Today in America gay couples can legally get married in seventeen different states and Washington D.C. Two weeks ago in Atlanta Mayor Kasim Reed announced that he is joining Congressman John Lewis and eleven other bipartisan marriage equality supporters as co-chairs of

the past four months, federal have declared gay marriage bans in Utah, Oklahoma, Virginia and Texas unconstitutional. And in Kentucky, a federal judge ruled that the state must recognize same-sex marriages legally performed in other states. Right now, our vibrant community is united more than ever as we can finally see the finish line on the horizon. Waiting for us there is equality for every LGBT person no matter what state you call home. The state of gay in America is strong. But that doesn’t mean we will see full equality realized without a 18 : March 13, 2014
the Southerners for the Freedom to Marry initiative. fight. There is no shortage of voices calling for the preservation of anti-gay laws and codified discrimination. However, their negative voices are being lost in the chorus of Americans that support our community for the first time in history. Last week a Washington Post-ABC News poll saw the highest support for gay marriage ever recorded. 59% of Americans polled said they support allowing gays and lesbians to marry legally. Only 34% said they were opposed. However, it was a subsequent question in the poll that made headlines. The respondents were asked: “Regardless of your own
preference on the issue, do you think that the part of the U.S. Constitution providing Americans with equal protection under the law does or does not give gays and lesbians the legal right to marry?” Exactly 50% of people responded that the constitution guarantees gays equal protection and only 41% said it does not. But wait, there’s more: 61% of the respondents said they favored allowing gay or lesbian couples to adopt a child. 78% said they think gay people can be as good parents as straight people. This is absolutely fantastic and heartwarming news for the gay community!
With poll numbers like these it’s easy to see why gay rights advocates are smiling from ear to ear. Even with today’s naysayers and well-organized opposition groups, for the first time in American history gay equality seems to be an inevitable progression. This may lead to sexual orientation not being such a big deal, but that is not a reality today. In fact, sexual orientation matters a great deal in modern society whether that is to your liking or dismay. It is sometimes easy in gay Atlanta to forget we’re a minority. But discrimination and hardship exists everywhere. Ready for an education? Ask a transgender friend about how their sexual orientation comes into play on a daily basis. Sexual orientation still matters so much to some people that the Arizona and Georgia legislatures recently considered bills that would allow businesses to refuse service to gays. Every few years Arizona likes to prove that it’s completely out of touch with reality. Last month the Arizona House of Representatives passed a bill that the ACLU described as “unnecessary and discriminatory.” The group explained that it would “allow private individuals and businesses to use religion to discriminate, sending a message that Arizona is intolerant and unwelcoming.” But no one is going to outdo the state of Georgia when it comes
to denying something to gays. The Georgia House of Representatives considered the “Preservation of Religious Freedom Act,” also known as HB 1023. It was sponsored by Sam Teasley (R - Marietta), Matt Ramsey (R - Peachtree City), Andrew J. Welch (R - McDonough) and David Casas (R Lilburn). The state Senate considered a bill with the same name known as SB 377. It was sponsored by Joshua McKoon (R Columbus), David Shafer (R - Duluth) and William T. Ligon, Jr. (R - Brunswick). The proposed legislation would exempt a person or business from government actions or legal proceedings that “directly or indirectly constrains, inhibits, curtails, or denies the exercise of religion by any person or that directly or indirectly pressures any person to engage in any action contrary to that person’s exercise of religion.” Language this broad could fundamentally change the legal landscape in Georgia. Want to break the law? OK. Just figure out a reason why that law is contrary to your religion. Sure it would allow a few businesses to refuse service to gay people, but it would also open Pandora’s slippery box. Do Americans want to refuse service to gay people so much that it’s worth creating these discriminatory laws popping up in Arizona, Georgia and Mississippi? According to the Washington Post-ABC
News poll from last week Americans say no. A staggering 81% of the respondents said that businesses should not be allowed to refuse service to gays. HB 1023 was tabled two weeks ago and taken off of the House calendar. The bill isn’t moving forward anymore, but it could be added back to the calendar in the future. The Senate adjourned without voting on SB 377 last week which means it won’t be voted on this session. “But the language could still come up in an amendment,” Georgia Equality warned on its Facebook page. The organization proved instrumental in keeping the public informed about the two bills and calling its supporters to take action. “Thousands have called and emailed from around the state. Thank you for taking action. It does make a difference,” Georgia Equality told its supporters via social media. Georgia’s got a bit further to go in realizing equality for all of its citizens. But we’re witnessing incredible progress throughout America in states from Massachusetts to Oklahoma. If we continue to demand equality the arc of the moral universe will continue to bend toward justice. We’re out. We’ve been proud for ages. But now we’re stronger than ever.

