President’s Letter
As the Guam Contractors Association looks forward to 2019, we anticipate many opportunities for the construction industry across all sectors of the local economy. Funding for capital improvement projects, incentives for affordable housing, and developments in the tourism industry all contribute to a positive economic outlook for construction in the coming years. The military buildup has already begun and will continue to be a major source of opportunity and revenue for Guam’s construction industry. The FY2019 NDAA authorizes $448.5 million for military construction projects on Guam to support the ongoing progress of the Marine realignment including $75.6 million for X-Ray Wharf Improvements. The law fully authorizes $141 million for a machine gun firing range with half authorized to be spent in fiscal year 2019. FY2019 NDAA builds on authorizations in last year’s NDAA that further extends the exemption from the temporary workforce national cap until Dec. 31, 2023 and provides a provision for up to 4,000 temporary workers for military realignment projects and other related construction projects. In July, Congresswoman Madeleine Z. Bordallo, introduced a standalone bill, H.R. 6480, known as the Guam Temporary Workforce Act, which would give the governor of Guam more control over the temporary labor determination process by providing authority to determine the need for temporary workers in Guam’s civilian labor market. As of 12/12/2018 no related bill information has been received for H.R.6480 - Guam Temporary Workforce Act. With the optimism of a growing economy and the resulting construction work that is expected over the next few years, the U.S. Citizenship and Immigration Service (USCIS) continues to deny or delay H2B petitions for nonmilitary construction projects, despite both a temporary injunction against USCIS and the class-action certification that was granted in GCA’s lawsuit. The preliminary injunction was granted in January 2018 that ordered USCIS to reverse its previous denials of H2B petitions and to stop the denial of future petitions at least until the merits of the case have been decided. Then on March 31, 2018, Chief District Court Judge Frances Tydingco-Gatewood granted class-action certification to the lawsuit, allowing her ruling to apply to other Guam employers filing for H2B petitions but who are not a named plaintiff to the original lawsuit and more recently, GCA has filed a motion in the District Court of Guam asking Chief Judge Tydingco-Gatewood to hold USCIS in contempt and impose sanctions on the federal agency for its continued denial of H2B petitions from Guam employers. We are currently awaiting a response from the judge on that motion. As we continue our litigation to resolve the H2B labor crisis, we ask our members to remain optimistic for a favorable outcome and to please continue to support our effort, not just for the industry, but for the entire community of Guam.

Here are some tips that will help your team understand each other and work together well: See beyond the surface: The old “Don’t judge a book by its cover.” Don’t define a person by what you initially think their personality is; try to learn more about your colleagues and their personalities. Leverage your team’s strengths: Different personalities in an office means different strengths are brought to the table. By taking time to know the members of your team, you can identify those strengths and leverage them when needed. Revise your own style: Changing your style to work better with others is always a successful strategy. An example would be how you communicate with people. You may prefer to communicate via messages or email, but some folks respond better with face to face meetings. The reverse is also true. Doing so will makes it easier to keep tasks or projects moving forward. Remember that you’re on the same team: While team members may have different personalities, don’t forget that everyone is working toward the same goal. Even though a colleague may complete a task in a different way than you would, there is no reason to be at odds. Focus on your priorities and let everything else go; engaging in workplace conflict is rarely productive.

On the off-chance you may be unaware, I am a teacher. I teach 8th grade literature – well, we call it ‘Reading’. In every aspect of teaching, what I have discovered is it is a matter of trying to make the learning accessible for all students. Some students are not the best orators or writers. They might not be good at numbers right off the bat either; or recalling the different layers of the O-zone layer. As educators we are tasked – among other things - with teaching skills and strategies students can hone. Some students are visual and auditory learners. Some of them are just ‘doers’ – of the kinesthetic thread that is open to learning from trial and error. Now, whether you are of the ‘there’s no such thing as learning styles’ party or not; tailoring lessons to multiple intelligences and getting students engaged in a lesson comes with a lot of risk taking. It takes designing lessons in a way that is not just engaging, but something that will stick with them long after they have left your classroom to higher learning or the workplace, or wherever. It is easy to say wherever or whatever now because we live in a world where colleges and universities are not the only options for students. And they should not be. The training is more important in the long-run anyway. If you search keywords on Google, like ‘construction’, ‘training’, ‘hands-on’, and ‘high school’ with a ‘news’ filter, chances are a litany of school-community partnerships pop up. It is not a novel concept. However, what it usually trickles down to is making the material beyond accessible and especially relevant to a student’s learning. Enter the Guam Contractors Association “Construction Warriors” career exploratory event. The event, held at the University of Guam Football Field, had students from throughout Guam Department of Education schools participate and learn from construction industry professionals and practitioners. According to a press release from GDOE, “Construction Warriors was designed to emphasize the safety requirements for construction and the safe use of industry tools and equipment.” Additionally, it built a bridge between the industry and the education system to “provide greater insight into career opportunities in the field of construction.” Science, Technology, Engineering, and Math (STEM) students from 7th to 12th grade were part of this collaborative effort between the Guam Contractors Association and GDOE’s Career Pathway Project,

