Giving and receiving gifts, are we doing it properly?
This festive season we enjoy the time spent with family and friends and the gifts given and received. It is often overlooked how the generosity of friends or a family member might lead to challenge in future.
Financial Abuse
Often it is elderly and vulnerable family members who are victims of financial abuse from close relatives, carers or friends by way of ‘gifts’. Such abuse does not need the person giving the gift to lack capacity and can arise from feelings of isolation, illness or, dependence upon an individual for care or other needs. In order to challenge a gift, there must be evidence of “undue influence” exerted by one party over the person making the gift. In some relationships, there is a legal presumption of influence (such as a parent and child, medical adviser and patient). However, it must be shown that the influence was “undue”. A relationship of influence can also exist where the person who made the ‘gift’
placed trust and confidence in the other party regarding the management of their financial affairs.
Gifts which might raise alarm bells are;
• where the gifts are unusually large;
• where they benefit one individual in a way that is not in line with other gifts made by the donor;
• where the donor of the gift does not seem able to explain why they chose to do it.
The burden of proof for an allegation of financial abuse or, undue influence, rests upon the person who claims to have been wronged.
Challenging these gifts will involve consideration of several factors and will also depend upon a) whether the donor has the capacity to have given the gift and, b) when the gift is discovered. If there are any lifetime transactions which cause you concern, it is certainly worth investigating and seeking advice so that the ‘gift’ can be reversed, if required, prior to the donor victim’s death.
Gifting under a Lasting Power of Attorney (‘LPA’)
There are specific ways in which gifts can be given by an attorney acting under an LPA. A gift is when an attorney moves ownership of money, property or possessions from the person whose affairs they manage to themselves or to others, without full payment in return. Deciding whether to make a gift is an important part of being an attorney. Gifts can help convey wishes and feelings towards the family and friends of the person whose finances an Attorney is helping to look after. Attorneys may give occasional gifts on customary occasions, for example, births, birthdays, weddings or civil partnerships, religious festivals. They can be given to anyone connected to the person or to a charity. These gifts must be reasonable, affordable and in the person’s best interests considering all the relevant circumstances.
If the person has the capacity to make a gift, they must do so themselves, an attorney does not need to act on their behalf. If it is decided that an attorney would like to make a gift, there are certain payments that only the Court of Protection can authorise, for example:
• making a loan from the person’s funds;
• making a large gift;
• living rent free in a property owned by the person;
• selling a property for less than its value / transferring it into someone else’s name.
An Attorney can make gifts which will be perfectly acceptable in accordance with the above, however they must also remember their obligation to keep records and receipts for all transactions taken in their role as attorney. If there is any doubt as to the appropriacy of a gift or, whether an application to the Court of Protection is required, then legal advice should be sought.
Gifting and Inheritance Tax (‘IHT’)
IHT is payable on transfers of value which are made when a person makes certain gifts during their lifetime. There are three types of lifetime gifts to consider for IHT purposes.
Exempt gifts such as gifts made between married couples or civil partners, gifts to charities, gifts within the annual exempt limit of £3,000 per tax year, of up to £250 to any individual each tax year and regular gifts which are made out of the donor’s income, which do not adversely affect the donor’s standard of living.
Chargeable Lifetime Transfers, such as gifts by an individual to a company or to most types of trust (with exceptions) would attract an immediate IHT charge and a further IHT charge if the individual were to die within seven years afterwards.
Potentially Exempt Transfers, where a gift from one person to another is exempt from IHT but only if the person making the gift survives for seven years after the date of the gift.
A gift may include:
• a sale of an asset or property for a price which is less than its market value;
• a failure by a person to act, which provides a financial benefit to another person.
A gift might be disputed in some circumstances where the donor retains a benefit in the asset which has been gifted. It is therefore important to obtain appropriate tax and estate planning advice if you, or a family member or friend, seeks to mitigate the payment of IHT through the making of lifetime gifts.

In keeping with its dedication to quality craftsmanship, R.M.Williams has drawn on the expertise of local British
craftspeople to furnish the store, with pieces from Stroudbased handmade furniture and cabinet supplier, Timberwoolf; Hampshire furniture maker, Morgan; Sheffield joinery supplier, Eclipse Manufacturing; and Rush Matters, the Bedforshirebased creator of the Marlow store’s window plinths and in-store risers, all woven from British rush, harvested by hand by Rush Matters founder, Felicity Irons.
First held in Canterbury Cathedral’s Precincts in 1383 following a royal grant by King Richard II, the market ran for hundreds of years. Reviving this centuries-old tradition in 2024, the modern Christmas market features a range of picturesque German-style wooden huts within the Cathedral Precincts, as well as delicious food and drink outlets, a vintagestyle carousel ride, and live music performances – including Saturday Shoppers’ Carol Services.
There is free entry to the Precincts during the market –sightseers only need to pay to go inside the magnificent Cathedral and Cloister during visiting hours – and a variety of fun low and no cost community activities. As always, it is free to attend a service at the Cathedral or to go inside to pray, with donations welcome.

