What can you do if your spouse or civil partner dies without leaving enough for you to live on?
It is a difficult and emotional time when a spouse dies. This can be made harder if you then find out that you have not been left enough, or anything, in a Will, or you do not inherit enough via intestacy, i.e. when someone dies without a Will.
In situations such as this, there is a potential help by way of the Inheritance (Provision for Family and Dependants) 1975 Act (“the Inheritance Act”).
The Inheritance Act
In England and Wales, a person is entitled to leave their assets (or estate) to whoever they want. This is referred to a testamentary freedom; however, this freedom is not absolute. The Inheritance Act allows certain categories of applicants to bring a claim against an estate of a deceased person, who died domiciled in England and Wales, where they have not been provided with ‘reasonable financial provision’ either under the terms of the will or via the rules of intestacy.
Who can make a claim?
People who are covered by the Inheritance Act can include:
• A spouse or civil partner.
• Children (both minors or adults). This includes adopted children and those who have been treated as a child of the marriage e.g. step-children.
• A former spouse or civil partner – if they have not remarried.
• Someone who has lived continuously with the deceased for at least two years prior to their death.
• Any person who was financially maintained in some way by the deceased.
Claimants under the Inheritance Act
If you are able to show that you are an eligible applicant, the court will consider what amounts to ‘reasonable financial provision’. This depends on whether you were married or not. Spouse of civil partner: These applicants are entitled to receive such financial provision as is reasonable in all the
circumstances, whether it is required for their maintenance or not. This generally means that a spouse or civil partner would be entitled to a higher standard of maintenance than the other categories of applicants. Anyone other eligible claimant: These applicants are entitled to such reasonable financial provision as is necessary for their maintenance. This is subject to the size of the estate.
This article will consider spousal claims under the Inheritance Act.
Spouses: What can you expect to receive from an Inheritance Act claim?
The court has wide discretion to consider a number of factors when deciding whether reasonable financial provision has been made and, if it has not, what further financial provision should be provided.
The factors the Court will consider are in section 3 of the Inheritance Act and include the following:
(a) Your financial needs and resources both now and in the foreseeable future – this includes your income, means and resources and will involve a consideration of the lifestyle you had with your spouse;
(b) The financial needs and resources of any other person making a claim against the estate, both now and in the foreseeable future – if there are no other claims then this factor is not considered;
(c) The financial needs and resources of any beneficiary of the estate, both now and in the foreseeable future – these are the beneficiaries in the Will or via the intestacy rules;
(d) Any obligations and responsibilities that the deceased had towards any applicant or any beneficiary of the estate;
(e) The size and nature of the estate – the Court cannot order any more than the estate is worth and, normally, any debts or liabilities have to be paid first;
(f) Any physical or mental disability of any applicant or beneficiary; and
(g) Any other conduct.
There are also additional factors that are taken into account for married couples / those in a civil partnership:
• The applicant’s age and the duration of the marriage;
• The applicant’s contribution to the welfare of the family of the deceased person and the management of any businesses; and
• The provision an applicant might reasonably be expected to receive had the marriage been terminated by divorce rather than death. The Court normally considers that a marriage is an equal partnership and on divorce the starting point is 50/50. While this is often adopted in Inheritance Act claims, certain factors can lead to a change in that starting point as the Courts recognise that a divorce is a decision made by the parties to bring a relationship to an end, whereas the passing away of one party to the relationship is an involuntary ending of the relationship.
The aims we look to achieve are:
• Your accommodation security;
• Whether you will be able to meet future costs e.g. costs of care;
• Whether you can meet your everyday costs of living until retirement; and
• Whether you can maintain the lifestyle that you had during the marriage.
If your claim is successful, the Court can make a range of awards including a lump sum, periodic payments, the transfer of property or the right to reside in a property for the rest of the applicant’s life.
Time limit to bring a claim
Court proceedings should be issued within six months of the date of the Grant of Probate (or the Grant of Letters of Administration). As such, it is important to act quickly to obtain legal advice if you think you may have a claim.
If the deadline has passed, it may still be possible to bring a claim, but you will have to apply for the Court’s permission to bring a claim out of time.

