. "With the growing volume of business, I gradually felt overwhelmed as the head of the company who was also in charge of purchasing and sales, so I chose to set up a trading company to communicate more directly with customers, and the number of foreign customers grew rapidly after that. Before that, our customers were mainly foreign trading companies," said GM Ying.

Oxidation Colored Stainless Steel Screws

Japanese Ikeda Metal Industrial has developed stainless steel screws colored blue, yellow or red by oxidation coloring treatment. These screws are designed to help operators detect foreign substance contamination at the food production site at an early stage and to prevent shipment in a contaminated state. Stainless steel screws are commonly used in the assembly of food manufacturing machinery because of their corrosion resistance, but they can be difficult to locate if they become loose and fall off and get mixed with milk, mayonnaise or other white colored foods. In fact, there have been cases where packaging has been mixed with screws and shipped unknowingly.

To solve this problem, Ikeda Metal Industrial designed a special surface treatment called "stainless steel oxidation coloring" for coloring stainless steel screws to comply with the Food Sanitation Law. By easily identifying the color of the screws, even if it is mixed with food, it is possible to detect foreign substance contamination at an early stage and prevent shipment in a mixed state.

Welded Bolts Not Requiring Heat Treatment

Welded bolts for high-strength steel plates have been in high demand. High-strength materials require the use of high-strength welded bolts, so conventional welded bolts are made of heat-treated high-strength steel. The manufacturing of welded screws calls for high carbon content in the material to increase bolt strength. However, the high carbon content results in poor weldability and sometimes reduces weld strength.

On the contrary, Japanese Yamashina's welded bolts are made of metal materials that do not require heat treatment, which saves heat treatment costs and improves quality. Due to the use of high strength materials, machinability is less desirable and advanced technology is required for its manufacture. Yamashina overcame this problem and began selling its welded bolts.

The characteristics of this product are as follows:

● Using high tensile strength materials

High-strength materials with a tensile strength of about 800 MPa. No need to harden the bolts by heat treatment.

● Achieving high-strength welding

Low carbon content in the material carbon makes for good weldability and enables safe and high-strength welding. To use Yamashina's welded bolts, weld it to a steel plate and stand it up.

Japan's First Colored Titanium Blind Rivets

To meet the increasingly diverse and complex needs of the industry, Nissen Rivet in Japan has for the first time achieved 100% localized manufacture of titanium blind rivets using advanced processing technology. In addition to improving efficiency and productivity, the applications of the blind rivets as an environmentally friendly fastening technology are expanding. The company also offers colored titanium blind rivets (using anodized coating).

The most important characteristic of titanium is its high corrosion resistance. It is ideal for use in corrosive environments.

The weight is about 60% of stainless steel and iron. Ideal for weight reduction, e.g. for car and motorcycle silencers and truck bodies.

Titanium hardly ages over time and is highly recyclable. It also has nontoxic and anti-bacterial properties that make it a human-friendly material compared to other metals.

ICC Insert Nut

Japanese Iwata Bolt headquartered in Tokyo has recently added a new product “ICC Insert Nut” into its wide range of fastener portfolio, which, according to the company, can solve various plating problems.

This new product currently available in the size range of M3-M8 and with improved plating feasibility and silver clearance can create a closed-end by crimping the lid and eliminate common issues such as plating deposition. It can be applied to transportation, electronics and many other industries. Tamper-proof Recess Inner

Recess Inner ® rolled out by AzumaNeji from Japan is a tamper-proof part that restrains unauthorized removal of bolts by loading it into the recesses of a bolt. It was developed to improve safety by reducing the risk of destruction or disassembly to machines and systems. In addition, it also prevents dust from entering the hexagonal hole.

Three types (BARNACLE, FLAT, and PLASTIC) with different characteristics are available in this lineup. The stainless steel "BARNACLE" and steel (stainless steel color plated) "FLAT" types can be removed with a special tool, while the "PLASTIC" type leaves traces when removed. The "Barnacle" is made of stainless steel and has high corrosion resistance, while the "Flat" is suitable for use where design is prioritized. Conventional machines use a "rule-based" method, in which inspections are performed based on rules set by human operators. In addition, many quantitative settings had to be made for each inspected item on the captured image, which required time and skill to set up. Asfa® WP Waterproof Screw

Nitto Seiko Corporation has released Asfa® WP, a new concept O-ring embedded screw that offers high axial force performance and waterproof performance. Its unique structure factors in product misalignment and stable carrying during the assembly process. This product, which has a different shape from general waterproof screws and offers various advantages in addition to waterproof performance, is patent pending.