Tring Brewery launches ‘Hop Beard Oil’ with profits raised for Men’s Mental Health
Created in collaboration with local makers Bare Essentials, who specialise in natural body care products, the beard oil boasts a bouquet of citrus, pine and tropical fruits. The aroma of the oil has taken lead from Tring Brewery’s popular IPA, Raven King, the artwork of which features a pensive warrior, inspiring the brewery’s drive for men’s mental health.
Tring Brewery have worked closely with mental health cause Hector’s House since January of this year, announcing the organisation as their ‘Charity of Choice’ for 2024.
Hector’s House was founded in 2016 to campaign in the name of Hector Stringer, a Tring local who sadly took his life aged 18. Based in Berkhamsted, just down the road from Tring Brewery, Hector’s House aims to prevent suicide and reduce mental health stigma through education, awareness and support.

Splashtastic Swimming Lessons
Swimkidz south bucks run by Tracey and her team which has been established for over 12 years. We have a large following in the area, teaching babies, toddlers and children to swim from as early as 12 weeks old. Due to growth we are excited to have launched a brand new pool in Holtspur, Beaconsfield, a great addition to our other locations across south bucks.
Swimkidz focus is to teach water confidence, water safety and provide a safe environment for swimming lessons in the local community.
Drowning is still one of the most common causes of accidental death in children so being able to swim is an essential life-saving sill and it’s important to remember that children who appear water confident are not always competent swimmers.

Enjoy a Historic Christmas
Visitors to the stunning medieval city of Canterbury can experience a rare festive treat as a 600-year-old Christmas market returns to the grounds of its world-famous Cathedral.
First held in Canterbury Cathedral’s Precincts in 1383 following a royal grant by King Richard II, the market ran for hundreds of years. Reviving this centuries-old tradition in 2024, the modern Christmas market features a range of picturesque German-style wooden huts within the Cathedral Precincts, as well as delicious food and drink outlets, a vintage-style carousel ride, and live music performances – including Saturday Shoppers’ Carol Services.
There is free entry to the Precincts during the market – sightseers only need to pay to go inside the magnificent Cathedral and Cloister during visiting hours – and a variety of fun low and no cost community activities. As always, it is free to attend a service at the Cathedral or to go inside to pray, with donations welcome.
A collaboration between the Cathedral, Canterbury Business Improvement District and Rockhopper Events, this is an extension to Canterbury’s existing much-loved traditional festive market which spans the city centre.

Everyone is welcome to celebrate Advent and Christmas at the Cathedral’s many services of worship, inspired by this year’s theme of ‘Journeys’.
These include traditional carol services with the world-renowned Cathedral Choir, stories and songs for young families at the weekly Teatime Carol service, the Festival of Carols featuring a living nativity (including a donkey!), and the Christmas Day Eucharist. And of course, it wouldn’t be Christmas in Canterbury without the appearance of St Nicholas!
All seasonal services are free to attend, with retiring collections to help cover the Cathedral’s costs. Donations given at their two traditional carol services, and at all Christmas Eve and Christmas Day services will, after deduction of costs, be shared equally between the Cathedral and their chosen partner charity for this year, The Social Justice Network.
There is also a range of family-friendly craft activities running at the Cathedral throughout the season, and beautiful decorations to enjoy.
One hour’s train journey from central London, Canterbury is one of the UK’s most popular destinations for festive breaks, with the worldfamous Cathedral, cobbled streets, and medieval landmarks within.

Valuing each party’s contribution to a marriage is not always an easy task. There can and invariably are misconceptions surrounding what types of contributions the Courts will take into consideration when a relationship breaks down. A contribution could be financial or non-
financial. The traditional family unit twenty years ago is very different to the way families operate today. It was common for one to go out to work and for the other party (invariably the wife) to give up her career in order to stay at home and look after the children.
There is a common misconception that because one party stayed at home, they should not be entitled to an equal share of the matrimonial assets because they did not “earn it”. This is particularly the case when we discuss the sharing of pensions. However, the Courts do not discriminate in this way. The Courts consider all of the available assets and consider each party’s needs, including future needs.