PADDINGTON BEAR TAKES A SEAT AT WESTFIELD LONDON & CONNAUGHT VILLAGE
Fans of all ages can take a pew next to Paddington as STUDIOCANAL unveils a series of cute statues of the marmalade loving bear. Launched as part of Paddington Visits – Westfield London and Connaught Village are just two of 23 locations across the UK and Ireland.
The statues are being unveiled in cities, towns, and beauty spots to celebrate the forthcoming release of PADDINGTON IN PERU, arriving in cinemas on 8th November.
This new adventure will see Paddington return home to the Peruvian jungle to visit his beloved Aunt Lucy, now a resident at the Home for Retired Bears. With The Brown Family and Mrs Bird in tow, a thrilling adventure ensues when a mysterious disappearance plunges them into an unexpected journey from the Amazon rainforest to the
mountain peaks of Peru.
With passers by stopping for selfies, everyone was buzzing with excitement as they gathered to welcome their new neighbour - a meticulously crafted and painted statue sporting the wise bear’s signature red hat, blue duffle coat, and a marmalade sandwich in paw.
Film creators STUDIOCANAL came up with the idea to spread the Paddington love, so has teamed up with the Ordnance Survey to help intrepid explorers discover Paddington near them. Families can embark on their own adventure, with locations ranging from John O’Groats to Land’s End, Westport Co. Mayo to London, and, of course, a very special stop in Newbury, the hometown of Paddington’s creator, Michael Bond.

In keeping with its dedication to quality craftsmanship, R.M.Williams has drawn on the expertise of local British craftspeople to furnish the store, with pieces from Stroud-based handmade furniture and cabinet supplier, Timberwoolf; Hampshire furniture maker, Morgan; Sheffield joinery supplier, Eclipse Manufacturing; and Rush Matters, the Bedforshire-based creator of the Marlow store’s window plinths and in-store risers, all woven from British rush, harvested by hand by Rush Matters founder, Felicity Irons.

Tring Brewery launches ‘Hop Beard Oil’ with profits raised for Men’s Mental Health

Hector’s House was founded in 2016 to campaign in the name of Hector Stringer, a Tring local who sadly took his life aged 18. Based in Berkhamsted, just down the road from Tring Brewery, Hector’s House aims to prevent suicide and reduce mental health stigma through education, awareness and support.
Jared Ward, public relations at Tring Brewery explains: “We would like to thank Nicky for her selfless efforts in what is now our second charitable collaboration with Bare Essentials, her expertise and shared community values are a perfect fit with ourselves. But there is another story, and it is being told right here in Buckinghamshire by an Amershambased charity which is transforming the life and experience of families caring for children living with the most complex, lifelong conditions.
Roald Dahl’s Marvellous Children’s Charity works in partnership with the NHS to provide Roald Dahl Nurses who are specialists in their field and who help families co-ordinate care while delivering a unique kind of emotional and practical support. And those families report feeling less isolated, stressed and confused as a result – their Roald Dahl Nurses quickly taking them to a place where they can not only have confidence in their healthcare, but feel more

“Our family life is so different because of our Roald Dahl Nurse Teresa,” says Holly, whose five-year-old daughter Maisie (pictured with her mum and dad and brother Harry) lives with Rett Syndrome. “Teresa is so hard working, so caring, and so supportive. Before we had her, we felt lost, and we don’t anymore. If Maisie is admitted to hospital – as she was last week when she was having epileptic seizures – I call Teresa and she appears, looking for us, asking if I’m alright. You are seeing so many doctors each time and they don’t know Maisie. But with Teresa, we have an expert in the room who cares so much for her, who knows her history, and who I know will fight for what is best for Maisie. That makes a difference that is hard to describe….”

