He is focused on membership, committed to making FSAE the value it should be to our members and our associate partners, and he is dedicated to making purposeful movements to achieve the goals that he has discussed with the FSAE Board.

great organization is leadership. The FSAE Foundation is fortunate to have an abundance of excellent volunteer leaders. In February, the Board of Trustees elected new trustees and officers for 2014/2015. Debra Boza-Valledor, CIPS, CRB, CRS, GRI, TRC, Chief Operating and Chief Marketing Officer of the Miami Association of Realtors, was elected ChairElect last year and will be installed as the FSAE Foundation Chair at the Annual Conference in July. Jaime Caldwell, ACHE, Vice President of the South Florida Hospital & Healthcare Association, the current Foundation Treasurer, was elected Chair-Elect and Donna Son, Executive Vice President of Operations and Administration/Chief Financial Officer at the Florida Institute of Certified Public Accountants was elected Treasurer. Additionally, three new trustees were elected to three-year terms. They are: Meg Caldwell, CMP, Sales Manager at the Grand Hotel Marriott Resort, Golf Club and Resort; Pam Fields, National Sales Manager, Sundial Beach Resort and Spa; and Fran Gilbert, CAE, Executive Director of the Florida School Nutrition Association.

I want to thank our CEO Search Committee members, led by Jim Ayotte, CAE who accepted my invitation to Chair this committee and play a large part in FSAE’s new journey. Committee members were from across the state of Florida, in a variety of positions within their Associations, represented a span of ages, and are among the best in our industry. Their dedication to the many hours of time it required to review applicants, interview applicants, and then deliberate on which candidate would best serve FSAE, is to be commended. Vetted Solutions who spearheaded our search process, was an incredible resource for us. We would not have been able to complete our search in such a short time without their team working on our behalf. Jim Zaniello who was our primary contact will be returning to FSAE at the Annual Conference and will be speaking at the CEO Roundtable. We will thank him publicly for his efforts in our success at that time. To each member of FSAE, I want to thank you as well. Many of you have shared with me and the Board your thoughts on FSAE’s future. We know what you have shared with us comes from a place of passion for FSAE’s success. Your commitment to believe in our process and your willingness to trust that the Board was acting in the best interest of the Society has truly allowed us to move

If you have ever considered getting more involved in FSAE or the FSAE Foundation, I encourage you to take the plunge and volunteer for a committee. Committee work is an excellent entrée into the organizations and a pathway to leadership. Your volunteer service will be professionally and personally rewarding. One of the most important functions of the Foundation is providing scholarships/grants to help members defray the cost of professional development. Last year, 12 professional development grants were awarded totaling $7,525. These grants were made possible by member and corporate contributions. I want to thank all of our Investors as well as our Corporate Scholarship Partners, Hyatt Hotels of Florida and Marriott International Hotels & Resorts of Florida. The deadline for all scholarship applications is April 15, 2014. Get your application in early! Frank Rudd,

CAE, CMP

The New President/ CEO of FSAE by Adrian Amos, Source Editor, FSAE FSAE runs through Frank Rudd’s veins. In 1985, while still in college, Frank went to work part-time for Peggy McCollum and helped with the Annual Conference in Marco Island. For the next 29 years, Rudd has had many roles in FSAE as a member, committee chair, think tank participant and been involved in numerous annual conferences. In February, the FSAE Board Chair Eleanor Warmack, CAE announced that Frank Rudd, CAE, CMP will be FSAE’s new President and CEO beginning on April 1. A Tallahassee native, Frank’s entire career has been in association management. He graduated from Florida State University with a degree in business management and an emphasis in Association Management – a degree program that was implemented with the help and leadership of FSAE. Immediately upon graduation, Frank went to work for McCollum Management and Meetings on a full time basis. Frank’s association career also includes serving as Director of Meetings at the Florida Home Builders Association and ten plus years as the Executive Director of the Florida School Food Service Association. For the