Joan Garner is originally from Washington D.C. but she has called Atlanta home since 1978. In fact her love for the city prompted her to become a Fulton County Commissioner in 2010 – a job she appreciates so much that she will be running for re-election this year. In 2010, Joan Garner made history by becoming the first openly gay commissioner to serve Fulton County, GA. She has since proven her worth to the residents of Fulton County by performing official duties like setting policy, approving the county budget and providing funding for Grady hospital. Her 2010 campaign focused strongly on building healthy communities and her 2014 re-election campaign’s focus remains overall the same: “Healthy citizens means you have a healthy county where people are able to work and create value,” Commissioner Garner explains, “I strongly endorse preventative measures that will create a strong and healthy work force and I will continue to do so in my new campaign.” In her mind, it is important to address the needs of all citizens, which for her means taking a bird's eye perspective on things when it comes to promoting health and building a better community. Because of her personal relationship – she is married to Judge Jane Morrison and they reside in the Old Fourth Ward – Garner also has an eye on current LGBT issues in Atlanta and Georgia as a whole. 20 : March 13, 2014
“Discrimination is still a factor when you look at it broadly,” Joan Garner says, “There are still issues that directly target our rights as LGBT people. Gay marriage is still not legal and gay people still experience discrimination when it comes to housing and employment. The same goes for parenting and adoption where LGBT people just don't have the same rights as others.” She also sees HIV/AIDS as a major issue for Atlanta’s gay community. Although the fight against HIV/AIDS is largely improving, it still has the power to instill fear in others and, for example, prevent people from coming out in the workplace. “It is still a group of citizens whose rights are not protected and, of course, I want to work toward changing that,” Commissioner Garner says, “The fact that I am an out lesbian provides me with a unique lens that I use when looking at legislation policy to make sure it becomes more inclusive.” In the big picture, the U.S. has come a long way concerning gay rights, but zooming in on Georgia there are still major
breakthroughs to be had. Gay marriage is still not recognized and legislation here seems to move very slow. Also, there have recently been attempts made to approve bills that could potentially legalize discrimination against gays. Garner acknowledges that there is a long way to go: “Personally, I cannot sit still and let this happen, because I know what discrimination feels like—albeit from another arena. I’m not sure it will go away, but I do see an opportunity here. Because if there is something that needs to be protected, let’s come together and make that happen. I believe that out of pushback and out of friction comes growth.”
"So maybe we won’t see legalized gay marriage this year or not even next year. But it is gaining momentum." And how about gay marriage? When will it become legal in Georgia? Will it ever? Commissioner Garner remains optimistic here also. Being married herself (they tied the knot in Massachusetts), Garner strongly believes in the official union of two people: “I’ve been married four years now, but I don’t think Georgia is there yet. But I think we have a strong case with a lot of legislators that back it up. We have a good civil debate and also the mayor has come out in support of gay marriage—kudos to him on this action. It’s people like him and other fair-minded legislators that have voiced their support who will help turn this around for us. So maybe we won’t see legalized gay marriage this year or not even next year. But it is gaining momentum.” The primary election for the Fulton County Board of Commissioners is May 20. Republican-led redistricting means Garner, elected to the District 6 post, is running for the District 4 seat. Garner’s reelection bid has been officially endorsed by Georgia Equality. Politics Robin Joy Shahar: Mayor's Adviser on LGBT Issues
“Last Autumn the mayor created the adviser position and asked me if I would serve. I was very honored and, of course, accepted,” Robin Joy Shahar told FENUXE Magazine during a recent interview. Shahar is the Mayor's Adviser on LGBT Issues and Chief Counsel at the City of Atlanta Department of Law. She began her career with the City of Atlanta in 1993. “I’ve worked in the Attorney’s office since 1993. I started out as an associate city attorney and worked my way up to now be one of the chief counsels in the office,” she explained. It is Shahar's job to advise the mayor on LGBT issues; however, she still has to separate her personal feelings from her professional opinions. “As a lawyer I have to distinguish between what is in my heart and how I address things professionally. Similarly, as an adviser I have what is in my heart, but I advise the mayor for what makes sense in his role. He feels very passionately about [LGBT rights] and I identify ways for him to accomplish what he wants to accomplish. I take that role very seriously and I’m honored to be in this role,” Shahar commented.