Now the clocks have gone back the evenings are drawing in and a chill is in the air our thoughts turn to warming stews casseroles and pot roasts. November is the time when wild game is in full season. At the restaurant we have venison wild duck and partridge all on our menu to reflect the wonderful local game we have around us in the Chiltern Hills. For this month I have chosen to champion pheasant; it is low in fat, readily available, cost effective and above all delicious, the puy lentils
help add an element of richness and soak up all those wonderful winter flavours. As an alternative chicken works extremely well and for a vegetarian option the meat & stock can be replaced using vegetable stock and vegetarian suet dumplings can crown your dish all sprinkled with a generous handful of your favourite herbs. Whichever you decide to go with this month’s recipe let’s celebrate the new season with slow cooking and hearty warming dishes, it’s certainly one of my favourite times of year !.

RECIPE: POT ROASTED PHEASANT WITH PUY LENTILS AND ROOT VEGETABLES
Ingredients
Serves 4
• 2 Oven ready pheasant
• 4 juniper berries lightly crushed
• 2 sprigs of thyme
• 2 bay leaves
• 8 slices streaky bacon
• Salt and freshly ground pepper
For the Lentil Broth
• 200g puy or green lentils
• 800ml chicken stock, hot
• 1 tbsp olive oil
• 2 large carrots
• 1 small celeriac
• 1 onion
• 2 shallots
• 2 cloves garlic
• 4 celery sticks
• 50g diced pancetta
• 200ml red wine
• Salt and freshly ground pepper
Method
1. Season the pheasant inside and out
2. Place the crushed juniper and thyme inside the cavity
3. Wrap the breast with the bacon then quickly brown the whole birds in a hot frying pan
4. Meanwhile prepare the lentils by rinsing them in chilly water.
5. Peel the carrots, onions, and celeriac and cut into a medium dice
6. Peel and finely dice the shallots and garlic
7. Sweat off the shallot and onion in a large casserole pot; add the celery, carrot, celeriac, bay leaf, and garlic.
8. Drop in the lentils and add the red wine and reduce for 5 minutes and then add your hot stock
9. Place your browned pheasants on top of the lentils cover with a lid and cook in a preheated oven 190 degrees C/375 degrees F/Gas Mark 5

11. Return to the oven uncovered for a further 10 minutes
12. Remove the pheasant from the pot turning upside down onto a clean tray to allow the juice to run back into the breast
13. Leave for 10 – 15 minutes in a warm place
To serve
The pheasant can then be cut into quarters, serving a section of breast and leg for each person.
Chefs Tip
The smaller female or hen bird has a more delicate flavour to that of the large male cock bird. The streaky bacon will lend moist protection to the very lean flesh.

The Design Museum has revealed for the first time the highlights of its major autumn exhibition on the exceptional career of director Tim Burton.
Visitors to the museum in west London are invited to step into The World of Tim Burton and to journey through five remarkable decades of creativity. Today the famed and fascinating objects which will be seen are announced — from Tim Burton’s earliest unrealised projects to his most recent film, Beetlejuice Beetlejuice (2024).
Over 600 incredible items will be brought together in the exhibition to chart the evolution of Burton’s unique design aesthetic. Objects are loaned from Tim Burton’s extensive personal archives, key film studio archives including Paramount, Amazon MGM Studios, and Warner Bros., and the private collections of Burton’s collaborators. Many items have never been on public display in the UK before.
Highlights include hundreds of Burton’s expressionistic sketches and drawings that he has created prolifically since childhood. These will be seen alongside props, set designs, and costumes from his iconic films, including Michelle Pfeiffer’s Catwoman costume from 1992’s Batman Returns, and the black and white striped dress from 1999’s Sleepy Hollow, worn by Christina Ricci.
The World of Tim Burton will showcase Burton’s remarkable output, with over 18 of his films individually spotlighted in the exhibition. It will celebrate the creative processes behind some of the most significant movies of the past five decades, including Beetlejuice (1988), Batman (1989), Edward Scissorhands (1990), and Charlie and the Chocolate Factory (2005).
The exhibition comes to London after a hugely successful decade-long world tour that has seen it visit 14 cities in 11 countries since 2014. Yet not only will this be the first and only time it will be
seen in the UK, it will also be the very final time the exhibition will be staged. For this very special homecoming – to Tim Burton’s adopted home city – it has been specially adapted, expanded, and physically reimagined for the Design Museum. Visitors will for the first time be able to take a deeper look at the director’s work by seeing it through a design lens. With the addition of over 90 new objects to the exhibition, this iteration of the show will examine Burton’s hands-on and design-led approach to filmmaking.
A major aspect will also be the spotlighting of his long-term collaborations with designers working across costume, set and production design. This includes the renowned costume designer Colleen Atwood, production designer Rick Heinrichs, architect and designer Anton Furst, and the award-winning puppet makers and stop-motion animators Mackinnon and Saunders.

