solution for Industry 4.0. The landside supply chain remains largely unconnected, in part because of the multitude of different systems out there. For us, it doesn’t matter if customers work with legacy EDIFACT systems or have API connectivity. We can connect people together, whether they’re carriers, agents, hauliers, ports, shippers, consignees or forwarders, sharing one version of the truth through the blockchain. That transparency means increased health and safety, not just at sea but from load point to quayside, it means everyone being able to speak to each other with the same information, and it means unlocking significant value above and beyond the requirements of the IMO SOLAS legislations.

Dublin – IAM – the Irish team sprang into action to ensure expats and locals alike could enjoy their traditional tipple on the big day. In fact, IAM was put in charge of moving over 30,000 pounds (13,600 kilos) of beer to be sold in Texas in time for the upcoming holiday. The barrels were collected in Ireland and delivered by truck to American’s London Heathrow (LHR) facility. On arrival, the operations team prepared the barrels for flight on one of the airline’s Boeing 777-300 wide body aircraft to Dallas/Fort Worth (DFW). After the plane landed at DFW, a truck connection was organised so that the extra barrels of beer could be on-forwarded to Houston just in time for Saint Patrick’s Day.

Though the recommended timescale for refresher training is not a regulation in itself, be aware that L117, as with any Approved Code of Practice, has special legal status. L117 provides guidance which, if followed, will ensure that you comply with the law. If you are prosecuted for a Health & Safety breach and it’s proven that you didn’t follow the relevant provisions as specified in L117 (or demonstrate that you complied with the law in another way), you will be found at fault by the court and at risk of potential prosecution, fines or both. Cost As with all such IT initiatives, the worry is one of what it will cost, how many bright shiny tin boxes will be needed and the software licences to make them work. The development of the open source software movement means that the vast majority of the software tools required to make these approaches deliver business value are available, on a like for like basis, that is much lower than the combination of licence cost and the annual, double digit percentage costs of support and maintenance that come with proprietary software packages. As these solutions are cloud based, the use of virtual hardware allows commoditized hardware to be brought up securely based in the cloud at a fraction of the cost of traditional approach of having bespoke tin boxes physically delivered to your premises. This approach allows a Proof of Value project to be undertaken for a surprisingly low initial investment and has encouraged more and more forward thinking organisations to dip their toe into the big data lake rather than diving in head first and hoping for the best.

Drivers themselves face fines of up to £2,000 per migrant found on board – even if they have passed through the rigorous checks at Calais. FTA recommends its members sign up to the Border Force Civil Penalty Accreditation Scheme (https://www.gov.uk/ government/publications/civil-penalty-accreditation-schemeaccredited-haulage-companies) to ensure they have effective policies in place – and to offer some mitigation if stowaways are discovered. Driver Tony Henderson, who regularly drives to France for Belfast operator Blair Transport, said he’d recently spotted sleeping bags close to the port and colleagues had witnessed migrants being removed from trucks. His firm has imposed a 50-mile no stopping zone around Calais to try to prevent migrants from getting on board. Six rest areas have now been closed on the A16 and A26, with motorway operator Sanef saying its services will remain shut until at least 30 June. Mr Hookham said,
This means our members will once again become
targets for illegal immigrants. It’s vital that the French authorities provide alternative secure facilities while these areas are closed and, above all, prevent the re-emergence of a Jungle camp.

dangerous driving and for failing to have proper control of the vehicle. Research has shown that driving while talking on the phone makes reaction times worse than driving while under the influence of alcohol – a sobering thought. And it’s not just the driver who is at risk. Employers can also be prosecuted for causing or permitting an offence by providing handsfree kits or calling employees while they are on the road. Mark Cartwright, FTA’s Head of Vans, has been highlighting the risks in a series of briefings to van operators across the country. He created a scenario representing a fatal crash at each event and outlined the consequences for the driver, operations manager and company owner, culminating in a mock court hearing. Operators really need to consider the possible consequences of drivers using mobile phones during their working day, even if they have a policy in place and provide hands-free kits. There is overwhelming evidence that having a phone conversation while driving causes serious distraction, so it’s worth considering a policy of no mobile phone use whatsoever while behind the wheel. Is there anything so urgent that it can’t wait for the driver to pull over? Using mobile phones while driving needs to become as unacceptable as drink driving. Until then we’ll continue to see accidents on our roads where phones are a factor. FTA’s Van Excellence scheme helps operators to adopt industry best practice and raises levels of professionalism in the sector. Expectations have been lowered to a 2.1% CAGR over the next 2 years. In the past, the UK and USA have been considered as close trade partners. With Brexit and the new Trump administration, time will reveal the future trade agreements between these two countries. With regards to transportation, the primary international gateways on the UK trade lane are JFK, ATL, ORD, IAH from an air standpoint (with significant traffic from Aberdeen in the energy vertical) and the Port of NY/NJ for ocean is the key gateway for these international shipments. At Crane Worldwide, the UK offices are completing regular twice-weekly air consolidations to these gateways. Trucking is deregulated from a pricing and tariff standpoint but highly regulated by the Federal Department of Transportation as it pertains to safety, operating hour limitations, etc. ELD (electronic recording devices) to record drivers' hours of services must be implemented by all fleets by December 2017. This is anticipated to drive 3–4% of the current capacity out of the market (active trucks). An issue that may well exacerbate the driver shortage issue that the USA is currently facing. Road transportation companies had a relatively soft year in terms of shipment and tonnage growth with revenue per load/ shipment down across the board – Full Truck Load, Less than Truck Load and Intermodal. FORWARD LAW WITH
O
Jill Headford, Partner, Tozers LLP
n 29 March 2017 the Prime Minister served notice under Article 50 of The Treaty on European Union starting the process of the UK’s departure from the EU. But what
does this mean for employment law? In terms of any immediate change, the answer is not much. Existing EU-derived laws should continue to apply until the UK has formally left the EU. The transition to leave the EU is a process that could take several years. Built within the mechanism of Article 50 is a two year negotiation period for the withdrawal from the EU but in reality it could be significantly longer, particularly given possibility of a different government being installed following the snap-election. Little is known about what will happen if a deal cannot be reached by the end of the two-year negotiation period. A large number of UK employment laws come from the EU such as Working Time Regulations, discrimination laws and drivers hours. The government has announced that it will put the 'Great Repeal Bill' ('the Bill') before Parliament next year. The Bill will repeal the European Communities Act 1972 that currently gives EU law direct effect in the UK. The government has stated that existing EU law will be preserved as far as possible, however most commentators are agreed that there will likely be small changes to existing EU-derived employment laws in order to make them more appealing to UK businesses..

EU. In practice, the UK’s terms of departure could include an ‘amnesty’ allowing individuals to remain in their chosen country until they are able to apply for citizenship. However this could be costly for employers. Migrant workers have become vital to the logistics industry as a result. Drivers from Eastern Europe in particular have done much to fill the skills gap since 2004. After Brexit, if free movement is restricted and replaced by a system of work permits, a shortage of qualified drivers is likely to push up wages, increasing costs and reducing the competitiveness of UK operators. Currently, non-EU members of the European Economic Area (EEA), for example Norway, have adopted most of the EU’s employment laws as part of an economic agreement allowing them to trade with the EU. If this is the future of UK/EU relations, then the effect of the Brexit could be minimal on our core employment rights. However if the UK government opts for a complete revocation of EU employment laws, or if EU negotiations end up being less favourable to the UK than Leave campaigners foresaw, then there could be some very significant changes ahead for both employers and their employees.
