Challenging the Validity of a Will
Sometimes, when a loved one passes away, there are circumstances where the family left behind do not accept that their loved one’s last Will accurately reflects their intentions. This could be for a number of reasons and you may want to investigate further, particularly when something doesn’t look quite right. There are steps that can be taken in those circumstances, to investigate the circumstances under which the Will was prepared.
Lodging a Caveat
In order to deal with the assets of a deceased, the executors of a Will would need to apply for a “grant of probate” which is a document that provides the executor (who is named in the Will) with the legal authority to deal with the administration of a deceased’s estate.
If you have concerns about the validity of the last Will, you can stop a grant of probate being taken out by entering a “caveat” at the probate registry. This is a relatively simple procedure that requires a short application to be made to the Probate Registry
and prevents a grant of probate from being taken out. A caveat lasts 6 months from the date of entry and can be renewed every 6 month periods for the same period. This allows you time to raise enquiries about the circumstances under which the Will was prepared in the secure knowledge that your loved one’s estate is not being administered.
Types of challenge
The most common reasons for challenging the validity of a Will are dealt with below.
Want of Due Execution
To be valid, a Will must be executed in accordance with s. 9 of the Wills Act 1837. In short
• The Will must be in writing and the testator must sign it, or another person must sign it in their presence and at their direction.
• It must appear that the testator intended by their signature to give effect to the Will.
• The signature must be either made or acknowledged in the presence of at least two witnesses present at the same time.
• Each witness must sign the Will, or acknowledge their signature, in the presence of the testator (but not necessarily in the presence of any other witness).
If the Will fails to comply with the above, it will be considered invalid.
Lack of Testamentary Capacity
For a testator to make a Will, they must have sufficient testamentary capacity to do so. The test set out in Banks v Goodfellow provides that a testator must understand:
1. the nature of the act of making a Will and the effects of the Will;
2. the extent of the property of which they are disposing of;
3. the claims on their estate to which they ought to give effect; and
There should also be no disorder of the mind so for example, if the testator had severe dementia at the time he or she made his Will, they are unlikely to have had the necessary capacity.
Want of Knowledge and Approval
The testator must have known and approved the contents of their Will in order for the Will to be valid. Proof of the testamentary capacity of the testator and due execution of the Will provides an inference that the testator knew and approved its contents. However, issues under this head may arise in the following circumstances:
1. the testator is deaf, dumb or blind;
2. where the party who writes or prepares the Will takes a benefit from it;
3. where there is an obvious mistake in the Will.
Undue Influence
A Will that has been procured by undue influence is not valid because it does not represent the testator’s true wishes. In Edwards v Edwards [2007] EWHC 1119, undue influence was described as coercion which is a:
‘pressure that overpowers the volition without convincing the testator’s judgment. It is to be distinguished from mere persuasion, appeals to ties of affection or pity for future destitution, all of which are legitimate.’
Establishing undue influence is difficult as by its very nature, it takes place behind closed doors. The court recognises this and will take a holistic view of all the circumstances before reaching its conclusion.
Fraudulent Calumny
Fraudulent calumny differs from undue influence in that the offending party changes the testator’s mind by casting dishonest aspersions on a potential beneficiary. The following factors must be established:
1. There must be a false representation;
2. To the testator;
3. About the character of an existing or potential beneficiary;
4. For the purpose of inducing the testator to alter their testamentary disposition;
5. In the knowledge that the representation is untrue, or recklessness as to its truth; and
6. The fraudulent calumny induced the testator to make the disputed will.
Forgery
The most common form of fraud pleaded in Will validity claims is forgery which usually involves a claim that the signature to a Will that is forged. Other types of fraud on a Will include where sections or pages of the Will are removed, inserted, replaced or if the entire document is forged.

The oily sardine cut beautifully with citrus orange combined with toasted breadcrumbs, pine nuts and raisins all forming the Sicilian classic “sarde a beccafico.” Of course, if you have access to fresh Cornish sardines then use them but I have replaced them for more readily available small size fresh mackerel.

On 28 September we’re celebrating the 200th anniversary of the naming of the first ever dinosaur species, Megalosaurus bucklandii with a special Dinosaur Day. Discover hands-on objects and activities exploring dinosaurs and other prehistoric animals including an opportunity to handle some real dinosaur fossils. Meet experts from the Oxford Museum of Natural History, Bucks Geology Group and the Isle of Wight’s famous Dinosaur Isle Museum.
On 4 October experience something different with a unique magic show Dreams and Deceptions that delves into the fascinating life of a magician. And every month one of our expert curators gives a fascinating talk about an aspect of the collections which is accompanied by a delicious afternoon tea.