The Last Noel Navigating Your Final Christmas Together Before Divorce
Christmas, whilst typically a time filled with joy, can also be a time of great difficulty and sadness. The pressures of striving to achieve the “perfect” holiday can leave many relationships at boiling point whilst uncovering differences which cannot be resolved. For others who have already decided that separation is inevitable, the desire to spend one last Christmas together as a family for the benefit of the children can be daunting and exhausting as you try to maintain a façade that all is well.
Many parents agree to “get through” Christmas, knowing that in the new year they will seek advice about the divorce process. Delaying the start of a divorce until after the school holidays is one of the reasons that divorce enquiries typically rise in January.
If you have decided that there is no prospect of reconciliation, the festive period provides space and time for reflection about what Christmas going forward might look like. There will no doubt be changes in arrangements and consideration will need to be given to what might logistically work for your children.
The festive period affords you the opportunity to take stock and consider whether divorce is the right path to pursue and to deal with the process at a point in time that is less stressful to you both. Avoiding acrimony is better for everybody’s sake but especially for your children.
The arena of divorce and separation may already be familiar to you if you’re in the midst of your journey. This comes with its own challenges such as trying to agree when the children will spend time with you or your former partner over the Christmas period and who will have them for Christmas Day. There is never an easy solution to these difficulties but creating new traditions within the separate family units can create excitement for children in what might be very different circumstances.
If you are struggling to agree child arrangements for the Christmas period and may already be embroiled within Children Act proceedings and experiencing huge court delays, the Family Mediation Voucher Scheme may assist. Family mediation at Christmas
The holiday season is a time of celebration and family gatherings. However, for separated or divorced parents, it can also be a period of stress and conflict, particularly when there is no clear plan for child arrangements over the festive break. Although there are many legal avenues to resolve such disputes, mediation is often the most preferred route by many. Lucinda Holliday, Partner and Head of Family & Divorce at Blaser Mills Law, explains how mediation can help to relieve some stress this Christmas.
What is mediation?
Mediation is a voluntary process where a neutral third party, known as a mediator, helps the disputing parents to reach an agreement. In the context of family law, mediation can be used to resolve a wide range of issues, including child arrangements during the holidays. The mediator does not make decisions for the parties but facilitates communication and negotiation between them to help them reach a mutually acceptable solution.
The benefits
Mediation offers several advantages over litigation. It is generally quicker, less stressful, and less expensive than going to court. It also allows the parties to maintain control over the decision-making process, which can be particularly beneficial when dealing with sensitive issues such as child arrangements. Additionally, mediation encourages cooperation and communication, which can help to improve the long-term relationship between the parents, ultimately benefiting the children. The process
The mediation process typically begins with an initial meeting, known as a Mediation Information and Assessment Meeting (MIAM). During this meeting, the mediator will explain the process, assess whether mediation is suitable for your situation, and answer any questions you may have.
If both parties agree to proceed with mediation, the mediator will arrange a series of sessions where you and the other parent can discuss your issues. These sessions are confidential, and the mediator will ensure that both parties have an equal opportunity to express their views and concerns.
During the mediation sessions, the mediator will help you and the other parent to explore different options and negotiate an agreement. If an agreement is reached, the mediator will draft a Memorandum of Understanding, which outlines the terms of the agreement. This document is not legally binding, but it can be converted into a legally binding court order if necessary.
What can I do if I don’t have a plan?
If you and the other parent have not yet agreed on where the children will spend Christmas, mediation can be an effective way to resolve this issue. Below are some steps you can take:
1. Contact a mediator: Lucinda Holliday can facilitate mediation at Blaser Mills Law, she also offers child inclusive mediation.
2. Attend a MIAM: This meeting will help you understand what mediation involves and whether it’s the right approach for your situation.
3. Prepare: Ahead of the sessions, think about what you want to achieve and any potential compromises you might be willing to make. It can also be helpful to seek legal advice so that you understand your rights and responsibilities.
4. Participate: Try to stay open-minded, listen to the other parent’s perspective, and focus on the best interests of the children. Remember, the goal is not to ‘win’ but to reach a solution that works for everyone.
5. Implement: If an agreement is reached, make sure you understand the terms and how they will be implemented. If necessary, you can ask the mediator to draft a court order to make the agreement legally binding.
In conclusion, while disputes about child arrangements during Christmas can be challenging, mediation offers a constructive and cooperative way to resolve these issues. By focusing on the best interests of the children and working towards a mutually acceptable solution, parents can ensure that the festive season is a time of joy and celebration for everyone.