Because of the structure that incorporates an O-ring in the lower shaft portion of the screw neck, general waterproof screws require counterboring the fastened object and the contact area with the screw head is small, making it impossible to fasten with high axial force. The most important thing in fastening screws is to secure axial force. The flat washer on the underside of Asfa®WP provides a larger contact area with the fastener than an O-ring does, which reduces surface sinking of the fastener and enables fastening with higher axial force. In addition, since no counterboring is required for the fastener, it contributes to the customer's total cost reduction.

When we use general waterproof screws with embedded O-rings, if fasteners misalign, the O-ring is not compressed, resulting in loss of waterproof performance. With "Asfa®WP," the O-ring is positioned on the periphery of the head, which allows the O-ring to be compressed evenly and provides stable waterproof performance.

Strong Market Demand Despite a Plunge in Fastener Export Value

From 2019 to 2022, China's fastener export value to the world continued upward. It peaked in 2022 breaching the USD 10 billion mark. The growth margin from 2019 to 2022 alone was high at 74%, indicating a large global demand for Chinese fasteners. However, unresolved inventory destocking issues in many countries caused the export value to plunge 43% in 2023 to the USD 6 billion mark, rolling back to a level slightly below 2019’s

The top five export destinations for Chinese fasteners in 2022 were the U.S. (USD1.66 billion), Germany (USD608 million), South Korea (USD577 million), Vietnam (USD481 million), Russia (USD479 million). In 2023, the top 5 changed to Russia (USD417 million), Germany (USD414 million), South Korea (USD372

million), Japan (USD325 million), and India (USD311 million). In contrast, Russia jumped from the fifth to the first place, while the US was no longer in the top five. It is worth noting that Germany has been the second largest export destination for Chinese fasteners over the past two years, despite the EU's ongoing anti-dumping duties on Chinese fasteners. This shows that Germany as the head of the EU is still an indispensable and important trading partner for Chinese fastener companies.

CBAM to be Amended Before Formal Implementation; China Plays One of the Key Roles

Since the announcement of CBAM, there has been a wave of resistance across the world. CBAM is almost a full-range and structural impact on a country's industry and economy that can be described as "astronomical" in terms of its scale. China could face a rise of 4% to 6% in the export cost of Chinese steel products due to CBAM. China Iron and Steel Association (CISA) called CBAM a new trade barrier to Chinese exports: “If other countries adopt reciprocal and similar trade protection measures to protect their interests, it will lead to higher trade costs and an increased risk of

China proposed multilateral discussions at the WTO's Committee on Trade and Environment (CTE), and pointed out loopholes in CBAM including mirroring of emission reduction under EU ETS in the emission reduction of another country, the lack of global carbon intensity standards and disagreements over carbon pricing mechanisms between different jurisdictions. China expressed its stance against any form of trade or technical barriers in the name of climate change.

Specifically regarding carbon pricing, a Chinese climate policy official said that it is currently not possible to require China to set the same carbon price as EU’s, because both parties set the price according to different development conditions, as well as emission targets which will take time to achieve. In 2023, the carbon prices in China hovered around RMB 55 per ton of CO2, compared to an average price of around €80 per ton in the EU carbon market. National Center for Climate Change Strategy and International Cooperation (NCSC, China) said that carbon price is determined by many factors, including emission reduction cost and labor costs. “The gap between China's and EU's per capita income and carbon price reflects China's acceptability of emission reduction costs and China's reasonable carbon price,” said NCSC.

In response to the comments from China, Gerassimos Thomas, Director General for Taxation and Customs Union Affairs of the European Commission, contributed an opinion piece to South China Morning Post in Hong Kong on November 15, 2023. He welcomed China's proposal to set up a high-level dialogue between China and the EU on CBAM, and acknowledged that it is important to do so in the fullest transparency when designing the mechanism. He mentioned his active and transparent outreach to Chinese authorities and businesses, including to EU businesses active in China, to better understand China’s carbon pricing reporting system and methodologies so EU can most effectively take them into consideration after the end of the CBAM transitional period.

Regardless of any amendments made to the aforementioned CBAM, the EU has taken the first shot and is not going to turn back. Chinese fastener companies will be closely monitored by CBAM and they have to find a way out of the new carbon cost dilemma. In recent years, China's iron and steel industry has been in full swing to reduce emissions. 89 enterprises have completed a makeover toward ultra-low emission. The demand for Chinese fasteners has been on the rise due to the country's robust manufacturing capabilities. As of my last knowledge update in January 2023, China has been a leading exporter of fasteners globally. The trade statistics fluctuate based on global demand, economic conditions, and other factors. HS code 7318 is the most demand of China fastener category.

