Georgia Legislature recently approved a new Insurance Code section in response to the growing use of Uber and other so-called “Transportation Network Companies” (TNC). TNC drivers use their personal vehicles and make themselves available by logging into the TNC’s digital network with Smartphones. Under the new law, whenever they are logged in but not carrying a passenger, minimum limits of 50/100/50 are mandatory. From the time the driver accepts a ride request until the transaction is completed, $1,000,000 CSL & $1,000,000 UM is mandatory. I chuckled when I read that an endorsement to a driver’s private passenger auto insurance policy would suffice.

Are there any PPAs that would really do that? TNCs may comply by purchasing the policy, either admitted or surplus lines, and notifying the DOI. TNCs must also provide primary coverage in the event the driver’s policy lapses. TNCs also must notify driver’s that coverage may not exist if they use their own PPA and it may violate their agreement with a lienholder.