Lets Talk Implants
What is a dental implant?
A dental implant is titanium, cylindrical, threaded fixture that is inserted into the jawbone to replace a missing root. The implant is then used as the foundation for the new crown. Dental implants can be used to replace a single tooth or a full mouth with no teeth. Titanium is a unique material in that new bone will grow onto the surface of the implant therefore “fusing” the implant to bone, a process known as osseointegration.
What are the benefits of implants?
Implant secured or stabilised replacement teeth are more comfortable than conventional dentures because there is no slipping or movement. This eliminates some of the key worries of dentures and improves self confidence.
Dental implants are the alternative to bridgework for permanently replacing missing teeth, eliminating the need to grind down healthy teeth. When teeth are missing the surrounding bone begins to shrink. Dental implants can help maintain the shape and structure of the jaw bone.
How long does it take?
It depends on the complexity of the treatment plan. Work may need to be carried out prior to commencing implant therapy. This may include improving oral hygiene, fillings, crowns and extractions. Also in certain situations, pre-operative bone grafts may be required in order to provide sufficient bone for implants.
For routine cases osseointegration takes 5 to 6 months in the upper jaw and 3 to 4 months in the lower jaw. Further tissue healing, impressions and fitting of the crown can take another month or so. The availability of better bone can be used to decrease treatment time, whilst more time and care must be taken with poorer bone, which can therefore extend treatment times. If there is no reason to shorten the duration of your treatment then be prepared to wait- nobody loses an implant from being patient and allowing nature to take its course.
Are they successful?
Dental implants produce predictable long term results and well maintained implants can be expected to last for many years and probably for your lifetime. Just like your own natural teeth, implants require regular follow up and professional cleaning by an implant hygienist as well as maintenance.
Currently failure rates are much less than 5%
Is it uncomfortable?
Implant surgery is a minor operation. Most patients would say it is less painful than an extraction. But it is wise to avoid significant social engagements for 5 days postoperatively as some minor swelling and bruising can occur. For most patients simple painkillers are required, but we may also prescribe stronger painkillers if necessary. Antibiotics may also be prescribed. Although most implant operations are straightforward and can be carried out under local anaesthetic, some patients are understandably anxious. For this reason many patients choose to have the first stage (implant placement) carried out under oral or intravenous sedation.
Are implants expensive?
Implants may seem expensive initially, but in the long term they are more cost effective without damaging the adjacent teeth and are placed by surgeons who have undergone post-graduate training.
Will I be without teeth?
It is normally necessary, particularly towards the front of the mouth, to construct some form of temporary teeth. These may be temporary crowns, bridges, or dentures. It is also possible to use immediate temporary implants to give rigid fixation while the final implants osseointegrate.