China’s Steel Wire Rod Export at New Record High?

Could be a Hidden Pitfall

China's steel industry has seen tremendous volatility over the past three years, with domestic demand declining at a compound annual growth rate (CAGR) of minus 1.3% year-on-year after peaking in 2020. In terms of steel export, although it hit a seven-year high of 90.26 million tons in 2023, up 36.2% over 2022, about 80% of China's steel companies suffered losses in the same year, indicating that although China's steel poured in the global market, those companies didn’ t benefit significantly.

Fluctuation of Chinese Steel Wire Rods

The fluctuation of steel also affects wire rods. How is this reflected in wire rod production volume, export volume, export value and export unit price? This article analyzes the statistics for the past six years, including the whole time line in and out of the pandemic, and gives our readers a glimpse of the fluctuation of Chinese steel wire rods.

Production Generally on the Decline

Steel wire rods fluctuate in line with steel. China's three major industries — real estate, infrastructure and manufacturing — have all been facing shrinking demand in recent years, with domestic steel demand peaking at 925 million tons in 2020 and then declining year-on-year. Domestic production of steel wire rod (Figure 1) also peaked at 165 million tons in 2020, and then fell 42% to 96.24 million tons in the next year, nearly halved. It rebounded 46% to 141 million tons in 2022 but didn’t make it back to the peak volume, and then immediately fell in 2023. The trend line (dotted line) is generally still pointing down.

As observed in Figure 1, although steel wire rod production rebounded after the end of the pandemic, it will take some time to get back in its heyday, given the shrinking demand from the three aforementioned industries and the challenge of a downward trend in China's macro-economy.

Export at 6 Year High

Wire rod export volume (Figure 2) did not fluctuate much during the pandemic from 2018 to 2022, averaging 2.05 million tons, suggesting that China's wire rod export to the world remained stable during the pandemic. However, it is worth noting that the export grew 8.8% in 2023, reaching a new high in the past six years. This indicates the world has higher demand for price-competitive Chinese wire rods after the pandemic ended, which is in line with the fact that Chinese steel export reached at a seven-year high in 2023.

Export Value Halved After the End of the Pandemic

The change in export value (Figure 3) is divided into three phases. In the first phase, from before the pandemic to the beginning of the outbreak (2018 to 2020), the export value of wire rod remained stable at an average of US$25.5 million, and here we can already see a slight increase. In the second phase from 2020 to 2022 when the pandemic was prevalent, export took a double jump, by 67% to US$46.1 million and by 31% to a peak of US$60.5 million. In the third phase, from 2023 onwards, export value dropped 47% to around US$32 million, almost halved, suggesting that China's wire rod export soared during the pandemic, but it lost significant profit margins after the pandemic ended, but in the long run, it just returned to the normal price level recorded in the first phase.

Export Unit Price Down Significantly After the End of the Pandemic

The export value also fluctuated similarly with the export unit price. The unit price (Figure 4) increase surged to a new high in the second phase, with a significant price increase of 64.9%, but then began to plummet by half, and even showed a negative growth, down 51% in the third phase. There was significant pressure of price cut after the end of the pandemic.

Domestic Demand Cools, Export Demand Increases

Maintaining Profit Margins will be a Priority

As seen from the above data, China is facing the challenge of downturn in three major industries and the domestic macro-economy, and the domestic production of steel wire rod is slowing down. On the contrary, export demand is at a record high. 2024 is a critical time to expand overseas market share. However, since both export value and unit price have been halved since last year, there is a hidden pitfall with profit margin. Profit margin is what relevant industry players need to keep stable.

As one of the key demand and supply players in the global fastener industry, China's annual fastener exports and imports are significant. Although 2023 is a down year for the global fastener industry, according to the latest data released by China's General Administration of Customs (http://stats.customs.gov.cn/), China's exports of fasteners (HS code 7318) in 2023 still amounted to US$6.28 billion, with Russia, Germany, S. Korea, Japan and India being the main export trading partners and its imports amounted to US$1.79 billion, with Germany, Japan, the United States, Taiwan, and Italy being the major sources of imports. It is estimated that in the second half of 2024, after the global economy gradually warms up, there will be another wave of significant adjustments and changes in the import and export data.