past 12 years, Frank has served as Executive Director of the Florida Engineering Society and the Florida Institute of Consulting Engineers. Anxious to get started and steer FSAE in the right direction, Frank said, “I am looking forward to hitting the ground running in promoting all that FSAE has to offer the association community. I think my familiarity with the Society will make for a short learning curve and we can help maximize the ROI of our members.....and convince our non-members that we need them and they need us!” “My first goal as I walk in the door is to work on creating a culture of outstanding customer service at FSAE,” said Frank. “We will have a responsive staff that goes above and beyond our members’ expectations. I am ready to bring in a new energy and enthusiasm to the organization. A successful association is one that is always looking to innovate and not just do a program because we always have. It will be our job to listen to the feedback of the membership and continue to transform our programs to meet their needs.”

My first goal as I walk in the door is to work on creating a culture of outstanding customer service at FSAE. Even though Frank never worked in sales, he has a strong ‘sales’ mentality and believes the customer/ member is always right. “I always think about that member of an association who may only call the office one time and his decision to get involved with the association – or renew – will be based on that one experience, so it has to be positive. That is the culture I plan to create, and build the organization from there.” “Florida is a large and diverse state and we need to serve all our members in all areas,” Frank continued. “Offering a variety of programs like in-person events and online training gives members access to the information they need, on their own time. The universal struggle for associations is to continue to innovate delivery methods and provide value to its members – do what they want, when they want it. I’ll be talking to our members and non-members to listen to what you need and how FSAE can help you succeed.” Frank plans to work with our membership and Board of Directors to develop the strategies that make Has your association implemented an innovative program? Both the FSAE Board of Directors and the Foundation Board have excellent leadership and a strong vision of where they want their professional association to be. Our associate members are as supportive of FSAE as any I have ever seen. This is a great benefit to the Society and I look forward to making that relationship stronger and beneficial for all involved.” “I’ve known and loved FSAE for a long time and I’m fortunate enough to be in a position in my career where I can devote my time to something I’m really passionate about: strengthening the profession of association management. Associations are built on relationships and early in my career I developed relationships with people I still call on today. I want this organization to provide that opportunity to current and future leaders in the industry.” Frank’s plan for FSAE is simple: communicate, listen to member feedback, exceed expectations.

Frank owes more than his professional life to FSAE, he met his wife Melissa at the 2004 Annual Conference at the Marco Island Marriott. Married now for 9 years, they have two children, Emily (7) and Andrew (5). Most of Frank’s free time is filled with family activities but he does run and swim to keep active and healthy. Member News Association News Florida Association of Special Districts Names New Executive Director The Board of Directors of the Florida Association of Special Districts (FASD) has appointed CMC & Associates (CMC) to manage the office of Executive Director with Fred Crawford as the lead. FASD is celebrating its 35th anniversary, and the association is proud to have been the driving force that has strengthened the laws that govern special purpose governments and for providing education regarding special districts to its members and the general public. CMC will lead FASD in its mission to unify and strengthen special purpose government through education, the exchange of ideas and active involvement in the legislative process.

Partners In Association Management Joins With Marriott To Support Local Charity In December of 2013, Partners in Association Management (PIAM) was selected by Marriott Hotels of Florida as a Partner of the Year. The selection committee based their decision on criteria that included culture, industry impact and community involvement. This award was also granted to two other local businesses for their support and involvement. Marriott Hotels of Florida awarded PIAM with a contribution of $500 to a local charity of choice. PIAM selected Big Bend Hospice and decided to match the donation for a total of $1,000 towards this organization. They are proud to support Big Bend Hospice as those funds were earmarked towards the recent Hospice House Campaign for Our House.

FRLA Members Donate Reusable Inventory to the Florida Department of Corrections The Florida Restaurant and Lodging Association (FRLA) is proud to announce a new partnership with the Florida Department of Corrections. Employers to Watch in 2014 Over the past few years, employers have been under assault from, among other things, a spike in employment discrimination and overtime lawsuits, and expansive governmental interpretations of federal employment statutes. This year, association employers must be as vigilant as ever in guarding against the traps and snares of personnel related issues. There are five hot topics association employers should keep in mind in 2014: minimum wage laws; pending state and federal legislation that further expand the types of lawsuits employees may bring; retaliation or whistleblower lawsuits; the proper classification of employees; and an evaluation of the need for employment liability insurance.