Let’s talk about sex
Let’s face it we all do it, we all think about it and we all need it…. Be it in different forms and different ways. We all need sex. Whether on your own or as part of a couple (or more!) it’s an important part of human connection and expression.
Except when we can’t or there’s a problem. Then it becomes very difficult to talk about it and perhaps to seek help or to even know where to go. There can be many reasons why sex may not work. There can be pain, dryness or for men a lack of function making penetration difficult. For either men or women libido can drop and this can happen for many reasons. Stress, kids,
lack of sleep or exercise can contribute to the sex hormones being diverted to form cortisol and this can impact your desire. For women the post-natal or perimenopause phase can be a very challenging time.

Until recently, breathwork in the West has generally been experienced as part of an activity such as yoga or meditation. However, with increasing research proving its incredible healing benefits, this ancient practice is currently enjoying a rise in popularity in mainstream wellness as a stand-alone discipline.
As a yoga teacher, I understand the power of the breath to help rebalance a dysregulated nervous system and thus improve both health and wellbeing. So, when I met Caroline Boyle, Seed’s Breath Guide, and learned about her breathwork classes, I was intrigued to find out more.
So, what is breathwork?
Breathwork means taking conscious control of your breathing pattern to improve your physical, mental and emotional state. It encompasses a variety of breathing techniques, from simple breathing patterns such as box breathing though to fully guided sessions.
Caroline’s journey to becoming a breath guide began during her treatment for breast cancer. Said Caroline. “Following my diagnosis and faced with a treatment plan which included 16 rounds of chemotherapy and surgery, I felt totally out of
control. I knew I needed to do something to support myself through this challenging period. I began to practice breathwork each morning and the change I felt was incredible, I began to feel calm, connected and positive.
“When my treatment was finished I booked myself into a breathwork retreat in Sweden, where the full transformational breathwork experience blew me away. I decided to return there to train as a qualified breath guide so I could bring this incredible healing tool to others.”

3. Flooring Focus
Flooring is often overlooked. While some equipment can be used on regular domestic flooring, high-impact exercises, heavy weights, or machines can damage standard floors. Rubber tiles provide shock absorption and protect the subfloor but can be unsightly. 1. Stay Active: Take breaks during long journeys to walk and stretch your legs.
2. Hydrate: Proper hydration is vital for maintaining healthy blood circulation. Drink plenty of water to prevent dehydration and reduce the risk of blood clots.

Nellies is a concept store where you can enjoy a glass of wine in a decadently designed bar setting, with all of the interiors available to purchase. The ground floor bar features furnishings, flooring, wallpapers, lighting and accessories that are all available to order and clients can sit on and experience our furniture while enjoying a glass of wine, and shop for the home in a really fun way. Upstairs is an interiors boutique & showroom so you can pick up a gift or order a bespoke sofa and everything in between, and on the top floor is our Interior Design studio and client lounge & dining room. As we specialise in bespoke kitchens too, we decided our ‘Bar’ would be a stunningly made bespoke kitchen.

Although we have a signature style, we love to get to know our clients and what it is that they want to achieve with their space in terms of relaxation and practicality to deliver them a design that is highly personal to them that they’ll love for years to come.
We don’t charge for our time, we just take a design deposit which is fully redeemable on the items purchased, so our design process is entirely free of charge, and one hundred percent of the clients budget goes on the products that they keep. Great design doesn’t have to cost the earth.