Due to the wide variety of fastener products, the focus of each customer base and demand of the industry sectors will appear some differences, so if the fasteners are divided into subcategories, one can find that the top trading partners of certain subcategories still appear some slight differences.

Imports of Fastener Subcategories

In descending order of value, the top three fastener subcategories imported by China were 731815 Other Screws and Bolts (about US$860 million), 731816 Nuts (about US$330 million) and 731822 Other Washers (about US$160 million).

It can be observed from the above data that many countries in Europe, the United States, Japan, South Korea and Southeast Asia still have a great demand for Chinese fasteners, and on the other hand, the local market in China also continues to import a considerable amount of fasteners from other countries to meet the needs of its domestic industries. Although China's economic growth and development prospects are still facing great challenges, making the overall supply and demand performance of Chinese fasteners much weaker than that of the prepandemic situation. However, if importers/exporters can actively identify the key demand products in different markets around the world from these statistics and explore more possible new markets to make up for the lost orders in certain countries/regions, I believe that the performance of China's fastener market will still be worthwhile to be expected in 2024.

International Fastener Expo 2023 U.S. Fastener Market Resilience Under Global Challenges

Over 50% Increase in Number of Exhibitors

More than 700 exhibitors including more than 100 first-time exhibitors, a 55.5% increase over the previous show's record of 450 exhibitors. This is a new history made in the IFE show spanning from October 9 to 11 last year. According to a survey by Mordor Intelligence, the North American industrial fasteners market value would reach US$20.05 billion in 2023 and will reach US$23.53 billion in 2028, with a CAGR of 3.25%, which is an indicator that the U.S. fastener market has not lost its touch in attracting business opportunities.

Last year's keynote speeches focused on the resilience and adaptability of the U.S. fastener industry in the face of rapid change, as well as nearshore and onshore sourcing strategies for OEMs and distributors, cloud-based digital technology, 3D computing and AI technology ready for distributors, and succession in the fastener industry. The U.S. fastener industry is also facing the challenge of technological transformation.

Visitors from Many Countries

In addition to local U.S. distributors and buyers, there were also buyers from India, Singapore, Indonesia, Germany and Saudi Arabia. Among them, Fastener World saw quite a many exhibitors from India, from which we can tell that uprise of "Indian Manufacturing" has prompted Indian exhibitors to seize the opportunity of striking deals with U.S. exhibitors.

Taiwanese Exhibitor Tripled in Number

This show made a great success in 2023. There were up to 90 Taiwanese exhibitors who applied for booths through Fastener World to grab the lion’s share of the U.S. market. That’s triple the number of around 30 exhibitors recorded in the previous show. The 90 exhibitors took up a large chunk of the venue. Some Taiwanese exhibitors said it was tremendously helpful to meet with buyers from many countries at the U.S. venue. Many buyers found their needs by viewing the suppliers’ ads in Fastener World magazines and then approached their booths to purchase products. A post-show survey conducted by Fastener World revealed that most of these exhibitors would exhibit again in 2024.

Fastener Poland 2023 Photovoltaic and Other Energy Industries in the Spotlight

This fastener fair which took place in Poland's second largest city, Krakow, on October 18-19, 2023, reached its 6th edition and brought together 148 exhibitors from Turkey, Italy, Czech Republic, Spain, China, Switzerland, Sweden, UK, USA, Taiwan, and Poland.

Poland is one of the world's top 10 markets for photovoltaics, so one of the main focuses of the 6th edition was the product display by manufacturers and suppliers of connectors and racks for photovoltaic, energy and electrical engineering, attracting buyers of photovoltaic, hydroelectric, wind and geothermal energy, EPC (Engineering, Procurement, Construction) contractors, as well as suppliers of network infrastructure and integrated renewable energy solutions.

Additionally, the organizer held the "Ecology and Economy in the Fastener Industry - Challenges and Opportunities" conference during the fair, where the topics in discussion included the assumed impact of CBAM regulations on imports from outside the EU, green revolution, circular building, and carbon reduction in car manufacturing plants.

In the course of distributing magazines and recommending fastener suppliers on-site, Fastener World met visitors from the Netherlands, Ukraine, Slovakia, Poland, among other countries. Fasteners World Middle East 2024 Swarming Visitors with Inquiries Demonstrate Strong Purchasing Potential

Fasteners World Middle East, a professional international exhibition for the fasteners, hardware, industrial components and related raw materials/metal processing technology industries, was held at the Expo Centre Sharjah in UAE from January 8 to 11 this year, which is also a thematic sub-show of the well-known SteelFab.