South Buckinghamshire law firm wins award for making a positive difference to workplace happiness and culture
The words “law firm” and “happiness” may not often be found in the same sentence, but South Buckinghamshire firm Blaser Mills Law is working hard to change that.
Last November, law firms from across the country gathered in Birmingham for a prestigious awards ceremony to celebrate excellence and achievement in the legal industry.
The event was hosted by LawNet, a not-for-profit nationwide network of over 70 member law firms, all of whom are committed to rigorous quality standards and best practice.
With only ten awards available across different categories, Blaser Mills, with offices in High Wycombe, Marlow, Amersham, Silverstone and
London, was absolutely delighted to win the ESG Initiative Award.
ESG – Environmental, Social, Governance, is also known by other terms such as “Responsible Business” and “CSR” – Corporate Social Responsibility. In essence, this covers the ways in which businesses go above and beyond to benefit their people, their communities, and the environment.
The LawNet judges were particularly impressed by Blaser Mills’s creation of a dedicated role of Responsible Business Partner – Tracy Jones; putting the firm’s impact on their employees, wider community and society at the very top of their priorities.
The judges praised the active staff-led groups within Blaser Mills, including an Inclusion Forum, Wellbeing
at Work Group, Community Group, and Environment Group. They saw that the firm was taking care to nurture long term relationships with local community organisations, working with education centres, food banks, nature charities, hospices and children’s charities to name but a few. The firm actively encourages colleagues to volunteer with these groups, giving them dedicated “volunteer leave” for this purpose.
The judges were particularly impressed by the anonymous weekly “happiness survey”; a central tool in the firm’s wellness drive. Every member of staff is sent a short survey each week, asking how their working week has been. The results produce data which can spot where support may be required and encourages teams to problem solve and work together.
“The weekly happiness surveys have had an enormous impact on the culture at Blaser Mills”, explains Tracy Jones. “Law can be a full-on area to work in, with people often not wanting to admit to feeling underpressure, stressed or overwhelmed.”Tracy explains that when her colleagues started to feel comfortable with the weekly surveys and the discussions that followed them, people were more open in saying that they might need a bit of extra help. Tracy saw that
colleagues began to share ideas more freely, thank each other and congratulate successes. And, over a relatively short period of time, data was available to support what she was sensing – that people were becoming happier at work. “Happy people enjoy their work and do their best work – which means happy clients too! Of course, happiness ebbs and flows. But we now have a firmly established culture where our colleagues can express themselves, knowing that they will be supported.”
Tracy confesses that to her, this feels “like gold, like winning the lottery”. She says, “Having spent all of my working life in law, I know that stress and burnout are significant issues for the legal industry, so to be a part of positive change, still makes me smile every day”.

Callum Turner has been named as Louis Vuitton’s new house ambassador.
The 34-year-old actor has said it is a “full circle moment” following his history with the French fashion house.
Before finding fame on the big screen, Turner was once a model, actually walking for Louis Vuitton in their 2009 spring/summer show.
“I’ve always loved [Louis Vuitton] from way back when, and I truly enjoy the full circle part of joining the guys,” Turner told Esquire.
Known for his roles in the Fantastic Beasts films, the historical drama The Capture, and the film adaptation of Jane Austen’s Emma.
Off the screen, Turner has made a name for his fashion credentials on several red carpets for his refined sartorial choices. The British actor often sports classically simple designs by the likes of Burberry and Ferragamo.
Turner has also become a source of inspiration for streetwear style, sporting cool and pared-back ensembles which often compliment his girlfriend, Dua Lipa’s style.

In summer of this year, Sienna Miller launched the ultimate Boho-chic clothing line at M&S, with most pieces selling out within hours.
Following its success, the 42-year-old actor has released a second collection with the British retailer, comprising of 35 partywear designs – arriving in stores just in time for the festive lead-up.

The clinic’s founder, former nurse Kay Greveson, said: “It is a charity close to my heart as I have had family members affected by cancer who have used hospice services, and so I understand how valuable the care they provide is to the community.”
Kay has personally undertaken various fundraising initiatives for the hospice, including running the Royal Parks Half Marathon, which raised more than £1,600, donating two prizes to the charity’s Sapphire Ball to mark its 45th anniversary last month, and making regular donations.

THE FERTILITY CENTRE
Formerly the Assisted Conception Unit, The Fertility Centre is a longstanding centre of excellence for fertility treatment and care at Chelsea and Westminster Hospital. In 2021 they enlarged the Centre with a new satellite service at West Middlesex University Hospital, extending patient care and convenient access across West London.
The Centre provides a broad and comprehensive range of fertility services to their patients –including IVF, ICSI and IUI – but their areas of particular expertise, include the management of women and couples over the age of 40, premature ovarian ageing or low ovarian reserve, and male or sperm-related infertility issues.
Notwithstanding their expertise in these complex fields, The Fertility Centre continues to perform very well in its success rates. The consultant-led care package allows you the choice of one of their experienced consultant obstetricians to personally guide you through your pregnancy and birth. Your consultant provides continuity and individualised expertise throughout your journey. They build a relationship with you and your partner through the antenatal period to give you confidence to birth safely with them in line with your birth preferences. They continue to support you through the postnatal period, including your 6 week postnatal check. All consultants are available to meet you and your birth partner without any obligation.