Mayor Atlanta is a progressive splash of blue treading water in a blustery sea of red. Keeping Atlanta on a Democratic bearing has been Mayor Kasim Reed since he was first inaugurated in 2010. However, Mayor Reed isn't a member of the LGBT community. He doesn't necessarily know what our community needs or how laws are uniquely affecting our population. So Reed created a new LGBT adviser position to help him navigate the legal landscape with respect to gay issues.
Shahar made an effort to point out that all of her work is made possible because Mayor Reed wants to affect positive change for the LGBT community. “He believes in it. Atlanta has a history of being on the right side of civil rights issues. Civil rights adds to the richness of this city. The mayor has identified that LGBT rights are basic human rights. On the issue of marriage equality it took him more time. But he was voting on LGBT equality issues in the legislator in a progressive, supportive way years ago,” Shahar said. Atlanta has a large and beautifully diverse LGBT community which must make advising the mayor on LGBT issues a daunting task. Shahar has to consider everyone in our community when she makes recommendations to the mayor. “It does feel like a lot of weight, but it gives me the opportunity to help Atlanta be cutting edge on LGBT equal treatment,” she remarked. If Shahar and Mayor Reed's goal is to keep Atlanta on the cutting edge of LGBT equal treatment there is data that clearly suggests the Mayor is succeeding. The city is the first in the deep South to get a 100 on the Human Rights Campaign’s Municipal Equality Index,” Shahar cheerfully added, “It is huge for us and that is not a stopping point. It is an area where we will continue to look at cutting edge ways to be supportive of the LGBT community and equal treatment as well as equal rights (because they’re not the same). As his adviser on LGBT issues I’m committed to providing him suggestions on how to do that. He wants to be doing that. I am talking to people, reading things and thinking about ways to improve Atlanta’s protection of LGBT rights.” One of the ways Shahar is helping Mayor Reed improve LGBT rights for gay Atlantans is through their work with the Freedom to Marry organization. “The Freedom to Marry is an organization that has been around for a while,” Shahar said, “Their goal is to try to get support nationally for marriage equality for different reasons. One of which is that even though the Supreme Court is supposed to be politically neutral the reality is that public
opinion does influence the timing of decisions. Freedom to Marry would like to show that there is a majority of Americans that support marriage equality.” Shahar helped Reed get on board as a co-chair of Freedom to Marry's new initiative, Southerners for the Freedom to Marry. We're “focusing on the South because it is likely the area of the United States that needs more attention in terms of education and having people think about the issue of marriage equality. Ultimately, it will also allow people who are struggling with it to have their views moved toward understanding the importance of marriage equality. As [Mayor Reed] said in his press conference, he will wear as many hats as necessary to help achieve marriage equality,” Shahar detailed. However, she didn't ignore the fact that Reed hasn't always supported marriage equality. Instead, Shahar highlighted Reed's evolution on gay marriage as the reason for his ardent support. “Marriage equality is an issue that the has struggled with and come to resolution with relatively recently in the past year or so. After making a decision about that issue he felt strongly that he needed to support it. Not just in Atlanta but nationally because it is a basic human right. He supports basic human rights and Atlanta supports basic human rights,” she said. Atlanta may support gay rights, but the same can’t be said for Georgia after recent legislative scares in both the House of Representatives and the Senate. Both chambers considered legislation called
the “Preservation of Religious Freedom Act,” also known as HB 1023 and SB 377. Critics argued that the bills would legalize antigay discrimination. However, Shahar sounded optimistic that Georgia won't pass these bills. The Georgia anti-gay “bills were almost identical to Arizona’s. What I thought was fascinating and very powerful was that the legislators who wrote the bills in Arizona realized that they had made a mistake and requested the governor veto them. That the Super Bowl came out and said to Arizona, ‘If you pass this we may not come here.’ That respected large corporations said to Arizona, ‘Don’t do this.’ You’re going to have people who feel threatened by the progress of LGBT rights. That’s to be expected. But what’s so fascinating is that they’re being drowned out. It wasn’t even the LGBT community that ultimately changed the minds of these folks. It was the reality that the private sector isn’t going to put up with it. The private sector is no longer behind it. The private sector by and large understands the importance

of LGBT equality and is going to say so,” Shahar explained. So we narrowly prevented a setback here in Georgia with HB 1023 and SB 377. Can Georgia's LGBT community realize progress when we're fighting to merely maintain ground? “I never thought that in my lifetime I would see the decision that came out of the Supreme Court this past year. I think that Georgia is moving forward. I think that statewide the progress will take time. I think we’re moving in the right direction consistently. We may have to step back and take two steps forward. I don’t think it will be easy. But I think there are enough people on the right side of this issue that progress will continue to be made. That’s huge. I think the city will lead the way nationwide in terms of progressive policies and progressive laws. Atlanta will continue to be a place where LGBT people will visit and make home. A place where they enjoy living, working and feeling like they are equal citizens like anyone else who lives here,” Shahar concluded.

PALLOOkAVILLE As a result of the recently proposed anti-gay legislation in Arizona and Georgia, this Avondale Estates eatery has been surprisingly verbal about what they thought of the whole thing. Their Facebook page touted that they believe in “'everyone being able to sit their merry butts down to have a milkshake” and they even posted the names, mailing and email addresses, and phone numbers of the legislators who supported the anti-gay bill.