The 4-day exhibition attracted many key industry players and potential buyers from the local and neighboring Middle East countries to observe the latest developments and innovations in the industry. Supported by the local government's policy of encouraging the metal fabrication industry to undergo digital transformation to enhance market competitiveness and gain more opportunities for development, the exhibition featured not only fasteners & metal-related processing technologies, but also other welding/cutting, power tools, machine tools, pipes & tubes, stainless steel products, as well as AI and robotics.

Hundreds of exhibitors from the UAE and other countries participated in the event, looking forward to deepening industry interactions and exchanges through the annual Middle East exhibition platform, and more importantly, promoting their brands to enhance their image and accelerating their steps to look for companies they can further establish business cooperation with in the future expansion of the Middle East market. Exhibitors from Germany, India and the UK, the largest overseas exhibitors groups this year, were also seen setting up their own national pavilions to showcase latest products, technologies and peripheral services.

According to the observation of Fastener World's on-site staff, most of the local Middle East buyers who had a large demand for fasteners during the show were general metal manufacturers, large-scale project builders (e.g., steel mills or power plants), and telecommunication transmission parts manufacturers. Many traders also came to our booth to ask for the latest publications and suppliers info, mainly inquiring about standard fasteners for various applications, while the demand for special fasteners was relatively low.

A few local buyers told Fastener World's on-site staff that “price, quality and flexible payment methods” were their key concerns when conducting pre-purchase evaluations. They also hoped to find Taiwanese fastener suppliers that can offer high cost–performance ratio of products through Fastener World’s multiple suppliers info platforms, including printed/digital publications, online buying and selling systems, and comprehensive supplier databases.

As the UAE is one of the most important import markets for fasteners in the Middle East, and a key gateway for many overseas fastener suppliers to enter the Middle East fastener supply chain, the on-site presence of Fastener World staff will help fastener suppliers interested in expanding their business in the Middle East or the neighboring emerging markets to build up more cooperation with the local buyers.

CBAM has entered the pilot phase since last October. The affected business owners has been required to prepare carbon emission data for Q4 2023 calculating from October 1, 2023 onwards. This transition period doesn’t require the owners to pay for the amount of carbon emission exceeding the quota. The first year of the pilot phase allows the owners to use in their submitted data the default value or verification regulations applicable to the manufacturing countries. CBAM will come into force in 2026, and from then on, products exceeding EU’s carbon emission threshold and entering the EU market will be subject to a carbon tax.

According to the Commission, EU importers of affected products must submit data on the greenhouse gases generated from the entire manufacturing process. The first report has been submitted by January 31 this year on a quarterly submission basis. On October 1, 2023, an online registration platform which EU set up for the transition period went live, through which the importers could make calculations and write emission reports. The Commission continues to provide detailed guidelines, instructions, and online training resources.

Taiwan exports up to 75% of its fastener production and in 2022 it translated to NTD 200 billion export value, of which 25% was exported to Europe. Taiwan Ministry of Economic Affairs (MOEA) estimates as many as 3,500 manufacturers and traders in Taiwan to take the impact of CBAM, and one of the potentially affected groups is the fastener industry having a total of about 1,860 fastener companies. Fastener owners prioritizing their export target to Europe will bear the brunt. The American and European fastener owners along with a few in Japan have gone ahead collecting data and

implementing measures for carbon reduction. So, how much have they deducted from their carbon emission? What measures have they taken that have been verified to be of reference to us? What are their carbon reduction targets? Referencing their experience, this article aims to help readers get into the basics of carbon emission data and encourage business owners to think up ways to reduce carbon emission.

• This article will narrow down to two topics carbon emission statistics and carbon reduction measures.

For the former topic, I will select American, European, Japanese and Indian listed companies with weight in the fastener industry, and extract carbon emission data from their ESG reports into separate tables to help readers understand their respective carbon emission volume and target setting. These tables include Scope 1 (direct emission from a company’s own manufacturing process, facilities and use of transportation vehicles), Scope 2 (indirect emission from a company's purchased energy sources), Scope 3 (all indirect emission from a company throughout the external supply chain, including the emission from business trips and within product lifecycles), as well as the sum of carbon emission.

For the latter topic, I will lay out their respective carbon reduction measures. The common ones include producing green power, planting trees, installing solar panels, and I will not repeat those here. Rather, ways that are unique to their characteristics will be picked up for readers to brainstorm and encourage discussion for more creative solutions.