Every Wednesday our Stay and Play Café offers a play space, free tea and coffee and chance to meet other parents. This month’s recipe has been inspired by our recent Sicilian trip where amongst the many great dishes we ate this simple combination was stand out. fresh mackerel. Your fish monger will happily fillet them for you if you wish and a small pair of tweezers will assist in removing the tiny pin bones which run down the fillet. Once prepared these wonderful fish parcels can be set up in an oven proof pan ready to be cooked in a pre-heated oven just before you need them. A simple salad of raw fennel thinly sliced with watercress sits nicely with the dish and for a little extra va va voom finish with this piquant vanilla orange dressing.
RECIPE: SICILIAN INSPIRED STUFFED MACKEREL

FILLET, FENNEL, AND WATERCRESS SALAD, ORANGE, VANILLA, AND CARDAMON DRESSING
Ingredients
Serves 4
• 8 small to medium mackerel or sardines
• 200g breadcrumbs
• 50 g finely chopped Parsley
• 50 g pine nuts
• 50 g raisins
• Salt and freshly ground black pepper to season
• 1 orange grated zest and juice
To Serve
• 1 large bulb of fennel thinly sliced
• 1 bunch of fresh watercress - washed
• 500 ml orange juice
• Small clove of garlic
• Half a fresh split vanilla pod
• 3 cardamom pods
Method
1. Wash and split the mackerel in two, leaving the fillets attached by the tail.
2. Toast the breadcrumbs in a pan, then remove from the heat and add plenty of chopped parsley, pine nuts, raisins, salt, ground black pepper and the juice and grated zest of one orange.
3. Place the mackerel flat skin side down with the two fillets side by side and the tail at the end
4. Arrange a little of the mixture on each of the mackerel fillets, roll them up towards the tail and arrange them in an oven-proof pan.

Tips for parents with children starting secondary school
It’s a new life stage for kids and parents alike, says Claire Spreadbury.
It’s the end of an era when your child leaves primary school. Your life and support network have been intertwined within a community that’s always at the end of the phone – if not a WhatsApp message – but now big school is looming and it’s time to move on.
Some of that network moves on with you, but a lot of it won’t. And discovering the best ways to tackle secondary – and all the difficulties that can come with it – is often tricky. Arm yourself with these tips and you should breeze through.
Get them kitted out with epic new stationery
Smiggle might rule the school at primary, but once they’re 11, Stabilo pens and highlighters are top of the lust list, and Paperchase becomes your go-to. Pencil cases should be sleek and cool, and funky organisers and pads make the whole experience feel fresh.
Label everything
Once they’re starting secondary, everything seems to cost quite a bit more – the fancy stationery, the school bag, the uniform. To avoid pouring all that money down the drain, be sure to label everything, so you can claim it back if (when) it gets misplaced. You can buy name stamps which don’t wash out, stickers which genuinely stay put or even grab a good old Sharpie and write on the labels.
Deck them out in cool shoes

Get to know other parents
When your child makes new friends, it’s much harder to get to know their parents. Lots of kids make their own way to school, and they have a phone to organise their own socials. This can feel a little bit worrying when your son or daughter is talking about going to a sleepover and you’ve never even met the child whose house they are staying at, let alone their mum or dad. Undoubtedly, this will get harder. You will be an embarrassing and interfering parent, so before they reach the Kevin The Teenager stage, try to get parents’ numbers, invite kids to your house, ask their mum or dad in when they come to pick them up – it can really help to reassure you.

PRIVATELY EDUCATED PEOPLE DOMINATE TOP BRITISH JOBS
The study, by the Sutton Trust education charity, shows that virtually every key profession is dominated by privately educated pupils grabbing the senior management/director positions
Their grip on power is most noticeable in the judiciary, where 74 per cent of leading judges (those in the High Court or Court of Appeal) were privately educated.
Figures in the report also show that one in three MPs (32 per cent) was privately educated –as were half the members of the Conservative Cabinet. Even in Jeremy Corbyn’s Shadow Cabinet, 13 per cent of members went to private school. Nationally, the figure is just 7 per cent.
The report, carried out by Dr Philip Kirby, goes on to show that 71 per cent of senior Army officers – two-star generals and above – went to private schools. Only 12 per cent attended comprehensives.

In medicine, 61 per cent of doctors were privately educated while 22 per cent went to selective state grammar schools and just 16 per cent to comprehensives. The list goes on – 48 per cent of civil servants were educated privately, 29 per cent went to selective grammar schools and 23 per cent to comprehensives.
The higher echelons of journalism are also dominated by the private sector, with 51 per cent educated in independent schools. And of those chief executives of FTSE 100 companies who were educated in the UK, 34 per cent were privately educated.
Nearly half the top actors – 42 per cent of Bafta Award winners – went to private schools, fuelling criticism that the profession is becoming more elitist.
“Our research shows that your chances of reaching the top in so many areas of British life are so much better if you went to an independent school,” said Sir Peter Lampl, the chairman of the Sutton Trust. “As well as academic achievement, an independent education tends to develop the essential skills such as confidence, articulacy and teamwork, which are vital to career success.