which coordinates Career and Technical Education (CTE). These courses under CTE help students gain critical knowledge and expose students to different careers beyond graduation. Frank Leon Guerrero and Sylvia Calvo of CTE at GDOE shared that “DOE’s State Strategic Plan Goal #1 is to prepare all students to pursue postsecondary education on- or off-island or to assume gainnful employment within the public or private sector.” Their programs, including the Construction Warriors program, assists in achieving this goal “Career and Technical Education has always been around the education system,” said Leon Guerrero, but he adds in the past it was Technology Education and Vocational Education. The Career Pathway Project itself was born in 2015. In addition to coordination, many educators and counselors were involved in the process of enticing students to participate. Yolanda Pilarca, a counselor at Vicente S.A. Benavente Middle School in Dededo, was part of getting students interested in participating in the workshops. It was not long after one of the monthly district counselor meetings that she jumped on the opportunity to get middle schoolers involved. Pilarca stated, “This event is important because not all students want to go to college or join the military. Exposing them to as many options as possible will give them hope that they will find their place as productive citizens post high school.” Additionally, she added, “They learned that the choice to work in construction is not limited by their gender identity.” What’s really neat about the program though was its ‘not-so-ordinary’ career day demeanor. In the grand scheme things, the contractors who signed up for the event got to work with students and engage them in tools, techniques, and talk about the industry. Part of the event also included group projects at each workshop, which got students’ – with supervision, of course – hands in there to work. These included workshops in carpentry, electrical, plumbing, masonry, safety, welding, architectural and engineering, heavy equipment operations, and HVAC and Refrigeration.
He added, “the students were excited about learning about the different opportunities in construction and working outside.” He added, “The students were also curious as to how much they can make doing different jobs and…if our careers were satisfying.” In Guam, the construction industry is on the cusp of some of the biggest construction projects this region has ever seen with the buildup. Yet, we are still experiencing a lack of trained and certified construction workers locally, which forces us to look elsewhere. Conversely, this program does not just give a small push, it immerses students in the possibilities of an industry that they can strengthen and ‘build’ right here at home. “I think it is an important program because there is a need for skilled workers in the construction industry in Guam,” Pilarca stated. “Students as young as middle school age should be exposed to the possibilities of career choices.” “I enjoyed the opportunity to work with the students and tell them things that I wish someone would have shared with me as a high school or middle school students,” Fountain revealed. “The more students can experience and learn about different construction trades will help them make a better decision when it comes to choosing career paths,” he finished. What could this mean for the future of learning? What about the industry? More than anything, while continuously striving and looking for relevance and practical use of classroom skills for the workforce of the future, it is not only important – it might be time to look at more opportunities to incorporate real world application in the classroom. A-plus for effort!
Thomas Fountain of Hensel Phelps explained how his workshop was about surveying and how they’ll be building a hangar for the military. “We thought it would be a good idea to give the students a set of drawings with a smaller scaled down version of the actual hangar,” he said. “They had to figure out different angles and dimensions based on the drawings we provided.” Afterward, they laid out the building corners of the hangar and did checks to verify correct locations. “It was nice to hear the students talking about the math that they were learning and how they can apply formulas to real life problem solving,” Fountain expressed.

OSHA Issues Final Rule on Crane Operator Qualification On Nov. 9, the Occupational Safety and Health Administration published a final rule that updates its standard for cranes and derricks in construction to ensure crane operators are qualified to safely operate equipment. The final rule requires employers to train operators as needed to perform assigned crane activities, evaluate them and document successful completion of the evaluations. OSHA clarifies that employers who have already evaluated their operators prior to Dec. 9, 2018, will not have to conduct those evaluations again, but will need to document when they completed the evaluations. The rule also requires crane operators to complete certification and receive ongoing training as necessary based on the crane’s type and capacity, or type only, revising a provision of the 2010 rule that specified that crane operator certification must include rated lifting capacity. The final rule, with the exception of the evaluation and documentation requirements, will become effective on Dec. 9, 2018. The evaluation and documentation requirements will become effective on Feb. 7, 2019. REMINDER: OSHA issued guidance on Nov. 5 detailing how employers should comply with crane operator certification requirements until OSHA’s new final rule on operator certification and qualification becomes effective. Construction Employment Picks Up in October, Says ABC by: Rachel O'Grady The U.S. construction industry added 30,000 net new jobs in October, according to an analysis from the Associated Builders and Contractors of data from the U.S. Bureau of Labor Statistics. The industry has added 330,000 net new construction jobs over the past 12 months, a 4.7 percent increase. Additionally, nonresidential construction employment grew by 13,500 net new jobs in October, with job growth split evenly between the heavy and civil engineering subsector (+7,100) and nonresidential specialty trade (+7,500). Construction unemployment dropped to 3.6 percent in October, 0.5 percentage points lower than the previous month, and 0.9 percentage points lower on a yearly basis. National unemployment, which reached a 49-year low last month, remained unchanged at 3.7 percent. “The fact that the U.S. economy is performing well is hardly a secret,” said
ABC’s Chief Economist Anirban Basu. “Therefore, today’s employment numbers may not seem especially newsworthy. They confirm in large measure what we already know. We know that many private employers continue to view the current period as a good one for enterprise expansion. We know that household finances are in good shape, which helps support overall economic growth as well as growth in certain sectors, such as hospitality and retail trade. We also know that workers remain in high demand and that for many businesses, the greatest challenge is securing sufficient levels of human capital. “Still, today’s report supplies some new insight into U.S. economic dynamics,” said Basu. “2018 may very well be remembered as the year that infrastructure investment roared back in America. The September nonresidential construction spending numbers confirmed massive increases on spending related to water supply, flood control and transit over the past year.
Today’s employment release reveals that the heavy and civil engineering segment added another 7,100 jobs last month and has added 52,000 jobs over the past 12 months. This is consistent with ongoing growth in spending on public works and is attributable to a number of factors, including rebuilding from catastrophes that have occurred during the past two years. But this is also a reflection of significantly improved state and local government finances as the recovery works through its 10th year. “Given elevated backlog, the expectation is that demand for construction workers will remain elevated,” said Basu. “One potential cause for concern is growing evidence that wages have begun to rise much more rapidly of late.