We can observe 3 characteristics from the carbon reduction measures of the 16 iconic companies above. One, companies falling under the fastener product category put their focus on optimizing the “manufacturing process” (including threading, forming, heat treatment, packaging), “ logistics/transport” , “ inventory ” , and “customer service” , while steel, aluminum and wire rod companies in the upper stream are locked on developing carbon-reducing material technology. Two, upstream material companies like Alcoa and Nucor emit over 10 million tons of carbon, while fastener companies fall between several thousand tons to several hundred thousand tons. Three, in my investigation of 43 listed companies from the U.S., Europe, Japan and India, I found that 13 companies (30% from the U.S. and Europe) release ESG reports annually. I could only find one Indian and two Japanese companies releasing the reports online. It is an indication that those who have scientifically verified the effectiveness of their ESG measures are still mostly European and American companies. ESG has yet to take the mainstream in Asia.

The EU and U.S. carbon taxes are coming up close and poised as a threat to Asian and Taiwanese fastener companies. Some American and European companies have already done Scope 1 and 2 a few years ago, and some of them are working on Scope 3. The fastener leaders in India and Japan have completed Scope 1 and 2. As far as Taiwan is concerned, with its one-of-a-kind inter-collaborative domestic supply chain, a mutually-beneficial approach could be for Taiwan Industrial Fasteners Institute (TIFI) and Taiwan Fastener Trading Association (TFTA) to set up a "Shared Platform of Carbon Reduction Intelligence and Technological R&D". This could be an online sharing platform or a physical forum, where Taiwanese fastener experts gather to extract the technological essence of the aforementioned 16 iconic companies, brainstorm and refine into carbon reduction technologies suitable for Taiwan. That is the way to catch up with the big trends around the world.

Less Reading Time! Compact Version of CBAM Regulation

For those who struggle with the daunting length of CBAM regulation in full text, Fastener World editors have gone through all 53 pages of the regulation, and extracted the essential parts into a brief article for fastener business owners. This article will help you get familiar with at least 80% of the core context of CBAM, and help you get into the swing of it.

The editors have slightly simplified abstruse statements in the Regulation and cut out repetitive and redundant words and phrases to make it easier to read. Without further ado, here are the key CBAM excerpts.

Regulation (EU) 2023/956 of the European Parliament and of the Council (10 May 2023)

Critical Definitions

1. ‘Direct emissions’ means emissions from the production processes of goods, including emissions from the production of heating and cooling that is consumed during the production processes, irrespective of the location of the production of the heating or cooling. For 7318 – screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, carbon dioxide washers (including spring washers) and similar articles of iron or steel, only direct emissions are to be taken into account.

2. ‘Indirect emissions’ means emissions from the production of electricity which is consumed during the production processes of goods, irrespective of the location of the production of the consumed electricity.

3. ‘Embedded emissions’ means direct emissions released during the production of goods and indirect emissions from the production of electricity that is consumed during the production processes. The authorized CBAM declarant shall keep records of the information required to calculate the embedded emissions until the end of the fourth year after the year in which the CBAM declaration has been or should have been submitted.

4. ‘Actual emissions’ means the emissions calculated based on primary data from the production processes of goods and from the production of electricity consumed during those processes.

5. ‘Ton of CO2e’ means one metric ton of CO2.

6. ‘CBAM certificate’ means a certificate in electronic format corresponding to one ton of CO2e of embedded emissions in goods.

7. ‘Surrender’ means offsetting of CBAM certificates against the declared embedded emissions in imported goods or against the embedded emissions in imported goods that should have been declared.

8. ‘Default value’ means a value calculated or drawn from secondary data, which represents the embedded emissions in goods. When actual emissions cannot be adequately determined by the authorized CBAM declarant, default values shall be used. When reliable data for the exporting country cannot be applied for a type of goods, the default values shall be based on the average emission intensity of the X % worst performing EU ETS installations for that type of goods.

9. ‘Carbon price’ means the monetary amount paid in a third country, under a carbon emissions reduction scheme, in the form of a tax, levy or fee or in the form of emission allowances under a greenhouse gas emissions trading system, calculated on greenhouse gases covered by such a measure, and released during the production of goods.

10. ‘Installation’ means a stationary technical unit where a production process is carried out.

11. ‘Operator’ means any person who operates or controls an installation in a third country.

12. ‘National accreditation body’ is appointed by each Member State.

Obligations and Rights of Authorized CBAM Declarants

1. Goods shall be imported into the customs territory of the Union only by an authorized CBAM declarant.

2. Any importer established in a Member State shall, prior to importing goods into the customs territory of the Union, apply for the status of authorized CBAM declarant.