Conveyancing fraud is on the rise – how can you protect yourself?
Amid the bustle of buying or selling a home it can be easy to fall victim to conveyancing fraud.
B P Collins’ property team explores how to recognise potential conveyancing cons and help you protect your finances.
Types of fraud
Common types of conveyancing fraud occur when criminals hack into your emails or steal personal information. This enables them to create an account to impersonate your solicitor and request payment.
Be wary if you are asked to transfer money into a new account, face an urgent request for funds, encounter unexpected extra expenses, or receive a payment request earlier than anticipated. If you make a payment to a scammer, by the time you realise your mistake, your money will have been moved and become untraceable.
Look closely at your emails
Traditionally, a phishing email, where the scammer tries to obtain your bank details, would have contained plenty of spelling mistakes, but as they become more sophisticated, this is less common.
One major indicator of fraud can be the sender’s email address. Criminals often create email addresses that differ from your conveyancing
solicitor’s address by just one letter. They might also mask their true email address with a fake one to appear genuine.
Top tips to avoid conveyancing fraud
• Check the address of every email and hover over any links to check whether a different web address lies behind it.
• Sign up to HM Land Registry Property alert service, which is free and helps to protect your property from criminal activity.
• Treat any urgent request to transfer money with suspicion.
• If you have any concerns, call your solicitor, using the phone number given on their website, rather than any included in the email.
• When speaking on the phone, always check who you are speaking to.
• If you decide to make a payment, transfer £1 first and call your solicitor to ensure it has been received.
• Check what security measures your conveyancing solicitor has in place to protect against conveyancing fraud.
• Trust your instincts and closely review all emails before making any payments.

Blaser Mills Law launches community group
July marked the exciting launch of Blaser Mills Law’s employee-led community group, a key part of the firm’s Responsible Business initiative. The group aims to foster long-term relationships with both charitable and non-charitable local organisations, particularly within the communities surrounding the firm’s offices in Buckinghamshire.
The community group consist of seven passionate staff members dedicated to raising awareness about issues affecting the local communities that Blaser Mills serves. Kicking off their efforts with a fundraiser for the children’s charity, Action4Youth.
The group was particularly impressed with Action4Youth’s work, especially their youth club in High Wycombe town centre, which not only provides a meeting place for young people but also offers the support of an on-site crisis counsellor.
Recognising the need for funds to support these facilities, the community group organised a charity Golf and Yoga day at Harleyford Golf Club with the attendance and support of the local business professional network. Despite questionable weather, the event saw strong team spirit, with everyone coming together to raise an impressive total amount of £2,320. Following this, the group hosted an additional fundraiser—a lucky dip event for all Blaser Mills employees—raising a further £300 for Action4Youth.
Jenifer Cameron, CEO of Action4Youth, commented:
“We are delighted with the funds raised by Blaser Mills. The funds are just invaluable to enable us to reach more children and young people in the region with our life-changing projects. Our work includes mental health and wellbeing support, leadership and life skills, employability and anti-knife and gang crime projects. We also have a centre, The Junction, in High Wycombe which offers support and a programme of activities 7 days per week completely free of charge.”
Looking ahead, the community group is looking forward to collaborating with Action4Youth on their upcoming projects, with a few other initiatives in the pipeline.
Amanda Stopps, a High Wycombe resident and Head of Practice Management at Blaser Mills, as well as a member of the community Group, emphasised the group’s core values:
“Central to the ethos of the community group is integrity. We have no hidden agenda, we simply wish to build relationships with local groups and assist where we can.”

The consultant-led care package allows you the choice of one of their experienced consultant obstetricians to personally guide you through your pregnancy and birth. Your consultant provides continuity and individualised expertise throughout your journey. They build a relationship with you and your partner through the antenatal period to give you confidence to birth safely with them in line with your birth preferences. They continue to support you through the postnatal period, including your 6 week postnatal check. All consultants are available to meet you and your birth partner without any obligation.

Top tips for blemish-free legs with leading consultant vascular surgeon Michael Gaunt
Few of us have blemish-free, perfect party legs. A familiar problem is thread veins or “spider” veins. Hard to disguise thread veins are common around the ankles, knees, and thighs and may also appear on the face. They initially emerge as one or two tiny red or purple lines, but quickly develop a web-like pattern, that enlarges across the skin, deepening in colour. Thread veins may cause symptoms of discomfort, itching and irritation.
Unsightly but treatable
Thread veins develop and increase over time as localised patches. Early treatment is advisable to gain healthy looking, blemish-free skin.

Thread veins on legs and ankles may be the first visible indication that there is a vascular problem. I always assess patients using a Duplex Ultrasound Scan to identify underlying varicose veins and provide a bespoke treatment plan. If varicose veins are left untreated, thread veins will be less responsive to treatment and will recur.

What treatments are available?
I specialise in minimally-invasive varicose veins surgery: Endovenous Laser and ClariVein techniques. For many patients, these procedures can be performed under local anaesthetic as walk-in, walk-out treatments.
An Outpatient treatment for less extensive varicose veins is Ultrasound-Guided Foam Sclerotherapy (UGFS). Saline injection sclerotherapy treats thread veins on the legs effectively and VeinWave is my preferred option for facial veins.