Minimum Wage Laws and Employee Practices

In Florida, the state’s minimum wage is adjusted annually in January to reflect changes in the consumer price index. This year, Florida’s hourly minimum wage increased to $7.93 for most employees and $4.91 for tipped employees. Effective January 1, 2015, federal government contractors and subcontractors will be required to pay their employees an hourly minimum wage of $10.10, and $4.90 for tipped employees.

While paying employees the appropriate hourly wage is important, association employers must also be mindful of other traps that can lead to wage and hour litigation. Toward this end, the following practices should be routinely implemented within the organization: (1) review the association’s handbook and policies with employees on a regular basis, making sure they understand the proper protocols for preparing to begin their shift, clocking in and out, taking lunches and taking other breaks; (2) review job descriptions to ensure they are reflective of what employees are actually doing; (3) consider implementing a time-clock or other time recording device to ensure employee time is being accurately recorded; and (4) make sure a procedure exists for employees to raise concerns over their exempt/non-exempt status.

Pending Legislation

The 2014 Legislative Session is upon us, and several key bills, if passed and signed into law by Governor Scott, will dramatically impact the workplace. Here are a few examples of bills affecting Florida’s employers:


• Florida Senate Bill 206, entitled the “Helen Gordon Davis Fair Pay Protection Act,” seeks, among other things, to require employers who have state contracts to comply with anti-discrimination and affirmative action requirements to ensure that women receive equal pay for equal work.

• Florida Senate Bill 220, which would amend the Florida Civil Rights Act to include the prohibition of discrimination on the basis of pregnancy.

• Florida Senate Bill 324, subject to various exceptions, this bill prohibits employers from considering an applicant’s credit history in determining compensation, terms, and conditions of employment.

• Florida Senate Bill 444 revises the penalties and other requirements of stop-work orders issued under the Worker’s Compensation Act.

Retaliation and Whistleblowing

Over the past four years, retaliation claims have been on the rise; in fact, these claims now exceed the number of claims of race discrimination filed in the state of Florida. A classic example of a retaliation claim involves an employee who, whether true or not, reports to a supervisor that he or she was the subject of sexual harassment or racial discrimination, and later has some job action taken against them that they perceive as retaliatory. Federal and state anti-retaliation and whistleblower laws provide protection to individuals who report what they believe to be an unlawful act or participate in an investigation or a proceeding concerning the act.

Employers can trip themselves up by failing to train their supervisors in this crucial area of the law and by failing to proceed with caution before taking action against employees who report allegedly unlawful conduct. Even where the complaint made by the employee is baseless and the employer has not actually discriminated against the employee, the employer may still be on the hook for the subsequent mistreatment of the reporter. Defending an allegation of retaliation can be a costly endeavor. It is important for employers to seek the advice of counsel once an employee makes a complaint of discrimination or unfair treatment to ensure the proper steps are taken in responding to the complaint and with regard to the subsequent treatment of the complaining employee. Management must also be certain that appropriate procedures for receiving reports of unlawful conduct, investigating, and remedying the behavior are in place and are being used by employees. It is equally important that employers analyze whether they are being consistent in documenting both positive and negative performance and conduct of all employees.

Classification of Employees

As the year progresses, employees may transition into positions with a higher degree of authority, a different range of duties and responsibilities, and different schedules and pay rates. Similarly, workers with whom employers contract as independent contractors may find themselves being asked to do more than what is called for in an independent contractor agreement. These types of changes may have legal and tax implications. Employers would do well to consistently review employee titles, duties, responsibilities, and hours worked to assess, among other things, whether they are subject to the exemptions of the Fair Labor Standards Act. The failure to take the time to engage in this type of review can lead to overtime litigation, a distraction with which no employer wants to deal. Similarly, the Obama Administration has signaled its desire to ensure America’s workers are being properly classified as independent contractors or employees, and has stepped up enforcement of applicable provisions of the tax code. Obtaining an annual opinion from a CPA and legal counsel to ensure workers are being properly classified should become as routine as year-end office parties, and will go a long way toward keeping the association employer out of hot water.