3. Where an importer is not established in a Member State, the indirect customs representative shall submit the application for an authorization.

4. The application for an authorization shall include the following information about the applicant:

(a) Name, address and contact information

(b) EORI number

(c) Main economic activity carried out in the Union

(d) Certification by the tax authority in the Member State where the applicant is established that the applicant is not subject to an outstanding recovery order for national tax debts

(e) Declaration that the applicant was not involved in any serious infringements or repeated infringements of customs legislation, taxation rules or market abuse rules during the five years preceding the year of the application, including that it has no record of serious criminal offences relating to its economic activity

(f) Information necessary to demonstrate the applicant’s financial and operational capacity to fulfil its obligations

(g) Estimated monetary value and volume of imports of goods into the customs territory of the Union by type of goods, for the calendar year during which the application is submitted, and for the following calendar year

(h) Names and contact information of the persons on behalf of whom the applicant is acting, if applicable

5. The applicant may withdraw its application at any time.

CBAM Declaration

1. By 31 May of each year, and for the first time in 2027, each authorized CBAM declarant shall use the CBAM registry to submit a CBAM declaration for the preceding calendar year.

2. The CBAM declaration shall contain the following information:

(a) Total quantity of each type of goods imported during the preceding calendar year, expressed in megawatt-hours for electricity and in tons for other goods

(b) Total embedded emissions in the goods, expressed in tons of CO2e emissions per megawatt-hour of electricity or, for other goods, in tons of CO2e emissions per ton of each type of goods

(c) Total number of CBAM certificates to be surrendered

(d) Copies of verification reports, issued by accredited verifiers.

Carbon Price Paid in a Third Country

1. An authorized CBAM declarant may claim in the CBAM declaration a reduction in the number of CBAM certificates to be surrendered in order to take into account the carbon price paid in the country of origin for the declared embedded emissions. The reduction may be claimed only if the carbon price has been effectively paid in the country of origin. In such a case, any rebate or other form of compensation available in that country that would have resulted in a reduction of that carbon price shall be taken into account.

2. The authorized CBAM declarant shall keep records of the documentation required to demonstrate that the declared embedded emissions were subject to a carbon price in the country of origin of the goods that has been effectively paid. The authorized CBAM declarant shall in particular keep evidence related to any rebate or other form of compensation available, in particular the references to the relevant legislation of that country. The information contained in that documentation shall be certified by a person that is independent from the authorized CBAM declarant and from the authorities of the country of origin. The name and contact information of that independent person shall appear on the documentation. The authorized CBAM declarant shall also keep evidence of the actual payment of the carbon price until the end of the fourth year after the year during which the CBAM declaration has been or should have been submitted.

Registration of Operators and of Installations in Third Countries

1. The request for registration shall contain the following information to be included in the CBAM registry upon registration:

(a) the name, address and contact information of the operator

(b) the location of each installation including the complete address and geographical coordinates expressed in longitude and latitude, including six decimals

(c) the main economic activity of the installation

2. The Commission shall notify the operator of the registration in the CBAM registry. The registration shall be valid for a period of five years from the date of its notification to the operator of the installation.

3. The operator may, at any time, ask to be deregistered from the CBAM registry. The Commission shall, upon such request, and after notifying the competent authorities, deregister the operator and delete the information on that operator and on its installation from the CBAM registry.

Professional Secrecy and Disclosure of Information

1. All information acquired by the competent authority or the Commission in the course of performing their duties which is by its nature confidential or which is provided on a confidential basis shall be covered by the obligation of professional secrecy. Such information shall not be disclosed by the competent authority or the Commission without the express prior permission of the person or authority that provided it or by virtue of Union or national law.

2. By way of derogation from paragraph 1, the competent authorities and the Commission may share such information with each other, the customs authorities, the authorities in charge of administrative or criminal penalties, and the European Public Prosecutor’s Office, for the purposes of ensuring compliance of persons with their obligations under this Regulation and the application of customs legislation. Such shared information shall be covered by professional secrecy and shall not be disclosed to any other person or authority except by virtue of Union or national law.

Accreditation of Verifiers

A national accreditation body may, on request, accredit a person to be a verifier for the purpose of this Regulation.

Review of CBAM Declarations

1. The Commission may review CBAM declarations, in accordance with a review strategy, including risk factors, within the period ending with the fourth year after the year during which the CBAM declarations should have been submitted.