How To Survive Christmas and emerge happy and healthy in January!

We all enjoy a bit of indulgence at Christmas, with food and drink central to the festivities. However if you are trying to manage your weight and look after your health, navigating the party season can be a challenge.
Here’s the good news: lots of traditional Christmas foods are great healthy choices! Turkey, salmon, beef, tangerines, nuts, brussels sprouts, parsnips, red cabbage, are all great sources of protein, healthy fats and essential vitamins and minerals – so enjoy them.
Start the day with a good breakfast including protein and fibre – for example porridge, eggs or yoghurt with nuts and fruit. This will stabilize your blood sugar and support your mood, energy and sleep, and you’ll be less tempted to snack. Later, enjoy your mince pie or chocolate as dessert rather than between meals, take time to savour, chew well, notice flavour and texture, and you’ll feel satisfied with smaller portions, and won’t feel too full.
Do eat what you want. But that doesn’t mean having chocolate/cake/crisps every day just because it’s December. It encompasses how you feel shortly afterwards, and the next day. It means enjoying
treats without sabotaging your goals, and still staying on track to feel healthy and vibrant. Shortterm temptation often leads to excess eating - it’s easy to disassociate with what comes later. So don’t lose sight of what you truly want. And that’s not always the cake.
Stay hydrated over Christmas – it helps detoxification, brain function, digestion, skin, and combats fatigue. Start the day with a large glass of water to replenish the system, and drink 1.5 – 2 litres per day. To enjoy Christmas drinks without overdoing things, make your first party drink nonalcoholic (that’s when we tend to drink quickest), alternate alcohol with water, have three alcohol-free days per week, and have one or two non-alcoholic alternatives handy. Try a Ginger Lemon Sparkler of 2oz each of fresh ginger juice and lemon juice, shake well, pour over ice with 2oz soda water. Use a lovely glass and make it feel special.
Finally, if you are masterminding Christmas in your house, it can be pretty overwhelming. Take care of yourself - ensure you set aside time each day to relax – a hot bath, a peaceful cuppa, a walk outdoors. You’ll feel more able to cope and everyone will benefit. Happy Christmas!

Once thought to be ‘the expensive choice’, live-in care is more affordable than ever and can help maintain independence and identity for those who need extra support.

The key to creating a great first impression is a cohesive design in terms of the materials and textures featured on the outside of your home. The front door is usually a focal point, but the path or stairs up to it, the lighting, the amount of glazing by the door, and the quality of the finishes make it work. Psst! Want to know a secret? Gone are the days of tiny doors. In the past, doors used to be small to retain heat but today anything goes and the bigger the better. Contemplate the Universe
Chris Baker is an astrophotographer based in Berkhamsted and has been imaging deep space for more than 20 years.
Initially Chris had a small observatory in his back garden, but as the hobby developed he needed more cloudless nights and less light pollution.
In 2012 Chris moved his equipment to a facility on top of a mountain in Spain, where the weather is perfect for long exposure photography. Chris operates his equipment remotely from wherever he is in the world, capturing the faint light from objects thousands or millions of light years away.
In 2016 Chris launched his art business based upon his beautiful images and Galaxy On Glass was born. Chris collaborates with the best Fine Art printers in Europe to produce spectacular wall art. “I wanted to do something different so the images are presented on Acrylic, Aluminium and also framed and backlit - which look quite remarkable on a wall. They are shipped all over the world. With each limited edition piece comes information on how far away the object is and what you are looking at – whether it is a beautiful star cluster, a nebula where stars are born or a distant galaxy hundreds of millions of light years away.”
Then in 2022 Chris again moved his equipment, this time to Australia. “The southern hemisphere sky is different so I have a completely new collection of stunning objects to photograph!”
Chris is interested in investigating the cosmos through the language of art as an alternative to the language of physics which is baffling to many people. He sees both physics and art to be simultaneous descriptions of reality which are equally valid. Like many scientists he was initially drawn to astronomy by a deep sense of wonder
and awe for the beauty, enormity and mystery of the universe.
Chris’s art taps into the human urge we all share to contemplate the universe, with its themes of the vastness of distance and time and the smallness of mankind who despite his ingenuity will never tame or fully explain the cosmos. The universe just gets on with doing its thing irrespective of what we do.