Employment Practice Liability Insurance

From allegations of discrimination in the hiring process, to a failure to accommodate a disability, or a claim of discriminatorily applying policies to members of a certain national origin or race, association employers that meet the jurisdictional thresholds of state and federal employment laws may be sued for a broad range of issues. As a result, employers are turning to the insurance industry for solutions. Obtaining an insurance checkup on an annual basis is crucial to protecting against risks of all kinds. For associations that do not already have employment practices liability insurance (commonly known as “EPLI”), it is advisable to ask an insurance agent with specific experience writing such policies whether the organization should obtain such coverage. For

In Your Own Words What’s one of the most interesting things you’ve hosted or experienced at a conference or meeting? One of the most interesting programs I’ve experienced is at our national convention. Annually our national counterpart has a live stream of the quality dealer (member) awards ceremony. They treat it like the Oscar’s; we even have commercial breaks. Each state submits their state quality dealers and among those nominations a national quality dealer is selected. Each nominee is videotaped prior to the ceremony and the audience sees why they won for their state. We are even queued to applaud for the viewing audience. Teambuilding and philanthropy have become large components of conferences I’ve seen hosted at my hotel. We recently had a company that combined both of these into one unique activity and it was extremely successful. Each team took donated food items, such as boxed pastas and canned goods, and built a putt-putt golf hole. Once the teams were done building, not only did they get a chance to play the

What do you think is the next hot trend in conferences, meetings or tradeshows? The events industry is always evolving and it’s so important that while we progress we always keep the main objective in mind. Opinions may differ on what that main objective is, but I see it as attendee engagement. We need to engage our attendees with pertinent and current educational topics, give them opportunities to network, and entertain them so they are energized and involved. I see a hot new trend of “Edu-tainment” emerging. This trend focuses on ways we can educate and entertain simultaneously. A lecturestyle session is becoming less and less appealing and people are gravitating to educational opportunities where both fun and attendee involvement is a main focus. Hybrid meeting have started to emerge. How do you see hybrid meetings affecting the meeting planner industry? As an association executive we are dealing with the evershrinkingbudget and hybrid meetings offer flexibility. Hybrid meetings provide a favorable economic opportunity and if properly integrated into an overarching and diverse event strategy, this meeting model can be advantageously leveraged to: reduce costs associated with producing traditional events, increase attendance and broaden attendee reach and it adds attendee value. Do you have a tradeshow at your conference(s)? How do you encourage attendees to visit and interact with vendors? We offer the opportunity to win one of three cash prizes at our conference tradeshow. In the past we had the


traditional punch card and that would give attendees an entry to the drawing. When I found out that attendees would borrow a hole-punch from an exhibitor, punch whatever number of spaces they needed and voila, they were done, I knew we needed to up the ante. Now we make them work for it. Each year I create a new game that attendees participate in to earn their entry into the drawing. We’ve played Monopoly, Jeopardy, Bingo, and last year we created our version of a Poker Run. Attendees have a great time and suppliers love the amount of traffic they receive. How has technology changed the way you plan and market your meetings? (Mobile apps, social media, QR codes, etc.) Over the last several years, technology has made a huge difference in how we handle our conference publicity, registrations and onsite conference handouts. We no longer do a printed conference publicity piece, just electronic versions – which allows us a lot of flexibility, and saves on printing and postage costs. We also use an Association Management Software (AMS) to streamline our online registration process and better manage our attendees’ participation. Two years ago, we added an Association Mobile App. We keep the App updated with association-wide information including our online membership directory, news clips, job lines, etc., and post all conference materials including agenda updates, workshop and committee