2. Where the competent authority concludes that the declared number of CBAM certificates to be surrendered is incorrect, it shall determine the number of CBAM certificates which should have been surrendered by the authorized CBAM declarant, taking into account the information submitted by the Commission. The competent authority shall notify the authorized CBAM declarant of its decision on the number of CBAM certificates determined and shall request that the authorized CBAM declarant surrender the additional CBAM certificates within one month.

3. Where the competent authority concludes that the number of CBAM certificates surrendered exceeds the number which should have been surrendered, it shall inform the Commission without delay. The CBAM certificates surrendered in excess shall be repurchased.

Sale of CBAM Certificates

1. A Member State shall sell CBAM certificates on a common central platform to authorized CBAM declarants established in that Member State.

2. The Commission shall ensure that each CBAM certificate is assigned a unique identification number upon its creation. The Commission shall register the unique identification number and the price and date of sale of the CBAM certificate in the CBAM registry in the account of the authorized CBAM declarant purchasing that certificate.

Price of CBAM Certificates

1. The Commission shall calculate the price of CBAM certificates as the average of the closing prices of EU ETS allowances on the auction platform, in accordance with the procedures, for each calendar week. For those calendar weeks in which no auctions are scheduled on the auction platform, the price of CBAM certificates shall be the average of the closing prices of EU ETS allowances of the last week in which auctions on the auction platform took place.

2. The Commission shall publish the average price on its website or in any other appropriate manner on the first working day of the following calendar week. That price shall apply from the first working day following that of its publication to the first working day of the following calendar week.

Surrender of CBAM Certificates

1. By 31 May of each year, and for the first time in 2027 for the year 2026, the authorized CBAM declarant shall surrender via the CBAM registry a number of CBAM certificates that corresponds to the embedded emissions declared for the calendar year preceding the surrender. The authorized CBAM declarant shall ensure that the required number of CBAM certificates is available on its account in the CBAM registry.

2. The authorized CBAM declarant shall ensure that the number of CBAM certificates on its account in the CBAM registry at the end of each quarter corresponds to at least 80% of the embedded emissions in all goods it has imported since the beginning of the calendar year.

Repurchase of CBAM Certificates

1. Where an authorized CBAM declarant so requests, the Member State where that authorized CBAM declarant is established shall repurchase the excess CBAM certificates remaining on the account of the declarant in the CBAM registry after the certificates have been surrendered. The Commission shall repurchase the excess CBAM certificates through the common central platform on behalf of the Member State where the authorized CBAM declarant is established. The authorized CBAM declarant shall submit the repurchase request by 30 June of each year during which CBAM certificates were surrendered.

2. The number of certificates subject to repurchase shall be limited to one third of the total number of CBAM certificates purchased by the authorized CBAM declarant during the previous calendar year.

3. The repurchase price for each CBAM certificate shall be the price paid by the authorized CBAM declarant for that certificate at the time of purchase.

Rules Applicable to the Importation of Goods

1. The customs authorities shall not allow the importation of goods by any person other than an authorized CBAM declarant.

2. The customs authorities may communicate confidential information acquired by the customs authorities in the course of performing their duties, or provided to the customs authorities on a confidential basis, to the Commission and the competent authority of the Member State that has granted the status of the authorized CBAM declarant.

Penalties

1. An authorized CBAM declarant who fails to surrender, by 31 May of each year, the number of CBAM certificates that corresponds to the emissions embedded in goods imported during the preceding calendar year shall be held liable for the payment of a penalty. Such a penalty shall be applicable in the year of importation of the goods.

2. Where a person other than an authorized CBAM declarant introduces goods into the customs territory of the Union without complying with the obligations under this Regulation, that person shall be held liable for the payment of a penalty. Such a penalty shall be an amount from three to five times the penalty referred to in paragraph 1. The payment of the penalty shall not release the authorized CBAM declarant from the obligation to surrender the outstanding number of CBAM certificates in a given year.

Circumvention

Practices of circumvention shall be defined as a change in the pattern of trade in goods, which stems from a practice, process or work which may consist of, but is not limited to:

(a) Slightly modifying the goods concerned to make those goods fall under CN codes which are not listed, except where the modification alters their essential characteristics

(b) Artificially splitting shipments into consignments the intrinsic value of which does not exceed the threshold

Scope of the Transitional Period

During the transitional period from 1 October 2023 until 31 December 2025, where the importer is established in a Member State and appoints an indirect customs representative, and where the indirect customs representative so agrees, the reporting obligations shall apply to such indirect customs representative. Where the importer is not established in a Member State, the reporting obligations shall apply to the indirect customs representative.
